Texas Attorney General Refuses Petitions

Same-sex marriage is legal in 19 U.S. states plus the District of Columbia: California, Connecticut, Delaware, Hawaii, Illinois, Iowa, Maine, Maryland, Massachusetts, Minnesota, New Hampshire, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, Vermont and Washington State. A separate federal appeals court next month will hear separate challenges to same-sex marriage bans in the four states in its jurisdiction: Michigan, Ohio, Kentucky and Tennessee. The challenge to Virginia’s ban was brought by several plaintiffs, including Timothy Bostic and Tony London of Norfolk. Two Richmond-area women, whose marriage was formalized in California, but is not recognized in the commonwealth also brought suit. Supporters of traditional marriage between one-man and one-woman have criticized the rulings in Virginia and other states, for expanding the right to homosexuals. Thirteen months ago, the Supreme Court cleared the way for same-sex marriages in California to resume. More importantly, it also rejected parts of a federal law that had denied federal

down Virginia’s ban on same-sex marriage on constitutional grounds. The ban had been in place since Colonial days, but only recently was voted into the state constitution. Monday’s ruling continues a nearunbroken string of state and federal court victories nationwide in the past year, giving marriage-equality supporters unbridled encouragement that their ultimate goal will be achieved: striking all laws limiting the rights of homosexuals to wed. “The choice of whether and whom to marry is an intensely personal decision that alters the course of an individual’s life,” wrote Virginia’s 4th U.S. Circuit Judge Henry Floyd in an opinion supported by Judge Roger Gregory. “Denying same-sex couples this choice prohibits them from participating fully in our society, which is precisely the type of segregation that the Fourteenth Amendment cannot countenance.” In dissent, Judge Paul Niemeyer said the issue should not be in the hands of the courts. During May oral arguments, the three seemed to agree that both sides in the case were using the appeals court as “way-station up (Interstate) 95” to the Supreme Court. Byron Babione, senior counsel with the group Alliance Defending Freedom, said Niemeyer noted correctly, in its view, that there is “no fundamental right to same-sex marriage and there
AUSTIN, TX—The petitions were supposed to send a message to Texas Attorney General Greg Abbott about the changing face of popular opinion regarding same-sex marriage. Instead, they got a slap in the face, and were told to leave Abbott’s office. Equality Texas wanted to drop off 5200 signed petitions in favor of samesex marriage, but were told that the petitions would not be accepted in person. The group’s next stop was the post office where all 5200 petitions were mailed. The group wants the state to stop defending the state’s current marriage laws. Back in February, a federal judge in San Antonio ruled laws prohibiting same-sex couples from marrying are unconstitutional and that Texas’ current laws deny homosexual couples the right to marry. Attorney General Greg Abbott is appealing the judge’s ruling. Jonathan Saenz says Texas Values plans to file a brief supporting Abbott’s efforts. This is an issue supporters on both sides are watching closely. Chuck Smith with Equality Texas says “I am disappointed with the rejection. I think it’s another symbolic slap in the face to Texas parents, families and their children. The adults who brought their children to deliver the petitions the rejection they got today is the same they get every day from the AG and the state not recognizing their families.” Jonathan Saenz of Texas Values says, “This effort to redefine marriage is happening in other parts of the country by just a small amount of judges but it’s not a reflection of what the people want.” The Equality Texas petitions are expected to arrive at the AG’s office sometime tomorrow. A decision could come down from the 5th Circuit later this year.

It’s a small club, with a select membership. And Virginia just made the cut. This past Monday, Virginia became the first southern state to strike down a voter approved ban on same-sex marriage. “We recognize that same-sex marriage makes some people deeply uncomfortable. However, inertia and apprehension are not legitimate bases for denying same-sex couples due process and equal protection of the laws,” the divided three-judge panel of the 4th U.S. Circuit in Richmond concluded. The ruling follows similar conclusions in Utah and Oklahoma, with another dozen states coming to the same conclusion in state courts. The 4th Circuit opinion also will affect marriage laws in other states within its jurisdiction, including West Virginia, North Carolina and South Carolina. Each state would require a separate order to begin issuing marriage licenses. To date, only Maryland has legalized same-sex marriage. As with all other Federal rulings, gay and lesbian couples in Virginia cannot marry in the state for at least another three weeks, giving time for a likely appeal. The Supreme Court will ultimately decide whether to review the constitutional issues pending in this case and those in several others, a process that may not begin at the earliest until later this year. Speaking to CNN, Virginia’s Democratic Gov. Terry McAuliffe said he was “overjoyed” at the ruling. He and Virginia’s attorney general have refused to defend the ban in court as is tradition, leaving it to other state officials to make the case. “This is a historic ruling for our commonwealth, and its effect will affirm once again that Virginia is a state that is open and welcoming to all,” McAuliffe said in a statement. Last February, a Federal judge struck

Same-Sex Ban “Offends Human Dignity”; Ruled Unconstitutional in Miami-Dade MIAMI, FL--Last Friday, a MiamiDade judge has struck down Florida’s gay marriage ban, becoming the second Florida judge in a week to find it unconstitutional. Miami-Dade Circuit Judge Sarah Zabel found that the state’s same-sex marriage ban “offends basic human dignity” and violates the 14th Amendment’s guarantee of equal protection under the law. As she did in an earlier same-sex ruling in a Monroe County countroom, Florida Attorney General Pam Bondi filed a notice of appeal of the ruling within an hour of the ruling being issued. “Preventing couples from marrying

solely on the basis of their sexual orientation serves no governmental interest,” Judge Zabel wrote in her order. “It serves only to hurt, to discriminate, to deprive same-sex couples and their families of equal dignity, to label and treat them as second-class citizens, and to deem them unworthy of participation in one of the fundamental institutions of our society.” Florida originally enshrined a ban on same-sex marriage in the state constitution in 2008. Voters approved an amendment that year banning same-sex marriage. Since then, the Supreme Court has overturned the Defense of Marriage Act at a national level and lower-level courts have repeatedly overturned state laws as appeals over state bans moves towards the U.S. Supreme Court. At its heart, this case is about the right to marry the person of one’s choice. It is about whether the right to marry can be denied to members of a particular group

based upon their sexual orientation, and whether couples and families who have members that fall into that group are entitled to the respect, benefits, and protections which marriage brings,” Judge Zabel wrote. Zabel put an immediate stay on her order pending the outcome of the expected appeals to be filed by the state of Florida. Judge Zabel’s order came in a motion for summary judgment in the case Catherina Pareto, et al vs. Harvey Ruvin, and the State of Florida. The summary judgment was granted, giving the plaintiffs an immediate victory. Judge Zabel’s ruling also said that Article I, Section 27 of Florida’s Constitution is “void and unenforceable.” She also declared the Florida Statutes that prohibit the issuance of marriage licenses “unless one party is a male and the other party is a female is similarly void and unenforceable.” The ruling also said that the Clerk of Courts should not be prosecuted for complying with the order and that the Clerk of Courts should modify marriage licenses to conform to the ruling. The ruling from the Miami-Dade Court would apply only in MiamiDade County. It comes just a week after Monroe County Circuit Judge Luis Garcia ruled that Florida’s same-sex marriage ban was unconstitutional. Judge Garcia’s order was immediately stayed when Florida Attorney General Pam Bondi filed a notice of appeal. Garcia later declined to lift the stay while the case is on appeal.

Governor’s Race Takes Aim at Same-Sex Marriage TALLAHASEE—With a number of court rulings in favor of same-sex marriage legalization in local counties, the issue has moved to the forefront of Florida’s gubernatorial race. Democratic candidate Charlie Crist, who was governor when an amendment was passed to the Florida Constitution defining marriage as between a man and a woman, now says that “This ruling is an important step in the fight for marriage equality. As governor, I will continue this fight this fight so all all Floridians have the right to marry the person they love.” Crist’s Democratic rival, Senator Nan Rich, suggests while the rulings are a first step, they need to go further. “I hope it moves all the way up to the state, and I hope that our attorney general stops her lawsuits against it,” said Rich said in a campaign stop in West Pasco County. Attorney General Pam Bondi’s appeals are just another way the Republican Party is pushing back. Gov. Rick Scott’s office released the following statement: “Gov. Scott respects the many views Floridians have on this issue. He believes in traditional marriage, consistent with the constitutional amendment passed by voters in 2008.” With the majority of Floridians now

Johnson’s company bought the debt from Compass Bank, after the original lender Southwest Guaranty failed. According to a filing in the case by Parliament House, Johnson has “vigorously pursued” the foreclosure case even though Granatstein has attempted to resolve it. The property includes a 112-room hotel, bars, a swimming pool and a 10,000-square-foot entertainment complex with dance floor and outdoor stage. “Over time, the debtor invested significant and substantial monies into remodeling the Resort at investors’ direction,” according to the bankruptcy case management summary. “More than 50 percent of the lodging rooms are completed or in the process of receiving contemporary updates, and significant remodeling has occurred in the entertainment complex.” A recent visit to the property suggests that business is booming and the popular facility is being managed well.

Ironically, the resort is in the middle of celebrating its 39th year anniversary. According to bankruptcy attorney Scott Shuker, the 4.5-acre complex defaulted on loans during the recession in 2009 and has been locked into a foreclosure and refinancing battle since that time. “It’s clearly the intent of Parliament House to continue operating and restructure its debts, but we just couldn’t reach agreement with two secured lenders,” Shuker said. Canadian businessman Donald Granatstein and Susan Unger, both of Toronto, have owned Parliament House for 15 years. Shuker said the business suffered cash flow problems in 2009. Both lenders that held mortgages also went under during the recession. The complex is about 1.5 miles west of downtown Orlando along Orange Blossom Trail in what was originally orange groves and farmland. One of the lenders, USA Capital, which holds $8.5 million in debt,

innesota Congresswoman Michele Bachmann’s idiotic statements did more than just make our front cover this week. She actually provoked some thought--for a change. During a radio interview in Ohio, she made a comment that in all of human history, never has there been a marriage other than between a man and a woman. It got us to thinking about Pan Zhang and Wang Zhongxian. They were Chinese males that lived during the Zhou Dynasty where they were publicly affectionate and a popular couple living in a domestic partnership. Pan was a beautiful writer; Wang his handsome student. The pair were said to have been together for fifty-two years, died during the same month, and are buried at the peak of Mount Luofu where a tree grows with interwined branches. It’s a famous true story from “Anthology of Tales from Records of the Taiping Era.” Michele must have missed the coloring book version. Actually, same-sex marriages were very common in ancient Mesopotamia, Greece, Rome as well as China. They were so popular in fact, that when Christian emperors Constantius II and Constans came to power in Rome, they wrote the Theodosian Code, which became law in 342 AD. Among the actions outlawed were same-sex marriage, with any samesex couples automatically subject to execution. In Hellenic Greece, the bonds between males were legendary. Perhaps Michele never heard about the naked wrestling or the pederastic relationships that were commonplace between older men and younger men, after approval by the teenagers’ father, natch. Though many of these relationships were considered platonic and mentoring relationships, particularly in Sparta, where young men were sent for military training. While the Greek relationship was normally for life, it wasn’t considered traditional marriage—except, of

ne-time Presidential candidate Michele Bachmann (R-Minn) has spent her entire political career fabricating lies about the LGBT community. But her latest rant has crossed the line of mental stability and stands as an embarrassment to not only the Minnesotans she is charged with representing, but every intelligent Republican with whom she must work. On the Ohio Christian University-based talk show “Faith & Liberty,” Bachman, speaking to host Dave Garrison, accused gay rights activists and their allies of working to abolish sexual age-of-consent laws and worse. “They want to abolish age-of-consent laws, which means…we would do away with statutory rape laws so that adults will be able to freely prey on little children sexually. That’s the deviance that we’re seeing embraced in our culture today.” All evidence to the contrary not withstanding, the darling of the Tea Party spewed further accusations so outrageous that, if they weren’t originating with a member of Congress, would be comical. “This is a revolution that we are encountering now. For all of the thousands of years of recorded human history, about 5,000 years (Editor’s note: Archeologists estimate that modern humans have been on earth 200,000 years), there is no instance of any culture, nation or tribe ever having as the established standard for marriage anything other than between man and woman,” Bachman argued. (Editor’s note: See “As I See It.”) “It may have been multiple women and a man, it may have been something like that, but it was always between men and women.” Now Bachman said that the current gay community has a far more sinister agenda. “I believe that we’re going to see coming an effort for multiples in marriage. Not just two, but multiples in marriage,” she said. Furthermore, this agenda, according to Bachman, is being forced on an unsuspecting America. “We see that in legislation being pushed all across the United States, to punish people who don’t agree with that viewpoint. And I think that’s very reflective of where
we are at in the culture and why we see the rise of tyranny. It’s the basis for hate-speech laws across the United States. It is an attempt to have government coerce and force speech and behavior. Let me say that again: This is an effort to have government coerce, force speech and behavior. And it’s being pushed and advocated by the gay community. This is their ultimate goal. “It’s to not allow for diversity of opinion on this issue, because they don’t want to be celebrated, they want to force everyone to not only agree with them but also have to finance their agenda. And they also believe that they have the right . . . to determine on a near daily basis what their agenda is. Today, the big push is on transgender, and so they’re continuing to push us down this the road.” Despite the fact that in her oath of office she swears to defend the Constitution of the United States, nothing in Bachman reckless statements mentions freedom of individual rights for all. Nothing other than conspiracy serves to explain to her the remarkable number of consecutive victories in courts across the nation in favor of allowing, without prejudice, the marriage between two individuals of the same sex. And nothing in Bachman’s mind suggests that gays are anything but messengers from hell. Perhaps it is best to put Michele Bachmann in
context. She is CHRISTO PHER HA about to end her term as LLORAN Congresswoman and be replaced in 2015. And she is, after all, the person who once made the now immortal comment, “Carbon dioxide is portrayed as harmful. But there isn’t even one study that can be produced that shows that carbon dioxide is a harmful gas.” Makes you want to connect the hose to the exhaust pipe.

FIVE HIDDEN HOTEL FEES AND HOW TO AVOID THEM
I
t never fails. You budget your vacation and then when you go to check out, there are a bunch of hotel fees tacked on to the bill. Hotels collect more than $1 billion in fees and surcharges each year. One way to avoid some charges is to sign up for the hotel’s loyalty program, which should be free. Generally, you’ll get privileges, immediately. Until then, here’s a list of some of the common ones and how to avoid them. Some hotels charge extra for check-in before a certain time. If you arrive early, before checking in, ask if there is an early check-in fee. Instead of checking in, ask if the hotel will store your bags (most will for free) until you do check in. Then go sightseeing or for a meal and check in later. Although the practice is disappearing, some hotels still charge for Wi-Fi, sometimes $10 to $20 per night. Save going on the Internet until you get to a Starbucks or other venue with free Wi-Fi. Oddly, many budget hotels offer free Wi-Fi. We all know that the beverages in minibars are pricey, but you don’t have to sample them for the charges to show up on

your bill. Simply moving an item (to store leftovers or chill your own water bottle) in the mini-bar can result in a charge (every item is on a sensor). If you see a charge for something you didn’t consume, tell the hotel clerk that it’s still there and contest the charge. They’ll usually do so immediately. Bottles of water or snacks in the room may appear to be complimentary, but may not be. Ask first, unless you don’t mind paying $5 for a bottle of water. Hotels in major cities often charge anywhere from $25 to $50 a day for parking, so ask when booking your hotel. If so, use Google “parking garage” and the hotel’s address to look for nearby parking garages. Then call to get a price. Also
check out the city’s visitor’s bureau or tourism web site, they’ll usually have a list of hotels and indicate what promotions they offer. If you usually leave a tip for the housekeeper, check to make certain that the hotel doesn’t add a 10% housekeeping gratuity. The same goes for using the hotel’s spa services. Often a gratuity is included. Check when booking services to make certain. Of course, in either of these cases, there’s nothing wrong with leaving an additional tip if you feel the service warrants it. Those are the main culprits for additional charges on your bill, but there is a couple more. It’s hard to believe in this day and age that anybody would use the hotel
phone, other than to call housekeeping or the front desk. Be aware that if you do, not only do hotels charge for long-distance calls, but also they often make you pay for local calls. Resorts often charge extra for activities and services. Always ask when you book your room what sorts of fees are charged. Find out whether you’ll have to pay them if you don’t use the services. Some hotels also tack on a gym fee. When you get your bill check to make sure you’re not charged for services you didn’t use. If they do, ask to have the fees removed. With a little due diligence you can easily shave 10-20% off your travel fees. Either pocket the savings or splurge on something you ordinarily wouldn’t!

F
or more than 20 years the media has bombarded us with a perpetual diet craze. An avalanche of fad diets are announced one after another as breaking news while producing zero true results. Sure, you may lose 5, 10 or even 20 pounds on a fad diet...but you’ll gain it all back and then some. How can I be so confident that your results will be shortlived? It’s actually a simple concept, and once you understand it you will be forever saved from the tortures of yo-yo dieting. Fad diets saddle you with unreasonable calorie restrictions and some even cut out entire food groups just to produce that short-lived drop in weight—a process that is actually harmful to your health. The fad diets also ignore one major component to shaping up: exercise. You see, most fad diets operate on one age-old premise: cut calories, cut calories, cut calories. By restricting the type and amount of food consumed the fad dieter usually sees an immediate drop in weight. If only it stopped there... But it doesn’t stop there. Life continues, and the fad dieter returns to their prediet eating habits — with one major difference in their body due to the sudden drop in pounds. Their calorie requirements have gotten smaller. In practical terms this means that the dieter will begin gaining weight even
though they are eating their normal pre-diet portions. And since exercise hasn’t become a part of their routine, the unneeded calories will result in pounds gained. So what’s a dieter to do? Find a brand new diet to follow-right? Wrong. There is a way to drop pounds and firm your body, but you won’t read about it in the next diet book or hear it on the news. The solution to your fad dieting nightmare is a lifestyle change. What is a lifestyle change? To change your lifestyle means to replace unhealthy habits with healthy ones, and to do so consistently. It isn’t something you do for a week or two, only to revert back your old ways -- a lifestyle change redefines who you are. Fact: The shape of your body is the direct result of your current lifestyle. Most people who are unhappy with their bodies are really only holding on to a few bad habits. Once these destructive habits are identified and then replaced with healthy habits their body naturally transforms from one that they loathe to one that they are proud of. In other words, to get the body that you want, simply determine your unhealthy habits and replace them with healthy ones. Here are the most prevalent unhealthy habits: he habit of inactivT ity. scotch egg is a hard-boiled egg wrapped in sausage meat, coated in breadcrumbs and deep-fried. The Scotch egg’s origins are obscure. The exclusive London “Fortnum & Mason” claims it invented the portable snack in 1738 for rich coach travelers. “The eggs would have been smaller in those days,’’ says the company’s archivist Dr Andrea Turner. “They would have been pullet’s eggs rather than hen’s eggs, and the meat would have been gamier.’’(And here I am wondering what a pullet’s egg is….) The finest Scotch eggs I can recall, freshly cooked and of first-rate ingredients, are those I have noshed on in the pubs of Dublin, but then of course I’m biased, and just a wee bit patriotic.

“Boyhood”

sister Samantha, Patricia Arquette as Mason’s mother Olivia and Ethan Hawke as Mason’s father Mason Sr. “Boyhood” is such an intimate achievement, that the experiences of Mason’s parents’ divorce, Olivia’s two unsuccessful remarriages, and the boy’s maturation from a kid with a “horseshit attitude” (Olivia’s words) to a philosophical and sensitive young man, feel completely authentic, not dramatized. From bicycles to pick-up trucks, from underage beers to ‘shrooms, from gutter balls to silver medals for photography, from first kisses to future romances, Mason’s boyhood unfolds in ways audiences have never experienced. Linklater has earned the praise that is being heaped on him and now has the difficult task amazing us again with his next project, a challenge he will no doubt meet.

and Oscar-winner Octavia Spencer (as James’ Aunt Honey, a madam), to play two of the most influential women in Brown’s life. As much a story about one of the most important artists in the history of 20th century music, as it is a portrait of friendships and long-lasting relationships, “Get On Up” allows us to feel empathy for Brown. From his business camaraderie with record exec Ben (Dan Aykroyd) to his volatile marriage to DeeDee (Jill Scott) and ultimately his fragile devotion to fellow musician Bobby Byrd (Nelsan Ellis, who plays gay LaFayette on “True Blood” and was also in “The Help”), Brown became a better person. Of course, that didn’t stop him from shooting up an office space full of people with a shotgun in 1988 because someone used his bathroom. The only complaint is that “Get On Up” could have been about 30 minutes shorter, which would have made getting on up out of your seat an easier feat after the credits rolled.

et On Up” (Universal) is about as non-traditional as a biopic can get. Sure, it employs the usual flashback techniques
and also paints a dreary childhood picture (see also “Ray,” “Lady Sings The Blues”) of the film’s subject, James Brown (well-played by Chadwick Boseman), as a way of portraying why he was so driven to achieve maximum success. But “Get On Up” relies far more on humor and camp than you might expect. That might have something to do with the sensibility of gay actor/director Tate Taylor (“The Help”). Taylor had Brown regularly breaking down the fourth wall, virtually winking and elbowing the audience. It was an unexpected touch that served to humanize the Godfather of Soul. It’s hard to imagine a straight director (ahem, Clint Eastwood) handling the scenes between Brown and Little Richard (Brandon Smith) with such finesse. Taylor also wisely included “The Help” cast members Viola Davis (as James’ mother Susie in a performance worthy of a Best Supporting Actress nod from Oscar)

ichard Linklater has been what you could call a groundbreaking independent filmmaker for more than 20 years. Beginning with his 1991 feature “Slacker,” in which he not only helped to make the title of the film a part of the mainstream vernacular, Linklater left his mark. With his next films “Dazed and Confused,” “Waking Life,” the gay-themed “Bernie,” and his beloved “Before” series (starring Ethan Hawke and Julie Delpy), Linklater has been steadily working towards Best Director and Best Picture Oscars. He may have finally achieved that goal with “Boyhood” (Cinedigm/IFC). Filmed over the course of 12 years, “Boyhood” clocks in at nearly three hours, but you’d never know it. The inventive and personal portrait of Mason (Ellar Coltrane), from grade-schooler to college freshman, features director Linklater’s daughter Lorelei as Mason’s
