Wal-Mart Accused Of Same-Sex Bias In Class-Action Lawsuit BOSTON (AP) - A Massachusetts woman filed a class-action lawsuit Tuesday accusing WalMart of wrongly denying employee benefits for same-sex spouses. Jacqueline Cote says Wal-Mart repeatedly denied medical insurance for her wife before 2014, when the retail giant started offering benefits for same-sex spouses. After Cote’s wife was diagnosed with ovarian cancer in 2012, the couple incurred $150,000 in medical costs. The lawsuit filed in U.S. District Court in Boston seeks damages for the couple and any other WalMart employees who weren’t offered insurance for their samesex spouses. A federal commission concluded that Wal-Mart’s denial amounted to discrimination and said in May that Cote could sue. Wal-Mart didn’t immediately respond to requests for comment. Wal-Mart, based in Bentonville, Arkansas, agreed in 2014 to start offering medical insurance for same-sex spouses. But the lawsuit brought by Gay & Lesbian Advocates & Defenders and the Washington Lawyers’ Committee for Civil Rights and Urban Affairs claims that hundreds or thousands of the company’s employees had already been wrongly denied benefits for their same-sex spouses.
No other employees are named in the suit, but it seeks damage for those who come forward. It also seeks damages for Cote and her wife, Diana Smithson, and it asks Wal-Mart to acknowledge a legal responsibility to continue offering benefits for same-sex spouses. Gay & Lesbian Advocates & Defenders, a nonprofit group that helped file the lawsuit, said Cote’s case is the first class-action lawsuit filed on behalf of gay workers since the Supreme Court legalized samesex marriage nationwide in June. Cote, of New Bedford, previously took her case to the U.S. Equal Employment Opportunity Commission, which decided in January that Wal-Mart’s denial amounted to discrimination and gave her the go-ahead in May to bring the lawsuit. Smithson quit in 2007 to take care of Cote’s elderly mother. That prompted Cote to try to add Smithson to her health plan the following year. Cote said she tried to enroll online, but the system wouldn’t let her proceed when she indicated her spouse was a woman. When she sought an official explanation, she was told that same-sex spouses were not covered. Each year thereafter, she tried and failed to enroll Smithson - including in 2012, when Smithson got her cancer diagnosis.
ATLANTA—Blake’s on the Park, Atlanta’s most popular gay nightclub, has been hit with accusations of discrimination for a new dress code posted last week. Among items outlawed at the mixed club: hoodies, oversized tank tops or T-shirts, sweat pants, dew rags, sunglasses, backpacks, oversized chains and medallions, slippers, athletic wear, saggy pants, headphones and “weapons and bad attitudes.” “To me I took it as ‘We prefer blacks not to be here’ without saying ‘No blacks,’” Gee Session-Smalls told the Georgia Voice. Session-Smalls was at Blake’s last Thursday evening and posted a picture of the sign to social media, which in turn flooded his Facebook account with comments, and the controversy it caused. “Even though many of us do not dress like that, I still take offense to it because I know you’re trying to eliminate a group of people.” That Session-Smalls would be the one to identify the snub and post it online is ironic, since the biracial man and his husband Juan are the founders of The Gentlemen’s Foundation. GF not only celebrates love, but also hosts an annual black-tie event in Atlanta that caters to the AfricanAmerican LGBT community. Of the black-tie event, SessionSmalls has been quoted as saying, “Black gay men wear such shame. We are proud of who we are. When you walk away, I want you to be wowed, take away a sense of pride and feel a sense of energy in the room. Just be proud.” But Session-Smalls felt no pride last Thursday. He was told by the doorman that the dress code was posted about half-an-hour before his arrival, and while Session-Smalls got admitted to the club/restaurant, he worried about how many of his community
would be turned away. “I think that in Atlanta, especially amongst the black community, there is an overall feeling that we aren’t really welcomed in a lot of the gay bars and establishments,” Session-Smalls told the Georgia Voice. “Blake’s being one of them, but we don’t have many choices of where to go.” In response, the management of Blake’s posted the following explanation on its Facebook page: In an effort to improve the safety of our customers at Blake’s on the Park, the management team met to discuss measures that might be taken to curb the presence of unidentifiable individuals within the establishment. The primary concern was the wearing by some of hoodies and dark glasses so as to make oneself unidentifiable. When we have had to review videotape for security reasons, the perpetrators have consistently been wearing such attire. Our customers must feel safe and the banning of hoodies and dark glasses, especially at night, will be enforced. The recent posting of a laundry list of banned dress was not developed by management of Blake’s. The dress code is a standard code adopted by many local clubs and bars. Our intention was to post an edited list to address our specific needs, but the code was prematurely posted in error prior to the appropriate edits having been made. We apologize to anyone who was offended by the error. We welcome ALL at Blake’s, and we will continue to make efforts to ensure the safety of ALL our customers. There were over 1,000 comments about the explanation, many of them labeling the post “backpedalling.”

NEW YORK (AP) - As he praised a recent Supreme Court ruling on same-sex marriage, Vice President Joe Biden on Thursday said more still needs to be done to protect LGBT Americans. Biden spoke at an event in Manhattan hosted by Freedom to Marry, a New York-based organization. He praised the Supreme Court’s recent ruling that same-sex couples have a right to marry anywhere in the United States, and said federal officials will continue to fight for the rights of the lesbian, gay, bisexual and transgender community. Biden said he has been thanked across the country for his work on LGBT issues, but told the assembled audience Thursday, “You don’t owe me or Valerie (Jarrett) or the president any thanks. We owe you.” “I really do think it is an incredible job you all have done,” Biden told the crowd. “This has been a heroic battle.” “In my view, the court’s decision was inevitable,” he said. “So many remained silent for fear of being ostracized. You set them free.” He told several hundred other elected officials, community leaders, advocates and celebrities that more needs to be done to inform Americans that LGBT people can be fired from their jobs in 32 states because of their sexual orientation. “There are still 32 states where marriage is recognized in the morning and you can be fired in the afternoon,” he said. “I don’t believe people in those states know you can be fired for being gay.” “We have to raise the issue up,” he said. “Once people realize, this will end as well.”

WASHINGTON, DC (AP) The Pentagon’s current regulations banning transgender individuals from serving in the military are outdated, Defense Secretary Ash Carter said Monday, ordering a six-month study aimed at formally ending one of the last gender- or sexuality-based barriers to military service. Carter said he is creating a working group that will review the policies and determine if lifting the ban would have any impact on the military’s ability to be ready for battle. But he said the group will begin with the presumption that transgender people should be able to serve openly “without adverse impact on military effectiveness and readiness, unless and except where objective, practical impediments are identified.” “The Defense Department’s current regulations regarding transgender service members are outdated and are causing uncertainty that distracts commanders from our core missions,” Carter said in a statement released Monday. “At a time when our troops have learned from experience that the most important qualification for service members should be whether they’re able and willing to do their job, our officers and enlisted personnel are faced with certain rules that tell them the opposite.” Carter asked his personnel undersecretary, Brad Carson, to lead the working group of senior military and civilian leaders to take an objective look at the issue, including the costs, and determine whether it would create any insurmountable problems that could derail the plan. The group would also develop uniform guidelines. During the six months, transgender individuals would still not be able to join the military, but any decisions to

And finally, America is coming out of an age of bigotry and homophobia, into a world where the first gay Lord President can stand before you today with his husband at his side.
Iceland fall apart morally? No. But in 2013, Icelanders booked hundreds of tickets for an event featuring anti-gay U.S. evangelist Franklin Graham so that they could not attend and instead leave their seats empty in protest at his presence in their country. But a gay president in the United States? If that were to happen it could prompt a whole swath of religious fundamentalists like Graham to emigrate, if they haven’t already been raptured heavenwards by then. (Wait, now there’s an idea!) But maybe it won’t be that drastic. Gradual change is happening. “The likelihood of there ever being an openly LGBT U.S. President grows every day,” said Stephen Peters, a national spokesperson for the Human Rights Campaign. “As LGBT people across the country in various positions of leadership – including in public office – continue to come out, they are helping to dispel myths and stereotypes about who LGBT people are and what our lives are like,” he said. “In our journey towards fairness and equality for LGBT people, we’ll continue to win by telling our stories and living openly and honestly.” And hopefully, without any zombies in the basement.

Last month, America did indeed seem to emerge from at least some of its past bigotry and homophobia. The justifiable — and enjoyable — euphoria over the Supreme Court decision to legalize same-sex marriage in all 50 states, remains suspended in the rarified air we can all breathe; for now. But “the first gay Lord President?” It’s fiction of course — along with the lofty enhancement to the usual POTUS moniker. Such aspirations remain locked in the imaginations of the creative and fanciful among us, such as out playwright, Robert O’Hara. O’Hara’s “Lord President” is Thom Valentine, the year is 2063, and there are zombies in the basement of the presidential residence deep beneath Mount Rushmore. Valentine’s hopeful election monologue opens O’Hara’s wild, dystopian fantasy — Zombie: The American — that recently ended its theatrical run in Washington, DC at the Woolly Mammoth Theatre. Valentine concludes the speech with “the words of one of our greatest leaders,” quoting verbatim from President Obama’s second inaugural address: “Our journey is not complete until our gay brothers and sisters are treated like anyone else under the law. Hip hip hooray! Marriage equality is the law of the land! Which means that gays and lesbians all over the country can finally do something many of them have been wanting to do for years: force straight people to have sex with them. Gone are the days where you pined over that dude-bro at the gym or feared that your married (to a man) friend would find out you have a crush on her. It’s Homo Rule now. All bets are off. Let the games begin! And may the odds be ever in gay-favor. Sounding the alarm for right-wing paranoids everywhere is Tim Brooks, senior pastor of Christian Ministries Church in Hot Springs, Arkansas. Brooks took to the Wall Builders radio show, hosted by Wall Builders founder David Barton who declared that the Supreme Court’s marriage ruling was “unambiguously wrong” and violated “the moral standards specifically enumerated in our founding documents.” So he’s not a fan. Brooks has some interesting theories, inspired by the stories of the Bible, about what living in America is going to be like now that the gays have taken over. “Here is the only thing that will satisfy this agenda, and it’s very clear: participation,” Brooks told Barton. Yes, when it comes to the homosexual agenda, participation is 100 percent of your grade. So get crackin’ heteros. He referred to the story of Sodom and Gomorrah — you know, the one where a couple of angels go visit Lot’s house
and an angry “gay” mob demands that Lot toss his guests to them so that they can do it with them. But Lot’s like, “Nah, have my daughters instead.” And then later Lot’s wife turns into salt, which is the origin story of why Americans use a Lot of salt on our food, I’m pretty sure. “We want you to come out of your house and participate with us,” Brooks says, speaking for the mob. “Now, as I read this story, Lot never tried to force his lifestyle on them, he never even brought that up. They are trying to force their lifestyle on him … come out and have sex with us, have to participate. They’re going to force participation and, Rick, that’s what we’re seeing around the country.” He then lists a bunch of places in the Bible where he claims towns are overrun with gay-mob rule. Less clear is where gay mobs are pillaging villages across the country raping people. But heterosexuals will want to check TripAdvisor very carefully from now on. “It’s unsafe in a city where the homosexual agenda has control,” Brooks says. “It’s unsafe when the homosexual agenda takes over the city. Speaking of which, Pride Month must have been a terrifying time for poor Pastor Brooks, what with the homosexuals “taking over” cities across America. And here you were thinking that gays were helping to revitalize cities across America and driving property values up. The only people that’s unsafe for are the poors, which right-wingers have proven time and time again they don’t care about. Make no mistake, gentrification driving lower-income residents out of their cities is a serious problem. But, hey, who has time to worry about economic inequality when gays are sexing everyone in the city by force? Pretend problems are much easier to deal with.

“Delray Beach is a first-class city with a diverse community,” Mayor Cary Glickstein said in a statement. “This ordinance lets people know that Delray Beach is open for business for everyone and that we oppose prejudice and discrimination of all kinds.” Delray Beach becomes the fifth Palm Beach County to enact such an ordinance, joining Boynton Beach, Greenacres, Lake Worth, and West Palm Beach. The PBCHRC has said it would continue to fight against discrimination against the LGBT community, recognizing that there is still much more to do, even with the United

The company, like all others in the “at will” state of Florida, can fire workers for any reason and without notice. “The reason I’m coming forward about this is that I don’t want anyone to make the same mistake I did about posting jokes like this on Facebook,” he told HuffPost.

CAPE CORAL, FL--Ryan Uhler is out of work, and all because of a Facebook post that was prompted by the Supreme Court’s June 26 ruling on same-sex marriage. Uhler, 32, a resident of Cape Coral, Florida, thought he was being clever when he wrote: ”How is marrying a dog different if you love them? Today I hope we can focus on doggy-style love. I love my dog Rocco, and he loves me. Hopefully one day we can be married.” Forget that Uhler is already married and the father of one. Forget that he was presumably joking. Last Tuesday his employer, Grace Investment Group, fired him from his position as a digital marketing specialist. “I was blindsided,” he told The Huffington Post. “I didn’t think anyone there knew how to use Facebook.” He also told HuffPost that he didn’t mean anything derogatory, and has no problem with the Supreme Court’s decision, though admits that likening same-sex marriage to an animal wedding is a cliche often used by critics of LGBT rights. “I’m very neutral about poli-

Anthony’s Coal Fired Pizza: Italian Goes Mainstream Anthony’s Coal Fired Pizza should be on your restaurant rotation. I frequent the Planation location, but I have included the east Fort Lauderdale address for our readers’ convenience. This is a very successful operation with locations all over the country and six locations in Broward alone. They attribute the success of the operation to a combination of top-quality ingredients, a simple, consistent menu, authentic, coal ovens and a staff that treats guests like “family.” To begin, they have a very interesting story. Growing up on Long Island in a traditional Italian family, Anthony Bruno, the proprietor, had a passion for great food that started at a very young age. His father, Anthony Sr., moved to South Florida in 1982 and father and son debuted Anthony’s Runway 84, (one of the area’s most celebrated and popular restaurants). In 2002, Anthony unveiled a new concept that introduced the taste of coal oven pizza to South Floridians. He believed there was a
great opportunity to create pizza that rivaled the ones he enjoyed growing up in New York. The Plantation location is very nicely laid out. There is table seating both indoors and out. There is a fully stocked bar at one end of the restaurant to imbibe while waiting to be seated, or just to enjoy a sporting event on one of the many flat screens that adorn the walls. While it is not the largest of spaces, it is never cramped, but it is quite popular, so get there early or be prepared to wait (the wait is worth it). There are old albums and covers adorning the wall and a great poster of John Lennon. It is a very nice atmosphere. After being seated by the hostess, I ordered the Roasted Chicken Wings to start with. These wings are special. They are served with caramelized onions and focaccia bread. I get the small (10 wings for $9.50) but they have a large (20 wings for $15.50) for the heartier appetite. I compliment this order with a Coal Oven Traditional Pie
(12” for $12.25; 16” for $15.50). They cook their pizzas in an 800-degree oven that provides a ‘well-done’ flavor that has become their trademark. They have a number of different specialty named pizzas but you can create whatever you are in the mood for and they will make it. Each additional topping is $1.75 for a small or $2.75 for a large. The popularity of this unique pizza, which takes only four minutes to cook, and the restaurants’ classic, casual ambiance has helped Anthony’s Coal Fired Pizza build an almost cult-like following. With a focus on fresh ingredients and authentic recipes, Anthony’s traditional and specialty pizzas (with dough made daily and stretched to order) are delicious. In addition to the great items I ordered on this visit, they offer a wide variety of salads and coal fired sandwiches including Anthony’s Classic Italian Salad—enough for two at $9.25. You can add gorgonzola (2.25) or mozzarella (2.25); Fresh Mozzarella and Tomato Salad ($6.95); Italian Tuna Salad Sandwich ($8.50)– served with lemon olive oil, tomato and arugula served on focaccia bread; and a Traditional Calzone with mozzarella and ricotta ($14.75 for a small; $17.75 for a large). An interesting section of the menu features Italian soul
food, served family style with focaccia bread; Meatballs with Ricotta Cheese--large hand-rolled meatballs slowly cooked in tomato sauce ($10.95 for 4; $5.95 for 2); Eggplant Marino--thinly sliced and served with fresh tomato sauce and Romano cheese ($10.95); and Broccoli Rabe & Sausage - bitter Italian greens sautéed in garlic and olive oil served with Italian sausage ($10.95). Finish your dinner off with an Espresso ($3.00) and a piece of New York Style Cheese Cake ($4.75). They have a special lunch menu and catering as well. Anthony Bruno often compares the restaurant industry to sports, pointing out that an athlete could be cheered by the fans one game, then booed the next. His motto: “I’m only as good as my last pizza.” Do yourself a favor and try Anthony’s Coal Fired Pizza. I’m sure you will become a fan!

Infinitely Polar Bear Infinitely Polar Bear (Sony Pictures Classics) marks the directorial debut of the film’s writer/director Maya C. Forbes and it feels like a first
movie. A deeply autobiographical project, the film also stars Forbes’ daughter Imogene Wolodarsky as Amelia, the character based on Forbes herself. Beginning in 1967, around the time Cam (Mark Ruffalo) and Maggie (Zoe Saldana), the parents of Amelia
much as he is able to give them a somewhat normal life. Bouts of depression, excessive drinking and chain-smoking combined with reckless driving, slovenly housekeeping, irresponsible parenting, awkward social interaction and so on, become the daily routine of the girls’ childhood. The story has as many, if not more, highs and lows than Cam. Should a movie about a manic depressive be as manic and depressing as its subject? Forbes seems to think so. Infinitely Polar Bear, whose title comes from Faith’s mangling of her father’s condition is not Ruffalo’s best work (see The Normal Heart or The Kids Are All Right for that). The young actresses hold their own in their scenes, while Saldana is the one who comes out the best. Not the worst first film ever, but one that raises doubts about what might come next.

Infinitely Polar Bear Cast during filming of the movie
(Wolodarsky) and Faith (Ashley Aufderheide), met while working at the Boston-based PBS affiliate WGBH, Infinitely Polar Bear follows the fractured family of four through a multitude of struggles. Bipolar Cam has lived his life under the unpredictable spell of his manic-depressive episodes. In 1978, after Cam lost another job, Maggie attempts to leave him and take the girls with her. However, following his hospitalization and settlement into a halfway house, Maggie has a slight change of heart. Realizing Cam will never be able to properly provide for them (in spite of coming from a moneyed blueblood family whose relative’s portrait hangs in the Museum of Fine Art), Maggie applies to and gets into an MBA program in New York. And here is the setup. With Maggie away at school working on her degree, Cam moved into the apartment with his daughters and does as

There are numerous tense moments – Lipsky is, after all, a journalist, not Wallace’s buddy, and when he raises certain questions, about Wallace’s trademark bandanas, his hospitalization for depression and “suicide watch,” interviewing Wallace’s mother, and his rumored heroin addiction, for example, things get heated. But there are also moments of joy, such as Wallace’s reading at The Hungry Mind in Minneapolis, a visit to the Mall of America, and Wallace’s reconnection with former University of Arizona classmate Betsy (Mickey Sumner) and writer Julie (Mamie Gummer). Joan Cusack, as Wallace’s Minneapolis escort, also brings some levity to the movie. As previously mentioned, Segel’s performance (on par with what Paul Dano does as Brian Wilson in Love and Mercy), is what gives The End of the Tour its heart and soul and is more than reason enough to see this film.

Based on writer David Lipsky’s book Although of Course You End Up Becoming Yourself, about the time he spent with the late writer David Foster Wallace during the final days of his 1996 book tour for Infinite Jest, The End of the Tour (A24) opens in 2008 on the day that Lipsky (Jesse Eisenberg) learns of the death of Wallace (Jason Segel giving a once-in-a-lifetime, Oscar-worthy performance). Twelve years earlier, Lipsky was a writer at Rolling Stone. His first novel (and second book) had just been published, but all the attention in the literary world was being given to Wallace for his epic masterwork. Lipsky pitches a story about Wallace to his Rolling Stone editor and, before you know it, he’s on his way to Bloomington-Normal, Illinois where Wallace is teaching at Illinois State University. At first, the equally socially awkward, “nervous and terrified” duo is wary of the other. Thankfully, the presence of Wallace’s two active black labs are there to help break the ice (and snow). Wallace, a recovering alcoholic, whose “level of fatigue and fuck-up quotient” can make him difficult to be around, is popular with and well-liked by his students. A smoker and tobaccochewer with a penchant for junk food and diet soda, Wallace doesn’t have a TV and is wary of the Internet. He doesn’t have a girlfriend (although he’d like to have one) and the two Davids’ exchange about “a five minute cup of tea” with Alanis Morissette is pretty priceless. Wallace is a man with a lot of opinions and once he becomes comfortable with Lipsky (they share a PopTart), he opens up to him.

When I used to weigh over 300 pounds, this was no problem -- easy to do! However now, with weight loss and a much improved diet, it cannot happen -- there is nothing to shake. So if you can grab belly fat and there is something there to shake -- you are at risk for diabetes and several diseases that result from inflammation like asthma, arthritis, inflammatory bowel disease and (of greatest concern) heart disease. Hormones help give you energy and motivation to exercise, however nothing will improve your health more than diet! Women suffer with increase in fat when estrogen falls and get fat in places they have never have before -- usually belly, butt and thighs. Men gain love handles and belly fat with lower than optimal levels of testosterone. As the level of fat in the blood rises, the body’s ability to clear sugar from the blood drops. Where does this fat in our blood that’s wreaking all this havoc come from? It comes from the fat that we eat and from the fat that we wear. The number of fat cells we have stays constant in adulthood. After massive weight loss, our fat cells shrink as they offload fat, but the number stays the same. Conversely, when we gain weight, our fat cells just stretch as we pack more and more into each individual fat cell. So when our belly, butt or thighs get big we’re not adding more fat cells we’re just cramming more fat into each cell. At a certain point our cells become so bloated that they spill fat back into the bloodstream. This is an illustration of the so-called “Spillover
Effect”. Not only does an obese person have more fat, but they’re constantly spilling that fat into their bloodstream. So that could be the link between obesity and diabetes. Fat is spilling out from our fat cells and gets lodged in our muscle cells, leading to the insulin resistance that promotes the onset of type 2 diabetes. Or the fat can enter our bloodstream through our mouth. If you put people on a low carb diet, fat builds up in their muscle within two hours, compared to a low fat diet, and insulin sensitivity drops. The more fat in the muscle, the lower our ability is to clear sugar from the blood. It doesn’t take years for this to happen, just hours after these foods go into our mouths. A fat-rich diet can increase fat in the blood and this increase is accompanied by a decrease in insulin sensitivity. Studies clearly demonstrate that fat in the blood directly inhibit glucose transport and usage in our muscles, which is responsible for clearing about 85% of the glucose out of blood. These findings also indicate an important role of nutrition, particularly increased consumption of fat, for the development of insulin resistance. Normally we only have 1 to 500 micromoles of free fat floating around in our blood stream at any one time, but those who are obese are constantly spilling fat out into their bloodstream. We can reach those same levels in our blood eating a high fat diet. So a skinny person eating a low carb diet can have the same level of fat in their blood that obese people do. Similarly being obese is like eating some horrible bacon and butter diet all day, because obese persons are constantly spilling fat into their bloodstream no matter what goes in their mouth.

Exercise Those Blues Away! By Tom Bonanti Depression is a reality that many people deal with on a daily basis. A life threatening illness, the loss of a job, a relationship break-up are all setbacks that can make you down and blue. In time, most recover from the sadness and other negative emotions that accompany such unfortunate human crises. If you feel depressed, or often get caught up in negativity because of work, relationships, or life in general, here are some practical cognitive strategies that will help you get out of that rut and keep your sunny side up! Maintain an active daily routine. Set a regular time to rise and shine. Have your clothes laid out, drink your coffee and eat a healthy breakfast. Delay checking and returning pesky e-mails and texts until you get to the office. Incorporate exercise into your daily routine. Many who exercise first thing in the morning before work report less anxiety, increased energy and a brighter mood all day-long. Don’t let negative thoughts control you. Let go of hurtful people and events from your past. Stop ruminating over things in the present that don’t concern you (i.e. a co-worker’s snarky remarks, etc.). As far as the future goes, worrying and fretting can do nothing to make things turn out the way you desire. Treat yourself well. Work, relationships and the daily grind can take their toll on you. Instead of falling into a negative, depressed cycle, try always to have things to look forward to in life. A trip to Starbucks, taking lunch outdoors on a sunny day, reading a good book on your breaks, are all awesome ways to brighten your spirit and feed your soul. Reaching out to others is tough when you’re depressed, but it helps if you keep a steady stream of positive people in your life. Just remember to be one yourself when someone else needs a caring friend or a strong shoulder. Whether you are already receiving professional help for depression, or just trying to deal with an occasional case of the blues, these cognitive self-help tips can make a difference.
