BREVARD COUNTY, FL. — A same-sex couple living in Florida who used their marriage license to change their names on their drivers’ licenses just received a letter from the Florida Department of Motor Vehicles warning them that they are both in danger of losing their licenses, according to Channel Nine Orlando. The warning came in the mail after WFTV in Channel 9 did a story on how Daniel and Scott Wall-Desousa managed to legally change their name
with an out-of-state marriage license. “It informs me and notifies me that my driving privileges will be canceled indefinitely as of Nov. 22,” said Daniel Wall-Desousa The Wall-Desousas successfully changed their names at the DMV by showing their marriage license. When Channel 9 reported on the name change, Scott Wall-Desousa said the clerk was told to not ask questions if the license was issued to a same-sex couple and simply grant the name change. “It is a ‘don’t ask, don’t tell’ policy, and I guess we have been told, ‘Here is the repercussion,’” said Scott Wall-Desousa. But their new last names are already on federal documents like Social Secu-
TALLAHASSEE, FL--Florida Attorney General Pam Bondi has filed an appeal with the Eleventh Circuit asking the court to consider ruling on Judge Robert Hinkle’s decision overturning the state’s ban on same-sex marriage. Last week, Hinkle announced that he would not lift the stay on his ruling before it is set to expire on January 5. The Eleventh Circuit also has jurisdiction over Alabama and Georgia — neither of which have marriage equality as yet. Here’s an excerpt from Bondi’s appeal: “Because no fundamental right is at issue, and because there is no other basis fro applying heightened scrutiny, only rational basis applies. Florida’s laws satisfy this deferential standard. Florida’s laws therefore do not violate the Due Process and Equal Protection Clauses of the Fourteenth Amendment. Nor do they violate the right to travel, the Establishment Clause, or a right to intimate association.”

Daniel Wall-Desousa questioned the timing of the letter, coming just a week after the couple spoke with Channel 9. “What does that say to you?” Channel 9 anchor Jorge Estevez asked. “It says it is a ‘don’t ask, don’t tell’ policy and that is offensive. It didn’t work once and it is not going to work again,” said Scott Wall-Desousa. The letter from Tallahassee was addressed to both men — by their hyphenated married name of Wall-Desousa.

U.S. Supreme Court Gets Same-Sex Marriage Cases The same-sex marriage constitutional controversy reached the Supreme Court last Monday in its simplest form, testing the constitutionality of a state’s denial of a right to marry for same-sex couples, according to Lyle Denniston, reporting on the ScotUSBlog. That is the sole issue raised in a new petition filed by a Michigan lesbian couple, April Deboer and Jayne Rowse, who want to marry and want the right for both parents to adopt their three children, identified only by their initials, N.D.-R., R.D.-R., and J.D.-R. Michigan denies both. The Michigan case had been fully tried in a Detroit federal courtroom over a nine-day trial, and, as such, is the ideal case for the Supreme Court to review according to the petition. Another case filed at the Court last Monday, from Kentucky, completed the round of appeals seeking to challenge the ruling November 6 by the U.S. Court of Appeals for the Sixth Circuit, upholding bans on marriage
and on marriage recognition in all four states in that court’s region. That ruling conflicted with decisions by four other federal appeals courts — usually, the situation that will lead to Supreme Court review. In the Michigan case, the couples’ lawyers told the Supreme Court that state officials had told them that the state would not oppose Supreme Court review of the issue. That was the same stance taken by state governments that were involved in the round of denials of review of same-sex marriage cases by the Court on October 6. At that time, however, there was no division within the federal appeals courts on the basic issue — a split now embodied in the Sixth Circuit’s ruling. With a total of four petitions filed in the six cases decided by the Sixth Circuit — the Ohio and Kentucky petitions are both joint filings in two cases — the stage is now set for the cases to be submitted to the Justices, as soon as state replies are filed in some or all of the cases. It thus appears that the cases have arrived at the Court in time — if review is,
indeed, granted — to be heard and decided in the Court’s current Term. To be heard and decided before the Justices complete this Term in late June or early July, the cases would have to be ready for the Justices to consider by mid-January. With the current split among federal appeals courts, it would be most surprising for the Court to refuse to hear any of this round of cases. It is up to the Justices to accept or deny each or all of the petitions. Here is the direct way the Michigan case framed the issue for the Court: “Whether a state violates the Fourteenth Amendment to the U.S. Constitution by denying same-sex couples the right to marry.” That is quite similar to the question that opponents of same-sex marriage raised before the Court — and the Court agreed to decide — in the case involving California’s ban on same-sex marriage: “Whether the Equal Protection Clause of the Fourteenth Amendment prohibits the State of California from defining marriage as the union of a man and a woman.” That case, however, ended without
an answer to the question, because the Court concluded that the sponsors of the California ban did not have a legal right (“standing”) to pursue the appeal (Hollingsworth v. Perry). There is no such problem for those appealing any of the new round of challenges to the Sixth Circuit’s decision. The new Kentucky case is slightly more complex than the one from Michigan, because it raises the separate issue whether same-sex couples who were married outside of the state have a right to have their unions official recognized. But that case, too, also raises the basic right to marry. In fact, the Kentucky petition urged the Court to take on the issue now “to settle the question first presented in Hollingsworth v. Perry.” Both of the new petitions challenge the Sixth Circuit’s decision, point by point, seeking to show that it conflicts directly on each point with rulings by four other federal appeals courts.

LANSING, MI--The Governor of Michigan is trying to void the marriages of more than 300 same-sex couples, who wed while marriage equality was briefly legal in the state. US District Judge Bernard Friedman struck down Michigan’s ban on samesex marriage in March leading clerks in several counties to immediately start performing marriages. The ban was put into place after 300 couples had already married – leaving them in legal limbo pending appeal – until the 6th Circuit Court of Appeals upheld the same-sex marriage ban last week. In filing in court last Monday, the state’s Republican governor Rick Snyder said that his administration will treat the marriages as if they “never existed.” State lawyers wrote: “The Sixth Circuit’s decision in DeBoer affirmed the validity of Michigan’s Marriage Amendment, which states, ‘[t]o secure and preserve the benefits of marriage for our society and for future generations of children, the union of one man and one woman in marriage shall be the only agreement recognized as a marriage or similar union for any purpose.’ “Now that the Sixth Circuit has reversed the district court’s decision in DeBoer, that condition cannot be met, and Plaintiffs’ marriages are therefore void. “It is as if the legal premise upon

which Plaintiffs’ marriages are based never existed. “Consequently, from a legal standpoint, because the marriages rested solely on the district court’s erroneous decision, which has now been reversed, it is as if the marriages never existed, and Plaintiffs’ requests for benefits attendant to a legal marriage must be denied.” The Sixth Circuit ruling is being appealed to the US Supreme Court, that is likely to take up the case as it creates a “circuit split.”

According to a White House official, Hardikar started last Monday as the new Associate Director of Public Engagement in the Office of Public Engagement. “In her role, she is the White House’s primary liaison to the LGBT community and Asian American and Pacific Islander (AAPI) community,” the official said, yesterday. Prior to joining the White House, she served as Director of the LGBT Leadership Council and Director of the AAPI Leadership Council for the Democratic National Committee, where she raised resources and mobilized community leaders around democratic issues. She also served as the LGBT Finance Director for the Presidential Inaugural Committee in 2013, and the Deputy Director of LGBT Voter Outreach and LGBT Finance for the 2012 ObamaBiden President Campaign. Aditi planned events and organized progressive young Americans for the Campus Progress team at the Center for American Progress in Washington. She also served as a White House intern in the Office of Public Engagement, where she worked on LGBT issues. A graduate of the University of Michigan-Ann Arbor, she earned her BA in Economics and Political Science. Raghavan welcomed the appointment of Hardikar to the White House. “Aditi has served President Obama for many years -- including on his 2012 campaign and at the DNC -- with distinction, integrity, and grace,” he was quoted in the Washington Blade. “She will bring fresh energy and perspective to the position and its portfolio. I also think it’s worth noting that she will be the first woman of color to serve as the White House LGBT Liaison -- reflecting the talent and diversity of the LGBT movement as well as this President’s Administration,” he said.

fficially it’s known as a Petition for Writ of Certiorari to the United States Court of Appeals for the Sixth Circuit. But to the layman, the move by petitioners April Deboer and Jayne Rowse as well as their adopted children N.D.-R., R.D.-R., and J.D.-R., is a plea to the Supreme Court of the United States to rule on same-sex marriage and the right of couples to adopt. Many would say the time is long overdue for the Supremies to get involved and settle this question once and for all. I am among them. It takes no small amount of courage, however, to put your lesbian relationship on view in front of the justices of the Supreme Court, but apparently April and Jayne have no qualms about the exposure they face. It is little wonder, however, for these two women are an amazing pair. The duo, who have been together for over a decade and long to get legally married in their native Michigan, are both nurses. April works as a nurse in a hospital neonatal unit tending to newborns with medical problems. Jayne works as a nurse in a hospital emergency room. No pansies here. Their adoptive children are quite the story as well. All three children were born to mothers with serious challenges, and two of the three children qualified as “special needs.” N was born on January 25, 2009, and his mother subsequently surrendered her legal rights to him. April and Jayne volunteered to care for the boy and brought him into their home following his birth. In November 2009, Jayne completed the necessary steps to adopt N legally. J was born on November 9, 2009, premature at 25 weeks. At birth, he weighed 1 pound, 9 ounces, and tested

positive for marijuana, cocaine, opiates and methadone. His birth mother abandoned him immediately after delivery. J remained in the hospital Neonatal Intensive Care Unit for four months with multiple health complications, and he was not expected to live. But he turned out to be a scrappy guy, though he was not expected to be able to walk, speak or function on a normal level in any capacity. His condition required around-theclock care from April, Jayne and other skilled therapists. Despite the uphill climb the baby faced, Jayne also legally adopted him after having first serving as his foster parent and legal guardian with April. Their third child, R, was born on February 1, 2010, to a nineteen year-old woman who had received no prenatal care and who gave birth at her mother’s home before bringing the infant to the hospital where April worked. R experienced issues related to her lack of prenatal care, including delayed gross motor skills. She needed a physical therapy program to address these problems. In this case, April adopted the baby girl. Now, with April and Jayne’s skilled and loving care, all three children are now thriving. It is interesting to note that all the lesbian couple originally wanted to do
when they filed suit in Detroit was gain the right to jointly adopt these children. Michigan law allows married and single people to adopt children, but not unwed couples wanting to adopt each other’s kids. But as the case progressed, April and Jayne added a plea to legally be wed in their home state as well. When other states started to allow same-sex marriages, Michigan went into high gear to protect the “integrity of marriage.” Not only did they declare that a marriage can only exist between a man and a woman, the state went further with subsequent legislation making it illegal to attempt to overturn the law. After a nine-day trial, the district court concluded that Michigan’s exclusion of same-sex couples from marriage violates equal protection because it is not rationally related to the advancement of “any conceivable legitimate state interest.” Yet, despite their decisive win, the state refused to give in and amazingly won the case on appeal. Hence the move to the U.S. Supreme Court, where the next chapter of the saga is certain to be written. A standing ovation to April and Jayne…Until next week….

It wasn’t until 10 a.m. Saturday morning that he heard the unbelievable truth: his brother was dead. News of the fatal accident was not shared with most bikers on the Smart Ride, who didn’t learn of the tragedy until safely completely their trek in Key West. “He died instantly… after the best day and the best ride of his life,” his nephew Matthew Haines said. As the news spread, many took to the Internet to share their fond memories of a man who was determined to help the LGBT community however he could.

t is still hard to believe. Mark Haines is dead. The LGBT activist and founder of the popular website, Mark’s List, was struck down in his prime at age 54. Mark was hit by a truck while attempting to cross Highway 1 in Duck Key. He was near mile marker 59, a particularly dark part of the only road in and out of the Florida Keys. Thrown toward the road’s center by the impact, Mark was subsequently hit by two SUVs, each trying to swerve out of the way of the truck, each unaware that he was in their path. I knew and worked with Mark for years, culminating in his brief tenure as the editor-in-chief of Mark Magazine. He was then, as always, spirited, determined and quite the eccentric— his long blond mane of hair whipping around his face as he bicycled to work and back home along the streets of Wilton Manors. And it was on his bike that I last saw Mark less than a week ago, as he screeched to a halt to allow two ducks to cross the road behind the local Dairy Queen. We talked briefly about his astonishing weight loss—some 70 pounds over the past year. Ironically, he was motivated to lose the weight in preparation for the Smart Ride, the annual 195 biking event that travels from Miami to Key West over a two-day period. It was going to be Mark’s first time riding, and he hit me up for a $100 donation for the fundraiser which ultimately earned $1,109,924 this year for HIV/ AIDS foundations. Mark had just finished the first leg of the trip, and celebrated with dinner at Hawk’s Key Resort where the day’s ride ended. With him was his brother, Jim, who had traveled from his hometown of Lawrence, Kansas, to participate in the Smart Ride. When Jim left the dinner to walk to their motel room

horned Maleficent encounters her first human, Stephan. An unlikely friendship develops. As they grow older, Maleficent (Angelina Jolie, born, I say, born to play this part) remains true to her spirit, while Stephan (a miserably miscast Sharlto Copley) goes the way of many humans (take your pick from bad, wrong, greedy or evil). When an embarrassed and dying king (whose attempt to invade the moors was halted by Maleficent) offers his kingdom to whomever can slaughter the fairy and avenge his crown, Stephan uses his established relationship with Maleficent to trick her, drug her and then clip her wings. With Maleficent’s wings in hand, Stephan ascends to the throne. Meanwhile, Maleficent convalesces in agony. When King Stephan and his wife have a baby – a girl named Aurora – Maleficent gets her revenge by cursing the baby. On her 16th birthday, Aurora will prick her finger on a spinning wheel’s needle and fall into an endless sleep, thus
becoming Sleeping Beauty. Wouldn’t this be a good place to put an unlikely and unexpected friendship? That’s what develops between Maleficent, who has been keeping a watchful eye on the future princess, the teenage Aurora (Elle Fanning), who mistakenly thinks that Maleficent is her fairy godmother (cute, huh?). The introduction of the very handsome Prince Phillip (Brenton Thwaites), turns out to be a red herring. The true love’s kiss that awakens Aurora from the sleep of her irrevocable curse comes from the most unpredictable place (yeah, right!). First-time director Robert Stromberg probably hoped that Maleficent would have the same appeal as say, the stage musical Wicked. The closest it comes is to that is that it’s wickedly awful. Included in the Blu-ray combo pack bonus features are several deleted scenes, numerous featurettes including “Classic Couture,” focused on Maleficent’s fashion accessories, and more.

aleficent (Disney), a movie that belongs in the same Disney trash heap as 2013’s Oz The Great and Powerful and 2010’s Alice In Wonderland, is a malfunctioning reimagining of a classic character’s beginnings. A derivative and clichéd story that takes far too many liberties, weighed down by tired special effects (haven’t we seen these mythical creatures somewhere before?), Maleficent raises a frightening question. Has Disney run out of fresh ideas? Intending to tell an “old story anew” (because who would actually want to see a new story anew?), Maleficent begins with the discord between two kingdoms, lazily described through narration. One kingdom, occupied by humans, wants nothing more than to add to their empire. The other kingdom, The Moors, bursts at the seams with peaceful and magical creatures basking in the glories of nature. As a young girl, the winged and

itular slumbering Princess Aurora (voiced by Mary Costa) may not look a year over 16, but Walt Disney’s animated classic Sleeping Beauty (Disney), now available in a Diamond Edition Blu-ray+DVD+Digital HD version, turned 55 this year. Of course, this occurred in the same year that the unfortunate live-action Maleficent malignancy (see below) was released. Fear not, “Sleeping Beauty” remains untarnished. Newfangled digital tech makes Sleeping Beauty look as good as new. The tale of shunned fairy Maleficent (voiced by Eleanor Audley) who places a curse on a baby princess and the efforts to prevent the curse from occurring, have serious and comic effects. Princess Aurora, raised in secrecy in a cottage by three good fairies (our favorite kind!) – Flora (voiceover queen Verna Felton), Fauna (voiced by Barbara Jo Allen) and Merryweather (voiced by Barbara Luddy) – accidentally meets the man of her dreams, dreamy Prince Phillip (voiced by Bill Shirley), but doesn’t realize he’s her betrothed until it’s too late. To be honest, Sleeping Beauty has enough scary moments to spook an adult, let alone children. Maleficent’s malevolence knows no bounds, as she makes reference to hell (!), turns into a dragon, keeps Prince Phillip in bondage (!) and generally wreaks thorny and stormy havoc on the kingdom. In the pre-PC era in which this ‘toon was made, intoxication and incapacitation are sources of silliness, but there’s a reason this Disney classic has endured and this Diamond Edition is as good a reason as any to experience it again (and again). “Beautyful” bonus material includes deleted scenes, karaoke and several featurettes.

Kauai
Kauai was Hawaii’s original premiere visitor destination, and was the first place in Hawaii to be visited by European explorers. It is a draw for tourists wanting to explore nature and wildlife more than wild nightlife. Kauai is home to grand waterfalls, narrow sea cliffs, crystal white sand beaches, and dark red clay canyons. Because the island is so small, there is not really much of a gay scene, but there’s still an active GLBT community, which gathers at the Sand Bar at the Aston Islander hotel for happy hour.

Mahina Kai Ocean Villa (4933 Aliomanu Rd., 800337-1134) is a gay guesthouse that has undergone a complete makeover (and it was pretty good to begin with) with Asian influences evident throughout. Try to book “The Tea House,” a separate building up the hill from the others with a panoramic ocean view, outdoor bathroom and a bamboo shower. The pool, which looks like a natural pond, is clothing optional.

Tortilla Republic (2829 Ala Kalanikaumaka St. Koloa, 808-742-8884) is a small chain (with locations in Laguna Beach and West Hollywood as well) which offers inventive Mexican fare, utilizing all natural meats and organic and locally grown produce. Gaylords at Kilohana (32087 Kaumualii Hwy., Lihue, 808-245-9593) is an upscale restaurant with a nice wine list and is a bit more upscale. The extensive brunch buffet on Sunday is fabulous, and don’t pass up the legendary banana cream pie!

Lava’s (2440 Hoonani Rd., Poipu Beach, Koloa, 808742-1661) in the Sheraton Kauai Resort is a great place to catch a great sunset while enjoying a cocktail, especially the Lilikoi Lemonade.

Also known as The Big Island, Hawaii is larger than the other islands combined. Hawaii Island has two active volcanoes, soaring mountain peaks, striking lava formations and beautiful sandy beaches. It is also home to some of the state’s biggest cities, has plenty of nightlife options and an active GLBT community.

Molokai
The fifth largest island in the chain is covered with lush vegetation and wet forests that receive over 300 inches of rainfall per year on the eastern half of the island, while the western half of the island is nearly barren. Small and visitorfriendly, Molokai is good for those looking for a low-key escape from the touristy hubbub you’ll find on some of the other islands. As for GLBT community, you won’t really find much of an organized one. You may meet some folks at One Alii I Park or Dixie Maru Beach.

207 Kaunakakai Condo (1000 Kam V Hwy, Kaunakakai, 541563-4209), the one bedroom (king bed), one bath condo has a wonderful ocean view, a pool and is centrally located. Hotel Moloka’i (1300 Kamehameha V Hwy., Kaunakakai, 808553-5347) and its popular restaurant, Hula Shores, closed after a fire, but will reopen by the end of 2014. Dine Most of your dining options will be at the few hotels on the island. Kualapuu Cookhouse (102 Farrington Ave, Kualapuu, 808-567-9655) is by far the best non-hotel affiliated restaurant on the island. Doesn’t look like much, but you’ll leave happy and full. Paddler’s Inn (10 Mohala St., Kaunakakai, 808-553-5256) offers good, plain cooking, seafood is usually a good bet and Outpost Natural Foods’ (70 Makaena Pl, Kaunakakai, 808-553-3377) lunch counter keeps odd hours, but the burrito is pretty damn good.

JACKSON: The chiropractic profession, I believe, dates back to 1895. How has the profession changed in recent history? DR. LASSITER: Chiropractic was founded with a structural and wellness focus on care. However, we marketed ourselves as a neck and back pain profession [which] significantly limited our ability to help people. With changes in healthcare, people are seeking various treatments and therapies to help with a variety of health issues. In some cases, chiropractic has helped people with problems such as headache, sinus congestion, bowel/ bladder issues, acid reflux, infertility, hypertension, even increasing the CD4 (T-cell) count in immune compromised individuals, such as those with HIV/AIDS. People ask how chiropractic helps with these issues, and the answer is simple: improved function of the nervous system. The nervous system controls all functions of the body. By maintaining proper alignment of the spine, we allow the nerves exiting the spine to communicate and function without interference, thus allowing optimum function and performance.
JACKSON: What is the difference between physical therapy and chiropractic? DR. LASSITER: Doctors of Chiropractic are considered primary care physicians, which means a patient can be seen by a chiropractor without a referral. Physical therapists require a referral from an MD in order for insurance reimbursement. Physical therapy tends to be rehabilitation post surgery or post injury. Chiropractic focuses on the correction of subluxation (misalignment of the spine) through the use of chiropractic adjustments. Physical therapy focuses on primarily on musculoskeletal issues, whereas chiropractic focuses on optimum function of the nervous system through specific spinal adjustments. JACKSON: There’s been a wellpublicized crackdown in South Florida on pain management clinics. What are the alternatives for someone suffering from chronic pain? DR. LASSITER: As a chiropractor, we consistently see patients that present acute to chronic pain conditions and treat them with much success. Other forms of pain
management that I have recommended to patients include massage therapy, physical therapy, acupuncture, and aroma therapy. JACKSON: There has been an upsurge in liposuction treatments in recent years with several new non-surgical procedures hitting the market. What is the ultrasound liposuction procedure you perform and how is it different from other treatments? DR. LASSITER: Our office provides a non-surgical, non-invasive, painless way to address areas of stubborn fat and cellulite. We utilize a process known as ultrasound cavitation. Essentially, we are using ultrasound to break up target fat cells. The cellular waste is then absorbed by the lymphatics, filtered through the liver and kidneys, and naturally eliminated from the body. Ultrasound Liposuction is often compared to CoolSculpting. Many patients state that Cool– Sculpting is uncomfortable due to the suction and the extreme temperature. Another difference is the price point with Ultrasound Liposuction being a more affordable option.
JACKSON: How safe is this procedure and what are the risks? DR. LASSITER: Ultrasound Liposuction is an extremely safe procedure. The only documented risks have been hypo/hyperpigmentation, which means that the patient may notice some redness post treatment. If the patient experiences any redness of the skin, it usually subsides within 10 to 15 minutes. JACKSON: Is this procedure appropriate for everyone? DR. LASSITER: No. When patients arrive for their first visit, we perform an exam and consultation. During the consultation, we ensure that the patient does not have any problems that could be exacerbated or irritated by the treatment. Ultrasound Liposuction is not for anyone who is pregnant or lactating, anyone with epilepsy, persons with a pacemaker, persons with uncontrolled hypertension, liver or kidney problems, thyroid gland dysfunction, photosensitivity, persons taking drugs that cause photosensitivity, persons with Herpes Simplex, persons with a compromised immune system, or persons who have cancer or a history of cancer.
