February 2 General Membership Meeting to feature Dungeness Water Management Open House The NPBA has arranged for an open house to be presented by the Department of Ecology regarding the Dungeness Water Management Rule at its next General Membership Meeting on Feb. 2, location to be announced. The open house will begin at 5:30 p.m with stations set up where you can talk with experts on the various portions of rule you may have questions about. At 6:30 p.m. dinner will be served and DOE staff will give 2012 Board left to right, back row: Garret DelaBarre, Scott Schwagler, Larry Hanna, Roger Wheeler and Greg McCarry. 2012 NPBA Board of Directors Installed

The 2012 NPBA Board of Directors were installed by Art Castle, Executive Officer of the Building Industry Association of Washington at the NPBA’s Annual Holiday Bash and Silent Auction on Dec. 10, 2011. The formal comment period will start once the rule is published in March. Plan to attend so you can be informed about what the adoption of this rule will mean to your property and your access to water once the rule is adopted.

NPBA’s Silent Auction raises nearly $1,800 for community support fund NPBA members attending the Annual Holiday Bash and Silent Auction check out the auction items donated by NPBA members and members of the community. The event raised nearly $1,800 for the Community Support Fund. Thank you to all who donated and purchased auction items. The NPBA Board thanks Donna Knifsend, Silent Auction chair, for coordinating this worthy event. NPBA Holiday Bash and Silent Auction

The NPBA’s Annual Holiday Bash and Silent Auction took place on Dec. 10 at the Sit-NBull in Port Angeles. NPBA would like to thank Gary and Gwen Blevins for their hospitality. NPBA members and guests enjoyed viewing all of the Port Angeles photo memorabilia and Dungeness Valley tavern history. A great time was had by all! The event was photographed by Kate Kesilis of Kesilis Photography who has posted a slideshow of the event on the Kesilis Photography Facebook page. Please take a minute to visit her page and check out the great photos. New NPBA printed membership directory format and distribution The NPBA Membership Directory Committee is very excited to announce a new format for the 2012 NPBA printed Membership Directory. In partnership with the Sequim Gazette, the 2012 Membership Directory will become a special "pull-out-andsave" section in the center of the new style 8.5 inches by 11 inches Official Expo Program Guide in March. There will be 26,500 copies printed that will be inserted into the Sequim Gazette, Peninsula Daily News and Port Townsend Leader, as well as being distributed at key locations in Forks along with the regular NPBA directory distribution plan. This is a terrific opportunity for NPBA members

to get exposure in thousands of households across the Olympic Peninsula. By now, you should have received your directory update form in the mail. Please return it no later than Feb. 3 to ensure your contact information and selected categories are up to date. If you did not receive your form, visit NPBA.info to download a form, e-mail faleana@npba.info or call the NPBA office at 452-8160. Forms may be returned via fax, e-mail or regular mail. Dear Donna: Question: After taking the lien class offered through the NPBA, I realize that I should be filing mechanic’s liens on some of my projects to ensure payment. My concern is that I am a subcontractor and the general contractor gets upset when I have to lien a project. How do I handle this? Answer: Blame the lawyers and good business practices. Tell the general contractor that your attorney has reviewed your contract and set up procedures to ensure payment. Part of the process is to lien the project when the work is completed by the subcontractor. As such, reassure the general contractor that you have the lien release prepared and ready to be handed over once payment has been received and cleared. (Conditional lien releases can help if you need to present the release in order to receive payment.) Although the property owner and general contractor will not be happy about the lien, it

is in the subcontractor’s best interests to keep the paperwork in place pending payment. Also, tell the general contractor that the lien is in the best interests of the general as well because if payment is not received, there will be an option to foreclose on the property rather than simply suing the general. Reinforce to the general contractor that following the lien laws makes both the subcontractor and general contractor look respectable and business-like as well as preserving options for payment. Just because a lien is filed does not mean that settlement cannot take place and the lien withdrawn. The key to prompt payment is to understand your rights, obligations, duties and explore your options. Note: Be sure and comply with all of the disclosure notices, preliminary notices, and time limits when dealing with liens. If you are unsure of the time limits and requirements to file a lien, consult with an attorney and also review the Labor and Industries website. Keep in mind that the L & I website has many forms and publications available to keep the contractor(s) in compliance. Finally, watch for upcoming NPBA classes that also can help you understand your rights, obligations and sound procedures. Question:

There are conflicting requirements in the International Residential Code (IRC) and the Uniform Plumbing Code (UPC) regarding the minimum shower compartment sizing (900in2 vs 1024in2) and the clear space in front of the water closet (21” clear space vs 24” clear space). Would the UPC, being more restrictive, take precedence?

Answer:

No. In this particular case, the requirements in the IRC would take precedence as it is the “first named code” in RCW 19.27.031. As stated in the RCW, “In case of conflict among the codes enumerated …, the first named code shall govern over those following.”

NLRB right to unionize poster rule delayed until April 30 The National Labor Relations Board has agreed to postpone the effective implementation date of its employee collective bargaining rights poster requirement — which includes a right to unionize notice — to April 30, depending upon the outcome of several legal challenges. The requirement was to go in effect on Jan. 31, but at least three lawsuits have been filed seeking to block the posting requirement — including one by the U.S. Chamber of Commerce. A federal court in Washington, D.C., has delayed its implementation until after hearing legal challenges to the new rule. The collective bargaining rights poster is available free for download on the NLRB website. If the rule is implemented, the poster must be hung in a conspicuous place with other workplace rights notices. The rule will apply to all employers with a gross annual business volume of $500,000 or more, whether or not the employer operates a non-union shop or conducts business in a “right to work” state. The NLRB has indicated that it will not conduct inspections to determine if the poster is in place, but it may take action if an unfair labor practices complaint is filed. The NLRB states on its website that it expects such complaints to be resolved if the employer subsequently agrees to hang the poster, but the agency could take further action if the employer refuses to hang the poster.
