The City of Knox is a loacl government area in Victoria, Australia in the eastern suburbs of Melbourne. Knox had a population of approximately 136,230 as at the 2019 Report which includes 9000 business and close to 59,000 households. The City of Knox was created through the amalgation the former Cities of Ringwood and Croydon in December 1994.

EVEN THE POPE CANNOT STOP THE VIRUS By Warren Strybosch
Italy is now in lock down with nearly all shops closed and the WHO declaring a pandemic. The Prime Minister Giuseppe Conte has also closed bars, hairdressers, food establishments and pretty much any store that does not provide general food items. It is the biggest lockdown Europe has seen. With the dramatic increase in deaths throughout Italy, the President Donald Trump has now suspended all travel from Europe the United States. The travel restriction will be in place for the next 30 days and if the death rate does not decrease it is likely to be extended. It is likely Australia will follow America’s lead in this area. I personally know of people who have lost thousands as their travel plans to Europe have been cancelled. It seems the Pope cannot stop this disease from spreading in his own country. The virus obviously does not respect sex, religion or race given it has now spread to over 100 countries. Let’s hope we see a decline in deaths and of new cases and that everything will get back to normal as soon as possible.
PET REGISTRATION INCREASE BY OVER 30% IN TWO YEARS AND COUNCIL ARE KEEPING MOST OF THE FEES By Warren Strybosch
Are you a dog or cat lover? If so, you might be interested to know that local council are benefiting from pet owners. Recently, residents on Facebook were questioning why dog rates had increased from $37 to $52 over a two-year period and cats from $27 to $42. So, we decided to dig a little deeper to find out why. When we spoke to Maroondah City Council, we were told that “the state government charges us [Maroondah Council] a fee, so the amount goes through to them [Victorian Government]”. We enquired with the Victorian Government and found that under Part 6 of the Domestic Animals Act (1944), the Victoria Government does indeed charge a levy to local council for each resident who owns either a dog or a cat. Firstly, here is the list of fees charged by my local council. Taken directly from the Maroondah City Council website: (Source:https://www.maroondah.vic.gov.au/Customer-service/Payments-and-fees/Fees-and-charges) So, let’s get this right. Council have increased the pet registration fee by over 30% in a 2-year period, but the levy increased only by 2.5% by State Government each year. The Victorian Government was asked if there were any other levies charged to council that related to dogs and cats. Their response was a categorical “No”.
Here are the Levies the Victorian Government charges local council: Dogs - $3.50 (three dollars and fifty cents) * Cats - $2.50 (two dollars and fifty cents) * *Each year this levy increases by roughly 2.5%.
So, why are council gouging pet owners? There is a disparity between what Government is charging and what our local council is asking its pet owners to pay. As a pet owner, I have not received any additional benefit from paying these higher fees. I simply pay the fee so that I don’t get fined in the future.
I asked State Government if it was lawful for Local Council to be able to charge suchexcessive fees to its local residences? They could not answer this question and directed me to ask our local council this question.

CHINESE RESTAURANTS ARE HURTING By Warren Strybosch
Across Australia and even in our own backyard Chinese businesses are hurting from the Covid-19. Already there are over 4,92 deaths across the world and $117, 747 known cases with Mainland China recording over $80, 000 of those cases. In Australia, there were a recorded 112 cases of which NSW recorded the highest being 60. Only three (3) have died in Australia to date from Covid-19 and hopefully that number will not rise much more over the coming month.
SOURCE: World markets have been affected with dramatic drops in share prices, toilet paper has disappeared off shelves in all but a few shopping outlets, and trade had nearly ground to a halt across the world. Interestingly enough, most commentators believe we will all forget about this in 12 months to 24 months’ time when the media stop making it more than what it is…just another flu strain that unfortunately results in deaths like every other year. Even so, we need to be mindful of how we are reacting to the virus and what we can do to support those around us that are feeling the impact more so than others.
One group that is definitely feeling the impact is our local Chinese Restaurants. We spoke to the owner of D for Dumplings in Ringwood, who stated that they had noticed a decline in patronage due to the virus. However, they pointed out that their dropin numbers were no way near as bad as those restaurants in the Box Hill and Glen Waverley areas. It seems that where there is a higher number of Chinese people living in those areas, those restaurants,
Chinese or otherwise, also in that area, have been the hardest hit with little or no customers attending. Even China town seems like a ghost town. As a Maroondah citizen, I encourage everyone to either dine in or at least Uber out a meal from a Chinese restaurant or a restaurant affected by the virus. Let’s show our support to those in our local community. Rather than spending money on toilet paper I encourage you to spend money on at least one meal at your local restaurant.

TREASURER READIES MULTI-BILLION STIMULUS
The federal government is eyeing a substantial stimulus package to help Australian businesses and workers through the coronavirus crisis but how that affects its much-touted return to surplus won’t be clear until May. Treasurer Josh Frydenberg said on Monday the support would be delivered using existing tax and transfer systems, which takes in welfare payments, family assistance and pensions. He described the package under consideration as “substantial” – an upgrade from what he and Prime Minister Scott Morrison have said previously would be a modest or measured response.
Unions will also use a meeting with Industrial Relations Minister Christian Porter and employer groups on Tuesday to ask for compensation for casual workers who don’t get paid sick leave. ACTU secretary Sally McManus said the package must address the financial risk to Australia’s 3.3 million casual workers in retail, hospitality, health and aged care, who will lose pay if they have to take weeks off work. We don’t want people with virus or people with symptoms going to work, but they are going to have to choose between paying the bills and feeding themselves or going to work,” she told Nine’s Today program.

SMSF - HAVE YOU GOT YOUR INVE ACCOUNTING By Warren Strybosch
Each year, a SMSF must get their tax return prepared and have it signed off by a SMSF Auditor prior to it being submitted to the ATO. One requirement of the SIS Act is that the SMSF must have an investment strategy and have it reviewed annually. Until now, no one has really paid too much attention to this requirement…until now. Last year, the ATO mailed out over 17,000 letters to SMSF Trustees asking them to provide evidence that they had reviewed their Investment Strategy. The ATO provided guidance as to what they considered to be a valid investment strategy e.g. one that was a tailored strategy to the specific requirements of the trustees and their individual circumstances. For many years, the Trust Deed contained a one-page investment strategy that was very generic. An example might have been as follows:

UPTICK IN WRITING TEST RESULTS OFFER HOPE By Katina Curtis, AAP Senior Political Writer
An uptick in the quality of Australian students’ writing is giving education experts hope and underlines the value of national testing. The final results of the 2019 NAPLAN tests,released on Tuesday, show writing improved across all years in all states and territories compared with the previous year. But for Years 5, 7 and 9, those results are still lower than the base year of 2011, the first time comparable tests were done. The head of national testing authority ACARA, David de Carvalho, described the results as a national upward movement. “I don’t think we can get too excited about this at this stage, one swallow does not make a summer, but if this was to be repeated, this kind of improvement in the coming NAPLAN results, it would be an encouraging trend,” he said. “What happens in 2020 will be an important source of information about what might be behind the change.” The results showed the beneficial way NAPLAN could call attention to problems. “We’ve had a national debate about our declining writing results in NAPLAN over the last few years,” Mr de Carvalho said. “One possible explanation for the uptick last year was that the renewed efforts and focus on writing that has been undertaken across jurisdictions is bearing fruit.”
Federal Education Minister Dan Tehan said the tests did provide valuable information. “The Morrison government continues to back NAPLAN because our community deserves to know how our students and schools are performing,” he said. Critics have also suggested the tests are behind an apparent flatlining of student results over time.
Some states have questioned the usefulness of NAPLAN, with NSW, Queensland and Victoria reviewing whether the standardised testing gives parents and teachers diagnostic information in the most efficient way.
Before NAPLAN was instituted in 2008, there was no nationally consistent testing to compare the achievements of all students. Mr de Carvalho said it wasn’t correct to say results
were flatlining, highlighting improvements in the average scores in most domains and years in the decade since testing began. Those improvements are most pronounced in the primary school years, a trend Mr de Carvalho said was also seen in international results. Labor’s education spokeswoman Tanya Plibersek said the latest results combined with those from international testing did not paint a pretty picture of Australian students and the nation couldn’t afford for the next generation to be held back.

Australia’s current account is in surplus for a third consecutive quarter but it shrank by $5.5 billion to $955 million in the December quarter. The result is lower than the market’s anticipated $2.4 billion surplus, which slips from a downwardly revised $6.5 billion in the September quarter. Tuesday’s seasonally adjusted figures from the Australian Bureau of Statistics showed exports of non-rural goods fell by 6.0 per cent as prices for metal ores, minerals, coal and mineral fuels softened. Export volumes of meat and cereal grains increased. The balance on goods and services surplus increased by half a billion, widening the surplus to $8.9 billion, with an expected contribution of 0.1 percentage points to growth in the December quarter. BIS Oxford Economics chief economist Sarah Hunter says the results confirmed general trends seen in 2019, with exports were broadly flat as sharp falls in the volatile net exports of goods and non-monetary gold offset gains in rural and non-rural goods.
Tourism-related services grew by two per cent, suggesting the bushfires in NSW at the end of the year had a limited impact on demand, she said.

For Example: A child at a supermarket being held by an adult, the child is screaming, throwing its body around and hitting the adult. You may think that you can treat insurance as you would a bill from the water board, and just wait for the red one to come in the post, and that service will continue after repeated warnings and payment defaults. For people who work for themselves being able to obtain finance to buy a home, grow their business or purchase another asset can be a very challenging exercise. LOW-DOC-LOANS Low Documentation (Low Doc) loans are available for potential borrowers who are self-employed and don’t have access to the documents required to obtain a traditional mortgage. Usually borrowers cannot provide financial statements and tax returns to verify their income, so the lenders rely on other
documentation provided by the applicant to determine whether they can afford to borrow the amount requested. The applicant would provide a declaration stating their level of income which would be supported by other forms of verification.This includes lodged BAS, trading account statements or a letter from the accountant for the business confirming the income declared is accurate. The level of information required may vary between providers, and these types of loans are available for owner-occupied, investment and commercial properties. These loans usually have a slightly higher interest rate than standard loans where full documentation has been provided, and not all lenders provide this option as part of their suite of products. The amount of property equity you would need to have to secure this type of loan will also be greater than a standard loan. But, if your circumstances mean you don’t fit the traditional type of borrower, this can be a good option to consider, particularly for Home Lending.
CASH-FLOW LENDING Cash-flow lending is usually a short-term loan that self-employed applicants might use for any business purpose. This can mean covering a temporary cash-flow shortfall, investing in new equipment or purchasing another business. The loan amounts are small, in most cases less than $100k, and in a lot of cases no security is required. Where traditional business lending requires the applicant to provide two years of financials and tax returns, cash-flow lending looks at things differently. The revenue performance of the business is used to determine the eligibility to borrow.
The cost of these loans can be quite high, above 10% per annum before you factor in fees and charges, as these are primarily unsecured loans so the risk to the lender is higher. But cash-flow lending is also oneof the fastest ways to inject funds into a business. Some of the providers suggest that they can have funds available within 48 hours of receiving an application, and the number of providers in this market is growing, even including some of the major Banks who have developed a product to cater for these types of requests. Where a self-employed applicant can meet the requirements to obtain finance through traditional means then usually this is a less costly approach to take, although potentially more inconvenient. Lenders are risk-averse businesses so the more information a selfemployed applicant can provide to verify their income is stable and secure the better. If, however you are in a situation where that is not possible, at least you know there are options available. With more time on their hands, retired people are getting a better night’s sleep and more exercise. The study of 25,000 older Australians shows that retired people sleep 11 minutes longer and spend 93 minutes more per week keeping physically active, compared with the same age group still in the workforce. These findings could be part of the reason why Australians are living longer. “We hope this information could translate to better health in older Australians, preventing cardiovascular disease and diabetes,” says Dr. Melody Ding, lead researcher for the study. So what could your healthy lifestyle in retirement look like? If you already like to run, hike or cycle, you’ll have more time to enjoy these activities and won’t need to budget for extra equipment. Joining a gym or sports team is another way to add exercise into your weekly routine, and make new friends too.

“Temporary” Apartment Qualifies as Permanent Place of Abode The Australian tax residency of an individual has been ruled incorrect by the Full Federal Court on appeal, reversing an earlier determination by the Commissioner of Taxation. A subsequent appeal to the High Court of Australia by the Commissioner has been dismissed. This is a major case for expatriates living abroad, as the individual in question had been living in “temporary” serviced apartments in the Middle East. During the time in question, the taxpayer’s family had been living in Australia in a property jointly owned by the individual. The case was overturned on account of the term “permanent place of abode” which is part of the Australian tax residency question. The ruling leaves a further option open for expatriates wishing to remain a non-resident of Australia for tax purposes when working overseas.
Luxury Car Tax Refunds Proposed for Farmers and Tourism Operators Primary producers and tourism operators may be eligible to apply for additional refunds of luxury car tax on vehicles purchased or imported after 1 July 2019. Generally, motor vehicles purchased above a certain threshold will incur additional taxes. The rate is usually 33%, although a small refund is allowed in certain industries. The increase in refund is subject to approval via both houses of parliament.

Super Guarantee Opt-out Coming for Certain Individuals Certain individuals will now have an option to opt-out of receiving certain superannuation guarantee amounts. Under the new legislation, individuals with multiple employers may get additional cash from their second employer if they can show an unintended breach of contributions caps. Generally, a breach may bring additional personal tax payable plus shortfall interest charge. The new law will allow the ATO to issue an employer with a shortfall exemption certificate. This can only occur when an employee would likely have excess concessional contributions, and removes the employer’s potential liability for super guarantee charge. This new law may reduce overall paperwork for superannuation compliance of high income earning individuals. Also, it may remove unintended interest and penalties.

The previous rules relating to SG charge denied the tax deductibility of late super payments, and applied additional penalties. A disclosure could theoretically be made from the quarter starting 1 July 1992. The current Bill has strict penalty provisions which the ATO must charge if an employer fails to declare a SG shortfall post-amnesty period.

Testamentary Trust Minor’s Distribution to be Limited Minors may only receive concessional tax treatment on testamentary trust income that is derived directly from assets originally transferred from a deceased estate. Subject to passing legislation, this will take effect for assets transferred into a testamentary trust after 1 July 2019. The exposure draft provides trustees of a testamentary trust with a clear understanding of when minor’s income will not be taxed at regular rates. The announcements are part of a crackdown on the misuse of testamentary trusts by some. This has included “injected” unrelated property into the testamentary trust vehicle for tax minimisation purposes.

Builders and Building Designers in NSW to Face Increased Regulation NSW government has proposed a bill designed to regulate builders and building designers in the state. This is in response to various building disasters experienced by the state, which includes the Opal Tower and Mascot Towers cases. Enforcement measures in the bill include the power to investigate and audit the various building projects in different stages of completion. If found unsatisfactory, a stop order can be implemented for the offending building works. The Bill not only seeks to register all building design and construction industry players, but to also impose penalties on the players for performing unsatisfactory work in their building projects.

Tradespersons Register Launched for Bushfire Relief The Insurance Council of Australia has introduced an online disaster-affected trades register to assist local tradespeople in helping rebuild communities affected by disaster. Qualified builders and tradespeople who have the relevant skills and capacity to work on property repairs and rebuilds are invited to register online. This initiative will assist tradespeople in bushfire affected areas by making themselves available for insurance work. This will also assist with the rapid recovery of the communities affected by the bushfire disaster.

Bushfire Tax Assistance tax exempt for volunteer firefighters The Federal Government has passed a Bill that addresses the compensation of volunteer firefighters for the 2019/20 bushfires and those affected by the 2019/20 Australian bushfires. This payment is meant to compensate their loss of employment income when working with the State or Territory fire service during the 2019/20 year. All payments made to people for bushfire support or as a volunteer firefighter will be non-assessable nonexempt income. The payment for loss of income caps at $300 per day, with a total cap of $6,000 for the year. The payment is not means tested, and multiple applications for the payment is excepted, provided the annual cap of $6,000 has not been reached. The payment is applied through each state or territory department which deals with the volunteer service. Some states and the territories have yet to implement it yet.

Construction labour costs to be capitalised: TR 2019/D6 issued Labour costs and other associated cost for employees involved in the construction and creation of capital assets will no longer be deductible due to s 8-1(2)(a) of ITAA 97. The draft ruling issued by the ATO states that not only are wages and salaries expenses affected by this ruling, but also other employee entitlements such as long service leave, annual leave, sick leave, bonuses and allowances will all be affected. However, not all capital asset labour costs will not be deductible. The functions undertaken by employees or contractors will determine whether their labour costs are deductible or form part of a capital asset.

DPN regime extended to GST liabilities The Director’s Penalty Notice regime will be extended to include GST liabilities, with legislation now passed parliament. Also, the legislation extends the regime for LCT and WET, taxes which are paid as part of activity statement lodgements. From the quarter following royal assent (at this stage likely 1 April 2020), the Commissioner of Taxation would be allowed to declare a GST liability estimate. From there, the director has 21 days to ensure an outstanding amount is dealt with to avoid a personal liability of outstanding GST. The extension will mean that a director may become personally liable for PAYG withholding, superannuation guarantee or GST owed by the company they represent.

Investment strategies and SMSFs An SMSF must hold an investment strategy as part of the requirements of the SIS Act, and it must be reviewed at least annually. Recently, the ATO has provided guidance to where an investment strategy is not considered valid under the SIS Act. This includes tailoring the strategy to be specific to the SMSFs circumstances rather than a document which merely repeats the words in the legislation. Advisers are being encouraged to review their SMSFs investment strategy to ensure it does meet these and other areas such as risk. In particular, using asset investment ranges of 0-100% for all classes is considered invalid when formulating an investment strategy.

COUNCIL MEETING LIVE STREAMS TO COMMENCE IN MARCH The Ordinary Meeting of Knox City Council on Monday 30 March will be the first to be live streamed online, contributing to improved transparency, accessibility and awareness of Council decision-making processes.
“Live streaming will allow even more of our community to access and experience Council meetings, providing greater transparency and insight so our community can have confidence in Council’s decision making,” said Cr Seymour.
All Council meetings and Strategic Planning meetings after that date will be live streamed, unless they are closed to the public, with recordings generally made available on Council’s website for at least two years.
“I am excited for this opportunity to promote a better understanding of the functions and activities of Council and to allow all residents to participate.”
Knox City Council Mayor, Cr Nicole Seymour welcomed the commencement of live streaming as an opportunity to facilitate greater engagement with the community.
Meeting live streams and recordings will be accessible through Council’s website. The implementation of live streaming brings Knox in line with best practice for transparency, as recommended by the Victorian Ombudsman.
Live streaming was originally approved by Council in September 2019, with the 2020 Australia Day Local Awards used as a pilot event to test the technology. A new Live Streaming of Public Meetings Policy was adopted by Council last week, which outlines key requirements with regards to privacy, attendee and participant behaviour, publication of recordings and more.

RESTAURANT PROSECUTED AS COUNCIL REINFORCES HARD LINE ON PUBLIC SAFETY
Knox City Council has achieved a significant prosecution under the Food Act, after the former proprietors of a Wantirna South restaurant plead guilty to twelve charges related to the condition of the premises, food safety and hygiene practices. The two people charged had been directors of a company which had been the proprietor of Wantirna South restaurant Paesano’s.
Magistrate Starvaggi at the Ringwood Magistrates’ Court indicated that he wanted to send a strong message to the industry and fined each of the accused $25,000 with conviction, as well as an order to pay costs of $271.40 each.
Paesano’s restaurant was closed in May 2019. The accused informed the court that the company had gone into liquidation and that they were bankrupt, however they are still involved in another food business. RESIDENTS TO HAVE THEIR SAY ON PROPOSED LAW Residents will be invited to provide feedback on the proposed Amenity Local Law 2020, to have their say on the issues impacting the community as part of a review of the General Provisions Local Law 2010 in Knox. Local laws empower Council to maintain peace and order, promote health and safety by removing hazards, manage community nuisances and improve quality of life for the whole Knox community. The Local law deals with many aspects of our day-to-day lives including waste collection, overhanging trees, neighbourhood amenity and your property, the keeping of animals, and the use and protection of Council land and roads.
