DOMA Support Crumbles Microsoft has joined dozens of corporations, organizations and governments in support of a challenge on the constitutional grounds of the federal Defense of Marriage Act (DOMA). The friend-ofthe-court brief Microsoft, and 70 other organizations filed late last week points out the significant costs and administrative burdens DOMA imposes on employers as well as the ways DOMA interferes with employers’ efforts to promote diversity and equal opportunity in the workplace and harms their ability to attract and retain talent. The businesses and organizations, which include Starbucks, Google, Time Warner, CBS, Nike along with several cities, filed the brief in the case of Commonwealth of Massachusetts v. US Department of Health and Human Services. It is one of two consolidated cases from Massachusetts challenging the constitutionality of DOMA. In 1996, Congress passed the Defense
of Marriage Act, which defines marriage as between one man and one woman. It bars the federal government from treating same-sex marriage as legal or granting gay couples federal benefits. This means that same-sex couples, who get married where same-sex marriage is legal, aren’t eligible for the benefits that come with federally recognized marriage such as filing joint federal tax returns or social security and immigration law benefits. Same-sex marriage is only currently legal in the states of Connecticut, Iowa, Massachusetts, New Hampshire, New York, Washington DC and Vermont. There are about a dozen cases around the country challenging DOMA. The joined Massachusetts cases, currently before the First Circuit Court of Appeals in Boston, are the first to reach the federal appellate level, just one step down from the U.S. Supreme Court, according to The San Francisco

Iowa Lesbian Couple Sues Iowa Department of Health Judge will Rule on Birth Certificate Lawsuit Heather Lynn Martin Gartner, 39, and Melissa McCoy Gartner, 41, of Des Moines, Iowa, sued the Iowa Department of Public Health, arguing that the agency’s 2009 decision to only list Heather as a parent deprives their daughter, Mackenzie, 2, of the protections and benefits of two legal parents being present from birth, The Des Moines Register reports. Judge Eliza Ovrom announced on Monday that she will rule later on the lesbian couple's lawsuit seeking permission to have both their names on their daughter's birth certificate. They also say it’s unfair, as reported by USA Today, “…that the state lists heterosexual couples as parents on a birth certificate even when they conceive as they [The Gartners] did: via anonymous donor insemination.” The couple’s fear regarding medical decisions has already occurred. MacKenzie had to be hospitalized a few months after birth with a respiratory virus. They do not discriminate – they help the children who need help. In Fiscal Year 2008-2009 HANDY provided free services to a total of 1,932 children touching their lives 16,500 times. HANDY’s programs provide children with safety and well being, education, social and recreational activities, and advocates to give these children a voice. Catholic Newspaper Drops Gay Column BOSTON, MA – The oldest Roman Catholic newspaper in the country has apologized and dropped an opinion column written by a senior official with the organization running the church suggesting the devil may be responsible for samesex attraction. Last week, The Pilot quickly withdrew Daniel Avila’s column titled “Some Fundamental Questions on Same Sex Attraction.” The Boston archdiocese newspaper says it failed to recognize the theological error before publication. Avila says in the piece that “the scientific evidence of how same-sex attraction most likely may be created provides a credible basis for a spiritual explanation that indicates the devil.” The 182-year-old newspaper published an apology from the associate director for policy and research for the US Conference of Bishops. H
Long Island Gay PTA Holds First Meeting LONG ISLAND, NY – The Long Island Gay PTA held its inaugural meeting last week to lay the groundwork for what
organizers believe to be a first-of-its kind effort to create such a support network and address GLBT issues in the classroom. According to the Long Island Press, about 50 parents, students and supporters gathered for the meeting at the GLBT Community Center in Garden City that opened two weeks earlier. Organizers said they plan to meet with every local PTA on Long Island, push to include gay history in lesson plans and help form Gay-Straight Alliances in high school and middle schools, among other initiatives. Presidential Proclamation on Adoption Includes Gays WASHINGTON, D.C. – In his annual proclamation declaring November as National Adoption Month 2011, President Barack Obama included, for the first time, “sexual orientation” as one of the listed types of families. “With so many children waiting for loving homes, it is important to ensure that all qualified caregivers are given the opportunity to serve as adoptive parents, regardless of race, religion, sexual orientation, or marital status,” wrote the President in his proclamation. Five states prohibit same-sex couples from adopting children and it’s only been one year since Florida allowed gay couples to adopt. H
GOP Leader Booed for Opposing Marriage Equality ANN ARBOR, MI – House Majority Leader Eric Cantor was booed during a speech at the Gerald Ford School of Public Policy at the University of Michigan last weekend for opposing marriage equality. According to Think Progress, Cantor was asked how he reconciled his advocacy for state’s rights with support for the 1996 Defense of Marriage Act (DOMA) which prohibits the federal government from recognizing marriages performed in states that allow same-sex unions. Cantor replied, “I just believe in traditional marriage between a man and a woman.” Some audience members booed the Virginia Republican and shouted, “What about liberty?” and “None of your business!” H
Malaysian Police Ban Gay Arts Festival KUALA LUMPUR, MALAYSIA – Claiming that a gay arts festival was a threat to public order, Malaysian authorities have shut down this year’s Sexual Independence gay arts festival. The festival, which started in 2008 and had been mostly a low-key event, had grown this year to a five-day event causing the police and government officials to take notice in the mostly Muslim nation. This year’s festival was to start on November 9 and was themed “Queer without Fear.” The festival was to be held at a private arts center. H

SPRINGFIELD, IL – The former wife of Illinois Republican Congressman Joe Walsh has said that he owes her for child support. Walsh was the only Illinois congressman to be named a “True Blue” member of Congress for “unwavering support of the family” by the Family Research Council for his 100% pro-family voting record. The Chicago Sun-Times reported that Walsh’s ex-wife says Walsh owes more than $100,000 in back child support for their three children. Walsh counters that he and his wife had a “verbal agreement” that he didn’t have to pay child support during years when he wasn’t earning as much. H

Teachers Tell Bullied Kids Not to Be So Gay ESSEX, ENGLAND – Teachers allegedly told bullied children to act “less gay” if they want to end their torment. In a report by Essex County Council, students revealed they had been accused of making themselves a target for bullies by choosing to behave or look differently. As well as criticizing their supposed sexuality, teachers reportedly told youngsters to “wear their hair differently” if they wanted to avoid trouble. The comments have been met with outrage by anti-bullying campaigners and gay and lesbian support groups across the county. H
Coming to a Starbucks Near You NEW YORK, NY – He goes by the name “Mr. Pee-Pee” and his goal is to masturbate in every Starbucks’ restroom in New York City and to photograph the final results. Mr. Pee-Pee discussed his plan in advance on the internet’s Glory Hole Radio Network. Pee-Pee told Glory Hole that he’s a big fan of Starbucks and he plans to rate each restroom on its cleanliness and “how hot the chicks were” in the location and if anyone knocked on the restroom stall door and interrupted him. Kardashian’s Ex Gets Chippendales Offer LAS VEGAS, NV – Kris Humphries’ divorce after being married to Kim Kardashian for 72 days could become a huge career move for the on-strike basketball star. TMZ has reported that the Chippendales in Vegas has reached out to Humphries hoping to fill their empty celebrity emcee spot at the Rio Resort hotel. A rep for the show told TMZ: “We figured since he was unemployed and, the soon-to-be ex-husband of Kim Kardashian, a gig at Chippendales might be the perfect job to help restore his faith in women.” Also, an online dating website, LocalHotClassifieds.com claimed it’s willing to match Kris’ salary on “Keeping Up
LEXINGTON, KY – The mother of an 11th grade Lexington High School student said her son, Kasey Landrum, 16, was given an in-school suspension after he was caught wearing makeup 10 minutes after school ended. “The principal walked into the school and immediately started yelling at me and told me to get outside,” Landrum told WBBJ-TV news. Landrum said that he did exactly what Principal Steve Lindsey told him to do. Landrum said that another student who witnessed the incident told Lindsey that Landrum was just expressing himself by wearing makeup. The next day, Landrum said, he was called to the office and issued a three-day in-school suspension. The suspension form obtained by Shelly Maness, Landrum’s mother, cited her son was suspended on the basis he violated the school’s dress code which states: “When a student is attired in a manner, which is likely to cause disruption or interference with normal operation of the school, the administration will take the appropriate action. In matters of opinion, the judgment of the teachers and administrators will prevail.” “I don’t know what kind of disruption it may have caused or may not have caused,” said Henderson County Superintendent Steve Wilkinson. Wilkinson said the principal has the authority to determine what is deemed a distraction. H
Gay Couples Allowed to Hold Civil Ceremonies in Church LONDON, ENGLAND – Same-sex couples will be allowed to hold civil partnership ceremonies in churches and other places of worship in England and Wales. The United Kingdom’s Equalities Minister Lynne Featherstone said no religious group would be forced to host them, but those who wished to could apply by the end of the year. According to the BBC, marriage between people of the same gender is not legal in the UK but civil partnerships were introduced in 2005 to give couples the same legal protection as if they were married. A Church of England spokesperson said it had no intention of allowing civil partnerships to be registered in its churches. “’The House of Bishops’ statement of July 2005 made it clear that the Church of England should not provide services of blessing for those who register civil partnerships and that remains the position,” he said. Chaz Bono May Sue National Enquirer over Death Article HOLLYWOOD, CA – According to TMZ, Chaz Bono is mad at the National Enquirer for publishing a story that predicts that Bono will die in four years, claiming the whole story is a “smear campaign” and it’s “blatantly false.” The story was highlighted with a cover headline on the November 11 issue stating, “Chaz Bono – ONLY 4 YEARS TO LIVE.” The article cites “expert” opinions from Dr. Patrick Wanis who claims Chaz’s weight combined with the stress and various medications associated with his gender reassignment “increase Chaz’s risk of an early death.” The Enquirer says Wanis predicts Chaz will likely die by 2015. In the letter, Chaz’s lawyer calls the story “blatantly false and defamatory” adding, “the salacious and inflammatory headline and article were crafted for the malicious purpose of discriminating against our client’s gender and sexual orientation. Further, the statements you attribute to Dr. Patrick Wanis and your depiction of him as a medical doctor specializing in transgender health issues are highly misleading and blatantly false.” H
Eight Arrested for Manila Cemetery Pageant MANILA, PHILIPPINES – Eight people were arrested Monday night for staging an impromptu gay beauty pageant inside the Manila North Cemetery. More than 100 people gathered to watch the scantily-clad transvestites dance on top of tombs, prompting security volunteers to disperse the group. Many of the pageant's participants escaped arrest. Police said the arrested suspects desecrated the dead and disturbed other visitors at the cemetery. Some of those who were arrested defended what they did by saying they have been holding the event every All Saints Day. H
Indonesia Opens First Gay Medical Clinic BALI, INDONESIA – Indonesia’s first gay medical clinic opened in Bali to serve that county’s LGBT community. Gays and lesbian are often denied admission to public medical facilities due to discrimination in the mostly Muslim country. The center has been accepting patients since September 27 but had its official opening last week. The Gaya Dewata Foundation, which provides counseling and promotes safe sex practices among Bali’s gay community, says the clinic will be welcomed by a community scared to find help in a society that shuns them. The new Bali Medika clinic will provide general medical check-ups as well as screening for sexually transmitted diseases, hormone therapy and psycho-
logical support. H
Shorter University Require Staff to Reject Homosexuality ROME, GA – Shorter University has required its 200-plus employees to sign a “Personal Lifestyle” pledge rejecting homosexuality. Any employee refusing to sign the statement, which also requires staffers to reject premarital sex and adultery, face being fired. Shorter University is a private, coeducational, liberal arts university located in Rome, Georgia. It was founded in 1873, it is a Christian university historically affiliated with the Georgia Baptist Convention. According to the Atlanta JournalConstitution, one long-time staffer said that the new policy has staffers fearful that a disgruntled co-worker could accuse another of being gay out of spite. Students, however, are not required to sign the policy. H
Gay Couple Allegedly Booted from Bus for Kissing CHICAGO, IL – A gay couple is considering filing complaints against the Chicago Transit Authority (CTA) after the bus driver allegedly tried to have them removed from the bus for kissing. The couple claims that the driver yelled homophobic slurs at them and called the police after they refused to leave the bus. According to the Windy City Times, Christopher Buchanan, 22, and his boyfriend Derrell Hughes boarded the bus after leaving an afternoon program at the Broadway Youth Center. Jacob Meister of The Civil Rights Agenda is representing the couple and said he will pursue a resolution with CTA before taking legal action. An email from CTA media relations said a complaint had been made with customer service and that they were looking into the matter. H
Cruise Ship Meth Dealer Sentenced WEST HOLLYWOOD, CA – Last week, a Federal judge sentenced a West Hollywood man convicted of selling a selection of drugs that included meth and ecstasy on a gay Caribbean cruise. WeHo News reported that Steven Barry Krumholz, who admitted selling ecstasy, methamphetamine and ketamine to passengers on board the Allure of the Seas in February, received a 21-month prison sentence in the US Virgin Islands, the site of his arrest. Mr. Krumholz pled guilty to the charges against him in July. He faced a potential 20 year prison term and $1 million in fines. H
Miss Virginia USA Lashes Out at Gay Roommate RICHMOND, VA – Some people are calling on the Miss Universe Organization to speak out against current Miss Virginia Nikki Poteet, after the
24-year-old beauty queen allegedly directed homophobic slurs towards her gay roommate at a party last weekend. According to Think Progress, Derek Powell, Poteet’s roommate since January, claims Poteet became “extremely violent and physical and proceeded to call me and my boyfriend ‘faggots’ and ‘cocksuckers’” in their group house in Richmond, Virginia. Poteet denied the allegations but admitted to some sort of argument. Poteet has repeatedly denied any wrongdoing and insists that Powell just wants attention. She said she likes gay people and knew that Powell was gay when she first moved in with him. The Miss Universe organization has yet to respond to Powell’s allegations. H
Minnesota for Marriage Uses Gift Cards to Garner Votes MINNEAPOLIS, MN – Minnesota for Marriage, a coalition advocating for passage of a 2012 vote on a constitutional same-sex marriage ban, launched a campaign that will award people prizes for obtaining pledges to support the ban, reported the Minnesota Independent. The campaign asks each person to obtain five pledges to support the ban in order to be considered for a prize drawing. Drawing winners will receive a $100 Visa gift card. The drawing will be held daily through the month of November. The gift card campaign has caused bloggers to question whether such activ-

Anita Bryant Wants a “Gay Best Friend” HOLLYWOOD, CA – HBO is developing a movie about the singer-turned-antigay-crusader’s life. She and her husband, Charlie Dry, have actually met with the film's screenwriter, Chad Hodge, who happens to be openly gay. “I went to Oklahoma and spent three days with her and Charlie,” Hodge told a reporter at GLSEN’s Respect Awards. “I was the first gay person she agreed to talk to in 33 years,” according to E! Online. Bryant was a former Miss America runner-up and pop vocalist from the 1950s and ‘60s. She was most famous for being the celebrity face of the Florida orange juice industry until she attracted much controversy in 1977 for leading the successful fight to overturn Dade County’s ordinance that prohibited discrimination based on sexual orientation. “She was panicked to meet me and I was panicked to meet her,” said Hodge according to E! “We talked about everything: religion, homosexuality, and every detail of her life. I mean, everything! She really opened up to me. It started very standoffish, but then it slowly took a turn and she opened up and cried to me.” Hodge added, “Turns out she wants a gay best friend just like everyone else.” H

Sanctity of Marriage? Get Real! Apparently the biggest threat to marriage is the gays. Marriage should be defined as a union between a man and a woman. We have heard it all before, that gay marriage is “unholy and threatens to undermine the sanctity of the institution of marriage.” There is also a school of thought that believes if the US allows gay marriage, the moral fiber of the nation will crumble and there will be disaster. I am reminded, particularly this week, of a comment comedienne Wanda Sykes made a few years back: “Gays aren’t the biggest threat to marriage. The biggest threat to marriage is divorce!” As amusing as this is, it is the truth. Marriage used to be something “not to be entered into lightly” and should last “till death us do part.” Today, however that simply isn’t the case. In the past when you got married, you stayed married. Then as times evolved, if things weren’t perfect, you stayed together for the kids, then split up. People who are against gay marriage have put forth many arguments. However a popular opinion, particularly attached to the stereotypes of gay men, is that they would just jump into marriage after five weeks together, making a mockery of the institution. A fair point, though not a reason to prevent gay people from getting married. But yes, there could very well be a rash of quickie marriages followed by even quicker divorces. Luckily that doesn’t happen in the straight community. Oh no, wait, yes it does. The media has been full of the subject of divorce. One divorce in particular, that of reality TV queen, Kim Kardashian and her dim husband, Kris Humphries. There has, in fact, been no way to avoid the stories and speculation about Ms Kardashian’s divorce. Will she give back the ring? How much money did she make from the debacle? Where is he? What will she do with all the wedding gifts? As we all get swept up in the judgement and hoopla surrounding the ludicrous 72day marriage (which began with a multimillion dollar wedding), no one has ques-
tioned what respect has been held for the sanctity of marriage. The Kardashian Klan has stood by Kim in defending her against the idea that she got married for the publicity and the money. Now I am an old romantic at heart, so I am going to give her the benefit of the doubt. Even if she didn’t get married for anything other than love, she did revel in the publicity, the E! TV special, “Kim’s Fairytale Wedding” and the multi-million dollar photo deals. Now how respectful is that to marriage? No DOMA supporters have come up with the idea that reality TV stars should have a constitutional ban on them getting married; that they should be prevented from profiteering from the “sanctity of a union between man and woman” or that they should work out if they love the person first. No, because apparently, and according to their ideals, Kim’s laughable 72-day marriage is acceptable, simply of course, because she is a woman and Kris is a man. Anyone who watches “Keeping up with the Kardashians” with any regularity also witnessed younger sister, Khloé marry Lamar Odom after just five weeks together. We are more inclined to believe her wedding, first because as far as we know they are still happy; and second, and more importantly, they looked and acted like a couple. In the case of Kim and Kris (the spelling of his name is just all too suspicious in itself, you expect it from an LA power family, not so much from a guy from Minnesota), their relationship seemed to be comprised of him whining at being seen as another castrated male counterpart to the media hungry Kardashian women, and poor Kim looking totally vacant during their whole whirlwind romance. She never seemed that into him. There has been a backlash, granted. Cries of foul play and that the Kardashians have duped us. Therefore, she hasn’t gotten off scot free so to speak, and, as I am being kind, she is also nurturing a broken heart. Yet, I find it appalling the amount of space and time given to this ridiculous marriage that no one has come up against, and yet gay people are still fighting for the right. All people are complaining about is the money, the

publicity, and the potential that a subject on reality TV could possibly be staged. Really, what a surprise! Furthermore, matriarch, Kris Jenner has been working the talk show circuit like a mad woman and with one breath telling the nation how upset she is, not only for the divorce itself but for all the bad press and accusations being thrown at her daughter. Yet, at the same time, she has jumped on the divorce band wagon and is hocking her new book – a book which, I might add, contains details of the affair she had whilst still being married to the late Robert Kardashian. These points alone show an utter lack of consideration for the sanctity of marriage and yet they are selling books. The Kardashians have gotten very good at selling things, products, lifestyles and ideas. So whilst gay people are being prevented from getting married, a flagrant abuse of the foundations of marriage is playing out on our TV screens all in the name of entertainment and to get us to buy stuff ! Furthermore Kim has already become guarded, yet a “statement” has been bandied around that is telling everyone they can see the breakdown of the marriage in the upcoming “Kourtney and Kim Take New York.” Mark my words, people will tune in, watch and absorb it all with morbid fascination. Again where is the respect? Worse, whether you like to admit it or not, Ms Kardashian is a role model and a popular person. This is the reason the family rakes in over $65m per year. She will influence people, people who will genuinely see marriage as something totally frivolous. Lest we mention, this is the second time down the altar for Kim (the first, admittedly lasted longer, but was not played out for the world to see, giving it a hint of credence). I would like to know what the protectors of marriage think about this circus. Surely this money-making machine and PR juggernaut under the guise of a marriage is a bigger threat to the respect and sanctity of the institution then allowing people of the same sex to be joined together. To keep the straights out, I turned into a private club and within one month had over 250 members. I charged $1.00 per membership. I would be glad to help Fred Frejes accumulate facts about gay bars at the time. We had free Sunday brunches, and the dance craze was the Hulley Gulley, which everyone did as, I allowed dancing in the bar. We had a couple of incidences from some straights, that made the papers at the time.
Including one my doormen getting stabbed, fortunately he recovered. If he would like to contact me I would be glad to let him know the history of the place. In a way, numbers can act as a system of checks and balances for us – which may explain why they become such an intricate part of lives. I’ve noticed just how much this column comes to rely on numbers. Here is a compellation of a few given over the last year. Cross-Eyed
“Mr. Peepers” By AJ CROSS While standing alone by the pool table at your favorite hangout, a random stranger introduces himself to you only to ask if he was in the right place, because he was supposed to meet some friends. Taken back by his beautiful dark blue eyes, full red lips and intentionally messy auburn hair, you did not even realize he had asked you a question. And then his smile emerges as he repeats the question nervously. “Um yes, this is the place,” you reply. “Hi I’m Jake,” he says while still smiling. You introduce yourself and still you are taken back by how ridiculously attractive he is. “I just moved here a few weeks ago, so I am still learning my way around.” You already knew he was not from around here, because there is no way that that smile would have eluded you this long. He thanks you and then walks off. For the remainder of the evening you find every opportunity to catch a glimpse of him. After about forty-five minutes, a miracle happens. He and his friends come toward the pool table and it turns out that one of the people in his group knows you and decides to introduce you to him. You both smile and shake hands again as if it was the first introduction. As the group of friends begin to play pool, you both dive into intense conversation. He is witty, charming and his childlike humor quickly draws you in. He then says, “I want to show you something” and then he stands up, lifts up his shirt and digs into his pants and your thinking, “Oh shit,” and then he pulls a book out. You laugh out loud but don’t reveal why it is you’re laughing. A strange sense of relief matched with a tad of disappointment fills you now that you realize what he was reaching
for. He tells you that he takes the book with him everywhere, because it’s “hilarious” and he tells you that when you read about “Mr. Peepers,” you will love it. He then turns to a specific chapter and gives you the book. As you read it and find it to be as funny as he does, you get a sense of him and the lightheartedness in which he takes himself and the world around him. After reading the chapter and returning the book to him, two commonalities emerge in your continued conversation. The first is that you both are candid about who you are and have no fear in acknowledging your humanity or humility. The second, which is odder, is that you love to have someone read to you and he oddly enough finds pleasure in reading aloud to someone. It seems the strangest of things to create a bridge between two people. You manage to make it through an embarrassing attempt at darts, while having a conversation that was not based around Lady Gaga or bodily fluids and just as the interest heightens, it all comes to end by the closing of the bar. One of the people in the group whispers into your ear. “Don’t get too excited, because he’s straight.” Normally that would have been devastating news, simply because he encompassed so many attributes you found appealing, but then the strangest thing happens in your head. You think to yourself that even though any hope of dating or elevating to intimacy is not an option, you have just encountered one of the most interesting of persons. Remove sexual incompatibility, jealousy, envy or any of the elements that make being a boyfriend to someone complicated and you end up with something even better: a friend. Who would have thought that a plastic parrot named “Mr. Peepers” would introduce you to what you hope will be a great friend. Damn, where are the crackers? H

Word Play Unhappily Ever After The Fight for Gay Divorce By ChriStiAN AlExANdEr The stars at night really are big and bright, deep in the now-wounded heart of Texas. So I could see why upwardly mobile gay couples would want to make a home there. Minus a small populous of narrow minded, backward cowboys, it could be a very nice place to set up a home. Not anymore. Not if you happen to be a gay couple. Unlike Massachusetts, Connecticut, Iowa, Vermont, the District of Columbia, New Hampshire and New York, gay marriage is illegal in Texas. Very, very illegal in fact. In 2005, Texas voters passed a Constitutional Ban on same-sex marriage, even though State law already prohibited it. Talk about over-kill. Why not just post a sign at every entrance to the State saying “NO FAGS ALLOWED.” Oh but wait, there’s more. I know of a couple who had been legally married in Massachusetts, had adopted a baby, and decided to start their little family in “The Great State of Texas.” Mom, Mom and baby makes three, and they were like every other married couple in the United States. The first few years were good ones – and then they weren’t so good anymore. They were so bad, in fact, that Mom and Mom decided to obtain a divorce and work out joint custody of the toddler. The couple, Angelique Naylor and Sabina Daly, sought a judge in Austin, who granted the divorce. Unfortunately for them (and the baby) the Texas Attorney General, Greg Abbott, appealed the decision. His reason? Because he was protecting the “traditional definition of marriage,” which he interpreted to mean the same for divorce. Therefore, since they shouldn’t have been married in the first place, they could not legally be divorced. A Dallas appeal’s court threejudge panel also agreed that the State’s same-sex marriage ban WAS Constitutional. I can almost smell the logic, but the scent is very similar to cow manure. Angelique and Sabina tried to stick it
out, but finally separated in 2007 as the arguments between them continued to mount. They eventually were able to get a higher court to dissolve the marriage amid escalating animosity between them, but that decision too is being appealed. Here it is, 2011, and as far as I was able to find out, while the couple remain happily separated, the state of their marriage is in limbo. I am forced to wonder what box they have to check on a form that asks about your marital status, Yes? No? or Undecided! Enter J.B and his husband H.B. They too were legally married in Massachusetts and decided to move to Dallas. Neither man would comment on the reasons, but they decided to file for a divorce in Dallas County in 2009. A district judge, Tena Callahan (Democrat), said that she did have jurisdiction to hear the case, saying that Texas’s ban on same-sex marriage was unconstitional. Once again, the same Texas Attorney General swooped in and appealed to the 5th District court which overturned Callahan’s ruling to allow the divorce. Shortly thereafter, an attorney for J.B. filed a Petition for Review of the 5th District’s ruling by the Texas Supreme Court. As I am writing this, I remain unaware whether J.B and H.B. are still considered married or not, but I’ll put good money on not. As for the rest of us? Gay couples seeking divorce are getting mixed results across country. A Pennsylvania judge refused to divorce two other women who also were married in Massachusetts while at the same time, New York grants divorces without so much as a peep. Film Festival attendees around the world have enjoyed the short film “GAYKEITH,” but few know that the director is a star in her own right with many credits to her name (including the role of Jack Bauer’s wife in the first season of “24”). Leslie Ann Hope has in fact acted in countless film and TV projects (search her name at imdb.com) including the recurring role of Kristina Frye in the hit TV series “The Mentalist.” I first met Leslie because we worked on the same film, “Formosa Betrayed,” directed by her husband Adam Kane. Nope, Leslie is not lesbian, but she is Canadian! “I was born in Halifax, Nova Scotia, Canada, and am always proud to say so,” said Leslie. “With a dad in the military, I was raised all over Canada and also overseas. I moved to California from Montreal two weeks past my 18th birthday, and although it's hard for me to believe, I have actually lived longer in the States than I ever did in Canada, although I still consider myself Canadian.” You be interested to know that Leslie only found out the fate of her character on “24” six weeks before the season finale. “The tricky part was doing press overseas when the show was an emerging hit and I knew I was ‘dead,’” she revealed. “I had to carefully navigate questions like 'aren't you so excited for Season 2?' and 'what do you think is next for Teri Bauer?'” Leslie met Scott Edgecombe, the writer/star of “GAYKEITH,” through a friend. “We fellow ex-pat Canadians tend to find and gravitate toward each other in LA,” she said. “Scott was a struggling actor and I often hired him as a 'manny' for my young son. Scott accompanied me on several acting jobs and we made a funny trio – Scott the big boy babysitter, my kid and me, traipsing off to locations to form a makeshift household wherever the work took me. My son is now almost 18 and still adores Scott. In fact, it was my son who did a lot of the music research for ‘GAYKEITH’ and found the tune that inspired the dance music written by Jeff Danna.” “GAYKEITH” is described as “a short romp through the outrageous terrain that is Scott’s head – Luchadore, feather dusters, leather boots and internet porn.” As Scott explains about what became initially a monologue for his acting class, “This story is about how last Christmas, for 40 minutes in North Hollywood, I was gay.” “When I read his monologue and was laughing out loud, I decided to turn it into a movie script,” explained Leslie. “I bought the rights and wrote the script. I knew Scott would play Scott, and the rest of the script was determined by the
rule of writing whatever I wanted, i.e. if I saw Scott's head exploding, I wrote it. If I saw Scott in tighty-whiteys and a Santa hat, I wrote it. I was very lucky to actually direct what I wrote in its entirety – that rarely happens. The movie was edited by John Roberts who was simultaneously working on ‘Glee’ at the time.” Making the movie was a family affair as Leslie explained, “My husband was the producer, my dear friend Charlie Stratton was the co-producer, and my best girlfriend Cornelia Kiss was the property mistress. That being said, I think most of my pals were supportive and forgiving, but not entirely sure if they would love it. But you know what? In the truest sense, I don't care. That is to say, of course I want those closest to me to like what I like. But I am happy to say that ‘GAYKEITH’ in all its glory is all my fault, and I love it.” In keeping with the themes of this column, I asked Leslie what she would like to say to the homophobes of the world. She responded, “What I would like to say is unprintable. At the same time, we are subject to the federal Defense of Marriage Act (DOMA), which precludes federal recognition of these marriages.” Companies have complained that when a same-sex couple legally gets married, it requires them to maintain two sets of books because the couple is considered married under state law but not married under federal law. The double entries, they say, ripple through human resources, payroll and benefit administration. In a major shift in policy, earlier this year, President Obama directed the US Justice Department to stop defending DOMA and Attorney General Eric Holder sent a letter to Congress to inform them that the Justice Department will now take the position that DOMA should be struck down as a violation of a gay couples’ right to equal protection under the law. “The President and I have concluded that classifications based on sexual orientation warrant heightened scrutiny and that, as applied to same-sex couples legally married under state law, a crucial provision of the Defense of Marriage Act is unconstitutional,” Holder wrote. Also earlier this year, it was rumored that Coca Cola pressured its law firm, King & Spalding, from defending DOMA in court. King & Spalding were hired by the Republican-held Congress to defend DOMA in court. However, Coca Cola is one of King & Spalding’s largest corporate clients. The health department has argued that state law allows only a husband's name to accompany the mother's on birth certificates, reports AP. USA Today reported that State attorney Heather Adams said Monday afternoon that if a child's mother and father aren't married, there is no father listed on a birth certificate unless paternity is established pursuant to a court order. Adams said the health department has extended other rights to same-sex married couples since the ruling. But she said state law regarding parentage is gender-specific and not open to interpretation. “If I had to summarize the department's case in one sentence, it would be this: It is a biological impossibility for a woman to ever legally establish paternity of a child,” Adams said. Gartner said she was at her wife's side when they decided to have kids, when they saw a fertility specialist and when Heather Gartner was inseminated. “I was there when Mackenzie was born. I cut her umbilical cord. And for them to say I'm not a legal parent? It just seems ridiculous,” she said. The Gartners married in June 2009, and Heather gave birth to Mackenzie three months later. Attorneys for both sides agreed samesex parents should adopt their children if they plan to travel because at least 30 states have adopted laws similar to a federal rule that defines marriage as between a man and a woman. “We say (this case) is about protecting children, both in tangible ways, emotionally and in respect to their financial security,” Taylor a lawyer with Lambda Legal Defence and Education Fund in New York, told USA Today. “Legal rights afforded to kids with two parents provide basic security and vital protections,” Taylor said. A birth certificate is necessary to travel, to determine child support and to obtain government benefits. Lambda Legal also led the effort that culminated in the legalization of same-sex marriage in Iowa. It is unclear at this point when a ruling will be made by Iowa District Judge Eliza Ovrom. H

Seeing Clearly Island City Eyecare – A Full Service Optometric Practice By AlEx VAUGhN Dr. Alan Shaffer is originally from Wyalusing, Pennsylvania, and is a graduate of Penn State University. He relocated to Florida in 1985 after graduating from the Pennsylvania College of Optometry. The Florida Agenda sat down with him to discuss how his practice, Island City Eyecare, is helping the wider community see clearly. Island City Eyecare has been open a little over two years. Alan explains how he came to be on Wilton Drive. “I have been in Florida since 1985. I have been practicing for 25 years, but my original practice was in Boca. I sold it to move here. Dr James Brauss, one of the partners had his practice further down the drive, by the high school on 4th avenue for 20 some years. He wanted to expand because his family is in optometry. He asked me if I wanted to create a joint practice together, as I had been in the community for many years. We looked for a location, found this one, bought it, built it out and have been on the drive ever since!” Island City Eyecare offers complete vision-health examinations; contact lenses (including fitting lenses for people with stigmatism and keratoconus); eye-glasses;
low-vision evaluations for visionimpaired patients; Lasik co-management and evaluations; and a comprehensive line of designer sunglasses, including brands like Dolce & Gabanna, Michael Kors, Prada, Gucci and Rayban. Schaffer also explains some other elements that differentiate his practice, “We offer 24/7 emergency eyecare for red eyes and other issues. We pride ourselves on having the latest technology to provide the most comprehensive eyecare we can. We consistently maintain a pulse on technology.” When asked why he likes having a practice in Wilton Manors, he says, “I enjoy being close by in order to serve [the com-
munity] easily and conveniently.” He is quick to point out that the practice services everyone’s eyecare needs, “We do accept many different insurance plans, and when you take insurance people will find you. We don’t feel we only service the gay community. We get many referrals and people will travel to see us.” He explains further the range of ways that Island City Eyecare obtains and maintains their customer base. “We send out surveys, something other practices

Yet for us the summer season is when a lot of people will come to see their doctors, while it is quiet. School teachers for example, who are on vacation come in and visit us. We don’t really feel any part of the year is a slow-down, People always need to see!”

Just recently we had three patients who found us on Google.” When you walk into Island City Eyecare, the first thing you notice is that it doesn’t look or feel like an optometrist office. It has a welcoming atmosphere and stunning modern furniture. Shaffer explains, “We have distinguished our practice to make it non- sterile. We want it to be a place that is welcoming.” This ethos carries through into his management approach “I definitely have a flexible management approach. This helps in creating a warm inviting practice. We want to give five-star treatment in order to distinguish ourselves from a run of the mill sterile medical practice. Having a team vision, team work and caring team members allows us to treat our patients as a part of the family.”
The community has responded very well to the practice. Shaffer attributes this to the attitude of the staff. “We have a very open door, we treat people of all persuasions, low or high income, we don’t judge and try and welcome everyone.” He continues, “We are also involved with GLBX, GLCC and the Art Walks. We open our doors to everyone and continue to remain part of the community.” When asked about how he feels the community has changed, he laughs, “Well growing up in a conservative, small town atmosphere with a lack of acceptance, it has changed drastically for me. Living in South Florida, you see people who are more open to different persuasions and ethnicities. In the last 20 years, South Florida has become so much more open and accepting. It is more comfortable and easier to live your life open here. It is more enjoyable for everyone when there is less stress.” How does he feel attitudes have
changed towards gay people? “There is a positive change in attitudes in the general sense for sure. There are more gay groups within associations. As being gay has become accepted, there is more opportunity to be yourself. The pressure to stay in the closet for fear of judgement is definitely diminishing. Of course, there are changes in politics as well, with the repeal of DADT and the discussions on not defending DOMA.” When asked about the future, he is clear about the vision. “We are always trying to maintain a finger on the pulse of technology to provide the best quality eyecare. We are also now expanding into examining overall body health and wellness. There is more to eyecare than just seeing 20:20. General health affects the eyes as it affects the rest of the body. “We have recently obtained new technology to evaluate if your nutritional supplements are working. All your vitamins and nutraceuticals make up a billion dollar industry but, till now, no one really knows if they work. There is finally technology to measure that. The machine measures your antioxidant levels, the higher the antioxidant level the better. If your levels are low, you need to increase them.” Would he develop Island City Eyecare into a chain? “No, I would rather be the CEO of a small company than a large one. I would not want to expand to the point of losing that personal touch. I come from a small town and I like the family atmosphere we offer.” There is no question that Alan and his team are passionate about their patients Alan is clear to state that though he has practicing for 25 years, he “still loves it.” The final question for Shaffer causes him to pause. If he had an open check book what business would he go into? After much thought he says, “As I said, I love what I do. If I had an open check book, I would love to take care of my patients and not worry about the bills. I would help people who aren’t as able to help themselves.” H

The Fabulous Fontainebleau Miami Beach From Golden Age to Modern Day By PAUL RUBIO
Part Vegas. Part Miami. All fabulous. The recent re-launch of the iconic Fontainebleau Miami Beach has forever changed the landscape of Miami Beach. After a whopping billion dollars in upgrades and additions, the 22-acre, 1504room oceanfront mega hotel stands as a self-contained world of hotel indulgence, great shopping, exceptional dining, wild partying, and beachside relaxation and frivolity. Though the hotel’s reinvention has brought it back into the spotlight as one of Miami’s hottest hotels, the Fontainebleau Miami Beach has a long history of being Miami Beach’s “it” hotel. How to Be Hardcore! Creative Core Training By TOM BONANTI So you want to turn up the heat under your current fitness regime a few notches? What’s the first thing you should focus on? Should you start lifting mammoth weights to overload your muscle groups? Maybe sign up for yoga a couple of nights a week to increase flexibility? Perhaps you could start your day off with an hour of cardio on an empty stomach to jump start your fat loss program. With so many choices, where does a sane person start? Most fitness professionals have, for some time now, promoted developing core strength as a foundation for any fitness regime. If you have a strong trunk or torso, which is considered your core, you can simply go farther more safely and successfully with your fitness goals. Good core strength is also essential for such popular Florida past-times as swimming, tennis and biking. Core strength begins with your posture. Stand up straight and tall – keep your shoulders back, don’t slouch, pull your belly button into the spine and lower back. Ask your workout partner, trainer or massage therapist to evaluate your posture honestly to give you pointers. Improving poor posture is like starting a new habit. It takes time and practice and a sense of self-awareness, but you’ll catch on if you persevere. It’s crucial to develop core strength since the muscles of this area protect your spine and help prevent dreaded back injuries. By the way, back injuries and lower back pain are the main reason why people miss work and workouts! So, which are your core muscles? Your abdominals including your obliques (your sides), upper and lower back (deltoids and rhomboids), hips (gluteals, hip flexors, psoas), outer and inner thighs (abductors and adductors), hamstrings, the pectorals and triceps to some extent, and a whole host of deeper muscles you’ll never see, make up your core. Training your core should be an essential part of everyone’s program.
Just as maintaining good posture is vital for core strength, so too is maintaining good form when you are stretching or doing cardio and especially pumping iron. What good is it to be able to curl a 100 pound dumbbell if you rock back and forth and throw out your lower back? Review your form with each weight training exercise. Make sure you know which muscle groups you are training. Be careful not to rush, jerk or swing your weights. Significant core strength can be achieved simply by maintaining good form when you’re lifting weights. To focus on the core, start out simply by working out on a Swiss Ball. Exercising on an unstable surface can help develop strength and steadiness in several muscles of the core at once. For example, instead of doing overhead dumbbell presses seated on a bench, steady yourself on a Swiss ball and then perform the exercise. When performing dumbbell flies, situate yourself by lying across the ball and then do the exercise. There are tons of ways to work abdominals on a Swiss ball, crunches, reverse crunches, bent knee leg lifts, you name it! There are literally hundreds of ways to strengthen your core with one of these Swiss Balls. Just make sure that you get used to steadying yourself before you add heavy weights to your exercises. Now that I have introduced you to core training, you can download different exercises and regimes from the internet. With a little creativity and hard work, you, too can be hardcore! The Best Comfort Food Comes from the South Portia’s – True Southern Cuisine By TIM SLIVINSKI Just for the record, I am not from the South, nor have I ever lived in the South. I have actually spent relatively little time in the South, other than South Florida, which we all know is not really the South anyway. However, in my years of dining—and there are many because I am old – I have come to have an appreciation and a palate for the many cuisines of the world and of our great, diverse nation. Therefore, I know for certain that some of the best comfort food in the world comes from our very own South. It’s not fussy; it’s not fancy. It’s just flavorful good food, especially when it’s made right. And the new kid (or should I say pig?) on the block, Portia’s, is doing it very, very right. Located just a block or so east of Andrews on the north side of Oakland Park Blvd., Portia’s is a comfortable, warm, friendly place that will have you feasting on wellmade comfort food and leaving satisfied. Walking in, there is a small dining room on the left with a larger dining area to the right. White tablecloths and linen napkins add a touch of class to the friendly vibe. On a recent rainy and windy night – just right for old-fashioned comfort food – we were shown to a corner booth and settled in to peruse the extensive menu offerings. In less than a minute, Bill, our most amiable and affable server, came to our table with cracklins, complimentary munchies, and enquired
about our drink preference. We chatted for a moment about this being our first visit and then ordered two glasses of Pinot Grigio. When Bill returned with our wine, he explained some details about the menu to us and offered some suggestions. This man knows his menu. We didn’t hesitate to place an order of Fried Green Tomatoes ($6.95) to feast on while we contemplated and discussed dinner decisions. When the appetizer arrived, it was clear they were freshly made in house. No, they weren’t perfectly round and even, and that’s all to the good. Freshly dipped in a great crunchy breading, they were crisp and tangy and not at all greasy. The accompanying dipping sauce was a mild horseradish sauce that had just the right amount of heat. We were out for a leisurely dinner, but they did not last long on the plate. I am a devotee of fried chicken, but I rarely order it because I hate to waste the calories on fried chicken that is sub-par. This night, I decided to throw caution to the wind and indulge. Portia’s offers its fried chicken entrée in either a two-piece dinner ($10.95) or a three-piece dinner ($13.95). Even better you can select any combination of pieces you desire: breasts, legs, thighs, or wings. I opted for the two-piece dinner of a breast and a thigh. The menu states (and Bill told us) to allow up to 20 minutes for the preparation.
Let me tell you, I would have waited twice that long once the entrée arrived and I tasted it. It is what Southern Fried Chicken should be. Crackly and crispy with secret spice batter on the outside that opens to reveal chicken that is juicy and moist. Decadently delicious. The chef brines the chicken for 24 hours, helping to create that moist juiciness so often lacking in poultry. From a long list of signature side dishes, I had selected Macaroni and Cheese (big surprise) and Collard Greens. Both sides were pleasing, with the collards having just enough smoky pork flavor and the mac and cheese just gloppy enough – that’s a compliment in my book – to be like mom’s. Fussy food? No, but so very delicious. My partner has a thing for chicken livers ($12.95), so when he saw them on the menu, I knew there would be no other choice for him. When his plate arrived, a heaping portion of fresh chicken livers that had been coated with a secret flour mixture arrived in all their crunchy glory. He proclaimed them tender and moist with just the right amount of crunch as they began to disappear from his plate. As his sides, he selected Pickled Beets, another of his favorites, and the Macaroni and Cheese. He relished the beets, saying they were just like he remembered at his grandma’s house when she cooked dinner. His portion was so generous that sever-

Throughout our experience, Bill checked frequently to make sure everything tasted great—it did!—and to answer any questions we had as well as refill wine and water glasses. Portia’s menu has several entrees that are in my future. Chicken and Dumplings, Bacon Wrapped Meatloaf, Chicken Pot Pie, and Catfish with Hush Puppies all caught my eye. An appetizer—Potato Rolls with Cheese Dipping Sauce—will be on my table too. Two gentlemen near us were sharing it and raving about it. It looked very tasty. Great food at reasonable prices in a comfortable atmosphere with attentive, knowledgeable service—Portia’s has it all going on. If you like Southern food and have not let yourself indulge in the real thing in quite some time, then head to Portia’s. They do a heck of a job with true Southern cuisine. H
jean’s Steak kitchen Tartare Legend has it that the nomadic Tartar Tribe didn’t have time to cook their food and often ate on the move, so they tenderized their steaks under the saddles of their horses, thus giving the name to the culinary delicacy, “Steak Tartare”. The dish remains very popular in Europe and is synonymous with Parisian bistros. It is often served with onions, capers and seasonings usually incorporating fresh ground pepper, Tabasco, Worcestershire sauce and a raw egg on top. When creating Steak Tartare, you must make sure the beef is high quality. It is important to buy the meat (whether it be beef tenderloin or fillet mignon) and eggs from reputable sources as you will be serving them raw. French food historians beleive that the dish became popular after World War II. Steak Tartare is now regarded as a gourmet dish and is best served with homemade fries. • 2 lbs Tenderloin • 1 egg yolk • 2 teaspoon mustard, use only real Dijon mustard • 1 teaspoon ketchup • 1 tablespoon onions, finely chopped • 1 tablespoon cornichons, finely chopped • 1 tablespoon capers, drained and chopped • A few drops of Tabasco sauce • 1 teaspoon Worcestershire sauce • salt and pepper
In a bowl, mix the egg yolk, onions, capers, mustard, ketchup, Worcestershire sauce, Tabasco sauce, salt and pepper and beat lightly for a few seconds. Trim and grind the meat. Add the meat and mix lightly with a fork for a few seconds. Serve immediately. We served this in our restaurant in France with the raw egg on top, and the seasonings around the plate, but most of our patrons would ask us to mix it for them. Steak Tartare cannot be preserved more than 2 hours, even in a fridge. Serve with french fries or as a starter. You are the chef. Drink a Red wine such as Beaujolais, or a Crozes Hermitage with this dish… Bon appetit! H
