riven by the objective to be the collective force influencing and shaping the real estate industry we are pleased to launch, "Hyderabad Realty Stars 2012" with a vision in mind for giving transparent, truthful and Unbiased Rating or an Opinion Poll on the Real Estate Players and Stakeholders in the field of Realty world of Hyderabad. These RATINGS have been instituted to conduct a survey and recognize the highest level of achievement by Stakeholders operating in the Realty Sector. These Ratings are a gesture to honour the industry players for their outstanding performances, achievements and innovation in Realty sector. The real estate industry has gone to new heights in recent times, technology and artifacts are very well amalgamated, also various steps
have been taken to go green, to be environment friendly and more usage of recyclable materials. Today many of the building projects have gone totally eco-friendly in all aspects. This survey will provide a reality check on how far the Realtors have kept their promises, and how well they connect with their customers. We have taken this initiative, first time ever, in Hyderabad to conduct this survey for the benefit of our readers. We want to define real Estate brands and property ratings and make it a culture so that there is a strong urge for all real estate developers to develop and built quality buildings. We are precisely doing the survey just to bring forward the good quality builders and associated businesses, so that our ardent readers can utilize the result and make wise decisions .The quality aspect is the paramount concern of a purchaser, added to that the builder has to give the possession of the property at the stipulated time, the same holds good for the architects and land developers. With the advent of all the major IT companies and MNCs in Hyderabad city, the commercial space demand has increased many folds .The city is expanding very rapidly and almost all major realty companies in India have their presence in this city. Also the demands for good Interior designers are increasing, clients want their offices to be designed very esthetically, and hence the competition among them is also increasing. There is a need to follow a code of conduct among the companies and hence a survey is needed to bring out the best in the business. As we all know that our city has got pockets of hilly areas, the scope for landscaping activities are in demand that is the reason we have incorporated landscape developers also in our survey. As our city gradually emerges from the three year old slump, it is time to recognize the efforts of the real estate community in putting Hyderabad on the global list of emerging cities. The landscape of this historic city has been transformed to world standards by the entrepreneurial spirits of many, backed by proactive government support. Hyderabad is now truly a cosmopolitan metropolis and amongst the fastest growing in our country. The city has weathered political uncertainties as well as global melt downs, emerging stronger than ever. The coming years is expected to revive the traction that we witnessed in the past. Being a responsible real estate magazine, we understand the business dynamics with solutions to identify the most trustworthy and best brands of Hyderabad. We feel proud and honoured to announce that we are conducting a Real Estate Property Survey to select the 2012 Best Brands of Hyderabad Realty in all aspects, which will be declared in the beginning of the year 2013 after the observations made by a panel of jurists who are the eminent personalities of the city. Along with all these we also collect the market and customer feedback. We have a well research team who will look into all the minute technical details and a very dedicated team of energetic persons to complete the survey process. This all survey data will be put forward to our panel of very distinctive judges who in turn will evaluate the contents and come to an unbiased conclusion. The decision will be totally impartial and all integrity will be maintained. Our research team has tabulated a very detailed questionnaire covering all the aspects of real estate business and their technicalities. A very dedicated team of surveyors will interview various persons cutting across all sections of the society, be it an employee of a MNC or a businessman, a professional or a common street dweller. Up to now, no rating agency has taken public opinion as a parameter for grading Real Estate Company. REPORTCARD Real Estate Bulletin bestows the report card of the first-ever CREDAI Property Show held at People's Plaza, in the heart of the city of Hyderabad from 2nd to 4th November 2012 at HITEX, Hyderabad. This will be helpful to the readers who are interested to buy some property but could not make to attend the show on those days due to various reasons. Even those who attend can get a better picture and a brief summary of the event organized by Confederation of Real Estate Developers' Association of India (CREDAI), Andhra Pradesh chapter. The three-day property show brought together realtors, building material manufacturers, consultants and financial institutions from Hyderabad as well as from tier-2 and tier-3 cities from the state at a common platform to interact and showcase the developments in the sector. There is a wide range of products including integrated townships, apartment complexes, gated communities, villas and green buildings and witnessed participation from over 150 developers and 50 stakeholders from the financial and manufacturing sectors. 15,000 dwelling units and commercial spaces worth Rs. 10,000 Crores are showcased by 150+ developers and stakeholders from the manufacturing and financial sectors. Property dealers, consultants, advisors, government officials, software professionals and others who are interested to invest in real estate industry visited each and every stall of the exhibition and made the event a great success. Real Estate Bulletin Team interacted with many visitors on all the three days of the event. It was certainly not a cake walk. As the entry is free and lucky gift coupons are offered, there is a huge crowd. It is tough to identify the visitor who is seriously interested to buy a property. Andhra Pradesh Chief Minister N. Kiran Kumar Reddy inaugurated the event that has brought together all the developers on a common platform providing potential customers an opportunity to interact directly, compare various options, and take informed decisions. Union Minister of State for Tourism K Chiranjeevi, Andhra Pradesh Housing Minister N Uttam Kumar Reddy and Minister for Municipal Administration & Urban Development M Maheedhar Reddy graced on the occasion. The property show was sponsored by LIC Housing Finance Limited and the conference by the State Bank of India.

Property Consultant on November 10th2012, which was held in four sessions on the same day starting from 10 AM and ending at 6PM. Trends the world over have shown that cities tend to get reoriented to mass transit systems and property prices in these corridors behave differently, remarked Hyderabad Metro Rail (HMR) Managing Director N.V.S. Reddy. He said the same was expected of the Metro Rail project as Transit Oriented Development (TOD) was being planned in the city. “Once the project shapes up, growth will happen in the eastern parts of the city,” he added. The Hyderabad Metropolitan Development Authority (HMDA) Commissioner, Neerabh Kumar Prasad, stressed the need to reduce the land cost component in projects and make available affordable housing that comes with a price tag of less than Rs. 20 lakh. “There is a large segment looking for affordable housing and real estate should find ways to address their needs,” he said.The HMDA and HMR were actively working on the TOD concept for all the metro rail stations and the area in a circle along them would be notified. “We will come up with a scheme of high rise development and there will be special incentives offered for the real estate in this,” Mr. Prasad said. Along the Outer Ring Road (ORR), developers can pool land for projects and the HMDA would help in infrastructure, he said adding, “My interest is to create as much supply as possible and keep the pricing low”. Developers showcased properties ranging from Rs 4 lakh in the affordable segment to Rs 4 crorerupees to prospective buyers. The show had registered over 40,000 visitors this time. The property developers who participated include best of the Indian real estate and construction companies. Apart from builders, 15 Leading Banks and Housing Financial Institutions like LICHFL, SBI, India Bulls, DHFL, HDFC Ltd, ICICI, SBH, Syndicate Housing Finance, Can Fin Homes, Axis Bank, IOB, Central Bank of India, Federal Bank, Punjab Housing Finance have took part in the property show and this enabled the prospective buyers an opportunity to enquire about the loan rates and consider the best possible competitive loan option. Developers too offered attractive prices coinciding with the event. For easy navigation, APREDA provided a map locator to aid the visitors to identify the location of the projects. The map locator made it simple for the visitors. The spacious venue of HITEX was packed with the visitors on Sunday. "APREDA Property Show 2012 has received an overwhelming response from the real estate fraternity & prospective buyers. The turnover rate has increased substantially as Real Estate has become a hot investment option despite volatility in the market. Visitors were given an opportunity to view a wide range of properties featured and financing sources, all under one roof "commenting on the occasion, Mr. P Prem Kumar, President of APREDA, said, “As the customers had to drive all the way to the venue, only those who are genuinely interested in buying the property has come to the show.” Echoing Mr. Kumar's views, Srikanth Surapaneni of Mantri developers said that each stall had at least five bookings per day. “Majority of people who came to the show were interested in purchasing houses. There were even people who wanted to buy highend property,” he said.However, the bulk of the house bookings were done in the properties between Miyapur and Shamshabad, he observed. Most people were looking for a house between Rs. 40 and Rs. 60 lakh in these areas, and a majority of them were software professionals, V. MadhaviLata from LIC Housing Finance added. Other agencies which show cased their initiatives include Metro Rail, HMDA, GHMC, IGBC, Registration Department, Sparsh Hospice and AkshayPatra Foundation.

REAL ESTATE (REGULATION & DEVELOPMENT) BILL The government is all set to enact a law to constitute a regulatory authority to look into issues relating to the real estate sector, which contributes about five percent of India's GDP and is the second largest employer after agriculture, in an attempt to bring in transparency and safeguards for consumers who buy properties from builders. Government sources said the Real Estate (Regulation and Development) Bill2012 is high on the agenda of the Union Cabinet. “Since the government intends to introduce the Bill in the upcoming winter session of Parliament, it is most likely that the Union Cabinet will approve the draft legislation at its meeting, which will be chaired by Prime Minister Manmohan Singh,” sources said. Major proposals include setting up of regulatory authority in each state, registration of builders wording on projects exceeding 1,000 square meters and mandating developers to submit project details. To understand better about the regulations to be enacted through this bill, we are providing the complete information for our readers in this issue and the next month issue of our magazine, after which we will continue the further part of The AP Apartments Act, 1987.
THE REAL ESTATE (REGULATION & DEVELOPMENT) BILL, 2011 A Bill to establish the Real Estate Regulatory Authority for regulation and planned development in the real estate sector and to ensure sale of immovable properties in an efficient and transparent manner and to protect the interest of consumers in the real estate sector and establish an Appellate Tribunal to adjudicate disputes and hear appeals from the decisions of the Authority and for matters connected therewith or incidental thereto. BE it enacted by Parliament in the Sixty-second Year of the Republic of India as follows:-
CHAPTER I PRELIMINARY 1. (a) This Act may be called the Real Estate (Regulation & Development) Act, 2011. (b) It extends to the whole of India except the State of Jammu and Kashmir. (c) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint: Provided that different dates may be appointed for different provisions of this Act and any reference in any such provision to the commencement of this Act shall be construed as a reference to the coming into force of that provision. 2. In this Act, unless the context otherwise requires, (a) “Advertisement” means any document described or issued as advertisement through any form of media and includes any notice, circular or other documents offering for sale of a plot, apartment or building or inviting persons to purchase in any manner such plot, apartment or building to make advances or deposits for such purposes; (b) “Allottee”, in relation to a premises of an immovable property, means the person to whom such premises or immovable property has been allotted, sold or otherwise transferred by the promoter and includes the person who subsequently acquires the said allotment through transfer or otherwise; (c) “Apartment” whether called dwelling unit, flat, premises, suite, tenement, unit or by any other name, means a separate and self-contained part of any property located in a basement or cellar or on one or more floors or any part thereof, in a residential building or on a plot of land, used or intended to be used for residence, or for any other type of
independent use ancillary to the purpose specified and includes any garage room or open space, whether or not adjacent to the residential building in which such apartment is located which has been provided by the promoter for the use of the allottee for parking any vehicle, or as the case may be, for the residence of any domestic help employed in such apartment; (d) “Appellate Tribunal” means the Real Estate Appellate Tribunal established under section 35; (e) “Appropriate Government” means in respect of matters relating to the,(i) Union territory, the Central Government; (Ii) State Government, the State Government; (f) “Architect” means a person registered as an architect under the provisions of the Architects Act, 1972; (g) “Authority” means the Real Estate Regulatory Authority established under sub-section (1) of section 17; (h) “Building” includes any structure or erection or part of a structure or erection which is intended to be used for residential, commercial or other related purposes; (i)“Chairperson” means the Chairperson of the Real Estate Regulatory Authority appointed under section 18; (j) “Carpet area” means the net usable floor area of an immovable property, excluding the area covered by the walls and the common areas; (k) “Company” means a company incorporated and registered under the Companies Act, 1956 and includes, (i) A corporation established by or under the Central Act or State Act; (ii) A development authority or any public authority established by the Government in this behalf under any law for the time being in force; (l)“Competent authority” means the local authority or any authority created under the law made by the State Government which exercises authority over land under its jurisdiction, and has powers to give permission for development of such immovable property; (m) “Development” with its grammatical variations and cognate expressions, means carrying out the development of immovable property, engineering or other operations in, on, over or under the land or the making of any material change in any immovable property or land and includes re-development; (n) “Development charges” means the cost of development works and includes all charges levied by the competent authority by whatever name called towards the development of the real estate project on immovable property; (o) “Development works” means the external development works and internal development works on immovable property; (p) “Engineer” means a person who possesses a bachelor's degree or equivalent from an institution recognized by the All India Council of Technical Education or is registered as an engineer under any law for the time being in force; (q) “Estimated cost of real estate project” means the total cost involved in developing the real estate project and includes land cost; (r) “External development works” includes roads and road systems, landscaping, water supply, sewerage and drainage systems, electricity supply transformer, substation of any other work which may have to be executed in the periphery of, or outside, a colony for its benefit, as may be specified under the rules or byelaws of the local authority; (s) “Internal development works” means footpaths, water supply, sewers, drains, tree planting, street lighting, provision for community buildings and for treatment and disposal of sewage and silage water or any other work in a colony necessary for its proper development;

LEGISLATION (t) “Immovable property” includes land, buildings, rights of ways, lights or any other benefit arising out of land and things attached to the earth or permanently fastened to anything which is attached to the earth, but not standing timber, standing crops or grass; (u) “Interest” means the rate of interest payable by the promoter or the allottee, as the case may be, under the agreement for sale for default by either party. Explanation- For the purposes of this clause, the rate of interest chargeable from the allottee by the promoter shall not be more than the rate of interest which the promoter would be liable to pay the allottee in case of default; (v) “Local authority” means the Municipal Corporation or Municipality or Local Body constituted under any law for the time being in force and legally entitled to exercise control in respect of the areas under their respective jurisdiction; (w) “Member” means the member of the Real Estate Regulatory Authority appointed under section 18 and includes the Chairperson; (x) “Notification” means a notification published in the Official Gazette and the expression “notify” shall be construed accordingly; (y) “Owner” means the owner or any subsequent owner of an immovable property having undivided interest in common areas and facilities appurtenant to it, in terms of the specific percentage specified in conveyance deed or agreement of sale or deed of allotment, as the case may be, executed under any law for the time being in force, and includes a person having any right or liability under the agreement by assignment or by operation of law; (z) “Person” includes (i) An individual; (ii) A Hindu undivided family; (iii) A company; (iv) A firm; (V) A local authority; (vi) An association of persons or a body of individuals whether incorporated or not; (vii) Any such other entity as the Appropriate Government may, by notification in the Official Gazette, specify in this behalf; (za) “Prescribed” means prescribed by rules made under this Act; (zb) “Project” means the real estate project under this Act; (zc) “Promoter” means (i) A person who constructs or causes to be constructed an independent building or a building consisting of apartments, or converts an existing building or a part thereof into apartments, for the purpose of selling all or some of the apartments to other persons and includes his assignees; or (ii) A person who develops a colony for the purpose of selling to other persons all or some of the plots, whether with or without structures thereon; or (iii) Any development authority or any other public body in respect of allottees of (a) Buildings or apartments constructed by such authority or body on lands owned by them or placed at their disposal by the Government; or (b) Plots owned by such authority or body or placed at their disposal by the Government; for the purpose of selling all or some of the apartments or plots, or (iv) An apex State level co-operative housing finance society and a primary co-operative housing society which constructs apartments or buildings for its members or in respect of the allottees of such apartments or buildings; or (v) Any other person who acts himself as a builder, colonizer, contractor, developer, estate developer or by any other name or claims to be acting as the holder of a power of attorney from the owner of the land on which the building or apartment is constructed or colony is developed for sale; or (Vi) Such other person who constructs any building or apartment for sale to the general public. Explanation. For the purposes of this clause where the person who constructs or converts a building into apartments or develops a colony for sale and the persons who sells apartments or plots are different persons, both of them shall be deemed to be the promoters; (zd) “Real estate agent” means any person, who negotiates or acts on behalf of one person in a transaction of transfer of his property, by way of sale, with another person or transfer of property of any other person to him and receives remuneration or fees or any other charges for his services whether as a commission or otherwise and includes a person who
introduces to prospective buyers and sellers to each other for negotiation for sale or purchase of immovable property and includes property dealers, brokers, middlemen by whatever name called; (ze) “Real estate project” includes the activities of, (i) Development of immovable property including construction thereon or alternation thereof and their management; (ii) sale, transfer and management of immovable properties; (zf) “Regulations” means the regulations made by the Authority under this Act; (zg) “Rules” means the rules made by the Appropriate Government under this Act. (zc) “promoter” means, (i) a person who constructs or causes to be constructed an independent building or a building consisting of apartments, or converts an existing building or a part thereof into apartments, for the purpose of selling all or some of the apartments to other persons and includes his assignees; or (ii) a person who develops a colony for the purpose of selling to other persons all or some of the plots, whether with or without structures thereon; or (iii) any development authority or any other public body in respect of allottees of (a) buildings or apartments constructed by such authority or body on lands owned by them or placed at their disposal by the Government; or (b) plots owned by such authority or body or placed at their disposal by the Government; for the purpose of selling all or some of the apartments or plots, or (iv) an apex State level co-operative housing finance society and a primary co-operative housing society which constructs apartments or buildings for its members or in respect of the allottees of such apartments or buildings; or (v) any other person who acts himself as a builder, colonizer, contractor, developer, estate developer or by any other name or claims to be acting as the holder of a power of attorney from the owner of the land on which the building or apartment is constructed or colony is developed for sale; or (vi) such other person who constructs any building or apartment for sale to the general public. Explanation. For the purposes of this clause where the person who constructs or converts a building into apartments or develops a colony for sale and the persons who sells apartments or plots are different persons, both of them shall be deemed to be the promoters; (Zd) “real estate agent” means any person, who negotiates or acts on behalf of one person in a transaction of transfer of his property, by way of sale, with another person or transfer of property of any other person to him and receives remuneration or fees or any other charges for his services whether as a commission or otherwise and includes a person who introduces to prospective buyers and sellers to each other for negotiation for sale or purchase of immovable property and includes property dealers, brokers, middlemen by whatever name called; (ze) “real estate project” includes the activities of, (i) development of immovable property including construction thereon or alternation thereof and their management; (Ii) sale, transfer and management of immovable properties; (zf) “regulations” means the regulations made by the Authority under this Act; (Zg) “rules” means the rules made by the Appropriate Government under this Act.
CHAPTER II REGISTRATION OF REAL ESTATE PROJECT AND TRANSFER OF IMMOVABLE PROPERTIES 3. No promoter shall develop any immovable property or make any construction thereon or alteration thereof or convert any existing undeveloped immovable property or part of it without registering the real estate project and obtaining a certificate of registration from the Real Estate

LEGISLATION Regulatory Authority established under this Act: Provided that no such registration shall be required,(a) when the area of land proposed to be developed does not exceed 4000 square meters, or an area as notified by the Central Government in consultation with the States and Union Territories from time to time, which may be different for different States or Union Territories; (b) where the promoter has sought all permissions and received all requisite approvals for the development of immovable property one year prior to the commencement of this Act; (c) for the purpose of renovation or repair which does not involve re- allotment and marketing of immovable property. Explanation.- For the purpose of this Act, where immovable property is to be developed in phases then every such phase shall be considered a standalone real estate project, and the promoter would have to seek registration under the Act for each phase separately: Provided that the promoter who has been carrying on the business of real estate sector on the commencement of this Act, before the expiry of the period of six months from such commencement shall apply in writing to the Authority for obtaining a certificate of registration under this Act: Provided further that in case a promoter who has been carrying on the business of real estate sector on the commencement of this Act, nothing in this section shall be deemed to prohibit such promoter from carrying on the business of real estate, until it is granted a certificate of registration or is by notice in writing informed by the Authority that the certificate of registration cannot be granted to it. 4. (1) Every promoter shall make an application to the Authority for registration of the project for development of any immovable property in such form accompanied by such fee and other information as may be prescribed. (2) The prescribed form referred to in sub-section (1) shall include but not be limited to the information relating to the number and size of plots, layout plan, proposed project and the proposed facilities to be provided thereof. (3) The promoter shall enclose the following documents along with the application referred to in sub-section (1), namely:(a) an authenticated copy of the approval and sanction from the competent authority obtained in accordance with the laws as maybe applicable for the real estate project mentioned in the application, and where the project is proposed to be developed in phases, an authenticated copy of the approval and sanction from the competent authority for each of such phases; (b) a declaration which shall be signed by the promoter stating,(i) that he has a legal title to the land on which the development is proposed along with a legally valid authentication of such title if such land is owned by another person; (ii) that the land is free from all encumbrances, or as the case may be, of the encumbrances on such land including any rights, title, interest or name of any party in or over such land along with details; (iii ) his affirmation that the project or the phase of the project shall be completed as the case may be in accordance with the terms and conditions of the registration; (iv) the period of time within which he undertakes to complete the project or phase thereof, provided it is within the period of sanction by the competent authority; (v) that seventy percent of the amounts realized for the real estate project from the allottees, from time to time, would be deposited in a separate account to be maintained in a scheduled bank, within fifteen days of its realization for meeting the costs of the real estate project and would be used only for that purpose; Explanation.- For the purpose of this clause, the term “scheduled bank” means a bank included in the second schedule to the Reserve Bank of India Act, 1934. (vi) that he has furnished such other documents as may be prescribed by the rules or regulations made under this Act.
(4) On receipt of the application under sub-section (1), the Authority shall within a period of thirty days from the date of receipt of the applications complete the process of the scrutiny of the applications submitted to it. (5)The Authority, after scrutiny of the applications shall (a) grant registration subject to the provisions of this Act and the rules and the regulations made thereunder; or (b) reject the application for reasons to be recorded in writing, if such application does not conform to the provisions of this Act: Provided that no application shall be rejected unless the applicant has been given an opportunity of being heard. (6) For reasons beyond its control, if the Authority fails to complete the scrutiny of the applications within the aforesaid period, the applicants may be permitted provisional access to the website of the Authority and allowed to enter the project details in respect of the projects covered in the application on the website: Provided that the Authority shall furnish a detailed report for every three months to the Appropriate Government, with reasons for delay on projects for which registration has not been granted within the aforesaid period of thirty days. (7) The Authority shall grant the registration to the promoter, if it is satisfied that the promoter has (a) entered into an agreement with the Competent Authority for completion of the development works; (b) complied all the provisions of this Act and the rules and the regulations made thereunder; and (c) furnished the information required by the Authority. (8) The registration granted under this section shall be valid for a period declared by the promoter under sub--clause (iv) of clause (b) of sub-section 3 for completion of the project or phase thereof, as the case may be. (9) The Authority shall, after registration, issue a Login Id and password to the applicant for accessing the website of the Authority and permit the promoter to access the website of the Authority to create his web page and to fill therein the details of the proposed project. 5. (1) The registration granted under section 4 may be renewed by the Authority for a further period of one year on an application made by the promoter in such form and on payment of such fee as may be prescribed: Provided that the registration so renewed shall not be for a period more than that extended by the Competent Authority; Provided further that no registration to a promoter shall be renewed for a period of more than two years; (2) No application for renewal of the certificate of registration made under this section shall be rejected unless the applicant has been given a reasonable opportunity of being heard in the matter. 6. Upon lapse of the registration or on cancellation of the registration under this Act, the Authority, may consult the Appropriate Government to take such action as it may deem fit including the carrying out of the remaining development works by competent authority or by the association of allottees or in any other manner, as the case maybe. 7. (1) The Authority may, on receipt of a complaint in this behalf or suo- moto or on the recommendation of the Competent Authority, revoke the registration granted under section 4, after being satisfied that (a) the promoter makes willful default in doing anything required of him by or under this Act or the rules or the regulations made thereunder; (b) the promoter violates any of the terms or conditions of the agreement entered into with the Competent Authority: Provided that the Authority shall revoke the registration under this clause only on a recommendation received from the Competent Authority in this behalf; (c) the promoter is involved in any kind of unfair practice or irregularities. Explanation:- For the purposes of this clause, the term “unfair practice means” a practice which, for the purpose of promoting the sale or development of any immovable property adopts any unfair method or unfair

LEGISLATION or deceptive practice including any of the following practices, namely:(A) the practice of making any statement, whether orally or writing or by visible representation which,(i) falsely represents that the services are of a particular standard or grade; (ii) represents that the promoter has approval or affiliation which such promoter does not have; (iii) makes a false or misleading representation concerning the services; (B) permits the publication of any advertisement whether in any newspaper or otherwise of services that are not intended to be offered. (2) The registration granted to the promoter under section 4 shall not be revoked unless the Authority has given to the promoter not less than thirty days notice, in writing, stating the grounds on which it is proposed to revoke the certificate, and has considered any cause shown by the promoter within the period of that notice against the proposed revocation. (3) The Authority may, instead of revoking the registration under subsection (1), permit it to remain in force subject to such further terms and conditions as it thinks fit to impose in the interest of the allottees, and any such terms and conditions so imposed shall be binding upon the promoter. (4) Upon the revocation of the registration, the Authority,(a) shall debar the promoter from accessing its website by deleting his details and inscribing his name in the list of defaulters on its website and also inform the other Real Estate Regulatory Authorities in other States about such cancellation; (b) may recommend to the competent authority to facilitate the balance of the development works to be carried out in accordance with the provisions of section 6; (c) may, to protect the interest of prospective buyers or in the public interest, issue such directions as it may deem necessary. (5) The Authority shall cause to be published in its web site the names and other details of promoter whose registration has been revoked under this section.
CHAPTER III OBLIGATIONS OF PROMOTER AND ALLOTTEE 8. (1) The promoter shall, upon receiving his Login-Id and password under sub-section (9) of section 4 and the Authority's permission to access its website, enter all details of the proposed project in all the fields as required, and the information and documents as specified in sub-section (2) as self declared. (2) The information and documents referred to in sub-section (1) amongst other documents as may be required, include,(a) details of the sanctions accorded by the Competent Authority; (b) details of the registration granted by the Authority; (c) full and true disclosure of his enterprise details including its name, registered address, type of enterprise (proprietorship, societies, partnership, companies, local authority etc.) and registration details under the law registered; (d) a full and true disclosure of the nature of his title to the land on which the proposed project is developed or intended to be developed; (e) If such land is owned by another person, the agreement with the owner of land for the development of the proposed project. Explanation.- For the purposes of this sub-section, documents relating to the title to the land shall be same as submitted before the Competent Authority; (f) details of all encumbrances on such land, including any rights, title, interest or claim of any party in or over such land; (g) fortnightly up-to-date list of bookings on the basis of the agreement to sell entered with them;
(h) proforma of the agreements proposed to be signed with the allottees; (i) the number and the carpet area of each unit or part of unit for sale in the project; (j) the layout plan of the proposed project or the phase thereof, and also the layout plan of the whole project as sanctioned by the competent authority; (k) the plan of development works to be executed in the proposed project; (l) the names and addresses of his real estate agents, if any, for the proposed project, as and when appointed by the promoter; (m) the names and addresses of the architect, structural engineer, if any and other persons concerned with the development of the proposed project; and (N) such other information and documents as may be prescribed by rules or regulations under this Act. 9. (1) No promoter shall issue or publish an advertisement or prospectus, or invite any member of the public to buy or book in such projects to be developed or take advances or deposits without obtaining a copy of certificate of registration with the Authority. (2) No promoter shall issue advertisement or prospectus without first filing a copy of such advertisement or prospectus in the office of the Authority. (3) The advertisement or prospectus issued or published after complying with the provisions of sub-section (1) shall mention prominently the website address of the Authority wherein all details of the registered project have been entered and include such other matters which are incidental thereto. 10. Where any person makes an advance or a deposit on the basis of the information contained in the advertisement or prospectus and sustains any loss or damage by reason of any incorrect, false statement included therein, he shall be compensated by the promoter in the manner as may be determined by the Authority: Provided that if the person affected by such incorrect, false statement contained in the advertisement or prospectus, intends to withdraw from the proposed project, he shall be returned his entire investment along with interest at such rate as may be prescribed. 11. (1) Notwithstanding anything contained in any other law for the time being in force, a promoter shall not accept any sum of money as an advance payment or deposit, from a person without first entering into a written agreement for sale with such person (2) The agreement referred to in sub-section (1) shall be in such form as may be prescribed and specify the particulars of development of the project including the construction of building and apartments, along with specifications and external development, works, the dates and the manner by which payments towards the cost of the plot, building or apartment are to be made by the allottees and the date on which the possession of the plot, building or apartment is to be handed over and such other particulars, as may be prescribed: Provided that the agreement shall be required after allotment where only a refundable application fee is collected from the applicant before draw of lots for specific allotment. 12. (1) The promoter, upon entering into an agreement to sell with the allottee for transfer of the ownership of the immovable property, shall be responsible to make available or cause to be made available to the allottee, the following information, namely:(a) site plans along with structural designs and specifications, approved by the local authority, by display at the site or such other place as may be specified by the regulations made by the Authority; (b) the stage wise time schedule of completion of the project;

LEGISLATION (c) the time schedule for connecting the proposed project with the various Municipal services as applicable; Explanation.-For the purposes of this clause, the term “municipal services'' means the services offered to the population of cities, settlements and villages by enterprises of the communal service system to meet the material-domestic needs of the population such as water, electricity, gas and other services etc.; (d) the certificate signed by the owner, architect and structural engineer regarding the compliance of statutory provisions related to the relevant revenue, planning, local, structural safety, and fire safety laws or requirements; (e) all such details pertaining to the development of the proposed project which may be required to ensure transparency in the development of the proposed project; (2) The promoter shall(a) be responsible to furnish immediately on payment of reasonable charges as may be specified by the regulations made by the Authority, true copies of the aforesaid documents, to the allottees individually or collectively; (b) obtain a completion certificate from the relevant local authority as per local laws or other laws in force and to make it available to the allottees individually or to the association of allottees, as the case may be; (c) also prepare and maintain all such other details as may be specified from time to time by the regulations made by the Authority; (d) be responsible for providing and maintaining the essential services, on reasonable charges as may be specified by the regulations made by the Authority, till the taking over of the maintenance of the project by the association of the allottees; (e) take steps for the formation of an association or society or cooperative Society, as the case may be, of the allottees, under the laws applicable or, as soon as the majority of members for the formation of the same are in place; (f) not cancel the allotment unless he has sufficient cause to cancel it in terms of the agreement of sale and if he so cancels the agreement of sale, he shall give due notice to the other parties to the agreement of sale and tender a refund of the amount collected along with interest at such rates as may be prescribed: Provided that the allottee may approach the Authority for relief if he is aggrieved by such cancellation and thinks the cancellation of the allotment by the promoter is unilateral and without any genuine cause and is not in accordance with the terms of the agreement of sale. 13. (1) The proposed project shall be developed and completed by the promoter in accordance with the plans and structural designs and specifications as approved by the Competent Authorities. (2) In case any major structural defect or deficiency in such development or services incidental thereto is brought to the notice of the promoter within a period of one year by the allottee from the date of handing over possession, it shall be the duty of the promoter to rectify such defects without further charge within reasonable time and in the event of promoter's failure to rectify such defects within such time, the aggrieved allottees shall be entitled to receive Appropriate damages or compensation as may be determined by the Authority. 14. (1) After obtaining the occupation certificate or completion certificate, as the case may be, the promoter shall submit a copy thereof to the Authority and thereafter take all necessary steps to execute a registered conveyance deed in favour of the allottee thereby transferring the title in the immovable property along with the undivided proportionate title in the common areas simultaneously with the handing over of the possession of the immovable property and the other title documents pertaining thereto. (2) After obtaining the occupation certificate or completion certificate, as the case may be and handing over physical possession to the allottees in
terms of this section, it shall be the responsibility of the promoter to hand over the originals of the title documents and the plans to the association of the allottees incorporated as per the local laws. 15. (1) If the promoter fails to complete or is unable to give possession of a plot or building,(a) in accordance with the terms of the agreement or, as the case may be, duly completed by the date specified therein or any further date agreed to by the parties; or (b) due to discontinuance of his business as a developer on account of suspension or revocation of his license under this Act or for any other reason, he shall be liable on demand, without prejudice to any other remedy to which he may be liable, to return the amount received by him in respect of that plot, building, with interest at such rate as may be prescribed in this behalf and also penalty as may be determined by the Authority; (2) The interest referred to in sub-section (1) shall be chargeable from the date the promoter received the amount or any part thereof, till the date the amount or part thereof and interest thereon is returned and such amount and interest shall be a charge on the land and other structures thereon and be recoverable as arrears of land revenue. 16. (1) Every allottee who has entered into an agreement of sale to take a plot or a building under section 11 shall be responsible to make necessary payments in the manner and within the time as specified in the said agreement and shall after taking possession of the plot or building under section 14 pay at the proper time and place, the proportionate share of the registration charges, municipal taxes, water and electricity charges, ground rent, if any, and other charges, in accordance with such agreement. (2) The allottee shall be liable to pay interest, at such rate as may be prescribed, for any delay in payment towards any amount or charges to be paid under sub-section (1). (3) The obligations of the allottee under sub-section (1) and the liability towards interest under sub-section (2) may be reduced when mutually agreed to between the promoter and such allottee.
CHAPTER IV THE REAL ESTATE REGULATORY AUTHORITY 17. (1) The Appropriate Government may, by notification in the Official Gazette, establish an Authority to be known as the Real Estate Regulatory Authority to exercise the powers conferred on it and to perform the functions assigned to it under this Act. (2) The Authority shall be a body corporate by the name aforesaid having perpetual succession and a common seal, with power, subject to the provisions of this Act, to acquire, hold and dispose of property, both movable and immovable, and to contract, and shall, by the said name, sue or be sued. 18. The Authority shall consist of a Chairperson and not less than two whole time Members to be appointed by the Appropriate Government. 19. The Chairperson and other Members of the Authority shall be appointed by the Appropriate Government on the recommendations of the Selection Committee and in such manner as may be prescribed, from amongst persons having adequate knowledge of and professional experience (for atleast twenty years in case of the Chairperson and fifteen years in the case of the Members) in urban development, housing, real estate development, infrastructure, economics, planning, law, commerce, accountancy, industry, management, social service, public affairs or administration: Provided that a person who is, or has been, in the service of the State Government shall not be appointed as a Chairperson unless such person has held the post of Secretary to the Central Government or any equivalent post in the Central Government or any equivalent post in the State Government. Provided further that a person who is, or has been, in the service of the State Government shall not be appointed as a member unless such person has held the post of Secretary to the State Government or any equivalent post in the

LEGISLATION State Government or any equivalent post in the Central Government. 20. (1) The Chairperson and Members shall hold office for a term not exceeding three years from the date on which they enters upon his office, or until the attains the age of sixty five years, whichever is earlier. (2) Before appointing any person as a Chairperson or Member, the Appropriate Government shall satisfy itself that the person does not have any such financial or other interest as is likely to affect prejudicially his functions as such Member. 21. (1) The salary and allowances payable to, and the other terms and conditions of service of the Chairperson and other Members shall be such as may be prescribed and shall not be varied to their disadvantage during their tenure. (2) Notwithstanding anything contained in sub-sections (1) and (2) of section 20, the Chairperson or a member, as the case may be, may, (a) relinquish his office by giving in writing to the Appropriate Government notice of not less than three months; or (b) be removed from his office in accordance with the provisions of section 23. (3) A vacancy caused to the office of the Chairperson or any other member, as the case may be, shall be filled up within a period of three months from the date on which such vacancy occurs. 22.The Chairperson shall have powers of general superintendence and directions in the conduct of the affairs of Authority and he shall, in addition to presiding over the meetings of the Authority, exercise and discharge such administrative powers and functions of the Authority as may be prescribed. 23. (1) The Appropriate Government may, by order, remove from office the Chairperson or other Members, if the Chairperson or such other Member, as the case may be,(a) has been adjudged as insolvent; or (b) has been convicted of an offence, involving moral turpitude; or (C) has become physically or mentally incapable of acting as a Member; or (d) has acquired such financial or other interest as is likely to affect prejudicially his functions as a Member; or (e) has so abused his position as to render his continuance in office prejudicial to the public interest. (2) No such Chairperson or Member shall be removed from his office under clause (c), (d) or clause (e) of sub-section (1) unless he has been given a reasonable opportunity of being heard in the matter. 24. (1) The Chairperson or a Member, ceasing to hold office as such, shall not, without previous approval of the Appropriate Government, (a) accept any employment in, or connected with, the management or administration of, any person which has been associated with any work under the Act from the date on which they cease to hold office: Provided that nothing contained in this clause shall apply to any employment under the Appropriate Government or a local authority or in any statutory authority or any corporation established by or under any Central, State or provincial Act or a Government Company, as defined in section 617 of the Companies Act, 1956; (b) act, for or on behalf of any person or organization in connection with any specific proceeding or transaction or negotiation or a case to which the Authority is a party and with respect to which the Chairperson or such Member had, before cessation of office, acted for or provided advice to, the Authority; (C) give advice to any person using information which was obtained in his capacity as the Chairperson or a Member and being unavailable to or not being able to be made available to the public; (d) enter into a contract of service with, or accept an appointment to a board of directors of, or accept an offer of employment with, an entity with which he had direct and significant official dealings during his term of office as such. (2) The Chairperson and Members shall not communicate or reveal to any
person any matter which has been brought under his consideration or known to him while acting as such. 25. (1) The Appropriate Government may, in consultation with the Authority appoint such officers and employees as it considers necessary for the efficient discharge of their functions under this Act who would discharge their functions under the general superintendence of the Chairperson. (2)The salary and allowances payable to and the other conditions of service of the officers and of the employees of the Authority appointed under sub-section (1) shall be such as may be prescribed. 26. (1) The Authority shall meet at such places and times, and shall follow such rules of procedure in regard to the transaction of business at its meetings (including quorum at such meetings) as may be specified by regulations made by the Authority. (2) The Chairperson or, if for any reason, is unable to attend a meeting of the Authority, the senior-most Member present shall preside at the meeting. (3)All questions which come up before any meeting of the Authority shall be decided by a majority of the Members present and voting and, in the event of an equality of votes, the Chairperson or the Member presiding shall have the right to exercise a second or casting vote. 27. No act or proceeding of the Authority shall be invalid merely by reason of(a) any vacancy in, or any defect in the constitution of the Authority; or (b) any defect in the appointment of a person acting as a member of the Authority; or (c) any irregularity in the procedure of the Authority not affecting the merits of the case. 28. The Authority shall take all possible measures for the growth and promotion of a healthy, transparent, efficient and competitive real estate sector and in particular take the following measures, namely: (a) make recommendations to the Appropriate Government or the Competent Authority as the case may be, on,(i) protection of interest of the allottees; (ii) measures to improve the processes and procedures for clearance and sanction of plans and development projects, and issuance of completion certificates from the Competent Authority to effectively implement the social and economic planning in the real estate sector; (b)encourage construction of environmentally sustainable and affordable housing, promote standardization and use of Appropriate construction materials, fixtures, fittings and construction techniques. 29. (1) Subject to the provisions of this Act, the Authority shall take all possible measures for the growth and promotion of a transparent, efficient and competitive real estate sector. (2) Without prejudice to the generality of the provisions contained in subsection (1), the powers and functions of the Authority shall, inter alia, include(a) to render advice to the Appropriate Government in matters relating to the development of real estate sector; (b)to publish and maintain a website of records of all real estate projects for which application for registration has been received, as database, with such details as may be prescribed including information provided in the application for which registration has either been granted or cancelled ,as the case may be; (C) to act as the nodal agency to co-ordinate all efforts of the Appropriate Government regarding the development of the real estate sector; (d) to fix for each areas under its jurisdiction the standard charges through policy or guidelines, or regulations to be levied on the allottees by the promoter or the association of allottees, as the case may be;

Architecture had taken a long journey. 20 years back, space was not a constraint. When space became a premium, individual homes got converted into apartments. It became a challenge for an architect to accommodate the number of apartments in each block and to bring the feel of a home in an apartment. Now it has reached its heights, there are apartments in Hyderabad where each floor is one apartment. We suggest our clients, instead of buying an individual house for Rs. 5 crore in Jubilee Hills, it is better to buy a flat in an apartment for Rs. 2 crore in the same area, with more security and other amenities like gym, swimming pool, club house etc. Apartment culture has crept into everyone and transformed big houses into apartments as it is convenient, affordable and brings the feeling of togetherness through community living.
Ø You have executed projects in India as well as abroad, what are the major differences you find in terms of structural design? In abroad structural designs are purely driven by technology, because of that construction time taken would be less. For example, Park Hyatt building at Hyderabad is a steel structure. Instead of going for RCC slabs and RCC columns, Steel columns and Steel structures are used, which are factory made by companies like JSW (Jindal Steel Works) etc. Building never gets delayed and number of work force is also less. Construction timeline reduces from years to months. (In India, we use traditional style of construction as we have more work forces). Though steel structures are expensive, they are re-usable. When the building is demolished, the steel columns can be used again or they can be exchanged for value of money. Where as the RCC will be a scrap in such cases. In India, people are very competent in advanced technology but weak in the implementation. Ø What initiatives you have taken to renew Hyderabad? I am a very small man (laughs). I will try to do my little bit to develop the city and to bring green technology in all the projects. 'Go Green' is my slogan, I try to use recycled materials in all our projects so that, I add value addition to my client. India needs to understand that resources are limited. We need to use recycled products by maintaining good quality. Ø Could you share your thoughts on the growth of infrastructure in Hyderabad? I stress on basic infrastructural facilities like roads, drainage, water supply and power. I would like all the town planning architects to plan the city in a better way with wider roads, proper electrical installation, continuous water supply, and good drainage system. I again suggest green technology for solar lighting system, solar water heaters to make them mandatory, so that we can use the inexhaustible solar energy just like the state of Gujarat. Ø Your upcoming Projects. We are currently working on Proto type system of architecture. It is a new concept from Malaysia, using recyclable materials like aluminium install, remove, carry and reuse. Through this, a person while shifting the place need not depend on any other resource for re-installation. European countries already use this concept. Ø With the ups and downs in the Realty Industry, would it affect your profession? One industry is interdependent on another. If there is a hospital, around that few guest houses will come, later food joints will start, a coffee shop, a flower store and so on. Every industry needs our service. If new projects come, we have better jobs to do, more revenue to us and more contribution to the society. The greatest thing is, we have repeat clientele for the last 13 years. They take our suggestions for their new projects and their expansion plans, incorporate them and move ahead.

December 31 deadline to clear pending BPS, LRS applications
There are still 27,860 applications needing approval
HYDERABAD : The GHMC has stated that illegal building and unauthorized constructions not covered under the Building Penalization Scheme (BPS) are liable to either pay 25 per cent more property tax and also face penal action like demolition. Commissioner M.T. Krishna Babu pointed our that the government has given an opportunity for the unauthorized constructions and buildings built in deviation of the sanctioned plans under the BPS in 2007. The scheme has been closed for any fresh applications and more than 2.5 lakh forms were received, of which 1.36 lakh were approved. There are still 27,860 applications pending for approval and it requires applicants to pay the balance penal amounts or submit the required documents. The government has issued orders a couple of months ago allowing the municipal corporation to collect a the remaining fees or documents and process these pending applications for disposal. BPS melas Mr. Krishna Babu said that 'BPS melas' have been arranged in all municipal circle every Saturday from 3.P.m to 5 p.m to enable the applicants to regularise their respective buildings. Similarly, the Commissioner has also requested citizens to make use of the Layout Regularization Scheme (LRS) which has been extended up to December end. Citizens can regularize their respective plots brought from unauthorized or' illegal layouts by paying a surcharge on the penal amounts. A 20 per cent surcharge on the penal amount will be levied on the balance penal amount to be paid if the initial amount was not paid before December 31,2011 or the 20 per cent surcharge will be on the total penal amount will have to be paid for applications received after December 31,2011. Raheja Mindspace project faces ACB probe Hyderabad: Paving the way for an anti-corruption bureau probe into the alleged irregularities in the Reheja Mindspace project in Madhapur here, Justice Raja Elango of the high court on Friday dismissed the criminal revision petitions filed by Neil Raheja, project chief, Ravindranath, general manager of the project, IAS officers BP Acharya (former MD of AOIIC) and K Ratna Pradha, and senior IPS officer M Gopikrishna. Earlier, following a complaint by an advocate, the ACB court directed the police to register stayed by the HC following petition by Raheja and others. The HC on Friday delivered its judgment dismissing their pleas questioning the order of the ACB court entertaining a complaint and directing the investigation into the circumstances leading to the reduction of the shares of the government in the Raheja joint venture. The judge rejected the plea that the court erred in directing the investigation against the beneficiaries or the officials. He reasoned that there was no reason to interfere with the order at the investigation stage. Minister's conviction stayed: Justice Raja Elango on Friday stayed the conviction and sentence awarded to minister K Parthasarathy by economic offences court in the FERA violation case. The imposition of penalty itself was stayed earlier by the high court. Fire Licence soon mandatory for small biz establishments Hyderabad: soon small businesses like function halls, super markets, hotels lodges without restaurants, nursing homes and petrol bunks will need a licence from the A.P State Disaster Response and Fire Services wing to carry our their operations. Also, they would be required to renew their licence every year. The fire services department has decided to put in place a licensing system for nine categories of commercial establishments. The new system is likely to come into force within a month. Officials said property owners or developers of high-rise buildings, both residential and Commercial, and hotels have to take 'No Objection Certificate (NOC) from the fire services department before applying for building permission. But, once the NOC is issued, the fire services department has no mechanism to check whether they comply with fire safety norms or not . “Some establishment like petrol bunks, which are prone to fire accidents, need to be inspected periodically by fire personnel. However, establishment which start business after taking NOC will be checked periodically from now on wards. Even minimum fire-fighting equipment installed at there establishments have become ornamental and seldom function in the event of a fire mishap,” a senior officer of the fire services said. Officials said there is a provision to implement the licence system. As per the AP Fire Services Act, 1999, and rule 19 (1) of the AP Fire &Emergency Operations and Levy of Fee Rules, 2006, nine categories of business establishments need to take licence and renew them periodically. This has not been implemented by the fire services department due to various reasons. The Greater Hyderabad Municipal Corporation's fire prevention which (FPW) has proposed that licence system be introduced for non-high rise buildings and other categories. The FPW in GHMC was created and was given the power to inspect buildings up to 15-metre height. Since 2009, the wing has been inspecting buildings before giving occupancy certificates for multi-storied buildings, school buildings, hospitals and commercial complexes. “The department is currently in the process of preparing procedures, checklists and other pro-forma for issuing licence. Powers have to be delegated to fire officers in the dispal limits. The entire process may take a month, ”fire services director P Ventakteshwar said.
GOVERNMENT SET TO HIKE LAND VALUE BY 20% Hyderabad: After enhancing fee for encumbrance, marriage certificate and other services of the registration and stamps department a couple of months ago, the state government is contrmp0lating increasing land value, both agriculture and nonagriculture, for registration purposes soon. If land value is increased, property buyers will have to pay more towards registration and stamp fee. Revenue officials said land values were last revised two years ago in August 2010 and since then revision has not taken place due to various reasons. Then, the state government had decided to increase basic land value annually on August 1. The registration and stamps department had prepared proposals by july-end this year However, revision of land values was kept on hold in view gift deed and other services this year. “When the proposals for revision of land values were prepared in July, the district registration authorities over the prevailing land rates. For instance, government value in Ghatkesar area is Rs 2,300 per square yard, which is likely to be increased to Rs 2,700 per sq yard. Similarly in Almasguda village near, L.B Nagar it is Rs 1,750 per sq yard, it might be revised to Rs 2,000 per sq yard. Sources said details details of land registrations (transactions ) in various sub-registrar offices, especially in surrounding Rangareddy district, were taken for the revision of land value recently, For instance, the number of transactions was more in areas abutting the Warangal state highway like Boduppal, Medipally and Ghatkesar where rates would be increased. Similarly land value in Shamirpet, Medchal, Kukatpally, Serilingampally and Gachibowli would be enhance. In areas like Shamshabad, Maheshwaram, Hayatnagar mandals, the rates might remain unchanged as there were not many transactions. On the other hand, realtors are worried over the proposal to hike registration and stamp duty. “Real estate started gathering momentum just recently. If the registration and stamp duty is hiked, there will be some impact on prospective buyers, ”Vittal Das, a realtor from Ghatkesar, said. Ø

Water Board to set up Own Pumping station at Sunkishala

yderabad: Civil works on an intake pumping station at Sunkishala in Nalgonda district will begin soon. The Hyderabad Metro polite Water Supply and Sewerage Board {HMWSB}has entrusted the job of preparing the detailed project report {DPR}to Tata Consulting Engineers {TCE}Ltd. On November 9, the TCE representatives had given a HMWS&SB managing director J.Syamala Rao on the head works to be taken up at Sunkishala. “Originally, the Water Board has proposed to construct an independent intake pumping
station at Sunkishala with the Puttangandi cistern, which is maintained by the irrigation department, suffering breaches regularly. The board has been drawing 180 million gallons per day (MGD) raw water from the Krishna through the cistern to supply to the city under the Krishna project phase I and II,”HMWS&SB director, projects, M Satyanarayana told TOI. In July, the cistern wall had collapsed and the irrigation department took up repairs. After that, the water Board proposed to construct an Impendent intake pumping station at Sunkishala.
Metro rail may run over 328 trees in city Approval Sought to Chop/Relocate Trees for parking Hyderabad: The Hyderabad Metro Rail (HMR) wants to get rid of more than 320 trees to make way for multi-level parking facilities in the heart of the city. Worrying environmentalists said it will only increase air pollution and rob locals of little lung space in the city. The HMR authorities have sough permission for the removal of 328 trees and an application has been filed with the Andhra Pradesh forest department to remove or relocate 105 trees in Punjagutta 160 trees in Errummanzil Colony, 18 trees near Hi-Tec City in Madhapur and 45 trees in Balanagar . The Tree protection Committee (TPC), which met on November 15, said on November 28 and takes a final call on it. According to metro officials, 25 locations have been identified in different parts of the city meant for multilayered parking facilities with skywalks, lifts or escalators meant or channel between these parking spaces and metro stations. Forest officials say that the decision would be taken as per the WALRA Act, 2002, which conserves and protects water bodies, ground water, trees and land. “We had an elaborate discussion on this issue and would be inspecting these sites soon. The removal of trees will only be allowed if it is necessary. yderabad: Several lakes in the Umda Sagar basin of the Old city have disappeared from the face of the earth due to rapid urbanization and three of the nine surviving lakes are likely to face the same fate too, a study has revealed. The recent study initiated by the central government had found that there were 30 lakes until a couple of decades ago. Presently, only nine lakes are 'surviving' in the basin.
Umda Sagar basin drying up The department of science and technology had commissioned the study which was taken up by local environmental protection organizations and a city-based Geographic Information system consultant in April last. The study set our to indentify the status of lakes within the watershed or basins of Mir Alam and Umda Sagar in the Umda Sagar a water shed, which approximately extends from Pahadi Sharif to Talab Katta, 30 lakes were indentified by the team based on Survey of India topology maps and satellite imagery. The researchers worked out that rampant construction within the full tank levels of the lakes and on the water channels led to the gradual disappearance of the water bodies. Some of the surviving lakes that are facing threat of encroachment include Gurram Chedruvu near Barkas where dumping of debris on the shore is shrinking the lake area. Construction of houses in nearby areas like Hufeez Bba Nagar is leading to constriction of the water channel. There by causing flooding in surrounding localities during monsoon. The situation is no different at Shaheen Nagar Lake. According to the study, around 80per of the lake is lost. The water body is dry most of the year but in monsoon the water gets collected in the remaining areas and floods nearby houses. Burhan Khan Lake in nearby Osman Nagar locality is another water body in the basin that is estimated to have reduced to half its original size. Officials of HMDA were shown the locations of the lakes in the Mir Alam Basin following which they decided to make report on the status of lakes. But source in the metropolitan body said that it is unlikely to translate into any Action. Activists associated with the study however are trying hard to salvage the remaining lakes. “Analysis of data will yield a clear picture but it is imperative that full tank levels be fixed as encroachment will reduce this level. So even if the water bodies have to be protected at a later sage, there will be little or nothing left to protect them,” said a member of the research team.

First metro train to run in mid-2015
yderabad; The first metro rail service is most likely to be commissioned bymid-2015 for the eight-km stretch between Nagole and Mettuguda, a part of Line Three between Nagole and Raidurg. Although the planned timeline is December 2014, the concessionaire L&T Metro Rail Hyderabad (L&TMRH) wants to be absolutely sure of all aspects in terms of safety before allowing passengers to embark. “A lot of time will be required for testing and trial runs,” said Managing Director & Chief Executive V.B.Gadgil in a recent interaction with the media. Though the line will be ready by next year-end, it will be commissioned a few months later, But in the meantime, contracts for automatic fare collection, elevators entries and exits as well as equipment for workshops are to be firmed up on schedule. “The project is on schedule and all out efforts are being made to complete all the 72-km routes by 2017. Geo-technical investigations are also going on at a very fast pace, he declared. While the current pace was oke, he made it clear that the works accelerator has to be pressed and the output increased if the “tight timelines” have to be met.

Water Board-Transco spat delays power supply to Godavari project Transco Insists On HMWS&SB Clearing Outstanding Dukes Of $.3.50Cr. Hyderabad: Hyderabad Metropolitan Water Supply and Sewerage Board (HMWS&SB) and A.P Transco officials are at logger heads over independent power lines for the prestigious Godavari drinking water supply project (Maulana Abul Kalam Hyderabad Srujala Sravanthi Scheme). Water Board officials want the power supply as early as possible while their Transco counterparts want the HMWSl&SB to clear outstanding dues of Rs.3.50 crore. The drinking water project aims to bring 172 million gallons per day (MGD) From Yellampally barrage in karimnagar district to meet the city's demand. “The water Board needs 36 megawatt (MW) for the drinking water project. Even before taking up the water supply project, we approached Transco with a request to provide 220KV power supply to pumping stations proposed at Murmur, Bommakal, Mallaram and kondapaka by building separate sub-stations,” a senior HMWS&SB official told TOI. The Water Board also sent a requisition to the Transco that each intermediate pumping station would require dedicated power lines. At substations, the Transco has to install transformers and required equipment. “Though we have been sending reminders to them, so far there was no response from them,” he said. When contacted, Transco, director (Transmission) Ch. Chenna Reddy said, “We have sent an official communiqué to the water Board to pay Rs.15.50 crore supervisory charges. After several reminders, the agency paid Rs.12crore. Transco has been intimating the water Board to clear the pending amount, but so far there was no response. “Transco is ready to provide 220 KV power lines to the pumping stations at Murmur, Bommakal, Mallatam and Kondapaka if they clear the dues,” he added. Water Board general manger Electrical Division. M Rajan said, “we have made all necessary arrangements for 220 KV lines from Transco point of supply to various pumping station sites, but the power utility was delaying procurement of equipment, “ On the other hand, laying pipeline work has been up done up to 100 kms of 186 kms. However, the government wants to complete the drinking water supply project by the end of 2013.

The company has a global shared services centre in Hyderabad that provides shared services to its parent company in the
Netherlands. Bartronics, meanwhile, provides smartcard services to major government and private outfits in India and abroad. During the review meeting held by the minister, issues like Kokapet SEZ, Hardware Park, Animation and Gaming park and the state of state government initiative in IT promotion and the progress of the MeeSeva service were discussed. As building inventories with developers become bigger, delivery becomes a priority and skilled labour replaces unskilled labour, we will see more and more construction companies following these practices these days. Prefab time saving Precast concrete technology has proved its worth by saving a lot of construction time. Presently, the real estate industry is under tremendous pressure when it comes to timely completion of projects it is a huge task for the builders. Precast and engineered homes technology helps in sustainable development by introducing eco-friendly and innovative technologies and could pave the way for green construction and a green plant. New technology will be critical to building homes quickly and more cost-effectively, especially as input costs for traditional construction continue to rise as the customers want quality and timely possession such technology is inevitable in house. RICS in partnership with asset management firm Sam Circle Venture, Philadelphia-based architecture firm Kieran Timberlake and Mumbaibased consultancy company Project Well is already working on an affordable housing concept called India Concept House that uses prefabricated technology and allows houses to be manufactured and assembled in under two months.

BEWARE OF MRP VIOLATIONS
The Legal Metrology department has issued advisory recommending customers to carefully watch Maximum Retail Price (MRP) on ceramic tiles and sanitary ware and allied products. Customers can also lodge a complaint over the toll-free number 1860-425-3333, if they found any shopkeeper violating MRP and demanding excess price. Recently, the department officials raided a shop at Kavadiguda and booked a case against the dealer for collecting an excess amount of Rs.23,595 from a customer David Raj from Chilkalguda.

He purchased 17 boxes of branded ceramic tiles each box priced at Rs.2,580 as against its MRP of Rs.1,690. The dealer had even issued a total bill of Rs.46,000. Mr. Raj later requested his friend L. Several other add-ons have popped up such as rock-climbing walls, Jacuzzis, integrated business centres, concierge desks and home elevators, to name a few. Add to this Singapore and US-style apartments, Spanish haciendas, and homes that look like plus hotels and you'll know what we mean. These homes also pay a lot of attention to details like plumbing, kitchen fittings and interior décor. “Luxury housing is all about delivering an
international living experience that brings together top-notch building quality, world-class amenities, and impeccable attention to detail,” says Jittu Virwani, chairman and managing director, Embassy Group. The basic price tag, says Virwani, ranges any where from Rs. 1 crore per unit. “White in some cases it can get higher, we stick within that band. Our luxury condominiums at Hebbal start at Rs.3 crore while the Embassy Boulevard is Rs.5 crore upwards. Highend apartments that are slightly cheaper begin at Rs.1.7crore,” he adds. called 'luxury' only if it costs at least Rs. 5 crore. In Chennai, however, the majority of luxury housing is in the Rs.1-2 crore range. Despite dismal times, this segment will continue to thrive-if only because the segment has been seriously under serviced so far. “The fourth quarter usually sees increased activity, with NRIs coming in to take investment decisions. The supply is opening up now because developers have realized that with input costs rising, they can add more amenities and launch luxury projects instead of mid-income ones,” says Ashutosh Limaye, Head-Research and RIES, Jones Lang LaSalle India.
