About the Find Geelong By Warren Strybosch

The Find Geelong is a community paper that aims to support all things Geelong. We want to provide a place where all NotFor-Profits (NFP), schools, sporting groups and other like organisations can share their news in one place. For instance, submitting up-and-coming events in the Find Geelong for Free. We do not proclaim to be another newspaper and we will not be aiming to compete with other news outlets. You can obtain your news from other sources. We feel you get enough of this already. We will keep our news topics to a minimum and only provide what we feel is most relevant topics to you each month. We invite local council and the current council members to participate by submitting information each month so as to keep us informed of any changes that may be of relevance to us, their local constituents.

We will also try and showcase different organisations throughout the year so you, the reader, can learn more about what is on offer in your local area. To help support the paper, we invite local businesses owners to sponsor the paper and in return we will provide exclusive advertising and opportunities to submit articles about their businesses. As a community we encourage you to support these businesses/columnists. Without their support, we would not be able to provide this community paper to you. Lastly, we want to ask you, the local community, to support the fundraising initiatives that we will be developing

New Year: A New Start By Warren Strybosch

With 2022 now upon us, we have been looking forward to leaving 2021 behind and hoping to hear less about COVID and more about businesses beginning to thrive again, people enjoying their holidays, and everyone being allowed to have the freedom they once had before. Ironically, I am writing this article as I sit in my caravan whilst the rain comes pummeling down, with the caravan fridge not working, the battery getting very low, and many other families having already packed up and headed home; shortening their summer holiday.

I then listen to the news and hear all about the spread of COVID across the country with daily stories of people I know getting COVID, local businesses suddenly closing their doors because one of their staff or customers having COVID, and watching people start to get nervous about these new strains and the rapid spread that is occurring.

Not exactly the 2022 start I was looking for, but you know what, “it could be worse”. That is exactly what someone said to me when I was feeling sorry for myself…I had an excuse…my shoulder was feeling sore at the time. The person was not trying to be mean or non-sympathetic to my plight, but was, in their way, trying to get me to see that I was still very fortunate. I still have a job, my wife and three teenage kids, whom I love, can still put up with me, we have a house over our heads, good friends around us, good staff in the business, and no one in our family is suffering from any major illness or injuries. Overall, I am very fortunate. I share my situation with you in the hope that, whilst some of you are experiencing difficulties right now and may not know what the future holds, to not give up. This period will pass, and things will get better. For 2022, I hope your business thrives, your relationships flourish, and you find Mark Mogato joy in the day to day. That is my hope for you all.

I hear of friends leaving Victoria and moving to Queensland or WA, with the hope that they will have a better lifestyle in those states than our own.

Find Geelong Column by Mayor Stephanie Asher I’m sure you’ve heard the catchphrase “rates, roads and rubbish” in conversations about local government. Ensuring our roads are up to scratch and rubbish is collected on time and disposed responsibly are all important functions of any council, but the reach of local government goes much further than the ‘three Rs’. Councils fund some of our favourite local meeting and exercise spots, like parks and gardens, sports ovals, libraries, playgrounds, community hubs and aquatic centres. They also provide childcare and maternal child health services, tree planting programs, aged care support, some kindergarten operations and financial grants for a range of community groups and clubs. Given the breadth of services and facilities that councils are responsible for, there’s opportunity to play a significant role when it comes to one of the most pressing issues of our time – climate change. Greater Geelong Council is committed to demonstrating leadership in sustainability and to genuine action towards reducing negative impacts of our organisation and, more broadly, community practices. We recently endorsed our Climate Change Response Plan, which sits within our Sustainability Framework and Action Plan. The Climate Change Response Plan will specifically guide the organisation and the community’s response to climate change issues and impacts through to 2030. The two major targets that we’re most excited about are: • •

Net zero emissions for the City of Greater Geelong’s operations by 2025; and Net zero emissions Greater Geelong-wide by 2035.

These goals are no doubt ambitious but they are achievable, and will make a difference in our region. There are more than 80 actions in the plan, including: • • • •

Transition City-owned fleet vehicles to zero emission alternatives; Implement and promote the Shared Trails Master Plan to encourage active transport; Implement a pilot food waste service for residents; and Increase support for the community’s ideas and projects through Council’s Environmental Sustainability Grants.

An important element of the plan is to empower the community to take grassroots action – such as active transport, buying fewer things or purchasing second-hand items, recycling and reducing energy consumption. At my house, our compost bin and chooks take care of our food scraps, which our garden then benefits from. We recycle a lot of our washing machine water onto the garden, we’ve invested in solar panels, we walk rather than drive whenever we can, and I am something of an op shop addict. We know climate change is a complex issue that can’t be solved by just one level of government, section of the community or organisation. So our Council’s commitments are just one part of the solution. We will continue to advocate for funding and partnership opportunities with other levels of government, while also supporting the local community and business sectors to implement their own initiatives. Everyone has an active role to play, and our Climate Change Response plan lays the blueprint for a co-ordinated, collective effort.

Christian Super

– must merge with another superfund By Warren Strybosch

APRA, who regulates superannuation funds, has imposed additional licence conditions on the trustee of Christian Super to protect the best financial interests of the fund’s members. APRA said the new conditions seek to address concerns from an APRA investigation into Christian Super’s investment oversight, governance and strategic decision-making. They are also aimed at rectifying Christian Super’s persistent investment underperformance, which culminated in the fund’s MySuper product failing the first annual performance test. Under the terms of the new licence conditions, Christian Super is required to implement a strategy to merge with a larger, better performing fund by 31 July 2022. In doing so, Christian Super is required to engage an independent expert to ensure the merger is consistent with its duties under superannuation law. A Defence review has found no national security grounds to recommend the federal government overturn the 99-year lease of the Port of Darwin to Chinese company Landbridge. The national security committee of cabinet has considered the review it commissioned to re-examine the 2015 agreement under which Landbridge won the bid to operate the port in a deal worth $506 million, The Australian reports. Defence Minister Peter Dutton had pushed the review amid deepening tensions between Beijing and Canberra. The government is still reviewing the matter but the Defence review recommendation makes it more difficult for it step in and overturn the port lease. Scott Morrison has said the port lease was “undertaken by the former Territory government and it was not a lease that was approved by the federal government – it was not”.

He also said the government would only act in relation to the port lease “if there is advice from the Defence Department or our security agencies that change their view about the national security implications of any piece of critical infrastructure”.

The defence department also undertook a review of a Chinese company acquiring 50 per cent of shares in the Port of Newcastle back in March 2018 and found no concerns with the transaction.

Government Works to Prevent Future

There are an estimated 1.7 million undiscovered viruses in mammals and birds, any one of which could become a new pandemic. To combat and manage emerging zoonotic diseases, the federal government will put an additional $8.4 million into Australia’s wildlife health and early detection research over the next four years. Agriculture Minister David Littleproud said the funding would put Australia at the forefront of a global initiative aimed at preventing future diseases.

“Nearly all major exotic livestock diseases of potential concern to Australia, including African swine fever and foot-and-mouth disease, will have wildlife and/or feral animals as part of their cause or spread.”

The government is also putting aside $205,000 to aid Papua New Guinea’s recovery from African swine fever outbreaks since 2020 and $180,000 to bolster Timor-Leste’s biosecurity after the swine fever broke out in 2019.

Environment Minister Susan Ley said a healthy environment was a precursor to human and animal health.

Mr Littleproud said the funds would help encourage better farming practices to minimise the health risks, with more than 70 per cent of Timor-Leste households keeping pigs.

“This funding will prioritise the investigation of significant wildlife disease events to identify the underlying causes and determine their relevance to human, animal(s), and environmental health,” she said. Wildlife Health Australia will lead the program’s delivery, which involves the establishment of a One Health investigation fund.

“COVID-19 has brought into sharp focus the importance of recognising and managing emerging zoonotic disease The fund will also aim to officially partner risks which can originate from wildlife,” WHA’s research within Australia and the Indo-Pacific region with the World Mr Littleproud said. The virus is spread through close contact between pigs and is widespread throughout Asia.

Elective Surgery Wait Lists to Increase By Warren Strybosch

Public and private hospitals have temporarily reduced elective surgery to urgent procedures as the number of COVID patients increase. For the time being hospitals across the state will only performing emergency or elective surgery procedures. The reductions will apply to many private hospitals and not just restricted to public hospitals. It is hoped that these restrictions will reduce the strain currently being placed on the hospital system as the Omicron strain continues to spread rapidly throughout Australia.

SMSF: Where is your Trust Deed and is it up to date? ACCOUNTANT By Warren Strybosch

For Trustees, it is important to make sure the original trust deed is kept securely and updated when new superannuation laws change; especially where those laws will have an impact on the decisions made by the trustees of the fund. A recent case, Jowill Nominees Pty Ltd v Cooper [2021] SASC 76, has highlighted the importance of ensuring that original trust deeds are kept securely, read and complied with. As highlighted in Jowill, one of the key duties of the trustee is to know the terms of the trust deed and keep the original signed trust instrument safe and secure. If the trust deed is lost, it is very difficult for the trustee to discharge their duties. The duty in this regard is heightened for SMSFs given the interplay of the concessional taxation regime and the legislatively mandated rules around membership and trusteeship. These risks are magnified if, as a further example, it is the trust deed of a related unit trust or limited recourse borrowing arrangement that is lost. Lost trust deed If a trust deed is lost and reasonable searches and inquiries had been made with all relevant persons, legal and accountancy firms and 3rd party authorities that could have been expected to hold a copy of the trust deed, without success, the trustees might be able to relay on ‘secondary evidence’ to prove the existence of a trust. However, the secondary evidence must be clear and convincing evidence not only of the existence, but also the terms of the trust. Secondary evidence For a court to be satisfied the secondary evidence is suitable, the text of the missing document must be able to reproduce the trust in full (see for example, Barp Nominees Pty Ltd [2016] NSWSC 990) and there needs to be evidence to satisfy the ‘3 certainties of a trust’, that is: a. b.

the identity of the beneficiaries; the property the subject of the trust; and

c.

the nature of the trust (i.e. whether fixed or discretionary or an SMSF).

There are numerous instances of when trustee actions have not been permitted due to an outdated trust deed. If the Trustees were to undertake such actions without the authority of the trust deed they could risk, to name a few:

Often, the information falls well short of producing the full contents of the trust deed and could not be relied upon.

Failure of trust

It is a timely reminder for all trust and SMSF advisers that the obligation to act in strict conformance with the terms of a trust deed is perhaps the most important duty of a trustee. Where, the deed has been lost, a trustee cannot discharge this overriding obligation and will be held to be acting in breach of trust. Therefore, if the trustee continued to deal with trust assets and administer the trust, they would effectively cause further breaches of trust, and this could lead to further sanctions. As an example, if a trustee were to make distributions, in the absence of a trust deed, this would be a clear breach of duty. Keeping it up to date Not only should the trust deed be read and heeded, it also should be kept up to date. Given the trust deed governs the operation of the Fund and provides guidance to the trustee as to the particular actions they can undertake, it is extremely important to ensure that the Trust Deed remains current and that the Trustee has the authority under the Trust Deed to act to the extent permitted by the legislation.

Audit exceptions because of invalid powers that could lead to ATO investigations and sanctions; Loss of tax benefits - for example if they attempt to commence a particular pension without the power in the deed; The wrong beneficiaries receiving Death Benefits because of invalid documentation (eg BDBNs being deemed invalid etc).

Conclusion Trustees have a duty to account to the beneficiaries of a trust. Having a trust deed in place, that has been read, as well as the terms of the deed being heeded, provides a good starting point to avoiding many of the breaches that might otherwise occur. A trustee needs to discharge its duty by ensuring that the original trust deed is kept secure, but also read; and complied with. Lastly, the trustee needs to review the trust deed to determine if the trust deed needs to be updated to allow them to perform the actions required of them. Call to Grab Migrants from Rival Economies Marion Rae (Australian Associated Press)

A trickle of migrants to Australia might be just enough to keep house prices in the black but an extra million people would help the whole economy, experts say. “In a competitive global market, postpandemic, it will be one thing to decide to increase skilled migration and another to achieve it,” KPMG chief economist Brendan Rynne has warned in new research. Australia should proactively target higher intakes from countries where people tend to migrate to the United Kingdom and Canada, he said. That would mean more new Australians from Poland, Ireland, Germany and the United States. “During the pandemic, we have suffered a significant decline in foreign migrants settling in Australia such that our net overseas migration numbers have turned strongly negative – the first time since the end of World War II,” Dr Rynne said. The latest official population data suggests net overseas migration will remain negative this financial year before slowly recovering to 235,000 per year from 2024/25. This will leave the population around 700,000 less in 2025 than was expected before the pandemic.

But Australia is not the only country to recognise the economic, social and cultural benefits, especially from skilled migrants who tend to be younger than the average worker in our ageing population. Australia recorded the seventh largest intake of international migrants at around 820,000 people in the five years to 2019, according to United Nations data analysed by KPMG. People mostly came from China (132,000), India (120,000), UK (56,000), Philippines (40,000), and Malaysia (31,000). The UK and Canada, considered rival destinations to Australia, received 1.14 million and 532,000 migrants respectively between 2015 and 2019.

Net overseas migration added about 10 per cent to Australia’s population over the more normal 10 years to 2019.

The Department of Home Affairs has identified 44 occupations as critical skills needed to support Australia’s response to the COVID-19 pandemic and economic recovery.

But if Australia wanted to match that 10 per cent growth trajectory in population through international migration, almost

The festivities are over! We may or may not have over-indulged over the Christmas period. We have hopefully had some time to rest and rejuvenate. We have said goodbye to 2021 and it’s now time to welcome in the new year and spend some time planning, preparing and setting ourselves up for 2022!

For me, January is an incredibly important month. The personal and professional development work that I undertake in January sets the theme, tone, and framework for my year ahead. And yes, unexpected things can happen during the year, as can challenges and barriers, but for me, getting really clear on my focus and establishing my 2022 intentions are key strategies that help to set me up for a great year ahead.

What are Positive Intentions? A positive intention is like a map. It tells your mind where you want to go in life and what you want to achieve. When you are adding a positive intention into your day, you are basically telling your mind what it is you want to accomplish in the next 24 hours. We all set intentions at the start of each day, whether we know it or not. So, imagine the impact of spending time in January to set some positive intentions for your year ahead. Imagine the impact of having an overview of how you want your year ahead to be! Imagine having intentions to work towards and achieve throughout the year! Imagine being clear on what you want and why! This makes things so much clearer and helps us to move forward and create a life that we want to live and experience, and guides our daily intentions.

So, what do I do every January? I like to start each new year with some new year rituals. These rituals help me to re-focus, re-energize, and plan for a successful year ahead. I find these rituals to be extremely beneficial, positive, proactive, and rewarding activities. -

Visualising works well with mindfulness and helps me to get really clear on – how I would like to feel on a consistent basis, what I’d like to see happen, how I’d like to live my life, who I’d like to be surrounded by, what I want and why.

Affirmations – I write down positive affirmations – things that I need to believe to be able to achieve my positive intentions. Vision Board – I create a vision board which is a visual display of my positive intentions and goals for 2022. I put my vision board in a prime location, where I can see it every day. This helps to keep me focused. Read key Personal Development Books – These books get me motivated and energized and prepare me for a great year ahead. Books I recommend are – Atomic Habits by James Clear, Feel the Fear and Do It Anyway by Susan Jeffers, Find Your Why by Simon Sinek, The Slight Edge by Jeff Olson

For me, January is an incredibly empowering and creative month. Time spent planning, reflecting, visualizing, creating, reviewing, and setting positive intentions is time well spent! It is these actions that lay the foundations for a successful year and put me in the starting blocks, ready to take off and help other people to move forward and create positive personal and professional change for themselves.

New Year… New Cycle… 2022, the year to build BOOKKEEPER By Mary-Clare Switz

We all know that businesses are cyclical. The skill is knowing your business’s cycles, when it will be up and when it will be down and how to manage into the future. Some business owners are better at this than others. Too often a business will enjoy the rewards of an up cycle and then hit the down cycle with no plans in place. Suddenly payments from customers slow down. The simple equation is then … less money coming in, less money to pay suppliers. But should it be that way? Maybe a business extends its borrowings to keep up, or negotiate new terms with suppliers, or just not pay them at all until more money comes in. A solid client/supplier relationship that may have been in place a long time can very quickly sour with non-payment. A business can suddenly find themselves without some corner stones (ie product and/or service suppliers) that make their business happen. If you find your business in this position you need to look at what is happening. You know income has slowed down, but have your expenses? Some expenses will not shift very much if at all. But other expenses should fluctuate with the cycles. Business owners also fall into the trap of not compromising what they take out of the business. Is it realistic that your own ‘income’ remains at the same level when business is down? Is it realistic to expect your suppliers to become an impromptu line of credit? Businesses that do not plan ahead for their cycles can quickly find themselves with additional credit that now needs to be serviced and poor (or non-existent) relationships with suppliers. This will affect your customer relationships and it also makes it so much harder to get back into an up cycle. It really takes the fun out of having your own business! SMSF Trustees Need to Prepare for the Retirement Income Covenant (RIC) In other words, the investment strategy will need to show that the investments will indeed benefit the members and compared to other options, it was a suitable one at that. It will also need to be reviewed annually.

The Retirement Income Convent is set to come into force on 1 July 2022, and this will apply to all superannuation funds including Self-Managed Super Funds. The retirement income covenant (RIC) proposed by the federal government in 2018, that was meant to be in force in 2020, and now looks to come into effect on 1 st July 2022, will require all superannuation funds, including SMSFs, to have a documented strategy to identify the retirement income needs of fund members and provide a plan to service those needs.

It is likely to lead to a greater variety of products being made available after the covenant comes into play. Dr Deborah Ralston, who sat on the Retirement Income Review, said: “I can see in a decade how superannuation funds will have a portfolio of products sitting on their platforms for retirees to help them through that phase of life.”

When the position paper was first released, the Digital Economic Minister, Jane Hume, said: “The introduction of the retirement income covenant is an important step in encouraging the further development of the retirement phase of superannuation.”

However, it is our belief that many products will come and go, and retirees will find it hard to move away from the products they are so familiar with e.g. allocated pensions with access to a variety of investment options, and lifetime income streams or annuities providing a guaranteed income stream.

“The covenant will codify the requirements and obligations for superannuation trustees to improve retirement outcomes for individuals, while enabling choice and competition in the retirement phase.” Sally Evans, director at Allianz Retire Plus, when discussing the proposal, said: “The covenant is essential because our industry is so heavily weighted to the accumulation phase of retirement. A covenant will help us focus on the purpose of superannuation and what is the right way for individuals to smooth their income to last a lifetime”. Currently, retirees are unwilling to draw down their capital in retirement for fear of running out of money. Allianz Retire Plus surveyed many retirees, and 61% were fearful of running out of money more than they were worried about dying. “People don’t know how long they will live, how long they will work or what their health status will be. Those uncertainties play out in fear and a lack of confidence. That creates an enormous challenge for people to overcome,” said Evans. A key finding of the Retirement Income Review, which has led to the RIC, is that they believe it is possible for retirees to increase their standard of living by better utilising their assets in retirement.

What we are sure of is the additional cost this will place on SMSF Trustees, who will be required to provide an Investment Strategy that meets these new requirements related to the RIC. The paper states: “Trustees are required to formulate, review regularly, and give effect to a retirement income strategy for the retired members of their fund, and the members of their fund approaching retirement. The strategy can be formulated for all members in generality, or cohorts of members in generality, as identified by the trustee.” Already we have seen auditors requesting more details regarding the investment strategy. Given most accountants cannot develop an investment strategy, trustees have had to engage financial planners to prepare the investment strategy which has placed increased costs on the SMSF members. When the RIC comes into play, auditors will be scrutinizing the investment strategy even more to make sure it meets the RIC requirements. Our opinion is that modelling will have to form the basis of each investment strategy so that trustees can demonstrate how the investments will give effect to member’s retirement.

Interestingly, according to the paper, the development of the retirement income strategy would not fall under the provision of giving financial advice to members. The paper states that “the retirement income strategy expresses the broad actions the trustee will take to assist their members to balance key retirement income objectives and does not consider the specific circumstances of individual members.” However, given the retirement income strategy will need to take into consideration the members’ balance, future goals, risk profile, age or retirement and so on, it is more likely the development of the RIC will require input from financial planners. The paper is open for consultation until 6 August and further consultation on exposure draft legislation will take place later this year. Subject to the passage of legislation, the covenant will commence from 1 July 2022. All in all, SMSF trustees can expect the ongoing costs of managing a SMSF to rise. Exit and Emergency ELECTRICAL OPERATIONS

At Clutterbuck Electrical we are always getting asked by a lot of building owners, tenants, school principals and maintenance managers if they need Exit and Emergency Lighting. The Building Code of Australia (BCA) 2010 states this requirement for this in Section E, Part E4. In essence every class 5, 6, 7, 8 or 9 building where the storey has a floor area more than 300m2 needs to have emergency and exit lighting. This includes shops, cafes, restaurants, milk bars, schools, offices, warehousing and some residential situations. All required Exit and Emergency lights must comply with Australian Standard AS2293.1 Exit and Emergency lighting provides lighting for occupants to safely exit a building when the normal lighting has failed due to power loss. Each exit and emergency luminaire is fitted with a battery and is required to provide light for at least 90 minutes after the power fails. Exit signs need to be clearly visible to the occupants of a building and illuminated at all times. They will be installed directly above exit doors, at the top of staircases and at any change of direction along the way to directing people along the “Egress path” escape route to a final exit or evacuation point. Emergency lights are installed at regular intervals around a building to illuminate the egress paths out of the building. The type of light, building shape and ceiling height will determine where they are required to be installed. What are the steps in planning emergency lighting? • • •

Walk around the premises noting large open areas and potential hazards in an evacuation. Identify what route people would take if an evacuation was to occur. Evaluate what fire safety equipment and evacuation measures are in place including fire fighting and first aid equipment, fire detection and alarm systems, location of evacuation hazards, employees’ understanding of escape routes and evacuation, testing of emergency equipment and high-risk areas of ignition.

Create and implement a plan of improvements to existing systems and equipment, including that the emergency lighting in place is adequate and compliant. A record of the improvements made to the emergency lighting must be documented and stored in a safe location. This must include a plan for testing the lighting on a regular basis. The emergency lighting document needs to be reviewed on a regular basis. Who can test Exit and Emergency lighting?

An appropriately qualified person such as a licensed electrician should be used to test and inspect the components of any style of emergency lighting system. The AS/NZS2293 standard includes requirements for testing of circuits and sensing of supply to the test facility which can only be performed by someone with the suitable qualifications. How do I know if my Exit and Emergency Lighting is working? Every exit sign and emergency light will have a visible LED Charge indicator in either a red or green colour.

If this indicator light is on it means that there is power to the fitting and that the battery is being charged. If the charge light is not illuminated, it means that either there is no power to the fitting or it has suffered a battery charging failure.

Demonstrating proof that the required repairs identified during the duration test have been carried out is necessary to demonstrate compliance. AS/NZS2293.2 outlines the Routine Service and Maintenance tasks that must be undertaken and recorded on a 6 monthly, 12 monthly and 10 yearly basis in order to ensure that the system operates correctly as per the installed design. These tasks undertaken during inspection, include but are not limited to:

Cleaning of exit signs and luminaire diffusers to remove dirt and insects Visual inspection of fittings for damage or obstructions Inspection of the duration test facility for correct operation Inspect that replacement fittings installed during maintenance match the classification and spacing requirements of the original design Check directional arrows on exit signs are labelled as per the original design Review of the maintenance and service records to ensure any defects or non-conformance recorded during the previous tests and inspections have been rectified.

One last thing, you may hear electricians talking about different types of exit and emergency lighting. There are two main types of lighting. Maintained and nonmaintained. What are the different types of emergency lights?

Each fitting will also have a test button next to the indicator, holding this button down will momentarily put the fitting into emergency mode.

• Maintained a maintained emergency light is continuously on and when the power fails it switches to a battery powered emergency output. • Non-maintained - a non-maintained emergency light is not normally lit and activates only when the power fails.

What do I do if I notice that one of my Exit and Emergency lights is not working?

What is the difference between maintained and non-maintained emergency lights?

Ideally steps should be taken to ensure an emergency lighting system is in perfect health and all fittings are operational at all times.

Non-maintained emergency lights turn on only during a power failure. Maintained emergency light illuminate continuously and continue to work during a power failure which enables them to function as both a standard light as well as an emergency light.

If you notice any fittings that are not working and pose a risk to occupant safety, you should report them to the maintenance contractor or other responsible party. That being said the twice-yearly scheduled duration tests will identify faults and list any defects or nonconformances for corrective action.

As difficult as it is to think about, we don’t want to leave the hard decisions to our families when they are grieving or suffering with our passing. Having a valid and accurate Will as well as other documents in place will alleviate a lot of the unnecessary concerns for the loved ones that we leave behind. A valid and effective Will is one that is tailored completely to you and your family needs that ensures the protection of your assets so that they pass to the beneficiaries that you intend. Circumstances that require your Will to be updated It is very important that you revisit your Will regularly, as different circumstances throughout your life may give rise to your Will being revoked or invalid. This is to ensure that your assets are passed to the people you actually intended and according to your wishes. Relationship changes in your life do have a significant impact on your Will, such as: •

Marriage automatically cancels a Will, unless your Will clearly states you were planning this marriage when you made it.

Divorce does not revoke the entire Will. Generally, it will revoke only any specific gifts to your former spouse but does not revoke the entirely of distribution of your main assets. Therefore, it is vital after a divorce to correctly revoke and update your Will ifOUR youSERVICES do not want your former spouse access to your assets after you pass and possibly avoid a massive legal drama for your family.

If you separate, your former partner will still get your property unless you make a new Will. It is important that you make a new Will after the separation of any relationship so that it cancels your old one.

When you enter or end a de-facto relationship, your Will should also take this into account. Other life events where it is crucial to update your Will to ensure it is the most accurate and up- to-date document are: • • • •

• • •

Having children, including adopted or foster children, or grandchildren. Buying significant asset or investment, such as a house. Get involved in a new business, company or trust. Your Executor or Trustee appointed in your Will dies, becomes unwilling to act or becomes unsuitable due to age, illness or distance. A beneficiary under your Will dies. You sell of giveaway any asset that you had specifically gifted in your Will. Your financial circumstances change, including any changes to the entities or structures you hold.

How do I correctly revoke my Will? A Will can only be revoked under certain circumstances. Among these circumstances are: • • •

whether or not a later Will exists, whether there was a document declaring a revocation intention or whether the testator or someone in the testator’s presence and by his or her direction attempted to destroy or write on the Will with the intention of revoking it.

In Victoria, there are four ways to revoke a Will. They are by • creating a new Will, • writing, declaring an intention to revoke it executed according to the Wills Act • destroying the Will, or • by the testator or by someone else in his/her presence and at their direction writing on the Will or dealing with it in such a manner that the Court is satisfied that from the state of the Will, the testator intended to revoke it. The easiest and most recommended way to revoke a Will is simply by creating a new one. The new Will, if properly executed and includes language that states your desire to revoke prior Wills, will be found to indeed revoke any prior Wills. Although for small changes a “Codicil” (which is a separate legal document explaining these changes in the Will) can be used, it is important to note that once a Will has been signed, there can be no alteration by crossing out or writing in new clauses. A Self-Managed Super Fund (SMSF) loan or limited recourse borrowing arrangement, as they are also known, are a great option if you are not able to buy an investment property outright. However, they are one of the most complex forms of finance in the current market and there are some very strict rules that you must adhere to that have been set out by the ATO. Self-managed super fund property rules

For anyone that already has an SMSF set up or are thinking of moving from either a more traditional retail or industry fund, the first step is to obtain both financial and accounting/taxation advice. Several accountants have an Australian Financial Services Licence, which is required to give advice on self-managed superannuation funds. However, if you would prefer to deal with your regular accountant and they don’t hold an AFS licence, then you will also need to seek the advice of a financial adviser who does. They can then give both the advice in relation to the benefits of moving to an SMSF, ongoing advice concerning the property & lending and diversification of other investments within your fund.

If property investment is in line with your overall retirement planning strategy, then you will also need to factor in the differences with purchasing an investment property through an SMSF when compared to a standard investment purchase outside of your super. SMSF borrowing Higher Costs - SMSF loans tend to attract both higher interest rates and set up fees than standard investment loans. • Single Acquirable Asset – you can purchase land for investment purposes, but you can’t construct on it under a separate contract. You can however purchase a property under a single combined contract, such as properties that are purchased ‘off the plan’. • Hard to Cancel - If your SMSF property loan documents and contract aren’t set up correctly, you can’t unwind the arrangement. You may have to sell the property, potentially causing substantial losses to the SMSF • Cash Flow - loan repayments must come from your SMSF. Your fund must always have sufficient liquidity or cash flow to meet the loan repayments. This will be offset by the fact that your rental income will also be paid into your SMSF account. So, there are a lot of facts to consider when looking at this strategy, but the main thing is to do your due diligence and to get the right advisers on board including a finance broker who specialises in this form of lending, which is not common due to the complexities of the arm’s length arrangement.

RAT in demand but States are responsible for supply By Warren Strybosch

The undersupply of Rapid Antigen Test (RAT) kits is causing frustration and concerns for many business owners and consumers alike. With PCR sites turning away people from as early as 4.30am in the morning, everyone is struggling to know how to move forward. What makes matters worse is that the RAT kits are only free to those who have a Commonwealth seniors health card, a healthcare card, a low-income card, a pension concession card, DVA Gold card or a DVA white card, leaving the rest of Australians having to pay out of their own pockets. The prime minister announced that anyone selling rapid antigen tests at more than a 20 per cent mark up would be in breach of a biosecurity regulation declared by the Health Minister. “And that carries a penalty of $66,000 and up to five years in jail,” he said. “We will include rapid antigen test as those products covered by the export controls that we put in place.” Mr Morrison said a purchasing restriction of one box of rapid antigen tests per person would be put in place. The Government is under pressure to provide free RAT kits and more of them. However, it is estimated that it is costing the government $50,000 per person per year to manage the COVID virus. No wonder the government has moved away from government controls to more of a self-managed approach where people are now required to purchase their own RAT kits, and self-isolate for 7-days if the test comes back positive. Interestingly, it has been heard that the RAT needs to be monitored closely and that at the 15-minute mark, the ‘true’ result will be displayed and after that the RAT test is known to display a negative result even if at the 15-minute mark, the test showed a positive test. The federal government has stated that the states are responsible for the purchase and administration of the RAT kits. Also, the federal government has stated that RAT tests do not need to be reported. As per the norm, the Victorian State Government has once again gone against federal government mandates, not only are they complaining they should not be responsible for providing RAT kits (no wonder Victoria has run out), but the state government are insisting that anyone who records a positive RAT result must report it immediately. Hopefully, the Labor government can find some additional supplies so that business owners and the wider community can get on with their lives.

The federal treasurer remains confident a surge in Omicron cases across the country won’t derail Australia’s economic rebound, following last year’s COVID-19 lockdowns. It comes as new figures released by the tax office showed 485,000 jobs were created across the nation since September. Josh Frydenberg said the country had experienced a jobs boom in recent months. It’s estimated there are 180,000 more people in work now compared to the beginning of the pandemic, “Small businesses across the country who did it so tough early on are now coming (back) better,” Mr Frydenberg told Sky News on Monday.

“What we’ve done so far during the pandemic here in Australia is avoid a repeat of the experience of the recessions that we had in the 1980s and the 1990s,” Mr Frydenberg told reporters. “We’re not out of this pandemic, there is no room for complacency, and we need to lock in this economic recovery.” Opposition Leader Anthony Albanese said the rebound in jobs figures was only because the economy had shut down due to government failures surrounding COVID. He said the new data didn’t tell the full story regarding employment. “One of the things we see with the jobs figures is the fact that two million Australians are either unemployed or want more hours,” he told reporters in Newcastle.

“We’re starting to see these jobs coming back and it’s looking very promising for the Australian economy.”

“They want full-time, permanent jobs, and one of the things we’re seeing in Australia with the insecure work is more casual jobs, less permanent jobs and less security for people.”

The Australian Taxation Office data on Monday comes after the unemployment rate recently fell to 4.6 per cent, which was a 13-year low.

The tax office data takes in the period following the lifting of lockdowns driven by the Delta variant in NSW, Victoria and the ACT.

Meanwhile job advertisements are at a 13-year high, with more than 250,000 positions available.

COVID-19 restrictions across the country eased after the lockdowns ended, but

infection case numbers have surged in recent weeks due to the spread of the Omicron variant. But despite the rise in infections, Mr Frydenberg said the economic recovery was still on track. Mr Frydenberg said there would be a natural progression in allowing international tourists to return to Australia, after travellers from overseas were largely blocked from coming to the country for nearly two years. Responding to calls by leading economists for a more aggressive approach to migration to help fill job vacancies following the pandemic, the treasurer said it would be done in a measured way. “We’ll continue to have a balanced, considered approach to migration,” Mr Frydenberg said. “We did see throughout the pandemic last year and the year before that, population growth (was at) … the lowest level in more than a century. “This is going to be one of the more permanent impacts of COVID on migration.” Skilled workers, visa holders and international students have been able to return to Australia without the need for a travel exemption since mid-December. expensing or not. In certain situations, it may be beneficial to spread out tax deductions over multiple years. Also, certain large entities will have separate eligibility criteria.

Accelerated Depreciation via Backing Business Investment Businesses with less than $500 million in aggregated turnover can accelerate depreciation deductions for new assets in the 2019-20 and 2020-21 income years. Accelerated depreciation rules for these entities have subsequently been superseded by new ‘temporary full expensing’ legislation in November 2020. However, the option to use accelerated depreciation continues. Accelerated depreciation is available for assets in the first year the asset would ordinarily claim a deduction. In the first year a deduction is allowable for 50% of the installed cost of the asset plus regular depreciation rates for the remainder. The Backing Business Investment measures are in concert with the extension of the instant asset write-off.

However, it may only be relevant for some clients until 6 October 2020, when the full expensing regime commenced. Small businesses using pooling can use a 57.5% write-off for assets purchased after 12 March 2020 that do not qualify for immediate write-off in the 2019-20 income year. Small business entities are also covered by the new full expensing legislation.

Instant Asset Write-off - COVID-19 Tax Stimulus Package The instant asset write-off will be available for the majority of businesses during some part of the 201920 and 2020-21 income years. For purchases between 12 March 2020 and 6 October 2020, businesses under $500 million in turnover can get an immediate tax deduction for assets costing less than $150,000. In the purchasing time frame, the asset needs to be first used or installed ready for use by 30 June 2021. In the legislation, the update also extends to the low value pool for the 2019-20 income year. An entity with a small business pool balance of less than $150,000 will be able to write off the entire balance (up

from $30,000). For the 2020/21 income year, general small business depreciation pools may be written

off in full in accordance with the full expensing rules. The government stimulus package, announced to prevent a large national economic downturn, includes this boost to instant asset write-offs. However, the stimulus will not be received until lodgment of the tax return. Subsequent legislation introduced into parliament will allow businesses an option of using the instant asset write-offs or to depreciate new assets over their effective life.

Payment Times Reporting Scheme The Payment times reporting scheme is commencing 1 January 2021, providing small businesses with greater understanding of the corporate treasury management processes within large business. In the publicly available report, information about how quickly a big business pays a small business for goods and services is delivered. This can provide a small business a snapshot regarding how quickly they

Being Emotionally Available for our Children I’ve been reading an inspirational little book entitled, ‘What your child needs from you,’ by best-selling Australian author and parenting expert Justin Coulson. The opening chapter talks about the importance of being available emotionally for our children. We’re often not available emotionally because we’re not in the right head space – we’re too busy, we’re too preoccupied with something else or we forget how important it is to give our children our undivided attention. Another issue is that our children want our attention at seemingly the most inopportune times. Even though my four children are grown up and are almost totally independent from my wife and I, sometimes when they call on the phone I’m mildly annoyed because I’m in the middle of something ‘important’. Each time they call, I have to remind myself that they are more important than the mundane thing that I’m doing. I need to stop and give them my full attention, otherwise I’ll miss the moment – a golden opportunity to connect with my children. Coulson states that children who have parents that give them their full attention on a regular basis are able to say: • • • • • •

My parents support me My parents console me when I am upset My parents show they care about me My parents show a genuine interest in me My parents remember things that are important to me My parents are available to talk to me at any time

Evidence indicates that children who’ve had the privilege of parents who have done the above have a greater self-confidence, are more resilient, better learners, have superior social skills and are better able to handle their emotions than children who haven’t. So if we’re too busy to give our children our full attention then perhaps we’re too busy and we need to slow down or change our priorities. One story that Coulson recounts is of a mother who attended one of his workshops who shared the following:

After learning about being emotionally available with my children, I decided that I would turn off the television at meal times and that we would talk. One night I asked my children what had been good about their day. As they talked, I felt great to be having these conversations with them. When it was my eldest daughter’s turn to tell me about what the best part of the day was, she looked at me and quietly said, ‘Right now, mum’. All the best everyone. City Awards $3 Million in Community Grants New baseball facilities at Wallington and a Geelong Eastern Park Bowls Club upgrade among 40 dynamic projects sharing in more than $3.1 million through the City of Greater Geelong’s 2021-22 Community Grants programs. The City has endorsed the awarding of 34 Community Infrastructure Grants and five Geelong Heritage Grants totalling more than $3 million. The Bellarine Bears Baseball Club will receive $350,000 through the Community Infrastructure Grants towards the development of fields, fencing, dugouts, scorers’ box, and lighting at Wallington Recreation Reserve.

Geelong Eastern Park Bowls Club, North Geelong Cricket Club, Newtown City Hockey Club and Manifold Heights Cricket Club will also receive Community Infrastructure grants of between $340,000 and $350,000 to deliver significant facility upgrades for club members and the wider community. Geelong’s Lazarus Community Centre, which has supported about 400 people experiencing homelessness and disadvantage over the past 12 months, is also a recipient of a $350,000 Community Infrastructure Grant to enable the upgrade of its kitchen, bathroom and dining facilities.

Five restoration projects across Geelong, Fyansford, Portarlington and Lara will share in almost $100,000 under the 202122 Geelong Heritage Grants, which replaces the former Central Geelong Heritage Grants this year to open the funding stream to applications across the municipality. The Festival of Sails annually attracts around 300 yachts and 4,500 sailing competitors to Melbourne and Geelong over the Australia Day holiday period. With over 15 different race series catering from the highest performance Grand Prix racers to trailable cruisers, the varied race action is sure to offer something for everyone, and spectators will certainly not be disappointed. First held in 1844, the Festival of Sails is Victoria’s oldest ongoing sporting event, and the largest annual keel boat regatta in the Southern Hemisphere. Geelong Waterfront Train & Bungy Trampolines If you’re looking for fun things to do with kids in Geelong, then the Waterfront is the perfect place for you. Along with the kids’ activities we’ve already listed here, kids get a buzz out of the Waterfront train and Four Bay Bungy Trampoline. The train runs return trips from the Carousel to the Eastern Beach pools. The ride takes around 20 minutes and leaves every half hour (every quarter-hour in peak season). Kids can somersault and jump 7 metres high (!) at the Bungy Trampoline. Located near the Carousel, there’s a 5-minute jump guarantee (longer when there’s no queue). Open weekends, school, and public holidays from September to May.

Cunningham Pier Geelong Cunningham Pier is one of the most recognisable structures on the Geelong Waterfront. Opening in the mid-1850s it was originally known as Railway Pier. It was an important part of the Geelong Port and you can still see the train lines that were used to transport cargo to the end of the pier. The pier stretches 250 metres out over Corio Bay and its bright white building is a standout feature of the foreshore. The two-storey weatherboard building houses the Wah Bar and Asian food restaurant (bao buns!), Wah Wah Gee. The Pier Geelong function centre is also located here. A large part of this Geelong pier is dedicated to car parking and a convenient covered walkway provides shelter as you walk along the train tracks. Cunningham Pier fishing has always been popular and in keeping with tradition, local anglers continue to use it.

The Poppy Kettle Playground This Geelong playground was inspired by a children’s book written by local author Robert Ingpen. The story focuses on a group of miniature people from Peru, who set sail in an old tea kettle to find the land ‘beyond the horizon’ and eventually come to rest in Geelong. Bronze statutes of the Poppy Kettle people are scattered around the park giving it a fairy tale quality. Other features include an interactive water fountain, a sea dragon, an awesome slide and climbing tower, and a terrific pyramid climbing net. There’s plenty of lush grass to picnic on, public toilets, and there’s usually an ice-cream and hot jam donut van parked nearby.

Geelong Skate Park Geelong is heaven for skaters as there are more skate parks in Geelong per capita than any other district in the country. And there’s no better location for a skate park than right beside the bay at Waterfront Geelong. The Youth Activities Area to the west of Cunningham Pier is an outdoor plaza-style park. It has a variety of street obstacles including ledges, stairs, rails, and bank ramps. The park also features a basketball ring, bench seating, open-air performance areas, and stereo music. Western Beach People have been swimming, boating, fishing, and playing at Western Beach Geelong since the 1840s. In those days there was an unwritten rule designating Western Beach for men’s bathing and Eastern Beach for women. But some ‘dastardly gentlemen’ would disregard the agreement scaring respectable women away. Today the area is rarely used for swimming, but it’s still a popular stretch of foreshore connecting Rippleside to the rest of the Waterfront. Here you’ll (Geelong’s Poppykettle area, and Boardwalk.

Curving out over the water the boardwalk has well-placed seats where you can sit back and watch the sea birds duck dive for fish. In the early morning, it’s perfect for watching the sun come up over the bay.

Rippleside Park Located on the western edge of the Waterfront, Rippleside Park Geelong is a pretty grass-covered foreshore reserve. Popular with locals, Rippleside is less well-known to tourists who drive past en-route to more popular areas. The park has magnificent bay views and is particularly appealing to families with young children who love the adventure playground. The huge wooden structure has ramps, walkways, steps, and plenty of nooks and crannies to explore. When the kids tire of the playground the reserve has wideopen spaces to run around in. Don’t forget to bring your footy! Tucked in next to the reserve is tiny Rippleside Beach where you can bask in the sunshine or splash around in the water. Overlooking the whole area is the bright and spacious Ripples On The Bay cafe. This stunning cafe serves excellent coffee and has huge windows with to-die-for water views. Other amenities include picnic and barbecue facilities, toilets, and plenty of car parking spaces.

Steampacket Gardens Located right beside the water Steampacket Gardens Geelong is a big rectangle of lush lawn that’s perfect for a relaxing picnic or a game of frisbee. A path on the northern edge connecting the gardens to the bay has seats where you can enjoy the sea breeze and watch the nearby helicopter toing and froing. On the eastern side you’ll find the Wharfshed Cafe serving yummy meals and to the west sits the delightful historic carousel. There are some interesting art sculptures dotted around the park. Be sure to check out the Volunteer Rifle Band bollards and The Buoys sculpture, a group of former channel buoys that have been turned into a powerful piece of artwork. The Geelong Waterfront Makers and Growers market (Steampacket Market) is held here on the first Sunday of each month. This popular market offers local produce, beautiful art and handicrafts, and lots of tasty treats. You can read about other popular Geelong markets here.

Geelong Helicopter Rides Geelong Helicopters specialises in scenic flights, private charter, aerial photography, and tours. This is a wonderful way to see Corio Bay, the Geelong CBD, Barwon River, Torquay, and the famous Bells Beach. Operating daily from the Yarra Street Pier, flights start at $59.00 pp for 5 minutes. Geelong Carousel The Carousel Geelong is a rare 1892 Armitage-Herschell handcarved wooden carousel. One of only a few in the world this beautifully restored carousel is considered by many to be the best that’s still in use today. Housed in a modern steel and glass enclosure the pavilion has an old-world carnival atmosphere that’s enhanced by a pipe organ playing Dixieland melodies. A ride on this enchanting carousel is a magical experience for children of all ages and abilities, with a mobility lift that assists wheelchairs onto the attraction. Entry into the pavilion is free. Tickets to ride the Carousel are $5.00.

In 2002, Becca Levy’s (Yale University) research provided us with evidence that adopting a positive mindset on aging creates 7.4 years of additional life, all other variables being equal. But how can you actually live younger in your retirement years? With lifespan increasing significantly, we’re sure that this question has been on your mind. Here’s a few ideas: 1. Get creative and stimulate your mind. It’s fine to do a daily Sudoku puzzle, but to live younger, you really should go a few steps further - towards Creativity.

An example would be when you establish a $2 Travel Club – arrange excursions on your local metro network at the daily senior’s fare. 2. Engage with people of all ages. One of the attractions of volunteering is that you create friendships with likeminded people. You too can achieve this level of satisfaction if you commit to keeping yourself updated on social media.

If you are still looking for direction, reflect what were your dreams were at age eight, or twelve or as a late teen. That’s where you’ll find your energy and excitement and the route to living younger. As over half of us will live at least until our mid-nineties, our retirement years are likely to span several decades. That’s a long time to be bored, which is why attempts at living younger are so vital.

FC LEOPOLD FC Leopold Coaching Announcement FC Leopold would like to announce it’s appointment for our Men’s Senior team for season 2022, Jarrod Gladman Jarrod is the only new face this year in the Senior Coaching Group. ‘Gladdy’ comes to us as a C Licenced coach with 10 seasons of varied experience - from GRFA Sunday League to FV State League 1, where he was most notable as Corio SC’s Assistant Coach to their Senior Men’s State League team “I’m looking forward to being apart of the continuing success that the club [FC Leopold] has had on and off the pitch in recent years”

FC Leopold would like to announce its appointment for our Men’s Reserve team - Carlos del Rio Carlos maintains his commitment to FC Leopold as the Coach of our Men’s Reserve team after leading the Senior Men’s team in a difficult season, that saw all of football in Victoria come to a halt on a number of occasions before it’s penultimate ceasing with the team challenging for finals.

FC Leopold is pleased to announce their Senior Women’s Coaching line-up for the upcoming season in 2022 will be Liam Tench (Head Coach) and Karen Costelloe (Assistant Coach). Both Liam and Karen are familiar faces around FC Leopold, where Liam took on the role of Assistant Coach of our Senior Men’s, while Karen was Head Coach of the Women’s team last season. Social Bowls is just how it sounds, it is a social game of bowls with people from our own club and often people from other bowling clubs.

A fun bowls competition for those who want a bit more than social or barefoot bowls, but big on social. Teams of 3 over 6 weeks,

It is a nice way to meet other people who enjoy the game and to get a feel for how the game is played in a relaxed game.

Entry fee of $5 per player includes use of bowls and BBQ come and meet new people. New-season resumes Friday 29th January from 6.30 pm

Pennant Pennant competition is played over 18 weeks (plus finals) where you represent your club in a team and play against other clubs. If your Find Cards does not display your signature and the correct code, the business can refuse to provide the discount offer advertised. You will receive your Authentication code after registering your Find Card.

Valid Find Cards have four folds and contain six different categories. Valid Find Cards will have its Regions logo sticker placed in the circle at the back and has an Authentication code display in front of the Find Cards.

NOT VALID

Find Cards that DO NOT display its Regions Sticker in the circle at the back and DO NOT display an Authentication code in front of the Find Card are INVALID. They will not be accepted at any participating businesses. Also, your signature must be present. You may be asked to present ID to verify that Find Card belongs to you.

Present the Find Card and ID prior to paying bill. Card is Non-Transferable. Each offer corresponds to a number on the card. Number will be crossed off once offer used. This is not a credit or charge card. Copyright 2021 Find© Pty Ltd.
