Following is a selection of legislation passed by the 2018 Session of the General Assembly that is likely to affect the daily lives of the citizens of Virginia. The following legislation has been signed by the Governor and for the most part went into effect on July 1, 2018.

The summaries were prepared by the staff of the Division of Legislative Services. Complete information on actions of the 2018 Session is available on the Legislative Information System (http://lis.virginia.gov).

Absentee Voting HB 397. Absentee voting; certain information not required when

completing application in person.

The law provides that a person completing an application for an absentee ballot in person is not required to provide the last four digits of his social security number on the application.

Alcoholic Beverage Control HB 422/SB 306. Alcoholic beverage control; sales by brewery on licensed premises. The law requires that, effective January 1, 2019, when a brewery licensee sells at retail the brands of beer that the brewery owns, at least 20 percent of the volume of beer sold for on-premises consumption in any calendar year must be manufactured

HB 852/SB 120. Alcoholic beverage control; substance abuse prevention; Virginia Institutions of Higher Education Substance Use Advisory Committee established.

The law directs the Board of Directors of the Virginia Alcoholic Beverage Control Authority (the Board) to establish and appoint members to the Virginia Institutions of Higher Education Substance Use Advisory Committee (Advisory Committee). The goal of the Advisory Committee is to develop and update a statewide strategic plan for substance use education, prevention, and intervention at Virginia’s public and private institutions of higher education. The Advisory Committee will consist of representatives from Virginia’s public and private institutions of higher education, including students and directors of student health, and other members as the Board may deem appropriate.

HB 1602/SB 61. Alcoholic beverage control; confectionery license.

The law creates a confectionery license, which authorizes the licensee to prepare and sell for off-premises consumption confectionery that contains five percent or less alcohol by volume.

Any alcohol contained in such confectionery shall not be in liquid form at the time such confectionery is sold.

HB 1087. Animal research; alternative test methods, civil penalty.

The law requires a manufacturer or contract testing facility to use an alternative to animal testing when available. The requirement does not apply to a facility using an animal test method for the purpose of medical research, drug research, or research involving certain other products. The law authorizes the Attorney General to bring a civil action for enforcement.

Any person who violates the law may be subject to a civil penalty of not more than $5,000 and any court costs and attorney fees.

HB 751/SB 984. Motorboats; means of propulsion, wakesurfing. The law allows a motorboat that is propelled by a means that is below the water line and forward of either the transom or an integrated swim platform to be accompanied by a person in the water. Current law allows a motorboat to be accompanied by such a wakesurfer only if the motorboat is propelled by an inboard motor.

HB 1205. Nonstock corporations; members’ meetings. The law authorizes the board of directors of a nonstock corporation to determine that any meeting of members not be held at any place and instead be held by means of remote communication, if the articles of incorporation or bylaws do not require the meeting to be held See LAWS, 4

SB 387. Annual reports of corporations. The law eliminates the requirement that a corporation authorized to issue one or more classes of shares list the number of shares of each class on its corporate annual report.

Civil Law HB 1361/SB 981. Calculation of child support obligation; multiple custody arrangements. The law establishes methods by which child support obligations can be calculated when multiple custody arrangements exist between parents of children subject to child support orders.

SB 540. Modification of spousal support; retirement age. The law provides that for the purposes of petitioning the court for a modification of spousal support, the payor spouse’s reaching full retirement age pursuant to the federal Social Security Act must be considered a material change in circumstances. The law provides a list of factors that must be considered by the court in considering modification based on the payor spouse’s reaching full retirement age. A request for modification based on the payor spouse’s retirement age is available to any per-

son subject to a spousal support order regardless of the date of the suit for initial setting of support or the date of entry of any such order or decree.

Constitutional Amendments on the November 2018 Ballot HJ 6/SJ 76. Constitutional amendment; real property tax; exemption for surviving spouse of a disabled veteran. The amendment, if approved by the voters, will provide that the real property tax exemption for the principal residence of the surviving spouse of a disabled military veteran applies without any restriction on the surviving spouse’s moving to a different principal place of residence.

SJ 21. Constitutional amendment; property tax; exemption for flooding remediation, abatement, and resiliency efforts. The amendment, if approved by the voters, will provide that the General Assembly may authorize a county, city, or town to partially exempt any real estate subject to recurring flooding upon which flooding abatement, mitigation, or resiliency efforts have been undertaken.

The law provides that any person who knowingly and intentionally causes an unmanned aircraft system to enter the property of another and come within 50 feet of a dwelling house (i) to coerce, intimidate, or harass another person or (ii) after having been given notice to desist, for any other reason, is guilty of a Class 1 misdemeanor. The law also provides that any person who is required to register with the Sex Offender and Crimes Against Minors Registry who uses or operates an unmanned aircraft system to knowingly and intentionally (a) follow or contact another person without such person’s permission or (b) capture images of another person without such person’s permission when such images render the person recognizable is guilty of a Class 1 misdemeanor.

Additionally, any respondent of a permanent protective order who uses or operates an unmanned aircraft system to knowingly and intentionally follow, contact, or capture images of any individual named in the protective order is guilty of a Class 1 misdemeanor.

The law also repeals the expiration of the prohibition on local regulation of privately owned, unmanned aircraft systems, clarifies the scope of such prohibition, and clarifies that such prohibition extends to all political subdivisions and not only to localities.

HB 1550/SB 105. Grand larceny; threshold. The law increases from $200 to $500 the threshold amount of money taken or value of goods or chattel taken at which the crime rises from petit larceny to grand larceny.

The law increases the threshold by the same amount for the classification of certain property crimes.

SB 47. Female genital mutilation; criminal penalty. The law increases from a Class 1 misdemeanor to a Class 2 felony the penalty for any person to knowingly circumcise, excise, or infibulate the labia majora, labia minora, or clitoris of a minor; for any parent or guardian charged with the care of a minor to consent to such circumcision, excision, or infibulation; or for any parent or guardian charged with the care of a minor to knowingly remove or cause or permit the removal of such minor from the Common-

Criminal Procedure HB 188/SB 35. Sentence reduction; substantial assistance to prosecution. The law allows a convicted person’s sentence to be reduced if such person provides substantial assistance, defined in the law, in the furtherance of the investigation or prosecution of another person engaged in an act of violence or for offenses involving the manufacture or distribution of controlled substances or marijuana. Sentence reduction can occur only upon motion of the attorney for the Commonwealth.

LAWS, from 4 dures to be used by courts to monitor the payment of restitution by defendants. The law requires that a probation agency ordered to monitor the restitution payments of a defendant placed on supervised probation notify the court and the attorney for the Commonwealth of the amount of unsatisfied restitution (i) 60 days prior to the defendant’s release from supervision or (ii) if the agency requests that the defendant be released from supervision, at the time the agency submits its request for the defendant’s release.

The law requires that the court conduct a hearing prior to the defendant’s release from supervision to review the defendant’s compliance with the restitution order. In addition to other hearing requirements, the law also sets forth the remedies available to the court, including contempt, in the case of a defendant who fails to comply with a restitution order.

HB 1249/SB 565. DNA analysis upon conviction of certain misdemeanors. The law adds misdemeanor violations of §§ 18.2-57 (assault and battery) and 18.2-119 (trespass) to the list of offenses for which an adult convicted of such offense must have a sample of his blood, saliva, or tissue taken for DNA analysis.

HB 1266/SB 566. Report of arrests; fingerprints; trespass; disorderly conduct. The law requires that a law-enforcement agency make a report of any arrest of a person for violations of §§ 18.2-119 (trespass) or 18.2-415 (disorderly conduct) to the Central Criminal Records Exchange and that such report be accompanied by the fingerprints and photograph of the person arrested. Under current law, such a report is required for all other misdemeanors punishable by confinement in jail under Title 18.2 (Crimes and Offenses Generally). This law is a recommendation of the Vir-

ginia State Crime Commission.

Domestic Animals HB 865. Pet shops; local ordinance requiring bond for out-ofstate breeder. The law authorizes any local governing body to adopt an ordinance that requires any pet shop selling dogs procured from outside the Commonwealth to furnish a bond of at least $5,000 if it maintains for sale an average of 50 or fewer dogs per year and not more than $30,000 if it maintains for sale an average of 51 or more dogs per year. The law authorizes such a locality to reduce or waive the bond requirement at its discretion and to terminate the bond requirement for a pet shop that has operated without interruption for 10 years without having its bond called by the locality. The law provides that if a pet shop ceases business operations, the locality has the right to call the bond and utilize the resulting funds as necessary to protect the welfare of the animals or fish from the shop.

HB 1537. Animal boarding establishments; clarifies definition of boarding establishment. The law excludes from the definition of “boarding establishment” any private resi-

dential dwelling that shelters, feeds, and waters fewer than five companion animals that are not owned by the proprietor.

SB 571. Animal bite history; disclosure of information; penalty. The law requires animal shelter officials and certain others to ask and document whether, if known, a dog or cat being taken in has bitten a person or animal and the circumstances and date of such bite. The law also requires that bites be disclosed upon release of a dog or cat for adoption and in other circumstances. Violation of such requirements is a Class 3 misdemeanor.

Education HB 1125/SB 349. Teacher licensure. The law makes several changes to the teacher licensure process, including (i) permitting teachers with a valid out-of-state license, with full credentials and without deficiencies, to receive licensure by reciprocity without passing additional licensing assessments and (ii) permitting a local school board or division superintendent to waive certain licensure requirements for any individual who holds a provisional license and is employed by the local school board.

The law prohibits, except for drug offenses, firearm offenses, and certain criminal acts, students in preschool through grade three from being suspended for more than three school days or expelled from attendance at school unless (i) the offense involves physical harm or credible threat of physical harm to others or (ii) the local school board or the division superintendent or his designee finds that aggravating circumstances exist, as defined by the Department of Education.

HB 1419/SB 273. Public elementary schools; unstructured recreational time. The law authorizes local school boards to provide, in elementary schools, a certain amount of unstructured recreational time that is intended to develop teamwork, social skills, and overall physical fitness for students.

HB 1600. Student discipline; long-term suspension. The law reduces the maximum length of a longterm suspension from 364 calendar days to 45 school days. The law permits a long-term suspension to extend beyond a 45-school-day period, not to exceed 364 calendar days, if (i) the offense involves weapons, drugs, or serious bodily injury or (ii) the school board or the division superintendent or his designee finds that aggravating circumstances exist, as defined by the Department of Education. The law requires the Department of Education’s definition of aggravating circumstances to include consideration of a student’s disciplinary history.

porting a firearm as an adult who was similarly ordered to involuntary treatment or was subject to a temporary detention order and agreed to voluntary admission and (ii) may utilize the same procedure as such adult for petitioning for the restoration of such person’s firearm rights. HB 883/SB 20. Department of Planning and Budget; regulatory reduction pilot program; report. The law directs the Department of Planning and Budget (the Department), under the supervision of the Secretary of Finance (the Secretary), to administer a three-year regulatory reduction pilot program aimed at reducing by 25 percent the regulations and regulatory requirements, as defined in the law, of the Department of Professional and Occupational Regulation and the Department of Criminal Justice Services by July 1, 2021. The law directs all executive branch agencies subject to the Administrative Process Act (§ 2.2-4000 et seq.) to develop a baseline regulatory catalog and report such catalog data to the Department, which shall then track and report on the extent to which agencies comply with existing requirements to periodically review all regulations every four years.

HB 286. Food and drink sanitary requirements; exception for dogs in wineries. The law provides that dogs may be allowed within a designated area inside or on the premises of a licensed winery or farm winery, distillery, or brewery or farm brewery, except in any area used for the manufacture of food products. Current law provides that no animal shall be permitted in any area used for the manufacture of food products, with certain exceptions for guard or guide animals.

tioners by eliminating the requirement for a practice agreement with a patient care team physician for a licensed nurse practitioner who has completed the equivalent of at least five years of full-time clinical experience and submitted an attestation from his patient care team physician. The law requires that a nurse practitioner authorized to practice without a practice agreement (i) only practice within the scope of his clinical and professional training and limits of his knowledge and experience and consistent with the applicable standards of care, (ii) consult and collaborate with other health care providers based on the clinical conditions of the patient to whom health care is provided, and (iii) establish a plan for referral of complex medical cases and emergencies to physicians or other appropriate health care providers.

HB 1054. Prescription requirements; treatment of sexually transmitted disease. The law, which expires on July 1, 2020, allows a practitioner employed by the Department of Health to prescribe antibiotic therapy to the sexual partner of a patient diagnosed with a sexually transmitted disease without the physical examination normally required.

HB 1251/SB 726. CBD oil and THC-A oil; certification for use; dispensing. The law, which became effective on March 9, 2018, provides that a practitioner may issue a written certification for the use of cannabidiol (CBD) oil or THC-A oil for the treatment or to alleviate the symptoms of any diagnosed condition or disease determined by the practitioner to benefit from such use. Under current law, a practitioner may only issue such certification for the treatment or to alleviate the symptoms of intractable epilepsy. The law increases the supply of CBD oil or THC-A oil a pharmaceutical processor may dispense from a 30day supply to a 90-day supply. The law

reduces the minimum amount of cannabidiol or tetrahydrocannabinol acid per milliliter for a dilution of the Cannabis plant to fall under the definition of CBD oil or THC-A oil, respectively.

As introduced, this law was a recommendation of the Joint Commission on Health Care.

SB 226. Prescription Monitoring Program; veterinarians. The law requires veterinarians who dispense controlled substances to report certain information about the animal and the owner of the animal to the Prescription Monitoring Program (PMP).

SB 511. Optometry; scope of practice. The law authorizes a TPAcertified optometrist to administer therapeutic pharmaceutical agents by injection for the treatment of chalazia by means of an injection of a steroid included in Schedule VI controlled substances, provided that the optometrist provides written evidence that he has completed certain training requirements to the Board of Optometry.

Horse Racing HB 1609. Horse racing and parimutuel wagering. The law establishes historical horse racing as a form of horse racing. The law defines historical horse racing as a form of racing that creates pari-mutuel pools from wagers placed on previously conducted horse races and is hosted at (i) a racetrack owned or operated by a significant infrastructure limited licensee or (ii) a satellite facility that is owned or operated by (a) a significant infrastructure limited licensee or (b) the nonprofit industry stakeholder organization recognized by the Virginia Racing Commission and licensed to own or operate such satellite facilities. The law establishes retainage fees similar to those already in existence for horse racing and provides for the Commission to promulgate emergency regula-

tions.

Housing HB 609/SB 391. Housing; installation and maintenance of smoke and carbon monoxide alarms. The law creates a statewide standard for the installation and maintenance of smoke and carbon monoxide alarms in rental property. The law requires a landlord (i) to install a smoke alarm but does not permit a locality to require new or additional wiring or the upgrading of smoke alarms under certain conditions and (ii) to certify annually that smoke alarms have been installed and maintained in good working order in a residential dwelling unit. The landlord is also required to install a carbon monoxide alarm upon request by a tenant. The law directs that a tenant of a rental dwelling unit with a smoke alarm or both smoke and carbon monoxide alarms must not tamper or remove such alarms. Under the law, a reasonable accommodation must be made for persons who are deaf or hearing impaired, upon request. Localities that have enacted a fire and carbon monoxide alarm ordinance must conform such ordinances with these state standards by July 1, 2019.

ment of Fire Programs, to develop a form for landlords for use in certifying inspections that summarizes smoke alarm maintenance requirements for landlords and tenants. The bill, as introduced, is a recommendation of the Virginia Housing Commission.

HB 855/SB 197. Landlord and tenant law; notice requirements; landlord’s acceptance of rent with reservation. The law changes the landlord and tenant law notice requirements for landlords to accept full or partial rent while continuing to proceed with a court action to obtain an order of possession and subsequent eviction by creating a single notice and removing the requirement for second notice for the time period between entry of an order of possession and prior to eviction. The law provides that the

landlord may accept full or partial payment of rent and still receive an order of possession and proceed with eviction if the landlord states in the written notice to the tenant that any payment of rent, damages, money judgment, award of attorney fees, and court costs would be accepted with reservation and not constitute a waiver of the landlord’s right to evict the tenant from the dwelling unit.

Hunting HB 239/SB 375. Hunting with the assistance of dogs; hunting or killing raccoons on Sunday. The law removes the prohibition on hunting or killing raccoons after 2:00 a.m. on Sunday.

HB 564. Hunting apparel; hunt-

ing from an enclosed blind, displaying solid blaze orange or solid blaze pink. The law allows a hunter hunting from an enclosed ground blind during any firearms deer season, except during the special season for hunting deer with a muzzle-loading rifle only, to display attached to or immediately above the blind at least 100 square inches of solid blaze orange or solid blaze pink material visible from 360 degrees in lieu of wearing specified hunting apparel. The law also requires that all specified blaze orange or blaze pink hunting apparel or material be solid in color and safety or fluorescent in hue.

HB 995. Dogs; licensed hunter may track a wounded bear, turkey, or deer with certain weapon. The law allows a licensed hunter to use

tracking dogs to find a wounded or dead bear, deer, or turkey. The law authorizes the hunter to have a weapon in his possession and to use it to humanely kill the tracked animal, including after legal shooting hours. Current law prohibits a hunter from having a weapon in his possession while tracking.

HB 1393/SB 859. Arrowgun hunting; authorized to hunt deer and small game when hunter is licensed to hunt with bow and arrow. The law authorizes the use of an arrowgun, a pneumaticpowered air gun that fires an arrow, for hunting and allows certain disabled hunters to obtain an archery license for hunting with an arrowgun.

The law prohibits health plans from using payment structures incorporating prorated dispensing fees and requires that dispensing fees for partially filled or refilled prescriptions be paid in full for each prescription dispensed regardless of any prorated copay or fee paid for synchronization services.

HB 1368. Group accident and sickness insurance; eligibility for continuation of coverage. The law disqualifies a discharged employee from continuation of health insurance coverage under his former employer’s group policy if the employee was discharged as a result of gross misconduct. The provision does not apply if the employer is required to provide for continuation of coverage under its group health plan pursuant to the federal Consolidated Omnibus Budget Reconciliation Act of 1985.

SB 672. Health insurance; small employers; self-employed persons.

The law revises the definition of “small employer” for purposes of health insurance to provide that it includes a self-employed person. The law also provides that an individual who is the sole shareholder of a corporation or sole member of a limited liability company, or an immediate family member of such sole shareholder or member, qualifies as an employee of the corporation or limited liability company if he performed any service for remuneration under a contract of hire for the corporation or limited liability company.

HB 709. Zoning violation penalties. The law increases the maximum fine for failure to remove or abate a zoning violation after conviction from $1,500 to $2,000 for succeeding 10-day periods after two previous failures to remove or abate the violation in accordance with court-imposed deadlines.

HB 1241. Car-washing fundraisers; use of biodegradable cleaners.

The law prohibits any locality from banning car-washing fundraisers that use biodegradable, phosphate-free, water-based cleaners and provides that no permit issued pursuant to the State Water Control Law shall prohibit the discharge of such noncommercial fundraising activity washwaters from a municipal separate storm sewer system.

The law expands the reasons that a physician may determine that it is impractical for a child to use a child restraint system to include the child’s height.

HB 737. Department of Motor Vehicles documents; veteran indicator.

The law requires the Department of Motor Vehicles to issue driver’s licenses, permits, and identification cards displaying an indicator signifying that the holder is a veteran, provided that the applicant requests such indicator and provides proof of veteran status.

The law repeals the authority of the Department to issue veterans identification cards.

SB 410. Steady-burning blue or red lights on law-enforcement vehicles. The law permits lawenforcement vehicles to be equipped with steadyburning blue or red lights in addition to being equipped with flashing, blinking, or alternating blue, blue and red, blue and white, or red, white, and blue combination warning lights of types approved by the Superintendent of State Police. Professional and occupational regulation; authority to suspend or revoke licenses, certificates, registrations, or permits; default or delinquency of education loan or scholarship. The law provides that the Department of Professional and Occupational Regulation, the Department of Health Professions, the Board of Accountancy, and the Board of Education are not authorized to suspend or revoke the license, certificate, registration, permit, or authority it has issued to any person who is in default or delinquent in the payment of a federal-guaranteed or state-guaranteed educational loan or work-conditional scholarship solely on the basis

Sexual Harassment Training HB 371/SB 796. Sexual harassment training; legislative branch.

Beginning January 1, 2019, the law requires General Assembly members and their full-time legislative staff and full-time employees of each legislative branch agency to complete sexual harassment training once every two calendar years.

Social Services HB 437/SB 920. Adoption and foster care; barrier crimes; exception. The law allows a child-placing agency to approve as an adoptive or foster parent a person convicted of possessing a controlled substance without a valid prescription, provided that eight years have elapsed following the conviction and the applicant has complied with all obligations imposed by the criminal court, completed a substance abuse treatment program, successfully passed a drug test within 90 days prior to being approved, and complies with any other obligations as determined by the Department of Social Services.

HB 873/SB 121. Child care providers; criminal history background check; sunset and contingency. The

law extends from July 1, 2018, to July 1, 2020, the expiration date and contingency on the requirement that the following individuals undergo fingerprint-based national criminal history background checks: (i) employees and volunteers of licensed family day systems, child day centers exempt from licensure pursuant to § 63.2-1716, registered family day homes, and family day homes approved by a family day system; (ii) applicants for licensure as a family day system, registration as a family day home, or approval as a family day home by a family day system, as well as agents of such applicants and any adult living in such family day home; and (iii) individuals who apply for or enter into a contract with the Department of Social Services under which a child day center, family day home, or child day program will provide child care services funded by the Child Care and Development Block Grant of 2014, as well as the applicant’s current or prospective employees and volunteers, agents, and any adult living in the child day center or family day home.

home are not appropriate permanency options. The law sets forth eligibility criteria for the program, payment allowances to kinship guardians, and requirements for kinship guardianship assistance agreements.

SB 539. Child day programs; exemptions from licensure. The law, which becomes effective July 1, 2019, splits the list of child day programs exempt from licensure into two categories. The first category sets forth programs that are not considered child day programs and therefore are not subject to licensure. The second category of programs sets forth programs that are considered child day programs that shall remain exempt from licensure; however, the law requires that such programs (i) file with the Commissioner of Social Services (the Commissioner), prior to beginning operation and annually thereafter, a statement indicating the intent to operate a child day program, identifying the Code provision relied upon for exemption from licensure, and certifying that the child day program has disclosed to the parents of children in the program the fact that it is exempt from licensure; (ii) report to the Commissioner all incidents involving serious physical injury or death to children attending the child day program; (iii) have a person trained and certified in first aid and CPR present at the

child day program; (iv) maintain daily attendance records; (v) have an emergency preparedness plan in place; (vi) comply with all applicable laws and regulations governing transportation of children; (vii) comply with certain safe sleep practices for infants; and (viii) post in a visible location notice that the program is not licensed by the Department of Social Services and only certifies basic health and safety requirements. The law also adds an exemption from licensure for any child day program offered by a local school division, operated for no more than four hours per day, staffed by local school division employees, and attended by school-age children who are enrolled in public school within such school division. The law also modifies staffing ratios for religious-exempt child day centers. Finally, the law directs the Commissioner to (a) inspect child day programs that are exempt from licensure to determine compliance with the provisions of the law only upon receipt of a complaint and (b) develop a process to gather and track aggregate data regarding child injuries and deaths that occur at such child day programs.

HB 287. Special license plates; STOP GUN VIOLENCE. The law authorizes the issuance of special license plates for supporters of stopping gun violence bearing the legend STOP GUN VIOLENCE with an expiration date of July 1, 2020. The law also authorizes the issuance of such plates as revenue-sharing special license plates as of July 1, 2020, with fees deposited in the Stop Gun Violence Fund to be used to enhance and ensure for the coming years the quality of care and treatment provided to individuals receiving public mental health, developmental, and substance abuse services in Virginia.

Taxation HB 1441/SB 249. Taxation of allterrain vehicles, mopeds, and offroad motorcycles. The law, which becomes effective October 1, 2018, makes all-terrain vehicles, mopeds, and off-road vehicles subject to the motor vehicle sales and use tax. Previously, these types of vehicles were taxed under the retail sales and use tax. Under the new law, they will be taxed at the same rate as before; however, the law changes the timing of the assessment of the tax (while the retail sales tax is due at the time of sale, the motor vehicle sales tax is due at the time of titling). If Virginia retail sales tax already has been paid on a vehicle, it is exempt from motor vehicle sales tax.

Trade and Commerce HB 304. Certain fraud crimes; Virginia Consumer Protection Act. The law adds the offenses of obtaining money by false pretense, financial exploitation of mentally incapacitated persons, and construction fraud to the prohibited practices under the Virginia Consumer Protection Act (§ 59.1196 et seq.).

HB 1027/SB 16. Security freezes; fees. The law reduces from $10 to $5 the maximum amount that a credit reporting agency may charge to place, remove, or lift a security freeze on a consumer’s credit report.

SB 418. Public safety answering points; deployment of text-to-9-1-1.

The law requires each public safety answering point (PSAP), by July 1, 2020, to be able to receive and process calls for emergency assistance sent via text message.

Transportation HB 505. Traffic signs; people with disabilities. The law allows any person who is deaf, blind, or deafblind, any person with autism or an intellectual or developmental disability, or the agent of any such person to request that the Department of Transportation post and maintain signs informing drivers that a person with a disability may be present in or around the roadway and directs the Department to post and maintain such signs in accordance with regulations developed by the Department.

HB 1539/SB 856. Mass transit in the Commonwealth. The law makes numerous changes to the administration of revenues for mass transit in the Commonwealth, specifically as it relates to funding of the Washington Metropolitan Area Transit Authority (WMATA) and the disbursement of funds in the Commonwealth Mass Transit Fund. The law sets a floor on the average price of fuel used to calculate the regional motor sales tax as the price of gas on February 20, 2013, the same floor that is used to calculate the state fuels tax. The law uses a variety of existing revenue sources to allocate revenues for mass transit and authorizes the issuance of $50 million in bonds only for a required federal match. The provisions of the law are contingent upon Maryland, the District of Columbia, and the federal government adopting similar actions to raise revenues for WMATA. Unemployment Compensation HB 1293. Unemployment compensation; penalty for failure to file reports. The law increases the penalty, from $75 to $100, that the Virginia Employment Commission is required to assess an employer who fails to file a report required under Title 60.2 (Unemployment Compensation) with respect to wages or taxes.

SB 51. Income withholding orders. The law repeals the requirement, enacted in 1993, that an employer request that each new employee disclose whether the employee has an income withholding order. This requirement has been superseded in practice by requirements that an employer submit information about new hires to the Virginia New Hire Reporting Center within 20 days of the employee’s hire date. Under the current system, relevant data in the State Directory of New Hires and the National Directory of New Hires is used by the Division of Child Support Enforcement to issue orders enforcing child support obligations. This law is a recommendation of the Virginia Code Commission.

Utilities SB 966. Electric utility regulation. The law provides that, in lieu of

the biennial review proceedings previously required, Dominion Energy Virginia (DEV) and Appalachian Power (APCo) will be subject to triennial reviews of their rates, terms, and conditions for generation, distribution, and transmission services. DEV’s first review after its Transitional Rate Period will be held in 2021, which is one year earlier than currently scheduled. APCo’s first review after its Transitional Rate Period will be held in 2020 and will utilize the three 12-month test periods beginning January 1, 2017, and ending December 31, 2019. The law also establishes a new rate adjustment clause category for expenses of electric distribution grid transformation projects and declares that electric distribution grid transformation projects are in the public interest. The costs of such projects may be recovered either through a rate adjustment clause or through a customer credit reinvestment offset. The law also directs the State Corporation Commission to approve the costs of certain conversions of an investor-owned electric utility’s existing overhead distribution tap lines with new underground facilities and provides that the portion of the costs associated with new utilityowned solar or wind generation facilities or with electric distribution grid transformation projects that are the subject of a customer credit reinvestment offset shall not be thereafter recoverable through the utility’s base rates or a rate adjustment clause. The law also includes enactment clauses that among other things (i) approve of the underground construction of two electrical transmission lines; (ii) bar APCo from recovering $10 million of incurred fuel costs; (iii) require DEV to provide current customers voluntary bill credits of $133 million in 2018 and $67 million in 2019; (iv) require reductions in the rates for incumbent electric utilities to reflect reductions in federal tax liability; (v) allow certain large nonresidential customers that enter into a three-year minimum exclusive supply agreement to receive a two percent reduction in their base generation charges; and (vi) require the utilities to develop energy conservation programs.

HB 1451. Net energy metering; schools. The law directs Dominion Energy Virginia to conduct a pilot program, not exceeding 10 megawatts in the aggregate, under which any public school in the Commonwealth that generates more electricity from a wind-powered or solar-powered generation facility than it consumes in a billing period may either credit the excess electricity to the metered accounts of one or more other schools in the school division or be paid for the excess electricity at the contractually negotiated rate.

Mark Egger locks horns with Supervisors’ Chairman Tony Carter at board meeting He expressed concerns about economic damage to community through actions of the ‘rogue EDA’

I’m here to further encourage you, the board of supervisors, to do something about the rogue EDA (Economic Development Authority) before they cause irrevocable damage to Warren County’s ability to promote industry and trade, which is the purpose of having a local EDA. Two months ago, I brought to your attention an advisory opinion of Virginia State FOIA (Freedom of Information Act) Council which included, ‘This topic, the investigation regarding the EDA Office Building does not appear to fall in any of the exemptions of the cited June 23, 2017 closed meeting.’

“More broadly, there does not appear to be any exemption within FOIA that would allow closed meetings to be held to discuss police investigations

“Given that the letter indicated that the investigation was discussed during a closed meeting, and that the topic of the investigation was not identified as a subject in the motion to convene a closed meeting, and that there is not a general exemption for the discussion of police investigations, it would appear that this discussion was not proper for a closed meeting,” he charged.

The letter to which Egger referred was one that the FOIA council received from the EDA Board, dated June 23, 2017, and signed by EDA Chairman Greg Drescher, which had been sent to the acting police chief of the Front Royal Police Department.

Egger read into record the full letter he was bringing to their attention.

“The board of directors of the Economic Development Authority discussed during closed session the investigation regarding the EDA office building (break in) that is currently being conducted by the Front Royal Police Department. The EDA hired a private investigator to assist in the investigation and we are now requesting that the Front Royal Police Department put the investigation on inactive status,” read the letter.

Egger also reported that he filed a FOIA request on January 30, 2018 to obtain records related to the private investigator the EDA hired. He said that he was told by EDA Executive Director Jennifer McDonald that the EDA never hired a private investigator.

Egger informed the board that he responded to the EDA. “You state that the EDA never hired a private investigator. The letter of July 17, 2017 signed by Greg Drescher states, ‘the EDA hired a private investigator.’”

Egger continued, noting that one of those statements was false and asking which one of the statements was false.

According to Egger, Jennifer McDonald responded that both were true.

“There is no way in the English language that both of those statements could be true,” he reportedly replied to McDonald, Egger then referred to a newspaper article he had read on the subject.

“In a February 23rd article by Josh Gully of the Northern Virginia Daily, we read this statement, he said, ‘McDonald said the Board did not discuss the police investigation itself. She noted that closed sessions are not recorded in minutes and guessed that Drescher potentially made a mistake regarding the letter’s wording,’” “So now we have the unbelievable post-talk explanation as to why the closed meeting was not in violation of FOIA,” Egger said.

“That the EDA did not discuss the police investigation and that it did not hire a private investigator is of course in direct contradiction of the letter of July 17, 2017 that states again that the board of directors of the Economic Development Authority discussed during closed session the investigation of the EDA office building currently being conducted by the Front Royal Police Department.

Back in the day, when hopes were high with the prospect of 600 highpaying jobs on the horizon, Councilwoman Bébhinn Egger was pictured with her fellow council members at the ground-breaking ceremony for the IT Federal site.

We have a letter that the EDA is now stating contains two lies that they deliberately sent to the Front Royal Police Department knowing that it

contained two lies and telling the police department to stop an investigation.”

Egger repeated the last few sentences for emphasis, and continued, “But more than three weeks after their illegal closed meeting they sent that letter to the Front Royal Police Department anyway. If that is not obstruction of justice I don’t know what is. I wonder what the EDA didn’t want the Front Royal Police Department to find out about the so-called break in.

“And still no one has been charged in this staged break in. In another two weeks the statute of limitations will come into play and no one will ever be able to be charged in the staging of the break in,” he added.

At that point, Egger moved onto a different topic.

“On a related note, we have another break in reported on June 15, 2017 at the residence of Executive Director Jennifer McDonald, which is still being investigated over 10 months later by the Warren County Sheriff ’s Office.

I guess they are still waiting for lab results, as they keep telling me every time I ask for my FOIA Request to be fulfilled. And what a strange coinci-

dence that the Warren County Sheriff is also the business partner of the EDA Executive Director,” he observed.

The time at the podium was now five minutes and 50 seconds, which is almost two minutes over the recommended limit, and Chairman Carter interjected, “Are you reaching a conclusion sir? It’s been almost six minutes.”

To which Egger replied, “Soon.”

Carter replied curtly, “I don’t want

soon, I want it quick.”

Egger’s reply was, “According to County Code, if one of the members of the Board wants to hear from me you are required to let me speak.”

After which the two argued over whether Egger had said town or county.

Egger won that argument and proceeded to plod on and addressed the remaining supervisors.

me? I wonder why he doesn’t want me to talk.”

“Because we have heard it all before,” Carter responded.

Ignoring the Chairman’s statement, Egger continued on by mentioning a business co-owned by Warren County Sheriff Daniel T. McEathron and Jennifer McDonald and questioning where money made by the business came from and then brought up an article he claimed was initiated by Jennifer McDonald.

In the article, he said, McDonald claims to have won, over a four-year period a total of $1,800,000 by playing the slots in Charlestown, West Virginia.

Egger scoffed at the statement.

“It is mathematically impossible to win at slots as a regular gambler like she has claimed she has done,” he charged.

“So the question is, why did she initiate contact with a news reporter with this bizarre story?” he asked.

Egger moved on to discuss the IT Federal project, which is an EB-5 Visa Program.

An EB-5 Visa is a United States visa created by the Immigration Act of 1990 for immigrant investors that provides a method of obtaining a green card for foreign nationals who invest money in the United States.

“The EDA gave away 30 acres of land with a big public announcement of a $40,000,000 investment and 600 well-paying IT (Information Technology) Jobs. In reality, the contract with IT Federal only calls for a $2,000,000 investment and a 10,000 square foot building and no mention of any jobs.

It is going to be pretty crowded in that building with 600 people. Each will have a space about the size of this podium. And IT federal has no contract – ,” he finished.

At this point Carter had had enough.

Banging his gavel, he announced, “Ok that’s it! Our policy says three minutes per speaker and no more than 15. That’s it.”

Mark Egger was hearing none of what Carter had to say.

“There’s a County Code that requires that if any of the members want to hear – ,” he interjected.

Carter interrupted Egger and asked if anyone on the board wanted to hear what Egger had to say.

Fork Supervisor Archie Fox indicated that he wanted to hear what Egger had to say, so the Chairman was forced to allow Egger to continue.

“IT Federal has no contracts to speak of as was claimed by the EDA. The EDA even took out a ten-milliondollar loan on behalf of IT Federal. A legitimate IT company with 600 employees would not need a local EDA to obtain any of their finances for them.

So 30 acres are given away to a shell company with no skin in the game.

The latest weird website of Truck Tran is Royal-Phoenix.com which is a website of another shell company named Royal Phoenix Trading LLC. “According to this website, if it can be believed, this is the real business that will occupy the little warehouse

that is being built at the site. What happened to IT Federal? What is this Royal Phoenix Trading Company?

Are the 600 high paying jobs really just a handful of warehouse jobs?” he asked.

Egger explained what an EB-5 project is.

“An EB-5 project is basically a citizenship sales scheme, according to Senator Diane Feinstein. Rich Chinese billionaires give $500,000 each and they receive, contrary to what Jennifer McDonald stated, not educational visas but permanent residency or green cards for themselves and their families and the project only has to create ten jobs, but they don’t even have to be direct jobs. Indirect jobs are acceptable. So let’s say, if McDonalds had to hire an extra cook, that counts. EB-5 projects are ripe for abuse as witnessed by former (Virginia) Governor and ‘Clinton Crime Family’ member Terry McAuliffe’s Greentech automotive scam. Terry McAuliffe is facing a multi-million-dollar lawsuit for his part in this scam perpetrated ‘by savvy and politically connected operators and business men.’

“Why don’t you ask Tunica County Mississippi how they feel about McAuliffe’s EB-5 program? Is this the type of economic development you want the EDA bringing to Warren County? When my daughter was on the Front Royal Town Council, (referring to Former Councilwoman Bébhinn Egger) and asked a few simple questions about the IT Federal Project, which should’ve been able to be answered very easily in about five minutes, she was subjected to a totally disproportionate verbal abuse by the political establishment of this community. It made me wonder why asking a few simple questions elicited that type of response. And she was given a load of nonsense for answers.

“Something did not add up and still does not add up. That is what prompted me to look into the activities of the EDA and I will continue to look into things that don’t add up. You all need to do the same. As I stated the last time I addressed you all, you need to remove the entire EDA board and begin anew with a new board that will put the interest of the community first,” concluded Eggers.

By the time he had finished, Eggers had taken up a total of over 10 minutes of the board’s time with his list of concerns and accusations.

Since that meeting, EDA Director Jennifer McDonald has been served with a warrant for making a false report to the police department which is a class one misdemeanor. If convicted, she could serve jail time and pay a fine.

That penalty could be confinement in jail for not more than 12 months and a fine of not more than $2,500, either or both. McDonald’s trial date has been set for October 31, 2018.

A list of the questions and concerns raised by Mark Egger has been sent to EDA Chairman Greg Drescher from this newspaper, and when there is a response to the questions, answers will be reported in an upcoming issue.

“Station 6 was trapped from both sides with the only way out being over Blue Mountain to Linden. (Front Royal/Warren County Fire and Rescue) Chief Mabie held a shift over so they could staff the engine and ambulance and provide a boat operator. He did the same thing with Station 1 with an off duty shift, mainly to keep boat operators available. All in all, I think everybody did their jobs correctly without too much serious incident,” Stanley said.

“As most of you are aware, the county experienced a sizable amount of rain over the weekend of June 1st through the 3rd. The county received 7-10 inches of rain from Friday June 1st, through the evening of Sunday June 3rd,” he reported at the June 11 meeting.

“With the ground already saturated, much of the heavy rain was run off into already full creeks, streams and low-lying areas. During this new rainstorm on Sunday morning, rapid flash flooding caused roadways to flood, cutting off traffic routes along Happy Creek Road, John Marshall Highway and Oregon Hollow Road in Linden and Howellsville Road,” he said.

“We experienced three vehicles in flood waters with rescues by passersby. Boats 6 and 3 rescued a citizen on Howellsville Road. Boat 6 also made a water rescue in Clarke County, off of Howellsville Road. Boats 14 and 3 rescued and removed 11 trailer occupants at North Fork Campground.

These people decided to stay and ride out the storm in their trailers until the river flooded, trapping them in their trailers, and then had to be rescued by Fire and Rescue boats. On June 4, Fire and Rescue sent a boat to search for and recover a dog that had drowned in the owner’s car. Overall, Fire and Rescue Departments recorded 12-14 boat rescues over the weekend. They

Next, Stanley reported on the county’s Reassessment project. He said that Wingate Appraisal has completed approximately 16,768 parcels, or 65 percent, leaving about 12,250 to complete this year. As of the week of this report, Wingate Appraisal has started field work inside the limits of the Town of Front Royal. The current

plan is to have the initial property visits completed by the end of September.

The next step is to visit, as necessary, all properties where building permits have occurred during the Reassessment in order to update those assessments. The amount of time necessary for this phase will depend on the volume of permits, but they expect this to occur during October.

Notices should be mailed around the end of October and will show the hearing location, dates and times of hearings, the proposed assessment, previous assessments, percentage of change, as well as the levy.

The administrative hearings, also known as the assessor’s hearings, should begin at or near the first of November.

Stanley also reported that the county had run the list of delinquent real estate taxpayers in the local newspapers. One of the county’s outside tax sale consultants will be holding a sale of delinquent tax properties sometime in late July. Once the county has all the information, it will be posted on the county’s website and Facebook page.

Stanley went on to report on the status of some of the county projects.

One of these was the Ressie Jefferies Elementary School roof/addition/ parking lot project which has been completed with Lance Construction, thus completing the county’s punch

list.

“The county hopes to be able to wrap up the project and pay all final invoices during the remainder of the month of June. Phase one (of the twophase) playground project has been substantially completed,” he said, and took this opportunity to compliment the Council on the extensive work that the town has done to Criser Road, saying that the work done to the area gave it a new and fresh look.

Other projects Stanley reported on were: • The Riverton Fire and Rescue Station. He said that the building committee had recommended that the county proceed with a one-story option.

• The Company #2 Station. Stanley said that county staff met with their leadership on March 27th to review preliminary plans for the replacement station at the Airport Road site. The county hopes to complete final design plans and put the project out to bid by late summer 2018.

• The Health and Human Services Complex. The Board of Supervisors’ April 3rd meeting awarded a contract to Juniper Construction for improvements to portions of the building to accommodate the Registrar’s Office and the Brighter Futures alternative school program. The contractor began work around June 1st. The county

hopes to have the school portion completed by September 1st and the Registrar’s Office by November 1st.

Stanley then gave a report on the VDOT (Virginia Department of Transportation), Marlow-Silek Revenue Sharing Project. The project will widen a portion of Route 340/522 South from the crossover in Front of Shenandoah Motors to the Crooked Run Boulevard entrance by adding a 3rd lane and a right hand turn lane.

The county administrator then gave a report on the new Morgan Ford Bridge, saying that it was underwater for three days during the recent flooding.

He made sure it was brought to the council’s attention that in the past the bridge would’ve been underwater for the past month, making note of the improvement over the previous bridge.

Stanley said that the bridge will still flood but not as badly as it has in the past.

The report concluded with a description of Phase Four of the Happy Creek Project. He told them that a public hearing was held on May 22 at 4:00 p.m. at Warren County Middle School. This is supposed to allow VDOT to move up the advertisement for the project to January 2021.

Art in the Valley Grand Opening brings more culture to downtown Gallery owners held “meet the artist” celebration with food and wine to welcome the public

“It was fantastic. We were excited by the turnout and the community support. We want to thank everyone who came out for the event.” said Tiffany.

“It was a longtime dream I’ve wanted since college,” Mike added.

Visitors participated in drawings and some lucky folks won a free portrait by Michael Budzisz, a photograph by local photographer Sarah Hart Morgan, an original paper sculpture

work by Tiffany Budzisz, a $50 credit toward art classes, and a sketching set.

The theme of the evening was “Meet the Artists,” and each of the twelve artists had their own section with their artist statement and biography, so that art lovers could learn more about them.

Tables were set up with fine wooden creations, pottery, and sculptures. The walls were hung with works by Mike, Tiffany, and many other local and non-local artists.

A variety of styles and subjects kept visitors absorbed and inviting more visits to look more closely.

They’re already looking forward to the next show which is set for August 3 from 5-9 p.m. There will be all new art work on the walls and the theme will be “Locally Inspired.”

The gallery has been open for business for a month and classes have already started. In spite of a fairly late start with advertising, Mike said, they’ve gotten a great response from people.

“We’re pleased by how much people like the classes,” he said.

The most popular class he teaches is figure drawing; some of the students have signed up for the next session already.

Tiffany also teaches classes in her intricate paper sculpture designs for children and adults.

She is from Front Royal and attended local public schools before attending Virginia Commonwealth University where she met Mike, who is from Fredericksburg. They both studied aspects of art. Tiffany focused on illustration and graphic design and Mike on painting and printmaking.

Mike taught private students and college classes as a student and Tiffany taught her paper sculpture art also.

They started seriously talking about the dream of owning their own gallery eight years ago, and then three years ago they made the actual decision to do it. Two years ago, they started look-

ing for a building, which took a year to find, but they worked on getting the business set up in the meantime.

The gallery itself has been renovated by the building’s owners and Mike and Tiffany thanked them for the excellent job they did in using historically accurate materials and responding to their requests.

“We gave them a list and picked the styles we liked, and they did it,” Mike said.

They both agreed that they feel great about being new gallery owners, but Mike said it feels like they’re just scratching the surface as far as where they want to be.

“There’s still a lot of work to be done,” he said, explaining that there was a lot to do before they even put artwork on display.

One of the things they’ve done is to put themselves on Virginia’s Artisan Trail Network, because they want to be a destination for art enthusiasts and visitors looking for interesting things to do.

Tiffany is approached every week by very talented artists to put their work in the gallery, but it requires a huge amount of paperwork and expense to keep so many artists in the inventory, so they want to put on local art shows, which will be juried, and invite artists to submit work, then they’ll advertise and host an opening, much like their

Mike and Tiffany are partners as retail design consultants in a threeyear-old second business, called MTB Creative Services. They recently teamed up with Front Royal Brewing Company to design their logo, labels for beer bottles and tasting cards, and Mike created some art prints with local themes.

“We worked with Tim, who is head brewer for ideas for each of the designs,” said Tiffany.

They’ve also done projects for national brands and a few other local businesses.

Two other people work with them at the gallery. Kelli Hart is part-time gallery associate and Laura Corebello teaches workshops especially for children.

Students learned basic coding by programming and designing computer games

By Carol Ballard Warren/Frederick County Report Five girls, ages 10-13, got a headstart toward future careers in information technology this summer at a summer camp through Lord Fairfax Community College in Middletown.

“Basically, we were getting requests for coding classes from school system people as a way to introduce girls to information technology, to get them more comfortable with being in that field,” said LFCC Program Manager Samantha Brill.

One area of Brill’s job as program manager deals with youth camps and the coding class idea originated with her as a way to open doors for girls and to get them actively involved.

“We will probably do this again next summer. It was a big success, basically, with how much fun they had,” she said.

Brill added that she visited the class multiple times during the week and saw how the girls were all engaged and having fun.

They learned on a free program called Scratch, which teaches programmers a code to create and animate a basic video game. The girls had a mouse run through a maze, heading toward a reward of cheese, and evade the villain chasing it at the same time.

Each girl participated in the group activity and then presented their individual projects at the end of camp.

“They learned a lot in one week,” said Brill.

This class was offered three hours a day for five days during the week of June 18-22.

“This was the first camp I did independently, and I’m thrilled because you don’t hear about girls in the coding world. It’s normally a man’s world,” said Gena Boice, who taught the class.

She went on to describe Scratch.

Designed for students from age 8 to 16, the game teaches basic coding in an introductory program, through which the creator programs a unique computer game. There are two ways to use Scratch. Students can go to the URL and sign in, or users can download it to a computer. For the summer camp, the girls used the URL and signin, so they could access their programs from home as well as in the class.

She said that some girls already had experience with Scratch before they started, and one of the girls was already learning script and lines of code.

Commas, colons and backslashes are all used to make code, but Scratch uses drag and drop, and little blocks that can be moved around that explain what the code is doing, so users are not required to make the code themselves.

“It’s a very good entry-level course, and I thought it would be so much fun to teach. Even though it was only a short time, it went really well,” said Boice.

She said that some of the students were so motivated that they worked on Scratch in their free time and were excited to go home and work on their creation independently.

While working on the group project, they learned how to cooperate and come up with creative ideas and solutions.

She described how during the creation of the video game where the mouse was racing through the maze, sometimes when the mouse was supposed to run into a wall, it went right through it instead.

Five girls had a chance to learn Information Technology coding in a summer class at Lord Fairfax Community College.

It had what she described as a bug glitch, and the book advised to solve the problem a certain way.

“But one of the girls said, ‘let’s do it this way,’ and she figured out a unique way to fix the glitch. They taught me as much as I taught them,” said Boice.

In addition to the group effort, each girl branched off, did troubleshooting and made up their own project to present.

“The girls were so willing to start with challenges and to stick with it – to create on their own or go from something already created,” she said.

Boice said she was proud to show the parents when they came to the last class for the girls’ presentation, to be able to say, “This is what your child has been doing.”

She said that parents told her they were impressed and how great it was to hear that.

Boice added that she’d like to teach more classes and said about the girls’ class that, “it’s really unique to have just a class for girls. It was a bonding experience. I look forward to more teaching in the future,” she said.

Boice has taught several kinds of computer classes along with fellow classmates and her high school IT teacher. She is about to enter the world of information technology, or IT, which has historically been something of a “boys’ club.”

In her last two years of high school, Boice was dual enrolled at LFCC which has given her a head start in her goal to get her Associates Degree from there and go into cyber security.

Samantha Brill said she advertised in the LFCC youth camp course catalogue and sent out email blasts to school systems in Frederick, Warren, Winchester City, Page and Shenandoah Counties to collaborate with school divisions.

She works with the STEAM (Sci-

ence, Technology, Engineering, the Arts and Mathematics) programs that are currently very widely used in many school systems. STEAM is an educational approach to learning, which uses these core subjects as access points for guiding student inquiry, dialogue, and critical thinking.

“The end results are students who take thoughtful risks, engage in experiential learning, persist in problemsolving, embrace collaboration, and work through the creative process.

These are the innovators, educators, leaders, and learners of the 21st century!” according to the description.

Winchester Police officer exchanges fire with armed suspect On July 2, 2018, Winchester Police (WPD) officers responded to a call in the 400 block of North Loudoun Street at approximately 4:48 a.m. for a report of a suicidal subject.

Officers attempted to make contact with the subject and asked him to come out of the residence. After refusing to come outside, the subject fired shots at the officers. One officer returned fire, striking the suspect. The suspect was transported to the Winchester Medical Center and is being treated for his injuries. No officers were injured during the exchange.

At the request of the City of Winchester Police Department, the incident is being investigated by the Virginia State Police (VSP) Bureau of Criminal Investigation, Culpeper Field Office. The investigation remains ongoing at this time.

Virginia State Police have identified the suspect as Scott Bradley Garthwaite, age 48, of Winchester.

Upon his release from the Winchester Medical Center, he was taken into custody and charged with two felonies - attempted capital murder of a law enforcement officer (18.2-31) and the use of a firearm in the commission of a felony (18.2-53.1). He was being held without bond.

The Fireman’s relish sold at their annual carnival is the stuff of legend 2018 Front Royal Fireman’s Carnival This year the Fireman’s Carnival will run from July 11th until July 21st (closed on Sunday) and is our 90th Fireman’s Carnival. It will be the 50th year that the carnival will be located on Crosby Rd next to Bing Crosby Stadium.

The Department [then called the Relief Fire Department] held fund raisers from the first year the Department was started in 1892 they were “lawn parties” or “horse shows”.

In 1929 the Department contracted with Hendrick’s Minstrel Show and “$10,000.00 Merry-go-Round” which was our first true carnival. That first carnival was held on the lawn of the court house on Main Street.

Inners Shows will provide the rides again this year. There will be 16 rides with an additional “mechanical bull”.

We also have bingo games every night of the carnival that are played for prizes. Mechille Smeltzer, chair of the bingo stand welcomes everyone to come and sit in the bingo pavilion

to enjoy a fun game of carnival bingo.

“It’s a great way to spend some quality time to sit under the fans and play a couple of bingo games, maybe finish off your supper (from the cook building), while socializing with family and friends.”

One of the major draws to the carnival is our famous fireman’s relish.

Be sure to come down early and get you pint of relish as we have run out towards the end of the carnival over the past few years. It might be best to get an extra pint so you can help out a friend that misses out! The mustard based relish we have is a recipe handed down over many years and has become very popular. Three members of our Department Hugh Williams, Skillet Henry, and Gary Keyser were the origin of this delicious condiment.

Why are the hot dogs so great? “We buy only quality dogs and burgers,” Eddie Henry says and he should know as he has been in charge of purchasing the carnival food for over 26 years.

“There is no chicken or turkey in our hot dogs; only 100% beef in the hamburgers with no fillers and we buy #1 grade potatoes for fries.”

Deputy Chief Derek Mabie, cook building co-chairman, has set the goal of opening up the cook building by 5pm every day. “We run a little late sometimes, but we work towards having the cook building open so you can stop by and pick up supper for the family.”

Mike Utley, who’s been cooking hamburgers at the carnival for over 30 years shares that he takes some of his vacation time every year to help in the cook building. “It’s a lot of fun……yes,

it’s a lot of hard work but no-the-less we have a great time working in the cook building. It used to be extremely hot behind the cook grills until David Santmyers of DDS installed air conditioners [at no charge], now it is not too bad with the heat.”

The fireworks display will be set off on Thursday night, July 19th, at about 10 pm. “We have to adjust the timing of the fireworks around other users of the stadium”, stated Joie Starcher carnival co-chair, “and we want to make sure it’s good and dark so the show is at its best display”.

On a side note, this is the 50th consecutive year that the author of this article [Hoss Feldhauser] has helped with the Front Royal Fireman’s Carnival!

Shenandoah County Fair releases full schedule. Adds a day back!

Don’t pet that fox!

Within the past three weeks, two foxes captured within Winchester City limits have tested positive for rabies, according to the Lord Fairfax Health Department. “While the captured foxes pose no further threat, they may have infected animals in and around the city,” says Lord Fairfax Health District Director Dr. Colin Greene. “To prevent rabies, avoid interactions with wild animals, and keep your animals vaccinated.”

The Health Department strongly advises that people take the following steps to prevent families and pets from being exposed to rabies: • Never approach or touch wild animals, especially any raccoon, fox, skunk, or bat, especially if it is behaving oddly or if it is seen in the daylight.

These animals are the main carriers of rabies in the eastern United States.

• Avoid stray cats and dogs. Feral or unknown cats and dogs may also carry rabies. Report bites or scratches from these animals to your physician or the Health Department.

• Vaccinate all cats, dogs and ferrets against rabies (even if they don’t go outdoors) and keep their shots up to date.

• Do not feed wild animals or stray cats and dogs. Eliminate outdoor food sources around the home.

• Keep pets confined to your property or walk them on a leash.

• If one of your domestic animals is bitten or otherwise interacts with a wild animal, notify the local Health Department and animal control officer at once.

If you are bitten, scratched, or licked by any of these animals, seek medical attention immediately. Rabies is fatal to both animals and humans once contracted. Rabies can be prevented in humans if they receive vaccine and medication soon after exposure.

Valley Health Receives Go-Ahead From State For New Warren Memorial Hospital Campus The Virginia Department of Health has approved Valley Health System’s Certificate of Public Need (COPN) application to build a new Warren Memorial Hospital (WMH) on Leach Run Parkway in Warren County. We sure did get a lot of rain Len, and that is a timely question. Tree watering is a key part of tree care and it is difficult to recommend an exact amount due to the varieties of climates. But a few guidelines will help you to water your trees properly.

For new trees, water immediately after you plant a tree. Then during the first couple growing seasons, your newly planted tree is expending a lot of energy trying to get its roots established in the

soil. Especially during the first few summers of your new trees life, it will have a difficult time dealing with heat and drought. You can make this easier by providing water and covering the soil with wood-chip mulch. Deep watering can help speed the root establishment.

Deep water consists of keeping the soil moist to a depth that includes all the roots. Also, to reach the maximum number of roots you should be watering away from the base and out around the drip line.

Not enough water is harmful for the tree but too much water is bad as well.

Over-watering is a common tree care mistake. Please note that moist is different than soggy, and you can judge this by feel. A damp soil that dries for a short period will allow adequate oxygen to

permeate the soil. As general rule, your soil should be moist. Usually 30 seconds with a steady stream of water from a garden hose with a diffuser nozzle per tree seedling is sufficient. Mulching is also key in retaining moisture in the soil.

You can check soil moisture by using a garden trowel and inserting it into the ground to a depth of 2”, and then move the blade of the trowel back and forth to create a small narrow trench. Then use your finger to touch the soil. If it is moist to the touch, then they do not need water. After your tree has been established in your yard for two years the roots will be established. This will allow your tree to withstand a wider range of water conditions.

The new three-story hospital with adjoining medical building will occupy part of a 28-acre campus and provide a modern, efficient and healing care environment with flexibility to meet patient, provider, and community needs now and into the future. The hospital will have 36 private inpatient rooms, including a 12-bed Critical Care Stepdown Unit, 18 Emergency Department rooms (plus shell space for four additional), six Observation rooms (for stays of less than 24 hours), three Operating Rooms, two endoscopy/procedure rooms, and a cardiac catheterization lab.

The current Warren Memorial Hospital on North Shenandoah Avenue dates to 1951, with regular improvements made in the decades since. There was a clear need for a new contemporary facility designed for the efficient, outpatient-centered, and technology-driven health care of the future. Valley Health purchased property on Leach Run Parkway in 2008, and by 2014 began to move forward with planning, design and site improvements. A Letter of Intent submitted to the Virginia Department of Health in November 2017 stated Valley Health’s intent to pursue approval from the Commonwealth of Virginia to build a replacement facility. The required application for the Certificate of Public Need followed in January 2018, and the approval letter arrived this month.

Front Royal Fire Travel Softball Tryouts

Sandra Lavern Carter (2011) Hit & Run - 300 Block of W. 14th Street On June 15, 2018, at 11:32 pm, the Front Royal Police Department responded to a report of a hit and run accident involving a pedestrian in the 300 block of W. 14th Street. When officers arrived, they observed a 41-yearold male who was lying in the roadway with injuries sustained after being struck by a vehicle. Witnesses advised the suspect vehicle had fled the scene before officers arrived. The victim, James Vincent Vansise, was transported by helicopter to INOVA Hospital with serious but non-life-threatening injuries. At this time, Vansise has been released from the hospital and is in a rehabilitation facility for his injuries.

During the subsequent investigation, the suspected vehicle was located, parked and unoccupied, on a nearby street. The vehicle had damage consistent with the crash. Further investigation revealed the vehicle was being operated by Sandra Lavern Carter.

Traffic Enforcement Officer Joshua Noland has obtained a felony arrest warrant for Sandra Lavern Carter, 45 of Front Royal. The warrant is for leaving the scene of an accident. At this time, Carter has not been located or arrested. Anyone with further information on Carter’s whereabouts or this incident is asked to contact Officer J. Access to businesses on Featherbed will be maintained during the repairs.

This is not a City of Winchester local government project, however, City staff will be hand-delivering information to the businesses located on Featherbed to make sure they are aware of the upcoming work and road closure.

“We are very grateful to CSX for making these much-needed repairs to the Featherbed crossing,” stated City of Winchester Public Services Director Perry Eisenach. “These repairs have been needed for quite some time and once completed, traffic will be able to move more smoothly in that area.”

Upon the arrival of the speciality hazardous materials response resources, a unified command system was implemented and entry into the hazardous environment was made.

The Haz-mat team was able to isolate the incident to a single vessel and eliminated any life safety hazards to the area. A hazardous materials mitigation plan was developed and implemented and the facility was turned over to Toray representatives.

Units cleared the scene at 6:50pm.

There were no reported injuries.

HSWC Yard Sale The Humane Society of Warren County will host a yard sale on Friday and Saturday, July 13th and 14th 8am2pm at the animal shelter located at 1245 Progress Drive Front Royal, VA 22630. All proceeds will benefit the homeless animals of Warren County, VA. Donations for the yard sale are appreciated and may be dropped off at the animal shelter prior to the event.

Hazardous Materials Incident Controlled Without Injury Warren County Fire and Rescue Units were dispatched to Toray Plastics (America) Inc. June 20 at 1:07pm for a possible hazardous materials incident with unknown fire conditions.

Units quickly arrived on the scene and were met by Toray Safety personnel and the Management Team. Units assessed the situation and determined that a chemical exothermic reaction occurred within a 55 gallon drum located in the remote chemical storage building. This process caused a failure of the drum and a active spill/leak of a hazardous chemical. This event caused an activation of the fire alarm system and crews determined no fire conditions were present within the building.

Based on the findings, units isolated the area of the chemical storage building and requested the response of the Virginia Department of Emergency Management Regional Hazardous

New Commuter Bus Service Begins: Front Royal to D.C. The Northern Shenandoah Valley Regional Commission’s RideSmart program began a new commuter bus service from Front Royal to D.C. June 28. The service supports the Transform I-66 Outside the Beltway project with funding from the Department of Rail and Public Transportation and the Virginia Department of Transportation.

RideSmart’s Program Director, Karen Taylor, rode the bus today to welcome new passengers. Commuters were provided with a light “to-go” breakfast to celebrate the first day of service, and Ms. Taylor spoke with each rider to better understand their commuting needs.

The motorcoach for this service is designed for commuter comfort; it boasts free WiFi, charging stations, water, personal climate control, reclining seats, and restrooms to meet the needs of passengers. Tickets are $25 per day or $440 per month and commuter transit subsidies are accepted.

This service adds another viable transportation option for residents of the region. RideSmart is a free ridematching service that helps users connect with commuters who share similar schedules or travel patterns. In addition to ride-matching, RideSmart also helps participants identify a full array of commuting alternatives, such as Telework Virginia, Metro and MARC Train.

Engle’s Angle: “I Don’t Understand”

By Kevin S. Engle I don’t understand why they’re called hamburgers. Shouldn’t they be cowburgers?

I don’t understand how anyone can like mayonnaise. Yuck.

I don’t understand why my grocery store carries 25 different flavors of vanilla ice cream. I like vanilla ice cream. But is there really a difference between Original, Old Fashioned, Homemade, Vanilla Bean and French?

I don’t understand why it’s going to take the phone company 19 days to come to my house and get rid of the loud buzzing sound on our line.

Nineteen days! Our house isn’t that hard to find. I’ll bet they’ll understand why we’re not going to be their customers for another 19 days.

I don’t understand why the Post Office is having such a hard time holding our mail. The first time I asked them to, they delivered it every day.

The next time, they held it but then wouldn’t deliver it when they were supposed to.

I don’t understand why I have to answer my bank account security questions EVERY TIME I log on to our account. Their website says it doesn’t recognize my computer, even though it’s the same one I use EVERY TIME. And I even check the box that says “remember this computer next time”. EVERY TIME. I’m glad they want to protect my account, but geez, come on.

I don’t understand why the phone company and the electric company and our internet provider are always redesigning my monthly bill to make it simpler and easier to read. Is it that difficult to do? Here’s a suggestion for the next time. Where it says ‘detach here’ near the bottom, make sure that lines up with the fold on the page.

I don’t understand why my printer works one time and then not the next.

I don’t understand why the Sunday Washington Post is put together the way it is. There’s Section A, then B and C. But then it jumps to E, F, G, J and back to D. What happened to H and I? And why is D at the end?

Am I missing something?

I don’t understand why the clerk at the library can’t hand me my card after she scans the barcode. Why does she have to slap it on the counter?

I’m standing right here.

I don’t understand why major league baseball players repeat their little rituals before every pitch. Last night I saw the strangest windup and delivery I’ve ever seen from a pitcher. How do they come up with this stuff? Pitchers, just throw the ball. And batters, stand there and swing at it.

I don’t understand why the robins keep building nests on the corners of my house. Even after I keep taking them down. You’d think they’d get the hint after a few times.

I don’t understand the printed instructions that come with almost any product that has printed instructions. I do like the sections in other languages because I know I’m not supposed to understand those.

I don’t understand how my car’s stereo works. I keep pressing the Mode and Menu buttons until I eventually find what I’m looking for.

And I don’t understand the intermittent wipers and the cruise control either. Maybe I should take another look at the owner’s manual. I’ll read the German version this time.

Snakes for pets? The author doesn’t understand that either.

Route 11 Bridge At ShenandoahWarren County Line Fully Opens To Traffic July 9 Replacement of the Route 11 bridge over Cedar Creek at the ShenandoahWarren County line is expected to open to two-way traffic on Monday, July 9. Motorists should be alert for a final traffic-pattern change as they approach the new bridge between Strasburg and Middletown.

Northbound and southbound drivers are tentatively scheduled to begin sharing the new bridge over Cedar Creek on the morning of July 9. Contractors will then start work to remove the old southbound bridge and its approaches. All work is weather permitting.

On January 18, 2017, the Commonwealth Transportation Board awarded

a $6.9 million contract to Perry Engineering Co. Inc. of Winchester, Virginia. The contract completion date is November 2, 2018.

Cedar Creek and Belle Grove National Park Announces Special “History at Sunset” Programs The following events are scheduled for the summer and fall: • July 13, 7:00 p.m. - Remnants of the Stonewall Brigade at Cedar Creek.

By the fall of 1864, the famous Stonewall Brigade was a shell of its former self. The Overland Campaign had taken a massive toll on the brigade, but nevertheless the men fought on. Find out how this famous unit performed at the Battle of Cedar Creek. Meet Park Ranger James Horn at the National Park Service Visitor Contact Station (7712 Main Street, Middletown, Virginia).

• July 27, 7:00 p.m. - A Diamond in the Rough: The Forgotten Story of the Bowman-Hite Farmstead. Join Ranger Kyle Rothemich as he explores the history of the Bowman-Hite Farmstead.

This farmstead stands as a unique example of a 19th century Shenandoah Valley agricultural landscape. Learn about the families who called this place home, structures that shaped their experiences and soldiers who marched by during the Battle of Cedar Creek. Meet at Belle Grove (336 Belle Grove Road, Middletown, Virginia) for an introduction. Visitors will then car caravan over to the Bowman-Hite farm.

• August 17, 7:00 p.m.- When the conflict is ended mercy again asserts itself - Treating the wounded at Cedar Creek. The Battle of Cedar Creek left in its wake over 8,600 Americans killed, wounded and captured; the second bloodiest engagement fought in the Shenandoah Valley. Join Ranger James Horn as he examines the treatment of wounded and the general practice of medicine during the Civil War. This special program includes living history demonstrations presented by staff of the National Museum of Civil War Medicine, and will be held at St. Thomas Chapel, which was used as a hospital by the Union army following the battle. Meet at St. Thomas Chapel (7854 Church Street, Middletown, Virginia).

• August 31, 7:00 p.m. - Not Just Black and White: Discovering the

Complexities of Enslavement in the Shenandoah Valley. This program explores the use of slave labor in the Shenandoah Valley. Learn how the settlement history, agriculture and iron industries shaped the use of slavery in this region. This program will take place at Belle Grove Plantation where a total of 276 enslaved people worked and lived over a 68-year period. Join Ranger Shannon Moeck for this stationary program at Belle Grove (336 Belle Grove Road, Middletown, Virginia). Visitors are encouraged to bring a lawn chair.

• September 14, 5:00 p.m. - Retreat and Redemption: The Union 19th Corps at Cedar Creek. After spending most of the Civil War fighting in Louisiana, the Union 19th Corps was sent east in 1864, eventually becoming a critical force in Philip Sheridan’s Army of the Shenandoah. Attacked from two directions at the battle of Cedar Creek, the corps initially retreated from its trenches, but later found redemption during Sheridan’s late afternoon counterattack. Join Ranger Rick Ashbacker to explore the key actions and locations of the 19th Corps at Cedar Creek. Meet at the National Park Service Visitor Contact Station (7712 Main Street, Middletown, Virginia).

• September 28, 5:00 p.m. - Medal of Honor Recipients at Cedar Creek. The Medal of Honor is the most prestigious award a member of the military can earn. At the Battle of Cedar Creek, 21 soldiers were awarded this medal.

Join Park Ranger James Horn to find out where these men earned their Medals of Honor and hear their stories of bravery. Meet at the National Park Service. Visitor Contact Station (7712 Main Street, Middletown, Virginia).

• October 19, 4:00 p.m. - Sabers and Spencers: Custer and the Cavalry at Cedar Creek. By late 1864, the Union cavalry had evolved into a ferocious offensive strike force under aggressive leaders like Brig. Gen. George A. Custer. At the battle of Cedar Creek, Custer used not only his own leadership skills, but also superior weapons, horses, and tactics to outflank the Confederate army. Join Ranger Rick Ashbacker to follow the actions of Custer’s division as it fought and chased the Confederates from early morning until late evening on October 19, 1864. Meet at the National Park Service Visitor Contact Station (7712 Main Street, Middletown, Virginia).

• November 10, 5:00 p.m. - Free at Last: The Complicated Road to Freedom for Emmanuel Jackson This program will explore how one enslaved man, Emmanuel Jackson, Jr., from Belle Grove Plantation was purchased by his free black father, Emmanuel Jackson, Sr. from Pittsburgh, Pennsylvania and ultimately freed four years later. Join Ranger Shannon Moeck for this stationary program at Belle Grove (336 Belle Grove Road, Middletown, Virginia).

Next Winchester Police Teen Citizen Academy scheduled for August 2 The Winchester Police Department’s (WPD) third installment of the Teen Citizen Police Academy is scheduled for Thursday, August 2, 2018 from 8:00 a.m. to 5:15 p.m. The Academy will be held at the Timbrook Public Safety Center, located at 231 E. Piccadilly Street in Winchester.

The Teen Citizen Police Academy aims to educate the area’s youth (ages 14-17) about the operations and challenges of local law enforcement. Participants will learn about the WPD’s criminal investigations process, E-911 communications, police training, narcotics and drugs, and K-9 handling, among other topics.

A goal of the Teen Citizen Academy is to foster well-informed teens who will use their influence on public opinion to dispel untruths about police practices and services. The Academy also provides a great opportunity for those interested in pursuing a career in law enforcement to learn about various aspects of the field and the Winchester Police Department.
