N EW S BR I EF S DEP HANDS OUT RAINWATER BARRELS TO CONSERVE WATER The city is turning to a low-tech solution to save water and money, as the Department of Environment Protection is giving out free rain barrels. People lined up early in Marine Park, Brooklyn on Saturday to get one of the 400 barrels that connect to rain gutters and collect water. That takes pressure off the sewer system and conserves drinking water. “I need to get rainwater so I can save on my water bill. Save on my water bill so I can water my plants and my grass,” said one recipient. “It’s environmental. I mean, if everybody does their part, there will be more water available for everybody,” said another. “This water is coming from upstate that we drink, so we may as well use the rain that falls on us.” The DEP will give out more barrels in Queens on April 30 and in the Bronx and Staten Island on May 7. REPORT: UP TO 400 NYPD OFFICERS MAY BE CHARGED WITH FIXING TICKETS Hundreds of New York City Police Department officers could reportedly be facing criminal or disciplinary charges as part of an alleged ticket-fixing scandal. According to the New York Post, as many as 400 officers are facing charges from all 12 precincts in the Bronx and possibly other boroughs. The paper says police officers helped friends get out of parking tickets, moving violations or quality of life summonses by losing paperwork or missing court dates. Police officers found guilty in department trials could be fired, lose benefits or be reprimanded and officers accused of tampering with documents or taking money could face criminal charges. OFF-DUTY MTA POLICE OFFICER SHOT, WOUNDED IN CAR REPAIR SHOP An off-duty MTA Bridges and Tunnels officer is recovering after being shot during a gunfight inside a Brooklyn auto repair shop. Police say Anthony Presley was inside the shop on Albany Avenue in Bedford-Stuyvesant when four men tried to rob it around 8:30 o’clock Saturday night. They say the men attacked Presley when they discovered he was armed, and a shootout erupted between the officer and the men. Presley was hit once in the shoulder and was taken to the hospital. A 19-year-old suspect was shot in the leg and shoulder and a 21-yearold suspect was struck in the neck and face. Both were taken to area hospitals. Police are still looking for the other two suspects. Republicans set 2012 budget battle with Obama By RICHARD COWAN and DAVID ALEXANDER WASHINGTON — Republicans in the House of Representatives united on Friday behind a 2012 budget plan slashing trillions of dollars in government spending while cutting taxes — two achievements conservatives say are necessary ingredients for a deal to raise the U.S. debt limit. The vote effectively serves as the Republicans’ opening gambit in what are likely to be contentious negotiations with President Barack Obama and his Democrats over debt and deficits in the coming months. The Congress must decide within weeks on raising the $14.3 trillion debt ceiling. By a vote of 235-193, the House passed the plan written by House Budget Committee Chairman Paul Ryan for the 2012 fiscal year beginning October 1. Democrats rejected the measure, which proposes slashing spending by nearly $6 trillion over a decade and reducing benefits for the elderly and poor. All but four Republicans supported it. There is almost no chance of the Senate approving the measure in its current form. The White House swiftly condemned the measure but said it was committed to working with Republicans to bring down record deficits that all sides acknowledged imperil the country’s economic future. “Though our approaches differ, our goal remains the same,” White House spokesman Jay Carney said in a statement that was more conciliatory than Obama’s sharply political attack on Ryan’s plan in a deficit-cut-
ting speech earlier in the week. The two parties are offering competing visions of America’s fiscal future. “Yesterday we cut billions, today we cut trillions,” said Kevin McCarthy, the third-ranking Republican in the House. He was referring to the passage on Thursday of a bill that funds the government through September 30 but at the same time cuts government spending by about $38 billion. Obama signed the bill into law on Friday. Republicans have made clear their support for raising the debt ceiling, which must be done by July 8 at the latest, is contingent on substantial progress toward reducing the $1.4 trillion annual deficit. In coming weeks, the Treasury Department estimates it will hit its $14.3 trillion limit on borrowing. Obama acknowledged on Friday that a compromise on spending cuts would be needed to get the necessary support in Congress to raise the U.S. debt ceiling, while warning that the world could plunge into a new recession if the United States were to default on its debt. Central to the Republican 2012 budget are deep reductions in domestic spending coupled with cutting the top corporate and personal tax rates to 25 percent, down from 35 percent. Long-term spending cuts would be achieved largely by revamping Medicare healthcare for the elderly. Future retirees would get a federal subsidy based on income and health status and would pick private insurers for medical coverage. “We don’t want to ration Medicare, we don’t want to see Medicare go bankrupt, we want to save
Medicare,” Ryan said. But Democrats jumped all over the Republican plan, saying it would hit seniors with higher medical bills — to the tune of at least $6,000 a year — while allowing generous tax breaks to oil companies and wealthy individuals. House Democratic leader Nancy Pelosi said the plan “breaks the promise that our country has made to our seniors that after a lifetime of work they will be able to depend on Medicare to protect them in retirement.” The vote capped a week in which Obama belatedly entered the debt debate with a new, albeit somewhat vague, plan to cut deficits by $4 trillion over 12 years. Polls show Americans are deeply worried about the state of the country’s finances and the debate is already sparking high emotions. Heckling protesters opposed to Ryan’s plan disrupted proceedings in the House on Friday and U.S. Capitol Police later charged 12 people with disorderly conduct. Republican unity on the budget plan could be strained in future votes if bipartisan negotiations on any budget/debt limit deal include tax increases that conservatives have so far ruled out. One big political question dominating Washington is whether Republicans are jeopardizing their 2012 chances in presidential and congressional elections if the public perceives their Medicare proposals as unfair and putting a heavy burden on the elderly, an important voting bloc. One of the Republicans voting against the bill on Friday was Representative Ron Paul, who is weighing a 2012 presidential run.
Walcott: Accountability key to city schools’ future Newly-appointed Schools Chancellor Dennis Walcott is calling for cooperation in order to solve problems that are plaguing city schools. During a lecture Saturday at Columbia University, Walcott stressed the importance of accountability in the school system. He mentioned the closure of failing schools and the removal of ineffective teachers as examples. He also said while poverty is a serious issue for many students, it is not the excuse for poor performance among some. Walcott said he’s not afraid to make the tough decisions needed to create better schools.
“You look at the faces of the students, you see the parents in there, you see the principal or the AP’s moving around, you see the artwork on the wall, you listen to the tone of the individuals who are talking, and you know that is a great school. I want to see those types of schools throughout the five boroughs in every ZIP code, in every neighborhood on behalf of our children,” Walcott said. Walcott also supports ending the controversial “Last In, First Out” policy for teachers facing layoffs. The chancellor also says he plans to keep an open line of communication with the teachers’ and principals’ unions.
Local employee sues over alleged racism CAIRNDEN, N.J. — A municipal employee in South Jersey has sued Gloucester Township and members of its Human Relations Commission for alleged racial harassment. The lawsuit filed by Steven Brodie Jr. in U.S. District Court also names past and present local officials, including the entire commission, the Courier-Post of Cherry Hill, N.J., reported. In court papers, Brodie accuses Mary Dorazo, a member of the com-
mission, of covering up racial incidents to protect her son. Michael Dorazo Jr., who allegedly locked Brodie in a storage cage in 2007 while both were working for the Gloucester Department of Public Works, is awaiting trial on charges connected to the incident. Brodie says Michael Dorazo and David Pomaniek, who has already been convicted of bias harassment and other charges, made racially charged
remarks to him. Both men are also named as defendants. “You throw a banana in there and he goes right in,” Pomaniek allegedly said. The lawsuit says Gloucester officials failed to train employees properly or to investigate complaints of racial incidents. Brodie’s lawyer, Charles Gibbs, in an e-mailed statement said his client never even got an apology.

Martin Luther King’s children celebrate at reopening of historic Ebenezer Baptist Church By ERRIN HAINES ATLANTA — The voice of the Rev. Martin Luther King Jr. again filled the halls of Ebenezer Baptist Church and a pipe organ triumphantly announced the reopening of the sacred sanctuary regarded as the birthplace of the civil rights icon’s vision of justice, equality and a nonviolent society. The King family was joined by members of the civil rights movement and Interior Secretary Ken Salazar in celebrating the reopening of Ebenezer, called the cornerstone of King’s legacy. Salazar said the church is “hallowed ground for a nation still very much in progress.” “To be here this afternoon is to feel that history and remember our personal connection,” Salazar told the crowd gathered in the building, which was closed to visitors in 2007. Ebenezer’s Heritage Sanctuary has been restored to its original appearance from 1960 to 1968, when King co-pastored there with his father. Work began on the $8 million project in 2000, and includes a return of the original pulpit furniture and furnishings, architectural and paint finishes, the baptismal pool and choir loft seating. It also restored King’s most important title: preacher, said his youngest daughter, Bernice King, who delivered the keynote address at the ceremony. “I’m happy that so many people will

come to this place ... that will stand as a reckoning point for millions of people all around the world,” she said. “You must remember always the pastor and the pastor’s mission: To redeem the soul of America. He loved God. He obeyed God and he loved God’s people.” Excerpts of King’s most famed sermons were piped into the sanctuary before the ceremony began. “Much comes to my mind as I stand here this afternoon, because I grew up in Ebenezer,” a smiling Martin Luther King III, president and chief executive officer of The King Center, told the audience. His daughter, Yolanda Renee King, opened the ceremony by ringing a liberty bell near the pulpit. The Rev. Joseph Lowery attended the ceremony and said he had many fond memories of the church, where he often met to discuss strategy for
the Southern Christian Leadership Conference, which he co-founded with King in 1957. “I can’t tell you how it feels to me to be standing here in this spot, in this place, at this hour,” Lowery said from the pulpit where King delivered his sermons more than four decades ago. “This church and this ministry have been significant in the history of this country for a long time. I thank God that it remains here to be seen.” King was born just blocks from Ebenezer on Auburn Avenue in downtown Atlanta, and grew up in the church. His father, the Rev. Martin Luther King Sr. — known as “Daddy King” — preached there and was a local civil rights activist. His grandfather, A.D. Williams, preceded him and also fought segregation during the early 20th century. King is also buried next to the church, in a crypt alongside his wife,
Coretta Scott King. The Rev. Raphael G. Warnock, current pastor of Ebenezer and a King scholar, said Friday’s ceremony was not only a restoration of a building, but of a movement. “We must rediscover lost values,” he said. “The Black church has been the conscience of America. We held vigil for that which is truest and best in the American spirit. We still have work to do. We can’t be silent.” During the ceremony, King’s only living sibling, Christine King Farris, was made an honorary park ranger by National Park Service Director Jon Jarvis. “This day is a day of tremendous emotional resonance for me,” said Farris, who was baptized by her father at Ebenezer when she was six years old. “I’ve tried to share as much as I can, being the last survivor of the nuclear family.” Ebenezer is the anchor of the Martin Luther King Jr. National Historic Site, which welcomes more than 700,000 national and international visitors annually.
Union: New York court system to lay-off up to 500 employees By DAN WIESSNER The New York State court system will lay-off as many as 500 workers in the coming weeks, according to a union memo released on Friday, as the state works to close a $10 billion budget gap. New York state lawmakers recently passed a spending plan for fiscal year 2012 that includes across-theboard cuts to state agencies. New York is not alone. Many cashstrapped states across the United States have been firing workers,
delaying big building projects and raising taxes after the 2008 recession and financial crisis left state coffers severely depleted. David Bookstaver, a spokesman for the court system, confirmed that layoffs are in the works but said it’s too early to tell how many jobs — or which ones — will be lost. “In the next two or three weeks we’ll have a firm understanding of numbers,” Bookstaver said. New York is not alone in slashing expenses in its court system. Connecticut’s top judge on Friday testi-
fied at a budget hearing that a proposed 10 percent cut to that state’s court system could result in layoffs and courthouse closings. Cuomo, a Democrat, has threatened 9,800 layoffs if public employee unions do not concede $450 million in savings from wages and benefits. The New York state memo, prepared by the Civil Service Employees Association, says that no decisions have been made regarding what positions would be eliminated. The court system currently has 15,350 employees, not including
Rev. Jesse Jackson, PUSH deny discrimination claims CHICAGO — The Rev. Jesse Jackson and his Rainbow PUSH Coalition are denying accusations of discrimination made by a former employee. In a statement, Rainbow PUSH Coalition said its leaders “unequivocally deny” ex-staffer Tommy Bennett’s claims of harassment, retaliation and discrimination,” the Chicago Tribune reported. Bennett reportedly said he was fired because he was gay and has filed a complaint with the Chicago Commission on Human Relations. The Rainbow PUSH Coalition said it was cooperating with the commis-
sion. “The organization does not condone or tolerate discrimination in any form,” the statement said. “[Bennett’s] inflammatory allegations are an attempt to malign Reverend Jackson and the organization, and are hurtful and harmful to the progressive community.” Besides alleging Jackson fired him unjustly, Bennett said in his complaint filed last year that Jackson forced him to perform “uncomfortable” tasks, including escorting various women to hotel rooms to meet Jackson for sex, the Chicago Sun-Times reported.

After Governor Andrew Cuomo publicly criticized the court administration for proposing to hold spending flat, the court system agreed to a $100 million cut, but lost an additional $70 million in the final week of budget talks. A Cuomo spokesman was not immediately available to comment on the CSEA memo, which says that some layoff notices could be sent out as early as next week, and would be effective May 4. The freshman governor this week announced an accord with a relatively small law enforcement union, including a three-year wage freeze and increased health care contributions. But the state’s two largest unions said that they rejected those proposals. In a video message last month, State Court of Appeals Chief Judge Jonathan Lippman said that the budget cuts would have “an unprecedented impact on the court system.” “The impact of our reduced budget will hurt our ability to serve all New Yorkers, in particular those who come to our courts seeking justice,” Lippman said. The judge went on to warn of a “significant number of layoffs across a broad range of operations,” as well as cuts to legal aid, town and village courts and mediation.

For years, Del’Rosa WinstonHarris kept her HIV diagnosis a secret. When she was seeking HIV/AIDS resources, “I went to places that were way outside of where I lived so no one could identify me,” she says. When a friend ran into her at the hospital and asked why she was there, “I said, ‘I’m here to get my cancer checkup,’ “ the 49-year-old recalls. “My biggest concern was that I couldn’t tell anybody.” A fear of disclosing one’s HIV status is not unusual, since there is a stigma surrounding HIV and AIDS that is ingrained in American society, says Bambi W. Gaddist, Ph.D., the executive director of the South Carolina HIV/AIDS Council. Most people would rather look the other way than acknowledge how many people are living with HIV, Dr. Gaddist says. “After 30 years of AIDS, people are still asking, ‘Is AIDS a problem?’ “ And, unlike diseases like cancer and Alzheimer’s, there’s the often unspoken rationalization that those with HIV brought the disease upon themselves. “HIV is a human immunodeficiency virus that’s causing a fight inside of my body, yet people have made it about lifestyle,” says Elveth Bentley, 46, of Atlanta. As a result,
many women hide their HIV status, fearing that people will judge them for having sex or succumbing to an addiction. But, AIDS activists are hoping to change that. In March SisterLove, an Atlanta-based reproductive-health organization that focuses on HIV/AIDS, launched a mini documentary series called Everyone Has a Story,” which features interviews with Black women who have HIV, who are sharing the realities of life with the disease. “We want to get more HIVpositive women talking and disclosing and really stepping into leadership where HIV/AIDS is concerned in the community,” says Tiffany Pennick, a spokeswoman for SisterLove. The documentary series is part of the organization’s 20/20 Leading Women’s Society program, in which 2,020 HIV-positive women will be trained during the next decade to help women across the world better manage their sexual and reproductive health. The Power of Disclosure Both Winston-Harris and Bentley participated in the documentary series, which covers such experiences as disclosing HIV status to family members for the first time, finding a support network, and dealing with strained family relationships. While both women are now more comfortable sharing their status with loved ones and strangers alike, the documen-

tary gives them an even larger audience for their stories. Winston-Harris began the process of disclosure after watching a friend who’d kept her diagnosis a secret die alone. Realizing how isolating the stigma of HIV could be, she had an epiphany. “The idea of dying alone is one thing, but living alone is another,” she says. “I realized somebody had to speak up and let people know this is a disease that anyone can get.” For Bentley, the road to disclosure began as she noticed how damaging shame could be. “You lose your sense of identity when you begin to buy into the stigma,” she says. “You let the disease define you.” She also saw that self-defeating behaviors often accompanied shame, such as avoiding the doctor’s office or HIV clinic because of a fear of being seen. Since disclosing their HIV status, both women have felt empowered and seen their lives improve. “I’ve learned how to communicate and socialize with any kind of person,” says Winston-Harris. I can meet people where they’re at now. Pre-HIV, I didn’t know how to do that.” Bentley agrees. “If I tell you [about my HIV status] myself, I’ve taken the power from you to say anything about it. What can you really say that I have not already said?”

Visual beacon for activism By LAMARR RENEE Charles Burnett a mainstream commercial director who has a portfolio of feature films has not achieved the celebrity that his work merits because his visual stories document the Black American experience in fiction and fact. It’s not a popular theme for the American majority but an insightful portrayal of some of the historical subjects that originate in the south and Vicksburg, Mississippi where he grew up. His realism is not tinted with palpable messages. Instead his images resonate the urban grit of a displaced generation that still seeks its rightful place. Television’s Eyes On the Prize audience became captured supporters of this civil rights documentary that chronicles the progressive battles of Black people. Then after its breakout he disappeared. At least from prominence. Subsequent films became less known and one would have to search film festival itineraries to find his work.
Such artistic isolation is not an option for a film director and thanks to The Museum of Modern Art he is no longer hidden from us. His feature length films are being showcased through April 25 in a comprehensive compilation appropriately called Charles Burnett: The Power to Endure. The African Film Festival presented by the Film Society of Lincoln Center is bringing this year’s program to different communities. Segments will be shown in April and May at the Institute of African Studies Columbia University where the late Professor Manning Marable presided; Maysles Cinema and The Brooklyn Academy of Music. Pan Africanists: people of the Diaspora who find cultural connections as strong links between the continent and world will find an appealing group of films to select from. Persons of other political persuasion will see broken myths and characters that supplant tribal customs with individualism. African film directors are beginning to circumvent cultural restraints through imaginative sto-
Manning Marable’s Malcolm X By WILLIAM REED Two of Malcolm X’s daughters take issue with a recent biography of their father alleging that the marriage between Malcolm X and Betty Shabazz was strained, and that both partners may have been unfaithful. Black academicians are having coronaries about the book: “Malcolm X: A Life of Reinvention”. Compiled by renowned Black historian Manning Marable, the book is a hot-seller. Marable worked on the book for 20 years and died just before its publication in April 2011. Among records Marable used were Malcolm’s personal papers and a letter to Nation of Islam leader Elijah Muhammad where he discusses his wife’s sexual frustrations and says she had threatened to “seek satisfaction elsewhere.” A major body of work, Marable’s “Malcolm X” includes interviews, source documents, and theories long bantered about, but never fully denied or proved. Malcolm X’s death has long been shrouded by the dealings of that era: informants, infighting among Black militants, power struggles within the NOI and allegations of lackluster handling of the initial investigation. In making Malcolm just a man, Manning broached his private life saying Betty Shabazz was “Not as subservient as Malcolm may have wanted her to be”. Manning said he sought: “to pay tribute to the slain activist’s life and influence” and avoid portraying him as “a saint without the normal contradictions and blemishes.” Few portrayals give credit due to the Nation of Islam and its role in the advancements of African Africans.
Foundered in 1930, the Nation of Islam (NOI) is a religious and social group often referred to as “a militant” African American organization. Frequently called “anti-Semitic”, “racist” and “sexist”; NOI supporters say they have been involved in programs toward the betterment of African Americans for more than 70 years. In the beginning, the NOI was led by Wallace D. Fard Muhammad, whom NOI members consider “a prophet”. Fard Muhammad’s agenda was to improve the spiritual, mental, social, and economic condition of Blacks. When Wallace D. Fard Muhammad disappeared in 1934, Elijah Muhammad took over and led the NOI into prominence up to 1975. Using practices preached by Booker T. Washington and Marcus Garvey, Elijah Muhammad proved to be “a great teacher” as he established NOI businesses, large real estate holdings, armed forces, and schools. The NOI practice of separatism incorporated into a do-for-self philosophy resulted in the NOI owning and operating hundreds of businesses and employing thousands of people nationwide during the 1950s and 60s. The “mentor” of Malcolm and Farrakhan, Elijah Muhammad led the NOI to purchase and operate foodindustry services, bakeries, and restaurants. They owned a large amount of Georgia farmland. Many NOI members still own and operate hair-care shops and businesses. Over the years, some of NOI business ventures have been success stories; others have been criticized as Amway-style marketing schemes. The official beliefs of the Nation of Islam have been outlined in books, documents, and

Yeelen (Kino International Films) is the clash of the modern world with shaman centered customs in the life of a young runaway. A Trip To Algiers portrays a warrior widow who fights for real justice that upholds the principles of their freedom fight. It is a picture of the unveiled Arab woman. Born To Be Wild an independent Warner Brothers film is a breathtaking 3D trip to Kenya and Borneo where 3 committed scientists and environmental purists take abandoned baby elephants and orangutans and nurture them until they are able to return to the wild. It’s a purist program that abhors zoos and game reserves. Down in Soho, The Tribeca Film Festival and The New York International Film Festival are offering new and untested screenplays. These staid community centered features always draw big crowds so plan in advance. The end of May brings Norman Jewison films to Lincoln Center. It’s a humorous mix of satire, melodrama articles, but through the years the NOI has preached that the entire American political structure and economy is based on white supremacy. Few can match Elijah Muhammad’s and the NOI’s urban successes. Malcolm X is an example of the NOI’s record in cleaning up drug addicts, reforming prostitutes, and keeping Black youth out of gangs. In 1963 James Baldwin said: “Elijah Muhammad has been able to do what generations of welfare workers and committees and resolutions and reports and housing projects and playgrounds have failed to do: heal and redeem drunkards and junkies, convert people who have come out of prison and to keep them out, make men chaste and women virtuous, and invest both the

Shame and stigma of HIV Continued on page 5 There’s also a political benefit that comes with sharing one’s struggle with HIV. “When we get more women to do that, then we will see a social movement like we’ve seen with breast cancer,” says Dr. Gaddist. “Until we get to that, we’ll never have a social change. We’ll never see financial investment in this issue domestically.” For those who are struggling to move past the stigma of their diagnosis, Winston-Harris and Bentley share some of the insights that have helped them overcome the shame. Forgive yourself: Before you can learn to ignore others’ judgments, you have to get past your own, says Winston-Harris. “I can remember being so angry with myself,” she recalls. Once she stopped blaming herself for her HIV status, talking
about it became easier. Find purpose in your story: Whether you’re using your voice to educate others about HIV or to build intimacy in your personal relationships, understand why it’s important for you to share your story with others, says Bentley. When you feel fearful about opening up, let that purpose motivate you. Know it’s a process: While disclosing your HIV status will likely get easier over time, “it’s still uncomfortable,” says Bentley, particularly when you’re talking to people whose opinions matter to you. “The unknown is always uncomfortable, but you find your voice more and more each time.”

As gas prices rise, some drivers head to Mexico By JIM FORSYTH SAN ANTONIO, Texas — U.S. drivers on the southern border could cut $1.20 or more per gallon from their rising gas costs right now — but there is a catch. They have to be willing to brave long delays at the border and run the risks of robbery, kidnap, and drug cartel violence to reach the gas stations in Mexico. Among those making the trip is Chad Foster, a former mayor of Eagle Pass, Texas, who made the run over the Rio Grande to Piedras Negras, in Mexico’s northern Coahuila state.
“When Piedras prices are under ours, a segment of Eagle Pass residents go to Piedras Negras to fill up,” said Foster, who works in real estate. U.S. pump prices for regular unleaded gas ticked up to an average $3.82 Saturday, according to the AAA daily fuel gauge report, with prices reaching nearly $4.20 in California. Pump prices are surging as oil rises to $109 a barrel on a stronger U.S. economy and war in Libya limits its output. But south of the border prices at one gas station on Friday ranged from 34.4 pesos a gallon for regular to 38.8 pesos for premium —
equivalent to $2.94 to $3.31 a gallon. Rising interest in cheap gas in Mexico — where state oil company Petroleos Mexicanos plans to spend about $1.3 billion on subsidizing fuel this year — has echoes of July 2008, when average prices hit a record $4.11 a gallon stateside. Tempers frayed amid long lines and short supplies in 2008 when American drivers flocked to northern Mexico stations. But this time around, soaring drug violence and growing wait times at border crossings are giving some residents of larger California and Arizona border cities
pause. Cartel mayhem last year claimed more than 12,400 lives in Mexico — with most deaths in states flanking the U.S. border. Kidnappings and extortion have also risen, piling on hazards. If that were not disincentive enough, the U.S. and Mexico have tightened security at crossings the length of the nearly 2,000-mile border to curb immigrant, drug, gun and cash smuggling. Crossing delays have drawn out to several hours at times, putting some drivers off. “Gasoline is cheaper in Tijuana and the army presence makes me feel safer, but the problem is it takes so
long to cross the border,” said Ivan Pavon, a San Diego, California, construction worker. “You have to ask yourself if it’s worth the hassle?” Pavon said as he filled his car with gasoline in Tijuana on Friday. In southern Arizona, Nogales businessman Jim Price said he was not planning to fill up in the namesake city in Mexico any time soon. “The last time I went to fill up .... at the south end of Nogales, there was a big shoot out next door the next morning, so I said ‘the heck with it,’” Price told Reuters. “It’s not worth it.”

1872 mining law threatens Grand Canyon By DEBORAH ZABARENKO WASHINGTON — A U.S. law from the pick-and-shovel days of the Western frontier now threatens natural treasures including Grand Canyon National Park as mining claims on public lands proliferate, an environmental group said on Friday. The 1872 Mining Law, signed by President Ulysses S. Grant, allows mining companies — including foreignowned ones — to take about $1 billion a year in gold and other metals from public lands without paying a royalty, according to a report by the nonprofit Pew Environment Group. “The law was enacted ... to encourage the development of the West and ... rewarded
those people who trekked across the frontier and gave them the right to mine gold, silver, whatever other valuable metals they could find on public land in unlimited amounts for free,” said Pew’s Jane Danowitz. While the law has remained largely unchanged, the mining industry has expanded so that now multinational corporations still enjoy “basically free access to a majority of public lands,” Danowitz said in a telephone interview. She said the government estimates these companies legally take at least $1 billion a year worth of gold, uranium and other metals from public lands without compensating U.S. taxpayers. This contrasts with the oil, gas and coal industries, which have paid royalties to
the U.S. Treasury for decades. As prices for uranium and other metals have risen steeply in the last decade, mining claims near the Grand Canyon and other natural landmarks have soared, according to the report. Federal data show that more than 8,000 mining claims have been staked in national forest and other public land around the Grand Canyon since 2004, an increase of 2,000 percent, while more than two-thirds of the claims on public lands near Yosemite National Park and 99 percent of claims surrounding Arches and Canyonlands in Utah have been staked since 2005. Another air controller sleeps; U.S. to change scheduling By JOHN CRAWLEY WASHINGTON — U.S. aviation regulators, investigating unsettling disclosures of sleeping air traffic controllers, will ban scheduling practices most likely to result in drowsiness at work. The Federal Aviation Administration also said on Saturday it had suspended a controller in Miami for nodding off on the job, the fifth incident of that type identified in recent weeks and the second at a major center. “We will do everything we can to put an end to this,” FAA Administrator Randy Babbitt said in a statement.
The string of cases, including one at Washington’s Reagan National airport where the lone controller fell asleep on the March 23 midnight shift with two jetliners en route, have alarmed regulators and safety advocates and raised questions about scheduling.
The FAA official responsible for overseeing the day-today operations of 15,000 controllers at more than 400 airports resigned on Thursday. The agency also ended the practice of staffing overnight shifts with one controller, which had occurred at more than two dozen airports.
Those were mainly small centers with very light traffic after midnight. In addition, the FAA said on Saturday it would by early this week prohibit scheduling practices most likely to result in tired controllers. Any changes must be negotiated with the union representing controllers, but they could include doing away with midnight schedule swaps, curbing efforts to compress work schedules, or eliminating cases where controllers end one shift and then report for another after a short period. “We are taking important steps today that will make a real difference in fighting air traffic controller fatigue. But
we know we’ll need to do more,” Babbitt said. Controller schedule changes would not reduce tower operations, which would affect airline flights. The biggest centers, like New York, Chicago and Los Angeles, have more than one controller on duty at all times. This also includes Miami, where FAA on Saturday said it suspended another controller for sleeping on the job at an air traffic facility that handles aircraft routing. A preliminary review of the incident showed the controller did not miss any radio contact from aircraft and that no flights were affected. There were 12 controllers on duty at the time, the FAA said.

Nigeria’s Jonathan set for victory in election By MATTHEW TOSTEVIN & NICK TATTERSALL ABUJA President Goodluck Jonathan took an unassailable lead Sunday as votes were tallied from around Nigeria, despite a strong showing by rival Muhammadu Buhari in his mainly-Muslim strongholds. Buhari, a former military ruler from the arid, dustblown north, was hoping to at least force a second round against Jonathan, the first head of state from the swamps and creeks of the oil-producing Niger Delta. But that looked impossible with a Reuters tally of results from 32 of 36 states across Africa’s most populous nation showing Jonathan on 21.2 million votes to 10.8
million for Buhari. There were not enough registered voters in the remaining states for Buhari to make up the difference. Observers called the election the fairest for decades. But there were still some accusations of malpractice and very high turnout figures in Jonathan’s heartland, which could fuel suspicions and inflame tempers when the full count is in. Jonathan’s officials said there would be no victory claim until results were announced by the Independent National Electoral Commission. They were clearly upbeat. “This is no time for triumphalism. It is a time for deep reflection, for strengthening the bond of our union and for all of us to work together,” Oronto Douglas, a senior advisor to Jonathan, told Reuters. The president did particularly well in his predominantly Christian south, while
Buhari swept many northern states in the country of 150 million people. To avoid a run-off, the winner must get a simple majority and at least a quarter of the vote in 24 of the 36 states. Jonathan already had that margin in enough states. CHALLENGES An outright win for Jonathan could ease worries over potential disruptions to crude exports from Africa’s biggest oil producer and lift local financial markets awaiting the end of a series of elections. But the voting made clear the challenge of ethnic and religious polarization facing the election winner alongside the need for reforms to Africa’s third-biggest economy, held back by poor infrastructure, mismanagement and corruption. “While a near term relief rally is easily plausible in Nigerian financial markets, the political impetus behind
real reform, and the extent to which theses challenges are met head-on, will be the determinant of longer term outcomes,” Razia Khan, Standard Chartered’s Africa economist, told Reuters. Heading African Union observers, former Ghanaian President John Kufuor said Nigeria appeared to have ended its reputation for badly flawed elections and could set an example for Africa with at least a dozen more African polls due this year. “I expect the developments here will have a very positive impact on the continent,” he told Reuters. It was unclear how well a victory for the candidate of the ruling People’s Democratic Party (PDP) would go down in the north, buoyed by early results showing Buhari doing very well and fearful that rigging could deny its candidate the vote. Buhari’s dominance
in parts of the north made it hard to point to fraud by the ruling party in those, but some eyebrows were raised by figures showing turnout as high as 86 percent of registered voters in Niger Delta states and the southeast. “Rigging is the stock in trade of the PDP,” said Bello Ar-Adam, a representative of Buhari’s Congress for Progressive Change. “A leopard doesn’t change its spots,” he told Reuters. The cast of the smash-hit Broadway musical “Fela!,” which chronicles the life of one of Nigeria’s greatest musicians, brought the show home on Thursday night to the New Afrika Shrine, Fela’s famed Lagos

100s of rockets found in Ivory Coast palace By MARCO CHOWN OVED ABIDJAN, Ivory Coast - While normal life is slowly returning to Ivory Coast’s main city after two weeks of urban warfare, discoveries of massive weapons caches stockpiled by ousted strongman Laurent Gbagbo show the bloodshed could have been vastly worse. The forces who forced Gbagbo from power this week say the discoveries vindicate their international bombing campaign that deprived him of the ability to use these weapons. Ministers in President Alassane Ouattara’s government toured Gbagbo’s abandoned presidential palace on Thursday. The fighters who had captured it the previous day walked them through rooms and hallways filled with more than 500 121mm artillery rockets, capable of leveling buildings and killing hundreds. Last month, the U.N. Security Council authorized military force to destroy the heavy weapons that Gbagbo’s forces had turned on the capital’s 5 million people. French and U.N. helicopters bombed Gbagbo’s residence and presidential palace as well as military camps around Abidjan this past week. Gbagbo’s advisers cried foul, accusing them of attacking nonmilitary targets and trying to assassinate Gbagbo. But Thursday’s discoveries reveal that the former president, who managed to stay in power five years beyond his elected mandate and stubbornly refused to step down after losing last November’s presidential elections, was preparing to defend his power at all costs, officials said. “We have here significant stocks of heavy arms, which shows clearly that the U.N. Fela himself was jailed dozens of times by military rulers in the 1970s and 1980s. In one event recounted in the Broadway show, he was caught with marijuana which he then swallowed. After bringing him to jail, the authorities demanded a stool sample for inspection, an order that prompted him to write another of his best-known hits, “Expensive Shit.” AFROBEAT RENAISSANCE?

Four opposition parties merge to contest elections in Guyana GEORGETOWN, Guyana — Four opposition parties in Guyana are working together to form an alliance to oppose the governing People’s Progressive Party Civic (PPPC) in the upcoming general elections. The presidential candidate for the main opposition party, David Granger, said that his party agrees in principle to the coalition, which would have to be formally ratified by Congress — the highest decision making body of the party. The four parties, the PNCR, Working
People’s Alliance (WPA), National Front for Alliance, (NFA) and the Guyana Action Party (GAP), are now defining the identify for the coalition. The other opposition party, the Alliance for Change (AFC), has already announced that it will not merge with either the PPPC or the PNCR. Meanwhile, the PPPC has formally endorsed Donald Ramotar as its presidential candidate — accepting the nomination made by the Central Executive of the governing body. The four other nomi-
nees, Ralph Ramkarran, Clement |Rohee, Gail Teixeira, and Moses Nagamootoo, have dropped out of the race, allowing Ramotar, who is the general secretary of the party, to be nominated unopposed. Days after Ramotar’s nomination, President Bharrat Jagdeo hit the campaign trail, electioneering for the 61year-old Essequibian, who Jagdeo said is the best person for the job because of his political experience. Nagamootoo, who has been sidelined by the Executive of the
PPPC, has been at loggerheads with Jagdeo for a number of years, but Ramotar told reporters that he would invite the journalist/attorney to assist him in his campaign. However, when asked if he would campaign for Ramotar, Nagamootoo declined to comment, but he told his friends that he was a PPPC all his life and he would continue to support the party he struggled with for five decades. Elections must be held before the end of the year.

OAS signs firearms marking agreement with St. Kitts-Nevis and St. Vincent WASHINGTON — The General Secretariat of the Organization of American States (OAS) and the governments of St Kitts and Nevis and St Vincent and the Grenadines on Friday signed a cooperation agreement for the implementation of the project, “Promoting Firearms Marking in Latin America and the Caribbean,” at OAS headquarters in Washington, DC. During a signing ceremony, OAS secretary general José Miguel Insulza expressed satisfaction with the initiative and explained that with this project “we aim to provide thirty countries with marking equipment, training and computer aid necessary for proper record keeping of the weapons that they mark, and that they confiscate illegally.” Insulza also remarked that “over the last decade reported murders in CARICOM member states of the OAS have doubled. This violence is something that no Caribbean country produces, they don’t produce drugs and they don’t manufacture weapons and in spite of that they are being attacked by this evil that is dangerous in the region.” “St Vincent and the Grenadines and St Kitts and Nevis are number six and seven in signing this cooperation agreement and I hope that many countries will come forward to do the same,” noted the secretary general. The permanent representative of St Kitts and Nevis to the OAS, Ambassador Jacinth Lorna Henry-Martin, thanked the hemispheric institution and the United States for the funding provided and stated that “the marking of fire arms
for us provides an opportunity for the setting of standards in controlling and tracking the arms that circulate within our subregion and our hemisphere. It requires licenses, serves to provide checkpoints and establishes a mechanism for information sharing between the member states of the OAS.” Similarly, the permanent representative of St Vincent and the Grenadines to the OAS, Ambassador La Celia A. Prince, highlighted the importance of the agreement and affirmed that “we now have the facility to mark the firearms that come into our country and by tracing it we believe that we will be able to stem the urgency of the problem.” Prince was also grateful to the OAS and the US State Department for “making this cooperation agreement a reality to ensure our citizens’ security in the Grenadines and within the hemisphere”. For his part, Steven R. Costner, deputy director of the Office of Weapons Removal and Abatement of the US Department of State, congratulated the two Caribbean nations for “taking this important step” and emphasized the significance of the initiative: “to be able to properly trace illicit weapons we need to have effective record keeping and to have recording keeping it is very important to be able to properly mark those weapons. So this is a very important process that can help identify where illicit weapons come from, potentially address sources, trafficking routes and give us better information so we can collectively combat such illicit trafficking.”

Beyonce hires 200 African dancers for new video Beyonce reportedly flew 200 African dancers to Los Angeles, according to Sister 2 Sister magazine. A source said the dancers will help her incorporate some of their native moves into her “Girl” music video. A commenter on Beyonce’s fan site gave more details, saying: “My friend got there and there were like 200 or more people in the room. A lot of Bey’s old dancers and probably every major dancer and choreographer you could think of. The song is called “Girl”. The video is being directed by Francis Lawrence. He was also there. 8 or 9 choreographers contributed to the routine. Danielle Polanco and Luam were 2 of those choreographers. Beyonce was there of course going over the routine and they were figuring out which pieces of the choreography they would be showcasing in the music video. The theme of “Girl” is like a female empowerment/girl power type of song that is a definite club banger with Top 40/Worldly appeal. The beat is driven by a sample of a popular club song that a lot of you will probably recognize. There’s a breakdown in the song that is described as absolutely fucking disgustingly sick! Report: High bacteria levels in meat at U.S. stores By AMAN ALI Researchers have found high levels of bacteria in meat commonly found on U.S. grocery store shelves, with more than half of the bacteria resistant to multiple types of antibiotics, according to a study released on Friday. While the meat commonly found in grocery stores is still safe to eat, consumers should take precautions especially in handling and cooking, the chief researcher for the study said. The study by the ArizonaTranslational based Genomics Research Institute (TGen, or TGRI) examined 136 meat samples from 26 grocery stores in Illinois, Florida, California, Arizona and Washington D.C. Dr. Lance Price, the head researcher on the study, said high levels of Staphylococcus aureus (S.Aureus) bacteria were found in the meat. “Staph causes hundreds of thousands of infections in
the United States every year,” Price said in an interview. “It causes a whole slew of infections ranging from skin infections to really bad respiratory infections like pneumonia.” Staph infections also kill more people in the United States each year than HIV, he said. A spokeswoman for the Food and Drug Administration said that the agency was
aware of the TGen findings, and similar studies of antibiotic-resistant bacteria in meats, and was working with the U.S. Agriculture Department and Centers for Disease Control and Prevention on the causes and effects. “FDA has been monitoring the situation. The TGRI study points out that the public health relevance of the findings is unclear. FDA continues to work with CDC and
USDA to better understand this issue,” the FDA spokeswoman said. Price said the most significant findings from the study aren’t the level of bacteria they found, but rather how the bacteria in the meat was becoming strongly resistant to antibiotics farmers use to treat the animals they slaughter. The study found that in 96 percent of the meats with staph bacteria the bacteria were resistant to at least one type of antibiotic, and 52 percent were resistant to three or more types. “The bacteria is always going to be there. But the reason why they’re resistant is directly related to antibiotic use in food animal production,” Price said. “Antibiotic resistance is one of the greatest threats to public health we face today.” “This is one more reason to be very careful when you’re handling raw meat and poultry in the kitchen,” Price said. “You can cook away
these bacteria. But the problem is when you bring in that raw product, you almost inevitably contaminate your kitchen with these bacteria.” Washing hands and counters before and after handling meat and keeping other foods away from uncooked meat are ways to prevent disease from spreading, Price said. But consumer initiatives aren’t going to solve the bigger problem, he said. “To put it all on the consumer is really directing blame at the wrong end of the food chain,” Price said. “The bacteria is always going to be there, but the reason why they’re resistant is directly related to antibiotic use in food animal production.” Of all the types of meats where bacteria was resistant to three or more antibiotics in the study, turkey was the most resistant, followed by pork, beef and then chicken. Price said it’s not clear why turkey was the most resistant.
FDA orders safety studies for some asthma drugs By ESHA DEY and BILL BERKROT WASHINGTON/NEW YORK — U.S. health regulators have ordered drugmakers to conduct clinical trials involving a total of 53,000 patients to test the safety of a controversial class of inhaled asthma drugs that are already on the market. The trials are being required to demonstrate the safety of medicines known as long-acting beta-agonists (LABAs) when used in combination with inhaled steroids, another class of asthma drugs, the U.S. Food and Drug Administration said on Friday. LABAs to be studied are AstraZeneca’s Symbicort, GlaxoSmithKline’s Advair Diskus, Merck & Co’s Dulera, and Novartis AG’s Foradil. LABAs have long been under FDA scrutiny as they can increase the risk of severely worsening asthma symptoms that can lead to hospitalizations and death. The drugs work by relaxing the muscles of the airways to help people breathe easier and are also used to treat the serious lung condition, chronic obstructive pulmonary disease (COPD).
The FDA expects to receive results in 2017 for the studies that will begin later this year. In four of the trials sought by the FDA, each of the LABAs plus a corticosteroid will be compared with the steroid alone in patients 12 years of age and older. Those studies are expected to include a total of 46,800 patients. Some of these drugs. such as Advair and Symbicort, are
combination drugs that include a LABA with a corticosteroid. The agency has also asked for a trial of 6,200 younger patients, aged 4 to 11, using Glaxo’s Advair Diskus. The huge size of the studies signals that FDA wants to be completely sure about the safety profile of these drugs as they are used so widely, Morningstar analyst Damien Conover said. Such a large study popu-
lation might pose some financial challenges for the drugmakers, he said. “Glaxo is complying with the FDA request to implement the Phase 4 study,” Glaxo spokeswoman Lisa Behrens said of the postmarketing trial. AstraZeneca said it was finalizing study protocol with the agency and supports efforts to address any questions regarding use of its drug.
Novartis said it was reviewing the post-marketing requirements issued by the FDA, while Merck said it would have a comment shortly. The FDA last June issued warnings on LABAs, saying they should never be used on their own to treat asthma and called on drugmakers to conduct further studies to better understand the safety of LABAs when used with inhaled steroids.

the dietary guidelines for preventing cancer and heart disease, including: Plenty of fruits, vegetables and other plant-based foods. Using herbs and spices to flavor foods instead of salt. Limiting consumption of red meat and alcohol. Using healthy fats such as olive and canola oils instead of butter. Eating fish and poultry at least twice a week. Another good diet is the whole-body type of diet, which involves eating six to seven small meals a day instead of the usual three large meals. It offers the following cancer prevention
benefits: Fruits, vegetables and whole grains in at least half your daily meals. Limiting foods high in fats. Eating lean protein. Daily physical activity. “Diet plans that encourage short-term change usually don’t provide the nutrients your body needs on a daily basis. These diets make our ‘bad’ list,” Amin said in a cancer center news release. Gluten-free diets are becoming popular but people shouldn’t go gluten-free unless they have celiac disease, Amin advised. Going gluten-free means avoiding foods with whole grains,
which are high in fiber, vitamins and minerals — all of which protect cells from damage that can lead to cancer. Carbohydrate-free diets are another bad choice. Completely eliminating carbohydrates deprives the body of its primary source of energy and of some important cancer-fighting foods — vegetables, fruits, whole grains and beans. “Instead of going carbfree, choose your carbohydrates wisely. Pick whole grains rather than cakes, cookies and other foods made with processed or refined grains and sugars,” Amin suggested.

Reputed gangster convicted of Irvington robbery, but jury deadlocks on four killings By ALEXI FRIEDMAN IRVINGTON - One witness testified that Rolando Terrell pressed a 9 mm handgun to Candes McLean’s neck, stepped back and fired a fatal shot into her head. Seconds later, the witness said, Terrell shot and killed her daughter and niece, both 18, and her boyfriend’s 13-yearold daughter, then set fire to the Irvington house. Authorities called the Sept. 8, 2008 quadruple killing on Columbia Avenue among the most horrific in recent memory. But despite testimony from Terrell’s admitted accomplice and from the lone surviving victim both of whom identified him as the killer - a jury in Newark Tuesday deadlocked on the top counts of murder against the reputed Bloods gang member.
The deeply divided panel returned a partial verdict, finding Terrell guilty on five of 16 counts, including two robbery charges, conspiracy to commit arson and two related gun possession offenses. The same jury later convicted him of possession of a weapon by a convicted felon in a separate, 45minute trial that immediately followed. Superior Court Judge Joseph Cassini III declared a mistrial only on the unresolved charges, including four counts of murder and four counts of felony murder. Killed were McLean, 40; her 18-year-old daughter, Talia McLean; her niece, Zakiyyah Jones, also 18; and 13year-old Latrisha Carruthers-Fields, her boyfriend’s daughter. The judge ordered them to continue deliberating and they did. Katherine Jackson fighting son’s estate Over Heal the World charity Michael Jackson’s estate and his mother Katherine are locked in a battle over the non-profit Heal the World Foundation, which claims it’s the successor to the King of Pop’s defunct charity inspired by the song. At stake in the skirmish, according to the AP, are trademarks worth millions of dollars and a piece of Jackson’s legacy. The dispute, which is playing out in a federal court in Los Angeles, has raised questions about which causes the singer would want to focus on if he hadn’t abandoned his charity to fight off allegations of child sexual abuse. Katherine left little doubt about where her sentiments lie in a recent court filing: “It is not my desire, nor would it be the desire of my son Michael, to continue this lawsuit against Heal the World Foundation.” Last year, Jackson’s mother and father joined Heal the World’s board of directors and elected to have their three children added to a youth board. Jackson’s
mother and his children were prominently featured on a recent “Good Morning America” story that also included footage of Heal the World giving a $10,000 donation to a shelter in Los Angeles. It was a high-profile plug for an entity that according to tax filings reviewed by The Associated Press has done little fundraising or charitable giving, but has fought to stake its claim to several Jackson-related trademarks and likeness rights that the singer’s estate maintains it should own. The foundation’s director, Melissa Johnson, claims the pop singer handed her control of Heal the World through intermediaries in 2005, when he was defending himself against child molestation accusations. Despite never having personally met the singer, Johnson’s attorneys claim she has the right to manage the charity, use various trademarks and that the permission now comes from the Jackson family itself.
The singer’s estate counters that even if Michael Jackson granted Johnson rights to the charity, which it denies, the estate has revoked the permission and Johnson should be barred from using Jackson’s name, likeness, and the name Heal the World for any future endeavors. The estate owns Jackson’s likeness rights and numerous trademarks and copyrights that have been used to market new products since his June 2009 death. “People are saying I have been manipulated by Melissa Johnson and that we are exploiting my grandchildren because we joined Heal the World, all while the executors convince people they are only doing what Michael wanted or what is in my best interests by suing everyone who help (sic) us,” states Katherine Jackson’s declaration, which was offered as sworn testimony in the case. “Please do not believe them. It’s not true.” Complicating Katherine Jackson’s involvement with
the foundation is her busirelationship with ness Howard Mann, a businessman who obtained some of Jackson’s recordings years ago. Mann, who is paying to defend Heal the World in court, is also being sued by the estate in a separate lawsuit that accuses him of infringing on estate copyrights. The singer’s estate, which has paid millions in the nearly two years since the pop singer’s death to support Katherine Jackson and her grandchildren, claims the organization is trying to supplant the trademarks and has no legitimate affiliation with the singer. The estate won a preliminary injunction in April 2010, barring Heal the World Foundation from using Michael Jackson’s name, likeness and trademarks on its website, but in recent weeks several of the pop singer’s former confidantes and his mother have cast their support with Johnson. The lawsuit has reignited division between Jackson’s family and the overseers of his estate, namely co-executor John Branca. Branca was Jackson’s longtime attorney, but did not work with him for several years until being re-hired shortly before the singer’s death.

RIM’s email-less PlayBook gets tough reviews By ALASTAIR SHARP and LIANA BAKER TORONTO/NEW YORK — RIM’s PlayBook tablet bombed with influential technology reviewers who called the iPad competitor a rushed job that won’t even provide RIM’s vaunted email service unless it’s hooked up to a BlackBerry. The poor initial response to a device the company hopes will get it onboard the tablet computing explosion overshadowed a splashy coming-out party in New York Thursday evening, where co-CEOs Jim Balsillie and Mike Lazaridis drummed up the gadget’s attractiveness with corporate users. There was little mention of the stinging reviews only hours before. “RIM has just shipped a BlackBerry product that cannot do email. It must be skating season in hell,” New York Times’ David Pogue wrote in a review published on Thursday. Research In Motion built its reputation on a BlackBerry email service that it says is so
secure that it can’t bow to government requests to tap messages, winning high-profile customers in business, defense and politics before branching out to a wider consumer market. But the PlayBook, which hits North American store shelves on Tuesday, offers that secure service only in tandem with a BlackBerry. RIM says secure email and other key services will come later, not at launch. “I got the strong impression RIM is scrambling to get the product to market,” Walt Mossberg, the widely followed business and consumer technology critic, wrote in a Wall Street Journal article headlined “PlayBook: a tablet with a case of codependency.” The pessimism of the reviews seemed to hit RIM’s often volatile shares, which fell 1.7 percent to $53.92 on the Nasdaq on Thursday, the lowest closing price since Oct 25. It fell a further 1.1 percent in after-hours trading. RIM’s 7-inch WiFionly device is priced identically to Apple’s 10-inch market leader and faces tough me-too competition from a slew of devices running
Google’s Android software. It is a first step in a major product overhaul intended to reinvigorate RIM’s fortunes. But the lukewarm initial reception, coupled with an outburst from Lazaridis that went viral on Youtube, cast a shadow over the coming-out party. Most reviewers have been impressed by the PlayBook’s well-documented capability to handle Flash websites and its ability to show one high-definition image — a movie, for instance — on a connected TV, while doing something else on its own screen. Internet gambling sites owners charged with fraud The owners of three of the largest Internet poker companies operating in the United States were accused on Friday of tricking regulators and banks into processing billions of dollars of illegal Internet gambling proceeds. Eleven people, including the owners of Full Tilt Poker, Absolute Poker and PokerStars, were charged with violating U.S. anti-Internet gambling laws, according to charges filed by federal prosecutors in Manhattan. Prosecutors also filed civil money laundering charges seeking to recover at least $3 billion from the companies, which are all based overseas, court documents said.
The Internet domain names of the companies were also seized. Representatives for the companies could not immediately be reached to comment on the charges. Two of the men were arrested on Friday, one is expected to turn himself in to law enforcement and eight others are not currently in the United States, prosecutors said. Raymond Bitar, 39, of Full Tilt Poker and Isai Scheinberg, 64, of PokerStars were charged with violating the Unlawful Internet Gambling Enforcement Act and other laws. Absolute Poker owners Brent Beckley, 31, and Scott Tom, 31, faced similar charges. The criminal charges
outlined a scheme by the company owners and some of their employees to direct the gambling profits to online shell companies that would appear legitimate to banks processing payments. The charges are part of a crackdown on Internet gambling in the United States, where it has been illegal since 2006. In March, Wynn Resorts Ltd said it had entered into a partnership with PokerStars, and that they would work for passage of U.S. legislation on Internet poker. U.S. lawmakers have in the past tried to pass legislation legalizing Internet gambling in the hope of reaping billions in tax revenue.

But the gadget’s camera app failed in the middle of the demo. “I broke the camera app, the rendering isn’t working. Bring me a new one,’ he said to a nearby media relations executive. RIM says the PlayBook and its brand-new QNX-based platform will launch with around 3,000 apps, the third-party tools that have helped make Apple’s iPhone and iPad so successful. That number will grow in coming months as RIM adds support for Android apps and those available on its smartphones. The iPad has a library of more than 65,000 apps. It’s too little for

U.S. prods companies to develop secure, easy-use ID WASHINGTON — The Obama administration urged the private sector on Friday to develop methods that consumers can use instead of passwords to identify themselves online and, in some cases, in brick and mortar stores. “The Internet has transformed how we communicate and do business,” said President Barack Obama in a statement accompanying release of a national strategy to safeguard identity on the Internet. “But it has also led to new challenges, like online fraud and identity theft, that harm consumers and cost billions of dollars each year,” the president said. As part of the strategy, the Commerce Department is asking
the private sector to create a system or systems that can identify Internet users in a way that safeguards their privacy, is secure, is interoperable and is cost-effective. Participation would be voluntary. “Consumers who want to participate will be able to obtain a single credential — such as a unique piece of software on a smart phone, a smart card, or a token that generates a one-time digital password,” the Commerce Department said in a statement. Millions of people are victims each year of identity theft, which costs victims an average of $631 and 130 hours to recover from, the Commerce Department said. Earlier this month, a long list of hotels,
financial institutions, retailers and others revealed that customer names and email addresses had been stolen by hackers, giving the criminals useful information to be used in identity theft. The strategy is a way to eliminate passwords — which are unwieldy for users and ineffective in many cases — to have them go the way of the dodo. But the Commerce Department is also keenly aware that any attempt by the federal government to create a national identity card would be extremely controversial. Companies at a Chamber of Commerce event to kick off the effort included Google, Symantec, eBay subsidiary PayPal, Microsoft and Northrop Grumman Corp.

World finance chiefs chastise U.S. on budget gap By LESLEY WROUGHTON WASHINGTON — World finance leaders on Saturday chastised the United States for not doing enough to shrink its massive overspending and warned that budget strains in rich nations threaten the global recovery. Finance ministers in Washington for semiannual talks took sharper aim than in previous years at the United States’ $14 trillion debt. While most of the criticism came from emerging market economies, some advanced nations joined the chorus. Dutch Finance Minister Jan Kees de Jager warned that if the United States and other advanced nations move too slowly it could undermine confidence in the global economy. “Insufficient budgetary consolidation may spark off further escalation of debt sustainability issues, with
repercussions on confidence and the still fragile financial sector,” de Jager told the International Monetary Fund’s steering committee. “Debt dynamics in other advanced economies, including the United States, are of concern.” The IMF this week said the U.S. budget deficit was on course to hit 10.8 percent of nation’s economic output this year, tying with Ireland for the highest deficit-to-GDP ratio among advanced economies. It urged Washington to move quickly to put a credible plan in place to tighten its belt. Brazil’s finance minister, Guido Mantega, offered sharp words in a thinly veiled attack on the United States. “Ironically, some of the countries that are responsible for the deepest crisis since the Great Depression, and have yet to solve their own problems, are eager to prescribe codes of conduct
to the rest of the world,” he said. The Group of 20 countries agreed on Friday to a plan that could put more pressure on the United States to fix its deficits as well as push other leading economies to address their own shortcomings. The IMF’s advisory panel on Saturday said issues of financial stability and sovereign debt stability must be addressed, saying in a communique that “credible actions are needed to accelerate progress.” It emphasized the need for fiscal consolidation in advanced economies while avoiding overheating in emerging economies. The Obama administration and the U.S. Congress are locked in battle over how best to fix the deficit. Republicans are pushing for deep spending cuts as part of the argument over raising the nation’s $14.3 trillion debt limit, something which is needed to avoid an unprecedented

President Barack Obama, who has offered a competing vision to curb deficits by $4 trillion over 12 years, said on Thursday the Republican plan would create “a nation of potholes.” The White House is wary about cutting spending sharply while the economic recovery remains fragile. Treasury Secretary Timothy Geithner told fellow finance ministers on Saturday caution was needed. “We are committed to fiscal reforms that will restrain spending and reduce deficits while not threatening the economic recovery,” he said. U.S. closes six banks, bringing 2011 total to 34 WASHINGTON — U.S. authorities closed six banks on Friday, bringing the total number of foreclosures in 2011 to 34. The largest of the shuttered banks was Superior Bank of Birmingham, Alabama with about $3.0 billion in assets and $2.7 billion in deposits, the Federal Deposit Insurance Corporation said in a release. A newly chartered bank subsidiary of Community Bancorp LLC of Houston, Texas, called Superior Bank, N.A. will assume the failed bank’s deposits, the FDIC said. The bank is the largest to be closed by regulators this year, as measured by total assets. In January, a New Mexico bank with $2.31 billion in assets was closed. Most of the banks that have failed so far in 2011 have had less than $1 billion in assets. Washington Mutual, which had $307 billion
in assets when it was seized in September 2008, remains the largest bank to fail during the financial crisis. In 2010, 157 banks with total assets of $92 billion failed. That compares to 140 banks failing in 2009 with total assets of $169.7 billion. FDIC Chairman Sheila Bair has said the agency expects the number of failures to drop in 2011. Community banks continue to struggle with the weak economy and many are facing problems related to their exposure to the commercial real estate market. The FDIC is pursuing lawsuits against failed banks and expects the caseload to be at least as heavy as after the savings and loan crisis of the 1980s and 1990s, Bair said on Friday. The FDIC has said it anticipates bank failures will cost the industry-funded insurance fund about $45
billion from 2010 through 2014, compared with a prior estimate of $52 billion. Day 2 of NFL mediation ends; talks resume Tuesday By DAVE CAMPBELL MINNEAPOLIS Negotiators for the NFL and its locked-out players wrapped up a second day of courtordered talks Friday with no signs of significant progress. They plan to sit down again next week. The two sides left the federal courthouse in Minneapolis after about four hours of talks, following nine hours of meetings on Thursday. They will meet again Tuesday. Hall of Famer Carl Eller, who is representing retired players in the antitrust lawsuit against the league, said he thinks the two sides are “moving forward” but the process “slowed a little bit” Friday. “There is progress, but it wasn’t like we’re right around the corner,” Eller said. “We could resolve it if we had met on the weekend, but maybe not.” U.S. Magistrate Judge Arthur Boylan, who is overseeing the sessions, assigned some weekend homework,
according to Michael Hausfeld, an attorney for the players. “The judge has asked us to provide answers to over a half-dozen questions that he’s asked,” Hausfeld said, declining to provide details. “There’s a lot of work.” With the 2011 season in jeopardy, Boylan is overseeing this round of talks after 16 days of mediated sessions in Washington failed to secure a new labor pact. “We need to have some productivity,” Eller said. “We need to come out of here with something, and I think that there is a sense of realism on the judge’s part. It’s not just talk. Just getting together to talk is not productive.” U.S. District Judge Susan Richard Nelson, who ordered the mediation, is still considering a request from the players to lift the lockout imposed by the owners. After an April 6 hearing, she said she planned to rule on the injunction request in a couple of weeks - which would mean next week. Players including MVP quarterbacks Tom
Brady and Peyton Manning filed the request along with a class-action antitrust suit against the league. The lawsuit has been combined with two other similar claims from retirees, former players and rookies-tobe, with Eller the lead plaintiff in that group. NFL commissioner Roger Goodell, four team owners and several league executives and lawyers left the building without speaking to reporters. NFL spokesman Greg Aiello, via e-mail, declined to comment. DeMaurice Smith, the NFL Players Association executive director, also refused to talk. He left the courthouse with lawyers and linebackers Ben Leber and Mike Vrabel, two other plaintiffs in the antitrust suit filed March 11 when the last collective bargaining agreement expired, the union dissolved and the lockout began. At least the mood appeared light. Reporters staking out the closed-door session were greeted with smiles and goodbyes
from negotiators and attorneys as they departed. In a packed elevator on the way down to the lobby, Smith needled Vrabel by deadpanning to media members inside, “All right, in all seriousness, Mike is going to have a statement. You ready?” Silence. Then laughter. The NFL’s first work stoppage since the 1987 strike, of course, is no joke for either side especially for the fans who pay to sit in the seats at sparkling new stadiums, buy replica jerseys to show their support and watch outof-market games on satellite television. “I’m a fan, too,” Eller said earlier this week. “We would like to ease their minds. We can’t tell them the outcome, but we are very interested in having a football season.” That’s one shared goal between the two sides. With the dispute now in court, public relations is a major part of the effort for each side - through press releases, links and comments on Twitter, and
communicating directly to the public in the push to get the message out. “We’re going to make sure we have football, and more of it,” Goodell said this week in a concall with ference Cleveland Browns season-ticket holders. Said Smith after the April 6 hearing in Nelson’s court: “Keep rooting for the players, and keep rooting for football.” Spin and rhetoric has been intense at times from both corners, but Aiello said the league doesn’t view this as a public relations battle with the players. “Our job always is to keep fans informed,” Aiello said. “That is what we’re doing in this situation.” NFLPA spokesman George Atallah didn’t return messages this week. The players have a website, nfllockout.com, that highlights community outreach and charitable efforts by the players and includes talking points for their side. The NFL website, nfllabor.com, is a simi-
lar version for the league. Lead negotiator Jeff Pash recently wrote an op-ed column in the Chicago Tribune, stressing concessions the NFL has made with a list of highlights of its latest offer before talks broke down. Eller sounded optimistic, not only about the progress but the opportunity to represent his fellow retired players, who have pushed for better benefits and care from the league for years. “We don’t drive this. We need them both,” said Eller, referring to the current players and the league owners. “Our needs hinge on both of them. It’s not an either-or situation for us. ... “What I want the retirees to understand is that we are carving a unique situation. ... We’re at the table, and I think this is something that they ought to be able to rejoice at an early stage, because where we go from here, it’s going to be a major move.”
Lewis Hamilton edges Sebastian Vettel SHANGHAI — McLaren driver Lewis Hamilton overcame a prerace mechanical drama to win a thrilling Chinese Grand Prix on Sunday, passing Red Bull’s Sebastian Vettel for the lead with five laps remaining. Vettel made a strong bid for three straight wins to start the Formula One season but he could not hold off Hamilton, who made one more pit stop than the German and had fresher tires at the end. “It was one of the best races I have experienced,” said Hamilton, whose last victory was last year’s Belgian GP. “It feels amazing to be able to bring it home. I
am absolutely overwhelmed. It feels like a long, long time [since winning]. I am so proud and extremely grateful.” Red Bull’s Mark Webber, who started 18th, made a remarkable charge to the front to finish third. Vettel, who has 12 victories in 65 career starts, was trying to become the first driver since Michael Schumacher in 2004 to start the season with three straight victories. Hamilton came close to being out of contention before the race even started, when a fuel leak was discovered in his engine. McLaren mechanics
worked frantically in the garage with the seconds ticking down until the pitlane closed. Had they missed the deadline, Hamilton would have started from pitlane rather than third on the grid. They sent him out on the installation lap with only one minute to spare, but with much of the engine cover missing, and that had to be drilled onto the car while it was sitting on the grid. “I had real confidence in the guys they would figure it out,” Hamilton said. “As I was driving to the light I was nervous that just as I got to it, it would go red, but fortunately I got out.”
McLaren’s Jenson Button, last year’s race winner, was fourth, ahead of Mercedes’ Nico Rosberg and Ferrari’s Felipe Massa, who all led at various stages at Shanghai International Circuit. Ferrari’s Fernando Alonso was seventh, ahead of Mercedes’ Schumacher, and Renault’s Vitaly Petrov, with Sauber’s Kamui Kobayashi taking the final point in 10th place. Vettel started from pole but was passed by both McLarens before the first corner. He managed to get ahead of both in the first round of pit stops, overcoming an odd incident in which Button mis-
takenly pulled into the Red Bull garage right in front of him, and had to be waved on to the correct space. Rosberg had already changed his tires by then and inherited the lead while the others pitted, but Vettel went ahead again after the second round of stops. Unlike McLaren, Red Bull then decided not to pit again and Vettel acknowledged after the race that the strategy of doing the final 25 laps on one set of tires “wasn’t the best.” “The pace was there, but we decided to be patient and go with two stops, and when it doesn’t work, it doesn’t work,” Vettel said. “I don’t see second today
as a disappointment.” Hamilton was fourth with 16 laps remaining and all pitstops completed. He passed Rosberg for third on lap 42, then got past Massa two laps later to move up to second, 4.6 seconds behind Vettel. Hamilton, who now has 15 career wins, whittled the gap down over the next eight laps, eventually passing Vettel comfortably on turn seven with five laps remaining. Meanwhile, Rosberg, Button and Massa were struggling on worn tires, and were swallowed up by Webber, who made an extraordinary charge through the field in the second half of the race.

Ortiz dethrones Berto in welterweight thriller MASHANTUCKET, Connecticut - Victor Ortiz dethroned previously unbeaten World Boxing Council welterweight champion Andre Berto Saturday in an action-packed 12-round fight that saw both men on the canvas. Ortiz emerged with a convincing unanimous decision, improving to 29-2-2 with 22 wins inside the distance as he captured the WBC belt. Ortiz knocked down Berto for the first time in the first round, and Berto responded by sending the off-balance challenger to the canvas in the second. Ortiz rattled Berto in the third and punished the champion in the middle rounds. The sixth was a
thriller as Berto, standing his ground in the middle of the ring, knocked down Ortiz, only for Ortiz to drop the champion later in the same round. It was Berto’s first defeat in 28 professional fights. The ringside judges scored it 115-110, 114112 and 114-111 for Ortiz, who had a point deducted in one round for hitting behind the head. “I fought like a possessed man, because that’s what the world and the crowd of boxing made me,” said Ortiz, who said he was stung by predictions that he couldn’t beat Berto. Berto had made five successful title defences since he knocked out Miguel Rodriguez in
June 2008 to take the belt. But he looked like he might not make it out of the first round on Saturday. Ortiz stunned him with a right followed by a left hook that appeared to put the champion down, although referee Michael Ortega ruled it a slip. Ortiz produced another knockdown before Berto made it out of the first. Ortiz was in control in the second when Berto backed him up with a short right. The challenger stayed on his feet and took a brief count from Ortega. Ortiz piled on more pressure in the following rounds but in the sixth Berto woke up,
punishing Ortiz before knocking him down with a right. Seconds before the bell, however, Ortiz sent Berto down with another left hook.
“I think I was very highly underrated,” the 24-year-old Ortiz said. “I knew I carried as much power as him, if not more.” Berto said he wanted

Wade misses Heat practice with migraine By TIM REYNOLDS MIAMI - One of Dwyane Wade’s biggest rivals is back, at the worst possible time for the Miami Heat. Wade did not practice Sunday because of symptoms of a migraine, a problem that has plagued him for years and kept him out of a game earlier this season. His status for Game 2 of Miami’s Eastern Conference first-round series against the Philadelphia 76ers on Monday is
unclear, prompting at least some mild concern for the Heat. “He’ll be here,” predicted Heat forward LeBron James. Heat coach Erik Spoelstra didn’t go out on that limb, saying that it’s “too soon” to know if the 2006 NBA finals MVP will be available when Miami gathers for practice Monday morning to complete preparations for Game 2. Wade told the team that he felt a headache coming on Saturday
afternoon before Miami’s 97-89 victory, playing 35 minutes without any obvious discomfort. Wade scored 17 points in that game, five of them in the final 1:34 as the Heat held off a huge comeback attempt by the 76ers. “We’ll have to see how he feels at the end of the day,” Spoelstra said. “We really wanted to be proactive right now and keep him rested and take medicine and we’ll go from there.” So while there was
some worry at Miami’s practice, the 76ers seemed totally loose at the end of their session. the 21-mile mark and finished the 26.2 miles in 2 hours, 4 minutes, 40 seconds - the fourth fastest marathon ever. He shattered the course record of 2:05:10 that Olympic champion Sammy Wanjiru set in 2009. “My dreams have come true because I had in my mind that of the five major marathons if I won one my achieve-
ment would have been greater,” Mutai said. “My aim was to win the race, not to focus on the time. ... I tried my best to push it until the end. It is fantastic because I created two achievements - I won the race and I improved my personal best.” Three-time champion Martin Lel was second in 2:05:45 after beating Patrick Makau in a
sprint in front of Buckingham Palace. Lel has been troubled by hip and leg injuries, and it was his first London Marathon since winning his third title in 2008. He only received an invitation to compete after a knee injury forced Wanjiru to withdraw. “After two years away it was important for me to have a good

Playoffs are Perkins’ time to shine for Thunder By JEFF LATZKE OKLAHOMA CITY - After two run-ins with Denver center Nene late in the season, Oklahoma City’s Kendrick Perkins hesitated for a moment when asked Saturday what he expected from the matchup in the playoffs. The two big men were literally face to face - foreheads pressed against each other in Denver less than two weeks ago, then Nene had to push his way out of a Perkins headlock in a rematch three days later in Oklahoma City. When the teams play again Sunday night in Game 1, there’s almost an expectation that the two will butt heads again. “Is this a trick question?” Perkins asked. “I don’t know. I don’t know what to expect.” The Thunder brought in Perkins for times like these. A stout defender in the low post, he brings the youthful Thunder a load of playoff experience. While most of his teammates have never made it out of the first round, Perkins has won an NBA title in Boston and went back to the finals last season. He wasn’t even healthy
when Oklahoma City sent away two starters to get him from Boston at the trade deadline. All he talked about was getting enough games under his belt so he could be ready when the playoffs started. The Thunder went 13-4 with him in the lineup, with Serge Ibaka moving from backup center to starting power forward. “He gives them a defensive presence that they didn’t have, and I think the combination of Ibaka moving in a good direction and him coming in, that’s a strong play,” Denver coach George Karl said last week. “Defensively, it’s a strong play.” Before the trade deadline, Nick Collison and Thabo Sefolosha were Oklahoma City’s only players who had ever advanced in the postseason - each reaching the second round once. And I know one thing about playing physical is that you’ve got to be willing to get hit back sometimes. “I’m just going to go out there and do what I’m doing. I can’t worry about what Nene’s doing.” And he’s certainly not ruling out any more heated exchanges. “I think all playoff games get a little chippy,” Perkins said. “This one’s not going to be any different. I think when it’s playoff time, you get a couple hard fouls. Guys are going a little harder because guys are not trying to go home. “I think if we was playing whoever, it would get a little chippy.”
Shaquille O’Neal to miss Boston’s playoff opener WALTHAM, Mass. Shaquille O’Neal will miss the Boston Celtics’ playoff opener against the New York Knicks on Sunday night with a right calf injury. General manager Danny Ainge made the announcement during practice Saturday and said “we don’t know when he’ll be ready.” Game 2 of the best-of-seven Eastern Conference series is in Boston on Tuesday night O’Neal received therapy before the practice then ran briefly before stopping because of the pain. He had missed 27 games with a sore right leg then returned on April 4 against Detroit. But he lasted just 5 minutes, 29 seconds, scoring
six points, before leaving again with the calf problem and has sat out the last six games. Team physician Dr. Brian McKeon said the injuries are related. “He’s actually made progression every day,” McKeon said, “but this is a tough injury. The blood supply in this area is so weak and so poor and (it takes) time. ... It’s just hard to get enough healing potential in that area.” He said surgery was not an option and that O’Neal would try running again when his leg strength reaches a certain level and he feels comfortable enough to do it. “He may come back in three days and feel like it’s better” and try to run again,
Ainge said. “It’s not like this magic test. The test is, `Does it hurt you? Run up and down the court and does it hurt?’ That’s the test. “We’re just day to day.” O’Neal played 37 games this season, averaging 20.3 minutes, 9.2 points and 4.8 rebounds. The Celtics signed him and Jermaine O’Neal to two-year contracts in the offseason to play center. Jermaine O’Neal was limited to 24 games by a knee problem that required surgery but has played in six of the last eight, including 36 minutes, 54 seconds in the next to last game of the season, a 95-94 overtime loss at Washington last Monday. - HOWARD ULMAN

Fairley trying not to sweat draft stock moves By JOHN ZENOR MONTGOMERY, Ala. - Not long ago, Nick Fairley was being projected as a possible No. 1 overall NFL draft pick. The former Auburn defensive tackle’s stock seems to have dipped since then among draft analysts amid questions about his work ethic, but Fairley is trying to keep his focus on landing a job and not on what people are saying about him. “If I would really pay attention to it, it would be a very stressful deal for me,” he said in a phone interview Thursday. “I really just try not to pay attention to it, to just let things flow out. They had me at the top then they dropped me down.” It’s not as if the Lombardi Award winner and defensive star for the national champion Tigers has plunged down the draft boards. He’s still widely projected to go in the top 10, with many mock drafts predicting the Tennessee Titans will select him at No. 8. Fairley has had private interviews with Denver (No. 2 pick), Buffalo (3), Cincinnati (4), Cleveland (6), Tennessee (8) and Washington (10). Fairley’s agent, Brian Overstreet of Houston, said another team picking in the top 10 has also started talks with them. ESPN draft analyst Todd McShay said there are questions about Fairley’s work ethic - “he takes more plays off than your average defensive tackle” - and the fierce pass rusher’s ability against the run. “And I also think there’s a major concern about him translating to the NFL, getting paid, having his paycheck and continuing to work,” McShay said. Fairley said those kinds of questions should be answered by the difficult route he took to Auburn, rising from a junior college player to one of the nation’s top defensive players in two years. “My work ethic’s not a problem,” he said. “I think
Nick Fairley it’s more like what you bring to the table when you’re out there on Sundays, is what the teams are looking for. I’ve been working hard since I played football, having to go the JUCO route. My work ethic shouldn’t be an issue.” He certainly made giant strides in two years at Auburn. Fairley had just 3 1/2 tackles for loss and 1 1/2 sacks as a sophomore while showing flashes as a pass rusher late in the season. It’s still a far cry from the 24 stops behind the line and 11 1/2 sacks of last season, when his quickness and explosiveness for a 6-foot-4, 291-pounder made him seem downright unblockable at times. “This past year, he just explodes on the scene,” McShay said. “Why is he just a one-year wonder? Is he going to work? You hear a lot of different things but ultimately everything comes back to whether he’s consistently working and doing the right things off the field and whether he’s going to take care of his body, show up on time, be responsible, be a leader on the defense to be a top overall pick or top 3.” McShay also said he has the ability to “come in and make a real impact if he wants to work at it.” Overstreet said he offered his client the same advice when he was projected as the No. 1 pick or “just” a top 10 guy. “We tell him to ignore them both,” Overstreet said. “The draft is really a chess match. No teams tells the others what they’re going to do. We understand the process they’re going to go through with a fine-toothed comb.

ZACH RANDOLPH SCORES 25 AS GRIZZLIES TAKE OPENER FRO M SPURS SAN ANTONIO — The Memphis Grizzlies own the first upset of the NBA playoffs, and they made history in the process. Zach Randolph had 25 points and 14 rebounds, and Shane Battier hit the go-ahead 3-pointer with 23.9 seconds left, and the eighth-seeded Grizzlies won the first playoff game in franchise history, 101-98 over the San Antonio Spurs on Sunday. Randolph, who scored nine in the fourth quarter and punished San Antonio under the basket, might have saved his hardest contact for a chest bump with Mike Conley after the final buzzer. The rest of the Grizzlies bench spilled onto the court, waving towels and leaping back into the locker room. Memphis began the playoffs with the motto “Let’s Make History,” and it needed just one game to do it. Sixteen years after the franchise debuted in Vancouver, the Grizzlies finally savored their first playoff win in 13 tries. The top-seeded Spurs didn’t stick around to watch Memphis celebrate. San Antonio had a chance to force overtime, but Richard Jefferson missed an open 3-pointer as time expired. Tony Parker led the Spurs with 20
points, but they sorely missed AllStar Manu Ginobili, who continued to rest his sprained right elbow. Spurs coach Gregg Popovich said Ginobili begged to play, and it’s safe bet the All-Star won’t have to convince Popovich for Game 2 on Wednesday. The Grizzlies spent the week insisting they didn’t tank their final two games to assure they’d get the Spurs. But the way Randolph and Marc Gasol bullied San Antonio in the frontcourt, Memphis showed that San Antonio isn’t such a bad matchup. Gasol had 24 points and nine rebounds. Conley scored 15 points and had 10 assists, and O.J. Mayo had 13 points off the bench. Tim Duncan had 16 points and 10 rebounds for the Spurs, who lost their sixth straight playoff series opener. And watching this latest one on the bench was Ginobili. The Spurs listed him as doubtful entering Sunday. But between the 33-year-old practicing a day earlier and his teammates convinced he would play, seeing Ginobili in lineup wouldn’t have been much of a stretch. Instead, Spurs coach Gregg Popovich played it safe.
