Appeals Court In California Delays Transgender Inmate’s Surgery

Judge: Same-Sex Couples Across Alabama Have Right To Marry MONTGOMERY (AP) - A federal judge on May 21 ruled that gays and lesbians have the right to marry in all Alabama counties, but placed her decision on hold until the U.S Supreme Court weighs in on same-sex marriage this summer. U.S District Judge Callie Granade, as she has before, ruled that Alabama’s ban on same-sex marriage is unconstitutional. And this time, she forbade all probate judges from enforcing it. But her decision to stay the order until the high court rules means that, at least for now, same-sex couples still cannot marry in Alabama. That didn’t stop groups from cheering the ruling as a victory, however, in a state that spent much of the early part of this year in a legal war over the issue. “Judge Granade’s new order means that very soon, no probate judge in the state will be able to deny a marriage license to any qualified same-sex couple,” said Southern Poverty Law Center deputy legal director David Dinielli. “This is the right result for Alabama families and it is the one the United States Constitution commands.” The ruling is the latest from the federal judge who has been at the center of gay marriage cases in the conservative Southern state. The order could be
her final salvo at the state level before the Supreme Court decision. Granade first ruled that Alabama’s gay marriage ban was illegal in January. As a result, gay couples were able to get married for three weeks until the Alabama Supreme Court in March ordered probate judges to stop issuing marriage licenses. More than 500 same-sex couples married in Alabama during that time, according to the Alabama Department of Public Health. Groups fighting for marriage rights fired back at the Alabama Supreme Court’s decision with a class-action lawsuit brought by gay couples across the state. Granade’s decision on May 21 was in response to that lawsuit. Alabama Chief Justice Roy Moore, although he did not participate in the state Supreme Court order, has been a vocal opponent of Granade’s decisions, arguing that she did not have a right to dictate to the state probate judges. The probate judges are part of a parallel state court system, Moore argued. Granade made no secret of which Alabama courtroom she believes has the final say. “It is true that if this Court grants the preliminary injunction, the probate judges will be faced with complying with either Alabama’s marriage laws that prohibit samesex marriage as they have been directed by the Alabama Supreme Court, or with complying with the United States Constitution as directed by this Court. However, the
SACRAMENTO (AP) - A federal appeals court delayed sex reassignment surgery for a transgender prison inmate in California on May 21, hours after a state panel recommended that she be paroled. The separate decisions make it less likely that convicted killer MichelleLael Norsworthy will receive the prisonfunded surgery before she is released. Norsworthy, 51, has lived as a woman since the 1990s and was scheduled for the procedure on July 1 after a lower court judge ordered the state to provide it as soon as possible. The state, however, contested the ruling and the appellate court delayed the surgery while it considers the case a process that could take months. Meanwhile, the state Board of Parole Hearings has 120 days to review the commissioners’ recommendation that she be freed. If it is upheld, Gov. Jerry Brown will have another 30 days to intervene. The three-judge panel of the 9th U.S. Circuit Court of Appeals said nothing about the parole decision in its brief ruling and instead noted that the case raises serious legal questions about whether the state’s resistance to the surgery violates Norsworthy’s constitutional rights. Lawyers for Norsworthy have argued that denying the operation would amount to cruel and unusual punishment. The state Department of Corrections and Rehabilitation countered that it has met all of its requirements by providing counseling and hormone therapy. “Also weighing in favor of a stay here is the likelihood that, absent a stay, this litigation would become moot before receiving full appellate consideration,” the appeals panel said as it set a hearing on Norsworthy’s case in August. The stay came the same day that two parole commissioners decided Norsworthy is no longer dangerous and should be freed after serving 28 years in prison for a second-degree murder conviction.
Senior Deputy District Attorney Ray Armstrong opposed her release, arguing that she has not taken responsibility for the murder of 26-year-old Franklin Gordon Liefer Jr. after an argument in a Fullerton bar in November 1985. Norsworthy, then 21, shot Liefer three times and he died six weeks later. Armstrong said Norsworthy initially claimed the weapon fired accidentally and later contended that she had not intended to kill Liefer. Armstrong also cited 16 prison rule violations by Norsworthy for fights, threats and possession of contraband, though she has had a clean record since 2009. Kate Brosgart, the state-appointed attorney representing Norsworthy, said after the hearing that her client is no longer a risk to public safety. “I think there is no question that Ms. Norsworthy is suitable for parole,” she said. She and Norsworthy’s attorneys in the surgery lawsuit both denied the state’s contention in court documents that Norsworthy delayed previous parole hearings so she could stay in prison until receiving the operation. Her lawyers said Norsworthy would be eligible for Medi-Cal, which covers medically necessary sex reassignment surgeries, if paroled.
Texas House OKs Letting Clergy Refuse To Marry Gay Couples
AUSTIN (AP) - The Texas House voted on May 22 to let clergy members refuse to perform marriages that violate their religious beliefs further shielding the nation’s largest conservative state from a possible U.S. Supreme Court ruling allowing gay couples to wed. Republicans, who control the legislature and haven’t lost a statewide office since 1994, say the bill will keep church elders from being sued for refusing to perform weddings that clash with “sincerely held” religious beliefs. Democrats didn’t object, but took to the House floor to say passing it won’t stop gay marriage from being legalized nationwide eventually. “Some fine day, my partner and I are going to be able to get married in the great state of Texas. The Supreme
He expressed concern that an eventual court order might also strike down the BSA’s policy of banning atheists. “Waiting for the courts is a gamble with huge stakes,” he said. “Alternatively, we can move at some future date - but sooner rather than later to seize control of our own future, set our own course and change our policy in order to allow charter partners - unit sponsoring organizations - to determine the standards for their Scout leaders.” Such an approach, he said, would allow churches, which sponsor about 70 percent of Scout units, to establish leadership standards consistent with their faith. “I truly fear that any other alternative will be the end of us as a national movement,” he said. But some churches may be alienated nonetheless. Some Southern Baptist churches stopped sponsoring troops after gay scouts were allowed, and letting in gay adults will likely prompt even more departures, said Southern Evangelical Seminary President Richard Land, who formerly led the Southern Baptist Convention’s Ethics and Religious Liberty Commission. To him, Scouts shouldn’t have leaders who are sexually attracted to their gender, whether a heterosexual man leading Girl Scouts or a gay man supervising boys, no matter
objections that leaders of any sexuality shouldn’t be assumed to be potential pedophiles. “This seems to me to be sound judgment 101,” he said, calling Gates’ message a display of “political correctness.”
New York Lawmaker Backs State Benefits For Gay Veterans ALBANY, NY (AP) - A New York lawmaker says the state should ensure that military veterans discharged for their sexual orientation under the U.S. military’s old policies are eligible for the 53 state programs, benefits and tax breaks other vets can get. State Sen. Brad Hoylman says he’ll sponsor legislation to do that for lesbian, gay, bisexual and transgender New Yorkers among the estimated 114,000 service members discharged since World War II for their orientation or gender identity. That estimate includes 14,000 discharged under the “don’t ask, don’t tell” policy established in 1993 and repealed in 2011. Hoylman says many of those veterans received an “other than honorable” discharge costing them benefits. His bill would establish a simple certification within the State Division of Veterans’ Affairs for LGBT veterans to clarify their discharge status.

NEW YORK (AP) - The president of the Boy Scouts of America, Robert Gates, said May 21 that the organization’s longstanding ban on participation by openly gay adults is no longer sustainable and called for change in order to prevent “the end of us as a national movement.” In a speech in Atlanta to the Scouts’ national annual meeting,

Gates referred to recent moves by Scout councils in New York City and elsewhere to defy the ban. “The status quo in our movement’s membership standards cannot be sustained,” he said. Gates said no change in the policy would be made at the national meeting. But he raised the possibility of revising the policy at some point soon so that local Scout organizations could decide on their own whether to allow gays as adult volunteers and paid staff. In 2013, after bitter internal debate, the BSA decided to allow openly gay youth as scouts, but not gay adults as leaders. The change took effect in January 2014. Gates, who became the BSA’s president in May 2014, said at the time that he personally would have favored ending the ban on gay adults, but he opposed any further debate after the Scouts’ policymaking body upheld the ban. On May 21, however, he said recent events “have confronted us with urgent challenges I did not foresee and which we cannot ignore.” He cited the recent defiant announcement by the BSA’s New York City chapter in early April that it had hired the nation’s first openly gay Eagle Scout as a summer camp leader. He also cited broader developments related to gay rights. “I remind you of the recent debates we have seen in places like Indiana and Arkansas over discrimination based on sexual orientation, not to mention the impending U.S. Supreme Court decision this summer on gay marriage,” he said. “We must deal with the world as it is, not as we might wish it to be.” Gates said the BSA technically had the power to revoke the charters of councils that defied the ban on gay adults, but said this would be harmful to boys in those regions He also noted that many states have passed laws prohibiting employment discrimination based on sexual orientation, raising the possibility of extensive legal battles. “Thus, between internal challenges and potential legal conflicts, the BSA finds itself in an unsustainable position, a position that makes us vulnerable to the possibility the courts simply will order us at some point to change our membership policy,” Gates said.

Court will hopefully take care of that issue for us,” said Rep. Celia Israel, an Austin Democrat who is one of two openly gay state lawmakers. “When that day comes, rest assured that, for those pastors and preachers who will take a more literal interpretation of the bible, my partner of 20 years and I will not be going to them to bless our union.” Texas’ bill is less divisive than so-called religious objections measures elsewhere, applying only to religious wedding ceremonies and largely restating existing state law - hence Democrats not voting against it. Gay marriage has been banned in the state since voters approved a 2005 amendment to the Texas Constitution. It was approved 141-2 after sailing through the Senate last month. A final, largely ceremonial House vote that’ll likely happen Friday would send it to Republican Gov. Greg Abbott, who is expected to sign it into law. Applauded by conservative preachers and pastors, the bill nonetheless raises some of the same issues as the religious freedom laws that sparked criticism this spring when approved recently in Indiana and Arkansas. Supporters say such measures protect the freedom to exercise religious beliefs from government intrusion. Advocacy groups argue they allow businesses to refuse service to or otherwise discriminate against gay people. Debate in the Texas House comes after the nation’s high court heard arguments about the constitutionality of gay marriage for couples across the country, and should the justices rule later in favor of same-sex weddings, it would supersede the state constitutional prohibition.

Gay Activist Ross To Run Against Dyer For Orlando Mayor
ORLANDO—Despite his popularity and gay friendliness, Orlando Mayor Buddy Dyer has at least one challenger when he comes up for reelection next year. Community activist Randy Ross has decided to run for mayor against incumbent Dyer in the 2016 citywide election. Ross made the announcement on May 20. “My hope will be to give a voice to the people of Orlando,” Ross said. “I’ve been listening and the people are not being heard.” Ross said he will run less than a month after Dyer declared his intention to seek a fifth term during his State of the City address on April 29. “I intend on holding the mayor accountable,” Ross said. “He should have to campaign and defend his decisions. We can’t just raise property taxes, move stadium plans or develop unprofitable rail systems without critical thinking as to the outcome.” Ross was arrested in January on fraud charges. He pleaded guilty to a charge of falsifying an insurance claim on stolen lawn furniture. As part of his plea, Ross is serving five years probation and must perform community service. “I always said that if I ran for office again I’d put my skeletons out front and center and I have,” Ross said. Ross moved to Orlando in 1994. He has worked with an annual event
ST. PETERSBURG—For the first time in more than two decades, the Tampa International Gay and Lesbian Film Festival will not be held in Tampa. The festival, which runs from Oct. 2-10, is leaving the downtown Tampa Theatre and crossing the bay to its new home at the Palladium in downtown St. Petersburg. After years of declining attendance, organizers of the annual event looked for a new location. The festival showcases LGBT films and videos. “A lot of this came about after meetings with Tampa Theatre,” said Margaret Murray, executive director of the festival. “There was no rift whatsoever. Everyone I’ve spoken to, once I told them the reasons, they’ve understood.” Murray said the Palladium was chosen because it offers organizers and attendees a nice place to hold screenings and parties. And, most importantly, it gives the festival a new foundation for growth. Tampa Mayor Bob Buckhorn has attended the festival every year since he took office in 2011 and has said he is happy to see it expand to other areas. St. Petersburg’s Pride Parade has become known as the largest gay pride event in Florida. Its relationship with the festival and St. Petersburg’s support for the LGBT community, Murray said, were extra incentives to move. Mayor Rick Kriseman of St. Petersburg said he is happy to have the festival and believes it will fit nicely alongside the parade. But he said people shouldn’t dwell on the festival’s relocation from Tampa. “This is certainly a regional event,” he said. “They are just moving their home over here.” Festival attendance at Tampa Theatre has dropped in recent years. At its peak in the late 1990s, about 800 people would attend a big screening on a Friday night. Recently, Murray said, about 400 to 500 people have turned out. “The festival is not in any danger of
going under. But we know we have to take steps now,” Murray said. Film festivals are being forced to get more creative and add additional entertainment to their programs as more and more people are content to stay at home and rent videos or watch movies online. “Viewing trends are changing rapidly, and we have to keep pace with that,” Murray said. As a result, the festival will feature new events including book signings, live music and museum visits. The Carter G. Woodson African American Museum in St. Petersburg will host an outdoor screening and picnic on Oct. 8. “The Palladium was created to be the home of non-profit events,” said Paul Wilborn, executive director of the Palladium. “We are excited about it.”
Majority Of Jacksonville Council Backs LGBT Bias Protections After Election JACKSONVILLE--A majority of the city council in Jacksonville now reportedly back adding sexual orientation and gender identity to the city’s nondiscrimination ordinance after a general election held on May 19. According to Equality Florida, its local volunteers, working with their counterparts from the Human Rights Campaign, were able to successfully mobilize more than 100,000 voters in an aggressive campaign to elect proequality council members. “The non-discrimination ordinance was a major issue in these elections and today’s victory by pro-equality candidates sends a clear message that Jacksonville is eager to pass a nondiscrimination ordinance,” said Equality Florida’s Deputy Director Stratton Pollitzer. In a closely watched race, Anna Brosche beat Kimberly Daniels, one of the most outspoken opponents of new nondiscrimination protections. In the contest for mayor, Republican challenger Lenny Curry unseated incumbent Democrat Alvin Brown despite Brown’s call for a comprehensive review of the city’s discrimination policies.

legally in Canada in 2003, sued Ireland unsuccessfully in 2006 to have their marriage recognized as valid. Once parliament passes enabling legislation by this summer, that Canadian wedding license will become legal in Ireland. But Zappone and Gilligan, a former nun, still plan an Irish ceremony. “There’s nothing like an Irish wedding,” Zappone said. Michael Barron and Jaime Nanci, a gay couple legally married in South Africa five years ago, celebrated with friends at the Dublin City counting center. “Oh.My.God! We’re actually Married now!” Nanci tweeted to the world, part of a cavalcade of tweets from Ireland tagged #LandslideOfLove. Political analysts who have covered Irish referendums for decades agreed that May 23’s landslide marked a stunning generational shift. “We’re in a new country,” said gray-haired political analyst Sean Donnelly. “When I was reared up, the church was all powerful and the word ‘gay’ wasn’t even in use in those days. How things have moved from my childhood to now.”

packing the pub. In the 1970s and 1980s, Norris waged an often lonely two-decade legal fight to force Ireland to quash its Victorian-era laws outlawing homosexual acts. Ireland finally complied in 1993, becoming the last European Union country to do so. This time, the gay community in Ireland managed to build a decisive base of support. “People from the LGBT community in Ireland are a minority. But with our parents, our families, or friends and co-workers and colleagues, we’re a majority,” said Leo Varadkar, a 36-year-old Irish Cabinet minister who in January announced on national radio that he was gay.” For me it wasn’t just a referendum. It was more like a social revolution.” Many gay couples took the moment to declare their intentions or renew their vows. One lesbian couple in Limerick proposed on bended knee at the vote count there, while one of Ireland’s most prominent advocates for gay marriage, American-born Sen. Katherine Zappone, asked her wife live on Irish TV: “Today in this new Ireland, Ann Louise Gilligan, will you marry me?” The couple, who met at Boston College and already were married

DUBLIN (AP) - Ireland’s citizens have voted in a landslide to legalize gay marriage, electoral officials announced May 23 - a stunningly lopsided result that illustrates what Catholic leaders and rights activists alike called a “social revolution.” May 22’s referendum saw 62.1 percent of Irish voters say “yes” to changing the nation’s constitution to define marriage as a union between two people regardless of their sex. Outside Dublin Castle, watching the results announcement in its cobblestoned courtyard, thousands of gay rights activists cheered, hugged and cried at the news. “With today’s vote, we have disclosed who we are: a generous, compassionate, bold and joyful people,” Prime Minister Enda Kenny proclaimed as he welcomed the outcome. Beside him, Deputy Prime Minister Joan Burton declared the victory “a magical moving moment, when the world’s beating heart is in Ireland.” Ireland is the first country to approve gay marriage in a popular national vote. Nineteen other countries have legalized the practice through their legislatures and courts. The unexpectedly strong percentage of approval surprised both sides. More than 1.2 million Irish voters backed the “yes” side to less than 750,000 voting “no.” Only one of Ireland’s 43 constituencies recorded a narrow “no” majority, Roscommon-South Leitrim in the boggy midlands. Analysts credited the “yes” side with adeptly employing social media to mobilize young, first-time voters, tens of thousands of whom voted for the first time Friday. In addition, a series of searing personal stories from prominent Irish people - either coming out as gays or describing their hopes for gay children - convinced voters to back equal marriage rights. Both Catholic Church leaders and gay rights advocates said the result signaled a social revolution in Ireland, where only a few decades ago the
authority of Catholic teaching was reinforced by voters who massively backed bans on abortion and divorce in the 1980s. Voters first legalized divorce only by a razor-thin margin in 1995 and now, by a firm majority, they have rejected the Catholic Church’s repeated calls to reject gay marriage. Abortion, still outlawed, looms as the country’s next great social policy fight. Dublin Archbishop Diarmuid Martin said the “overwhelming vote” against church teaching on gay marriage meant that Catholic leaders in Ireland need to urgently find a new message and voice for reaching Ireland’s young. “It’s a social revolution. ... The church needs to do a reality check right across the board,” Martin said. “Have we drifted completely away from young people?” he asked. “Most of those people who voted ‘yes’ are products of our Catholic schools for 12 years.” David Quinn, leader of the Catholic think tank Iona Institute, said he was troubled by the fact that no political party and only a half-dozen politicians backed the “no” cause. “The fact that no political party supported them must be a concern from a democratic point of view,” he said. Fianna Fail party leader Michael Martin, a Cork politician whose opposition party is traditionally closest to the Catholic Church, said he couldn’t in good conscience back the anti-gay marriage side. “It’s simply wrong in the 21st century to oppress people because of heir sexuality,” he said. After the result was announced, thousands of celebrants flooded into the Irish capital’s pubs and clubs none more popular than the city’s few gay venues. At the George, Ireland’s oldest gay pub, drag queens danced and lip-synced to Queen and the founding father of Ireland’s gay rights campaign, Sen. David Norris, basked in the greatest accomplishment of the movement’s 40-year history. “The people in this small island off the western coast of Europe have said to the rest of the world: This is what it is to be decent, to be civilized, and to be tolerant! And let the rest of the world catch up!” Norris, 70, shouted with jubilant zeal to the hundreds

What Ireland’s Same-Sex Marriage Vote Means to America’s Presidential Election
May 27, 2015

T
he sweeping popular vote in Ireland last week that legalized same-sex marriage had much of the small country celebrating into the wee hours of the night. On an island known for its conservative Catholic values, last Saturday was a time spent celebrating in the streets, in bars, waving rainbow flags, and beeping car horns, as Guinness flowed in celebration. The enormity of the victory was astonishing. The same-sex marriage referendum was affirmed by 62 percent of the voters, and passed in all but a single of Ireland’s 43 districts. This was an impressive victory by any count, but made that much more incredible when put in light of Ireland’s conservative history. Samesex marriage was voted into legality in a place were it wasn’t even legal to get a divorce until 1996. Ireland’s longstanding tradition of marriage for life was brought to its knees by yet again a different national referendum. The people spoke. And it was not only that Ireland spoke, but rather that they spoke against tradition—particularly that of the Catholic Church that has directed its national thought process since the Republic of Ireland broke from British rule in 1922. After last Saturday’s vote to legalize same-sex marriage, Ireland officially put behind a past entrenched in theocracy and tradition. The church is no longer capable of ruling its flock as a new generation of voters is flexing its muscle. This has direct implications for America in the next Presidential elections. In the coming year, as candidates from a myriad of political parties pony
up to throw hats in the ring, there will be a sharp divide between the conservatives and the liberals for control of the nation. The majority of that debate will likely center on domestic economic policy, but same-sex marriage will certainly be a major talking point where social issues are concerned. The United States Supreme Court is likely to rule on the issue of same-sex marriage next month, and the expectation is that the highest court will decide in its favor, mandating states to follow suit. Yet, that may well not be the end of debate. It will take time for certain states to adjust to a federal ruling that would require them to recognize gay marriages. It will take even longer for conservatives in this country to adjust to the concept. Where in the past, much of that acceptance would have come through religious discipline and guidance, in the next Presidential elec-
tion, that push will come from social media—just as it did in the Irish vote last week. Social media was successfully used to mobilize young, first-time voters in Ireland. The “yes” campaign also featured personalized stories from prominent Irishmen and women who either came out as gay or revealed their hopes for gay children. Currently, the Republican party is strongly anti-gay marriage, as are its announced Presidential candidates. That position is chasing away the youngest voters who might otherwise be supporters if it weren’t for the party’s exclusionary stances. Yet, it is these young voters who will likely decide who will become the next President of the United States. If America can learn anything from the Irish vote on same-sex marriage, it is the importance of our youth in elections. Yet for all their importance, these
voters have not really been given a place at the table by either of the two parties in this country. This is particularly true within the LGBT community. No one knows that better than Jerri Ann Henry, the campaign manager for Young Conservatives for the Freedom to Marry. “There are a lot of LGBT people out there who are brilliant small business owners, who hold to the principles of limited government, strong families, fiscal conservatism and strong national security — things that we as Republicans love — but they don’t have a place in the Republican Party right now,” she says. “What’s unfortunate is they also clearly do not have a place in the Democratic Party.” As the Irish vote clearly suggests, there is a social revolution going on in the world. Every U.S. political party needs to realize that fact or face certain defeat at the hands of change.

y any standard, Bill Novak, 78, and Norman MacArthur, 76, are in love. They’ve been together for more than 50 years, and intend to die in each other’s arms. Though they have wished to be legally married for decades, Bill and Norman aren’t wed…at least not yet. Before they could exchange vows and throw rice, the couple had a little legal matter to resolve. You see until last week, MacArthur was Novak’s adopted son as well as his lover. There’s a movie in there somewhere. The Novak/MacArthur saga began when both were in their twenties and began dating. One year melded into the next, until 1994 when they officially became domestic partners in New York State, which they then called home. Two years later, they decided to retire and moved into a beautiful stone home in Erwinna, Pennsylvania, some 40 miles north of Philadelphia. Unfortunately, at the time, not only did Pennsylvania not recognize samesex domestic partnerships, it had in fact just passed a statutory ban on same-sex marriage. Undeterred, and wanting to protect their combined estate, Novak adopted MacArthur in 2000. The move reduced their inheritance tax liability and gave them hospital visitation and other legal rights then unavailable to same-sex couples. “We were told when we started to look into this that hell would freeze over before Pennsylvania would allow same-sex marriage,” according to MacArthur. “So doing the adoption was literally the only thing we could do to give legal underpinning to our relationship.” Imagine the couple’s excitement when, on May 20 of last year, a United States Federal District Court judge ruled Pennsylvania’s same-sex marriage ban unconstitutional. MacArthur and Novak were

And while MacArthur has said his status as Novak’s legal son did not change the dynamics of their relationship in any way, he still is thrilled at the prospect of finally being able to officially marry his former dad. About 30 of the couple’s friends were in the courtroom last week when the judge, noting rapid acceptance of same-sex marriage nationally, agreed to vacate the adoption. “The courtroom burst into applause. I burst into tears,” MacArthur recalled. “They were certainly happy tears. After months of investigating ways that we could do this and finally having the decision coming down in our favor, I’m still walking three feet above the ground.” This week, Novak and MacArthur were issued a marriage license, but are waiting until the summer to actually tie the knot. Well, after waiting over 50 years, what’s a few more weeks. One suspects, there are some preparations to be done, and, yes, a honeymoon to plan. finally free to marry, except, of course, they weren’t. It was that father and son thing that stood in their way. While there are no statistics I could locate that count the number of gay couples who have used adoption as a means to obtain legal recognition of a relationship, I suspect the number is low. The practice was also controversial within the gay community, according to Angela Giampolo, a Philadelphia attorney specializing in lesbian, gay, bisexual and transgender law. Giampolo said she was approached years ago by a gay couple who wanted her to help them navigate the adoption process, but she turned them down. “What a lot of advocates back then were saying was this was delegitimizing’ of samesex relationships,” said Giampolo, who blogs as Philly Gay Lawyer. Also, unlike a marriage, the adoption could not be undone, she said she told the couple. Or at least no one had ever tried and succeeded until last week when Judge Gary B. Gilman of Bucks County Orphans’ Court vacated the adoption decree.

CAPITOL BEAT BY LINDA PENTZ
Gays In Plays Get A Whole New Approach “Ribbed. Extremely safe. Pineapple.” These words, spoken with equal parts relish and pathos, are heard in the closing moments of the new play, Jumpers for Goalposts, that just opened at the Studio Theatre in Washington, DC. Jumpers tells the hilarious and also moving story of a really hopeless soccer team that is competing in a gay, lesbian and transexual recreational soccer league in Hull, a northern city in Britain. “Ribbed, extremely safe and pineapple” refers, of course, to a condom. It’s a pivotal moment in the play and a line that manages to evoke laughter in an audience that is at the same time choking back tears. But while Jumpers does deal with specifically LGBT issues, it is also very deliberately not a gay play. Nor is it a play about gay people. It’s a play about life, love, loss, winning and losing — in which four of the five characters are gay. And in that sense, it marks a bit of a departure from theatrical norms. “Gay plays” such as Torch Song Trilogy and The Normal Heart have tended to deal with “gay issues,” especially AIDS and homophobia. These plays remain very important in their own right. While providing an empathetic dramatization of daily life for LGBT audiences, they also serve to educate and enlighten straight audiences who have no first-hand experience of this kind of discrimination or suffering. And LGBT characters are beginning to appear with more frequency and with quite a high profile on television, although perhaps less so in film and theatre. Nevertheless, their very definition as “LGBT characters” still separates them from the rest of the so-called “normal” characters who remain the overwhelming majority. Tom Wells, a gay British playwright whose work is being premiered in the U.S. for the first time with Jumpers for Goalposts, is trying to change all that. “My experience of growing up as a gay man is you have mates and you do stuff that everyone does,” said Wells. “I
wanted to write a straightforward play that has gay people in it.” With this approach, Wells is turning an important corner in contemporary theatre, using the ordinariness of daily life to help both narrow the gap and broaden the understanding and empathy between the LGBT and straight communities. So gone is the funny gay, the token bestie gay, the queenie gay. The characters in Jumpers feature a timid librarian, an aspiring soccer coach, a forceful female pub owner, a down-on-his luck
from his diary, and perhaps speaking for Wells’ own aspiration in writing the play: “My life is really boring but for some reason I feel the need to record it in quite a bit of detail.” The detail in Jumpers emerges in postgame vignettes that are funny, witty, and occasionally sad. The characters are, too. We laugh along with them. We share their pain — of yearning for someone, being rejected, mourning the departed, watching dreams evaporate, suffering the pain of endless losses on the soccer field and off. Yet, amidst these quotidian
Jumpers, when Beardy does remove his hat, there is no gasp of horror from his teammates. It is treated, as Wells did with his own beating, as somehow inevitable. As the LGBT movement continues to strive for acceptance and equality, it will be interesting to see if the sexuality of characters portrayed on the stage will begin to matter less and less. Will playwrights like Wells serve to unite us in our shared experiences, helping to build greater compassion and understanding? It’s certainly the point we
busker and a grieving widower. Only the widower is straight. Almost everything that troubles or even entertains these characters, has nothing to do with their sexuality. Viv just wants to win the trophy for her pub. Beardy aspires to fame as a singer. Luke wishes he could stop getting things wrong all the time. “I can get anything wrong,” he asserts with a mixture of pride and shame. “It’s like a superpower!” Danny wants to pass his soccer coaching exam and tell Luke he loves him. And Joe just wants to do better in goal, and for Viv to give in to her grief at the loss of her sister, who was also his wife. As Luke explains it after reading
moments, Wells manages to skillfully remind us that there are darker experiences still unique to gay life. Thus, the busker, Beardy, refuses to remove a hat that conceals a huge scar, the result of being “gay bashed.” Wells himself was dragged into an alley and beaten up for “wearing a gay hat” while he was writing the play. But it was the reaction of the straight community to this incident that struck him more than the beating itself. “What surprised me was how surprised everyone else was,” he said. “I think the world’s still a bit more homophobic than you realize if you’re straight. It didn’t feel like a massive surprise to me that it happened.” In
arrive at when Jumpers for Goalposts ends. It’s an important destination. The immortal “pineapple” line belongs to Luke, who, after running scared from Danny’s admission that he has HIV, returns to make amends. “There’s no one I’d rather put a condom on than you,” Luke tells Danny with sweet sincerity. As the words leave his lips, you sense a palpable sigh of relief from the audience, even a silent cheer amidst the laughter and tears the line evokes. It’s ushering in something else important and rare for the subject matter. A happy ending! Photo: Igor Dmitry

Civic Center. Bear in mind that all of this has been happening in the Pensacola area -- considered one of Florida’s most conservative regions politically – at the same time that we have been hearing so much about the growing LGBT communities and related development within the more southern counties of Miami-Dade and Broward. Just because those of us who prefer to live in South Florida aren’t seeing other parts of Florida on television and in the movies, doesn’t mean life isn’t happening. Now head east from Pensacola to Jacksonville on the other coast. It may surprise you to learn that Jacksonville is the largest city in Florida by population. It’s another metropolis that wouldn’t traditionally rank that high when it comes to diversity, tolerance or LGBT friendliness. But as a result of the most recent citywide election held on May 19, a majority of the city council in Jacksonville now back adding sexual orientation and gender identity to the city’s nondiscrimination ordinance. According to Equality Florida, its
local volunteers, working with their counterparts from the Human Rights Campaign, were able to successfully mobilize more than 100,000 voters in an aggressive campaign to elect proequality council members. Advocates say they are now confident that the new makeup of the council will lead to the passage of an expanded nondiscrimination ordinance--voted down three years ago. But even if the council approves protections for LGBT people, the new mayor, Lenny Curry, could veto them. Curry said he doesn’t think discrimination exists in Jacksonville. Thankfully, when a mayor vetoes a bill, the council can override it. What does this all mean? As the recent legislative session in Tallahassee shows, there are still plenty of forces at work that could see our agenda slow down or stopped in its tracks completely. But as this past Memorial Day weekend and the recent Jacksonville election show, it’s now much too late for that. The very noticeable cracks of progress have begun to appear throughout North Florida and beyond.

ties going down every night starting Friday night and continuing through Monday evening. Parties, on the beach and off, have begun to attract international DJs and entertainment industry celebrities. Local experts say the influx of visitors provides a huge, crucial boost to the region’s economy. While most of the visitors drive in from surrounding areas, an increasing number are starting to fly in as well. In fact, from Memorial Day on for the next 10-11 weeks during summer, it’s a do or die situation for most area hotel and restaurant owners. All need to make enough money during the summer to get them through the weaker winter or shoulder seasons. And that’s where the LGBT community provides vital support. According to local business owners, LGBT events have been held on Santa Rosa Island since the mid1970s. Then, in the late 80s and through the 1990s, Memorial Day weekend really took off, with parties springing up in warehouses and eventually moving to more mainstream venues like the Pensacola

ast week, I wrote about the rise of Orlando as a global LGBT destination. This goes beyond just tourism, which has been drawing in visitors to the theme parks and Gay Days for years. It’s becoming a cultural hub of creativity, leisure and tolerance due to a variety of legal and commercial factors. Now comes word from across the pond that Ireland has become the first country to legalize samesex marriage by popular vote. This predominantly Catholic country has made a huge statement for human rights. I would not be surprised if the Catholic head of state, Pope Francis, continues to carry this message of acceptance and diversity when he visits Cuba and the United States later this fall. These global trends are highly encouraging of course. But as Orlando illustrates, Florida itself continues to make great strides as the ripple effects from marriage equality continue to wash over the state. While South Florida has been attracting LGBT singles and couples for years, North Florida is now beginning to show signs that the social divide between north and south has become less stark. During the last 10-20 years or so, what was clearly a blue versus red schism (and still is to a large degree), continues to slowly blur with time. This past Memorial Day weekend witnessed thousands of LGBT people attend holiday festivities at Pensacola Beach. Organizers say more than 150,000 have attended LGBT-related events during the past couple of Memorial Day weekends. The Emerald City bar in downtown Pensacola has reportedly come to serve as a kind of party central in past years and this year has proven to be no different with major activi-

THE WEEK
DINING
I ventured out on Sunday with no real destination in mind. When that happens, I gravitate to areas with a lot of restaurants (east side of Fort Lauderdale). While cruising down Sunrise Blvd., I had an urge to check out the new wine lounge everyone has been talking about before catching a bite to eat. Mod Wine Lounge offers the perfect space to gather with friends and enjoy perfect wine and small plate pairings. This establishment is located directly next to the Gateway Theater on Sunrise right at the curve to Federal Highway. Parking is available with metered spots along the adjacent streets. Mod is a step back in time to a period a lot of us remember with great fondness. Decorated in a hip “mod” motif, I instantly felt very comfortable. The lounge is laid out with an ample bar on one side and a generous lounge area throughout the remainder, filled with couches and comfy lounge chairs. There is also some seating around the front window. Upon entry, we were greeted by Clint Gordon, the proprietor (who opened the lounge along with his partner J.W. Arnold) and Eric, our friendly wine attendant. Mod offers a wide selection of both red wine and white wine along with a “small plate” menu. Eric explained the various wine selections in great detail. Bold Whites include both Chardonnay oaked and unoaked. Light whites offer Sauvignon Blanc and Pinot Grigio and sweet whites have Riesling and Mocato. Finally are the interesting whites – Sea Monster Octopussy ($14/$42), Batasiolo Gavi di Gavi ($13/$39) and Marques de Caceres Deusa Nai Albarino (bottle only $33). A number of the selections are offered by the glass as well as by the bottle. Next up are the “Bubbles” – Champagne, Rose and Prosecco. Included in this group is a very interesting Blanc de Bleu, a pure 100% California Chardonnay with an added hint of Blueberries It is a delicate sparkling wine reserved for memorable celebrations (I had to leave with a bottle of this!). The “Reds” run the gamut from bold reds (Bourdeaux, Cabernet Sauvignon and Malbec) to medium
(merlot and zinfandel) to light (pinot noir). Rounding out the reds are some “interesting reds” and a “port” selection. As with the whites, there are offerings by both the glass and the bottle. We ordered a nice white zinfandel – Cosentino Winery--The Zin ($10/$30). Please note – the wine selections come from various destinations around the world – not just domestic – so there is something for everyone! I was not going to leave without taking a walk through the small plate menu. Offerings include salty and savory country pate – aromatic peppercorns scent this rustic, Traditional Chicken and Pork Pate, served with baguette slices ($10) and a Duo of Dips – expertly blended olive tapenade and classic organic hummus, served with pita chips and baguette slices for dipping ($10). There is a nice section titled “Sweet” made up of a New York Cheesecake ($8), Dark Chocolate Bread Pudding ($5), Momma Rosalie’s Rum Cake ($4) and Dark Chocolate Covered Almonds ($3). There is a “Hearty” section as well featuring a Charcuterie Board – a daily selection of imported domestic cheeses, cured meats and all the accoutrements: prosciutto, soppressata and calabrese salami, organic Oregon blue, 5-year aged English cheddar and mini mozzarella (large $24 and medium $15). I opted to sample this dish. WOW. The presentation alone made the dish not to mention the great taste. In speaking with Clint, most folks find the lounge before and after the movies. It is perfectly located and very inviting. I used this location as my appetizer for my next meal and I very glad I did (stay tuned). Please stop in a visit this great venue. The formal grand opening is weeks away and I am sure it will be quite an event!!!

5/30 Daniel’s Husband The recent legalization of gay marriage had an unfortunate downside for playwright Michael McKeever—his new play Daniel’s Husband became completely obsolete. The play explores the relationship between Mitchell, who doesn’t believe in gay marriage, and Daniel, who wants to be married. McKeever had to extensively rewrite the play, taking into account Florida’s new laws supporting marriage equality. The revamped play was work-shopped as part of Jan McArt’s New Play Reading series and will be closing out Island City Stage’s third season. 8:00 p.m. Empire Stage. 1140 N. Flagler Dr. Fort Lauderdale. 33304.

Best known as the acclaimed Hitchcock film, Frederick Knott’s 1952 play Dial M for Murder tells the story of Tony Wendice, an ex-professional tennis player, and his attempt to murder his adulterous wife Margot. The film starred Ray Milland, Grace Kelly, and Robert Cummings and is considered a classic. Curtain Call Playhouse—the most active local touring company—will be performing the stage version throughout May and June. 2:00 p.m. Sunrise Civic Center Theatre. 10610 W. Front dumbbell raises are dynamite for the front and rear deltoids. Stand with your feet slightly apart. Hold the dumbbells with your palms down (overhand grip). Resting the dumbbells on your thighs or slightly to the side, raise the dumbbells forward to shoulder height alternating each side. Bent over lateral raises are great for the overall shoulder, but especially for the rear deltoids and upper back. Stand with your feet spread apart and your knees slightly bent. Bend forward at the waist and keep your back straight. Hold the dumbbells with your elbows slightly bent. Inhale and raise the dumbbells to your sides. Exhale as you complete the movement. The upright row is another exercise for the mid and rear deltoids. Holding a weighted bar in front of you with an overhand grip, pull it to your chin while keeping your elbows above the bar. Keep the bar close to your body. With each of the above exercises try performing three to four sets of 10 to 12 reps with a manageable but challenging weight. Be careful to maintain proper form with each exercise. Train shoulders twice a week for best results! So there you have it, a workout that will give you those distinctive boulder shoulders. With regard to shoulders, besides having an arsenal of exercises, I also suggest checking your posture. Many guys have a forward slump which causes rounded shoulders. Remember, just stand up straight, chin up, shoulders back, pecs out and enjoy the attention you’ve earned!

hat constitutes a really fine physique? Everyone has an opinion. A tapered, V-shaped back, biceps like soft balls, a shapely butt, and a sleek well defined six-pack are great places to start. A physique with these assets is well worth flaunting anywhere! Just don’t forget to work those legs! Nothing looks quite as silly as a big overly developed upper body supported by toothpick legs. One muscle group that guys sometimes forget about, or simply train routinely, are the deltoids. Strong well developed deltoids will give your upper body that extra flair. The stronger these muscle are, the more your deep rotator cuff muscles will be protected from injury. The deltoids are located at the top of each arm and consist of the anterior or front deltoids, mid or lateral deltoids, and the posterior or rear deltoids. Well developed deltoids resemble canon-balls and they’ll give your physique the extra “POW” that will leave them staring! Here’s my guide to exercises that will help you to attain bigger, broader shoulders: Seated dumbbell presses are great for front and mid deltoids as well as for traps and triceps. Sit on a bench with your back straight. Never arch your lower back during any weight training exercise. Grasp two dumbbells with an overhand grip and lift them to your shoulders, palms facing forward. Inhale and press your arms to an extended vertical position. Exhale as you lower them back to your shoulders. Side lateral raises are great for the mid deltoids and they help you to achieve a broader look to the upper body. Stand with your feet slightly spread. Keep your back straight, your arms hanging at your sides. Holding a dumbbell in each hand, raise the dumbbells to shoulder height, keeping your elbows slightly bent. Return to the starting position slowly and intently.

(Antoine-Olivier Pilon). In a not-toodistant future Canada, following the passage of a law known as S-14, Die is forced to take responsibility for the care of her irrepressible offspring. Unwelcome in schools as well as detention centers (where he started a fire injuring a fellow teen), Steve comes under Die’s ill-equipped supervision. Intending to home-school Steve, although she is relatively uneducated herself, Die encounters a series of events that would probably topple the average mother. Her car is totaled in an accident, she loses her job and Steve is increasingly violent and dangerous. Enter neighbor Kyla (Clément), a schoolteacher on sabbatical following a breakdown that has left her a shell of her former self. In an unexpected turn of events, Steve and Kyla bond (as Steve and Die’s relationship unravels), and the two wounded souls come to the aid of the other. But, of course, the period of healing is short-lived and the downfall is agonizing. Dolan has never been more daring and enthralling. The alternating dark (hints of incest, the uncontrolled self-destruction) and light (the unlikely friendship that develops between the women) aspects of the film make Mommy as disturbing as it is entertaining. Even at well over two hours, Mommy is well-worth every minute. There are no bonus features to speak of on the DVD+Digital edition.

n Eat With Me (Wolfe), Emma (Sharon Omi) is in a deadend marriage to Ray (Ken Narasaki). Ray is thoughtless, a loud snorer, and when he uses a wire cutter to cut off his too-tight wedding band, Emma has had enough. She packs a suitcase and shows up at the restaurant where her hot gay son Elliot (Teddy Chen Culver) is the cook and boss. The restaurant, serving average Chinese food, was left to Elliot by his late uncle and he feels obligated to keep it going, in spite of being six months behind on the mortgage. Elliot makes room for Emma in his L.A. condo, but they have an oil and water relationship. Elliot claims to have a system to the clutter in his house, but neat-freak Emma can’t help but straighten it up. Elliot cooks all day at the restaurant and prefers to dine out, at food trucks, for example, when he’s hungry. Emma likes the tacos they have at one such food truck, but can’t resist cooking him an incredible breakfast. One taste of Emma’s cooking reminds Elliot of her culinary acumen. But their relationship is still strained due to Emma’s inability to come to terms with Elliot being gay. Elliot’s busybody neighbor Maureen (Nicole Sullivan of MadTV fame) attempts to help Emma be a better and more accepting mother. Meanwhile, Elliot, who has trouble maintaining a long-term relationship, meets musician Ian (Aidan Bristow). There is potential and spark,
