Gay Attorney Named No. 3 at U.S. Justice Department WASHINGTON — Stuart Delery, head of the Justice Department’s Civil Division for the past two and a half years, will become acting associate attorney general following the departure of Tony West, expected later this month. Delery reached prominence when he argued at the appellate level in the United States v. Windsor case, which ultimately progressed to the Supreme Court. That court ruled the federal ban on same-sex marriage was unconstitutional. Delery is openly gay, and thanked his partner during the Senate confirmation hearing to his current position. The announcement was made last Friday by Attorney General Eric Holder, adding “I look forward to his

Winston-Salem Recognizes Same-Sex Marriages for Benefits

this bible belt state which will recognize municipal workers’ out-of-state same-sex marriages for the purpose of employee benefits, according to the Winston-Salem Journal. In a letter sent to city employees Aug. 28, Human Resources Director Carmen Caruth said that the city would recognize marriage licenses from any state or U.S. jurisdiction for all city benefits, regardless of whether the couple is of the same or opposite sexes, the Winston-Salem Journal said in an exclusive story. That decision went into effect immediately. Caruth cited a ruling by the 4th U.S. Circuit Court of Appeals that overturned a gay-marriage ban in Virginia and a recent statement by N.C. Attorney General Roy Cooper that he would no longer defend the marriage amendment to the state constitution, which was passed in 2012 with 61 percent of voters voting in favor. “This means that if you are currently married to someone of the same sex, and have a valid marriage license from any state or U.S. jurisdiction, you can enroll your same sex spouse and children in all city benefits …” Caruth told employees in the letter. The city has also set up a special enrollment period, ending Oct. 31, for any employees who are qualified and want to enroll.

SAN FRANCISCO — Lambda Legal senior attorney Tara Borelli told a three-judge panel at the 9th Circuit Court of Appeals that the ban on marriage for same-sex couples in Nevada must be struck down as unconstitutional. She spoke on behalf of the eight couples we represent, and on behalf of all samesex couples in Nevada who deserve the freedom to marry. Many of the plaintiffs from Nevada were in the courtroom, including Beverly Sevcik and Mary Baranovich, now in their seventies, who have been together for more than 40 years. They committed their lives to each other on October 2, 1971! They raised three children and are now the proud grandmothers of four grandchildren. They have seen each other through thick and thin, and they want to commemorate their love for each other as other couples are entitled to do--through marriage. This is the second time in two weeks that Lambda Legal has presented oral arguments for marriage equality before a federal appeals court — the courts that are just one step away from the U.S. Supreme Court. On Thursday, Lambda Legal joined the ACLU won

a unanimous decision striking down the marriage bans in Indiana and Wisconsin. The 9th Circuit Court of Appeals in San Francisco also heard arguments today in a marriage case in Idaho brought by attorney Deborah Ferguson and our colleagues at the National Center for Lesbian Rights. Excluding same-sex couples from marriage, whether they live in Nevada or Idaho, is wrong and unconstitutional.

More Same-Sex Marriage Appeals: Bondi Does it Again TALLAHASSEE — Appeals have been filed by Florida State Attorney General Pam Bondi on behalf of Florida’s Surgeon General Dr. John H. Armstrong, Secretary of Management Services Craig J. Nichols and Washington County Clerk of Court Harold Bazzell. Each of the defendants had been named as parties to a lawsuit in which U.S. District Judge Robert L. Hinkle in Tallahassee ruled last Aug. 21 violated that the 14th Amendment’s guarantees of equal protection and due process. Hinkle issued a stay delaying the effect of his order, meaning no marriage licenses would be immediately issued for gay couples. The latest appeal means that that stay

now is in effect until the case can be heard before the 11th U.S. Circuit Court of Appeals in Atlanta. The latest Florida ruling came in a pair of lawsuits that brought by gay couples seeking to marry in Florida and others who want to force Florida to recognize gay marriages performed legally in other states. One of the litigants, Arlene Goldberg, lost her wife and partner of 47 years, Carol Goldwasser. Because Florida won’t recognize their marriage, Arlene experienced both the humiliation of not being listed as Carol’s wife on the death certificate and was denied the full social security benefits they had earned as a couple. The discriminatory denial of her benefits is especially cruel as it contributed to Arlene losing the home she and Carol had shared. Judge Hinkle ruled that there was no public interest in further denying Arlene the simple human dignity of

being listed on her wife Carol’s death certificate. Pam Bondi disagreed. Currently, 19 states and the District of Columbia permit same-sex marriage.

Police Shoot and Kill Despondent Man in Wilton Manors WILTON MANORS--Police in Wilton Manors shot a man carrying a gun on Sunday afternoon outside a Northwest Ninth Terrace residence. It is unclear what prompted the call to the police. Preliminary reports stated that the man was holding his roommates hostage inside the house. Later accounts reported that he was locked out of the house and was threatening to kill himself. The man was confronted by the police when they arrived. According to the police, he was told to drop his weapon. Broward Sheriff spokeswoman Dani Moschella told South Florida Sun Sentinel, “Neighbors told our investigators [the man] said ‘Shoot me, just shoot me.’” Two police officers shot the man “as he was approaching with the firearm in his hand,” Police Chief Paul O’Connell told reporters at the scene. “The officers had no choice,” he said. The wounded Wilton Manors man

was then taken to Broward Medical Center in Fort Lauderdale, where he was later pronounced dead. He was identified as Thomas Carberry, 50, who was a guest in the home of David Dlouhy and his partner Terry Cooley. Carberry had lived with the couple for nearly eight months, and was reportedly despondent over a recent diagnosis of Hepatitis C.

Domestic Partnership Affidavits Now Accepted by Orange County Clerk of the Courts ORANGE COUNTY, FL — The Orange County Clerk of Courts, Eddie Fernandez, announced on Monday that his office will begin accepting Orange County domestic partnership affidavits. Making the announcement from the steps of the Orange County Courthouse, Fernandez said that any domestic partners who care to will be able to now register at the five office locations of the Clerk of the Courts. In 2012, Orange County leaders voted to create the registry, which grants domestic partners accommodations, including hospital visitation rights, and guardianship privileges. Prior to Monday’s announcement, the Comptroller’s Office was the only location in the county where affidavits were accepted. “Thousands of visitors walk through our doors every day to conduct business with us and it’s gratifying to be able to offer yet one more service to our customers,’’ said Fernandez. Orange County Mayor Teresa Jacobs, who attended the announcement, said she fully supports Fernandez’s decision. “I applaud Eddie Fernández’ leadership,’’ she said. “His commitment to the betterment of Orange County is admirable, as is his demonstrated commitment to fiscal accountability.’’ In addition to registering in person, an affidavit can be downloaded at myorangeclerk.com.

e admit it. We’re big fans of Ken Kelley. In case you’ve forgotten, or never knew, Ken owns Scandals Saloon, a local favorite of the line-dance crowd where cowboy hats and boots are considered de rigueur; as well as The Stable, the intimate levi/ leather club in Oakland Park. We watched as Ken mourned the death of his partner in life and business, Lloyd Pagels, last February. They were together for 35 years—nearly ten of which was spent running the two clubs—so “tragic loss” would seem an understatement. In March, Ken received the double whammy when he got the news that he was suffering from follicular lymphoma. Fortunately, after six rounds of chemo, he is recovering nicely. Since we all know that everything comes in “threes,” the Scandals/Stable regulars were just waiting for the final shoe to drop. They didn’t have to wait long for news surfaced in the past few months that WalMart had purchased the K-Mart store across the street from Scandals Saloon and was planning on building a SuperCenter on the property. Scandals Saloon has long used the K-Mart parking lot for its overflow, so the idea that the lot was about to be shut to traffic meant more potential drama. As with all things Scandals, however, there’s a blessing around every corner. Beginning October 1 (my father’s birthday, in case you want to buy Big Joe a present), you’ll notice the signs showing up for Tim Higgins’ East Coast Valet Inc. Yes, valet. Now, before you see $$ signs in a cartoon balloon over your heads, rest easy. While there will be a $5.00 fee for

You’ve got until November 2 until the place is cleared out, right down to the shelving. The building will then be totally gutted, such as has been done to the old Holsum Bakery Outlet store next door. (Check out the east side of the parking lot and look for a lawn green enough for croquet.) Then, you can expect a good six to eight months of building on the site, and another month to stock the store. All of which means that sometime before Thanksgiving of 2015, the mood of the neighborhood on the corner of NE 6th Avenue and Oakland Park Boulevard is going to change. That’s plenty of time for all the

WalMart haters to get on their soapboxes and wax poetic about the doom and gloom that the mega-retailer will bring to the surrounding mom and pops. No question that WalMart has an image problem, particularly after last year’s spontaneous employee picketing before its Black Friday sales event. It matters little if you are the nation’s largest retailer, or that’s you’ve managed to make $11 billion profit in the past year—particularly not if you’ve done it on the beaten backs of mistreated employees and wage inequities. For all its clout, WalMart still gets sued 5,000 times a year—or 17 times every day. That makes for a lot of unhappy employees. All of which brings us back to Ken Kelley, with his Scandals Saloon front and center right across the street. The bar is full of happy customers and smiling line-dancers—each one a potential WalMart customer. Save Money. Live Better. Visit Scandals (and The Stable too)….Until next week….

SAME-SEX DIVORCE NOW LEGAL IN BROWARD!

W

hen Heather Brassner, a lesbian from Lake Worth, wed her lover Megan Lade in a Vermont civil union on July 6, 2002, she could not have imagined that she was taking the first step toward legalizing same-sex divorce in Florida. Even officials in the state of Florida would have found it bizarre that, as of 1:30 p.m. Wednesday, September 10, Brassner will be granted her legal divorce from Lade—this in a state where samesex marriage is still illegal. In Brassner’s lawsuit, Brassner v. Lade, she alleges that four years ago, Lade cheated on her and then disappeared from her life. Despite hiring a private investigator to locate Lade, Brassner was unsuccessful and has no idea in which state Lade may now be living. When Brassner, an art dealer who has lived in Florida for the past fourteen years, attempted to get the state of Vermont to dissolve her civil union with Lade, she was told by Vermont that Lade had to provide a signed affidavit from Lade, affirming her knowledge of a pending divorce action. With Lade’s location unknown, such an affidavit was impossible to provide. It was then that Brassner decided to sue Lade for divorce in Broward County. With help from her attorney Nancy Brodzki, Brassner filed for divorce in September 2013. Eventually the case was assigned to the Broward County Circuit Court under Judge Dale Cohen, but since Florida does not recognize same-sex marriages or civil unions from other states, Cohen announced that he would need time to determine the

Last August 4, Cohen declared in favor of granting the divorce, but placed a hold on the decision for 30 days pending appeal. In announcing his decision, Cohen, by default, also ruled on the constitutionality of banning same-sex marriage. “To discriminate based on sexual orientation, to deny families equality, to stigmatize children and spouses, to hold some couples less worthy of legal benefits than others based on their sexual orientation is against all that this country holds dear, as it denies equal citizenship. Marriage is a well recognized fundamental right; all people should be entitled to enjoy its benefits,” Cohen wrote. “This Court finds that Florida’s ban

on same-sex marriage violates the guarantees of due process and equal protection under the laws,” Cohen ruled. “Florida’s prohibition on same-sex marriage denies some citizens, based on their sexual orientation, the fundamental right to marry, and does so without a legitimate state purpose. This Court finds these laws are unconstitutional and grants the Petitioner’s Motion For Declaratory Relief, declaring Florida’s ban on same-sex marriage unconstitutional.” Even though she was not a party to the lawsuit, Florida state attorney general Pam Bondi requested that Judge Cohen continue his stay on his ruling. At press time, Cohen had no response and planned on holding a hearing to confirm the divorce of Brassner from Lade at 1:30 p.m. today.

For her part, Brassner has moved on and plans on marrying her current girlfriend, Jennifer Feagin, and has stated she would love to have the ceremony in Florida, when the ban against samesex marriage in this state is lifted. In the meanwhile, Brassner has received her divorce in a state where she could not have been married. In theory, when Cohen decided in favor of Brassner, he also ruled in favor of same-sex marriage, leaving it up to county clerk Howard Forman whether or not to begin issuing marriage licenses. He suggested that he would announce a decision within days. “I’m researching it as quickly as I can. We’ve been researching it for months,” Forman said in a statement last week. “Florida’s changing a lot and we’re vetting the issue as hard as we can.”

A

few issues ago, we discussed how to avoid hotel fees. With airlines charging extra for just about everything now (“Oh, you wanted to ride inside the plane? That will be $50 extra”), it’s even more important to keep an eye on the little extras that add up. When comparing airfares, keep those extra fees in mind. It may make what appears to be a bargain more costly than standard fares on another line. Southwest still allows two free checked bags; JetBlue permits one. If you’re going on a long trip, that free baggage check may make a difference. See the sidebar for a list of baggage fees charged by the major air carriers. Also, keep in mind the weight limit for bags. It’s usually 50 lbs. and the costs for overage are significant, sometimes as much as $50 if even just a single pound over. I had a friend who dumped a bunch of t-shirts in the garbage rather than pay the weight charges. An easier way to deal with the situation is to hand the person checking in the luggage a tip. It’s amazing how a sawbuck or ten-spot can lighten a load. If you’re worried about excess baggage or carry-on charges, why not wear your extra items instead of cramming them into your suitcase? There are some fantastic products on the market that make carrying a few extra items on board a snap. These new garments, sometimes called “wearable luggage” or “luggage jackets” are essentially clothes with lots of pockets allowing you to “wear” many of your belongings. You’ll never win a fashion competition wearing one of these, but you only need to wear them as you board the plane. Airlines don’t count an article of clothing that you’re wearing as luggage. Hand the agent your boarding pass and saunter down the jetway. Once you’re on the plane, take off the jacket and store it in the overhead. Mission accomplished. The Rufus Roo Luggage Jacket ($49

• 2 tablespoons of butter •2 oz. of cognac, brandy, whiskey, or bourbon • 2 small shallots • 1 small onion • 1 tablespoon of flour •1 cup of beef or veal stock, or demi-glace (demi-glaze)

Melt the butter in a sauce pan and, after chopping the onion into small pieces, sauté it until it is nice and browned, then add the shallots (cooking quickly over high heat) until transparent, approximately two to three minutes. Sprinkle with a tablespoon of flour, and using a whisk, incorporate the liquor and the stock. Add the whole green peppercorns (to taste; the amount you use is up to you). Add the heavy cream. Bring the liquid back to the boil, and cook for three to five minutes (to thicken the sauce), stirring constantly. Taste and adjust seasoning. (Some chefs believe heavy cream doesn’t belong in the traditional steak au poivre recipe, although many restaurants and athome chefs include the cream. It does make the sauce so delectable. Voila! Use this sauce for steaks, chicken, duck— anything you can grill will be perfect with this sauce. You are the chef!

The faceless participants (faces are obscured when the camera comes in contact with them) run the gamut from gay to straight, cut to uncut, long to short, and pierced. One interview subject describes the penis as “brilliant technology,” a statement that is hard to dispute. Some of the stories are difficult.

Interviewees, described as “Craigslist subjects and participants,” spanning an age range from the 20s to the 70s, go through various stages of undress as the interview process progresses. They

long time in the making (no thanks to Barbra Streisand), the Emmy Award-winning movie adaptation of Larry Kramer’s difficult and devastating “The Normal Heart” (HBO Films) bows on DVD + Digital HD. The film opens in 1981 with the arrival, at the dock, of a boat to Fire Island Pines, followed soon after by the touchstone of the New York Times article about a rare cancer in homosexuals.

Writer Ned (Mark Ruffalo), a semi-autobiographical character based on Kramer, his hot boyfriend Felix (Matt Bomer), closeted exmarine/current financial guy Bruce (Taylor Kitsch, who is hereby forgiven for all of his past bad acting choices), Gay Men’s Health Crisis executive director Tommy (a brilliant Jim Parsons), and others navigate the frontlines of the battlefield. Meanwhile, the casualties continue to mount as these brave and brash men find ways to make their voices heard. “The Normal Heart” beats hard, loud and fast. Director Ryan Murphy holds his own here, even pulling some of his own trademark visual tricks out of his hat. He gets exceptional performances out of a well-intentioned, but miscast, Julia Roberts as AIDS research Dr. Emma Brookner. Additionally, Joe Mantello, as Ned’s friend Micky, and the aforementioned Kitsch, Bomer, Parsons, and, of course, Ruffalo deliver career-high performances. To his credit, Murphy also doesn’t shy away from the sex, some of which is depicted graphically, a necessary component of the story. As with HBO’s award-winning adaptation of Tony Kushner’s “Angels In America,” “The Normal Heart” found its audience in people’s homes, not in movie theaters. That’s probably best as “The Normal Heart” is a not-a-dryeye-in-the-house production. What queen wants to be seen leaving a movie theater with bloodshot eyes, tear-stained cheeks and a runny nose anyway? DVD special features include “How To Start A War,” a featurette about the true inspiration behind the film, including interviews with Kramer, Ruffalo, Roberts and others.

play it safe, Frankie is the kind of person shocked by anti-gay graffiti or when Todd (out actor Matthew Risch), a fellow male dancer, confesses to having had sex with men for money. The air is thick with fear and paranoia, as news stories on TV and on the front pages of newspapers and magazines stir up AIDS phobia. When he’s not rehearsing, trying to untangle his telephone cord, listening to cassettes on his Walkman or busy checking his skin for lesions, Frankie is setting traps for the mice invading his apartment; something akin to introducing the gun in the first act. Relegated to understudy, superstitious Frankie is anxious to prove himself to the critical choreographer. Nevertheless, he finds time to hook up with a neighbor, as well as Walt (Kristoffer Cusick), as well as maintain a steady flirtation with Todd, all the while literally and figuratively wringing his hands. Ultimately, Frankie faces his various tests – filling in for a lead dancer on stage, taking the blood test, buying a pet mouse, and beginning a relationship with Todd. Whether or not they can pass the test of monogamy remains to be seen. DVD bonus features include deleted scenes, theatrical trailer and more.

Papadosio is an innovative band melding progressive rock with psychedelia, folk with electronica, and dance music with jam. Born in the artistic city of Athens, OH, the quintet is now based out of Asheville, NC (another creative community), though spends most of the year on the road. Papadosio headlines shows in every region of the country and has become a staple of the festival circuit, performing at such festivals as All Good, Wakarusa, Electric Forest, Oregon Country Fair, Sonic Bloom, Bear Creek, and Envision Festival. English synth-pop duo Erasure has maintained a respectable career for almost thirty years. Openly gay lead singer Andy Bell is considered a gay icon, coming out in a less accepting time period. Connection Festival Jacksonville Jacksonville’s largest fall art and music festival features over eighty local and national musicians in up to five simultaneous venues. The show is an acrobatic tribute to the nomadic soul (the word varekai means “wherever” in the Romani language). The show focuses on the Greek myth of Icarus and reimagines Icarus’ story after flying too close to the sun and falling from the sky. I get it, we all lead busy lives that leave very little extra time for healthy meal prep, but the alternative of fast food meals, frozen dinners and restaurant fare is making us lose in the battle of the bulge. All too often I see people exercise hard every day, and then flush their results away with irresponsible eating. Don’t let this be you! To get you on the fast track to quick, healthy eating here are 5 healthy meals that take only 5 minutes to prepare: Fast Meal #1: Traditional pancakes are filled with carbs, grains and a plethora of simple sugars – not something you’d consider healthy. In fact, eat pancakes regularly and you’ll find your fitness results quickly disappear. However, this simple, wholesome, 3-ingredient pancake recipe is the exception. It’s a pancake that you’re able to enjoy without guilt. 3-Ingredient Pancakes Here’s what you need: 3 ripe bananas 2 eggs 3T ablespoons almond butter ½ t easpoon vanilla extract or ground cinnamon *optional Mash the bananas in a bowl (or blend in a food proces-

Add the zucchini, green onion, chives and rosemary. Cook until the zucchini is lightly browned on both sides. Crack the eggs into the skillet and continue to cook, mixing, until the eggs are set. Sure, there are plenty of ways to take a salad and make it fattening, but that’s not what we want to do. By taking a big bowl of fresh greens and topping it with lean protein, colorful veggies and a light, homemade dressing – you’ve got yourself the perfect meal! Everything Salad Here’s what you need: Dark leafy greens (spinach, arugula, kale) Lean protein (chicken, turkey, lamb, hard boiled egg) Colorful veggies, chopped (bell peppers, tomatoes, zucchini) Fresh Herbs (basil, rosemary, oregano, mint) Homemade dressing (see recipe below) Raid your fridge for fresh, organic produce and lean, cooked protein. Add in some fresh veggies and chopped herbs and mix together with a simple, homemade dressing. There you have it, the perfect meal! While eating healthy, nutritious meals is awesome, don’t forget that exercise is half of the battle when it comes to getting and staying fit.
