...growth in the real estate sector and infrastructure space since the NDA government has taken over at the centre, gets a place of importance in this budget. The Confederation of Real Estate Developers' Associations of India (CREDAI), the apex body for private real estate developers in India is confident that with liberal norms for FDI and tax incentives for the REITs , besides the focus on low cost housing, infrastructure development and the budget allocation of Rs. 7060 Crores for development or up gradation of 100 smart cities along with the promise to deliver 'pucca' housing for all by 2022 will bring “Acche Din” for the real estate sector. Speaking about the budget Mr. C Shekar Reddy, National President, CREDAI said, “The budget unfolds some important initiatives for the real estate sector. Our demand for easing the norms for the FDI in real estate sector has been accepted by the FM in the budget and to encourage development of Smart Cities, which will also provide habitation for the neo-middle class, requirement of the built up area for FDI is being reduced from 50,000 square metres to 20,000 square meters and capital conditions reduced from USD 10 million to USD 5 million respectively with a three year post completion lock in. If these projects commit at least 30% of the total project cost to affordable housing, they will be exempted from minimum built up area and capitalisation requirements, with the condition of 3 years lock in. This will make more projects eligible for FDI funding and specially promote affordable housing segment. Apart from this the Government is also looking keen to make REITs more attractive and has proposed making it a vital tool to attract and encourage investments in the sector by providing tax incentives for REITs have been proposed as requested by us. This will encourage retail investors participation in commercial real estate and provide a source of funding to the developers helping improve liquidity and encourage them to undertake more projects. However our long standing demand for an infrastructure status to the housing segment has not been granted, which is disappointing as it limits the access for bank and institutional funding to the real estate sector particularly the affordable housing" Mr. Reddy further added that “Finance Minister has proposed to allocate Rs. 4000 Crore via National Housing Bank to boost low cost affordable housing for urban poor and Rs. 8000 Cr allocation for development of rural housing. We are waiting for more clarity on how the funds would be used. If this allocation is for the interest subvention scheme as proposed in the BJP manifesto it will give a boost to affordable housing by increasing the eligibility of the people and increase the demand for such housing giving a boost to affordable housing. Morover the allocation of 7060 Cr to develop or upgrade the existing 100 smart cities. Proposals such as allocation of Rs. 50000 cr for urban infra projects, development of Metro projects in cities with population of 20 lakh and above, setting up 7 smart industrial cities and steps for reviving the SEZs will trigger job creation and stimulate the demand for housing. Proposal for investment in national highways and state highways along with development of airports in tier I & II cities will further boost the infrastructure leading to industrial development and have a ripple effect on boosting the real estate sector.” Adding to this Mr. Reddy said, “Though our expectations related to the personal taxation and exemption on interest rates have not been fulfilled, however the little change of raising the tax exemption limit by Rs. 50,000 and raising limits on exemption under section 80 C by 50,000 will add to the investible surplus in the hands of the common man backed by the increase in exemption on interest on Housing loans for self occupied houses to Rs 2 lakh from 1.5 lakhs under section 24 (b) would help


improve the sentiment and stimulate the demand for housing.” Overall Mr. C Shekar Reddy National President CREDAI commented that , “ The budget has a vision towards shaping the future of the country and spreading the development across the board. The budget has given the real estate sector the due importance, although our long standing demand for infrastructure status for the real estate sector and an exemption of service for real estate projects is still awaiting the government nod. Some of our other demands have been heeded to and been incorporated in the budget. With the pro real estate stance taken in this budget and our meetings with the cabinet ministers before the budget we are hopeful that we can work closely with the government and get the desired response to other non fiscal requirements like streamlining of online approval process by eliminating all the NOC's etc. However we at CREDAI are confident that the “Acche din” for real estate sector are definitely on the cards as the Government in the budget has given stimulus to the industry and infrastructure sector which will have a ripple effect on the Real Estate industry.”

Editorial Winds of Change The ambient change in the outlook of the present Government have brought cheers to the nation, as the whole country was eagerly waiting for some pragmatic & well thought plans to be rolled out. The union budget of 2014 was just that needed one, at this hour, which is more or else a balanced budget considering the constraints, which the Government have to confront with. Over all, this year's budget set a ball path figure going forward in terms providing fiscal prudence in coming years. The budget unfolded a plethora of incentives to the ailing realty sector and have imparted a paramount importance to affordable housing sector & the property buyers, by announcing slew of innovative schemes. The central Government dream of providing housing for all, by 2022 is a very encouraging step towards self sufficiency of our fellow citizens. To fulfill this mammoth task, this year's budget has relaxed the FDI in realty sector norms, so that the benefits can percolate to the small time builders. Also some fundamental changes have been made in REIT's taxation norms, so that the investment horizon in this sector broadens. Some more deductions are given to the property buyers as tax incentives. More importantly the Budget proposals have given a positive indication regarding Government's willingness to listen to the concerns of the industry. There is a veritable menace of cartelization of cement manufactures across the country, as a result of which there is steep rise in cement prices in the state. However a joint action committee has been set up to roll back the prices, supported by all leading builders consortium like CREDAI ,APREDA & others, who relentlessly have opposed the price hike and are in purchasing holiday mode. As cement is considered as basic raw material for the realty sector, we wish that its price should be controlled by the government. rather than the cement manufactures, so that it is kept under check. A strict vigil on cement dealers by central & state ministry is very much warranted. A paradigm change in functioning of this sector is on the cards and hope that it translates into a robust growth, whereby the dream of housing for all by 2022 is meticulously achieved. Id Mubarak !

Center Suggestion Incentive For Better Housing Given the objectives of improving housing, the Union government has provided tax incentives and non-tax to encourage investment in urban infrastructure and housing sectors besides increasing investment in developing the 2014 Budget Plan 15.Union Urban and Housing Minister M. Venkaiah Naidu addressed senior officials of the two ministries to initiate immediate action to operationalize new initiatives subsequent to the submission of the budget. Recognizing the importance of urban development and renovation to meet the increasing aspirations of the people for better living, the NDA government led by the BJP has increased plan outlay projects related to the planning of 251.44 per cent in the Budget. The plan outlay, which was Rs 6561.34 crore in the revised estimate for 2013-14 has

been hiked to Rs 16.497 million rupees for the current financial year. Noting that "an average class is emerging neo-which has aspirations for better living standards," the government has provided Rs 7,060 crore for the vision of Prime Minister Narendra Modi for developing 100 intelligent cities. According to a senior official of the Ministry of urban development, cities will be developed as satellite towns of large cities and the modernization of existing medium-sized cities. Mr. Naidu said the smart cities to accommodate the growing number of people without whom existing cities will quickly become unfeasible. In order to promote the development of smart cities, the requirement of built-up area of foreign direct investment (FDI) has declined from 50,000 square meters to 20,000 square meters and capital requirement

of $ 10 million to $ 5 million. To further promote this activity, this type of projects that make at least 30 percent of the total project cost of low cost affordable housing will be exempt from minimum capital requirements and constructed area, with the status of a child three years lock-in.

Market Gains On RBI's Nod For Housing Projects

Equity markets finished expand their growth for a second day after new infrastructure purchases, shares of realty sector banking and after the RBI on Tuesday authorized banks to issue long-term bonds to finance infrastructure projects without providing the minimum statutory

reserves. In addition, the central bank also decided to give infrastructure status to inexpensive housing projects. The Sensex soared 321.07 points or 1.27 percent to end the trading session at 25,549.72, while the slippery closed the day at 7,624.40, gaining 97.75 points or

1.30 percent. Among the BSE sectoral lab, the Realty index was the biggest gainer on the day at 4.28 percent, followed by banking index, which gained 2.50 percent. According to India Forex Advisors, the latest move by the RBI would reduce the cost of funds to the banks, as they will not have to set aside funds for reserve requirements. “As, banks cost of funds will reduce, they can pass this benefit to customers. So the cost of loans for the housing sector may reduce,� it said. The Sensex, which shot up to a 11month high downplayed the data on the trade deficit in June 2014 released during market hours. "The trade data were only slightly negative. Upon movement of RBI, we saw a lot of institutional buying in shares of infrastructure, real estate and banking sector," said Alex Mathew, head of research, Geojit BNP Paribas Financial Services. Provisional data from the stock exchange showed which foreign investors purchased shares worth Rs 621.68 million rupees.

JAC Formed For Cement Purchase Holiday By Builders

In order to further steer up the demand for roll back of steep and unjustified hike in cement prices and with the

growing support for the JAC decision of Cement Purchase Holiday, the JAC of builders in Telangana and Andhra Pradesh represented by The Confederation of Real Estate Developers' Associations of India (CREDAI) along with all its chapters in Telangana and Andhra Pradesh, Andhra Pradesh Real Estate Developers' Association (APREDA), Telangana Real Estate Developers' Association (TREDA), Builders Association of India (BAI) & Telangana Builders Federation (TBF), representing 2000 strong developers community along with 1000 small, medium & mega contractors have unanimously decided to extend the cement purchasing holiday by a week from 19th July, 2014 to 26th July, 2014. With this decision the JAC along with all its members, has entered into the third week of Cement Purchase Holiday. In wake of the massive impact of this movement, Telangana government has initiated the discussions with JAC and the Cement Manufacturers Association (CMA). Further the government has promised to re look at the cement prices and have assured of a positive outcome. As the discussions between the Telangana Government and CMA are still

in progress, JAC has decided to extend the Cement Purchase Holiday by a week. The JAC is also expecting a positive outcome of reduction in cement prices from the ongoing dialogue, which is essential to safeguard the interests of the individuals and the construction industry, the 2nd largest employer having significant multiplier effect on the economy of the country. The movement which started against the unwarranted price hike and cartelization of cement manufacturers has now entered into its third week and has gained tremendous empathy and support during the period. It may be recalled that last month the cement manufacturers increased cement prices unwarrantedly across the southern states, which forced the financially struggling real estate community to stand and condemn the act. The JAC stands united with its demand for cement manufacturers to avoid cartelization to affect an increase of up to 50% in both the states and roll back the steep hike to a justifiable increase in prices. Delhi Tops India List of Property Fraud Cases

Delhi tops the list in terms of relating to fraud and misappropriation of property among all states and union territories in the country cases, according to the National Crime Records Bureau (NCRB). The overall number of cases reported in the areas lost by the criminal violator confidence and cheating in 2013 property was 181, the highest in the country, according to the report. VAASTU A SCIENTIFIC PERSPECTIVE

CASE STUDIES Following are some of the case studies wherein the Vaastu defects are explained. These facts are being given without any prejudice to anyone, only with a view to make the people understand that how the same plot and the house could give health and wealth to the inmates after certain alterations were made in the defective one. In all the cases cent percent correction would not be possible, yet one could try his best under the given circumstances.

From then onwards he went into a lot of problems. He lost considerable amount of money in business. His partners made an attempt on his life. When he showed his house to a Vaastu pm& the mistake was found. When the garage was disconnected by creating a gap in between the old and new building, and 30m: modifications were done on the first floor, things changed fast. He could sort out problems with his partners amicably. He even recovered from his ill-health thereafter. GATE AND BOREWELL IN SOUTH-WEST

DEFECTIVE PLOT Some time back, a plot of (5000) yards was purchased by a developer much against the advice of Vaastu Pandits. He paid five lacs as advance, and tried to dig a bore well in the plot but in vain. For a year, no construction could be started. Meanwhile the Income Tax Department served a notice on him to the effect that the department would take over the plot by paying some extra cost. The matter had ultimately gone to the court. For five years the capital invested on it yielded no returns. Added to that the buyer incurred further expenditure of rupees two lacs. Needless, to say that both buyer and the seller were in distress. The following are some of the defects in this plot: i) Gate in south-east direction facing east. ii) North & north-east - very big sheet of rock and very high levels in the north-east. iii) The Shape of the plot was odd and irregular and not at all good as per Vaastu. EXTENSION OF EXISTING BUILDING Normally building should not be extended to the south or west joining the existing building. A business man was doing well in the real estate business along with his partners. He did some extension in his house towards south by constructing a garage, connecting to the main building.

An air force officer built a house in Hyderabad, with lots of open space in the west with the main entrance in the south-west. He had two bore wells one in the southeast and another in the south-west. All these are against Vaastu. The couple soon lost their health. His wife became a mental patient and had to be admitted in an asylum. When the owner was told about the defects of Vaastu in his home, he did not believe in the first instance, but later on, he took the advice of a pundit and corrected the house as per Vaastu. The bore wells in south-west & south-east


BELIEFS were closed. The west open space will cover and south-west gate was changed to north-west. After making these corrections both of them recovered their health and living happily. ACCIDENTS

Construction of a theatre in Hyderabad was started during 1976, but could not be completed until 1986. After completion it was inaugurated in a big way, but that happiness did not last long. It was closed for more than a year. Then landlord took over the theatre from the leaseholder and spent more money, remodelling the same and got reopened in 1990, but before long it was closed again. The efforts of the management to start the theatre once again did not work, except every time they tried to do something, they incurred heavy expenditure, and the people who invested in this project have gone bankrupt and the theatre is closed permanently. The following defects of Vaastu were found in the plot and the building. 1. The very sight was not in accordance with Vaastu. North-west corner and north side were bad as per Vaastu. 2. The south-west corner of any building should be 90째, but here in this case it was not in order.

Here is an example of a house with a road on the west. The north east corner of the plot was cut off, which is a big defect in the plot as per Vaastu. Added to that a room and a bathroom on North. East corner was constructed on the ground floor and a 4mi tier structure on the top of it. The ground levels were higher in tie east and lower in the west. The bore well was dug in the Southeast. All these were against Vaastu and caused lots of problems to the owners. After some time the person living in the Northeast quarter died in an accident and his wife became seriously ill. HOUSE OF TWO A Vaastu Pandit of Guntur town while discussing Vaastu and its influence, narrated one special feature of a particular house, with two roads; one on the south and the other at the east, meeting at a T' junction. This is called south-east block. There was a well in north-west. Levels in the west were low. He said that the owner of such a house may have two wives according to Vaastu. How true! The owner of that house indeed had two wives. The most astonishing fact was that not only the father had two wives, but his son also got married twice. Interesting to note is that the ladies outlived the males and enjoyed the property for long. CINEMA THEATRE

3. The east vacant space must be more than west, but west open space in this case was much more than east. 4. This plot was neither a rectangular nor a square. It was having more than four sides which are against Vaastu. 5. The building's north-east has an offset reducing the northeast. 6. Canteen, cycle stand and scooter parking sheds were built all along the northern border and north-east corner on to the north side compound wall which is very bad financially. 7. The main gates were fixed and kept open in the south-west and north-west direction. One in the north-west is not bad, but the south west drains out the finances. 8. Gate fixed in the northeast was good, but it was closed permanently for some reason, which stopped the financial inflow. The natural rain water flow had been towards the west and south-west instead of the northeast which added more complications. All these above defects and some more in the construction of the theatre, put together caused heavy financial loss to the concerned leading to closure of theatre ultimately.

Telangana Chief minister - Sri K. Chandrasekhar Rao addressed a workshop of ministers, secretaries, head of departments (HoDs) and district officials said he will Reinvent Telangana to proliferate 39 percent of urbanization to 50 percent. The conference was held at Marri Chenna Reddy Human Resource Development Center, Hyderabad. The minister talked about a new approach “Bottom – Up” for the development of the newly formed state and strengthening panchayats and municipalities. The speech was given for about three hours, where he wanted to re-invent policy making and reorienting policies, and the commissioned officials and public listened in spellbound attention. In between, there were such revelations in the social audit of Indiramma housing schemes that were taken in the village Parakala mandal in Warangal district Varkal. In the direction of the director general of the Housing Corporation, an audit conducted by the team of Social Responsibility Audit and Transparency was launched from December 9-15, 2013 The administration had released a grant of Rs 3 , 09.37874 for the

construction of 952 pucca houses. The social audit team found irregularities worth Rs 1,32,48,123. Of the 952 households, irregularities in the construction of 500 houses were found. Downstairs, the building of houses still had not taken off. In some instances, the records indicated that the beneficiaries had received the money paid by the government, but in fact have not been deposited in their accounts. The report also noted that more than 105 old houses are displayed as new construction and Rs 42,024 lakh was paid. Besides, Rs 22.20 lakh was paid for 69 houses that did not even exist. Various houses were taken in singles primers rationing. More than 11 members gave their houses to rent, while four plaintiffs sold theirs.

he real estate sector has witnessed a challenging time with demands slowing down and over all stagnation in the market. There has been a positive sentiment post general elections. However, it is yet to fully translate in to overall demand. Through several debates and discussions over how the NDA government at the centre will bring the 'acche din' to the recession-affected Indian economy, finance minister, Arun Jaitley , unveiled the union budget 2014-15 amidst concerns over the economic slowdown, while promising bold steps for a course of correction. He emphasized that it aims at 7-8 per cent GDP growth over the next three-four years, lower inflation, less fiscal deficit and a manageable current account deficit. The real estate sector, which was quite hopeful about the outcome of the budget, has heaved a sigh of relief as the finance minister has brought some cheer to the sector, by announcing a handful of measures and allocations. The real estate players, for past several years have been seeking policy intervention from the government on both fiscal and nonfiscal side. On the fiscal side, as per per survey carried out by various agencies, an emphatic majority of the sector demanded Section 80-IA tax holiday to be extended to integrated township projects and special residential zones (mass housing/ residential townships). The industry also expects the government to promote eco-friendly projects by providing tax benefits. Budget Impact Let's look at the overall budget propositions and its impact on the overall economy and to the real estate sector. Enhancement of the exemption limit for the general category of individual tax payers from Rs 2 lakh to Rs 2.5 lakh. Impact: This platform will create a business and investor-friendly ecosystem in India by making all business and investment related clearances and compliances available on a 24Ă—7 single portal with an integrated payment gateway.

Relaxation in minimum area and minimum capitalization The Finance Minister has proposed to reduce the requirement of minimum project size from 50,000 square metres to 20,000 square metres, and the capitalization requirement (for a wholly owned subsidiary) from USD 10 million to USD 5 million respectively. Previously, in order to qualify for FDI, the project size had to be a minimum of

50,000 square metres and at least USD 10 million had to be infused for a wholly owned subsidiary. This was a major challenge since in Tier I cities which formed a bulk of the demand demography, finding such a large project was difficult, whereas in Tier II and III cities where such projects were available, the demand was not sufficient enough to warrant investor interest. This relaxation has partially addressed the long standing demand of the industry, which was expecting a reduction to 10,000 square metres, since even 20,000 square metres could be difficult for some Tier I cities (ex –Mumbai). The relaxation is a positive step towards providing impetus to development of smart cities providing habitation for the neo-middle class, as contemplated in the Budget. Promoting affordable housing The Budget has proposed introduction of schemes to incentivize the development of low cost housing and has also allocated this year a sum of INR 40 billion for National Housing Bank for this purpose. In addition to the above relaxation, to further encourage this segment, projects which commit at least 30% of the total project cost for low cost affordable housing have been proposed

The proposition of the Finance Minister to include slum development in the statutory list of corporate social responsibility activities is quite encouraging, as it not only provides developers an avenue to meet their CSR requirements, but also at the same time could give a huge impetus to this segment. Budget 2014: A Game Changer for REITs Budget 2014-15 ("Budget") has introduced tax incentives for the real estate investment trusts ("REITs") regime, and also provided for relaxations in foreign direct investment ("FDI") regime. With the tax incentives in place, the Securities and Exchange Board of India ("SEBI") is likely to formally announce the REIT regulations that are currently in draft form. The finance minister has made some key changes and its Budget 2014 impact on

the real estate sector positively. REITs in India are required to be set up as private trusts under the purview of the Indian Trusts Act, 1882. Parties: The parties in the REIT include the sponsor, the manager, the trustee, the principal valuer and the investors / unit holders. Sponsor sets up the REIT, which is managed by the manager. The trustee holds the property in its name on behalf of the investors. The roles, responsibilities, minimum eligibility criteria and qualification requirements for each of the abovementioned parties are detailed in the Draft Regulations. Sponsors are required to hold a minimum of 15% (25% for the first 3 years) of the total outstanding units of the REIT at all times to demonstrate skin-in-the-game. Use of SPV: REITs may hold assets directly or through an SPV. All entities in which REITs control majority interest qualify as an SPV for the purpose of the Draft Regulations. Investment and Listing: Units of a REIT are compulsorily required to be listed on a recognized stock exchange. Potential income streams: REITs are principally expected to invest in completed assets. Income would consist of rental income, interest income or capital gains arising from sale of real assets / shares of SPV. Distribution: 90% of net distributable income after tax of the REIT is required to be distributed to unit holders within 15 days of declaration. REITs are beneficial not only for the sponsors but also the investors. It provides the sponsor (usually a developer or a private equity fund) an exit opportunity thus giving liquidity and enable them to invest in other projects. At the same time, it provides the investors with an avenue to invest in rental income generating properties in which they would have otherwise not been able to invest, and which is less risky compared to under-construction properties. For a REIT regime to be effectively implemented, complete tax pass through is essential, as is the case in most countries having effective REIT regimes. Though the tax incentives for REITs introduced in the Budget is definitively a positive move, however, the tax incentives only result in partial tax pass through to REIT, at the maximum. It is hoped that the Finance Minister would address the issues as mentioned in this piece going forward

Global Realty Investors Focus on Metros Although the government's move to reduce the limit capitalization of $ 5 million (Rs. Rp 30 million to $ 1 = 60 rupees) is likely to attract foreign direct investment (FDI) in real estate, expert's industry insiders believe that global investors may initially focus on major metropolitan areas to invest in Tier-2 cities and 3 high risks. While the developer community is upbeat about

foreign investment in smaller cities, international players are reluctant to enter markets that are high risk, especially when the infrastructure is not yet developed. The new government has announced in its budget reduced threshold built area of 50,000 square meters to 20,000 square meters and drop the lower limit of foreign direct investment to $ 5 million, $ 10 million

surface. As there is a shortage of over 18 million homes and tier 1 cities are exploding at their seams. Given the current scenario, the opportunity presented Tier 2 and 3 cities are ripe, waiting to be exploited by developers supported by foreign investors. Tier 2 and 3 cities can own land, but at the same time if the basic infrastructure is not in place, they become high risk markets for investors. There is a need for intellectual and social infrastructure. Between levels 2 cities, Pune, Chandigarh, Ludhiana, Coimbatore, Bhubaneswar and Kochi and tier 3 cities like Madurai, Baroda, Nashik and Trichy are able to attract investment, as they are

"close" in terms of social infrastructure and development economical. According to experts, at least for the next 12-18 months, major international investors can look 6-7 meters. Smaller cities are high-risk markets, particularly when we have the necessary infrastructure. For us, we will continue looking at 5-6 major markets such as NCR, Pune, Mumbai, Bangalore, etc.

National private equity players are at an advantage because the sector is improving and we expect better valuations. Investors continue to pursue developers with a good track record thus permitting improved real estate market in those regions.
