About the Find Geelong By Warren Strybosch

The Find Geelong is a community paper that aims to support all things Geelong. We want to provide a place where all NotFor-Profits (NFP), schools, sporting groups and other like organisations can share their news in one place. For instance, submitting up-and-coming events in the Find Geelong for Free. We do not proclaim to be another newspaper and we will not be aiming to compete with other news outlets. You can obtain your news from other sources. We feel you get enough of this already. We will keep our news topics to a minimum and only provide what we feel is most relevant topics to you each month. We invite local council and the current council members to participate by submitting information each month so as to keep us informed of any changes that may be of relevance to us, their local constituents.

We will also try and showcase different organisations throughout the year so you, the reader, can learn more about what is on offer in your local area. To help support the paper, we invite local businesses owners to sponsor the paper and in return we will provide exclusive advertising and opportunities to submit articles about their businesses. As a community we encourage you to support these businesses/columnists. Without their support, we would not be able to provide this community paper to you. Lastly, we want to ask you, the local community, to support the fundraising initiatives that we will be developing

and rolling out over the coming years. Our aim is to help as many NFP and other like organisations to raise much needed funds to help them to keep operating. Housing Prices Drop For the past two years we have seen significant housing growth but now capital city values are starting to trend downwards, according to latest data.

Stronger housing market conditions were recorded in Brisbane and Adelaide and Hobart, where housing values rose by more than 1.0 per cent in February.

Sydney has posted the first decline in housing values since September 2020. Whilst the drop of 0.1 per cent is a modest decline, it is an indication of where the market is likely to head for both Sydney and Melbourne over the next 12 to 24 months.

Regional markets remain strong

CoreLogic’s national Home Value Index recorded a 0.6 per cent gain in February, the pace of growth had slowed since April 2021 and marked the lowest monthly reading since October 2020.

Over the past three months, housing values across the combined rest-of–state regions increased (up 5.7 per cent), compared to combined capitals that rose 1.8 per cent.

Whilst capital cities are starting to trend downwards, regional Australia continues to record a substantially higher rate of growth than the capital cities.

Although the rolling quarterly rate of value growth remains rapid across regional Australia, conditions have eased from its recent peak of 6.4 per cent over the December quarter and is down from a cyclical peak of 6.6 per cent recorded in April last year. CoreLogic’s director of research, Tim Lawless, said demographic tailwinds, low inventory levels and ongoing demand for coastal or tree-change housing options are continuing to support strong upwards price pressures across regional housing markets.

We have great food and wine, cultural and sporting experiences, world-class beaches, the Barwon River and an enviable lifestyle. The Bellarine recently took out the 25th spot and Geelong the 69th in Leading Places: The 100 Most Loved Destinations Around the World for 2021. To be recognised in this way despite the challenges of a global pandemic goes to show that our region is one to tick off your bucket list. And our live music scene has no doubt contributed to these rankings. We have a history of producing quality musicians and groups – think Divinyls frontwoman Chrissy Amphlett, rock band Goanna, Magic Dirt’s Adalita Srsen and Mark Wilson from Jet. And we have a big range of vibrant indoor and outdoor venues to choose from, like the Potato Shed, Pistol Pete’s, Piano Bar and the newly redeveloped Palais Geelong. It’s that Time of the Month With International Women’s Day on Tuesday 8th March, now is a good time to talk about periods. Having a positive mindset about your cycle can help reduce some of the negative emotions around it. Know that this can be a time to deal with emotions gathered over the last month and a chance to give yourself time for nurture and rest. Whilst every woman’s cycle has it’s differences, a normal cycle is 28 days (give or take 7 days), last for 4-7 days (give or take 2 days), and loss should be 30ml-80ml (although this can be hard to measure). If your cycle is not within these parameters, or you experience the following, you should see your doctor: • •

Cramping that lasts more than a few days, is a stabbing pain, or pain with sex Large, dark clots

Pain Pain can be reduced with regular exercise and improved diet in the month prior to your cycle. Increasing vegetables, fruit, and protein whilst decreasing sugar and processed white grains can make a big difference. Try to eat a wide variety of vegetables not just the same few, and eat protein foods such as unprocessed meat, dairy, eggs, nuts, seeds, and legumes.

Ginger is an anti-inflammatory herb that also increases circulation to the pelvic organs and is used for period pain. A 2009 study found ginger to be as effective as ibuprofen in reducing period pain.1 Ginger can be consumed in stir fries, curries, or as a tea. You can boil fresh grated ginger in water, then strain and add lemon or honey to flavour. If you use a tea bag, leave the bag in the mug to make it nice and strong. Consume ginger regularly throughout the day and for a few days for best results.

Australia is just hours away from returning to pre-pandemic interstate travel arrangements, with Western Australia set to bring down its hard border with the rest of the country. WA will reopen to eastern states from 11.59pm on Wednesday, making travel freely permitted again between all states and territories.

Health Minister Greg Hunt said since Novavax was first approved by the country’s medical regulator, more than 25,000 doses of the vaccine have been administered as a first dose. “The Therapeutic Goods Administration is currently considering an application for whole-of-population use of the Novavax COVID-19 vaccine as a booster,” Mr Hunt said. “The TGA and ATAGI continue to review emerging evidence on all COVID-19 vaccines.” While vaccines are not yet approved for children under five in Australia, US President Joe Biden indicated in his State of the Union address American scientists were working on such an approval. The head of the TGA previously said approval for under-fives vaccines had been “put on ice” in the US, meaning approvals would not take place in Australia until at least after Easter. There have been 59 deaths reported from COVID-19 on Wednesday, including 28 from Victoria, 24 in Queensland, five in NSW and two in the Northern Territory. More than 25,000 new infections were detected across the country, of which 10,650 were in NSW, 7126 in Victoria, 5011 in Queensland, 1053 in the ACT, 624 in the NT, and 868 in Tasmania.

Businesses Fudging the Books are Placed on Notice By Warren Strybosch

Have you ever gone to pay for something and wondered whether the money you handed over is being recorded correctly for tax purposes? Do you sometimes think, especially when they ask if you want a receipt or not, if the funds are being recorded in a way so as to avoid paying tax? Well, your thoughts might have some validity to them. The ATO has recently released PS LA 2022/1 Administrative penalties for electronic sales suppression tools. It provides guidance to ATO staff on the application and remission of the administrative penalties for producing, supplying, possessing and incorrectly keeping records using an electronic sales suppression tool (ESST). ESSTs are hardware or software tools designed and used to manipulate sales records, understate income and assist in avoiding tax obligations. The production, supply, possession and use of ESSTs contribute to the black economy and undermine the integrity of the tax system. What is an ESST? ESSTs are designed to interfere with electronic sales records; that is, they can falsify, manipulate, hide, obfuscate, destroy or prevent the creation of electronic sales records, often without an audit trail showing the interference. They can take various forms and are constantly evolving, but some examples include: • • •

software that deletes or modifies point of sale (POS) records storage devices (such as back-up drives) containing software that deletes or modifies records POS devices with software that deletes or modifies records.

Penalties apply for producing, supplying, possessing, and incorrectly keeping records using ESSTs, as well as aiding or abetting another to do so. If you discover an entity has possession of or is using an ESST, in addition to considering if a penalty applies, you should work with the entity to ensure that the ESST is removed so the entity will no longer engage in conduct that can attract a penalty. Deciding whether something is an ESST To be an ESST, the tool must both be capable of interfering with a record and one of its principal functions must be to interfere with sales records. A modification

or additional features added to a legitimate sales system can be an ESST, even if the device or program as a whole is not. Records are information in any format that explain an entity’s transactions or other actions. Precisely what they are and what form they take depends on the circumstances. They generally include tax invoices, receipts and records of sales and all business transaction information. An ESST must be capable of interfering with records. Typically, a tool can interfere with records if it can: • • •

manipulate, falsify or delete the record of transactions renumber or recharacterise transactions interfere with records without showing an audit trail of the changes.

A tool passes the capability test for an ESST if it can interfere with a record that: • •

an entity is required by a taxation law to keep or make, and has been, or could be, created by a POS system which creates or feeds data into an entity’s tax records.

You do not need evidence that the tool has been used to interfere with a record, just that it is ‘capable’ of doing so. Criminal prosecutions An entity that produces, supplies or possesses an ESST or uses an ESST to incorrectly keep taxation records may be liable for criminal prosecution. The ATO may seek prosecution of an offence by conducting a criminal investigation and referring the matter to the Commonwealth Director of Public Prosecutions. Example 1 - not an ESST - changes are recorded Bellissima Beans Café Ltd buys a POS system for their new café. This POS system includes a function to reverse and void transactions. The manufacturer states that this function is for correcting mistakes and generating refunds.

The POS system records all changes to transactions in its history log. It produces a receipt and marks it as a void transaction. All receipts have sequential transaction numbers so any void transactions with missing receipts can be identified. Although this function gives Bellissima Beans Café Ltd the ability to delete and reverse transactions, the POS system creates an audit trail, so a reasonable person would not conclude that one of its principal functions is interfering with records. The POS system is not an ESST. Example 2 - possession of an ESST - full remission

The ATO conducts a routine audit of a bookstore owned by Book Worms Pty Ltd (Book Worms). Bob is the director of this company and runs the bookstore. During the audit, a hidden function within the system allows sales transactions to be deleted or manipulated without leaving a record of the original transaction. As a reasonable person would conclude that one of the primary functions of this system is to interfere with sales records, it is an ESST. Bob is surprised to discover that his system has an ESST and explains that he had no idea that it was there. He had bought the bookstore from Keanu in March 2017, who had not mentioned that there was anything unusual about the business or the equipment. He explains that he had not used the ESST and contacts his POS system supplier immediately to ensure ESST capabilities are removed. At the conclusion of the audit, no evidence was found that the ESST had been used to alter any of Book Worms’ business records. The audit did not result in any amendments to Book Worms’ income tax returns or BASs. Book Worms has a good compliance history. Notwithstanding the above, Book Worms is liable to an administrative penalty of 30 units for possessing an ESST. It does not matter that Book Worms came into possession of the ESST before the legislation was enacted. MARCH 2022 | FIND GEELONG

New Rules for Social Media Influencers (Australian Associated Press)

Australian influencers will soon be banned from giving their personal opinion when promoting health products on social media in exchange for cash or gifts. Under changes to the Therapeutic Goods Administration’s advertising code, from July 1 influencers will have to abide by strict rules when posting about health products and services, including medicines, vitamins and skincare. They will be banned from giving personal comments or testimonials on health products that haven’t been tested or approved, whether they have been paid or given the product for free. The rules will apply to therapeutic use, which includes cosmetic claims such as “removes toxins” and “fades age spots”, as well as “relieves pain”, “aids sugar metabolism” and “reduces inflammation in the body”. Influencers can still endorse products but must disclose that it is advertisement, for example by including the words “paid partnership” or #Ad. Murdoch University social media researcher Catherine Archer said the TGA ruling was “long overdue” but there was already pushback from influencers. “Unfortunately for the influencers, health and related products/services are where many of them make a lot of their money, so there will be pushback,” she said.

“Already we have seen some say that they should be paid for things like sunscreen as it is a ‘community service’. “Having researched this space for 10 years, and recently conducting interviews with influencers who have been working in that space for the same length of time, the need for more enforceable guidelines is obvious.” Menzies Health Institute Queensland principal research fellow Lauren Ball said

the TGA’s decision revealed the importance of credible, evidence-based information when it comes to health. “We have large workforces of health professionals, like dietitians and GPs, who are certified to practise safely in this space,” she said. “Influencers sharing unsubstantiated claims in the form of click bait are dangerous, and prevents Australian’s from seeking professional help.”

Gone Up in Smoke - $42m Worth of illicit Tobacco Ceased and Destroyed By Warren Strybosch

The ATO via “Operation Greyhound”, they have uncovered a large source of illicit tobacco in Koraleigh, New South Wales. The amount covering 24 acres, was estimated to be over 250,000 kilograms in weight, and worth a staggering $42m on the open market. The ATO undertook significant warrant activity with assistance from officers attached to the Murray River PD Rural Crime Team and the Proactive Crime Team from NSW Police Force. The ATO said that this outcome demonstrates their commitment to detecting, disrupting, and dismantling crime syndicates that grow illicit tobacco.

Dealing in Crypto? ASIC asks you to get financial planning advice By Warren Strybosch

Crypto, like any investment can rise and fall. In the last few months, we have seen crypto currencies fall between 40% to 90% and with a current unstable world economy, it does not look like we will see a rebound in this sector anytime soon. The most common crypto currency is Bitcoin. At its height in November 2021, it was worth close to $94,000 AUD, and currently it is worth $53,000. Even before the fall in crypto pricing, ASIC was concerned with the number of people investing in crypto. People had it in their mind that crypto would just continue to rise in price without ever falling. They, those who wanted to invest, were concerned they were missing the boat on such a lucrative opportunity. However, like with all investments that are driven mainly by fear in greed, crypto has proven to be no different to other investments we have seen in the past. It will have its amazing ups and downs and trying to ‘guess’ or ‘time’ the market can have devastating consequences for many investors whilst only a few people end up walking away as the winners. I have heard stories of investors jumping in at the high, watching crypto drop 1015%, leverage up their investment (in otherwards borrow against their current investments), to only see the bottom drop

as the example above demonstrates. If you do happen to time it right and get some growth, you then must decide when to sell. Once you have sold you are out of the market. With the lack of income that crypto provides e.g., none at all, it is not the most ideal investment to place your money into. Crypto should only be used by those investors who a) don’t need their money, and b) have all the time in theworld to watch the price go down. It is back the capital in the near future. ASIC is so concerned about crypto and the increased market activity whereby schemers are recommending you switch from retail and industry funds to SMSFs to invest in crypto, that they have requested everyone seek financial planning advice from a licensed financial planner before making such decisions. ASIC said that individuals should not rely on social media ads or online contact promoting an “investment opportunity” or “high return” portfolio.

This has resulted in a margin call whereby they have had to sell down their now worthless investments to cover the borrowings because the lender was concerned, they might not have the ability to pay back the loan. This has resulted in them walking away with a few thousand dollars from the nearly $50,000 they had originally invested. Does this sound familiar? This is what happened with the GFC where investors had margin loans against their investments. Of those who had margin loans during the GFC, approximately 90% of investors had margin calls and were required to either sell down their investments or come up with additional funds to pay back the loan. Time simply repeats itself and the same lessons are being learned, albeit by the next generation. The biggest issue with crypto investing is income – it simply does not produce any. With all good investments you should seek growth and income and not simply growth. Yes, you can stake some coins, and this can alleviate some of the issues around price drops, but given there is no income, you are subject to everyone else’s fear and greed driving pricing. This lack of income makes you heavily reliant or hopeful on growth and when it does not occur can cause all kinds of problems

“Setting up an SMSF is one of the most significant decisions you can make relating to your retirement savings,” ASIC said. In particular, individuals should be wary of cold calling, text messaging and emails that recommend transferring super to an SMSF or investing in crypto assets via their SMSF. “Australians who decide to self-manage their super should consider the risks before using their SMSF to invest in cryptoassets,” ASIC noted. “As the trustee of your SMSF, you ultimately bear responsibility for the fund’s decisions and for complying with the law even if you rely on other people’s advice – licensed or otherwise.” The regulator pointed to its own website, Moneysmart and the ATO website as providing resources for information about scams, crypto investments and SMSFs. In summary, crypto is an investment that will go and down in value, does not produce income, and should only be considered as an asset class for those investors who have the time and resources behind them to see them through a bearish market, and importantly, to seek advice, from a licensed financial planner, before making any decisions about what to invest in, that includes crypto.

Significant Material Costs Lead To Dwelling Build Approvals Collapsing In 2022

With the collapse of housing construction companies like Probuild and building materials doubling in price, it is no wonder dwelling building approvals have collapsed over the last 12 months. The number of approved residential construction in Australia has plummeted, hitting its lowest figure in almost 18 months and the first decline since October last year. We have even heard of large home building businesses offering future homeowners up to $50,000 to break their home building contracts given the significant increases in material costs. It is apparently cheaper for them to pay a large break cost than to go ahead and build the new home. One builder stated that building materials like wood had only increased by 10 cents per metre but over the last 12 months, the price of wood has literally doubled. They stated that they would have to bear the cost of the increase if any building contracts were signed given it is illegal to

pass on the increase to the consumer once a contract has already been signed.

The same category of dwelling was said to be behind the uptick of approvals reported in December.

According to the Australian Bureau of Statistics’ data on building approvals in Australia, there were a total of 12,916 total dwellings approved over the month of January, falling 27.9 per cent comparative to December and over 24 per cent compared to the same period last year.

However, housing approvals were also reported by the ABS as suffering a sudden fall, hitting 8,712 over January and marking a monthly reduction of 17.5 per cent.

This fall was observed almost across every state, with the decline being felt most distinctively in Victoria (-35.5 per cent), South Australia (-29.2 per cent) and NSW (-25.9 per cent). The only state that reported monthly growth was Queensland, which saw a marginal increase of 0.5 per cent. Driving this distinct loss in new dwellings, which is the lowest since June 2020 (12,724), was a dearth of apartments, town houses, and units, which fell 43.6 per cent month-to-month, hitting 4,007.

This again was observed across the country, with every state reporting a diminished approval figure, with NSW reporting the smallest decline (-14 per cent) and South Australia the largest (-19.9 per cent). Compared to January 2021, this new figure for private houses reflects a downturn of 29 per cent. It is likely, given the large increase in building material costs, that many people will hold off building their new home or an extension, and we are likely to see further declines in new dwellings being built during 2022.

Australia to Provide $105m in Ukraine Aid Australia will send a $105 million package of weapons along with humanitarian assistance to Ukraine following the Russian invasion. Prime Minister Scott Morrison said $70 million of defensive support would be provided to Ukraine, which would include missiles and ammunition. A further $35 million would be spent on humanitarian assistance such as shelter, food and medical care. The decision came following a meeting of federal cabinet’s national security committee on Tuesday. Mr Morrison said the majority of the defensive support to Ukraine would be lethal aid and distributed through a partnership with NATO. However, he would not provide specifics on what weapons, or the amount of weapons, that would be sent to Ukraine due to national security concerns. “I don’t plan to give the Russian government a heads up about what is coming their way, but I can assure them it is coming your way,” he told reporters in Canberra. “We will be answering the call from (Ukrainian) President Zelenskyy. He said, ‘Don’t give me a ride, give me ammunition’, and that is exactly what the Australian government has agreed to do.” The prime minister said the $35 million in humanitarian support, which would be provided to international organisations, would be the “opening contribution” from Australia. Mr Morrison said it was expected there would be further requests made over time, and welcomed efforts from other countries to impose sanctions on Russia and its government following the Ukrainian invasion. He said while the sanctions were working and having a serious impact on Russian progress, it was expected to lead to more aggression. “It is also likely to lead to an even more violent response from Russia,” he said. “Anyone who thinks the Russian government is just going to sit there, I think, doesn’t understand the intent and the outrageous objective of President Putin.”

All outstanding visa applications for Ukrainians looking to come to Australia have been processed, the prime minister said. About 100 applications are being received per day, which are being processed as the top priority due to the unfolding situation. Mr Morrison said options were being prepared to support broader humanitarian efforts. “We want to ensure we can provide the temporary refuge.” Opposition Leader Anthony Albanese said earlier on Tuesday there was bipartisan support for action taken against Russian aggression. “It’s important that there be a single direction going forward, as there has been up to this point, we would support any government action,” he told reporters in Melbourne. The Labor leader said the opposition strongly supported the sanctions Australia had carried out against Russia,

alongside international partners such as the United States, United Kingdom and European Union. Opposition home affairs spokeswoman Kristina Keneally said Labor supported the actions of increased military support from Australia to Ukraine. “This is a fast-moving situation, one provoked by Russia and upends the international order that has prevailed since the end of World War II,” she told Sky News. Defence Minister Peter Dutton told reporters in Canberra that Russian forces would become more intense as they move towards the capital of Kyiv. “Many people will die unless President Putin changes the action of the course he is on at the moment,” he said. The Sydney Opera House will be lit up in the colours of the Ukrainian flag on Tuesday night. COVID-19 $450 payments to cease. By Warren Strybosch

The Andrew’s government will cease paying the $450 payment to Victorians whilst they await their PCR test results, as rapid swabs make the system obsolete. The state government announced its test isolation payment will end with demand reducing as rapid antigen tests become more widely available. Industry Support and Recovery Minister Martin Pakula said Victoria was entering a new phase of managing the pandemic and the program was no longer necessary. “The recommended testing method has changed with rapid antigen tests providing results within minutes and eliminating the need to miss work while waiting for test results,” Mr Pakula said. More than 1.2 million payments worth about $545 million have been approved since the system began in July 2020 during the state’s devastating second wave of COVID-19 infections. Payments will still be available for Victorians who have to self-isolate, quarantine or need to care for someone in self-isolation or quarantine under the federal government’s pandemic leave disaster payment.

It’s known to soothe the soul but can music also help people study? Macquarie University music psychologist Kirk Olsen says music can stimulate the imagination – especially while undertaking creative tasks. But he wanted to know if it also helps with concentration – particularly if music can drown out domestic distractions as more people study and work from home. His research found that listening to music while studying or trying to focus on work can be helpful for some people, in certain situations. “If you are studying in a distracting environment such as a busy coffee shop, listening to quiet music through

headphones can mask those sources of distraction and replace it with a predictable and enjoyable source of stimulation,” he said. Music can also help to calm students who are finding the material difficult or stressful, he says. The ‘Mozart effect’ is a well-known phenomenon that emerged from a 1993 study that showed that people who listened to Mozart performed better on a mental task than those who did it in silence. “Follow-up research has largely discounted the hypothesis that listening to classical music puts the brain in a sophisticated operating mode,” Dr Olsen said. However, it’s likely that listening to music may be linked with higher performance

So, listening to any music you enjoy can improve your mood and help you work more effectively. “Music can help to make a tedious task more enjoyable,and this can help motivate students to continue studying for longer periods of time,” Dr Olsen said. “Music can even stimulate the imagination, so can act as a source of inspiration for tasks that involve creative thought.” However, fast and loud music or music with lyrics have a greater chance of pulling the listener’s focus off task. And musicians always find music distracting because they are so used to listening attentively to it. One study found that extroverted people can perform well on a task while listening to complex or fast-paced music, whereas introverted people performed better with slower-paced music or no music. How to use music to help you study: •

Family Trusts in the ATO Firing Line ACCOUNTANT By Warren Strybosch

The ATO has released a suite of new guidance products that is set to have a major change on family trust distributions and tax arrangements. The ATO has released new draft public advice and guidance (PAG) products relating to section 100A reimbursement agreements and division 7A of the Income Tax Assessment Act 1936. The Draft Taxation Ruling TR 2022/D1 suite is open for consultation and clarifies the ATO’s position on reimbursement agreements under section 100A, and identifies arrangements that will not attract ATO compliance resources. when “financial accommodation” arises under division 7A whilst Taxpayer Alert TA 2022/1 highlights arrangements of concern from the ATO where taxpayers are using adult-child beneficiaries of family trusts to avoid tax on income. The draft Ruling means the ATO may charge Trusts up to 47% tax where a trust distributes funds to adult children and it is found the parents are using those funds instead of the intended beneficiaries, in this case, the adult children. It has been common practice for family trusts to be set up and income splitting to occur between spouses and other family members e.g., adult children. The ATO is aiming to stop or at least restrict this practice by using section 100A arguing that the beneficiary never used the funds and therefore was not actually entitled to the trust money that was paid to them. If this is found to be the case, then the ATO can tax the trust at the maximum rate of 47% (45% tax + 2% Medicare levy).

The guidance will be relevant to any trustee (or controller) of a closely trust that may have concerns about whether the trust anti-avoidance provision in section 100A may apply when trust income is distributed to relatively favourably taxed beneficiaries, but the benefits of that income are enjoyed by others. It also addresses trusts that intend to, or have in the past, made a private company beneficiary presently entitled to trust income but not paid the amount on the basis that the amount is held in a sub-trust for the benefit of the private company and the arrangement avoids the application of division 7A. “The vast majority of small businesses operating through a trust will not be affected by this public advice and guidance,” the ATO explained. If the ATO begins to enforce section 100A, all trustees of family trusts will need to review their income-splitting strategies and how they distribute funds to beneficiaries. It will be important for trustees to have written document in place which adequately explains the justifications as to why a beneficiary is entitled to the revenue generated by the trust. This is going to be paramount for business owners who run their business through a family trust where the main business owner is the key person generate the revenue flowing through the trust and for those who have set up trusts to pass on funds to adult children. The ATO’s further guidance in PCG 2022/ D1 specifically calls out children-parent arrangements. It is likely these types of arrangements will be targeted resulting in future penalties applying if the ATO conducts an audit. An example might be where a beneficiary has a significant difference between their entitlement to taxable ‘net income’ and their ‘trust income’ in specific year (not that uncommon) and the ATO thinks the gap

is contrived to pay less tax. Again, it will be important to have carefully documented reasons as to how the adult children are using these funds for their own personal use e.g., pay board, petrol, etc. Another area the ATO will be looking closely at is where a trust pays money to a company in a circular way between a Trustee that holds shares in a Company and then the Company is also a beneficiary that pays dividends to the Trust. The idea being the Company becomes entitled to trust money which the Trustee is really using for its benefit (and which the Trustee should instead be accumulating and paying tax at 47%). It is advisable that these arrangements cease immediately. Family trusts have always been in the firing by the ATO and more so since Labor limited the ability of trustees to distribute funds to minors. These new developments, whilst they might add another level of complexity for trustees, does not mean trusts hold no value. They are still a good vehicle for asset protection, and when set up correctly, with the right documentation in place, can still provide a good way of distributing funds to adultchildren, and used for income-splitting purposes. Single Touch Payroll (STP) came into being on 1 July 2018 for employers with 20 or more employees and the following July for employers with less than 20. Concessions have been available to some businesses, industries and employer types to allow time for them to participate in the STP regime … most of these ended on 1 July 2021. Employers are required to file an STP report via their payroll software on the day they pay payroll (or the day before). Payroll software such as Xero, KeyPay, Quickbooks Online and MYOB have been STP compliant since 2018.

What information is sent to the ATO when an STP filing is made & what happens to the data? Each time an STP filing is made, your payroll software sends: • • •

employees’ Year to Date gross salaries and wages employees’ PAYG withholding amount employees’ Superannuation liability information

Not sure if you are STP filing? If you use a BAS Agent/Bookkeeper or a Tax Agent to process your payroll check with them that they are managing your STP filings. If you, as an employer, manage your own payroll, you should be filing already. STP Phase 2 started 1 January 2022 … but some payroll services have had a deferment (more on that below). It does not change the payments you need to report through STP but it does change how those amounts need to be reported. It granulizes the information. For instance, some employees will need their STP tax category defined such as actors and shearers. Allowances have also become more structured.

(you’re now shifting your perception; you’re shifting your experience). Pay attention to how you now feel and the gratitude you feel, compared to how hard it could be if it was even worse! (you’re now in a nice train of thought... and can move forward) Stimulate progress with these questions;

And in order to change your language around the perception, you must first create a different reality (because remember, the meaning we give any situation is based on our own experiences aka reality)...

How to Make the Most of Fringe Benefits Before End of FBT Year SALARY PACKAGING SERVICES By Dan Nicholls

If you’re smart enough to utilise the benefits of salary packaging, then you’d know that the 31st of March is an important date on the financial calendar. This is when the FBT year officially ends and is the cut-off day for that year’s FBT claims. Unlike normal deductions you would make at tax time, fringe benefits are items you can claim through your salary packaging. After this date, your salary packaging cap restarts and a new cap limit is allocated to you. If your salary packaging is set up as regular payments to your nominated supplier or you have a regular reimbursement, all you need to do is check with your provider that you are maximising your entitlements. If you’re using a salary packaging card or you claim a reimbursement of Meal and Entertainment expenses, we have more than a few ideas on how to make the most of your fringe benefits in the nick of time. Stake your claims early To say March is a mad scramble for salary packaging providers is an understatement. That’s because we’re busy trying to process as many claims as possible so they process before the clock ticks over at midnight on the 31st of March. If you try to claim expenses on the day of the 31st, they may not go through the system in time to go towards reaching a zero balance. As a general rule, try to submit your reimbursement claims by mid-March so they definitely contribute to your current annual balance. Remember that unused and unclaimed funds reduce your benefit in the following year.

The No Rollover Myth A rollover occurs when a benefit balance is not spent or claimed and rolls over from March 31 to April 1. Contrary to popular belief, you won’t lose the money that you had sitting in your unclaimed balance. However, it is still wise to spend it if you can before March 31. When the FBT year changes, the ‘rolled over’ money is reported as spent in the new FBT year instead of the previous one. This means the ‘rolled over’ amount is treated as part of your new cap limit, so, depending on your industry, your cap entitlement for the new year is reduced. The result is that you may have less tax benefit in the new FBT year. Not sure what your balance is before March 31? You can look it up in your salary packaging card phone app or call your salary packaging provider for an update.

What can you claim? It depends on your industry, but as a reminder the claimable expenses can include: • • • • • • • • • •

In the spirit of the return to ‘normal’ after the last couple of years, we encourage you not to be shy. When you do use your salary packaging card to try and push towards a zero balance, remember that some vendors, banks and financial institutions may take several days to process transactions. The FBT spending spree You have this excess balance, but what can you spend it on before March 31? While you have set up regular salary packaging deductions with your payroll, the deducted amount might arrive too close to the deadline and you have no time to spend it. So, be aware of this and discuss with your provider ways to make additional deductions earlier and relieve the pressure. An end of FBT spree is your chance to review your salary packaging setup and possibly claim other payments that you have made using your after-tax pay, if they are eligible and you don’t exceed the relevant cap. You simply need to check with your provider and complete your claim form and proof of payment by mid to late March. You need to ensure that you haven’t claimed on these items previously.

Post-Separation Property Misconceptions LAWYERS By John Van Beveren

Separating from a partner can involve a series of complex and overwhelming emotions and working out how to divide your money and property after a relationship breakdown can be stressful. How property will be split in a settlement relates to the initial and ongoing contributions in a relationship as well as future needs and opportunities to work. There are two common misconceptions about post-separation property matters – 1. 2.

The relationship asset pool is calculated at the time of separation; and Any property acquired after separation does not form part of the relationship asset pool.

Calculation of asset pool Regardless of when you and your partner separated, when the property pool is finally being settled in a family law proceeding, a court will require you to disclose your full and frank financial position at that time and not at the time of separation. When the court is identifying the value of the current property held by the parties, both financial and non-financial contributions will be considered from the time the relationship commenced to the current date. It is important to remember that contributions lacking tangible recognition or are not susceptible to a dollar calculation, does not render those contributions any less important than a financial contribution. For example, a mother taking care of the children is a contribution to the relationship and is no less important than a father paying a household utility bill. It is important to understand that the asset pool is not calculated at the time of separation because this means if there are any delays in the property settlement it can impact on the value of your relationship asset pool - sometimes to a significant degree. Finalising postseparation property matters should be done as soon as possible to ensure anything you acquire after the separation is protected, which leads us into our next common misconception. Property acquired after separation There are consequences of not finalising your post-separation property matters

as soon as possible. For example, if you purchase a new house independently, this house has now become a part of your relationship asset pool, despite your ex having nothing to do with the purchase.

You don’t have to wait until you are divorced. If you get a divorce and haven’t worked out your property arrangements yet, you must apply to court for property orders within 12 months of your divorce becoming final.

Maybe you have a new partner, and you bought this house with them? Unfortunately, this is irrelevant, when finalising your property settlement your ex-partner is still entitled to claim whatever your interest in that house is. The court will have the discretion to decide what happens to any post-separation property.

If you were in a de facto relationship, you must apply within two years of the date of separation.

An example of property acquired postseparation occurred in the case of Calvin & McTier (2017). In this case, the parties had been separated for 4 years but had not finalised their property settlement when the husband acquired a substantial inheritance. At trial, the judge decided that the inheritance received by the husband should be included in the relationship asset pool and therefore, divided between the parties and the wife ended up receiving 35% by way of property settlement. The husband appealed this decision and argued that there was an insufficient connection between the inheritance and the parties’ relationship, but this was ultimately rejected by the court. How can I protect myself? Your personal circumstances may not require protection but if you have any concerns, you should seek legal advice. However, there are situations where protection may be more urgent. For example, if you are the person in the relationship who: a b c d

Has a significantly higher income; or You have a significant amount of superannuation; or There is a chance you will be coming into money; or You are planning or wanting to acquire post-separation property

Then you should seek legal advice to ensure you are protected/prepared for the future and have a pathway to ensure maximum protection in your separation.

If you do not apply within these time frames, you will need permission from the court to apply for property orders. This is not always granted. Also, it is often the case in Family Law matters that by the time you seek legal advice, you have already started obtaining interest in properties that will form part of the asset pool. For example, you bought a new house post separation but prior to the property settlement and now you seek legal advice because your ex-partner is trying to claim your new house as part of the relationship asset pool. In this example, it is too late for a lawyer to protect your new house because it has already been purchased. Had you sought legal advice prior to the purchase, your lawyer could have advised you of the consequences. An important take away from this is that if you are making any big decisions, whether it be personal or financial, you should seek legal advice to ensure that the decision does not have any unwanted consequences and you are protected. Preparing For The Perfect Paint Job

of warm water until it is dissolved completely. Dip the sponge mop into the solution and wipe down the walls. Rinse the surface with a clean sponge and let it dry before starting to paint. For small rooms, you could try Selley’s Sugar Soap Wipes. Clean with the smooth side and scrub with the other, rougher side to remove marks and stains. For more stubborn stains, try Mr Clean Eraser Pad Block. Cut to the size you need and test on an inconspicuous area. Scrub off those hard-to-lift pen scribbles or oils stains and rinse with water – easy! Painting the room First, set up a safe workstation. Access to and from the door should be free and uncluttered. Avoid situations where you have to reach over or across a ladder or painting equipment. While you are painting, cover your paint trays with aluminium foil, or a plastic or garbage bag. Put a paper plate of baking foil to catch the drips under each paint can. Have a damp cloth within reach to be able to immediately wipe up drips before they dry.

Interior painting relies for success on the quality of its preparation. Preparing a room for painting is time-consuming and laborious, but if you follow these tips, you will have beautiful, smooth walls every time. Preparing the room Shift all possible furniture out of the room and cover what’s left with canvas drop cloths. Canvas absorbs paint and prevents it leaking onto the floor, a common problem if you use old cotton sheets or plastic sheets. You can also cover odd-shaped furniture with cling wrap.

To protect skirting boards and other surfaces you don’t want painted, apply masking or painter’s tape. Using a putty knife, press down firmly on the tape, especially where the unpainted and tobe-painted surfaces meet. This reduces paint bleed. Check for any indentations or cracks in the surface. Use a putty knife and a minute amount of putty to fill in. Wipe off the excess and sand back gently. Washing the walls Whether DIY or done by professionals, washing the walls is mandatory. If you’ve hired professionals, washing walls is not usually part of their service and they will charge extra for doing it. Hire a professional cleaner or do it yourself.

Dust all surfaces to be painted whether you believe they are clean or not. Minute fibres or dust particles will interfere with the painting process. You can use a damp cloth but the best tool for dusting is a long-handled microfibre duster, preferably with an extension handle to reach up to ceiling level. It is a good idea to wear a face mask while doing this, even if you don’t have allergies or your walls have been dusted recently.

Using a sponge mop, clean the walls (and ceilings if you are painting those) with a solution of sugar soap, also known as TSP (trisodium phosphate). It is essential to apply sugar soap in kitchens, especially near greasy areas like stoves, as grease can prevent paint adhering to the walls. Walls previously painted with a satin or gloss paint also need sugar soap so that the new coat of paint will not crack due to the slippery sheen of the gloss. Note that sugar soap will darken some wooden surfaces such as mahogany.

Even when closing a paint tin carefully, there is the likelihood of paint splattering across the room. When you first open the can, punch a series of holes (using hammer and nails or a nail punch) in the rim’s channel where the paint collects so it will drain into the can and not all over your newly painted project. Stretch a rubber band or tie a piece of string vertically over the paint can. Use it to scrape the excess paint off your brush. This reduces the amount of paint collecting in the channel of the rim. The Reserve Bank has said it will increase the cash rate at some point and with some economists predicting that this could commence as early as June this year and by the end of 2024, the cash rate will have increased by 1.15% to 1.25%. CBA economists believe that with the cash rate at 1.25 per cent, it would take the cost of mortgage repayments to about 15 per cent of household disposable income. “This is the level we assess to be ‘normal,’ based on the experience of the past two decades,” the bank’s economists say. CBA thinks the RBA will hold rates at 1.25 per cent until 2024, but futures markets are betting the central bank would eventually push rates towards a much higher 2 per cent by then. Governor Philip Lowe has repeatedly tried to calm speculation, stressing that he does not expect to raise interest rates until 2024, though lately he’s conceded 2023 is also plausible. When that happens, banks will almost certainly raise their mortgage rates in line with these increases. So, what can you do to prepare?

Calculate by how much your repayments would increase if your home loan rose by anywhere from 0.25 percentage points to 1.50 percentage points in the years ahead.

Embroidery is the process is turning graphic design into needle and thread art for application to the fabric. These designs can be simple, single color or multi-color intricate pieces of art. If the fabric can be laid flat then it can be embroidered. (Which leads to the question of how are hats embroidered? But, that is the subject of another post). Of all of the methods of fabric embellishment embroidery is generally considered to add sophistication to any work or club apparel. What is the process?

Teach the machine what it has to do The embroidery machine is then instructed which design we are working on. The correct threads are loaded onto the machine and the machine taught where to find each colored thread. So for example, if the design includes some red and the red thread is on station 12 then the machine has to be taught that when stitching the red areas use station 12. Stabilize and hoop the garment During the embroidery process, the garment is held in a hoop. This is a 2 piece frame which is sandwiched over the garment to keep the fabric secure during the sewing process.

Test A test sample is stitched out using the selected design, the required thread and on fabric which closely matches the finished article of clothing. Stitch out When we are happy that the digitized design is correct and loaded on the embroidery machine, the garment is correctly hooped and secured, the correct threads have been selected and the machine taught where to find them, then we start the embroidery onto the finished garments. This may be a run of 5, 10 or 100 items. This is when the industrial embroidery machine earns its keep, these machines are designed the work all day every day without missing a beat.

Digitize the image Custom embroidery is primarily an automated process that converts a digital image into data which guides the operation of the embroidery machine. For this to happen, the first step is to digitize the image. This may include lettering, a logo or a visual image. Digitizing converts the image into stitch data which the embroidery machine can understand. It involves tracing your logo with a mouse to select size, length, density, turning stitches, machine trims, color changes and many variables around fabric strength.

Temporary full expensing of depreciating assets

The majority of businesses are eligible to claim an outright deduction for the cost and installation of new assets. To qualify for full expensing, the asset must be first held and first used or installed ready for use between 7:30pm AEDT 6 October 2020 and 30 June 2023. This final date of temporary full expensing was extended by 12 months from a 2021 Federal Budget announcement and is now law. Unlike prior rules on instant asset write-offs, no limit applies to the cost of an asset under the full expensing rules. That is, an asset of any value may be fully deducted in the appropriate income year. For a business to qualify for the outright deduction, the entity must have an aggregated turnover of less than $5 billion. Certain large entities

The low-income earners’ exemption states that an employer is not required to pay superannuation guarantee where their employee earns less than $450 in a calendar month. The change that is occurring is a repeal of the subsection of the legislation which provides the employer’s exemption from superannuation guarantee liability. The repeal will not be in place until 1 July 2022. Where

Downsizer contributions to superannuation Downsizer contributions have been available to members of complying superannuation funds since 1 July 2018. From this date, a person aged 65 years or older has been able to make a contribution up to $300,000 from the proceeds of selling their main residence. A legislative amendment originally from the 2021 Federal Budget will reduce the age limit from 65 to 60 from 1 July 2022.To be eligible to make a downsizer contribution, an individual must have owned their main residence for at least 10 years. It is available to both members of a couple for the same home, even if only one is on the title deed. Downsizer contributions are in addition to existing rules and caps and are exempt from the:

Individuals can withdraw funds out of their superannuation account to be used for a first home deposit. The scheme began on 1 July 2017, with voluntary contributions up to $15,000 per year able to be used for an FHSS scheme withdrawal. The Rotaract club of Djilang (Geelong) which launched in November 2021, has already established connections and developed services to enhance the Greater Community of Geelong. The Rotary Club of Kardinia, Otway Rotaract Club and Study Geelong have significant supported the commencement and development of the Djilang club through rich collaboration and knowledge sharing. Rotaract is a global organisation auspiced by Rotary International that provides opportunities for young adults to enhance their personal development, awareness, and skills to address the physical and social needs of their communities. This occurs through promoting peace and better relations between all people worldwide following a framework of friendship and service. Rotaract is made up of young adults aged between 18-30 years. Our members come from a wide range of diverse back grounds, cultures and experiences. We work together to support ideas that fall into the categories of community and international service, fellowship, and personal development. Members are encouraged to think outside the box to create and participate in social events to expand their knowledge and leadership skills. Our goals that create our outline are:

We are currently meeting twice a month. Firstly, at our regular meeting, which is held the second Tuesday of every month at Virginia Todd Hall, West Geelong and another gathering toward the end of the month for a fellowship/social event. We encourage new or potential members to attended one of our meetings to see what we are all about and meet other likeminded individuals.

Rotaract has an exciting year planned out for community service events including Clean Up Australia and Lids for Kids collections. Whilst also starting fundraising to support our chosen Rotary International projects. Looking for Gold Nuggets Another reflection from Justin Coulson’s great little book, ‘What Your Child Needs from You’. I thoroughly recommend going on line and ordering yourself a copy. Coulson compares parenting to a gold digger with the following illustration: A young inexperienced digger arrived at the goldfields intent on finding nuggets but all he uncovered after much gruelling work were rocks. Despondent, he made preparations to leave. An old digger asked where he was going. The young man explained that he was giving up looking for gold since all he could find was rocks. To his amazement the old man gave the young man a glimpse of his bulging pouch full of gold flecks and then to the young man’s further surprise the old man began splitting the young man’s rocks pointing out the shiny little flecks inside. Coulson suggests that as parents we are often like the young man making the mistake of looking for nuggets in our family life rather than seeing the little flecks of gold that are often hidden in the midst of the mundane and difficult times. As I reflected on Coulson’s words I thought about how much of our lives are made up of the mundane and routine events of life. Finding meaning and purpose in those times isn’t easy. Although we don’t like it, dealing with these times produces character and getting through the hard times develops resilience. Judi (my wife) and I with three young children, spent two years living and teaching in a small village in Samoa in the 1990’s. Our first year there was not easy to say the least. I have distinct memories of the tears, sweat, culture shock, conflicting expectations and feelings of frustration during that time. And yet now we recognise that those years were some of the most important and formative in the life of our family. It’s hard to see the flecks of gold in the difficulties or routines of life. But it’s so important to continue to model consistency and kindness during those times. Our children still need to be loved and understood in the midst of a demanding week. At such times we need to ‘hang in there’ and continue to give out for their sake. Coulson states, ‘When we learn patience, compassion, charity, service and sacrifice for our children and do these things willingly, something interesting happens. We see our role as parents, as an opportunity for our own development and our children’s development. Our focus is on being the best we can be for our children. LEOPOLD SPORTSMANS CLUB In 1971 a couple of locals, Len Lewis and Kevin Ash had an idea for a bowls club in Leopold. The idea took hold, a committee formed and money raised. A location was needed that would have enough space for two bowling greens and a clubhouse. Finally this was located in Kensington Road, our current location and 5 acres purchased for $8500. In May 1975 the club was officially opened as a family friendly sporting club by Brian Dixon, the then Minister for Youth, Sport and Recreation. You can see the results for yourself on visiting our club. There are so many people to thank over many years for their support, encouragement and voluntary help along with the the original crew that helped established the club. Leopold Sporties, located in Leopold, Victoria, is a club based on sports. We offer Bowls, both social and Pennant, Golf, Racquet Ball and Squash.

FC LEOPOLD FC Leopold was established in 2016 by Jared Larkins and Mitchell Vials. The club is based in Leopold, Victoria and played its first competitive games in 2017. In our first season we had over 100 registered players and expect those numbers to grow in 2018 and continue to grow into the future as the club continues to develop. The club aims to provide a positive family friendly enviroment for our members to develop their skills off the field and to also become great people off the field.The club is run solely by volunteers and we are always looking to get members involved in helping the club grow and develop. We are aiming to become a huge part of the Leopold community and look forward to growing the sport of football (soccer) in our beautiful town. FC Leopold is a community club that fields senior mens teams, a senior womens team and multiple miniroos and junior teams in Geelong competitions. FC Leopold are looking for enthusiastic members of the community who would like to contribute to the clubs ethos and family friendly feel - whether that is through being a committee member, volunteer, coach or player. I AM Sculpture Arrives in Lara

A sculpture celebrating people who have a lived experience with disability has moved from its temporary home at Eastern Beach to Austin Park in Lara. Each letter in the sculpture weighs around four tonnes and it was moved to Lara using a crane truck. Deputy chair of the Creative Communities and Culture portfolio Councillor Jim Mason and Member for Lara, John Eren MP, joined artist Mark Cuthbertson is celebrating the arrival of the artwork in Lara. The City of Greater Geelong commissioned Mark Cuthbertson with artist-collaborators Robert Croft, Hannah Wilkinson, Christian Den Besten and George Macaronis to develop the public art sculpture. The sculpture was developed based on more than 85 contributions from the local community through a series of artist-led workshops. Drawing reference from powerful political and pop culture statements such as the 1968 Memphis black sanitation workers slogan “I AM a man”, and Helen Reddy’s 1971 anthem “I AM woman”, the work celebrates the empowerment of diversity in our society.

The sculpture stands at more than two metres and is interactive by design, inviting you to be a part of the work. You can position yourself within and take photos (using the hashtag #IAMGeelong) that will form a collective voice celebrating the diversity of our local community.

The sculpture was funded by the Victorian Government through the Community Support Fund and delivered in partnership with VALiD (Victorian Advocacy League for Individuals with Disabilities) and Geelong-based ArtGusto. The sculpture will remain in Lara until later this year.

Win for Community as Wildlife Sanctuary Protected

The City of Greater Geelong is celebrating a win on behalf of the Lara community after Fire Services Victoria withdrew its bid to build a new fire station opposite the Serendip Wildlife Sanctuary. The withdrawal of the VCAT appeal, which had been lodged after the committee’s refusal of a permit in June last year, vindicates the position that the emergency services facility was not in keeping with this area of Lara. The Planning Committee, made up of councillors, voted unanimously to refuse the permit. The committee’s decision was about environmental protection, preserving the rural feel of the area, and listening to the views of the community.

We value and appreciate the services provided by Fire Rescue Victoria and the hard work they do keep our communities safe. However, this was just the wrong spot in terms of the zoning of the area and the impacts on the native habitat. It would cause too much disruption to local wildlife and natural aspects of Serendip, which is a place that is treasured by many people and we have a responsibility to project it. Well done to Fire Services Victoria for recognising the community was clearly against this proposal and withdrawing its appeal to VCAT.

Share your views on public parking at Pakington Street, Geelong West The City of Greater Geelong is seeking feedback from business owners, managers, shoppers and residents about public parking conditions on Pakington Street in Geelong West. Local business owners and managers are invited to attend two workshops on public parking issues and needs and community members can submit their feedback using a map on the Have Your Say page. The feedback will be used to inform the development of a Public Parking Plan for the much-loved commercial strip. The Final Pakington Street and Gordon Avenue Urban Design Framework (UDF), which was partially endorsed in December 2021, includes an action to prepare a Public Parking Plan for Pakington Street North and Heritage Core Precincts. A Public Parking Plan analyses the parking conditions and needs of an area and can provide the basis for a Parking Overlay or other appropriate implementation mechanisms to manage parking in a precinct. The scope of the Parking Plan study includes existing public parking spaces servicing businesses along Pakington Street (including public parking facilities behind Pakington Street businesses). The scope of the Parking Plan study does not include: The provision of public parking spaces in residential areas (this will be addressed in future studies) the provision of private parking facilities additional public parking spaces (this will be addressed in future studies). Feedback closes on Monday 28 March 2022.

On Tuesday, Councillors gave the green light to seeking public feedback on the proposed use of the three sites for social housing in Corio, Belmont, and Bell Post Hill.

Annual Windfire Music Festival Our 12th Annual Windfire Music Festival which will take place from 11 to 20 March 2022. Our opening concert will be presented by Orchestra Geelong and will feature the inaugural concert of the Geelong Youth Orchestra. The Vardos Trio will bring their gypsy flavoured music to Wesley Uniting Church on Saturday and the Excelcis choir will bring a world of song to All Saints Church on Sunday.

The festival will conclude on Sunday with the Melbourne Chamber Choir who will present gems from the French a capella repertoire.

During the week there will be two workshops – one on African Drumming presented by Jacqui Dreessens and the other will be a vocal workshop on the Bellarine peninsula presented by Kym Dillon. There will also be a series of free “Organ + 1” recitals which will feature pipe organ and one other instrument.

Cunningham Pier Geelong Cunningham Pier is one of the most recognisable structures on the Geelong Waterfront. Opening in the mid-1850s it was originally known as Railway Pier. It was an important part of the Geelong Port and you can still see the train lines that were used to transport cargo to the end of the pier. The pier stretches 250 metres out over Corio Bay and its bright white building is a standout feature of the foreshore. The two-storey weatherboard building houses the Wah Bar and Asian food restaurant (bao buns!), Wah Wah Gee. The Pier Geelong function centre is also located here. A large part of this Geelong pier is dedicated to car parking and a convenient covered walkway provides shelter as you walk along the train tracks. Cunningham Pier fishing has always been popular and in keeping with tradition, local anglers continue to use it.

The Cultural Precinct The Geelong Gallery is one of Australia’s oldest regional galleries with a magnificent collection of 19th and 20th century Australian and European paintings. The 1915 architecture is a temple to the arts with Greco-Roman columns and high ceilings. In contrast to the building’s classical roots, exhibitions are often cutting edge. They recently had a Rone retrospective, highlighting the work of a local street artist who has become world-renowned for his large-scale wall paintings of esoteric female faces and immersive installations exploring beauty and decay. Geelong Library and Heritage Centre tower over the gallery. The glass-clad masterpiece nicknamed “the Dome” cost $45 million and has won several architectural awards. An elevator goes to the top floor. Step out on the balcony with the pigeons, and Geelong is at your feet! Enjoy lunch at Public, a contemporary library cafe with views of the parklands.

Skate Parks In Geelong We have more skate parks per capita than any other municipality in Australia. Skate parks in Geelong have a variety of facilities available for skate boarders, bladers and BMX bike riders including quarter pipes, handrails, funboxes, vert ramps, pyramids, banked ramps, and stairsets. The Old Paper Mills Hubcaps To Creative Hubs is the title for a series of short films about creative Geelong. Hubcaps are a reminder of Ford as a major employer before pulling out in 2016. Vacant industrial spaces such as factories and wool mills have become creative villages. I stayed in a Vrbo in the Old Paper Mills (1878). In Victorian times, this bluestone mill pulped rags to make paper. The dramatic waterfall setting reminded me of the cover of George Eliot’s novel The Mill and the Floss. The present owner, Alex Robins, has lovingly restored what he refers to as an Industrial Cathedral. The old mill is a labyrinth of galleries, studios, workshops, and boutique shops with handmade goods. Enjoy a coffee at The Door Gallery Cafe surrounded by antique Indian doors. Provenance Wines has a cellar door and restaurant in the main building. Enjoy tastings matched with bite-sized food pairings. Rone painted one of his famous esoteric faces on the back wall. As street art is so transient, it’s great to see a lasting testament to his work.

Western Beach Geelong People have been swimming, boating, fishing, and playing at Western Beach Geelong since the 1840s. In those days there was an unwritten rule designating Western Beach for men’s bathing and Eastern Beach for women. But some ‘dastardly gentlemen’ would disregard the agreement scaring respectable women away. Today the area is rarely used for swimming, but it’s still a popular stretch of foreshore connecting Rippleside to the rest of the Waterfront. Here you’ll find the Boat House restaurant (Geelong’s best spot for fish and chips), the Poppykettle Playground, a designated fishing area, and the marvelous Western Beach Boardwalk. Curving out over the water the boardwalk has well-placed seats where you can sit back and watch the sea birds duck dive for fish. In the early morning, it’s perfect for watching the sun come up over the bay.

Rippleside Park Located on the western edge of the Waterfront, Rippleside Park Geelong is a pretty grass-covered foreshore reserve. Popular with locals, Rippleside is less well-known to tourists who drive past en-route to more popular areas. The park has magnificent bay views and is particularly appealing to families with young children who love the adventure playground. The huge wooden structure has ramps, walkways, steps, and plenty of nooks and crannies to explore. When the kids tire of the playground the reserve has wideopen spaces to run around in. Don’t forget to bring your footy! Tucked in next to the reserve is tiny Rippleside Beach where you can bask in the sunshine or splash around in the water. Overlooking the whole area is the bright and spacious Ripples On The Bay cafe. This stunning cafe serves excellent coffee and has huge windows with to-die-for water views. Other amenities include picnic and barbecue facilities, toilets, and plenty of car parking spaces.

Steampacket Gardens Located right beside the water Steampacket Gardens Geelong is a big rectangle of lush lawn that’s perfect for a relaxing picnic or a game of frisbee. A path on the northern edge connecting the gardens to the bay has seats where you can enjoy the sea breeze and watch the nearby helicopter toing and froing. On the eastern side you’ll find the Wharfshed Cafe serving yummy meals and to the west sits the delightful historic carousel. There are some interesting art sculptures dotted around the park. Be sure to check out the Volunteer Rifle Band bollards and The Buoys sculpture, a group of former channel buoys that have been turned into a powerful piece of artwork. The Geelong Waterfront Makers and Growers market (Steampacket Market) is held here on the first Sunday of each month. The Carousel Geelong Carousel The Carousel Geelong is a rare 1892 ArmitageHerschell hand-carved wooden carousel. One of only a few in the world this beautifully restored carousel is considered by many to be the best that’s still in use today. Housed in a modern steel and glass enclosure the pavilion has an old-world carnival atmosphere that’s enhanced by a pipe organ playing Dixieland melodies. Limericks are nonsense poems that take their name from nonsense poetry that originated in – yes, you’re right - Limerick, Ireland. And now, as a senior, you will recall how limericks revitalized those (otherwise boring) long car trips when you were a child. This competition enables you to revisit those childhood memories. Limericks are five line poems with a strict meter, and as they are easy to construct, they have been frequently written for children. Their simplicity and singalong rhythm have also made it easy for drunkards in pubs to write rhyming slang, frequently with sexual content. Which has enabled this art form to persist down through the ages. They went into literature when Edmund Lear published a collection titled “A Book of Nonsense” in 1846. It’s never been out of print ever since. Here’s an example of his work:

The Downsizer Contribution – an easy way to get money into super If you have reached the eligible age, you may be able to contribute up to $300,000 from the proceeds of the sale (or part sale) of your home into your superannuation fund.

90 days of receiving the proceeds from the sale of your home to your respective super fund. Generally, this would mean 90 days from settlement. You can make multiple contributions from the sale of the primary residence, provided they do not total more than $300,000 each.

From 1 July 2022 the eligible age is 60 years old or older. Prior to this it is 65 years old or older.

Downsizer contributions form part of your tax-free component within superannuation and will be taken into account for determining eligibility for the Age Pension (whereas the value in the main residence is exempt).

According to the ATO, this downsizer contribution is not a non-concessional contribution and will not count towards contributions caps. The downsizer contribution can still be made even if the contributor has a total superannuation balance (TSB) greater than $1.7 million.

You do not have to have lived in the home for the entire ownership period. So long as you are claiming at least a partial exemption from capital gains tax [CGT] under the main residence exemption, your property meets the main residence criteria for a downsizer contribution.

Important points to note:

The home must in Australia, have been owned by you or our spouse for at least 10 years and the disposal must be exempt or partially exempt from capital gains tax (CGT)

You have not previously made a downsizer contribution to your super from the sale of another home or from the part sale of your home.

Prior to (or at the same time) as making your contribution you must provide your fund with the ‘Downsizer contributions into super form.’

A downsizer contribution will not affect the TSB until this is recalculated to include all contributions, including downsizer contributions, on 30 June at the end of the financial year.

The downsizer contribution will count towards the transfer balance cap, currently set at $1.7 million. This cap applies when superannuation savings are moved into retirement phase. Downsizing contributions can only be made for the sale of one home and cannot be accessed again for the sale of a second home.

Downsizer contributions are not tax deductible and will be taken into account in determining eligibility for the Age Pension.

If the contributor sells their home, is eligible and chooses to make a downsizer contribution, there is no requirement to purchase another home.

9 tips to consider

One of the key areas to note is timing when considering this strategy. You must make the downsizer contribution within

Tip 1 — Date of contract of sale Be aware of the date your client entered into the contract of sale to sell their home.

A downsizer contribution is only available where the contract of sale for an eligible property was entered into on or after 1 July 2018. Tip 2 — 10-year ownership interest You must have held an ownership interest in the home being sold at all times during the 10-year period prior to the sale. Tip 3 — Age-based considerations An individual must be aged 60 years or older when they make a downsizer contribution to superannuation. Interestingly, there is no upper age limit, so a downsizer contribution may be available to an individual well over the age of 65 who never had the opportunity to contribute to superannuation. Usually, any contribution to superannuation made on or after an individual’s 65th birthday requires the work test to have been met. However, a downsizer contribution can be made irrespective of an eligible individual’s work status. Tip 4 — Contribution amounts The amount you can contribute is limited to the lesser of $300,000, or the total capital proceeds you receive from the sale of your interest in the home. If you are a couple with joint ownership in the home, then you would be eligible to each contribute up to $300,000, resulting in a total downsizer contribution of $600,000. Tip 5 — Contribution timing Eligible individuals must make a downsizer contribution within 90 days of the change of ownership on the eligible property. In most cases, this will be 90 days from the date of settlement, unless an extension has been granted. You can make multiple contributions from the sale proceeds of the one eligible home within the 90-day eligibility period, so long as the total contributions do not exceed the lesser of $300,000, or the total capital proceeds received from the sale of your interest in the property. Tip 6 — Downsizer contribution form The contribution needs to be accompanied by the downsizer contribution into superannuation form either when making, or prior to making the contribution to superannuation. Tip 7 — Age Pension entitlements Age pensioners need to carefully consider how a downsizer contribution may impact their Age Pension entitlement. While the value of an individual’s home is means test exempt, the value of their

superannuation interests, both in accumulation and pension phase, are means tested when determining eligibility for the Age Pension. Eligible age pensioners may find a downsizer contribution indirectly impacts their Age Pension entitlement, however any additional amount they now have in superannuation as a result of the contribution could be used to further support their retirement income needs. Tip 8 — Estate planning perspective A downsizer contribution is a new type of after-tax contribution to superannuation and, therefore, will not count toward an individual’s non-concessional contribution cap. Any amount contributed will form part of the individual’s tax-free component. From an estate planning perspective, the taxfree component would not attract tax if a death benefit lump sum was paid to nontax dependants such as independent adult children. Tip 9 — Transfer balance caps While an individual’s TSB can limit their ability to make certain additional contributions, most notably nonconcessional contributions, eligibility to make a downsizer contribution is not impacted by their TSB. However, an individual continues to be restricted to only moving a maximum of $1.7 million to retirement phase under the transfer balance cap (TBC). Should your client have already fully utilised their TBC, any additional contribution to superannuation under the downsizer measure would remain in accumulation phase. Extension of time In some circumstances, contributors might be able to request a longer period for making a downsizer contribution, for instance, when a delay has been caused by factors outside their control. However, an extension of time will not be granted to allow an individual to meet the age requirement. According to the ATO, an extension of time should be requested before the 90-day period from the date of settlement has expired. If a contributor has overlooked the 90-day timeframe, an extension of time may still be granted due to, but not limited, to: • • •

ill health death in the family moving house.

ATO example of an extension being granted Ben, aged 77, decides to sell his family home of 15 years. Settlement occurs on 1 August 2018. He purchases a new home in a retirement village, which is due to settle on 1 October 2018. The retirement village has only just been built, and Ben’s settlement is delayed until 1 December 2018 while final council approvals are obtained. Ben does not want to contribute funds from the sale to his superannuation until after the settlement of his new property to ensure he has enough money to purchase and move into the property. Upon his request, the ATO gives Ben an extension of time to contribute until 1 February 2019. This extension allows Ben enough time to settle on the new property and make a contribution of the remaining money from his sale. Ben can afford to contribute $200,000 to his superannuation fund after the sale and makes this on 25 January 2019.

Conclusion The benefit of the downsizer strategy is that there is no requirement to meet a work test to make this contribution. This is beneficial for clients aged between 60 and 74, but it is even more appealing for clients aged at least 75 who may still wish to contribute to their superannuation – whether they are still working or not. Not only is this a great advantage of the downsizer strategy, but so is the fact that it does not matter how much a client already has in superannuation. The total superannuation balance threshold of $1.7 million that would normally preclude an individual from being able to make further non-concessional contributions does not apply for downsizer contributions. Downsizer Contributions Question 2: In-specie transfer of assets for downsizer contribution

My client wishes to make a $300,000 downsizer contribution to super and would like to make this contribution via an in-specie transfer of personally owned shares. Is this possible? Answer: Yes. A client can make a downsizer contribution as an in-specie transfer of assets, provided the value of the transfer does not exceed $300,000 or the total capital proceeds received for the property sale. The ATO have confirmed this in LCR 2018/9 and provide the following example on their website: Alisha has a portfolio of listed shares worth $150,000. She sells her home for $500,000. As Alisha meets all the other requirements, she can make a downsizer contribution of up to a maximum of $300,000 using a combination of her shares and cash. Remember, the downsizer contribution must be made within 90 days of receiving the sale proceeds and any transfer of shares from individual ownership to super will trigger a CGT event and capital gains tax implications may apply. Find Cards that DO NOT display its Regions Sticker in the circle at the back and DO NOT display an Authentication code in front of the Find Card are INVALID. They will not be accepted at any participating businesses. Also, your signature must be present. You may be asked to present ID to verify that Find Card belongs to you.
