Editorial Hola, lectores del residente, bienvenidos a la edición de octubre de su periódico local favorito. Bueno, tengo que empezar este mensaje con el viejo adagio “¡ten cuidado con lo que deseas!” Fue solo el otro día cuando comenté a un amigo que sería bueno un poco de lluvia después del largo verano. Bueno, sí que hubo lluvia, de lo que la buena gente de Marbella, Alhaurin, Monda y Málaga pueden atestiguar. Pero tenemos que simpatizar con los ciudadanos de Mallorca que sufrieron catastróficas inundaciones repentinas en las que varias personas perdieron la vida. De todos modos, las cosas han vuelto a la normalidad y ha salido el sol, pero la limpieza continúa mientras la imagen de la portada, tomada por el fotógrafo local Martin Urch, demuestra que hay mucho trabajo por hacer: esta es la playa de Sabinillas, que está cubierta con cañas de los lechos arrancados de las cercanías de los ríos por los torrentes. Ahora que el verano ya se acabó, se ha comenzado a prestar atención a las elecciones locales del consejo municipal que se celebrarán el domingo 26 de mayo de 2019. Con la escena política española en un estado de flujo constante, será interesante ver cómo se acaban configurando las cosas. Un tema que merece un atento seguimiento.. Finalmente, alguna información sobre nuestras fechas de publicación. Al acercarse la Navidad, hemos cambiado nuestra publicación a mediados de mes, lo que también nos impide entrar en conflicto con otras publicaciones mensuales y evitar la duplicación de contenido. www.theresident.eu Hi Resident readers, welcome to the October issue of you favourite local paper. Well I have to open this message with the old adage ‘be careful what you wish for’! It was just the other day when I passed the comment with a friend that we could do with a bit of rain after the long summer. Okay, so we certainly had plenty of it as the good people of Marbella, Alhaurin, Monda, and Malaga can attest to. But we have to sympathise with the citizens of Mallorca who suffered catastrophic flash floods in which a number of people lost their lives. Anyway things have returning to normal, and the sun is out, but the clear up continues as our front cover image, taken by local photographer Martin Urch shows there is a lot to clear up - this is the beach in Sabinillas which is covered with canes ripped out of the river beds by the torrents. Now that the summer is out of the way attention has begun to turn to the local municipal council elections which will be held on Sunday 26 May 2019. With the Spanish political scene in a constant state of flux it will be interesting to see how things shape up. Watch this space. Finally, some information on our publication dates. With Christmas approaching we have shifted our publication to the middle of the month, this also prevents us from clashing with a number of other monthly publications and avoid duplication of content. best regards Gary Beaumont Editor

Who is really in charge of the Community?
I
t would appear that the President and the Administrator run the Community, however according to the Horizontal Property Act, it’s the General Meeting that is at the top of the pyramid. Communities are supposed to be Democratic – so all owners are supposed to decide what type of Community they want at the meetings, and the President and the Administrator have to legally abide by these decisions. The GM is a meeting that is held at least once a year (AGM or EGM) and to which all owners are invited, but most choose not to attend, for whatever reason. These meetings are to decide on everything to do with the Community, monies, works, legal actions, etc. By not going, you are leaving the Community’s decisions to someone else. At the end of the day, if you live in a community with 100 properties and only 3 people attend the meeting, that means that only 3 people will decide what happen’s and if you didn’t attend the meeting then you don’t have a say. The GM will choose a President and an Administrator, and it is these two figures who have to carry out the decisions made by owners. They have to make sure all the services are provided within the expected budget and make sure the Community is maintained to the required standard. They do have a capacity to make decisions
in the best interest of the Community as a whole, however they do not have ‘carte blanche’. The law establishes what decisions need to be made at a GM and the majorities needed to carry these out. For example, the President can’t decide to hire security if not included in the yearly budget, this would require a 3/5th vote at a GM and he can’t increase or reduce the fees without a majority vote at a GM and so on. But he can decide to repair the roof if there is a leak without asking the GM, what’s more, he HAS to carry out the repair even if the community does not have the finances to pay for it. Now the problem comes when decisions are made in a Community by the person ‘in charge’ that have not been approved at a GM and owners do not agree with, who’s responsible now? The only person who is a professional in Community Administration and who has to be aware of all the current legislation is the Community Administrator. Who has the legal obligation to advise the President on what decisions to make to comply with the law. If the President makes a decision that is detrimental for the Community and there are legal or financial consequences, then he would be liable. But, if you have a Chartered Community Administrator then their legal responsibility is to advise you. If you have been wrongly advised then the Administrator would be liable and all
Chartered Administrators have a Professional Indemnity Insurance to cover them in the event. The problem comes when the Administrator is not Chartered and there are a lot of ‘cowboy administrators’ in our area. If there is a considerable issue they will just wipe their hands and then it’ll be ‘see you in court’ and we all know this can take forever. With this said each Community is unique, make sure that the President is in it for the right reasons and that you have the right Administrator for the Community. The General Meeting is only held 1 day per year, so your President and Administrator are in charge for 364 days. Participate in the meeting when it comes up as you are an owner in the Community and you only have 1 chance per year to talk about your home and investment, so please don’t waste it! ¿Quién está a cargo de la Comunidad?
T
odo el mundo piensa que el Presidente y el Administrador son quienes dirigen la Comunidad, sin embargo, según la Ley de Propiedad Horizontal, es la Junta General (JG) quien está en lo alto de la pirámide. Se supone que una Comunidad es democrática, es decir, que todos los propietarios deciden qué tipo de Comunidad quieren, en una Junta, y el Presidente y el Administrador deben hacer cumplir estas decisiones. Una JG es una reunión que se celebra al menos una vez al año (JGO o JGE), al que se invita a todos los propietarios, pero la mayoría decide no ir, por diversas razones. Estas reuniones son para decidir todo lo que ocurre en la Comunidad, que pasa con el dinero, los trabajos a realizar, acciones legales, etc. Al no ir, estás dejando esta decisión en manos de otra persona. Si vives en una Comunidad de 100 propiedades y solo 3 van a la Junta, esto significa que solo 3 personas deciden que pasa en la Comunidad y si no vas a la junta entonces no tendrás voz en los asuntos de tu comunidad. La JG elige al Presidente y al Administrador, son estas dos personas quienes han de cerciorarse de que se cumplan las decisiones tomadas por los propietarios. Ellos son quienes deben asegurarse de que se cumplan todos los servicios dentro del presupuesto acordado y
asegurarse de que se mantenga la Comunidad al nivel requerido. Tienen la capacidad de tomar decisiones en el interés de la Comunidad, pero no tienen carta blanca. La Ley establece que decisiones se deben tomar en una JG, y las mayorías cualificadas para cada decisión. Es decir, el Presidente no puede decidir contratar Seguridad en una Comunidad donde no estaba incluido en el Presupuesto anual, ya que esto requeriría una aprobación de 3/5 partes en una JG, ni puede subir ni bajar las cuotas de los vecinos sin una aprobación por mayoría en una JG. Pero sí puede decidir reparar el tejado si hubiera una filtración de agua sin pedir permiso a la JG, lo que es más, es su OBLIGACIÓN realizar esta reparación, incluso si la comunidad no tiene dinero para hacerlo. El problema llega cuando las personas que están a cargo toman decisiones en la Comunidad que no hayan sido aprobadas por una JG y con los que los propietarios no están de acuerdo, quién sería responsable si fuera perjudicial para la Comunidad? El único profesional en este campo es el Administrador de Fincas Colegiado. Este es quién tienen la obligación legal de asesorar al Presidente sobre las decisiones a tomar para cumplir la ley. Si el Presidente toma una decisión perjudicial para la Comunidad y hubiera consecuencias legales o económicas, él sería responsable.
Pero, si el Administrador de tu Comunidad es colegiado, entonces tiene el deber legal de asesorarle. Si el asesoramiento no ha sido correcto, entonces tiene un Seguro de Responsabilidad Civil Profesional que cubriría este error. El problema es cuando el Administrador no está colegiado, y hay muchos no profesionales en nuestra zona. Si hubiera un problema, entonces podrían intentar limpiarse las manos del asunto y tendríais que verlo en el juzgado, y todos sabemos cuánto puede tardar eso. Dicho esto, cada Comunidad es única, así que debéis aseguraros de que el Presidente ocupa el cargo por las razones correctas y que tenéis el mejor Administrador para vuestra Comunidad. La Junta General solo se celebra 1 día al año, así que serán estas personas quienes dirijan la Comunidad durante los restantes 364 días. Participad en la Junta cuando se celebre ya que eres un propietario en la Comunidad, y solo tienes esta oportunidad una vez al año para hablar de tu hogar y de tu inversión, no lo desperdicies! Love to Sing Choir raises 800 euros for Estepona firefighters

They performed to a packed audience, even having to turn people away, and were praised with two standing ovations and raised a total of 800 euros for the Estepona Fire Service. The Choir are welcoming new members not only for
the future but to join in time for their Christmas repertoire of Christmas carols and they will be staging performances from Manilva to Fuengirola. Casares celebra la II Ruta Casares celebrates the Second ‘Recoveras’ de las Recoveras el próximo Route on Saturday, October 27 The registration period to take The complete route between Memorial or email turismo@ sábado 27 de octubre Desde el 5 al 22 de octubre está abierto el plazo para inscribirse en la segunda Ruta de las Recoveras, que rememora el recorrido a pie, desde Casares a Gibraltar, que hacían en la posguerra muchas mujeres para adquirir productos de ultramar que vendían o cambiaban para poder sobrevivir. La ruta completa entre Casares y la frontera de Gibraltar tiene una distancia de 49 kilómetros. La salida tiene lugar a las 6 de la madrugada del sábado 27 de octubre desde Casares y está prevista la llegada a la Verja sobre las 18.00 horas. Los participantes podrán optar entre realizar el recorrido completo o volver tras finalizar el primer tramo de 15,8 Kilómetros desde Secadero, o el segundo de 39,8 kilómetros desde El Toril en San Roque. Desde el Ayuntamiento de Casares se va a disponer autobuses al final de cada tramo para que los senderistas puedan regresar a Casares. Las inscripciones son gratuitas para los adscritos a la Federación de Senderismo y tiene un coste de 5 euros para no federados que serán para gastos del seguro. Pueden realizarse en la Casa Natal de Blas Infante o a través del correo electrónico turismo@casares.es presentando justificante de pago en la cuenta del Ayuntamiento de Casares (ES 35/2103/0122/6500/3000/3828 de Unicaja) o adjuntado licencia federativa de senderismo. Casares and the Gibraltar border is 49 kilometers long. Departure time is 6 am on Saturday October 27th from Casares and is scheduled to end at the border at 6 pm. Participants can choose between completing the full route or returning after finishing the first section (15.8 kilometers from Secadero) or the second section (39.8 kilometers from El Toril in San Roque). Buses will be provided by the Casares Town Hall at the end of each section so that participants can return to Casares. There is no sign up fee for members of the Hiking Federation, but there will be a 5 euro fee for everyone else to cover insurance costs. To sign up, participants must go to the Blas Infante

The Asociación de Vecinos y Amigos de Marina de Casares held a very successful Macmillan Coffee Morning at their new premises. They had many donations of delicious cakes and goodies, plus many prizes for the raffle and tombola. The room was packed for about 3 hours and people were very generous. So far they have raised about 970 euros, a wonderful result for Macmillan. A very big thank you to everyone and anyone who helped in any way to achieve this. They held had their first Quiz Night in the new premises as well as a Film Night. There was a good number at the monthly lunch, this time at La Choza.
Art classes have begun on Wednesday mornings and card craft classes will begin again in November on Friday mornings, both between 11am and 1pm. A member of the Committee will be present at their club house next to the back entrance of the Sabinillas Bookshop, on Wednesday and Friday mornings between 11am and 12 noon to take subscriptions, answer any questions about the Club, etc. They are looking for new members and would be pleased to welcome you.

El II Concurso de Monólogos Villa de Casares ya está en marcha. Un evento que, según la concejala de Cultura Rocío Ruíz se organiza de nuevo gracias a la aceptación del público que tuvo el pasado año, ya que era una petición que hicieron los vecinos en los Primeros Presupuestos Participativos, pidiendo la realización de eventos culturales de esta índole, con lo que funcionó muy bien en cuanto a participación . El certamen se celebrará el 1 de diciembre en el Centro Cultural
Blas Infante. Aún no se ha abierto el plazo de inscripción de los participantes, pero las bases persiguen continuar en la misma línea, con monólogos originales, y en los que cada participante debe entregar una grabación de sus trabajos previos o un enlace web, así como un currículum con su trayectoria humorística. El Jurado, que se está configurando estos días, evaluará las grabaciones para seleccionar los participantes, que estarán en torno a la decena para que
el espectáculo del día 1 tenga un formato ágil y no demasiado extenso. El Certamen contará con un premio de 1.000 euros para el ganador, otro de 300 para el primer finalista y un galardón del público de 200 euros. La iniciativa pretende impulsar la vida cultural, de ocio y tiempo libre de nuestro pueblo, tal y como ha explicado la edil de Cultura Rocío Ruíz. Casares suma así nuevas iniciativas culturales, en esta ocasión a través del mundo del humor y la interpretación.

En estos momentos, las brigadas operativas están realizando trabajos para reorganizar el tráfico en la zona de Huerta Nueva, concretamente en la calle Celestino Prieto, donde se están creando quince nuevas aparcamientos para coches y unos diez destinados a motocicletas. Para conseguir esta optimización del espacio se ha trabajado en uno de los laterales de la calle donde se ha pasado del estacionamiento en línea a batería en oblicuo. Además, se está procediendo al ensanchamiento de las aceras en los tramos donde se ubican los pasos de peatones, con la intención de dar mayor visibilidad y mejorar la seguridad de los viandantes. Una vez finalice esta actuación, esta vía que era de doble sentido pasará a ser de único sentido, con entrada por las calles Carlos Cano y Huerta Nueva y salida a Cristobal Ruiz Méndez. De la misma forma, el Consistorio está trabajando también en la calle Gabriel Celaya, donde se ha convertido una explana de tierra en una zona de estacionamiento para una decena de vehículos.
Aquí los trabajos han consistido en cubrir la superficie de tierra con hormigón impreso, la señalización de las plazas y la instalación de sumideros para evacuar el agua de la lluvia. También se han eliminado barreras arquitectónicas y se han plantado once moreras. Junto a esta, se crearon 40 nuevas plazas de aparcamiento con la creación de un nuevo vial junto al pabellón deportivo Ramos Cazorla. Asimismo, también se habilitaron otros 40 estacionamientos en la calle Ortega y Gasset. Además, el Ayuntamiento continuará con estas actuaciones puntuales en otros lugares del municipio, con la intención de facilitar el mayor número de estacionamientos a los usuarios, siempre y cuando las condiciones de las vías lo permitan. En próximas fechas el Consistorio actuará en otro área de Estepona, concretamente en la calle Juan Gris que está situada en pleno centro urbano. Asimismo, el Ayuntamiento también está aprovechando los nuevos proyectos que se van ejecutando y las nuevas infraestructuras que se van creando, para dotar a la ciudad del mayor número de aparcamientos gratuitos. Dentro de este plan municipal, destacan los 130 nuevos
estacionamientos que se habilitaron en las zonas de La Lobilla y Huerta Nueva, tras la ejecución de obras de urbanización en ambos enclaves. También cabe recordar que el Ayuntamiento acondicionó el pasado año una parcela junto a la avenida San Lorenzo, en pleno centro urbano, como aparcamiento público para más de 140 plazas. Esta zona de aparcamiento gratuito está gestionada por la Asociación
Prodiscapacitados Psíquicos de Estepona (APRONA) Asimismo, se crearon medio centenar de plazas en el entorno de la plaza de toros; 180 nuevos aparcamientos en la zona de La Cala; 107 en la zona de Parque Central; 105 en el entorno del Parque Botánico-Orquidario; 76 en La Lobilla, 80 en el entorno del estadio San Fernando; 36 en la calle Ortega y Gasset; 20 en la calle Espronceda y 20 en la calle García Olmo.
Por otro lado,hay que recordar que el Ayuntamiento ha construido un parking en la céntrica plaza Antonia Guerrero con el precio de un euro al día, por él que sólo en el primer mes de funcionamiento pasaron 15.000 vehículos. A éste habría que sumarle las más de mil plazas con las que contará el aparcamiento subterráneo que está construyendo el Consistorio bajo el futuro estadio de Atletismo.

Guerrero ha añadido que, tras comprobar que el sillón se corresponde con la documentación del archivo, se ha consultado información sobre Luis José Robledo -tanto del Archivo Histórico Nacional como del Archivo General de Simancas-, relativas al nombramiento de corregidores. Así se ha descubierto que Estepona, independiente desde 1729
sido gobernada desde esta fecha por alcaldes, vecinos del pueblo, hasta que en 1760 se decidió nombrar un Corregidor de Letras, con sede en Estepona y con un salario de cuatrocientos ducados anuales. El nombramiento recayó en la persona de Luis Robledo, quien tomó posesión de su cargo en enero del citado año. El edil de Patrimonio ha afirmado que este hallazgo se suma a los muchos otros que han ido apareciendo gracias a la remodelación del casco histórico. En este sentido, ha recordado la pintura mural del siglo XIX que se descubrió recientemente en un edificio de la plaza de las Flores. Esta pintura ha permitido locali-

The appointment fell to Luis Robledo, who took office in January of that year. This finding adds to the many others that have been appearing thanks to the remodeling of the historic town center. Previously a nineteenthcentury wall painting was discovered in a building in the Plaza de las Flores. This painting has allowed officials to locate the exact situation of the Town Hall in that era inside the square.

El Orquidario de Estepona aumenta un 10% sus visitas durante el verano con relación al año pasado El Parque Botánico-Orquidario ha incrementado un diez por ciento el número de visitas en este verano con relación al año pasado, lo que indica que cada vez son más las personas que nos visitan que se interesan por el apasionante mundo de las orquídeas. Durante el último año han florecido especies muy singulares que, sin duda, han conseguido dar más prestigio al Orquidario como la floración de diversas especies de Stanhopea, algunas de ellas con una duración de apenas dos días. El Orquidario de Estepona es ya el mayor Orquidario de España y es uno de los más importantes de Europa con sus más de 1300 especies y unos 5000 ejemplares de orquídeas que contiene en su interior. Durante la pasada semana el Curator del Orquidario de Estepona, Manuel Lucas, presentó la singularidad del Orquidario de Estepona en un ciclo de conferencias organizadas por la Universidad de La Laguna en el Parque Botánico de las Pirámides de Güímar (Tenerife) destacando en ella la importancia para

Para el orquidario de Estepona es muy importante estar presente en las exposiciones más importantes del sector que se celebran en toda Europa.
De esta manera el Parque Botánico Orquidario de Estepona ha estado presente en exposiciones en Lisboa, Polonia, Alemania y ahora también en Francia. Este equipamiento se ha convertido en una de las atracciones más visitadas de la ciudad. Los empadronados en Estepona tienen dos entradas gratuitas al año que podrán recogerse en las oficinas del Ayuntamiento en el edificio Puertosol o en la antigua Casa Consistorial, ubicada en la plaza Blas Infante, enseñando el DNI.

El Ayuntamiento inicia la plantación de más de 200 palmeras en las céntricas avenidas El Carmen y Juan Carlos I El Ayuntamiento de Estepona ha puesto en marcha una actuación de mejora de jardinería en las avenidas El Carmen y Juan Carlos I con la plantación de más de 200 palmáceas. El concejal adscrito al área de Parques y Jardines, Sergio Rodríguez, ha explicado que en la avenida de El Carmen se contempla la plantación de trachycarpus (palmeras mediadas) y palmitos. Por su parte en la avenida Juan Carlos I se van a plantar copernicias, butias, palmitos, bismarkias y dionis. Además, en esta céntrica avenida se colocarán una decena de palmeras de gran porte en el perímetro de la nueva rotonda que se ha creado en esta avenida y que cuenta con una gran fuente con juegos de luces y agua. Esta actuación se une a la que se llevó a cabo el pasado mes de septiembre en las avenidas Puerta del Mar y San Lorenzo con la colocación de plantas de flor como tajetes amarillos y naranjas, zinias de varios colores, celosías rojas y lampranthus.
El proyecto Estepona, Jardín de la Costa del Sol se ha convertido en una seña de identidad de la ciudad y,por tanto, el cuidado de los jardines públicos es una prioridad para el equipo de gobierno. En este sentido, Rodríguez ha destacado que el Consistorio realiza varias plantaciones al año de flores de temporada y, además, actuaciones puntuales como esta para que los jardines públicos luzcan siempre su mejor aspecto. Hay que recordar que el Ayuntamiento trabaja en la plantación de flores y otras especies sino y también en el diseño de los parques y jardines públicos para conseguir un mayor atractivo visual que capte la atención de los ciudadanos. Remodelación de la Plaza de Los Se reanuda el programa Forma-T con interesantes Baños en el Castillo cursos

l concejal de Infraestructura y Obras, Antonio Barragán, se ha personado en la obra que se está acometiendo en la plaza de los baños romanos en el Castillo. Fue adjudicada a la empresa Gestiona Innovación Andaluza
S.L. por un importe de 36.886,00€ + IVA. Las actuaciones a ejecutar consisten en la remodelación de dicha plaza, se sustituirá la actual fuente por jardineras revestidas que albergarán árboles y elementos marinos decorativos.
Según comentó Barragán: "el Castillo es uno de los lugares más atractivos y singulares del municipio y mejorarlo entra dentro de nuestras obligaciones tanto para los vecinos como para los visitantes", apuntó.

Presentado el nuevo proyecto del Club Deportivo Manilva Basket Base
El PabellĂłn municipal de Las ViĂąas fue el escenario de la presentaciĂłn del nuevo proyecto del Club Deportivo Manilva Basket Base para la temporada 2018/19. Ante el numeroso pĂşblico asistente el Club manilveĂąo presentĂł a las cinco plantillas que este aĂąo participarĂĄn en las ligas provinciales, asĂ como a sus entrenadores y patrocinadores. En los momentos previos, tambiĂŠn se hizo entrega de la nueva indumentaria que los jĂłvenes llevarĂĄn durante el nuevo ejercicio. Una nueva imagen que ha sido destacada por su presidente Rafael Mena. En este acto estuvieron tambiĂŠn presentes el alcalde de Manilva, Mario JimĂŠnez y el primer teniente de alcalde, Antonio BarragĂĄn.
Todos tomaron la palabra para dirigirse al pĂşblico presente, mostrando el apoyo del equipo de gobierno al CD Manilva Basket Base. AgustĂn Vargas, que por motivos personales no pudo acudir al acto, trasladĂł tambiĂŠn este sentir al baloncesto local a travĂŠs de sus compaĂąeros. Cabe destacar que en esta ocasiĂłn son 53 comercios locales los que se han volcado con este nuevo proyecto, demostrando una vez mĂĄs el apoyo de los empresarios de nuestro municipio al deporte local. Todos coincidieron al destacar el trabajo de la directiva del Club, los familiares y por supuesto, el esfuerzo de los casi cien jĂłvenes que forman parte de esta gran familia.

Una aĂąo mĂĄs, Javier MontaĂąez, serĂĄ el encargado de dirigir a los mĂĄs pequeĂąos. Junto a Francisco Candiles, llevarĂĄ las riendas de los equipos preminibasket, minibasket de primer aĂąo y minibasket de segundo aĂąo. Por su parte,JosĂŠ AndrĂŠs GonzĂĄlez, se harĂĄ cargo de los equipos junior y cadete masculinos, que serĂĄn los primeros en debutar esta temporada los dĂas 20 y 21 de octubre, respectivamente. El acto finalizĂł con la foto de todas las plantillas del Club que, a buen seguro, nos darĂĄn muchas alegrĂas a lo largo del curso.

Presenting Club Deportivo Manilva Basket Club The Municipal Pavilion of Las ViĂąas was the scene for the presentation of the new project of the Manilva Basket Baseball Club for the 2018/19 season. Before the large audience, the ManilveĂąo Club presented the five squads that this year will participate in the provincial leagues, as well as their coaches and sponsors. In the previous moments, the new clothing that the young people will wear during the new exercise was also delivered. A new image that has been highlighted by its president Rafael Mena. In this act were also present the mayor of Manilva, Mario JimĂŠnez and the first deputy mayor, Antonio BarragĂĄn. Everyone took the floor to address the audience, showing the support of the government team to the CD Manilva Basket Base. It should be noted that on this occasion there are 53 local businesses that have supported this new
project, demonstrating once again the support of entrepreneurs in our municipality to local sport. They all agreed to highlight the work of the Club's board of directors, the relatives and, of course, the effort of the almost one hundred young people who are part of this great sporting family. This sports club, has teams in the prebenjamin, first and second year minibasket, cadet and junior. One again, Javier MontaĂąez, will be in charge of directing the youngsters this year. Together with Francisco Candiles, he will lead the reins of the preminibasket, first-year minibasket and second-year minibasket teams. Meanwhile JosĂŠ AndrĂŠs GonzĂĄlez will take charge of the junior teams and male cadets, who will be the first to debut this season on October 20 and 21, respectively. The event ended with a photocall of all the Club's staff that, surely, will give us many triumphs throughout the course of the season.

III Ateneo Awards in collaboration with the St George Charity On Thursday 11 October the theatre at the Civima Wine Centre in Manilva hosted the III Ateneo Awards. Organised by the Ateneo Cultural Association and the Duquesa Charitable Society of St George in collaboration with Manilva Town Hall's Culture department and the local company Servygilancia Metropolitan, the awards are presented to local youngsters who have excelled in the arts including: Music, Painting and Drawing, Literature, Theatre, along with other members of the local community that have made a contribution to arts and culture in Manilva and an overall artist of the year. Music will be provided by members of the Manilva School of Music, singer Ranya Ksiri, and singer/guitarist Manolo Bรกez.

RECLAMACIONES DE DAÑOS CONTRA LA COMUNIDAD DE PROPIETARIOS
L
as Comunidades de propietarios son responsables civiles de los daños que causen a terceros o incluso a sus propios comuneros, derivados del mal funcionamiento o negligencia en el cuidado de sus elementos comunes. Con carácter general se consideran elementos comunes, las antenas y sistemas de comunicaciones, ascensores, azoteas o cubiertas, calefacción, cerramiento de zonas comunes de edificios o urbanizaciones, cimentaciones, conducciones y canalizaciones, corredores y pasillos, elementos de cierre y revestimientos exteriores, elementos estructurales (el art.396 CC, tras hablar en general de elementos estructurales, enumera en concreto los pilares, vigas, forjados y muros de carga). Su regulación fundamentalmente de todo lo concerniente a las comunidades de propietarios, se encuentra en la Ley de propiedad Horizontal. La comunidad de propietarios ha de guardar siempre las garantías y procurar que sus elementos constructivos estén en perfecto estado de conservación. Así lo dispone la Ley de Propiedad Horizontal (LPH) en su art.
10 cuando establece que la Comunidad de Propietarios está obligada a la realización de las obras necesarias para el adecuado sostenimiento y conservación del inmueble y de sus servicios, de modo que éste reúna las debidas condiciones estructurales, de estanqueidad, habitabilidad, accesibilidad y seguridad. Si como consecuencia de la no realización de las obras imprescindibles de mantenimiento de los elementos comunes, se produce un daño a una persona o a alguna vivienda, la comunidad puede ser responsable civilmente, pero también podría responder bien directa o indirectamente el Administrador o Presidente que no tomaran las medidas adecuadas para el correcto sostenimiento de las obras de reparación urgente, cuando exista constancia de que la no reparación puede causar un perjuicio a un tercero. Si la Comunidad de Propietarios no cumple con las obligaciones que establece el citado precepto y se producen daños, hemos de distinguir dos supuestos dependiendo del perjudicado:
1. Puede ser un comunero. Por ejemplo, si se produce una avería en un bajante comunitario y las agua revierten y causan daño en elementos privativos de una vivienda de un comunero, si se producen filtraciones de aguas de lluvia desde una terraza comunitaria o fachada comunitaria o en el caso que se encuentre rota o mal conservada la solería del portal de la comunidad provocando una caída de uno de los comuneros. En estos casos podrán interponer una reclamación por daños contra la Comunidad en base al citado art. 10 LPH. 2. Si el perjudicado es un tercero, ajeno a la Comunidad y por tanto a las interrelaciones que nacen dentro del régimen de la propiedad horizontal, la acción se incardinaría dentro de la culpa extracontractual, donde el plazo de prescripción para reclamación por daños contra la Comunidad es de UN AÑO desde la existencia de los daños. DAMAGE CLAIMS AGAINST A COMMUNITY OF OWNERS Communities of Owners are civilly liable for damages caused to third parties or even members of their own community. When these damages are derived from the malfunction of community owned items or where there has been negligence in the care of community property. In general, community property could be any of the following; antennas and communication systems, elevators, roof terraces, roofing, heating installations, enclosures of common areas, buildings or urbanizations, foundations, pipes and ducts, corridors, locks, external coverings, structures, (Article.396 CC, lists in particular pillars, beams, slabs, and weight bearing walls). The regulations which govern Communities of Owners can be found in the Horizontal Property Law. Communities of Owners must always maintain the guarantees and ensure that all common constructions and areas are in perfect condition. Article.10 of the Horizontal Property Law (LPH) establishes that the Community of Owners is obliged to carry out the necessary works to sustain the proper maintenance and conservation of the property and its services, so that it meets the necessary structural, habitability, accessibility, safety and security conditions. If damage to a person or to a dwelling occurs as a result of neglect to maintain the common installations, areas, or property in perfect condition, the Community of owners can be held civilly responsible, but the Community President or administrator could also be directly or indirectly responsible. They are required by law to take the appropriate measures to ensure that no harm can occur to a third party by ensuring any urgent repair works, or maintenance is carried out immediately when there is evidence that the lack of maintenance could cause harm to a third party or dwelling. If the Community of Owners does not comply with the obligations established in the Article.10 of the Horizontal Property Law (LPH) and damages do occur, we cite two cases to demonstrate the difference in claims depending on the affected party 1. 1. – If the affected party is an owner in the community and falls due to inadequate maintenance by the Community of Owners i.e. a broken tile or poorly preserved community entrance floor, or if damage is caused to their property due to a leaking community drainpipe, a leak from a community terrace, or a leak from a community façade, they should file a claim for damages against the Community based on Article. 10- LPH. 2. If the affected party is a third party, i.e. not an owner inside the community, the method of reclamation from the community is governed by different criteria and the period for a claim is limited to ONE YEAR FROM THE DATE OF THE DAMAGE OR INJURY Therefore, if you have problems with a Community of Owners, it is important to have an expert lawyer to advise you and manage your claim, to protect your rights and to be able to obtain full compensation for the damages caused. Estepona Floral Art Club’s new season had a fantastic start last month when Nicky Heal visited. He showed Club members lots of different ideas for weaving and winding plant material. A great afternoon and the Club are looking forward to another wonderful afternoon in the company of this months demonstrator Caroline Jackson. Caroline, from the North Midlands, has been demonstrating since 2004. In her role as the NAFAS Press Officer she spent the whole week at the Chelsea Flower Show where she met one of the members of Estepona Floral Art Club and she was in Barbados for the World Flower Show last year. Caroline is also part of the Botanical Engineers, a different approach to flower arranging which she may share. Caroline's demonstration is on Tuesday October 16 and will start promptly at 3 o'clock, at Agrojardin, Cancelada. Members fees are due for the new
programme, please note this is the last month annual membership is available this year. Caroline is supporting the 'Wear it Pink' campaign in aid of Breast Cancer, and has asked that if possible people wear something pink for the demonstration. The flower Club will be donating a euro for every person who attends the demonstration. Demonstrations are an enjoyable afternoon of live entertainment where you can appreciate the beauty of flowers, pick up lots of hints and tips on all aspects of floral art, gardening and plant information. water kiosk in Sabinillas proves a great success
S
abinillas now boasts a new ‘Casa de Agua’ a water vending kiosk, where the public can purchase still and sparkling water in 500 ml; 1 litre; and 1.5 litre measures. Installed by the Italian company Ecozona, which has over 6 thousand such kiosks throughout Italy, this is the first permanent kiosk to be installed in Spain, although the company does
provide mobile units for large events, music festivals, etc. The kiosk takes water from the public water supply and passes it through a stringent filtration system before being delivered, nicely chilled at the vending point. The system is designed with public health at the forefront, all the tubes, and outlet nozzles are automatically sterilised, after 15
minutes of inactivity preventing the build up of bacteria. The water is available either still or sparkling at the nominal cost of 5 cents for 500 ml; 10 cents for a litre; and 15 cents for a litre and a half, you just have to provide the container. Dean Tyler Shelton, Councillor for Manilva’s Environment Department, told The Resident that“This is the culmination of two years work to secure this facility, the first in Spain, for Manilva.” Councillor Shelton also pointed out the advantages “Not only does the facility provide low cost filtered water that hasn’t been sat in a bottle for days, weeks, or even longer, it is also important from an ecological point of view, reducing the need for single use plastic bottles, and all the energy that goes into processing and transporting, thus reducing the consumer’s carbon footprint”. The kiosk can be found in the Plaza de Blas Infante, on Calle Espinosa opposite Las Brasas restaurant.

ROTARY CLUB Estepona Sotogrande International The new Rotary Club International has been officially constituted and its inauguration will be celebrated at the Elba Estepona Gran Hotel & Thalasso Spa **** in Estepona on the 13th October at 7.30 pm, when the Governor of Rotary Andalucia will present the Official certificate and attach the Rotary Pin to each of the founding members. The importance of this singular club is that it covers more than one area, Estepona, Casares, Manilva and San Roque. All four Mayors have confirmed their attendance at this historical event
which will be attended by over 100 people. Rotary International is an international service organisation whose stated purpose is to bring together business and professional leaders in order to provide a humanitarian service and to advance goodwill and peace around the world. It is a non-political and non-sectarian organisation open to all people regardless of race, colour, creed, religion, gender, or political preference. There are 34,282-member clubs worldwide, and 1.2 million individuals, known as Rotarians, have joined.

Samaritans in Spain Samaritans is a charity established in the UK by Chad Varah in 1953. Since then it has grown exponentially and more recently, has spread overseas, including Spain. The Samaritans’ main function is to listen to anyone who is experiencing distress. Communication is mostly via telephone, free of charge. All listeners are trained volunteers who serve in rotas and are available 24 hours a day, 365 days of the year. How many hours or how often they offer their services (‘listen’) is up to the individual volunteer. Samaritans listen to people who are either lonely, or feel themselves unable to express their feelings, concerns, or problems to those around them. They do not ‘counsel’, but provide an empathetic ear. Volunteer listeners
are drawn from all backgrounds, all ages, and all walks of life. After initial training all new listeners are supported with mentoring. It is not only those who face life traumas, bereavement, or those burdened with guilt, who contact Samaritans. Anyone who feels the need for emotional support, encouragement and lacking confidence will benefit by talking to a Samaritan. A call to the Samaritans could last a few minutes or much longer, since callers are never rushed. The need for this type of help in the community is exemplified by the rapid expansion of Samaritans in Spain since its inception in September 2005. Increasingly, Samaritans in Spain not only require more volunteer listeners for its primary function, but also to
help in administration, publicity and other varied roles. With branches in Madrid, Denia and shortly on the Costa del Sol, Samaritans in Spain will be able to provide this service to most of Spain's English speaking community.

Simon’s Story
In 2003, Simon noticed changes in the way he was feeling. He had been struggling with depression. Worried about what people might be thinking of him, he avoided going out and meeting his friends. His GP diagnosed him with agoraphobia and referred him to a mental health team. But he was still struggling to cope, Simon explains: As a man, it is still difficult to open up about the way you feel. It isn’t ‘manly’ to share your feelings. The trouble is,
for men who are battling depression, this expectation can be damaging. If you carry on bottling things up, overtime they will overwhelm you. “I spent the best part of a decade feeling alone with the way that I was feeling. I think this is part of the reason why I would feel suicidal. These thoughts and feelings lead me to attempt to take my own life on more than one occasion.” He says: “I heard of Samaritans and I knew that they were there to listen. But before I called them, I didn’t realise what a positive impact their support would have on my life. “I explained that I was thinking about taking my own life. He wanted me to walk to the branch to meet face to face. The thought of this was so overwhelming - it took me everything just to leave the front door. “The volunteer remained on the phone with me until I was just a short walk from the front door. I was
welcomed with a warm smile, before sitting down to talk about what was making me feel so down and depressed. “Knowing that there is someone there, has improved my quality of life. I no longer feel alone, with nobody to understand. The day I chose to get in touch with Samaritans, I took back some control.” Simon says that with hindsight, he should have reached out to Samaritans sooner. Food Bank The Saint George Charity runs a food bank initiative to help local people who are finding it difficult to make ends meet, and invites people to donate non-perishable goods, such as long life milk, pasta, rice, biscuits, tinned meat and fish, tinned vegetables, etc., along with toiletries, personal hygiene and cleaning items.
The charity will supplement these items with fresh produce, and will distribute on a weekly basis to a number of individuals and families that have been identified as being in urgent need of this service. BuddyUp (Manilva) Community Support Group In response to a tragic situation earlier in the year a number of local residents came together to form the BuddyUp (Manilva) Community Support Group, a ‘befriending’ group to provide support, comfort and a point of contact for people facing a variety of challenges. The BuddyUp group is coordinated by Marguerite Wilkins, and already has a number of members signed up. Working closely with other local charities and organisations, including the Duquesa Charitable Society of St George, Age Concern, Estepona and Manilva, Citizens’ Advice, Cudeca, Social Services, etc., the group aims to provide support and advice for the elderly, disabled, those who have recently lost a partner, single parents, divorcees, the socially excluded, people that are new to the area, in fact anyone who might need someone to talk to or just pointing in the right direction.
BuddyUp volunteers work in pairs and have access to a wide range of resources to call upon depending on the needs of those they are assisting. In Sabinillas one of the shops sells quality second hand clothing, shoes, hats and accessories; whilst the other sells a wide range of secondhand furniture, decorative items, household goods, books, cds,
dvds, etc. Our shop in La Cancelada sells the same full range of secondhand items as our Sabinillas shops and also stocks larger items of furniture and beds. Thanks to our generous donors there are new items in the shops daily, so visit regularly so as not to miss out on that fabulous bargain.
As well as stocking some great quality items the St George Charity shops also rent out various items such as wheelchairs, walking aids, travel cots, etc. The shop management welcome donations of quality secondhand items, and can arrange collection if needed. We are also looking for secondhand books, especially in languages other than English, to populate are extensive bookshelves. Does your pet get bored? Although scientists point out that certain doses of boredom are good for people, as they stimulate creativity, no one likes to be bored all the time. Given this concept, pets are no exception. Pets without stimuli can develop behavioural problems, such as destroying the furniture in the house or going for the rubbish bin, for the simple joy of getting to capture the attention of their owner. A bored pet that sleeps all day or spends too many hours alone lacks the necessary motivation for normal development. This explains why it is not surprising that a pet with a lack of stimuli may demonstrate its lack of entertainment with behavioural problems such as excessive vocalising, destruction at home or disobedience. These behaviours are the only way the pet has to communicate to its master that it has a problem. However, its boredom can lead to even more serious disorders. So a pet that does not get the attention and care it requires can even develop health problems such as separation anxiety or some forms of depression if left alone at home. But avoiding boredom for a dog is possible. Here are five great ideas to achieve this.
1. How to choose their toys "Toys are not a luxury for dogs (or cats), but a necessity," explain the vets from the Society for Prevention of Cruelty to Animals. It has been found that toys help combat boredom when the pet is left alone at home. But they also provide for their well being helping to prevent the development of problematic and unhealthy behaviours. Having a variety of toys can be useful to end their tedium. There are pets who prefer soft toys, others who are more pleased by the balls for them, while go mad with the dolls that make noise. Your preferences must be taken into account when choosing the most appropriate (toys) for them.

By slowing rolling over various areas of your body, you’ll help break up adhesions and scar tissue and speed up the healing and recovery process after your workout. This works for most body parts, I do it daily before I start a heavy strength workout and twice weekly post workout! You can buy the rollers from Amazon, Decathlon or even make one using PVC pipe.
Pre workout - using slow movements, roll over the whole area, until you find a sore bit, then spend another 1-2 minutes rolling the sore bit (inside of knees, outside of thighs, forearms, top of shoulders, can be quite sensitive). Post workout - using firmer and faster movements, pay more attention to the whole muscle. You may feel that you are bruising your body, rarely does it actually bruise, it’s just releasing very tight fascia. Avoid the bony areas though, this can be very painful.
Drink plenty of water post ‘foam rolling’ this helps flush out any toxins.

Sergio García, la Ryder Cup y el Andalucía Valderrama Masters, más allá de las cifras El Andalucía Valderrama Masters - Fundación Sergio García, que se celebrará del 18 al 21 de octubre en el Real Club Valderrama, servirá de escenario para el reencuentro entre Sergio García, el European Tour y el Real Club Valderrama apenas unas semanas después de que el jugador de Borriol se convirtiera en el plusmarquista histórico en puntos de la Ryder Cup. Esta hazaña, no obstante, trasciende las cifras, igual que la implicación de Sergio en el torneo español va mucho más allá de su mera presencia en el mismo. Suele decirse que las estadísticas no reflejan toda la verdad, que en ocasiones son un mero corte en sección de la realidad y que no ofrecen más que una fotografía borrosa de un instante determinado. Sin embargo, que Sergio García se convirtiera en la pasada Ryder Cup, en el golfista que más puntos ha conseguido en la historia de la competición desde su fundación en 1927 es la consecuencia lógica de casi dos décadas de triunfos en un torneo que premia el carácter y el trabajo colectivo. Aun así, el castellonense es consciente del valor relativo que tienen los logros individuales en un torneo en el que prima el equipo, y por eso restaba importancia a la posible consecución de su récord al principio de la semana. “No pienso en batir récords, ni me lo planteo. Si yo consigo batirlo y perdemos la Ryder Cup, sería inútil y no tendría ningún valor para mí. Lo importante es sumar puntos para el equipo y que entre todos recuperemos la copa para Europa. Somos un equipo y eso es lo que importa”. García llegaba como elección personal del capitán, Thomas Björn, y con su novena aparición superaba en una a su héroe de la niñez, Seve Ballesteros, como
español con más participaciones en el torneo (en 2010 fue vicecapitán). En la distancia volvía a producirse el relevo que ambos ya protagonizaron dos años después de que el as cántabro capitaneara al combinado europeo en Valderrama. En Brookline, en 1999, García debutó (batiendo el récord de precocidad en la Ryder Cup) y los europeos encajaron una dura derrota, pero el español ya exhibió esa combinación de talento y corazón que le ha convertido en el alma del equipo europeo. Si la irrupción de Ballesteros, que junto a Antonio Garrido abrió las puertas en la selección de golfistas continentales para la Ryder Cup, cambió el rumbo de la competición, la presencia de Sergio García ha sido imprescindible para afianzar el dominio europeo durante las dos últimas décadas. Además de dar la cara en los cruces individuales, García ha sabido complementarse con sus compañeros y encumbrarlos, contagiándoles su entusiasmo para llevarlos en volandas. Son muchos los que se han beneficiado del “efecto García”, desde Lee Westwood o Luke Donald hasta Rory McIlroy o Alex Noren, sus parejas en esta última edición. Los 25,5 puntos que figuran en su palmarés son el resumen perfecto de su trascendencia en la Ryder Cup. Aun así, una vez conseguida la victoria, Sergio seguía anteponiendo el triunfo colectivo y volvía a agradecer a Thomas Björn que le hubiera brindado la oportunidad de jugar en París. “Fue increíble, nunca pensé que lo conseguiría, pero, como he dicho en muchas ocasiones, el récord no habría servido de nada si no hubiéramos ganado. Ser el máximo anotador es una gran
satisfacción y un orgullo, pero estoy mucho más orgulloso y feliz por haber ayudado al equipo a ganar la Ryder Cup. No suelo llorar, pero no pude evitarlo. Me vinieron a la cabeza muchos momentos, muchas sensaciones. Ha sido un año duro. Siempre estaré agradecido a Thomas por haber confiado en mí y me alegro de no haberle defraudado”. Mike Errera’s Monthly Golf Etiquette Tip When to record your score This one just makes sense, yet we see if done incorrectly all of the time. When you finish a hole, the correct time to record your playing partners and your own score is NOT off of the side of the green of the hole that you just finished. The correct time to record scores is when you make it to the tee box of the NEXT HOLE! The reason why it is important to record your scores at the next tee box is because you want to be able to GET OFF THE HOLE AS QUICKLY AS POSSIBLE. If you are wasting time next to
the green, you will hold up the group behind you. They will have to wait until you are clear of the green for them to be able to play their shots in. While it only takes about one minute to record everyone’s score, this time does add up. If you add one minute per hole for the group behind you, you have added 18 minutes to their round of golf. This cumulative effect throughout the day can really slow down the pace of a busy golf course. Moving forward, please be considerate of the groups behind you and
exit the green as quickly as possible. Record your score should when you are clear from the hole that you have just completed.

Sergio made this point very clearly at the start of the week in Paris: “I’m not concerned by records, I’m not even thinking about that. If I managed to beat that record, but we lost the Ryder Cup, it would be worthless to me. I’m only interested in adding points to the team so that we win back together the Cup for Europe. Only the team counts this week.” It was Sergio’s ninth appearance in the showdown against the US, one more than his childhood hero Seve Ballesteros. He made his debut at Brookline (3-1-1) where Europe lost, but the Spanish rookie exhibited the blend of talent, courage and team spirit that would enable him to take up the torch as one of the pillars of the European side. While Seve revitalized the event by opening its doors to continental Europe and inspiring the team to new heights, Sergio has made a vital contribution to consolidating European dominance
over the last two decades. After a disappointing season this year, the 38-year-old arrived at the Albatros Course as a risky captain’s pick, but by week’s end he had cemented his legacy as one of the greatest players of the biennial event. His Sunday singles victory over Rickie Fowler capped a 3-1 week in which he was key to Europe’s sixth consecutive victory on home soil, and pushed his career Ryder Cup record to a sparkling 22-12-7 in his nine appearances, the 25.5 total points breaking the previous record. It was a glorious and emotional moment after his win on Sunday: "Yeah, I don't usually cry, but I couldn't help it. What a week! It's been a rough year, but you know, we fought hard. Obviously so thankful for Thomas to pick me and believe in me, and so happy, so happy to get the Cup back here in Paris and in Europe and for everyone to enjoy it as much as they did." But the team was definitely on the front of his mind: "Yeah, it means a lot but at the end of the day, I've always said it. It's about the team and I'm happy that I was able to help with some of the points. It's a bonus. It's something that I never thought I would have the possibility of doing, and now that it's happened, I'm just
so happy. I mean, these guys are unbelievable." Next week at Real Club Valderrama, one of his favourite courses, Sergio will look to build on this positive momentum as he fights, this time individually, for his third Andalucía Valderrama Masters title.
