AIM FOR

EXCELLENCE APOSTAR POR LA EXCELENCIA

Marbella is a hotbed of talent that has always known how to shine. And the fact is, Marbella and Malaga are in vogue. International companies such as Google and Amazon, as well as major international hotel chains, are betting hard on Malaga and Marbella. This is already a reality, and it encourages us to continue along the same lines of quality and excellence in all sectors, and to keep growing and evolving. We still have a long way to go on a cultural and architectural level, in sporting events, and above all, in promoting and instilling in our children a love and passion for design and for the artistic and cultural environment, to the standard that this cosmopolitan city deserves. It is up to us to make a difference, to cross borders and position the name of MARBELLA in an international context with more precision and relevance, in order to attract the most important personalities. Between us all, and aiming for EXCELLENCE, we will succeed.

enelope owes her name to a song by Joan Manuel Serrat, one of the favourites of her parents, Eduardo Cruz, a car dealership salesman, and María de la Encarnación Sánchez, owner of a hairdressing salon. The Extremaduran and the Andalusian settled in the town of Alcobendas, Madrid, where the actress was born in 1974, and later her siblings, Monica and Eduardo. ARTISTIC VOCATION The actress always had an artistic vocation. Nine years learning classical ballet at the National Conservatory of Madrid, three years of Spanish ballet with Ángela Garrido, jazz dance courses with Raúl Caballero, and four years of acting at the Cristina Rota School gave her discipline and spirit of achievement. Her first opportunity came with the videoclip La fuerza del destino, by Mecano. Her spontaneity did not go unnoticed, and after her first contact with the cameras, her big break in the cinema came in 1992, with Bigas Luna in the film Jamón, Jamón, where she shared the limelight with the man who would later become her husband, Javier Bardem. With this film she was nominated for the first time as leading actress for the Goya Awards of the Spanish Film Academy. Her career had only just begun. With the role of Luz in Belle Époque, by Fernando Trueba, which won the Oscar for Best Foreign Language Film in 1993, an era began in which Penelope worked non-stop. In 1996, the actress filmed El amor perjudica seriamente la salud, and a year later, Abre los ojos. She also saw one of her dreams come true when she worked with Pedro Almodóvar. This was followed by a series of great successes in which her work won the hearts of audiences, critics and colleagues alike, such as La niña de tus ojos, with which she was awarded her first Oscar as leading actress. HOLLYWOOD OSCARS Her first Oscar nomination came with Pedro Almodóvar’s Volver, for which she also won a Goya, and was nominated for an Oscar as leading actress. The second nomination would come a year later, with Woody Allen’s Vicky Cristina Barcelona, for which Penelope won a Goya, and an Oscar for Best Supporting Actress. Her third Goya nomination came in 2009, with Nine. Never had a Spanish actress made it so far. International audiences succumbed to her charms when, in 2011, she starred alongside Johnny Depp in one of films of the Pirates of the Caribbean series, which would cross the billion-dollar mark for global box office sales. Protective of her private life, the actress has managed to keep her professional facet separate from her intimacy. She married Javier Bardem in 2010, after a three-year relationship, and she has had two children with the actor, Leo and Luna, who have always been her top priority. Those who know Penelope know that she embodies the best definition of a calm yet passionate woman, who is family-oriented and a loyal friend.■

JOSÉ CARLOS GARCÍA Q UA L I T Y CU I S I N E AND PRI D E I N LOC AL PROD UC E

José Carlos García knew from a very early age that he wanted to be a chef. Nowadays, he has been dedicated to the trade for over 25 years having been trained in the kitchens of great masters in several European cities. The prestige of managing for 20 years the only restaurant in the city of Malaga with a Michelin star, in addition to two Repsol suns, is proof that he chose the right profession

osé Carlos García loves local produce, which he acquires every day at Atarazanas Market, at the fish market, or from his trusted suppliers. The resulting dishes are drawn from traditional Andalusian recipes, with a touch of audacity, which flood with flavour the restaurant that bears his name, located in the Port of Malaga. They are the product of everything he learned in the family business of Café de Paris, together with his culinary experience and what he picks up on his travels. MALAGA IN ITS PUREST STATE The resulting dishes reflect his personality, in a formula that is the perfect combination of loyalty to his roots, the classicism of the family legacy, and “a touch of Rock ‘n’ Roll”. The tasting menu presents an array of local flavours, among which the seafood and fish dishes stand out, while sharing the limelight with vegetables, meats or game. An exquisite proposal that can also be enjoyed at home, with the possibility of the chef displaying all his culinary knowledge in the client’s own kitchen. Those who prefer to go to the restaurant or celebrate an event will find warm, comfortable, safe spaces. The different lounges offer privacy in exquisite surroundings, with the added bonus of enjoying a beautiful vertical garden or privileged views of the Port of Malaga, the Cathedral, the Alcazaba or Gibralfaro Castle. OTHER GASTRONOMIC OPTIONS Another way to enjoy José Carlos García’s cuisine is going to Café de París, one of the emblematic restaurants of the city of Malaga’s gastronomy for four decades. With a casual, cosy décor, you can try local dishes with traditional flavours, but adapted to today’s tastes. Cold soups, casseroles and fish, or meat and poultry, in a menu that varies depending on what the market offers each day. What José Carlos García proposes is a gastronomic experience marked by a passion for traditional Andalusian recipes and the quality of local and seasonal products, with that touch of audacity that makes it unique and special. ■

Grupo Mosh is currently a benchmark company on the Costa del Sol, but how did the idea of creating the group come about? CN: Mosh Fun Kitchen was our first project. In 2016, we opened a restaurant inspired by New York, where you can enjoy a fun dinner and have drinks to the rhythm of the music. The following year, we made another dream come true, opening a restaurant on the beach in Marbella, where clients could have a meal and choose from an extensive menu of cocktails, while enjoying the sun and surrounded by palm trees. In 2018, our big project arrived; an emblematic building on the Golden Mile, which we call the temple of music. The disco isn’t its only appeal, but also its fusion cuisine and its magical open-air terrace. That was the year when we realised we’d become a benchmark corporate group in the sector, and that we had to restructure our business and start operating as a group. After that, just one month before all the alarms went off in Spain due to the pandemic, Motel Particulier was inaugurated, inspired by “La Belle Époque” of Paris. It’s a dinner club with an unparalleled charm. Then Vila Santee. AB: I think Grupo Mosh has evolved spontaneously and naturally. What we’ve done is create experiences which we thought were lacking in our city, Marbella. It’s been five years now since we set up our first business, and what we’ve found is that we’ve created a group, Grupo Mosh. As entrepreneurs, you’ve suffered the consequences of this pandemic first-hand. Now that it seems to be coming to an end, how do you view the current situation of the hospitality industry in Marbella? CN: We try to be as optimistic as possible about the future. Although the tourism and hospitality sectors on the Costa del Sol have been hard hit, we remain optimistic because we have absolute confidence in the prospects of our city. Marbella is unique for its beauty. AB: The hospitality industry in Marbella now is reaching its limit. If we can’t start working in the next few months with a certain degree of normality, many of us will have to close down. It’s true that we were fortunate last season, but this winter has been very hard. We stay positive and hope it will be over soon. Is it easy to combine work with family life? How do you find the perfect balance? CN: As we work together, it’s complicated, and we need help at home so as to be able to attend to our work responsibilities. For the last year, we’ve primarily been striving to form a solid structure that allows us to entrust many of our functions, and to be able to devote ourselves more to the expansion of our group, the creation of new concepts and, of course, to our family. AB: The truth is, it’s not easy, as we’re both perfectionists and obsessed with our work. We have to learn to delegate... we’re working on that. You’ve managed to give each of your premises a unique character. Where do you get your inspiration for the distinctive atmosphere you create in your businesses? CN: We draw inspiration from the wonderful experiences we’ve had travelling around the world. We love decoration.

AB: What we enjoy most is travelling and drawing inspiration from what’s going on outside Marbella. Each business we’ve created has had a city as a reference. The atmosphere is created by our clients, we simply try to provide all the ingredients so that they always leave happy. You’re tireless workers and entrepreneurs. Can you tell us if you have any new projects in mind? AB: Despite the current situation, we intend to keep persevering, and for this summer of 2021, if all goes well, we’ll be opening a new beach club in Estepona. Your businesses are synonymous with success, so what’s the key to the Mosh phenomenon? CN: The key is never settle for less, always try to make new things happen, and surprise your clients. Along with our partners, we’re constantly trying to come up with new ideas to avoid the businesses becoming stagnant. Could you give us the keys to being the perfect host? AB: Simplicity, friendliness and treating everyone alike, no matter who they are. 4 words to define Grupo Mosh? CN: Original, fun, dynamic and surprising AB: Passion, Good atmosphere, Inspiration, Teamwork.

CN: La clave es no conformarse con nada, buscar siempre que pasen cosas nuevas y sorprender a tus clientes. here are instances where the works of architects surpass them in fame. The British architect, Tom Wright, is one of them. His name, unfamiliar to many, takes on meaning when it is known that he is the man behind the design of the Burj Al Arab in Dubai, one of the most famous and luxurious hotels in the world. Wright designed the hotel in 1993. Its construction began a year later, and it was completed in 1999. From the outset, Wright realised the magnitude of the assignment. Standing 321 metres high, and located in the middle of the Persian Gulf, the hotel is 270 metres from the beach, situated in the sea on an artificial island connected to the mainland by a walkway. BURJ AL ARAB IN DUBAI The interior decoration was carried out by the Chinese designer, Khuan Chew, who conceived a space based on Carrara and Brazilian marble, soft velvet and 22-karat gold leaf. Managed by Jumeirah Group, the building has a facade made of Teflon-coated textile material, and has 202 suites ranging from 169 to 780 square metres. Additionally, the hotel has nine active restaurants, including the Al Mahara, a space located under the sea, where you can observe aquatic species while enjoying an exquisite meal. The Al Muntaha restaurant, which is accessed via a panoramic lift, is located 200 metres above sea level on a cantilever platform, and offers breathtaking views of the city. At night, the hotel changes colour at 15-minute intervals, through a sophisticated lighting system designed to create a curious visual effect which, nevertheless, does not disturb the guests staying there. BAHRAIN WORLD TRADE CENTER Another of the architect’s best-known works is the Bahrain World Trade Center, located in Manama, the capital of Bahrain. Each of the towers is 240 metres high, with 73 stories, and the building is known for integrating wind turbines into its design, which produce enough electricity to cover 15% of the energy consumed by the hotel. The sail-like shape of the towers is designed to act as a wind funnel to direct the air to the point where the wind turbines are located. This creates an S-shaped current that runs perpendicular to the turbines, thus increasing their potential. Tom Wright has joined the list of the most outstanding modern architects. With a passion for excitement and new challenges, and after spending a large part of his professional life as chief architect at Atkins HQ in Epsom, he left the practice in 2013 to set up WKK Architects. Since then, Wright has worked on buildings in Australia, the Middle East, the Far East, Europe and the U.S., with works such as Capital Gate, the Tehran Ribbon of Light, and the Limassol Building in Cyprus.

COVID 19

FORCE MAJEURE, THE REBUS SIC STANTIBUS CLAUSE AND ABOVE ALL COMMON SENSE T E X T: S A N T I A G O D E L A C R U Z

Following the approval of Spanish Royal Decree 463/2020, which declared a state of alarm throughout Spain on 13th March 2020, and its subsequent modifications, we have been subjected to an exceptional situation that will last until 9th May 2021. The measures adopted by the Royal Decree, its subsequent modifications and the orders issued under the authorisations granted as a result of the situation caused by COVID-19, have had a decisive impact on many contractual relations in both the public and private spheres, as they have led to the total or partial, continuous or semi-discontinuous paralysis of a large part of the country’s economic activities, with supranational, regional and local variations. Attorneys, court representatives, judges, lawyers of the administration of justice and civil servants of the administration of justice, along with the rest of the legal operators, are contemplating how to solve the situations that have arisen from this surprising health crisis and its economic and legal impact on countless contractual legal relationships. In order to do so, we have no choice but to resort, on the one hand (1) to two legal concepts that are currently the centre of discussion - force majeure and the rebus sic stantibus clause, the exceptional nature of both of which gives rise to many doubts because their configuration is fundamentally jurisprudential and doctrinal and, on the other hand, (2) to that which should always be present in a society that wants to solve its problems without creating greater problems: common sense. Before briefly reviewing both legal concepts, we can simplify by saying that the application of force majeure is applicable in cases of supervening impossibility to fulfil what has been agreed, while when what has been agreed is not impossible, but rather when what has been agreed is possi-

ble but is much more onerous and produces a clear disproportion between the performance of one party and the other, then the rebus sic stantibus clause shall apply. In principle, force majeure only affects obligations to do or deliver a specific thing, not obligations (debts) of a purely pecuniary nature (the courts admit “at best temporary non-performance or delay” as a consequence of the supervening impossibility of fulfilling a pecuniary debt due to force majeure). However, the rebus sic stantibus clause does not distinguish between obligations of one type or another in its possible application, only in the supervening disproportion between the performance of one party and the other. FORCE MAJEURE Article 1105 of the Spanish Civil Code contains a description of unforeseeable circumstances or, in very broad terms, of the concept of force majeure: “Apart from the cases expressly mentioned in the law, and those in which the obligation so declares, no party shall be liable for events which could not have been foreseen, or which, foreseen, were unavoidable.” In these cases - events which could not have been foreseen or which, if foreseen, were unavoidable - the debtor is exempted from liability. COVID 19 is an unforeseeable event, and also seemingly unavoidable, which has disrupted the continuation of normality. But has COVID 19 resulted in a real, supervening impossibility to perform all or part of a given service or contract? This is the question that must be answered. Force majeure can only be invoked when performance of the contractual obligations proves impossible. Jurisprudence considers that all the means available to the debtor to fulfil the contractual commitment must be exhausted, including the performance of the obligation by alternative means. Consequently, it seems complicated to

invoke the supervening impossibility of paying a periodic rent or fee for companies that have the financial resources to meet such compliance during the period covered by the COVID-19 situation, although it seems logical that this would have to be qualified on a case-by-case basis so as to avoid making unfair generalisations. Finally, one thing is obvious. Case law excludes force majeure when the impossibility of fulfilling the agreed performance is caused by the debtor. The debtor who wishes to benefit from exemption from liability due to force majeure must have acted in good faith and must be able to justify that they have tried to adopt all the necessary measures to mitigate the harmful effects derived from such an event. THE REBUS SIC STANTIBUS CLAUSE Roman law did not create or generate the rebus sic stantibus clause, although at a certain stage of its development, the praetor began to grant an exception to the debtor when the creditor demanded the fulfilment of an obligation that was unfair to the latter. However, this was not a rebus sic stantibus clause. It was not until medieval law that the rebus sic stantibus clause was formulated. However, it arose in a non-express manner, when, due to the influence of Christian moral postulates, the requirement of maintaining the contract as long as things (rebus) remained as they were at the time the contract (sic stantibus) came into force. The aspect of “things being as they are” (rebus sic stantibus) is the origin of the possibility of revising contracts when things are no longer as they are. In the French 19th century, the use by the Courts of Justice of the rebus sic stantibus clause for centuries and its influence on the stability of contracts broke down for two reasons. On the one hand, due to the deep mistrust that the revolutionaries had towards the Judiciary - an essential part of the old regime- and, on the other hand, ▶ EXCLUSIVE LIFE MAGAZINE |

due to the abuse of the interpretation of the clause in favour of the most influential. This lead to it being excluded from the French Civil Code, consequently meaning that it was not included in all the 19th century civil codes of French influence, and the Spanish Civil Code was no exception. This explains why the rebus sic stantibus clause is not included in the Spanish Civil Code. However, in the 20th century a new event of global significance brought the clause back. In the legal field, the First World War made French jurisprudence work hard and, even without regulation in its Civil Code, it began to recognise the rebus sic stantibus clause in its law of obligations to moderate the impact of the war and its consequences in the disproportionate performance of parties in a very large number of contracts. In Spanish law, once the effects of the country’s own war had been dealt with, Spanish jurisprudence tried give the rebus clause a body of doctrine, listing a series of conditions for the Courts to accept the contractual modification. However, the Spanish Supreme Court was very demanding and cautious in accepting the application of the rebus clause and even considered it a “dangerous clause”, requiring for its application an extraordinary alteration of the circumstances, an exorbitant disproportion between the benefits and the annihilation of the balance of performance (see the Supreme Court Judgements of 25th June 2007, which reproduce the jurisprudential requirements established in the Supreme Court Judgements of 17th May 1957). However, the economic crisis of 2008 transformed Spanish jurisprudence, changing the traditional approach to the figure to give it a modern vision, with a view to standardising its application by the Courts, provided that certain conditions are met: Extraordinary alteration of circumstances, a consequent exorbitant dis-

62

| EXCLUSIVE LIFE MAGAZINE

proportion between the parties’ performances resulting in a breach of the equivalence of the considerations and that all of this occurs due to the appearance of radically unforeseeable circumstances. As additional requirements to the aforementioned presuppositions, it is necessary that the excess of burdensomeness or onerousness is not attributable to one of the parties, that there has been an act in good faith - and there is no good faith in the unilateral imposition by one of the parties of the modification of the contractual conditions under the rebus sic stantibus clause without initiating a negotiation process and, lastly, that there is no regulation or imputation of the risk derived from extraordinary and unforeseeable events in the contract. The idea that emerges from this new jurisprudential approach is that the application of the rebus clause by the Courts should not be something exceptional, but rather that its consideration should be standardised as it is a mechanism for restoring the balance of performance, accepted by law and based on the principles of good faith and contractual commutativity. There is no doubt that COVID 19, the lockdown, standstill or slowdown of economic activity are all exceptional circumstances that alter the onerousness of contracts and the proportion of the respective performances of the contracting parties. However, this is where common sense - and good faith - must prevail. The rebus clause is not a weapon or an excuse for non-performance of contracts in the form of procedural trickery. COMMON SENSE Gertrude Stein (American author, essayist, poet, playwright and businesswoman, who was born on 3rd February 1874 in Pennsylvania, USA

and died on 27th July 1946 in Neuilly sur Seine, Hauts-de-Seine, France) said that “Everybody gets so much information all day long that they lose their common sense.” This woman, ahead of her time, had already foreseen the pernicious effects of an excess of information and a lack of knowledge, a destructive combination of common sense. And what does common sense dictate? That before flooding the courts with avoidable lawsuits, in the private legal sphere, we as parties should try to renegotiate the terms of contracts that have been affected by the unforeseeable circumstance of COVID 19 in a fair and reasonable manner. That we should make preventive advice work to find the lost contractual balance, understanding that not winning is not necessarily losing. We have all been compiling judgements that have been upheld and some that have been rejected by the different Courts in order to situate ourselves, to prepare ourselves, to do our work better and to be able to advise our clients. Some judgments relating to leases of hotel rents, restaurants, commercial premises, airport shops, others relating to sales contracts, resolutions for non-payments, etc. With them and with the true legal understanding of force majeure in some cases and of the rebus sic stantibus clause in others, we must avoid misuse, but we must also avoid invented excuses, throwing weapons or procedural trickery deprived of good faith. We must apply common sense -and good faith-, we must avoid submitting ourselves to already overcrowded and in some cases collapsed courts, and we must encourage agreements between the parties -in private legal relations- with temporary formulas of reciprocal convenience to alleviate losses and reduce a wave of litigation due to non-payment, contentious contractual resolutions and bankruptcy proceedings.

H

ow is it that entrepreneurs focused on Marbella luxury decide to opt for Malaga? Carlos Rodríguez - The city of Malaga has experienced a remarkable transformation in recent years, becoming one of the fastest growing, most dynamic, culturally rich, and highly attractive cities to reside in. Based on these factors it was clear that Malaga’s residential market needed an iconic project fulfilling the shortage of high end properties in the city. How has the experience been so far? Luis Rodríguez - Working with an architect like Carlos Lamela, who has designed world-renowned flagship projects, has been an equally gratifying and enriching experience. Sales volume throughout the past year as well as currently has far exceeded our expectations despite the complexity of the pandemic, which ironically has had a very positive effect on high end real estate on the costa del sol, particularly in EPIC MARBELLA AND SB TOWER. We´re also pleased to announce and inaugurate the beginning of construction in SB Tower in Malaga this month. ”Sierra Blanca Tower” along with “EPIC by FENDI” in Marbella are the two most luxurious residential projects currently being developed in Spain and beyond. Two pharaonic megaprojects - quite a feat in the middle of a pandemic! What was your strategy? Carlos Rodríguez - Always remaining faithful to our philosophy as a company of maintaining the very highest quality standard and commitment to producing excellence, highly sought after locations, innovative design, and a very close, personal relationship with our clients. What are the differences between investors in Marbella and Malaga? What’s the buyer profile? Luis Rodríguez - The buyer profile in general is more international than ever, in both projects. Without specifying any in particular, North American, South American, Arabic, European, etc. and a recent growing demand from Spanish clients as well which is a very positive reference point.

Sierra Blanca Tower

There are more national clients in Sierra Blanca Tower which in turn has encouraged many international buyers, who traditionally invested in Marbella, to make the leap to Malaga, upon seeing the opportunity to be a part of an unprecedented project in luxury and quality. What would you highlight about “Sierra Blanca Tower”? Carlos Rodríguez - The first true luxury project in the city of Malaga. SB Tower will be the tallest building on the western perimeter of the capital, reaching 21 floors and 81 metres maximum height. Malaga’s urban planning for future buildings no longer permits a height aboSierra Blanca Tower

ve 60 metres, which guarantees the residents of Sierra Blanca Tower fully panoramic views from all levels and viewpoints in each and every apartment. What type of services will “Sierra Blanca Tower” have? Luis Rodríguez - SB Tower residents will enjoy truly world class amenities on the highest level such as three swimming pools; spa jet circuit pool, an indoor climatized pool, and a roof terrace sun deck pool on the 21st floor, having the most breathtaking views of Malaga. SB Tower gym will also enjoy stunning sea views, co-working area, entertainment/games room, as well as first aid assistance, etc. What would you say to a future buyer to make them decide to invest in “Sierra Blanca Tower”? Luis Rodríguez - Simply look at our track record of leading and widely revered developments by Sierra Blanca Estates over the last 36 years which have clearly stood the test of time. Some of which are the original villa estates and mansions in Urb. Marbella Sierra Blanca, Marbella´s most prestigious address. Reserva de Sierra Blanca, an outstanding recent success

of luxury duplex apts in Sierra Blanca; Epic Marbella, currently the leading true luxury project on the Mediterranean coast in association with Fendi Casa. Our concept is to provide extra large premium residences with the highest quality standard incorporating world class amenities and concierge services, all within the confines of the development in Marbella and Malaga alike. Sierra Blanca Estates is positioned as the leading luxury developer on the Costa del Sol. What’s the next project you have in mind, and where? Carlos Rodríguez - Due to incalculable hard work, perseverance and some good fortune, both Epic Marbella and Sierra Blanca Tower projects are under construction whereby sales are progressing at well beyond initial projections allowing us to start advancing new project ventures. Several exciting projects are already in the planning phase, the most immediate ones being launched this summer. We can however reveal two extraordinary villa projects in Sierra Blanca and a fully branded complex of seven villas by Karl Lagerfeld on the Golden Mile, a truly revolutionary concept in Marbella luxury living. ■

SANDON breaks into furniture design with an online custom-made furniture concept manufactured exclusively by highly qualified Spanish artisans. The customer has the ability to customize their own piece by selecting, if desired, the choice of fabric and the colour of wood finish to suit to their style. It offers truly unique pieces for those discerning customers who appreciate the value of small details. SANDON’s key values are quality and individuality. Only with high quality materials can pieces be designed to last, a value that appeals to our growing need for sustainability: buy less, but buy better.

SUSANA URBANO INTERIORS CREATING PERSONAL, EXCLUSIVE, AND UNIQUE ENVIRONMENTS

90

| EXCLUSIVE LIFE MAGAZINE

exclusivelife. | INTERIOR DESIGN

I have found that in the Costa del Sol, especially in Marbella, we are surrounded by wonderful villas that need change, certain houses have had previous lives and are now relatively outdated. But we are also surrounded by very modern villas that lack character and style. How can we add that interesting touch to a room, providing it with personality and making it exclusive? The first thing I like to observe is what type of room we are in and what surrounds us. The exterior environments and the structures of the houses have a lot of personality and speak for themselves, setting the new beginning and changes of the house. My purpose is to create designs and environments that are able to be enjoyed throughout the day, regardless of the time of day or the weather. Even when we are alone or entertaining guests. Likewise, each of these spaces and even the exteriors of the villas have to be united under a unique concept, sothat both the owners, guest are at ease from the first moment. In the study where we begin our journey, we observe these very significant elements. We then proceed to think about the reasons why our clients want to change their environment and what we as the designers see that needs to be improved. Our first stop is always the lighting. The importance of developing a good lighting concept that allows us to create environments throughout the day. Subsequently the selection of material. It is important to decide which are the appropriate materials for the different rooms in order to be able to convert them into what the clients are looking for. The selection of these materials, the furniture, the textures, and the colors that we choose will define and apply unique personality to each of the rooms. I always recommend creating different areas within a room, to enjoy it the most. Our activity throughout the day is different, so it is very important to adapt the environment to our lifestyle. The formula to achieve interesting, comfortable spaces with a personality that invites you to stay, is to analyze the way of life, needs, and tastes of our clients, combining them with the personality of the house itself. We achieve the exclusivity of them by using quality materials and uniquely combining them with our client’s furniture or with new pieces that suit the tenant or owner of the house completely. ■ www.urbanointeriors.com

INTERIORS

92

| EXCLUSIVE LIFE MAGAZINE

■ www.urbanointeriors.com

ART AS AN

INVESTMENT Buying art is a safe bet, as these pieces do not fluctuate as much as the stock market, real estate or other types of assets. Hence the reason why more and more people are focusing on art as a form of investment. Millionaires, singers, actors, film directors and sportsmen have come to create significant artistic patrimonies by investing their fortunes in art. One of the most renowned is George Lucas, the creator of the Star Wars and Indiana Jones sagas, who has a collection of some $600 million, with works by Norman Rockwell and Edgar Degas, among others. The singer, Madonna, also has a private collection valued at some $100 million, with paintings by Frida Kahlo, the painter she has admired since she was a child. For his part, the actor, Leonardo DiCaprio, has an artistic patrimony of around $260 million, and he has become one of the world’s biggest investors. His collection includes works by Picasso and Oscar Murillo.

T

he film director, Sophia Coppola, also has a collection of very valuable paintings and photographs. Former footballer, David Beckham, with a collection valued at around £40 million, loves provocative British art, including works by Banksy. Brad Pitt and Angelina Jolie are also great art lovers, and had a private collection valued at €18 million. After their separation, the actress put up for sale a painting by Winston Churchill that Pitt once acquired for her, and which Christie’s has valued at an estimated price of between 1.7 and 2.8 million euros.

Jackson Pollock’s painting, Number 17A, 1948, was acquired by the multimillionaire art collector, Kenneth C. Griffin, for some $200 million, while Paul Gauguin’s Nafea Faa Ipoipo, created in 1892, was bought by the Swiss collector, Rudolf Staechelin, for $300 million.

THE MOST EXPENSIVE WORKS OF ART Art collectors say that each piece is a unique, exclusive object, which appreciates in value year after year, reaching stratospheric figures. The painting Salvator Mundi, the last work painted by Leonardo Da Vinci around the year 1500, was sold for more than $450 million. Another noteworthy work of art was Paul Cézanne’s The Card Players, which was bought by Qatar’s royal family for $274 million.

Suprematist Composition by Kazimir Malevich, The Grand Snowing Mountains by Cui Ruzhuo, and The Visitor by Marlene Dumas are some other works that have been acquired for exorbitant prices.

For their part, modern works of art also fetch very high prices. One example is the sculpture Rabbit, by the American, Jeff Koons, which reached a price of more than $91 million, the highest figure ever for a living artist.

FAIRS AND AUCTIONS Fairs play an important role in boosting sales and generating trends. Art Basel, in Basel (Swit-

zerland), the most important event in the contemporary art calendar worldwide, and Frieze, in London (United Kingdom), which brings together almost 200 contemporary art galleries, are both worthy of note. Artissima, in Turin (Italy) has sections dedicated to galleries and emerging artists. And FIAC, in Paris (France), also features exhibitions and conferences. For its part, at TEFAF, in Maastricht (The Netherlands), you can see the best works of the moment. Finally, there is another way to obtain a work of art, and that is to participate in an auction. Prestigious auction houses, such as Sotheby’s and Christie’s, dictate the rules of the market. Founded in London in 1744 and 1766 respectively, they usually have between 20 and 40 auctions per month, offering investors and private collectors the opportunity to get their hands on the best works on the market. ■

EL ARTE COMO INVERSIÓN

102

| EXCLUSIVE LIFE MAGAZINE

exclusivelife. | BUSINESS

WINE T E X T: PA S C U A L G O N Z Á L E Z

| EXCLUSIVE LIFE MAGAZINE

exclusivelife. | WINE We are currently seeing how people are becoming more and more interested in wine and how this interest is prompting changes in the way it is made, in an attempt to adapt the product to consumers’ demands. My name is Pascual González. I am a sommelier and director of the Decopaencopa Wine Club and I am here to tell you about 4 new trends in the world of wine and about my personal project. ORGANIC AND NATURAL WINES Organic and natural wines are based on organic agriculture, which means that the wines are cultivated in an environmentally friendly way and without using any chemical products, trying to recover the native ecosystem by controlling pests biologically and, above all, placing value on the terroir, which when all is said and done, is where the wine originates. LOCAL OR REGIONAL WINES Giving value to regional products and the distinctive nature of each region, is something consumers find very appealing. Tradition, local grape varieties, as well as knowing the origin of these wines, arouses great interest. It is more than likely that someone who is strongly attached to their native land will ask for wines from that region. WINES WITH MORE FRUIT AND LESS OAK The days of “Parkerized” wines are long gone. This was the name used to define the style that the prestigious wine critic Robert Parker preferred: strong, concentrated wines with intense aromas and a pronounced taste of new oak in the wine. Now, as consumers’ tastes evolve, we are moving towards wines that are easier to drink and place less emphasis on extraction and oak. Wines of terroir and varietal character. SMALL PRODUCTIONS By nature, our brain tends to be quite exquisite, and when we see written on the bottle or we hear the sommelier say that the wine he or she is recommending is “limited production” or one of “only 900 bottles”, then we find it quite fascinating. These words awaken a psychological feeling of pleasure in us because we think they are synonymous with quality. In the great majority of small productions such a statement is true, since the smaller the production, the greater the care and attention paid to the production process. PERSONAL PROJECT The Decopaencopa Club that I run with my brother Daniel Gonzalez, is very much focused on everything I have mentioned above. Let me just explain a little about the Club. We started Decopaencopa with the dream of sharing wines from all over our country. Our goal is to encourage people to venture into this universe and discover all that wine has to offer. Hence the idea of creating a monthly selection of wines based on the knowledge and criteria of our team of sommeliers. We seek out wines that fill each bottle with honest and passionate work, wines that allow you to enjoy them to your heart’s content (gastronomic wines), wines that provide you with new experiences and, above all, wines of different styles so that we can help you to discover the diversity that both small, less well-known wineries and those with more established reputations can offer us. LA NUEVA VISIÓN DEL

VINO T E X TO : PA S C U A L G O N Z Á L E Z

108

| EXCLUSIVE LIFE MAGAZINE

T HE TRA NS G RES SION OF HAUT E COUT UR E

When it comes to describing the fashion designer, Yves Saint-Laurent, any adjective would fall short. His creative genius, transgressive at many times in his life, made him a man ahead of his time, elevating him to a position reserved only for the biggest names in fashion.

Born in Oran (Algeria), he was the eldest son of Charles Mathieu, a successful lawyer, and Lucienne Andrée Saint-Laurent, an elegant woman who immediately understood that her son was destined to be an important figure in the world of fashion. Constantly teased at school, she encouraged him to enroll in a dressmaking training centre in Paris, and he moved there when he was only 17 years old, ready to learn everything about the world of fashion. AMBITIOUS AND SENSITIVE His designs soon impressed Michel de Brunhoff, the director of Vogue, and led him to win his first awards, which would open the door to work under Christian Dior, making him his natural heir. He achieved great success with his first collection at Dior, but in 1960, he had to put his career on hold when he was forced to do military service. The harshness of the army caused him to fall into his first major depression. He was admitted to a military psychiatric hospital, and when he was discharged, he found that the house of Dior had replaced him. Yves Saint-Laurent sued the firm, and with the compensation received, he started his own couture house, with the constant

support of Pierre Bergé, the business partner who would eventually become his life partner. CREATOR OF THE WOMEN’S TUXEDO In 1962, he presented the first collection under his name, and four years later he launched the women’s tuxedo, which has become a fashion icon today. The couturier was the forerunner of numerous garments, such as the sahariana, shorts, transparent blouses and open-back dresses, which led him to success after success. Yves-Saint Laurent was the first designer to break the rules of haute couture. With the idea of making fashion accessible to everyone, he began to create his own prêt-à-porter collections. At the same time that he was reaping professional success, he was undergoing personal crises and addictions, which caused him to fall ill, be admitted and recover cyclically, without ever achieving emotional stability. For long periods of time, the couturier would disappear, taking refuge in his villa in Marrakech, only to reappear stronger than before. ■

FASHION ICON Throughout his career, many artists and public figures fell in love with his creations. The actress, Elizabeth Taylor, wore one of his designs at her wedding to Richard Burton, and his clients included Marlene Dietrich, Sophia Loren, Catherine Deneuve and Farah Diba. In 1983, the Metropolitan Museum in New York dedicated an exhibition to him, and by the end of the 1980s, his company had more than 10,000 people working in 200 countries, and a turnover of more than €360 million a year. The Yves Saint Laurent Foundation, which opened to the public in 2004, brings together the most important models from all the French couturier’s collections, along with his drawings and sketches. The Foundation houses some 5,000 outfits and more than 15,000 accessories, as well as rooms for exhibitions and press material, videos and interviews. Similarly, the designer’s legacy is also on display at the Yves Saint Laurent Museum, located in the fabulous Majorelle Garden in Marrakech, the city that so inspired the French couturier. And additionally, the Yves Saint Laurent Museum in Paris, inaugurated in 2017, where its 450 m2 presents dresses, accessories, sketches, photos and videos of his career. He retired in January 2002. Six years later, he died in Paris, at the age of 71, after being ill for several months. The fashion designer, who never stopped taking risks in his creations, took his rightful place among the best designers of the 20th century. Years later, women all over the world are faithful followers of a style whose hallmark changed the fashion world forever.

■ EXCLUSIVE LIFE MAGAZINE |

In different versions, fabrics and widths, the masculine suit is occupying more and more space in the female wardrobe, as a sign of strength and presence, but without sacrificing the glamour that characterises women with their own personality. This spring’s fashion does not renounce the masculine style capable of enhancing a woman’s most feminine side. They are designs for confident women, with an air of rebelliousness and, above all, a lot of style. Angel Schlesser opts for soft fabrics, jackets with plunging necklines adorned with necklaces of architectural structure, blouses with puffed sleeves and lightweight trench coats, while Isabel Sanchís proposes large lapels, sheen and a mix of shades. Brain & Beast makes a bold statement with asymmetric cut jackets, and trousers with bows as belts. Juan Carlos Pajares presents a woman with a very masculine look, in oversized jackets and vests. For his part, Marcos Luengo opts for blouses with wide sleeves, and corsets which, as a counterpoint, enhance the figure. Maine softens the masculine air of the suit with sheen, belts and feather trimmings. Dominnico opts for huge 80s shoulder pads and pastel shades. Pertegaz lets himself be carried away by ruffles, polka dots and an Andalusian style, proposing a femininity that never goes out of fashion. Finally, Devota & Lomba and Maison Mesa opt for a sober combination of colours and the always elegant black, combined with masculine hats that do not go unnoticed thanks to their size. The suit is an essential style for women. If you know how to combine it with shoes and accessories, the masculine air tends to enhance femininity even more. It is the art of being what it is not. The combination that speaks of an independent, selfconfident woman.

This naturalness and joy of life is also reflected in the newest brand campaign shot on the beaches of Tulum and Malibu, where the popular face of the brand Carolyn Murphy and new model Zippora ‘Zippy’ Seven present the newest TAMARA COMOLLI design highlights charming with a twinkle in their eyes. WATER AS A SOURCE OF INSPIRATION The German-born designer has embodied her beach girl spirit since childhood. Growing up in Spain, Gibraltar, France and Germany, Tamara Comolli has always felt magically drawn to the element of water. It therefore comes as no surprise, that the water drop has become the hallmark of the brand adorning each of her designs in solid 18-carat gold. “I still draw my strength and inspiration from spending time out by the ocean or lake. Whether it is scuba diving or taking my dogs for a walk on the beach… You always find me near water.” It is not only the love of water that distinguishes the TAMARA COMOLLI brand, but also its endless passion for rare and color-intensive gemstones. The latter is particularly evident in Tamara Comolli’s popular Color Stories, enchanting and harmonious color compositions that create true gemstone symphonies. To ensure that only flawless precious sto-

nes are used in the collections, each stone is carefully selected by hand in the company’s own atelier at Lake Tegernsee. Especially more elaborate designs such as the MIKADO Flamenco bracelet with its 51 acorn-shaped gemstones require many years of expertise in sourcing the raw materials. Always on the lookout for treasures of nature, Tamara Comolli also celebrates special “one-offs” such as Paraiba Tourmalines or Aquamarines in unique pieces, the so-called COLLECTIBLES. SPIRIT LOCATION” MARBELLA The designer chooses the locations of her boutiques, her so-called “spirit locations”, based on personal memories and experiences that she associates with the respective place. Representing the brand ethos of ‘Barefoot Luxury’ like no other, the Marbella boutique invites you on an exotic journey discovering sunshine, happiness, and sparkling gems – by the beach! Flowing shapes, bright colored gemstones and breathtaking silhouettes make up the ultimate “Marbella Look” allowing for that glamorous resort feeling all year long…■ Boutique Address TAMARA COMOLLI Fine Jewelry, Avenida Bulevar Príncipe Alfonso de Hohenlohe, s/n, at Marbella Club Hotel, Golf Resort & Spa, Marbella.

THE IDEAL DIET IT IS VOX POPULI THAT MEDITERRANEAN DIET IS THE BEST DIET IN THE WORLD. VALIDATED BY THE SCIENTIFIC METHOD, THIS IS A TRUE STATEMENT Of all the studies that support the benefits of the traditional Mediterranean diet, the Spanish PREDIMED (“PREvención con DIeta MEDiterránea”) study is the macro-trial that science worldwide considers the most important piece of evidence. We launched it in several centers, starting with a collaboration between the University of Navarra and the Navarra Regional Health Service in 2003. Thanks to the generosity of 7447 volunteer participants, we obtained the best scientific evidence of the benefits of this diet for health (and also for the palate). This is what we explain in the book entitled “PREDIMED: DATE EL GUSTO DE COMER SANO” (EUNSA, 2015). We developed a simple 14-item questionnaire with “yes” or “no” answers that was the basis for the intervention by trained nutritionists. A score of 8 or lower indicated poor dietary adherence, while a score of 9 or higher was a good sign. A mammoth task in changing this score in thousands of people, enabled us to show that the better the score, the better the consequences after 5 years: lower levels of risk factors for chronic disease, less obesity and lower risks of developing strokes, heart attacks, diabetes, arrhythmias or breast cancer. Even closer to our own actual lives, it has already been shown in other studies that obese people are very weakened against COVID19. Compared to people of normal weight, they have a 46% higher risk of becoming infected, a 113% higher risk of being hospitalized, and a 48% higher mortality rate. The good news is that a good compliance to the Mediterranean diet substantially reduces the risk of becoming infected by the coronavirus. Yes, you read that correctly. These are data that are pending publication and that I had the honor of announcing for the first time at the reception of the “Dr. Carles Martí Henneberg” Scientific Career Award, which the Danone Insti-

tute was kind enough to grant me in March 2021. In the SUN (“Seguimiento Universidad de Navarra”) follow-up study, with more than 9000 participants who had been assessed since 1999 with repeated measurements of their diet and other factors), it has been proven that the better the compliance to the Mediterranean Diet, the lower the risk of becoming infected with covid-19. This is consistent with the latest (2021) US News ranking again placing the Mediterranean diet in first place, as in previous years. It is rated as “the easiest diet to follow” and “the best among plant-based foods”. This top place is the culmination of a historical record of virtues that the best studies have demonstrated, time after time, from the reduction of premature mortality to protection against depression, diabetes, fatty degeneration of the liver, frailty in the elderly or cognitive impairment. But how is it possible for a single dietary pattern to have so many favorable effects? Simple. The traditional Mediterranean diet is able to cover all our nutritional needs. On the one hand, through a high consumption of virgin olive oil, fruits, vegetables, legumes, nuts fish and many salads, it ensures all the body’s requirements, such as protein, fiber, healthy fats, vitamins, or minerals. On the other hand, because of the reductions in red/processed meats, whole-fat diary and butter, commercial bakery and sodas, it lacks the vast majority of harmful ingredients, such as trans fats, refined flours, excess of ultra-processed foods or sugars. Such properties reveal that nothing but health benefits can be expected from it -a state so longed for and valued, especially in these times-. In addition, the Mediterranean diet shows us that eating healthy is not torture, but full of succulence. Undoubtedly, it is the best option.

LA DIETA

IDEAL

mperial town and capital of the South, Marrakech doesn’t look like any other city in the world. Its perfumes intertwine with the wind, surrounding and inviting the travelers to get lost among its cobblestone streets. It is a great handicraft centre, with green palm trees and ochre colored walls that turn a beautiful pink at sunset, granting its name to this fascinating city. Here, life still maintains a medieval character, where modernity and tradition cohabit and a vast spectrum of people can be seen, people who will ignite the curiosity and fascination of the visitors. Accompanied by a private guide, Nuba travelers will discover the city’s most emblematic and interesting monuments, such as the Saadian Tombs from the end of the XVIth century, the Bahia Palace, the exterior of the compounds of the Koutoubia Mosque, whose minaret is Marrakech’s emblem, or the walls of the ancient Medine, with its more than 25 access gates, 9 of which date to the Almoravid dynasty. Travelers will have the time to discover Marrakech at their own pace too; Nuba’s suggestion for this time is to get on a buggy to get to the Menara Gardens. But when mentioning gardens, the Majorelle Gardens are an indispensable visit, designed by the famous painter, to whom they owe their name, during the 20s. This charming botanical garden, open to the public since 1947, is composed of five great categories of plants from different parts of the world such as America, Africa, India or Mesopotamia. There, the visitors will have the opportunity to admire the taste and the elegance of a true botanical piece of art that, in the future, Pierre Bergé and Yves Saint Laurent would perpetuate. After a route along the Hivernage residential area, with its modern and landscaped avenues, and through Gueliz’s French neighbourhood, full of prestigious restaurants, the travelers will have the chance to discover freely the heart of Jemaa el Fna Square. The scent of incense and spices fills the air, and there is no need to open your eyes to realize that the vibrant Marrakech Souk unfolds in front of us, bustling and full of life. From the moment the sun begins to set, well into midnight, they will have the opportunity to attend a true living theater play, where musicians, acrobats, snake charmers, sword swallowers and fortune tellers gather around, staging a unique show that has gained Marrakech worldwide fame.

SUCCESSFUL FILMOGRAPHY During her career, she starred in films that gained acclaim thanks to her very presence, such as The Kneeling Goddess (1947), Maclovia (1948), Messalina (1951), Naked Passion (1952), The Soldiers of Pancho Villa (1958) and La Valentina (1965). With all of them, she gradually became the archenemy of the morality of those times. Her career consisted of 47 films shot in Mexico, Spain, Italy and France. She never accepted supporting roles, and always set her own salary higher than that of the male actors who starred alongside her in the films. Going to Hollywood never figured in her plans. “They only offer me Indian roles, and I only play queens,” she stated. FAILED MARRIAGES When Jorge Negrete died in 1953, María was filming La Belle Otero in France. She returned for his funeral wearing black pants, which caused quite a scandal at the time. Her fourth marriage was to the Romanian-born French banker, Alexan

der Berger, to whom she was married for 18 years. Berger died of lung cancer in 1974. Her last partner was the Russian-French painter, Antoine Tzapoff, about whom the actress commented: “I don’t know if he’s the man who’s most loved me, but he’s who has loved me better”. AHEAD OF HER TIME María Félix’s charm made her a symbol of glamour. Designers such as Dior, Givenchy, Yves Saint Laurent and Balenciaga made exclusive designs for her. “She’s so beautiful it hurts,” commented the novelist, Jean Cocteau. Maria Felix died in her sleep on April 8, 2002, on her 88th birthday. Her son had died of a heart attack years earlier, and her fortune was inherited by her 28-year-old personal assistant, Luis Martínez de Anda. The actress’ siblings hired private investigators, and although the body was exhumed due to suspicions that she had been poisoned, it was concluded that she had died of natural causes. ■

“Flowers! I hate flowers! They last for a day and you have to be grateful for them for the rest of your life.” “¡Flores!

In pursuit

of magic For those who gravitate to Ibiza, Bali and Costa Rica, Tulum is on the same vibration route and during covid times a hotspot as restrictions in the the Yucatan area are very lenient! T E X T: @ r e f i n e d b y k e n z a | k e n z a e y z @ y a h o o . c o m

TULUM HISTORY: Tulum was one of the last cities built and inhabited by the Great Mayan Civilization; located on the east coast of the Yucatan peninsula in southern Mexico, it was an important Mesoamerican centre which displayed both Maya and Toltec influence. Tulum was a major trading and religious centre between the 11th and 16th centuries CE. First settled in the 6th century CE, Tulum prospered, under the Mayapán influence as an important centre of trading. The Mayans constructed temples and pyramids. They created a style of writing with hieroglyphics and were knowledgeable in astrology and mathematics. This clever society produced beautiful works of art and became highly advanced traders. Not only did the Mayans create stunning art pieces, but they also cultivated vanilla, chocolate, pineapples, chili peppers and papayas. Protected by the jungle of Quintana Roo, the site survived the general Maya collapse and was largely left untouched by the Spanish. The ceremonial complex of Tulum, built on a 12 metre high limestone cliff, was surrounded on three sides by fortification walls, while the fourth side faces the Caribbean Sea. The name Tulum is a colonial one and means ¨wall¨. The original local name may have been Zama meaning ‘dawn’ in reference to the site’s position facing east across the sea. It is one of the only fortified Mayan sites in the world and one of one of the best-preserved Mayan sites in all of Central America.
