RICHMOND – State budget language adopted by the House Appropriations Committee would delay the expansion of Medicaid and other benefits of the new federal healthcare law in Virginia, a statewide group said Wednesday. Act would hurt Virginians who need better health care – and hurt the state’s economy. “Virginians deserve better ... They deserve quality health care,” said Julia Newton, vice president of Service Employees International Union Virginia 512, a union representing home care providers in Fairfax and Loudoun counties. Michael Cassidy, president of the Commonwealth Institute for Fiscal Analysis, a nonprofit think tank, said the delay could cost Virginia millions of dollars. For every day the law is delayed, he said, Virginia would miss out on $5 million in federal tax money and nearly $400,000 in state budget savings. “Delaying [is] financially irresponsible for Virginia when you account for not only the loss of federal dollars ... state budget savings... but also the access to quality affordable health

care for hundreds of thousands of hardworking Virginians across the state,” Cassidy said. Cassidy and Newton spoke at a press conference held Wednesday by the coalition, which includes nearly 60 organizations. On Sunday, the House Appropriations Committee adopted budget language that would require a long list and three phases of Medicaid reforms as a condition to expanding the federal-state program, which serves low-income individuals and families. Under the committee’s language, the General Assembly would have to approve the expansion after completion of the reforms. The coalition said these stipulations would delay the Medicaid expansion by at least six months – from January 2014 until July 2014. Karen Grizzard, who chairs of the

The expansion would “make necessary mental health services and primary care available to thousands of people who don’t have that care today. Any delay [would] hurt those Virginians,” Grizzard said. One such person is Martha Harding, who works at a minimum-wage job to help support and raise her four grandchildren. Her job doesn’t offer benefits, and like other Virginians age 55 to 64, she is too young to qualify for Medicare. Harding spoke at the news conference and urged state legislators to expand Medicaid as part of the Affordable Care Act’s implementation.

CRIME OF THE WEEK - FEBRUARY 4, 2013 The Frederick County Sheriff’s Office and other area agencies are investigating reports of persons making bogus promises to render services to citizens in order to gain entry to their homes. Such promised services include cleaning, driveway repair or sealing, or in some instances, simply asking to use the bathroom or for something to drink. If entry was allowed, the victims noticed items missing from the residence, once the suspect left the area. One suspect in these incidents is described at a white male, clean cut, wellspoken, 6’2”, 18-20 years old with short hair and a medium build. He is described as driving a gray pickup truck. Other vehicles also mentioned were a blue Ford Explorer, a 4 door red car and a white full-sized pickup. More bad optics in Middletown

The calm before the storm? Middletown’s newly minted planning commission. By Sue Golden Frederick County Report Troubles are back in Middletown. The Town Council seems intent on instilling civility into its workings. The biggest issue on the horizon for the council is the next budget, which appears to be on schedule. An audit is in process. Things seem serene. But wait. Lurking beneath the surface are some very troubling issues. Readers probably remember the fateful day of March 12, 2012 when then-Mayor Mark Brown and Councilors Gil Barrington and John Blaisdell abruptly resigned from office leaving the town in the lurch. Town attorney David Griffin’s letter of resignation was read at the same time. Councilor Carl Bernhards, Jr. resigned for personal reasons soon thereafter. No mayor, no quorum, no attorney: then-town manager Joan Roche had her hands full. Jump forward to 2013. Mr. Griffin is expected to be appointed town attorney at the council meeting on Monday, February 11th. At the January 22nd town council committee meeting, current Mayor Charles Harbaugh IV asked Mr. Griffin “Can I ask what made you want to leave?” Mr. Griffin responded. “Sure. Absolutely. I’m not sure I am the guy you guys want to bring back. Our position is that we represent the locality. It’s not the personality. I’m not here to get between policy decisions that go on here. That’s up to you all. That’s not my job. I can be a parliamentarian. I can tell you what Roberts Rules are. But I am not a referee and I am not going to be a referee. Not everyone can be a referee. “The law is real clear. How a locality works is you are a municipal cor-

poration. You are no different from the Norfolk Southern Railroad. You are a company. Councilmembers are essentially the board of directors of that company. If I see you doing something illegal, I’ve got to tell you. Ultimately, when you decide to continue down that road, I have a choice. I can’t turn you in. I can’t get my client in trouble. But I can’t let you keep doing something that is wrong either. So I have to lay it out and say no, you can’t do it this way. After that, I have to walk. That is where we are now.” Interestingly, everyone from the prior council except Mr. Bernhards, Jr. is back involved with the town. Councilor Harbaugh IV is now mayor. Councilor Donna M. G. Gray is on the council. Former councilors Barrington, Blaisdell and Davis are on the planning committee and Mr. Brown was appointed a citizens advisor to the commission. Another interesting point is that the former members of council who left the town in such a mess, were not only appointed to the planning commission but Mr. Blaisdell, who apparently did not attend one meeting between the time he walked off of the council until the day he first sat on the planning commission, was voted chairman of the commission. The planning commission meetings have been extremely contentious. The first issue discussed was the updating of the town’s comprehensive plan. The planning commission prior to the new appointments was working on updating the comprehensive plan that was approved by council in 2005. That plan was the result of many long hours put in by members of the community to decide where the community wanted Middletown

to be in the future. According to Milton Herd of Herd Planning and Design, the consulting firm that was paid approximately $18,000 to help guide the community in developing its plan, the basis of the 2005 plan was solid. Mr. Herd said the public forums and discussions were well attended and well represented. Prior to resigning from his position as mayor, Mr. Brown, frustrated with the alleged slow progress of the comprehensive plan update committee, recruited Mr. Barrington, Mr. Blaisdell and town zoning administrator Fred Wharton, and drafted his own plan. According to Mr. Brown, he contacted the American Planning Association, found out who had won the highest award for a comprehensive plan, and contacted that locality to get permission to use their plan as the basis for the one for Middletown. Mr. Brown said the final result was vetted by the head of the Virginia Planning Association. The two documents are very different in scope and style. The plan being worked on by the update com-

mittee contains a vision statement and plans on how to reach that vision. The draft by Mr. Brown is more limited in scope. After a very nasty two meetings, the commission voted to use Mr. Brown’s plan as the basis for the new plan, while using limited sections from the updated committee version. As for the meetings, the raised voices, finger pointing and personal attacks were out of control. The smug smiles were worse. Councilors Tripp Chewning and Carole Snyder have repeatedly chastised the commission for their poor conduct. At the committee meeting last week, Councilor John Copeland, the council liaison to the planning commission apologized that he “got out of hand with Mark Davis, but Mark and I have done that over the years.” Apologies aside, the conduct at the next planning commission meeting was the same. Prior to the vote on the plan, interested citizens requesting copies of the plan were told by Mr. Wharton that they could get copies of the two

plans at $.20 per page. The documents were not put on the Middletown web site. (Both plans and audio of the meetings are posted on our new website FrederickCounty.com). At the last planning commission meeting, Mr. Wharton asked Mr. Brown and David Lellock of Lellock Consulting, PC and a Middletown resident, to act as citizen advisors to the commission. The two gentlemen will work with the commission and have input into its decisions. Councilor Snyder said that “every member of town can come to meetings,” to which Mr. Wharton responded that residents can come to the meetings, but they are “not part of the commission. We are inviting two people to join us.” Councilor Snyder, sounding incredulous, asked “the public can’t join in?” “No” Mr. Wharton responded. “That is what a public hearing is for.” Members of the town have questioned whether Mr. Wharton, as town zoning administrator, has a conflict serving on the planning commission. torney with the Virginia Municipal League said that not only is there is no conflict but it is a common practice in Virginia. According to “Qualifications, appointment, removal, terms and compensation of members of local planning commissions” section 15.2-2212 of the Virginia Code, “One member of the commission may be a member of the governing body of the locality, and one member may be a member of the administrative branch of the government of the locality.” The next big issue on the horizon is the boundary adjustment across I-81, along Reliance Road. Approximately 250 acres on the east side of I-81 are the subject of discussions between the property owners, Middletown and Frederick County. Approximately 11 acres beside the current Exxon on the south side of Reliance Road, and 29 acres on the north side are currently zoned B-2 commercial in Frederick County, which allows for the development of restaurants, gas stations and hotels. An additional approximate 210 acres are zoned RA, or rural agriculture, until rezoned. Frederick County hopes to see a technology park developed on the property. Robbie Molden, one of the property owners, considers the boundary adjustment “a great chance for Fred-

erick County and Middletown to do some future development of some sort – offices, a training facility, perhaps space for Lord Fairfax Community College. This development will be good for future local jobs and revenue for Frederick County and Middletown.” Mr. Wharton noted that a “letter of intent” has been circulated to the land owners included in the boundary adjustment. As of Monday’s council committee meeting, councilors were demanding to see the letter of intent. Included in the letter is an understanding that the properties will be brought into Middletown with the same zoning as currently designated by Frederick County. If brought into Middletown this way, the property owners will be able to do anything they want to do with the property, so long as it is allowed by the zoning designation. Another alternative is to bring the property into Middletown with “conditional” or “transitional” zoning. Under the latter designations, the properties will be brought into Middletown on a conditional basis, and the property owners will be able to apply for a zoning designation. During the application process, the property owners would be required to follow the zoning guidelines, which include making proffers

to the town, in public hearings. This is the only way that the residents of Middletown and the surrounding area will have any say regarding the development. Chair Blaisdell says he “knows what the citizens want, what the County wants and what the property owners want,” and appears determined to bring the land into Middletown with a simple zoning clause. The chair appears to be afraid that the property owners will walk away from the

boundary adjustment and Middletown will lose needed revenue. The countering view is addressed by Mr. Davis. “Virginia State Code provides a tool for localities to protect themselves during boundary adjustments; it’s called conditional zoning. The rezoning allows for public hearings so interested individuals can hear and respond to development plans. It also allows for proffers, which are usually financial or other offers of help to compensate

local entities like the fire or police departments to maintain their services with the added burden. Otherwise the properties will be brought in as “by right developments” where the developers can do anything.” Of course, the County has not weighed in on any of these issues in detail. Any future agreements will need to be decided by Frederick County, Middletown and the property owners.

Remembering School Board Member Melvin S. “Jim” Harmon Frederick County School Board member Melvin S. “Jim” Harmon passed away this morning at the Winchester Medical Center following a courageous battle with cancer. Harmon represented the Stonewall District on the School Board from January 1, 2007, until his passing. He was initially appointed to the Board on December 18, 2006, following the resignation of Patricia Stiles. In November 2007, Harmon was elected to fill the final two years of Stiles’ term. He was reelected to a four-year term on the Board in November 2009. His current term would have expired at the end of 2013. Frederick County Schools Superintendent David Sovine says, “Mr. Harmon was a valued member of the Frederick County School Board. During his tenure, students were always his top priority. He was an advocate for the arts and had a great appreciation for the many talented students who attend our schools. Having worked as both a teacher and school administrator, Mr. Harmon also possessed a good understanding of the challenges educators face and he worked tirelessly on their behalf. His many contributions and vision for the future of Frederick County Public Schools as a member of the School Board will be missed.”During Harmon’s tenure on the School Board, he served on a variety of the Board’s committees. He was a member of the Instruction Committee in 2007, 2008, 2009 and 2010. He served as the Chairman of the Instruction Committee from 2012 until his passing. Physicians to practice in communities that need them most The National Health Service Corps awarded more than $10 million in funding for loan repayment to 87 medical students in 29 states, the District of Columbia and Puerto Rico, who will serve as primary care doctors and help strengthen the health care workforce, Department of Health and Human Services Secretary Kathleen Sebelius announced today. Made possible by the Affordable Care Act, the National Health Service Corps’ Students to Service Loan Repayment Program provides financial support to fourth year primary care medical students in exchange for their service in the communities that need them most. “This new National Health Service Corps initiative is an innovative approach to encouraging more medical students to work in primary care, and to bring more primary care doctors to communities,” Secretary Sebelius said. “This is an important part of the administration’s commitment to building the future health care workforce.” The Health Resources and Services Administration’s (HRSA) Students to Service pilot program provides loan repayment assistance of up to $120,000 to medical students in MD and DO programs in their last year of education in return for their commitment to practice in the communities that need them most upon completion of their primary care residency. “The average medical school debt is often more than $200,000,” said HRSA Administrator Mary K. Wakefield, Ph.D., R.N. “The Students to Service program help relieve a tremendous debt burden, allowing them to follow their passion for primary care.” These newest NHSC providers must provide three years of full-time service or six years of half-time service in designated rural and urban areas. As a result of historic investments in the Affordable Care Act and the Recovery Act, the numbers of National Health Service Corps clinicians are at all-time highs. The number of providers serving in the Corps has nearly tripled since 2008. Today nearly 10,000 National Health Service Corps providers are providing primary care to approximately 10.4 million people at nearly 14,000 health care sites in urban, rural, and frontier areas. Lawmakers tout crackdown on texting while driving RICHMOND – The day after bills to crack down on texting while driving passed in both the House and Senate, a bipartisan coalition of legislators came together to urge their colleagues to complete the process of turning the measures into law. “I’d like to thank everyone who has been a part of this group. We’ve never made it this far with these bills before,” Delegate Ben Cline, RAmherst, said at a press conference Wednesday. Cline introduced one of 10 bills this legislative session to impose stiffer penalties for texting while driving. The bills were filed by both Republicans and Democrats. The House bills were combined into HB 1907, sponsored by Delegate Rich Anderson, R-Woodbridge. The House passed that bill, 94-4, on Tuesday. Sen. Tommy Norment, R-Williamsburg, filed an identical proposal in the upper chamber – Senate Bill 1222. It cleared the Senate on a 24-15 vote Tuesday. Bills involving texting while driving have been unsuccessful in recent years; four failed last year alone. Norment, the Senate majority leader, said his support may have helped with this year’s success. “When I heard what these senators were doing, I thought a bipartisan approach might help to move it along,” he said. Under existing law in Virginia, texting while driving is a secondary offense (meaning you can get cited only if you have been pulled over for some other violation). The current penalties are $20 for a first offense and $50 for a second or subsequent offense. SB 1222 and HB 1907 would make texting while driving a primary offense and raise the fine to $200 for a first violation and $500 for a second. Texting while driving also would be punishable as reckless driving. Some opponents have disparaged the legislation, claiming it would prevent drivers from making cellphone calls or using GPS systems. Such claims are untrue, Anderson said. “It prohibits anything text-related while driving,” he said. “You can still use your phone to make calls or use GPS.”

Kate Fristoe I am a twenty-one year old artist from Warren County, Virginia. I am happily married with a son and a step-daughter. I did not always make art, but I have always loved it and been surrounded by it. In college, I started drawing, and have since grown as an artist. I now primarily paint with acrylics on canvas, or pretty much whatever surface I can find and love to explore new techniques and skills.
