A Long way to G(o)row Property shows are lined up in the city indicating the revival in Hyderabad real estate market with the formation of the separate state of Telangana from Andhra Pradesh, and the city of Hyderabad being the joint capital for the next 10 years. If a stable government is established after 2014 elections, the property prices in Hyderabad are likely to go up by 15 per cent according to the industry experts who participated in a series of panel discussions at CREDAI Hyderabad Property Show. The general elections this year are very crucial and the voters should differentiate the leaders who could maintain the standards and the politicians who use double standards. Many political parties are mushrooming these days with a mindset of making money through illegal means, though their manifesto shows Social Justice, Anti Corruption, Inclusive Growth, blah blah blah. Previously celebrities are invited into politics but now they are intruded for their own monetary gains. Everyone who is interested in earning early affluence choose politics as a platform. Unfortunately it resulted in a state where public lost faith in democracy. They must know the fact that wealth grows gradually and there is no short cut to success. Anything achieved step by step lasts longer. This month cover story says about how to make more money from real estate. Truly there is a lot of scope to raise funds from this sector but the stake holders should make wise and in-time investment decisions. Tenants in frying PAN As the financial year 2013-2014 draws to a close, tax returns and exemption filing is gaining momentum for the salaried taxpayers, who are required to file their tax exemption documents before March 31. This time around, however, many salaried taxpayers are being forced to forgo their house rental allowance tax exemption, as their landlords refuse to reveal their PAN, or a written declaration (in case they do not have PAN card) as per the new I-T norms passed in August 2013. The circular (8/2013) issued by Central Board of Direct Taxes states that “...an employee claiming exemption from tax with respect to HRA received is now required to report the PAN of the landlord to the employer, if the rent paid by the employee to the landlord exceeds Rs 1 lakh per annum, along with the rent receipt.” “I pay Rs 10,000 as monthly rent and my landlord demands it in cash. According to the new norms, I have to give the PAN details of the owner. But, he clearly said that he will not give any sort of PAN details nor written declaration. This time I

am planning to forgo the HRA tax exemption as I don't want to go hunting for new house,” said Dharam Singh, an analyst in an investment bank in Hitec City. Sudheer Allam, a telecom engineer, said “I pay a rent of Rs 14,000 per month since last six months. My landlord is neither

willing to provide PAN nor to sign the declaration that he doesn't have a PAN. If I am not able to give the details, around Rs 20,000 would be deducted from my salary.” Chandan Dhanani, a tax expert says, “If a landlord does not want to give declaration, then one would probably have to forgo his/her HRA deduction and claim for refund later. Giving rent receipts is to the

satisfaction of the employer. If not, one can file the I-T returns and claim HRA exemption on the basis of rent agreement or proof of payment through cheque or online to the landlord.” The new tax norm issued by Central Board Direct Tax, which mandates the salaried taxpayer to submit PAN and other details of the house owner to avail the HRA exemption, is to streamline the rental taxes, say tax experts. “Most of the house owners don't pay the tax on the rentals. But there are many employees who claim for house rental. There is a huge imbalance in the inflow and outflow of the rental tax,” said D. Vijay, a city-based chartered accountant and a professor of the subject. Earlier, an employee claiming HRA tax exemption had to show only a rent receipt (one every quarter) or a declaration from the house owners. But now it has been made mandatory to submit the PAN or a declaration by the landlord saying that he/she doesn't have a PAN. Vijay said, “The department cannot be blamed for the new norm as they are only trying to prevent tax losses. When a tax exemption is given on HRA to an employee, then the department needs to get the same tax from the house owners.”

Realtors stay bullish on Hyderabad market With an end to political uncertainty in the state, real estate developers expect a 20 to 30 per cent rise in property prices in Hyderabad in the next six months. “In the last three years, Hyderabad has seen just five to 20 per cent growth in real estate prices, due to a host of factors such as political turmoil, delayed clearances, and economic slowdown,” said N. Jaiveer Reddy, Credai president for Hyderabad chapter. Mr Reddy was speaking at the Credai Hyderabad Property Show 2014. “The next six months will be crucial, which will explain as to how Hyderabad

will shape up after the state's bifurcation,” said S. Ram Reddy, president, Credai AP. A Jones Lang LaSelle report says that over the next six to nine months, the overall business sentiments in the city are likely to remain stable.“Investors may find this period favourable, as property valuations are low and there is still potential to capitalise on this,” said Sandip Patnaik, MDHyderabad, Jones Lang LaSalle India. Realtors oppose shifting of tanneries to Rampally Fearing land rates may crash with shifting of tanneries from Bholakpur (Musheerabad) to Rampally in Keesara mandal, which is close to IT zone at Pocharam, realtors and property owners are opposing shifting of tanneries, plastic and iron scrap units there. Apart from realtors and locals, Gas Authority of India Limited (GAIL) has also raised objections over relocating the units as their gas pipeline passes through the area in Keesara mandal. Soon after water contaminationrelated deaths at Bholakpur in May 2009, which claimed 14 lives, the then chief minister YS Rajasekhara Reddy had directed the Hyderabad district collector and the Greater Hyderabad Municipal Corporation (GHMC) to shift tanneries, which were believed to be the primarily cause of water pollution in the area, along with other plastic and iron scrap units from Bholakpur to outskirts of the city. Though it is close to five years, officials failed to relocate even one tannery, plastic and iron units from Bholakpur due to pressure from the realtors lobby. Officials said the revenue department had identified about 44 acres of land at

Rampally village of Keesara mandal, which is also close to the modern abattoir at Chengicherla and behind Singapore Township. The land was handed over to GHMC in April 2010.When a layout was prepared, GAIL had raised objections over the layout for rehabilitation and relocation of Bholakpur units as their gas pipeline passes through the land. The State Human Rights Commission (SHRC), which has been closely monitoring the issue, sought a report on the gas pipeline details like depth, length and other issues related to the project from GAIL. Then, the realtors felt that if the units, especially tanneries, are relocated it may raise a stink apart from causing groundwater pollution. They approached a former minister of Ranga Reddy district and expressed their concern, a senior official of the Hyderabad collectorate said. Though GAILs objection can be resolved immediately, the revenue authorities have been sitting on it for the past two years, the official said. Incidentally, the state government had appointed a committee in 2009 itself with Hyderabad district collector as chairman, officials from GHMC, revenue department as members to shift

the units. The corporation had even conducted a survey for identifying traders in Bholakpur in 2010. As per the survey, 107 tanneries, 300 plastic and iron traders were running their businesses in Bholakpur. The Hyderabad district collector held several meetings with traders and officials on shifting of units from Bholakpur and the traders were assured that plots would be registered on the name of individual traders immediately. The collector and GHMC officials agreed to provide infrastructure like road, drainage, water connection, fire station, hospital, primary schools, labour quarters and other facilities to shift their units. The GHMC had even prepared tentative expenditure for basic amenities in the area at a cost of Rs 50 crore. However, everything came to a standstill with the intervention of realtors as land rates started escalating on areas abutting the Warangal state highway. When contacted, GHMC chief veterinary officer P Venkateshwara Reddy said there was delay in shifting the tanneries due to objections by GAIL, which would be resolved soon.

Hyderabad Metro eyes 55% revenues from real estate L&T Metro Rail (Hyderabad), a special purpose vehicle incorporated to execute the elevated metro rail project in Hyderabad, expects 50-55 per cent of its revenues coming in from real estate and the rest from ridership in the initial years, according to chief executive officer and managing director Vivek B Gadgil. “These models are not static but dynamic in nature. This ratio will change

when the ridership picks up over a period of time and they will definitely change depending on the city's development also,� he told media persons, on the sidelines of an international conference on publicprivate partnership organised by the Institute of Public Enterprise. The over Rs 15,000-crore project comprises 72 kilometre of elevated metro rail line and six million sft of transit-oriented development (TOD). Gadgil said while the total TOD proposed was 18.5 million sft, the company would execute six million sft first and then consider taking up the remaining 12.5 million sft either utilising accrued rentals or on a project-by-project basis. Stating that 90-95 per cent of civil works on Stage-I (between Nagole

and Mettuguda) was almost complete, and expected to be commissioned by March 21, 2015, he said the first full train with three coaches would arrive from Hyundai Rotem in South Korea by April-end or early May for trial runs at the depot. L&T Metro had already tied up funds with the banks. While it has been granted a viability gap funding of Rs 1,400 crore, the company has thus far spent around Rs 3,000 crore on the project through equity and debt in equal proportions. Also, the company has taken a comprehensive insurance policy and has so far paid a premium of Rs 27 crore to cover the project for the initial three-anda-half to four years. To a query on whether the bifurcation of the state and the uncertainty surrounding it would have any likely impact on the passenger traffic of the Hyderabad metro rail project, Gadgil replied in the negative. State Bank of India conducted “SBI Property Show” on 22nd and 23rd February at Shilpakala Vedika. CREDAI Hyderabad presented its Property Show at Jalavihar, Necklace Road from 28th February to 2nd March. Exactly around these days, from 28th February to 3rd March “Furniture Fair” is also organised at HITEX. But it made no difference in the huge number of footfalls at the most credible property show of the Confederation of Real Estate Developers Association of India (CREDAI).

About Visitors Real Estate Bulletin Team conducted a survey based on the responses received from the visitors. For the purpose of analysis and preparation of this report, the responses of over 1500 respondents has been considered, after accounting for not answered or incomplete and skewed responses. Our observations based the responses received from the visitors are as below: Age Profile: 52% of the respondents were in the age group of 25 to 34 years and 24% of the respondents were from the age group of 35 to 44 years indicating inclination of young population towards property purchase. 16% of the respondents were from age bracket of 45 to 54 years and 8% of the respondents were above 55 years of age. Occupation: 68% of the respondents were salaried. Self employed represented around 30% of the visitors and 2% were retired.

Monthly Income: 25% of the respondents reported monthly income between Rs. 25,000 to Rs. 50,000 which can be categorized as Middle Income Group (MIG). 46% of the total visitors were earning monthly income of more than Rs. 50,000 and belonged to Higher Income Group (HIG). Only 29% of the visitors were from Low Income Group (LIG) earning monthly income up to Rs. 25,000.

Product Mix: 2/3 BHK apartments were widely showcased in the expo accounting for 75 % of the projects exhibited. Villas, duplex apartments in the luxury segment and affordable homes for value buyers were also exhibited at the expo.

Prefeered Location: Gachibowli / Nallagandla / Manikonda around Hitec City, Miyapur / Chandanagar, Kukatpally belt and LB Nagar / Uppal / Nagole were the most preferred locations amongst the respondents.

Only 13% of the visitors were interested in property purchase at project launch stage.

All About Stamp Duty Real Estate Bulletin offers guidance on stamp duty and registration. It throws light on processes involved on transaction of property.

B

uying a house is one of the biggest financial decisions that you will make in your life. It is an overwhelming experience, both financially and emotionally. While buying a house, we need to identify the property, make down payment, apply for loan, sign the sale agreement, etc. The most important step while buying a house is the possession and registration of the property. After the possession of the property is being transferred to you, it is your responsibility to get it registered in your name. Possession is the physical transfer of the property, but it is not sufficient. You also need to have legal evidence of ownership. For this you will have to get the property registered in your name in the local municipal records, with the seller documenting that the property is being transferred to you. At the time of registration, you will also have to pay a stamp duty which is a government tax levied on property transactions. Let's try to understand what is stamp duty, why is it essential to pay stamp duty and many more aspects of stamp duty. Stamp duty is collected on the basis of property value at the time of registration. Stamp duty's amount varies from state to state and also property typeold or new. Since it adds up to the property cost, it's better to have a fair idea before you finalise your property deal. Stamp duty is a legal tax payable in full and acts as an evidence for any sale or purchase of a property. The levy of stamp duty is a state subject and thus the rates of stamp duty vary from state to state. The Centre levies stamp duty on specified instruments and also fixes the rates for these instruments. Real Estate Stamp duty is a type of tax

accumulation by the Government of India. Stamp duty is established on the agreement value or on the market value whichever is greater. Stamp Duty basically is nothing but a type of tax collected by the government under its jurisdiction for a transaction of property. The types of property may be freehold or leasehold from land (agricultural and non-agricultural), independent houses, flats to commercial units. As a general rule, Stamp Duty is generally paid by purchasers. According to early rules, the Duty has to be deposited in the government treasury for all property transactions, which are done through document or instrument under the provisions subscribed in Indian Stamp Act of 1899 and Bombay Stamp Act of 1958. The amount, collected by governmentappointed Stamp collectors, would go directly to the concerned State under which the individuals are taxed. In many states, still the Indian Stamp Act, 1899 is in force. For those who buy flats, stamp duty is calculated on the basis of the land parcel

applicable to the purchaser in the multistorey apartment. This is known as undivided share (UDS) of the property. For example, if the apartments made on 2400 sq ft having 10 equal sized apartments, each member has to pay for a stamp duty for 240 sq ft land. The size of UDS varies if the apartment sizes vary and largest portion will be allotted for those having large sized apartments. Why should one pay stamp duty? As mentioned earlier, this is a tax in line with sales tax or income tax collected by the Government. Technically speaking, Stamp Duty for any property transactions is paid under Section 3 of the Indian Stamp Act, 1899. Stamp duty is payable in full and on time. If there is a delay in payment, it attracts penalty at the rate of two percent every month on remaining amount and as maximum penalty being levied 200 per cent for the unpaid amount. Another advantage for paying stamp duty is that the document acquires evidentiary value. It is admitted in any court of law in India as evidence provided the documents are properly stamped. How to pay stamp duty? Now the question comes, how to pay the stamp duty? Many states have simplified the payment procedure. For example in Maharashtra, one can pay the stamp duty online as the government has recently announced linking of all subregistrar offices across the state for easy payment. Otherwise, stamp papers, equivalent to the value of the stamp duty, should be purchased in the name of one of the parties involved in the transaction. The amount will be paid at the sub-registrar office of the jurisdiction on or before the execution of the sale deed. Though in India it has become a practice that only purchasers bear the cost of stamp duty, actually, it is either paid by a transferee or purchaser or as mutually agreed in the agreement between parties. How much to pay as stamp duty? The percentage of stamp duty levied varies in different states. For example Maharashtra charges 6.5 per cent of the property value as stamp duty if the property lies within the city limit, while in Tamil Nadu 8 per cent Stamp Duty is collected for all types of property transactions. In our state of Andhra Pradesh, 7.5 per cent was levied as stamp duty and one per cent as registration charges over property transactions. But recently to boost the individual property buyers and the overall realty sector in the state, Chief Minister N. Kiran Kumar Reddy gave green signal to reduce stamp duty significantly, which will bring down the property registration charges. change, the highly regressive previous step of charging 5 per cent on Development & Construction Agreements has now been brought down to 0.5 per cent This was necessitated after drastic fall in revenue was noticed though real estate activity was booming. Obviously, due to the high stamp duty rate, parties were avoiding registration of such agreements defeating the very purpose of increasing the rate. Realtors said the government's decision will legalise property registration activities and check “shady transactions” which had been prevalent in the realty sector due to higher registration charges. This will be a win-win situation for both the consumers and the government since the revenues for the government will also increase significantly. It's the end users who were adversely affected on account of higher registration charges all these years.

The developers used to pass on the burden of higher registration charges to the customers. With this, properties had become unaffordable for people of middleincome groups. Moreover, it also encouraged builders and buyers to engage in shady transactions to avoid paying higher registration charges. “Instead of registering the properties, people opted for 'on-paper' transactions. The reduced stamp duty rates will legalise the entire registration process in the state. We consider it as a historical decision taken by the CM. We have demanding this for years,” said M. Vijaya Sai, secretary general of APREDA. The higher stamp duty on gift deeds had also prompted people not to go for registration of properties if it was transferred to members within the family. This issue has also been addressed by reducing the duty to 1 per cent from 5 per cent. Mortgage without possession in favour of government or local bodies or UDAs to ensure compliance to building/layout rules has been fixed uniformly at Rs 5,000 instead of the earlier 0.5 per cent; “other than above” has been kept unchanged at 0.5 per cent.

When cooking meat, use a meat thermometer to test for a safe internal temperature before eating. Do not eat raw or slightly cooked eggs. The old adage “One man's trash is another man's treasure” defines reuse. Reusing items by repairing them, donating them to charity or selling them reduces waste. Recycling includes collecting recyclable materials that would otherwise be considered garbage, sorting and processing recyclables into raw materials, and manufacturing raw materials into new products. Recyclable materials typically include: paper, cardboard, glass, metal, plastic, yard waste, electronic equipment, and food waste.

It's been reported that cockroaches spread at least 33 kinds of bacteria, six kinds of parasitic worms, and at least seven other kinds of human pathogens. While the sand prices stood at Rs 1,100 per tonne last month, it is currently being sold at Rs 1600 per tonne. local builders and property developers, owing to soaring sand prices ensuing in rising construction costs. Dealers said sand prices have increased by about 50% in the past several weeks caused by poor supplies from coastal Andhra due to the transport strike. While the sand prices stood at Rs 1,100 per tonne last month, it is currently being sold at Rs 1600 per tonne. In Hyderabad, at least 500 big to mid-sized projects have been affected due to the transport strike and the rising costs of raw materials. Local builders rue that construction prices have gone up by Rs 20 per square feet. "As it is, the market is far from being in a good shape. The spiraling costs will have a huge impact on the construction sector," said Ramachandra Reddy, joint secretary of CREDAI-Hyderabad. "Those who have already started their projects have no option but to go ahead with their plans as have to accomplish the dedication given to their customers. However, they have to contend with less-than-expected profit margins," he added. Industry specialists said the present situation will inevitably lead to higher property rates. "The prices may go up further in the coming days if there is no end to the agitation," said a sand dealer from Kukatpally. "The protestors there are

It does content very high silt fine particles. Presence of other impurities such as coal, bones, shells, mica and silt etc makes it inferior for the use in cement concrete. The decay of these materials, due to weathering effect, shortens the life of the concrete. Today, the Government have put ban on lifting sand from River bed. Transportation of sand damages the roads. are classed as most important minerals. The extraction of minor minerals is governed by state rather than federal laws. The sand-hungry construction industry uses the material to mix with concrete and for making bricks. Construction contributed 9.8% to India's gross domestic product in 2010, up from 8.4% in 2006. According to the Planning Commission, investment in infrastructure needs to increase to 10% of GDP by the fiscal year ending March 31, 2017, from 8% five years earlier, if India is to continue to develop. The state government has the power to make rules preventing illegal mining, and regulating the transportation and storage of minerals like sand. These can include putting in posts for checking minerals in transit and weighing the quantity being transported. Based on the recommendations made by a Group of Ministers, which reviewed the sand mining policy in the light of the Supreme Court's verdict banning indiscriminate quarrying, the Industries Department issued an order today framing the revised policy guidelines. The policy, if implemented effectively, will curb the growing activities of the sand mafia in the state and make sand available to all at an affordable price, officials said. The Government Order issued by Principal Secretary (Industries) D Sreenivasulu said the existing norms of the Andhra Pradesh Minor Mineral Concession Rules, 1966, were being rescinded to regulate sand quarrying activity. "Allotment of feasible sand-bearing areas shall henceforth be through a selection process by way of draw of lots.�Extraction of sand shall be by manual means only and use of machinery shall not be permitted except in specific sandbearing areas where there is no impact on groundwater table," the Principal Secretary maintained. For the first time, the Government

issued guidelines for sand mining in private lands along the river beds. Only farmers who own the sand-casted land will be permitted to quarry and sell it after paying seigniorage fee to Government. The Director of Mines & Geology has put the requirement of sand during 201213 for constructions or civil works in private and Government sectors at 218 lakh cubic meters and 230 cubic meters, respectively. The district authorities have been asked to identify new sand reaches.

AP to take up massive urban infra development programme The state government is planning to take up massive programme for urban infrastructure development to improve the living standards of low income groups and their economic development. This is as part of efforts to face the challenge of steep rise in population in urban areas with growth pegged at 33.5 per cent in the state against the national average of 31 per cent. The urban population in AP is projected to increase to 45.5 million or 4.55 crore by 2030 constituting 46 per

cent of total population. The state government has prepared detailed estimates of required investment in eight sectors which include water supply, sewerage, solid waste management, storm water drains, urban roads, urban transportation, traffic support infrastructure and street lighting. Based on the estimates made by the high power expert committee on urban infrastructure services, the per capita investment required in the state in the next six years (2014-2020) is Rs10, 846 on each

individual, amounting to Rs 30,695 crore. Part of the focus would be on Energy Efficiency measures to further improve power supply situation in Urban areas for which Govt. of AP/Utilities initiated a major programme of Restructured Accelerated Power Development and Reforms Programme (R-APDRP) with an investment of Rs 1,880 crore for development of IT and Supervisory Control and Data Acquisition (SCADA), System improvement works like REAL ESTATE

But we are happy farming on this land as of now,” he smiled. The going rate for an acre of land here is anywhere between Rs.15 to Rs.18 crore. Backbreaking tax on vacant land in Hyderabad In a strange twist of logic, the Greater Hyderabad Municipal Corporation (GHMC) imposes more tax on vacant plots than it collects from owners of buildings and other structures. For instance, a building owner in 300 square yard land in Jubilee Hills has to pay property tax ranging between Rs 5,000 and Rs 10,000 depending on the plinth area, while a plot owner in his vicinity has to cough up Rs 30,000 to Rs 60,000 per annum or more towards vacant land tax (VLT). As per the GHMC Act, 0.5% of

registration value of land could be collected as vacant land tax by the corporation. After a building is constructed on the plot, the owner would have to pay property tax based on assessment. This provision has been incorporated in the Act basically to discourage property owners to keep their plot vacant in a developed area, which would burden the civic body. Officials admit the VLT has become a major burden on plot owners as the registration and stamps department has been increasing land values from time to time. The government had last year revised

land rates to Rs 45,000 per square yard in areas like Prashasan Nagar in Jubilee Hills, Rs 30,000 per sq yard in Madhapur and Rs 20,000 per sq yard in Srinagar Colony. The high court recently declared that “levying tax on vacant land other than the land appurtenant to the buildings as provided under Section 212 (2) of the Act is ultra vires, unauthorised and illegal.” These remarks were made in a case in which the corporation tried to collect tax even after building permission was taken. Repo rate hike will intensify realty crisis The Confederation of Real Estate Developers' Associations of India (Credai) has expressed concern over the RBI decision to increase the repo rates by 25 bps to 8 per cent in the monetary policy review. C Shekar Reddy, President CredaiNational said, “The industry expected the RBI to maintain the status quo on rates as the index for industrial

production was at a low of 2.1 per cent for December. The housing sector has a multiplier effect on the economy as it covers 300 allied industries.” Sanjay Dutt, Executive Managing Director-South Asia, Cushman & Wakefield said “The RBI again adopted a hawkish stance and increased repo rate by 25 basis points, intensifying the crisis that the real estate sector is

already witnessing.” RBI's stance is disappointing as, and just as we started to see some uptick in home sales, this move can potentially derail the sector, which has been witnessing financial headwinds due to subdued sales and limited access to funding, he said.
