Why major corporations are watching LGBTs By PETER JACKSON

W

NIELSEN SAYS SOMETHING, you’d better believe it. The global consumer research giant has a proven record and impeccable reputation for studying and analyzing what consumers the world over watch and buy. HEN

So when Nielsen raves about the influence and attractiveness of LGBT consumers, and backs it up with cold, hard data from new research, corporate America sits up and pays attention. “Across music, sports, TV and brand sponsorships, LGBT consumers are showing they are attractive for future marketing appeal,” Nielsen reported this week. “They are trendsetters, tech-enthusiasts and show unique levels of engagement across various consumption areas.” In a 15-page summary of its 2015 LGBT Consumer Survey, Nielsen concludes, “LGBT consumers present companies across entertainment, retail, and consumer goods with a real opportunity to create meaningful connections with a vibrant consumer base.” CONTINUED4

Within the LGBT community, Generation X lesbian and bisexual women are most likely to be parents of a child under age 18. However, this may change in the future. Both Millennial men (51%) and women (55%) desire to have children in the future.

NEWSWATCH SPECIAL REPORT | The CONTINUED and reliable source, Community Marketing Inc. (CMI), in partnership with Rivendell Media. The CMI report supports and amplifies the Nielsen findings on the growing influence and impact of LGBT consumers, reporting significant growth in spending by this sector across almost all major categories in 2015 over last year. For instance, LGBT Americans are buying or leasing more cars (20% in 2015 compared to 16% last year) and making more major furniture purchases (26% compared to 15% last year). The buying power of gay America is also far greater than previously believed. That figure, which represents the income after taxes of adult LGBTs in the USA, is $884 billion annually, according to pioneer LGBT market analyst Bob Witeck. Speaking in Las Vegas last weekend at a conference of the National Equality Publishers Association (NEPA), a newly-formed group of LGBT print and digital media executives, Witeck delivered solid and sometimes stunning new facts about LGBT Americans. The author of Business Inside Out, the first business book on marketing to LGBT consumers published in 2006, Witeck told about 20 publishers and 30 Las Vegas hotel, casino and travel industry executives that the impact of the Supreme Court’s June 26th ruling on same-sex marriage “will influence market and political trends across the U.S. and globally.” [A detailed Q&A interview with Mr. Witeck follows this article]. The marketing guru also revealed: 4 26 million Americans (11% of the population) acknowledge at least some

same sex attraction; 419 million Americans (8.2%) report they have engaged in same-sex sexual behavior; and 4Over 16 million adults (individuals over 18 years of age) identify as LGBT.

S

o the LGBTs are a sizable market. But do they — everybody from Kellogg’s and Nike to Starbucks and Mercedes Benz — represent the next frontier for national brands to court? Will they spend millions of dollars to do so? Can we expect a wave of print ads and television commercials featuring two moms and two dads? “Yes,” the volume of national advertising will increase, says Todd Evans, another pioneer in LGBT advertising and marketing. “However it really all depends on the level of commitment [by national brands]. It is one thing to support equal rights but quite another to pursue the LGBT marketplace.” Evans is the president and CEO of Rivendell Media, an agency that is believed to book more than 95% of all national brand and pharmaceutical advertising in LGBT media across the United States. His company recently published the 20th annual edition of Gay Press Report which tracks all advertising and revenue in the gay press. Currently there are an estimated 114 print media with web site counterparts across the nation which collectively earned $405.7 million in ad revenues last year, up 6.4% from 2013, according to the report. “The surge we are seeing now is the doubling down of all the companies that have been pursuing the marketplace for some time,” says Evans.

“Many other companies have failed to use their support of equal rights as their entry into the LGBT market.” Evans is referring to the more than three hundred major corporations that sent a writ to the Supreme Court earlier this year supporting marriage equality. Unquestionably there is an unprecedented interest by national corporations in the LGBT market and its $884 billion spending power. And there should be. The gays are well-educated, leading heterosexuals and bisexuals with a 48% college graduate rate. They are getting married and starting families in record numbers. Over half of gay men and women are actively researching real estate online or through an agent, with a third of them having bought a home in the last three years or planning to do so in the next three years, according to CMI. And they are loyal, with ample research to indicate LGBTs support the businesses that reach out to them or are supportive of equal rights. For gay and bi men, the top 10 brands are Target, Starbucks, Apple, Absolut vodka and Nabisco, followed by Amazon, JC Penney, Macy’s, American Airlines and Home Depot. For lesbians and bi women, the top 10 brands are Target, Starbucks, Nabisco, JC Penney and Apple, followed by Amazon, Absolut vodka, Home Depot, Barefoot wines and Subaru. How quickly the nation’s top businesses will wake up and understand they can grow their market share by reaching out to LGBT consumers is uncertain. But it’s a pretty good bet that they will.

NEWSWATCH SPECIAL REPORT | The

Rise of Gay America

FLORIDA AGENDA: Your company spans three decades as the leading national advertising agency for LGBTQ media. How has advertising in LGBTQ media changed over that time? EVANS: Well, so much has changed really while at the same time so much remains the same. Advertising has taken its normal course and so has progressed from token insertions [by national brands] in the LGBT press to real campaigns, and likewise the campaigns have evolved, too. A normal progression is [for major national brands] to test the waters with their mainstream creative and then when ready to slowly craft their outreach to

LGBT specific [advertising messages]. What has remained the same is that still today, in 2015, most of the largest efforts come from, and have some, LGBT champion on the corporate level. Agencies are glad to include LGBT when they think it is appropriate, but real dedicated efforts must have the champion on the corporate level to move it along. So while the business case for pursuing the LGBT market is quite clear for many sectors of the economy, it still lags as an opportunity for most. FLORIDA AGENDA: Corporate America has shown tremendous support for LGBTQ equality issues, including same-sex marriage. Do you see this support manifesting itself into national advertising to the LGBTQ market as well? EVANS: Yes, however it really all depends with the level of commitment. It is one thing to support equal rights but quite another to pursue the LGBT market-

place. The surge we are seeing now is the doubling down by all the companies that have been pursuing the marketplace for some time. Many other companies have failed to use their support of equal rights as their entry into the LGBT market. FLORIDA AGENDA: Can you give us an example? EVANS: Nabisco and the Rainbow Oreo ad come to mind as a good example of an opportunity that was never fully realized. The Rainbow Oreo ad, which was so timely and such a nice statement in social media, was never executed into a real advertisement as their entry into the LGBT marketplace. That image could have been used with a campaign in the gay press to provide a “real” call to action in the market. Now, I’ll bet, except for the professionals in the LGBT market, the ad is fading from memory. Worse yet is that I’ve heard some opinion makers say about this ad, and others at the time of

the SCOTUS decision, that really they took advantage of the market and have no intention of supporting it with real dollars. The idea is that companies like Nabisco, Starbucks or Apple can take their support of equal rights and bring that into their advertising to the LGBT community and ultimately make the LGBT community advocates for their companies. That would be the true win-win.

WHAT HAPPENED TO THE RAINBOW OREO? On June 25, 2012, a picture of an Oreo cookie with six layers of frosting in the colors of the rainbow flag was posted on Kraft Nabisco’s Facebook page. The image was accompanied by the captions “June 25 | Pride” and “Proudly support love!” in recognition of LGBT Pride Month in the United States. The Facebook image post was instantly met by polarized opinions between supporters and critics of gay marriage, quickly escalating into a lengthy debate of more than 23,000 comments in the first 24 hours.

THE AGENDA INTERVIEW

THE NEW

MARKETING 101 LGBT Americans are shaping market trends and influencing the economy and politics

Q: You are indisputably a pioneer in research of the LGBT market in North America, having studied it for more than 20 years. What headline describes this market demographic today? A: Great question. If I had to craft a headline, I’d say, “LGBT Americans, Growing in Visibility, Shape Market Trends and Influence Economy.”

BOB WITECK, president of Washington, DC-based Witeck Communications, Inc., is a leading communications expert on strategies to reach lesbian, gay, bisexual and transgender (LGBT) households and consumers.Witeck has more than four decades’ professional communications expertise in the public and private sector. Before opening his practice, he was senior vice president for Hill & Knowlton Public Affairs, the global public relations and public affairs firm. On Capitol Hill for over a decade, Witeck served as communications director for the U.S. Senate Committee on Commerce, Science and Transportation and as a Senate press secretary and legislative assistant. He is a graduate with distinction of the University of Virginia, where he was named an Echols Scholar. In their 25th anniversary, the editors of American Demographics magazine selected him as one of 25 national leaders ‘who have made significant contributions to the worlds of demographics, research, media and trend spotting’ for his pioneering work on America’s LGBT population. Witeck is also the co-author of Business Inside Out: Tapping Millions of Brand-Loyal Gay Consumers (Kaplan Publishing, September 2006), recognized as the first book advising marketers and business leaders on building successful bridges with LGBT stakeholders.

with PETER JACKSON

Q: The spending power of the LGBTQ market in the U.S. is estimated at $884 billion annually. No surprise, corporate America is waking up to the fact that this is one of the last untapped potentially lucrative demographic segments. What should we expect to see in terms of advertising targeted to the LGBTQ sector in the new few years? A: When I began my work nearly 25 years ago, few major brands felt bold or brave enough to advertise or include LGBT audiences and imagery in their campaigns. Most felt it was highly risky, feared backlash and lacked confidence (and sophistication) in targeting LGBT consumers. The evidence is clear that today marketers know their competitors are beating them to the punch, and they are seeing far less risk today by executing LGBT-inclusive strategies. It’s really Marketing 101, and the imperative to never leave any household behind. Advertising is truly far more inclusive and diverse, and that trend will only grow. Q: What two or three statistics do you feel are most telling about the LGBTQ demographic in the United States? A: Simply put, the Census now tells us that same-sex couples live in over 98% of all counties in the United States. So we are truly everywhere. And conservatively, I project there are over 16 million adults in the nation who self-

identify as gay, lesbian, bisexual and/or transgender. Of course, there are millions more LGBT-friendly Americans who are our families, friends, neighbors and co-workers. Q: National brands ranging from automotive manufacturers to airlines, hotels and cruise lines already spend millions of dollars nationally in mainstream advertising. Why should they consider LGBTQ-specific ad campaigns – and how do you think this strategy would help their brands? A: LGBT inclusive advertising is today found in almost all sectors from automotive to films to alcohol to hospitality to grooming products to travel to high tech. While including and engaging LGBT consumers itself is rewarding, it has one more tangible benefit. It also tends to engage and attract millennial and non-LGBT consumers who see that brand with fresh eyes and a more contemporary identity. It helps to engage younger audiences and new, loyal customers. Q: Can you think of an example where this strategy has been successful for a national brand? A: Sure. Just consider Honey Maid over the past year. Most of us grew up eating graham crackers. Can you imagine a more universal or more wholesome product? Honey Maid crafted an innovative new video campaign – found on broadcast, in print and on digital channels that included a same-sex couple and family as part of their narrative message embracing all families. Honey Maid’s reputation soared, along with its consumer impressions and product sales. It reminds us that even solid, old school brands still have new audiences to meet and new customers to drive loyalty and repeat sales.

Q: Do gays and lesbians really have more disposable income and spend more on sectors like travel and entertainment – or this is just unsubstantiated speculation? A: LGBT consumers are not more affluent or privileged than others. We regrettably stereotype gay people as wealthy, when the data clearly disputes it. We are found in almost all families, within all paths of life, all races and ethnicities, and all incomes. However, we tend to have more couples with two earner incomes, and also a higher share of wallet for discretionary spending particularly for priorities such as travel, entertainment and dining. We tend to parent less, and therefore can dedicate more income to personal priorities. With the coming of marriage equality, of course, we are likely to see more families formed and more children raised – which will again make LGBT households more like their straight counterparts over time. Q: Some 25 LGBTQ print and online publishers have joined forces to form the National Equality Publishers Association (NEPA) in an effort to represent the market to corporate America. This is the largest effort of its kind. Do you support this initiative? A: I am a serious advocate and lifetime believer in LGBT community newspapers and media. I grew up in the 1960s reading the Washington Blade, and later, while in college, reading the Advocate and other popular magazines. When we were hungry for community, same-sex intimacy, self-knowledge, political progress and respect, we often found it in our gay newspapers – and trusted them to get it right. I am proud to have so many friends and allies collaborating and growing their businesses, and naturally want to encourage my fellow entrepreneurs.

the National Gay and Lesbian Chamber of Commerce to our beaches and our sunshine, providing liberal access to both for the sold-out crowd descending on the Marriott Harbor Beach Resort just off Seabreeze Boulevard. The conference which saw its first arrivals Tuesday, continues through Friday with an agenda that covers networking, branding, benefits, and even marriage equality.

August 12, 2015

12

We attended this conference last year at Caesars Palace in Las Vegas, and can vouch for the power that common goals bring. But a lot has happened in the LGBT world since By 2014. This Phoenix risen from the RICHARD has ashes of contempt HACK to stand tall in a world where being gay isn’t quite the horrible curse it was once thought to be. With the ruling of marriage equality by the Supreme Court, the LGBT community is now being openly courted for its business like never before allowing companies like Multimedia Platforms Worldwide to provide a beacon of clarity to corporations hoping to reach our considerable buying power, currently estimated at $884 billion (with a “B”) per year. Our buying power, also referred to as “pink money” is the amount of cap-

ital that individuals (or households) have available to spend and save after paying taxes and pension contributions to the government. It’s an amount equal to roughly 86% of income. This figure has been growing annually, according to Witeck Communications, out of Washington, DC, that keeps track of such things. It was only two years ago that we were reporting that the buying power of the LGBT community was $790 billion—but as we said, a lot has changed. Companies like Macy’s and CVS, Target and Best Buy have reached out for our business by welcoming us as employees and as customers. So too Sears and Safeway, Office Depot and Wells Fargo, Kellogg’s and PepsiCo, DuPont and the Capitol Grille. Equally as important are those who fail to make any effort to seek out our business. Those names might surprise you. Publix Supermarkets, the major food chain in the South, scored a zero in the Human Rights Campaign’s Buyers Guide. Even more amazing is the zero

rating earned by fashion icon Dolce & Gabbana since company founders Domenico Dolce and Stefano Gabbana are gay and were in a longstanding romantic relationship until 2005. Ditto other Italian fashion brands founded by gay designers Giorgio Armani and Gianni Versace. Zero and zero. As the National Gay and Lesbian Chamber of Commerce rolls out its agenda in the days ahead, it is well aware of the power that the LGBT community can muster if it unites in purpose to achieve common goals. Yet, by its very nature, LGBT’s are experts at hiding within themselves to fit into a society that has previously made every attempt to label us as mentally unstable, morally apprehensible and politically impotent. To put our market strength in perspective, the LGBT community is second only to Hispanic Americans and African Americans in buying power.

To put our market strength in perspective, the LGBT community is second only to Hispanic Americans and African Americans in buying power.

Hispanics traditionally wield over a trillion dollars in purchasing power with African Americans coming is well under that at $1,200 billion. But mere numbers are deceiving. The LGBT community’s $884 billion purchasing power represents a cross section of America, including Hispanics and African Americans. We also behave uniquely in the marketplace. The LGBT market is less fickle than the heterosexual consumer. Eightyfive percent of LGBTs remain brand loyal over the course of their purchasing lifetime according to surveys by Community Marketing Inc. and Harris Interactive. Seventy-eight percent would switch to brands that they know are gay friendly. Seventy percent would pay a premium to buy products from companies that support the LGBT community. And a full 55% would choose to do business with companies who choose diversity and equality in the workplace. It is by certification through the NGLCC that companies wishing to reach the LGBT market can make their marketplace position known. And by looking for that certification, consumers can mobilize their purchasing power to show their support. As more gays and lesbians, bisexuals and transgenders come out of the closet and stand side-by-side in business, religion, education and recreation, we pool our resources to gain a voice that has been silenced for far too long. Be proud and rejoice; our time is now.

Let’s allow for the creation of a sanctuary on Wilton Drive where people who want to get out of their cars and stroll, shop, dine and interact with others can do so safely instead of continuing to give preference to the air polluting, greenhouse gas emitting car culture that other cities are working to put the brakes on. The most “comical” were the individuals who crossed the street in front of the (empty) police car that was in front of the sign threatening to ticket people for jaywalking. I am afraid that many who utilize the business (mostly at night) really do not care about their own safety. In fact, as my partner and I were heading down Wilton Drive in our truck, four individuals got out of a car opposite one of the more popular evening venues and preceded to walk in front of us without even looking. If

it were not for my partner’s quick reflexes we would be dealing with even more gory drama on the drive. I think it odd that we as adults do not take interest in our own welfare and do what we can to be safe. I also think it odd that the city thinks that putting up a few crosswalks and maybe a few more lights will solve the problem. Perhaps changing destructive behavior and patterns should be a topic of discussion. ANTHONY JOHNSON

ithin the last few months there has been a lot of discussion about how dangerous Wilton Drive is due to the deaths of individuals crossing the streets. The biggest discussion I hear is that there needs to be more timed cross walks so people do not feel that they need to cross a busy street where none exists. Though I feel having crosswalks is of great importance, I think what may be of greater importance is educating individuals on how and when to use them. I have been on the drive a few times and watched as individuals crossed the street (when it was highly traveled) only a few feet away from the cross section. I guess saving a few steps superseded the safety of

hile it only took a small boy in the fairy tale about the emperor who had no clothes to point out to the city folk that the emperor was naked, it’s unfortunate that it took yet another death on Wilton Drive for more residents of Wilton Manors to see that the long reign of Emperor (Mayor) Resnick and his friends in City Hall has been all about talk that’s not backed up with substance. Why does it take a group of protesters and an overflowing City Hall meeting to finally get Resnick to wake up and smell the coffee? Probably the fact that he only won the last election by about 500 votes with a very low voter turnout during the last mayoral election in Wilton Manors and that simply billing yourself as a “Gay” mayor isn’t cutting the mustard anymore when he has ignored doing the job he’s paid to do, which includes insuring public safety. Now the emperor has had signs posted around Wilton Manors telling pedestrians to be more careful on Wilton Drive. Where are the signs around Wilton Manors telling drivers to obey the speed limits and watch out for pedestrians and back this up with the presence of Wilton Manors police on Wilton Drive? Is Wilton Manors so crime ridden and poor that Emperor Resnick can’t put a regular police presence on Wilton Drive? In an area where the car culture has ruled for far too long with four- and six-lane highways named “Boulevards” and “Drives,” it’s time for sane citizens to take back Wilton “Drive” and make it

But the “conversion” of Thomas to a more empathetic character came at a price. When the meddling manservant returned from a trip to London looking pallid and clammy, some of us knew instantly what had happened. Equally, when we watched the decline and fall of one of Britain’s greatest unheralded World War II heroes, as portrayed in the biopic The Imitation Game, we cringed with horror. We were witnessing the painful unraveling of a gay man trying to “turn” straight. CLIFF NOTES By Cliff Dunn

I’ve Got No Strings:

Wireless Speakers to the Rescue

Lately, I’ve taken to waking up early and sneaking in some episodes of “Ray Donovan” and “Nashville” on my Android tablet to start my day (what—you thought I was more of a “Desperate Housewives” kind of girl?). The novelty of watching Guilty Pleasure TV on my tablet wore off quickly when it became clear I couldn’t listen to my programs in all their savage splendor. The popularity of wireless speakers has increased tenfold, with most manufacturers offering models with varying features and coming in a variety of shapes, sizes and wireless configurations.

August 12, 2015

22

Which Wireless is Right for You? Apple’s wireless audio feature, AirPlay, lets you stream music from the iTunes library onto your iPod, iPhone, iPad, and Mac, simultaneously streaming to multiple speakers, and relaying track information to the display. Although top-heavy with features, and compatible with any iOS device, it only works with Apple mobile products. In addition, they tend to be more costly than Bluetooth speakers, and are generally less portable. Bluetooth, by comparison, doesn’t command the plethora of features as AirPlay, but it supports a lot more devices. Since Bluetooth works by pairing, a device can stream to only one speaker set at a time. On the price end, Bluetooth speakers are generally less expensive than those for AirPlay, and a lot of models run on rechargeable batteries, which means it’s them easier to carry them around.

In addition, a number of companies, including Sonos, offer Wi-Fi based wireless multi-room systems that make decent alternatives to the iOSdependent AirPlay or Bluetooth. Speaker of the House (and Beach) Knowing what kind of speaker will work best for you is as important as the type of wireless connection you’re using. With smaller, battery-powered speakers (such as Bluetooth), you can “take them with,” but don’t expect them to get very loud. On the other end of the spectrum, larger speakers put out richer sound, but at a cost of portability and, well, cost. I’ve Got the Power For the most part, Bluetooth speakers can be taken used anywhere, which isn’t the case with all wireless speakers. Most Wi-Fi-based models are a lot bigger and require a continuous power source. While more constraining, there are advantages. The larger size and continual power translate to bigger sound than any unit you could toss into your gym bag. Mention should also be made of more rugged speakers. A lot of Bluetooth speakers can take exposure to water, but rugged speakers that are specifically made for outdoor use are infinitely sturdier. For example, the UE Roll and JBL Clip+ can be thrown, submerged in water, and dirtied up, and still crank out the Mozart and Will-I-Am like no one’s business.

NATION Catholics Wrestle With Teachings As Gay Employees Dismissed

MARYCLAIRE DALE Associated Press PHILADELPHIA (AP) - Pope Francis refined his vision for the church last week when he said long-spurned divorced and remarried Catholics should be welcomed with “open doors.” And he has famously parsed centuries of thought on homosexuality into a five-word quip: “Who am I to judge?” Yet the Archdiocese of Philadelphia opened its door only briefly when married gay teacher Margie Winters, trailed by supporters, arrived Monday with 23,000 petitions seeking reinstatement to her job at a Catholic elementary school. “The school and the Sisters of Mercy allowed me to work there for eight years. Once the diocese was notified, something changed,” said Winters, who was disappointed that a security guard, and not a church official, took her petitions at the chancery door. Winters, 50, lost her job at Waldron Mercy Academy in June after a parent complained about her 2007 marriage to a woman. Her case highlights the shifting fault lines over gays in the church - and in church workplaces - just before the pope visits Philadelphia next month for the World Meeting of Families.

Jesuit-run Fordham University is standing by its theology chairman whose samesex marriage made the New York Times wedding section this year, while Seton Hall University, with ties to the Newark, New Jersey, archdiocese, recently dismissed a chaplain who denounced gay bullying and later came out as gay. Around the country, more than 50 people have reported losing their jobs at Catholic institutions since 2010 over their sexual orientation or identity, according to New Ways Ministries, an advocacy group for gay, lesbian, bisexual and transgender Catholics based in Mount Ranier, Maryland. Philadelphia Archbishop Charles J. Chaput, wading into the issue amid Winters’ case, stressed that Catholic schools are responsible for “teaching and witnessing the Catholic faith in a manner true to Catholic belief,” referring to the church’s condemnation of homosexual activity. He said the Mercy officials showed “character and common sense” for sticking to church teachings. “A great number of people like to pick apart the remarks of the Holy Father and manipulate them to drive their own agendas,” his spokesman, Ken Gavin, said

Thursday in response to questions about the pope’s latest comments. “Keeping the doors open does not mean that basic church teachings will be changed. ... The Holy Father has not given any signals that teaching on the meaning and sanctity of marriage will be changing.” Winters and her wife, Andrea Vettori, clinical director at a health center for the Margie Winters, an eight-year veteran of the Waldron Mercy Academy, homeless, met in their was let go from the school for having a wife. Board: Ohio Judges Can’t Choose Marriage Type They Perform

SC Attorney General Must Pay $135,300 In Gay Marriage Case

Judge Voids Same-Sex Marriage Ban as Unconstitutional

COLUMBUS, Ohio (AP) - An Ohio judicial board has ruled that judges who perform weddings can’t refuse same-sex couples based on personal, moral, or religious beliefs. The board also says judges who stop performing all marriages to avoid marrying same-sex couples may be interpreted as biased and could be disqualified from any case where sexual orientation is an issue. The Ohio Supreme Court’s Board of Professional Conduct issued the ruling Monday after a Toledo judge who refused to perform a same-sex wedding asked the board to clarify his duties. Toledo Municipal Judge C. Allen McConnell said he didn’t marry a same-sex couple because of his religious beliefs after the U.S. Supreme Court made gay marriage legal in all 50 states in July. A message was left with McConnell seeking comment.

SEANNA ADCOX Associated Press COLUMBIA, SC (AP) - A federal judge has ordered South Carolina Attorney General Alan Wilson to pay more than $135,000 in legal fees for a couple who challenged the state ban on same-sex marriage. According to the order filed Monday, Wilson must reimburse seven attorneys a total of $130,600 for 390 hours of work. That’s $17,400 less than the attorneys requested. Judge Richard Gergel also awarded them the full $4,700 they sought in other court costs and fees. Colleen Condon and her partner, Nichols Bleckley, sued last fall to get a marriage license. Gergel notes South Carolina was the only state in the Fourth Circuit to still enforce its gay marriage ban after the court found a similar ban in Virginia unconstitutional.

WICHITA, KS (AP) - A federal judge has voided the Kansas ban on same-sex marriages as unconstitutional in the wake of a U.S. Supreme Court decision on the issue. U.S. District Judge Daniel Crabtree summarily ruled Monday that the provision in the Kansas constitution that prohibits issuing marriage licenses same-sex couples or recognizing such marriages violates the Fourteenth Amendment to the U.S. Constitution. That ruling also applies to any Kansas statute, law, policy or practice that bars or fails to recognize such unions. But Crabtree stopped short of issuing a permanent injunction so as to give Kansas the opportunity to voluntarily comply. The court says some facts in the court record suggest Kansas officials have not uniformly complied with the U.S. Supreme Court ruling.

federal government. According to Idaho law, the fund is for “restoring, maintaining and advancing the sovereignty and authority over issues that affect this state and the well-being of its citizens.” The fund was originally allocated $1 million, but it was slowly depleted after being used to pay for legal expenses for settlements with Planned Parenthood in 2008, according to a list of the fund’s expenditures. A federal judge ruled last week that the law violated the First Amendment and the Equal Protection Clause of the U.S. Constitution, but the state has not decided if it will appeal the decision.

JULIET LINDERMAN Associated Press BALTIMORE (AP) - The Baltimore police have arrested a suspect in the fatal stabbing of a transgender woman last July. Interim Police Commissioner Kevin Davis announced Thursday that 44-year-old Shawn Oliver has been arrested and charged with the murder of 26-year-old Mia Henderson, who was found stabbed to death July 16, 2014. Davis said police were able to identify Oliver from DNA extracted from under Henderson’s fingernails. Davis said Oliver was already behind bars when he was charged with killing Henderson. Davis said the case is still under investigation to see if hate crime charges are warranted. Henderson’s body was found five weeks after another transgender woman, 40-year-old Kandy Hall, was found dead. Her death was ruled a homicide.

AUSTIN, TX (AP) - State officials say they’ve complied with a court order and amended the death certificate of a man to include the name of his same-sex spouse. The Texas Department of State Health Services said in a statement Thursday night that John Stone-Hoskins of Conroe has been added to the death certificate for James Stone-Hoskins, who died in January, months after the couple had married in New Mexico. John Stone-Hoskins said in a federal court filing earlier this week that the certificate initially listed him only as a “significant other.” He argued the U.S. Supreme Court’s landmark decision on gay marriage in June means state records such as death certificates should recognize such unions.

CHICAGO (AP) - Chicago Mayor Rahm Emanuel announced plans on Wednesday to allow sex reassignment surgery for the city’s employees as part of their health benefits package. “Chicago is known for being a city that is welcoming to all and inclusive of every resident, and this new policy is in line with our efforts to support the rights and well-being of transgender individuals,” Emanuel said in a statement. “With this change, Chicago will ensure that transgender city employees are able to receive the medical care that they need.” The change first will be implemented for nonunion employees. The city said it is working with labor representatives to remove an exclusion of sex-change treatment for union members. The mayor’s office said the change is expected to be approved by the city’s Benefits Committee on Aug. 11 and would go into effect on Oct. 1. City employees and their dependents would be eligible, with a “lifetime cap” of $100,000 for the male-to-female and female-to-male procedures. The city currently is finalizing the specific criteria that must be met in order for an employee or dependent to receive coverage for sex reassignment surgery, as well as the specific procedures that will be covered. John Knight, LGBT & HIV Project Director for the American Civil Liberties Union of Illinois, said he commends the city for “recognizing that no one should be denied insurance coverage because of who they are.” Chicago is joining several other major cities that have removed the exclusion of sex reassignment surgeries from their health care plans, including San Francisco, Washington, D C and Philadelphia.

Idaho to use Defense Fund to cover $900,000 in attorney fees KIMBERLEE KRUESI Associated Press BOISE, Idaho (AP) - Idaho will pay roughly $900,000 in legal fees using the state’s Constitutional Defense Fund after recently losing three key lawsuits, including covering the plaintiff’s costs in the state’s failed attempt to uphold its same-sex marriage ban. The fund will also cover fees for the winning plaintiffs in a case that overturned an anti-abortion law and another case where the state sought to restrict protesters from camping near the Statehouse. Gov. C.L. “Butch” Otter, Senate President Pro Tem Brent Hill, and Attorney General Lawrence Wasden unanimously voted Monday to use the fund to cover the court-ordered attorneys’ fees and costs. However, doing so reduced the fund from $1.2 million to about $300,000. “You’re going to have to ask the lawyers why we’re losing,” Otter said. “But I can tell you that in every case, we were either defending statutes or our Constitution. That’s why it was appropriate.” Otter added that he will ask lawmakers to boost the fund back up to the million-dollar range at the beginning of the 2016 legislative session, which got an endorsement from Hill. The Constitutional Defense Fund was created in 1995 to defend the state’s legal rights against the

August 12, 2015

Eight Broward County Mayors Fight For Uber’s Return On August 5, the mayors of Hallendale Beach, Davie, Tamarac, Dania Beach, Parkland, Lauderhill, Cooper City and Pembroke Pines, published a letter in the Sun Sentinel newspaper urging Tim Ryan, the mayor of Broward County, to bring Uber back to Broward. The ridesharing service exited the country on July 31 after the Broward County Commissioners passed strict regulations including required commercial insurance, county inspections and fingerprinted background checks. “In your inaugural speech, Mayor Ryan, you said, ‘the most pressing issue before us today and in the coming years is how to meet the demands on our county’s transportation needs.’ You were right, and now we’re calling on you to lead on the issue. As mayors in Broward County, we intimately understand the needs of our constituents. And we all agree that transportation continues to be a great challenge our communities face. The arrival of ridesharing options like Uber is a win-win. Ridesharing expands access to safe, reliable rides, provides job opportunities, and helps take drunk drivers off the road.

Across the country, policymakers are welcoming this innovation with modern, sensible regulatory frameworks for ridesharing. We must follow their lead. The people of Broward County have spoken; they want this service. From mayor to mayor, we urge you to stand up for our communities and bring back options like Uber to Broward County.” The letter was signed by Harry Dressler ( Mayor of Tamarac), Joy Cooper (Hallendale Beach), Judi Paul (Davie), Marco Salvino (Dania Beach), Frank Ortis (Pembroke Pines), Greg Ross (Cooper City), Richard Kaplan (Lauderhill), Michael Udine (Parkland). Obvious by their absence from the letter was Fort Lauderdale Mayor Seiler and Wilton Manors Mayor Gary Resnick. Currently, Uber is available in 70% of the U.S., with 223 million people having access to the ride sharing phenomenon. Locally, some 80,000 letters and messages of protest have reached the desks of county commissioners.

WILTON MANORS--City Commissioner Justin Flippen has introduced a resolution to have Wilton Manors become one of the first cities in Florida to formally support the Equality Act (H.R. 3185/S. 1858) introduced in Congress by Representative David Cicille (D-RI) and Senator Jeff Merkley (DOR). “Wilton Manors has a strategic plan dedicated to strong community identity and pride that is diverse and open to all,” said Commissioner Flippen. “Our city’s support of the Equality Act is consistent with the goals and objectives of our strategic plan, and Wilton Manor’s historical advocacy of equality from the municipal to Federal levels is something I am proud to continue. Besides, it’s the right thing to do. The Equality Act promotes fairness and modernized Federal law by banning anti-gay and gender-based discrimination.” The Equality Act has approximately 168 co-sponsors in the House and 39 cosponsors in the Senate and would prohibit discrimination on the basis of sex, gender identity, sexual orientation, and other forms of discrimination. The Wilton Manors resolution urges passage of

the Equality Act and will be sent to the Broward L e a g u e of Cities, Broward County Legisla-

tive Delegation, Congresswoman Lois Frankel, and U.S. Senators Bill Nelson and Marco Rubio. The Equality Act would protect the LGBT and gender nonconforming community from discrimination in employment, housing, education, credit, public accommodations, jury service, and Federally funded programs. The Equality Act would also update the law to add protections against discrimination on the basis of sex where protections are not already in existing law. The Act includes protection of those associated with this community, such as children of LGBT people.

Thinking Errors Throughout our day, we often have many reactive, negative interactions. In Psychology, we are taught that our perception (thought) determines our emotions and our emotions determine how we react. If we have negative thoughts, we then experience negative emotions which cause us be reactive and go into a defensive mode. There are fifteen common thinking errors we often use as a template to distort our thoughts during an interaction. Any time we have a negative encounter with someone, one of these thinking errors are used. 1.

Filtering - We take negative details and magnify them while filtering out all positive aspects of a situation. Black and White Thinking - We place people or situations in either/or categories with no shades of gray. Overgeneralization – We come to a general conclusion based on a single incident or a single piece of evidence. Jumping to Conclusions - Without individuals verbalizing, we know what they are feeling and why they act the way they do. In particular, we are able to determine how people are feeling toward us. Catastrophizing - We expect disaster to strike no matter what. This is also referred to as “magnifying or minimizing.” We hear about a problem and immediately experience “worst case scenario” thoughts. Personalization – We believe everything others do or say is some kind of direct, personal reaction to us. We also compare ourselves to others trying to determine who is smarter, better looking, etc. Control Fallacies - If we feel externally controlled, we see ourselves as a victim of other people’s control over us. Internal control has us assuming responsibility for the pain and happiness of everyone around us.

8.

Fallacy of Fairness - We feel resentful because the situation is not “fair.” 9. Blaming - We hold other people responsible for our pain, or we blame ourselves for every problem. 10. Shoulds - We have a list of ironclad rules about how others and we should behave. 11. Emotional Reasoning - We believe that what we feel in the moment must be true. We assume that our unhealthy emotions reflect the way things really are — “I feel it, therefore it must be true.” 12. Fallacy of Change - We expect that other people will change to suit us if we just pressure or cajole them enough. 13. Global Labeling - We generalize one or two qualities into a negative global judgment (stereotyping). 14. Always Being Right - We are continually on trial to prove that our opinions and actions are correct. Being wrong is unthinkable and we will go to any length to demonstrate our rightness. 15. Heaven’s Reward Fallacy - We expect our sacrifice and self-denial to pay off, as if someone is keeping score. We feel bitter when the reward doesn’t come. The goal is to be aware of when we use a thinking error and immediately change our thoughts about the situation. Think of a Rubik’s cube. There is more than one side to look at. It just depends on how we hold it. Whether you are proactive or reactive in a situation depends on your focus. The more aware we are in not using one of these thinking errors, the more successful we will be in life.

CREEP OF THE WEEK

By D’Anne Witowski

Priests for Life Warning! A three-headed beast is on the loose, and it’s coming for the children. Specifically the unborn. I know what you’re thinking: “Nice try, but monsters aren’t real.” Ah, don’t be so quick to dismiss, because as a homo, you’re part of the problem says anti-abortion group Priests for Life. Note: Priests for Life is not to be confused with defunct pop group Priests 4 Lyfe, who did Catholicthemed covers of boyband songs at local Knights of Columbus Halls (See: “God Wants It His Way” in the style of the Backstreet Boys, “Glad You Came To Confession” in the style of The Wanted, and “I’ll Make Love to You (But Not in the Jesus Hole)” in the style of Boyz II Men). But back to this monster business. PFL recently posted the following warning on their website: “Friends, we are faced with a three headed monster that resists the Word of the Lord – ‘Be fruitful and multiply’ (procreate)!” above an image of a three-headed dog monster, each dog representing a different way “procreation” is “under attack.” The first is “Sexual Perversion,” which includes homosexuality, fornication, adultery, incest, human trafficking, pornography and what is deemed “other hidden practices,” which apparently stands in for sex stuff so crazy they didn’t know what to call it. Obviously we know that homosexuality does not belong on PFL’s long list of sinful “practices,” as two women in love is not the same thing as, say, selling two women into sex slavery, and two men having consensual sex with each other is not the same as an uncle raping his nephew. Unfortunately, PFL hasn’t gotten that memo. Their main focus is babymaking, and any sexy-time stuff, including heterosexuals having consensual sex for fun, is equally terrible to them. Which means that they can’t possibly be taken seriously. The next monster head is labeled, “Abortion and Unnatural Contraception: No babies born, women maimed, babies slaughtered.” Note that they’re

PFL activist

photo: amarillo.com

not only against abortion, they’re also against birth control. PFL believes every sperm is a potential baby jerked out into the world and every unfertilized egg is wasted. I’ve long said that right-wing religious groups who seemed to focus on just the gays actually had their sights on being the boss of all sex, heterosexual, too. Unfortunately, straight folks, even the ones sympathetic to LGBT people, either didn’t notice or didn’t believe it. The last monster head is “Racism: No mating with ‘inferior’ humans who are not my ‘color.’” This one confuses me a bit. PFL is an African-American outreach organization headed by Martin Luther King Jr.’s niece, Alveda King (though her views and her uncle’s views are wildly different). Racism is definitely a huge problem in America, but there are no longer laws against interracial marriage, even if there are terrible people who are against the races “mixing.” But I am especially disappointed in Priests for Life. What kind of organization sounds the alarm about a babystealing monster without even trying to get a photograph of the beast? That’s just plain irresponsible.

oFunctional Medicine People experiencing symptoms generally attributed to “aging” tend to take one of two actions: lifestyle changes, like a new diet or exercise, or a medicinal strategy – taking pills, more supplements, or new prescriptions to treat chronic problems. The truth, though, may be far simpler. It’s entirely possible for a 55-year old man or woman to never experience the health problems that surprise so many. Hypertension, obesity, diabetes and similar conditions aren’t set in stone; there are plenty of preventative actions you can take to embrace a better quality of life. I should know – this is the proactive approach I have followed. Starting with testosterone replacement therapy supplemented with a new exercise program (including weight training five times per week), a high protein/low carb diet, and changes to sleep habits and alcohol consumptions, I’ve managed to avoid the common problems of aging. This is an approach I pass on to those patients I serve through functional medicine.

oFour Steps to Improve Overall Health I believe the best approach to personal health is one taken on a personal level. Do you feel stressed? Are you gaining weight, feeling bloated, or struggling with memory or retention? Changes to strength or libido may be considered “normal” for our age, but this is not true. Knowing how to make the right changes, whether it’s turning off electronics two hours before sleep or only drinking a half glass of wine once or twice a month, is best left to a conversation between you and a physician. There are general steps the average person can take though to improve his or her health over time:

Drink plenty of water. I can’t stress that enough. Take essential supplements. Omega 3 and fish oil (from a reputable, mercuryfree brand) are beneficial to everyone. Vitamin D is crucial. Consider decreasing your caloric intake. Modify your diet with fruit, vegetables, and protein. Focus on being happy. Stress is a major factor in a person’s overall health.

Age is no excuse not to pursue your happiness! Reconnect or pursue new relationships, set new financial, spiritual, or personal goals, and never stop learning. If you’re unhappy, you have the power to change that. By chasing these dreams, the body will respond positively.

August 12, 2015

Each day I work with patients to help them understand how functional medicine works by targeting their unique physiology and biochemistry. Think of functional medical like taking a car in for a tune up. Instead of looking for the symptoms, I take a proactive strategy of measuring urine, saliva, or blood to gauge an individuals health and how his or her body uses these components in a chemical reaction. I am able to take this information to restore the body’s optimal metabolic function.

nti-aging sounds like something you’d read on a topical cream. For many, the term is nothing more than a marketing ploy – and an effective one. Mid-life crises, heart disease, diabetes, and the increased risk of comparable conditions give people nightmares as they progress through adulthood and into their 50s and 60s. This is simply not true.

“Weird Al” Yankovic

8/09

Music satirist “Weird Al” Yankovic has somehow remained relevant for almost four decades in the industry. That might be because his fun send-ups of both popular music and popular music videos include equal amounts wit and sophomoric humor to appeal to a wide range of demographics. His latest album Mandatory Fun was his first number-one album, proving that the guy’s still got it. 8:00 p.m. Broward Center for the Performing Arts. 201 SW 5th Ave. Fort Lauderdale. 33312.

Unique experimental cultural space Fashion Project will be showcasing twenty-four classic films that explore the rich intersection of fashion and film. Tonight’s film is Gary Cooper and Marlene Dietrich’s dazzling erotic tango in Josef von Sternberg’s Morocco, which famously introduced the world to Dietrich’s signature androgynous style. 7:00 p.m. Fashion Project at Bal Harbour Shops. 9700 Collins Ave. Bal Harbour. 33154.
