Located in Indian Shores, The SunCoast Seabird Sanctuary is dedicated to the care and rehabilitation of injured avian life, with an on-site hospital. The Lowry Zoo, the Florida Aquarium and the Tarpon Springs Aquarium offer experiences with marine and wildlife most will never forget. Or, strike out on your own adventure at one of the many preserves. Brooker Creek Preserve's 8,500acres are sanctuary to over 50 reptiles, 40 mammals, 160 bird species and 20 amphibians, of which many are rare or listed as protected. Shell Key Preserve is a 1,755-acre preserve, whose unique habitat provides a sanctuary for vulnerable and protected wildlife species. Moccasin Lake Nature Park, a 51acre preserve, or Boyd Hill Nature Park located on Lake Maggiore, a 245-acre preserve, will bring you up-close to many of the endangered plants and rare wildlife of the Tampa Bay area. Botanical Bounty Not only is the region rich in botanical beauty, but also features the added benefit of a rich history and culture. The signature destination of St. Petersburg's Sunken Gardens, first opening in


1935, offers rare foliage, along with a magnificent butterfly garden. The beautiful Palm Arboretum sits on two-acres of bounty offering hundreds of botanical specimens. Florida Botanical Gardens features 90-acres of protected wetlands and endangered scrubland, along with an abundance of spectacular color throughout the year, and a very special Children's trail. A member of the National Register Of Historic Places, Weedon Island Preserve, situated on Old Tampa Bay, was once home to at least four prehistoric cultures who thrived on the area's natural abundance. The Cultural and National Historic Center features a creative blend of environmental education infused with the Weedon Native American Indian culture.

HAPPENINGS On the fourth weekend in January the Annual Arts and Crafts Festival is held at the Venice Municipal Airport. The Venice Symphony begins its season in January and has concerts on the first Friday of the month through April. The Venice Little Theatre runs from October through May, while the Golden Apple Dinner Theatre features year-round performances. Each January brings Sarasota Arts Day, a celebration of the local artists, on the streets of downtown Sarasota, along with the St. Armands Circle's Winter Art Festival, Punta Gorda's Sullivan Street Craft Festival and the Annual Downtown Venice

Craft Festival. The official opening of the Opera Season includes a Sarasota extravaganza and the Winter Concert Series of the Jazz Club of Sarasota. January also plays host to Circus Sarasota Opening Night and the Southwest Florida Heritage Festival at the Crowley Museum. In February, when our northern counterparts are shoveling snow, we are continuing to enjoy outdoor recreation and numerous festivals including the Anna Maria Island Art & Craft Festival, Venice Craft Festival and Siesta Fiesta Craft Fair. March winds bring the Annual Downtown Venice Art Classic, while live performances continue this month at Florida Studio Theatre and The Van Wezel Performing Arts Center, along with many others throughout the area. April offers up the 17th Annual Sharks Tooth Festival, along with the Florida Winefest & Auction at the Longboat Key Club. 2009 will be a great time to purchase real estate on Florida’s Southwest Coast. Prices are at levels comparable to what we saw seven years ago and interest rates are near historic lows. But some of the buzz words have changed. Everyone is talking about short sales and foreclosures. Prospective Buyers should become informed of the legal issues inherent in these types of transactions. This article describes some of those issues but is no substitute for legal representation. In a short sale transaction the seller of property asks its mortgage lender and/or other lien holders to release the property from the lien(s) for less than the full amount owed them. The price and terms of the Purchase and Sale Contract are negotiated between a Buyer and Seller who execute the Contract and deliver it to the Seller's lien holders for approval. Both the Buyer's and Seller's obligations are contingent upon the lien holders' approval. Typically, the buyer makes a relatively small earnest money deposit with his or her attorney who will also review the contract on behalf of the buyer and monitor the short sale approval process. The Buyer's obligations can still be made subject to satisfactory inspections and financing however, the inspection and financing contingency clauses are modified so that time periods do not begin to run until the lien holders have approved the contract terms. These clauses protect the buyer from spending sums on inspections and appraisals before the short sale is approved.

Buyers should be aware that some of the short sale contracts allow the seller to continue to submit subsequent offers for lender approval. This can be problematic and we encourage our clients to make their highest and best offer so that they are not displaced by another prospective buyer willing to pay more after weeks of waiting. The short sale process typically takes 2 to 3 months although we have obtained some approvals in as little as 3 weeks while others have taken as long as 9 months. During this period the lender reviews the financial status of the seller and obtains a value opinion of the property. If the buyer cannot wait this long he or she should consider making an offer on a bank-owned property or non-short-sale property. When making an offer on a bank-owned property a buyer should be aware that the Purchase and Sale Contract has been modified by the bank's attorneys to limit the seller's liability and to remove some of the buyer's rights. These contracts should always be reviewed by an attorney. Although many Realtors understand the terms of the contracts they are prohibited from explaining the potential legal ramifications to buyers. Buyers should consider that many bank-owned properties have remained vacant for an extended length of time. We therefore recommend that our clients obtain mold inspections in addition to the typical home inspection and termite


inspection. When representing buyers of bank-owned properties we also review the chain of title to the property to make sure there are no outstanding liens or code enforcement violations that would affect our client's title in the future. We also ensure that the proper fees are charged on the Settlement Statement.

While the economic downturn has made the purchase process more difficult to navigate through we are certain that benefits of purchasing in this market far outweigh the costs. So, you are thinking of buying a house in Florida. Or perhaps you have already bought one. Congratulations! Despite some media depictions of Florida as a destination in decline, Florida is still a great place to vacation or live. Housing prices are the lowest they have been in years. Sarasota's beaches rank among the top in the world. Our landscape is beautiful and serene. And, well, the weather…. As an immigration lawyer practicing in Florida, the question I receive most often from Canadian visitors is “How long can I stay in the U.S.?” There are several options for staying in the U.S., depending on the length of time one desires to be here and the extent to which one wants to be involved in work and/or business.

Canadians may come to the U.S. without visas as tourists for business or pleasure for six months at a time. I am often asked if the six months is cumulative for a year, or whether one then has to stay out of the U.S. for a certain period of time before coming back in for another six months. There actually is no formal rule on that. Some people come for six months, leave for a month and come back for another six months without running into difficulties. Others come in for a few weeks, return to Canada, come back in a year and are told they cannot enter. The answer is that there is no answer, and it depends on that person's particular set of circumstances. But one can take a few steps to avoid immigration problems as a visitor.

Unfortunately, we do not have a “retiree” visa. This type of visa has been proposed for years. Perhaps the state of our economy and the entry of newly elected officials with a better sense of the tremendous contributions of foreigners will result in changes to the present system.

Entry into the U.S. is governed by the U.S. Customs and Border Patrol (CBP), a division of the Department of Homeland Security. Entry is within the discretion of the CBP.

In the meantime, however, unless you wish to study or work (for an employer or your own business), the only option is to come as a visitor.

The CBP is charged with determining whether one's visit is actually a visit or if the person's intent is to come and work or reside permanently in the U.S.

Tips from RBC Bank for Canadians buying in the U.S. The Sunshine State has a lot to offer Canadians, which is why more than 2.7 million visit each year, including more than 400,000 snowbirds. Florida is often the destination of choice for a Southern vacation – and a way to avoid harsh Northern winters. The Wall Street Journal reported on Sept. 5, 2008, that “the largest proportion of foreign buyers of U.S. homes (24%) from May 2007 to May 2008 were Canadian, double the percentage a year earlier, according to the National Association of Realtors (NAR)” This confirms that Canadians are taking advantage of the soft real estate market all over the U.S., including Florida. When considering buying a vacation home in the U.S., take advantage of the on-average low mortgage interest rates that we've seen over the last 5 years, as well as the large inventory of properties for sale, with something for all types of lifestyles and budgets. There is a perception from Canadian residents that they have to pay cash or make at least a 50 percent down payment to purchase a vacation or investment property in the U.S. This presents a difficulty since most do not have a social security number or a credit history in the States. This is true if you request a mortgage from most U.S. banks. However, RBC Bank (formerly RBC Centura), a fully owned subsidiary of RBC Royal Bank, has developed an innovative cross-border banking program called RBC Access USA, especially designed to help Canadians with their U.S. banking and home financing needs. The bank has various mortgage solutions, and can tap into Canadian credit histories for clients who bank at RBC Royal Bank, to make getting a mortgage in the U.S. easier. Consequently it may be advantageous to consider getting a mortgage in the U.S. with RBC Bank. Your mortgage in the U.S. will be disbursed in USD which avoids the premium on the conversion of your CAD to USD for the amount of the loan. As an example, if you pay your property USD 200,000 and you finance 75% with RBC Bank, you will get USD 150,000 mortgage, which means that you only have to buy USD 50,000 (or CAD 62,500.) However if you pay cash using CAD or you get a mortgage in Canada in CAD, you will need CAD 250,000 to pay the property USD 200,000. Second, Canadians in particular will find banking and mortgage industry laws, regulations and terms are different in the U.S. than the ones back home. RBC's team of crossborder specialists understand these differences and can help answer your questions. For example, it can take three to four weeks to get a mortgage in the U.S. However, if you are planning to buy in the near future, you may benefit from pre-qualifying, which can save time and give you bargaining power to help negotiate a better price, especially in today's buyer-friendly market. Also, most of RBC Bank's mortgage loans offer the option to repay the principal partially or in full without any pre-paid penalty, which provides flexibility for the borrower. Another feature that most Canadians are not familiar with, when getting home financing in the U.S., is the closing cost which includes third party fees, taxes, etc. As part of the buying process, the mortgage specialist will provide the borrower with what is called a “Good Faith Estimate,” which itemizes all the charges involved in the transaction.

Here are two things for Canadian and other non-U.S. residents to know if you're in the market for a second home in Florida.
