he majority of employment-related lawsuits result from the termination of employees. Many of these lawsuits could have been avoided if employers had just followed a simple procedure. First, employers should take action to obtain all the facts, including the stories of the employee, the manager and witnesses, as applicable. Second, employers should evaluate prior discipline and termination decisions for similar offenses. Third, employers should analyze the risk of a legal action narrowing the options before making a decision. Before terminating an employee, it is important that employers give the offending employees an opportunity to explain his or her side of the story. Given an opportunity, employees may admit to the rules violation or agree that their job performance has been unsatisfactory making the termination less difficult and greatly minimizing legal risk. An option available to employers that may be useful in some situations is first suspending the offending employee to ensure a proper review of the suspected performance issues or misconduct is conducted. The preliminary review should consider potential factual and legal issues presented by the situation and what actions could be taken to improve the employer’s position. When considering the disciplinary actions taken against other employees in similar situations, the employer should consider possible disparate impact claims based on legally protected classes. A review of the relevant documentation is critical in advance of the termination. Documents relating to the particular offending employee as well as those

If an employer finds a lack of documents supporting the termination decision, it may be in its best interest in some situations to delay the action until proper documentary support is available. Employers can further minimize legal liability by considering the person who will communicate the termination decision. This person needs to have a working knowledge of the relevant facts and possess the skills and personal qualities to communicate the termination decision in an appropriate manner. It helps the employer’s defense if the person
Another trusted manager, or a trusted employee if a manager is unavailable, should be present as a witness when the termination decision is communicated. It helps minimize the possibility of legal issues if the matter is reviewed by another manager or legal counsel before the employee is told of the termination decision. Implementing and following this simple procedure will greatly assist employers in minimizing legal risk associated with discipline and termination decisions. This simple procedure will also ensure that employees are treated consistently and fairly.

Member Spotlight
Chris Smith: Holding the Vision clouds,” Chris found that businesses can reduce the costs associated with having full-time employees, do business anytime, anywhere, get the staffing expertise they need without worrying about turnover or fraud issues, and utilize shared infrastructure to further enhance efficiency. In fact, it was while he was working with the shared services model of corporate accounting in the 1990s that the seeds of Chris’ visions took root. He wanted to take best practices from the shared services approach and help make business operations more efficient. Chris saw an ideal fit with technology, and he remained ahead of the technology trends that make outsourced accounting the efficient and effective process that it is today. Now he and his nine employees, including two other CPAs and five accountants, can take the duties of entire accounting departments — even those of the chief financial officer — and do them for clients in the clouds.
C
hris Smith, CPA and owner of CB Smith & Associates, has a knack for explaining the complexities of accounting and taxes and putting them in terms everyone can understand. Some call it a gift — and it’s one that enables him to combine his love for accounting with a deep desire to help individuals and business owners save money and plan for the future. That often means forming a vision and seeing it through to fruition, which is what Chris has done with his own firm. He founded CB Smith & Associates in September 2003 to provide professional accounting and tax services, along with business management guidance, and then expanded its offerings in 2006 with remote accounting services because of the many advantages they offer to small and midsize businesses. By doing their accounting virtually, or “in the

Chris has a keen eye for solutions, and believes in a partnership philosophy that helps businesses remain profitable and successful. For example, he had a client whose business processes were inefficient and in need of improvement. As a former corporate controller, Chris knew that the client’s firm needed scalability. No matter how large it would grow to be, its processes had to keep up. He merged his knowledge of accounting with his expertise in business process automation — a unique combination in the accounting world.
After undergoing an extensive discovery process to determine how the client’s business processes were running, he implemented a plan to tackle three primary objectives: eliminate paperwork, reduce costs and improve business processes. Today, CB Smith & Associates is a proud member of the Cumming-Forsyth County Chamber of Commerce since 2003 and is also the Chamber’s outsourced accounting firm of record. Its sister company, Reliance Payroll, provides payroll and human resources services for the Chamber. Chris shares his expertise as a speaker, and has published articles in The Atlanta Journal-Constitution, Atlanta Business Chronicle and Appen Newspapers. He also has been featured as an expert on Fox 5’s “Good Day Atlanta.” Chris earned a degree in accounting from Georgia State University’s J. Mack Robinson College of Business and is active in local community groups such as the Rotary Club of Lanier Forsyth and numerous CPA organizations. Chris and his wife Mary, a human resources professional and partner at Reliance Payroll, live in Cumming and have three children. When he finds spare time he enjoys golf and boating.
