Steinmetz passed away early in the morning on Dec. 5 after a battle with brain cancer. “It pays to be a good guy and Cal was always the good guy,” said friend and fellow attorney Miriam Richter. “There wasn’t a mean or nasty bone in his body. I don’t think he ever ticked off anyone off except opposing counsel.” Steinmetz handled everything from minor criminal defense to

ATLANTA, GA — The U.S. Court of Appeals for the Eleventh Circuit has denied a request by the state of Florida to extend a stay blocking a federal judge’s ruling that struck down that state’s ban on same-sex marriage.U.S. District Judge Robert Hinkle in August ruled the Florida gay marriage ban was unconstitutional. But he stayed the effect of his decision until the end-of-day on January 5, hoping to avoid confusion while the state filed its appeal.In November, Florida Attorney General Pam Bondi sought to extend the stay while she appealed

MIAMI — The Miami-Dade County Commission voted 8-3 to amend the existing Human Rights Ordinance to prohibit discrimination in housing, public accommodations and employment based on gender identity or gender expression. Sponsored by Commissioners Audrey M. Edmonson, Bruno A. Barreiro, Daniella Levine Cava, Sally A. Heyman, Barbara J. Jordan and Dennis C. Moss (who couldn’t be present to vote), the amendment also received “yes” votes from Commissioners Rebeca Sosa, Xavier L. Suarez, and Jean Monestine. Commissioners Esteban Bovo, Jr., Jose “Pepe” Diaz and Juan C. Zapata voted against it. “As Florida’s most populous county, it was critical that Miami-Dade join the 27 other Florida municipalities that already have these protections. With today’s victory, more than 50% of Floridians are protected from discrimination based on sexual orientation and gender identity, giving a major boost to our ongoing efforts to pass these protections statewide,” said Stratton Pollitzer, Deputy Director of Equality Florida. “Now, all people who live or work in Miami-Dade County can continue to provide for their families without fear of losing their job or being denied

Miami-Dade Adds Transgender Protections to County Human Rights Ordinance

Today the commission did what is right for their constituents and what is right for the economy, and showed that MiamiDade County respects the rights and dignity of all people,” added Pollitzer. Gwendolyn Ann Smith reports on the Human Rights Campaign website that “Over the last decade, more than one person per month has died due to transgender-based hate or prejudice regardless of any other factors in their lives. This trend shows no sign of abating.” According to respondents to the National Transgender Discrimination Survey, conducted by the National Gay and Lesbian Task Force and the National Center for Transgender Equality, the prevalence of suicide attempts among transgender individuals is 41 percent. This vastly exceeds the 4.6 percent of the overall US population and is also higher than the 10-20 percent of LGBT adults who reported attempting suicide. Michigan Republicans Pass Bill Allowing Gay Discrimination

BOSTON, MA—The First Circuit Court of Appeal has refused to dismiss a case against homophobic preacher Scott Lively, president of Abiding Truth Ministries, a vehemently anti-gay ministry known for its opposition to LGBT rights. Lively has been accused of crimes against humanity, and had attempted to have the case dismissed on free-speech Scott Lively grounds. The suit was filed by lawyers for the human rights groups Sexual Minorities Uganda (SMU) and the Center for Constitutional Rights. SMU alleged in its complaint that Lively “devised and carried out a program of persecution” and “strategies to dehumanize, demonize, silence, and further criminalize” LGBT Ugandans. Lively addressed an anti-gay conference in Uganda just prior to that African country’s drafting of its homophobic legislation. Lively also cheered on anti-gay legislation in Russia, branding Putin an ‘unlikely hero’ for getting the country to pass it. In its judgment, the US First Circuit Court of Appeal ruled: “Although it is debatable whether the district court has properly parsed the petitioner’s protected speech from any unprotected speech or conduct, his right to extraordinary relief is not clear and indisputable. The petition is denied.” Lively ran last month for Governor of Massachusetts as an independent candidate, but came dead last, amassing just 19,378 votes out of 2,158,326 – even being beaten by the number of ballot slips turned in blank, at 28,465.

LANSING, MI—Michigan’s House of Representatives have passed House Bill 5958, which effectively will allow anyone to use their religious beliefs to discriminate on the ground of sexuality. Called the ‘Religious Freedom and Restoration Act’ is presumably meant to “limit governmental action that substantially burdens a person’s exercise of religion” Passed along party lines by a vote of 59-50, the bill could easily be used as a legal excuse to discriminate against gays, shielding people citing their religion from any antidiscrimination laws in the state. The bill must next go to the Michigan Senate, followed by the state’s Republican Governor Rick Snyder. The bill is not likely to receive much opposition from either. House Speaker Jase Bolger dismissed claims the bill was actively homophobic, telling MSNBC: “Do you think that Bill Clinton and Ted Kennedy were extremists? “We modelled [this bill] directly after what they did. I’m baffled to hear that what we’re doing is out of line.” Civil rights leaders, however, were quick to disagree. Brooke Tucker of ACLU Michigan said: “In many religions, it’s OK for a man to beat his wife. Based on language in this bill, all he has to say is my religion allows me to do this.” ACLU counsel Eunice Rho added: “We are very concerned as marriage equality becomes a reality that proponents of these bills are going to regroup and pour more resources into it, and that the push will be even more aggressive. We’re certainly expecting [religious freedom bills] to be a very real threat in the upcoming year.”

Homophobia in Anchorage ANCHORAGE, AK—Adam Jacobson and his husband were stunned to return to their Anchorage home to find it pelted with raw eggs, mailbox bashed, and a handmade sign that declared the town as a “Fag Free Zone.” Jackson, who has lived in the home for four years, said that nothing like this overt homophobic behavior has happened before. “The whole thing kind of felt like they had observed us or they were at least familiar with who we were,” he reported to a local TV station. “It was planned. They clearly put a lot of effort into that poster.” The poster, painted in shades of pink, orange, yellow and green, has been turned over to the police who are investigating the incident, and carried a number of strongly homophobic phrases, including “FAG FREE ZONE,” “White Power,” “Fags Die, God Laughs,” “Homosexuality is Sin” and “Homos are possessed by demons.” Pink News reported that Jacobson also said that “I suspect that people that think this way and believe these things probably are feeling marginalized and feeling like sort of victims of the progressive moment, and maybe those sort of feelings of victimhood are what sparked this sort of behavior.” Jacobson says that he has been besieged with kind words and supportive messages since the incident. He said: “It just proved what I already suspected, which is that we have a really great, supportive community.”

Vanderpump worked with Street and Tack for weeks on the design of the rings, an interlocking motif crafted in white gold, symbolizing the love between newlyweds Dominic and Magno and the joining of their lives together. Street and Tack were themselves married in California in 2008, for at the time they couldn’t marry in their home state of New York. They were one of the 18,000 couples married during the short window of time before Prop 8 went into effect ending marriage equality in California that year.


John Smid, the former director of Love in Action, and a board member of the Christian “gay cure” group Exodus International, has gotten married in Oklahomas to his same-sex partner, Larry McQueen. The former activist eventually quit the group in 2008 and later apologized for his work on “gay cure” therapy. Since leaving Love of action, Smid has campaigned to ban “gay cure” therapy completely. The couple live in Paris, Texas, a town of 25,000 in Northeast Texas, where sameJohn Smid and sex marriage is Larry McQueen still illegal and unrecognized. Speaking to Towleroad, Smid said, “I believe that due to my former notoriety, my marriage will definitely have its impact. “I believe it is encouraging for other former ex-gays, and maybe even those who are still trying to hold on to their ex-gay belief system. “We think our relationship reveals something very normal, not strange or deceptive gay stereotypes. “We have come to realize that our marriage is very much the same as your average heterosexual marriage.” He added: “I realized this week that my relationship with Larry is a mirror I see in every day. “For most of my life, the mirror I saw reflected my mistakes, shortcomings and failures. “The reflection I see today with Larry shows me the positive things in my life, my strengths, gifts and talents. “ Mr Smid has been previously married twice to women, and had two children in the 1970s. Former Director of “Ex-Gay” Group Gets Married to Same-Sex Partner

out-of-state same-sex marriages, and whether a ban on recognition violates the constitutional right to travel that the high court has recognized in some contexts. In addition, the brief said, there are several “sub-issues” at stake: does the “right to marry” include marrying someone of the same sex, and what level of analysis is to be used to judge the validity of a ban based on claims of discrimination based on sexual orientation, gender, or hostility (“animus”) to gays and lesbians. “This swath of issues,” state lawyers said, “may require a separate briefing and argument. In that event, it would make sense to have a range of experienced counsel with a variety of approaches, which granting multiple petitions would accomplish.” In promoting the Louisiana case as an appropriate one for review along with the Michigan petition, Louisiana’s filing cited these facets, among others: the judge resolved both the celebration and recognition issues, there is no problem of anyone’s legal status (“standing”) to pursue a challenge, the rulings were final and were based solely on law rather than facts that were disputed, and there is now not only a conflict among federal courts over the outcome of test cases, but there is also a dispute within Louisiana itself: a state court has struck down the ban, while the federal judge has upheld it. The Louisiana filing did suggest that the high court may choose to wait, until further decisions emerge in state or federal courts. The entire tone of the document, however, was set on the opening page, referring to “a spiraling national controversy that has already nullified the marriages laws of over twenty states and spawned a four-toone circuit split.”

Washington, D.C. -- A second state — Louisiana—has asked the U.S. Supreme Court to consider taking on the constitutional dispute over samesex marriage without further delay, urging a prompt review of a federal judge’s decision to uphold Louisiana’s ban and that the high court examine the dispute in a broader context of all the issues. With the filing last week of Louisiana’s views, paralleling a suggestion for early review made by Michigan in another case, the high court now has two new cases nearly ready for early consideration, in all likelihood in time for a final decision before the end of the current term. Other cases on the issue are pending, but if the court waits for all of the filings to be submitted in all of the cases, that could slow the process, according to Lyle Denniston of SCOTUSblog. If the court does move now to review any of the new appeals, its new filing makes clear that Louisiana — like Michigan — wants its own ban on same-sex marriages upheld. But, at this stage, the two states have stressed the importance of advancing the controversy toward a final resolution by the only court with authority to do that, in a case or cases which lay out the issues that will shape the outcome. Louisiana said it supports a grant of review of the Michigan case, DeBoer v. Snyder, but wants the justices in doing so to also put on their decision docket the case of Robicheaux v. George, in which a federal judge in New Orleans ruled in favor of the state and against the challenging same-sex couples. Although Michigan’s ban, like Louisiana’s, not only forbids samesex couples from getting married in the first instance but also refuses to recognize same-sex marriages performed in other states, the only couple challenging the Michigan ban

is testing the so-called celebration issue while the seven couples who have filed the Louisiana case together are testing both that issue and the recognition question. The U.S. Court of Appeals for the Sixth Circuit, in the decision upholding the Michigan ban, also upheld recognition bans in other states in its region. Even so, the Supreme Court may have some hesitation to reach both questions if the petition from Michigan is the only one it accepts for review. That is why the twin-issue case from Louisiana was promoted by state lawyers as a broader test case. But, to grant the Louisiana case at an early point, the Supreme Court would have to agree to let that case skip the level of a federal appeals court. After the federal trial judge upheld both Louisiana bans, the samesex couples involved appealed the case to the U.S. Court of Appeals for the Fifth Circuit, where it is now scheduled for a hearing on January 9. The couples involved in the case have since asked the Supreme Court to grant the case without waiting for the Fifth Circuit’s review. That is the move that state officials supported on Tuesday. As of now, the Supreme Court has five petitions from which to choose, if it is ready to choose. In addition to the Louisiana and Michigan petitions, there are filings testing the bans in Kentucky, Ohio, and Tennessee. In addition, state officials in South Carolina said this week that they will be filing their own petition, asking the justices to leap-frog an appeal the state now has pending at the U.S. Court of Appeals for the Fourth Circuit. In the new Louisiana filing, the state’s lawyers said that “the sheer number of issues” supports the suggestion that the high court grant review of “multiple petitions.” The main issues that the new brief said are presented by the pending petitions are these: whether a state is required by either the U.S. Constitution’s Equal Protection or Due Process clauses to allow same-sex couples to marry, whether those two clauses or the Full Faith and Credit clause compel the state to recognize

At around 10 p.m. last Sunday night, a customer at Johnny’s Nightclub on Broward Boulevard walked into the east room in the popular male strip bar with a bottle of water. He was a familiar face—a regular who stops by two or three times a month, particularly on Sundays, which features Amateur Strip Night and a multitude of drink specials. But this customer hadn’t come to drink, or watch the young strippers, or

join friends. This man calmly emptied the contents of his water bottle over his head, saturating his clothing. Nor was it water in the bottle. It was filled with gasoline, and no sooner had he emptied the bottle then he took out a lighter and set himself on fire. Club owner Sean David was in that part of the bar at the time. It’s the quieter of the bar’s two rooms, where guests can hold conversations, and get to know some of the strippers on a one-onone basis. Even now, days after the inci-

dent, Sean remains in a state of shock. “The club was very, very crowded, and I had seen the guy walk in,” David said. “He was a familiar face, like many of our customers are, and nothing looked out of place. He just calmly walked to the center of the bar, and lit himself on fire.” Johnny’s has been in business for over 34 years, and for a great deal of that time David has been the owner. “When you own a gay club, you expect to see some unusual things happen. But never have I ever seen anything like this. “The guy was immediately consumed by the flames. His hair, his face, his clothing were all seriously on fire. People starting pouring water on the flames while I rush toward him with a blanket.” Those at the scene report a strong smell of gasoline and burning flesh, along with a sense of horror as the unbelievable act unfolded. David covered the man with the blanket, burning himself in the process. “The guy was screaming to me, ‘I want to die; I want to die.’ And I just told him, ‘Not tonight you’re not. Not here, not now.” Several patrons had called 911 and the paramedics arrived “in less than five minutes,” David said. “They were so quick and efficient, and handled the scene as if it was just another night at work.” But of course it wasn’t. Because of their prompt emergency efforts, the man lived, albeit suffering second degree burns over 80 percent of his body. “He had no hair left, and his face— I’ll never forget,” David said. “They say he was recently homeless and wanted to make a statement before dying. of Florida, told the Miami Herald that much has happened since July in Florida. “I don’t want to say the memo is wrong, but the world changed since that memo was written.” The ACLU sued the state on behalf of its client, the gayrights group SAVE, and same-sex couples who were legally married in other states only to have their marriages not recognized in Florida. In that case, among the defendants was the clerk of the court in Washington County. The date of January 6 was decided by U.S. District Judge Robert Lewis Hinkle, who last August ruled that the state’s ban on gay marriage was unconstitutional, but granted a temporary stay in same-sex marriages until January 5 in deference to the state, which appealed to the Eleventh Circuit. On December 3, the U.S. Court of Appeals for the Eleventh Circuit denied a request by Florida Attorney General Pam Bondi to extend that stay freeing samesex marriages to begin at the time. Broward County Clerk of the Court Howard Forman said that his office was prepared for a rush of applicants on January 6, while Monroe Country Clerk Amy Heavilin intends to become the first clerk in Florida to marry a gay couple, keeping her office open past midnight on the 5th to celebrate with Key West’s gays and lesbians. All the while, the increasingly absurd Bondi is continuing to weigh her options, refusing to say she’s out of options to stop history in the making.

Peterson said that the current form refers to “a bride and a groom,” two categories that would ultimately be altered to state “spouse.” Though not widely known, it is Florida’s Department of Health that actually produces the certificates. “I do not know if they have prepared anything to have those changes made,” Peterson said. Adding to the uncertainty is a memo that was sent last July by attorneys John Londot, Hope Keating and Michael Moody of the law firm of Greenberg Traurig’s Tallahassee office that represents the Florida Association of Court Clerks and Comptrollers. According to that memo, “If a trial court declares Florida’s same-sex marriage law ban unconstitutional, the decision is technically binding only upon the parties to the suit, but is otherwise not mandatory for Clerks who are not named as defendants. Thus, ordinarily, Clerks in other jurisdictions may consider it prudent, but not necessary, to follow the example of the deciding court.” While pointing to the various state statutes that govern the issuing of same-sex marriage licenses, the memo stated that it “is a misdemeanor of the first degree, punishable by imprisonment of not more than one year and a fine of not more than $1,000.” According to Greenburg Traurig, “Clerks who are not named defendants and who issue licenses to same-sex couples may be susceptible to a charge of violating criminal law.” Howard Simon, executive director of the ACLU

alm Beach Clerk & Comptroller Sharon Bock is excited about her place in Florida history. Beginning January 6th, her office will begin issuing marriage licenses to same sex couples, barring any unexpected intervention by the Florida Supreme Court. “We have been waiting for quite a long time, knowing this was going to come up. We are 100 percent ready to provide applications to all people that want to get married,” Bock said, while adding that she will also be performing ceremonies as well. The attractive blonde joins 66 other county clerks and their offices that are expecting to be besieged by applicants when the first Tuesday in January rolls around. Yet, despite the excitement, there is caution running just beneath the surface, and can be felt when Bock adds that she intends to contact Florida Association of Court Clerks and Comptrollers “to make certain that we are uniformly acting appropriately across the state.” To switch from issuing licenses to male-female applicants to same-sex couples apparently isn’t quite as simple as some would hope. For one thing, the applications themselves need to be “gender-neutral.” Currently, they are not. The exact wording of marriage licenses in Florida is up to the individual court clerks that are issuing the document. Hampton Peterson, who is Bock’s general counsel, told the Daily Business Review that clerks across the state have been preparing for the move ever since the U.S. Supreme Court struck down the

Part 1: Check Your Posture

is for your overall posture. Now, notice your shoulders, hips, knees and ankles. Is each pair aligned at the same height? Do your ankles and knees line up directly under the hips? Are your eyes parallel? Is your head vertically straight over your neck and spine? If not, you are either developing bad posture or you already have it. Turn sideways now and start again. Do you lock your knees in hyperextension? Do you arch your lower back, creating a swayback and protruding abdomen? Do you round your shoulders or curve your upper spine forward, causing your neck and head to tilt forward? If you answered “yes” to any or all of the above questions, then you need to work on correcting your posture. Don’t feel bad because most people, even incredibly fit and beautiful people, need to “straighten up” a little. The good news is that with a little stretching, and by tweaking your workouts, you can make vast improvements on your posture in no time at all. For example, if you slump forward because your upper back is too weak and your chest and the front of your neck are too strong, your goal should be to stretch the chest while strengthening the upper back. It turns out that Dad was pretty much on target with his assessment. Good posture is more important than you know. Drooping shoulders, a sway back and forward head tilt can actually compromise your health. Gravity is constantly pulling your bodyweight downward creating a comprehensive load on every joint, forcing your organs to work harder, and giving you unwanted girth around your middle. Poor posture is usually the result of a weak core (the muscles of your abdomen, inner thighs, and middle and upper back, among others.) When these muscles are deconditioned and weak, your lower back compensates by becoming chronically tight. This instability adds to flaring, increasing waist and hip dimensions which are sure to exacerbate back problems. A swayed lower back causes the upper spine to lean backward; to keep from falling over, the chest muscles contract pulling the upper body forward. This also overdevelops the front neck muscles, often leading to neck, jaw and headache problems. Over time any or all of these difficulties, caused initially by poor posture, can result in bulging or herniated discs, arthritis, sciatica, and a whole host of other health problems. You can avoid or at least lessen many of the above situations with simple posture analysis. Stand stripped facing a full-length mirror. Check out your feet: are they flat? Do your ankles pitch inward, creating a knock-kneed effect, or do they pitch outward, shifting your weight to the outside of the heels? Good posture is dependent on the physics of proper weight bearing – every level below affects the area above it. The straighter and more parallel your feet are, with each heel lining up behind the second toe, the better it

management to oversee the build of the new club. “It’s a lot of fun,” Patrick says about his job, which began with the opening of Progress South Florida in September. He isn’t just referring to the beach, although there is that. “There’s a gay beach in Chicago,” Patrick acknowledges. “And it’s awesome, but it’s not really as nice or as beautiful as the ocean beaches here. The Chicago River has nothing on the Intracoastal or Atlantic Ocean,” he adds. Another body of water which he enjoys is Biscayne Bay, upon which he recently enjoyed a midnight cruise. So he likes the water? “Definitely,” he replies. I venture to ask him his favorite color. “Blue,” Patrick answers. On a roll, I inquire as to his favorite animal. “Otter,” he says without hesitation (although he insists that he isn’t one in the Bear/Cub sense). “I helped to create most of the specialty drinks we serve at Progress,” Patrick acknowledges. In his professional opinion, what would he recommend as a “cocktail to impress?” “When I started bartending, I went through a long ‘whiskey’ phase. I think there is something very classic about the Old Fashioned (a whiskey cocktail made by muddling sugar with bitters, a garnished with twist of citrus rind). “It has subtle ‘notes’ of other tastes that make it both sweet and flavorful,” he adds. t wouldn’t be fair to say that William Patrick had no idea what he was in for when he moved from Chicago to help open Progress South Florida as its lead bartender. Still, his first sight of the place—I’m talking his VERY FIRST SIGHT EVER of South Florida—was from the airplane when he landed in Fort Lauderdale on July 8. “I moved here blindly,” Patrick admits with a laugh. “I really enjoy a new challenge, so I was excited about coming to South Florida. I love the tropics.” William Patrick, 26, was born in the north suburbs of Chicago, famous for such residents as basketball legend Michael Jordan, Smashing Pumpkins front man Billy Corrigan, and mobster Al Capone (he of St. Valentine’s Day Massacre fame). A bartender since his early 20s, Patrick’s first gig was working at a straight sports bar in Highwood, Illinois, which earned its place in the Guinness Book of World Records following World War II for having the most bars per capita in the world. “It also featured in the Haymarket Riot,” Patrick adds. “The Haymarket Riot,” I ask? “As in the 1886 Haymarket Riot?” This isn’t your usual bar conversation. (Well, gay-bar conversation, anyway.) In addition to an unparalleled depth of knowledge about 19th Century Chicago, Patrick studied art history, and sees that field as his possible post-bartending, “grown-up” future. “I worked in some really amazing art galleries when I was younger, and would like to see what happens when it’s time to pick that up again,” he muses. In the meantime, he’s doing now what he really wants to be doing. “My plans for the future are happening naturally. It’s an organic process. Bartending was a childhood fantasy for me,” he admits. “So I am fulfilling something that I’ve always wanted to do.” Patrick previously worked at the company’s flagship bar, Progress Chicago, moving with select members of

The ingenious creation of comedian and writer Paul Reubens, man-child Pee-Wee Herman appealed to both kids and adults. Pee-Wee’s Playhouse: The Complete Series” (Shout Factory), which premiered on CBS in 1986, running for five years, was like watching all previous kids’ show hosts, such as Captain Kangaroo, Soupy Sales and Shari Lewis on an acid trip.
