SETTING UP A TRUST FUND
IT PAYS TO THINK AHEAD
The news story earlier this year regarding a dispute regarding the inheritance of Elizabeth Hurley’s son Damian has highlighted an issue around trusts and how they are set up, and the importance of using a professional financial adviser, says Rob Wood, Independent Financial Adviser at Scrutton Bland.
D
amian Hurley’s American grandfather is Peter Bing, who set up a family trust in 1980 for the benefit of his future grandchildren, and to minimise his estate’s tax liabilities after his death. However around twenty years later, Peter’s son Steve Bing went on to have two children in ‘non-exclusive’ relationships with two different women, one of whom was Elizabeth Hurley. Neither of the two children spent much time in the family home. In fact, Steve Bing initially claimed that Elizabeth’s son Damian was not his child – although this was quickly disproven in a paternity test. The dispute arose when Steve Bing’s other child, Kira Kerkorian, started making enquiries about her entitlement under her grandfather’s trust. This in turn led to one of the trustees seeking clarification of Peter Bing’s intentions, as Peter said when he drew up the trust almost forty years ago, he intended that the term ‘grandchildren’ did not mean children who had been born out of wedlock and who had not spent a substantial part of their lives in the family home. The quarrel quickly escalated and went to court, where a Californian judge declared that there was no ambiguity, and that the term ‘grandchildren’ was applicable, whether or not their parents were married at the time, and irrespective of how often they had visited the family home; so Damian and his stepsister Kira will both be eligible beneficiaries when the time comes. The Hurley case raises an important point, which is equally applicable in the US and UK, namely the importance of being absolutely clear about your objectives

when drawing up a trust to protect your assets and to benefit your family after you have died. Getting legal and financial advice is paramount, and working with a trusted financial adviser and tax professional will help to ensure that your wishes are laid out in the correct way. It is also vital to keep the terms of the trust applicable to your life as it evolves, and your circumstances change. Trusts are complex arrangements and when setting them up you need to be unequivocal in your intentions, to avoid any misunderstandings or disputes further down the line. This is especially true if you wish for your blood relatives to benefit from your estate. There have been numerous cases where a beneficiary or beneficiaries of a trust have divorced and remarried, which can cause problems when the trust needs to be distributed. For example this is a situation which occurred at Scrutton Bland: • A trust fund was set up several years ago by our client Mr W to leave a sizeable sum of money to his daughter. • The daughter married but there were no children. • The daughter then died, and her will left everything to her husband who inherited her trust fund. • The husband then remarried and had children with his second wife. They moved away and have lost touch with Mr W. • The trust fund is now eligible to be inherited by children of the second marriage, who are no relation to the client – and he is powerless to prevent this happening.

Pupils achieved 100% passes in Art, Biology, Chemistry, English Literature, French, History, Physics and Spanish. At Normanhurst, 89% of grades achieved were at grade 4 or above, with a quarter at grades 7-9, equivalent to the previous grades A*or A. Pupils achieved 100% passes in Art, Business Studies, Computer Science, French, Geography, Graphics, History, Spanish, Biology, Chemistry and Physics. We were delighted with both sets of GCSE results, which are a testament to our pupils’ hard work and commitment as well as the dedication and expertise of their teachers. Q: Where do pupils go when they have to leave Braeside and Normanhurst at 16? A: We prepare our pupils for next stage of their education and for a variety of courses. Most move to local schools in the area, which are either selective independent sixth forms (often with scholarships), grammar schools or local state schools or colleges.

Launches at wellbeing hub, eccleston yards
Belgravia’s Eccleston Yards will host a free, chromotherapy-inspired light installation from 28 November – 11 January Created by artists Squidsoup, ‘Wave’ will suspend 500 individual lit orbs with 500 individual voices in a range of colours

his Christmas, Eccleston Yards – the hub for independent retail, wellbeing and coworking developed by Grosvenor Britain & Ireland (‘Grosvenor’) – will illuminate its courtyard with a multi-sensory light installation, titled ‘Wave’. The installation will debut at the London destination from 28 November - 11 January this year, and has been created by internationally renowned artists, Squidsoup. ‘Wave’ will offer visitors an interactive light and voice experience that explores the wonders of colourful illuminations, taking inspiration from the ancient healing concept of Chromotherapy: the science of using the powers of light and colour to balance energy in the body and mind. With 500 individually suspended orbs, each with a unique voice, ‘Wave’ is an all-encompassing, immersive experience that will light up Eccleston Yards and contribute to a calming energy balance for the visitor – synonymous with the wellbeing ethos of Eccleston Yards. Visitors will find themselves entranced as they walk through the installation, listening to evolving hypnotic harmonies created by the orbs. The vibrations projected by the different orbs will energise the body (orange), stimulate happiness (yellow) and calm the heart rate (blue). PEDAL POWER FOR HOSPICE
Cyclists ride 55 miles from city to sea to raise funds for children’s hospice
A
team of 11 cyclists completed the London to Brighton bike ride on Sunday, 15 September in aid of Haven House Children’s Hospice. Neil Leahy, Michael Woolley, Rory Patterson, Chris Marsh, Bradley Gale, Ralph Cox, Scarlett Louka, Nicholas Bowerbank, Dan Lion, Damien Barnecutt and Arhon Ankhkara completed the 55-mile route on one of the warmest days of September. Participants set off south of the capital, down into the beautiful countryside of Surrey and Sussex, up to the stunning views of Burgess Hill summit and then down to Brighton’s seafront where they were met with a symphony of cheering and applause from the crowds. So far, the team have collectively raised an incredible £5,000, for the Woodford Green based charity, that provides specialist care for seriously ill children and their families. Sophie Bragg, Haven House’s Events Fundraising Officer, said: “I’d like to say a massive thank you to all
We are working with Haven House because of the incredible work they do the cyclists for taking part in this challenge on behalf of Haven House. Every penny raised helps us support children and their families facing the toughest of times. “We are truly grateful to all the Haven House champions who took part. Neil, Michael, Chris and Bradley from the firm on Forest Drive, Theydon Bois raised £2,500 by taking part in the popular bicycle challenge. “Our philosophy is simple,” said Neil Leahy, managing director, of Butler & Stag. “As well as giving our clients and customers a first-class service we like to give something back to local community projects and charities that need our help.” Woodford Green businessowner Dan Lions also completed the ride. This is the first of a string of challenges he and his team are undertaking in a bid to raise £1,000 for Haven House. Dan, owner of Holiday Designers, said: “We operate an established and successful independent travel business locally and feel it’s important to give something back to the community. “We are working with Haven House because of the incredible work they do. We will be really pushing the limits with what we have set ourselves both as a team and individually, but we remain focused on raising our target and nothing will stop us.”

Selfridges London’s biggest triple-sided window at the corner of Oxford Street and Orchard Street showcases the feast of Christmas from the Selfridges Food Hall, featuring a magical shipwrecked feast amongst the waves, with giant magical moon and moving boat and oars. • Over 85,000 Christmas baubles, with many reused from existing displays are hung across the stores’ balconies and ceilings. • Snow globes across all stores each contain over 40kg of biodegradable confetti • 13,000 paper decorations hung across the stores’ ceilings • A giant 1.5 tonne, 13 meter high mirrored Christmas tree hangs in the Oxford street store’s central atrium – it will come alive through a dazzling lighting show projected on its surface • Over 100 metres electric cabling was used to install the handrail atrium decoration framing the giant Christmas tree • Over 100 bespoke mirrored Christmas trees in

lthough most families would like elderly relatives to live within their own home, there may be circumstances where it would be safer in residential care. They might need to be closely monitored and have access to extra facilities, security and medical attention that is not possible from home. So many older people are lonely, sitting on their own waiting for a call, a visit or invite to somewhere. When you are working, looking after a family and busy with life, time can fly but when you’re alone, time can be slow and painful and it is easy to slip into a routine of not cooking, not caring about yourself, forgetting to take medication and a gradual sink into apathy. JUMPING UP THE LADDER WITH HELP TO BUY M oving from shared rental accommodation to owning a three-bedroom semi-detached house could seem like an impossible dream for a first-time buyer. Through Help to Buy, this has become a reality for Alex Stokoe, a financial controller working in Mayfair. “I’ve gone from living with four lads to having my own space in which I can do whatever I like,” says Alex. “It was a great time but I’m really looking forward to the small things like cooking for myself and just chilling out in the evening.” Alex originally lived in the Isle of Man and has spent the last few years renting in central areas of London. “I started the job I’m in about five months ago and really thought it was time to stop wasting cash on rent. Although I work in London, I was happy to move out providing the travel connections were good. I could have probably afforded to get on the ladder without Help to Buy but definitely not to the standard of accommodation that I have now. I looked at some older properties but I felt that it was a risk because there could be issues with damp or other work requiring a lot of cash. With new build, you get a warranty so a lot of this worry has been removed.” Once Alex had settled on a new build, he visited quite a few developments but wasn’t keen on the size and scale of them. “I knew I wanted a three-bedroom property because my girlfriend will probably move in soon,” says Alex. “The plan is to stay at least five years so if we want to start a family, we also have the space. But a lot of the developments we visited were huge and wouldn’t be finished for a number of years, so if we do decide to sell, it will be harder to compete with the brand new property on the same development.” Award-winning developer Higgins Homes is skilled in creating boutique developments. When Alex visited Parva Green in Broomfield Village just outside Chelmsford, featuring 27 two, three and four bedroom houses, he knew almost instantly that it was going to be a good fit. “I plan to cycle to the station to get the train to London

but when the weather is horrible, I needed to know there are other transport options available,” says Alex. “There are busses that go to the station at Chelmsford just a short walk from Parva Green and there are regular trains going directly to Liverpool Street.” When Alex and his girlfriend Sarah visited Parva Green, there was a good choice of three-bedroom properties for them to view. “We settled on our house quite quickly for a number of reasons,” says Alex. “It has a big garden and Sarah has lots of pets; rabbits, guinea pigs and cats, so she was particularly keen. The position was perfect too; quiet with nice views. Inside, the home will adapt to our needs; it’s great to have a kitchen that gives us plenty of space to cook and the interior design has been done so well with double doors opening to the lounge to create lots of space and light.” As a first-time buyer, Alex was unsure of how stressful the process would be. “I know people who put in an offer before me and they still haven’t got the keys,” he says. “I didn’t really know what to expect but it really has been a very straightforward transaction. The house is totally to their taste so apart from sorting the broadband, buying a sofa and some other interior touches, all that’s left is for them to explore the area. “I’m going to join the cycling club and I have a few friends that play for Essex Cricket Club so I’m looking forward to finding out more about the area. The shops and night life look good, with plenty of restaurants and pubs, so I’m not at all sad to be leaving London because the atmosphere here is great.”
