Supervisor candidate withdraws after Hatch Act finding Federal employees barred from participation in partisan elections since 1939

By Thomas Sayre Warren/Frederick County Report Bruce Townshend has ended his short-lived Independent campaign for the Happy Creek District seat on the Warren County Board of Supervisors after Warren County Republican Committee Chairman John Smith directed that a complaint be filed saying that Townshend’s candidacy was a violation of the Hatch Act which bars some federal employees from certain partisan political activities. The complaint and Townshend’s LinkedIn profile states that

Federal employees are not supposed to be running in a partisan race,” Smith said. Townshend had appeared and spoke at a Young Republicans event Saturday, May 1. “I did not invite him there but from what I know somebody did invite him. He is not supposed to come to a Republican event. They did have him come up there and speak, but I was not there,” Smith said. Smith indicated it was his understanding that Wendy Kurtz introduced Townshend as an independent candidate and invited him up to speak. Smith said he spoke with Kurtz about it and she said she didn’t know who Townshend was. After the Young Republicans event, Townshend posted in part on his candidate Facebook page that, “I’m not a Republican, but I appreciate the invitation to attend and unexpected opportunity to speak at the Warren County Young Republicans event yesterday, hosted by Mike and Melanie Salins.” He concluded, “Thanks Mike and Melanie.” As to inviting someone who was violating federal law as a candidate and then allowing him to speak at the event, Smith said, “They should have known better.” Michael Salins did not respond to our requests for comment but Melanie Salins did via text message. “It was a beautiful event! You should have come!!! I won’t participate in making a non-issue into an issue.” Chairman Smith reacted by stating, “This is a big issue because it undermines everything

we do. It does not look good on us at all. Also violating the Hatch Act is just as bad and if [Townshend] does not know that, that is not good on his part. That is not good at all. “People should know better, and for her (Salins) to keep justifying it, she either does not understand or I do not know what. She just does not get it. The Warren County Republicans and the WCRC will not think it is a non-issue,” Smith said. Hatch Act complaint The Hatch Act of 1939, An Act to Prevent Pernicious Political Activities, is a United States federal law. Its main provision prohibits certain civil service employees in the federal government, except the president and vice president, from engaging in some forms of political activity. The Hatch Act has been amended over the years, most recently by The Hatch Act Modernization Act of 2012 signed by President Barack Obama. In a complaint filed with the U.S. Office of Special Counsel (OSC), a question is asked, “Does the Subject have knowledge of the Hatch Act?” Answer: “Yes. Mr. Townshend publicly announced he is running for Warren County, Va. Board of Supervisors Happy Creek District position at the Warren County Young Republicans meeting, and stated he is a Federal Civilian Employee, but is not subject to the Hatch Act since he is running under the banner as an Independent Candidate.” Also, on Townshend’s campaign Facebook page Townshend opines that, “As an employee of the federal government he is prohibited from running under any party

The BOS is a partisan election. “In attendance at the Young Republicans meeting was Stephen Kurtz, on the Virginia GOP State Central Committee, and his wife Wendy Kurtz, currently a member of the WCRC. She introduced Mr. Townshend to speak publicly. (People) were dumbfounded that Mr. Townshend was allowed to speak at this event since it is a Republican partisan event. “Mr. Townshend then publicly shared with the group of about 50 people that he is a Federal employee but is not subject to the Hatch Act since he is running as an Independent Candidate.” “Mr. Townshend distributed flyers promoting his candidacy. He also has a Facebook page soliciting campaign donations. On his Facebook page Mr. Townshend emphasizes that he was invited to attend the event that was hosted by ‘Mike and Melanie Salins,’ current members on the WCRC. Mr. Townshend says on his Facebook page that ‘partisan politics should have very little place in local elec-

tions,’ yet emphasizes that the event is ‘truly the way to be,’” the complaint continued. Stephen Kurtz said the impromptu speech “was an accident and it shouldn’t have happened. “Wendy didn’t know who he was and had a bunch of people speaking. It is not to say that people there didn’t know, but somebody invited him, of course. They didn’t understand the rules. I talked to Jay Butler and Jay Butler talked with a few people who were involved, and I think it is all taken care of as far as I know. “Wendy didn’t know who the guy was and that is how the guy ended up speaking. I didn’t see it, I would have gotten him off there immediately. Warren County is not a designated locality, and the Office of Personnel Management is the only agency vested with the authority to specify which jurisdictions are designated as such. Even though I was running as a non-partisan candidate for a non-partisan position on the BOS, the way the Hatch Act is being applied is that even though the race is considered non-partisan by the Commonwealth of Virginia the presence of a candidate running under a party banner makes it one. It goes to show that those folks did not do their homework well. It took me all of 15 minutes on the internet and a phone call to determine that yes, it is a violation of the Hatch Act. It just says whether it is a partisan

race. And Ms. Carol Tobin (Warren County Voters’ Registrar) said, ‘yes this is a partisan race.’” Butler said Tobin told him that if either the Republican or Democratic Party, or both provide the names of their nominees to run in a partisan race such as the BOS, it is a partisan election. In the case of non-partisan elections, such as Town Council or School Board, a Party may endorse a candidate, but will not provide their names as a party nominee. “So it is a moot point. In early March the WCRC issued their official call and they announced that I was the Republican nominee by acclamation on March 25. I have

been the nominee since March 25 and if they had done their homework correctly, they would have known that,” Butler said. Butler’s check for $500 was dated March 12 to the WCRC to file as the Republican nominee and he was officially publicly nominated by acclamation on March 25. Chairman Smith filed for “Jerome Butler as a Republican candidate in the November 2 general election, a Party Certification of NonPrimary Candidate under Va. Code § 24.2-511 with the Virginia Department of Elections on April 23.”

On Wednesday, May 12, Valley Health opened a COVID-19 vaccination site for first and second doses at Apple Blossom Mall in Winchester. The site will be open three days a week during mall business hours: Mondays and Wednesdays from 11am – 8pm, and Saturdays from 10am – 9pm. By Carol Ballard Warren/Frederick County Report A Purple Cow would stand out in a field among a herd of ordinary cattle, and the Purple Cow Appleland and Raceway Park in Stephens City does just that in the field of amusement and family fun sites. The place has a 20-year history and has been a favorite of local people over the years. “But in 2019 it closed because the previous owners were deal-

ing with health issues,” said Carl Story, who also co-owns the Purple Cow Soft Serve Adventure Center in Paw Paw, West Virginia with his business partner Christopher Breeden. And he had an interesting story to tell about how it came about. “One day in March or April of 2020, I woke up to multiple emails from people telling me I should get into this,” Story said. “We talked about it and decided we couldn’t let this go.

GellyBall was a later addition. “And this year we added indoor axe-throwing and put in pool tables and an arcade,” he said. Their other business, the Purple Cow Adventure Center at the County Line store in Paw Paw is about 45 minutes away from Stephens City, and since they took over the new place in Stephens City, they’ve slowly started adding more attractions there too like axethrowing and GellyBall. The distinctive purple cow mascot makes it even more fun for the children who come with their parents to participate in activities like batting cages and go-carts. He was quick to mention that they are following all the latest CDC guidelines, like the 6 feet apart rule and said the usual indoor capacity is 24 people, but now is 18. The outside activities are easier to control with the COVID restrictions, he said, and added that, “The go carts are sanitized with bleach, also. People are happy to get back outside even before COVID, and the batting cages are super easy to control with only one person in them.” He described how there are nine different speeds in the cages, so it’s enjoyable for kids and adults. For the younger kids, there is the underhanded slow throw. T-ball is also available for the very small kids, but for adults, the speeds are 80 mph and under. “Very few can do that, (the 80mph) but a lot try,” he noted. Story said they employ 20 people altogether and is glad that they could keep all of their staff working through the COVID-19 pandemic. The same menu is offered at both places, with tasty items like cheeseburgers, cheese steaks, pizza, ice cream and specialty sundaes. They serve Hershey’s ice cream, and the soft serve ice cream comes from a Pennsylvania dairy-delivered fresh every week. The Purple Cow Paw Paw website proclaims their motto, “Where friends are only one bite away from becoming family.” And as far what people can expect when going there for fun, Story said, “There are a bunch of new activities. Some, like the GellyBall and batting cages are for younger kids five years old and up and gocarts are for 10 and up. Right now, we have one on the 23rd of May and are expecting 200 cars from Backwoods Kustoms.” “We are trying to make it familiar, to make memories. So, two weeks into October of 2020, they began the search for another place. “We looked into a lot of places and talked to people –the consensus was that there are a lot of tourists who come to Main Street, so we opened here on January 1. “Since a year ago today, it has grown 500 percent. “We were hoping for a 20 percent growth and were surprised. “Hopefully we’ll stay on track for that,” said Pam, who was holding their grandchild, Ryatt. “And since then, we’ve seen a change in the demographics, with 30 percent tourists,” Scott observed, and added, “We’ve had a lot of locals tell us they are glad we moved. There’s better parking, for one thing.” When asked how sales are affected by downtown events, he said, “Family fun Day on May 11 was pretty much how we thought it would be, not more or less people than usual, and the Saturday before Mother’s Day was busy as always, but we did see more people coming by and checking us out.” At the former place, Scott held workshops and classes so those are continuing here as well, with double the space. So now, one positive outcome of that is they are doing a good amount of business online, including shipping internationally. “We just sent our first shipment to Australia,” said Scott, with a grin.

By Carol Ballard Warren/Frederick County Report Two local groups have created gardens to produce fresh vegetables which is then donated to the community. This will be the second year for Citizens Helping Each Other (CHEO), and the third year for the United Methodist Church group called Cre-

ation Care Community. “We are anticipating the possible aftermath created by the current pandemic of large-scaled food shortages resulting in greatly increased food cost and lack of availability,” said Fern Vasquez, who coordinates the garden project for CHEO with Betty Showers of Fussell Florists and Michael Graham being very involved and instru-

The first garden, located at the junction of Criser Rd. and Luray Ave., is still there. “We were kind of operating by the seat of our pants last year but had a good crop. This year we had a soil test and discovered the soil was very fertile, which we already knew, but this made it official. The second plot is in Rockland. “We have lots of acreage with both gardens,” she reported. “They’ve been staged for planting with rows and pathways set out and covered with landscaping materials and straw to keep the weeds down. After all that, a major planting on May 15 was planned for both sites to get things going for this year’s crop. The newest Front Royal CHEO garden is located at the Virginia Hills Church at 737 Rockland Rd., They invited everyone to participate in the planting and are still eagerly welcoming volunteers. There is an idea in place to extend the harvest by canning some of the produce, but they need to find a health department certified person and place to do it. “But first things first,” she continued. “We are getting everything ready now.” The gardeners decided not to plant until May 15 because of the possibility of frost. But she said that they already had started some cold-hardy vegetables like potatoes and spinach and were working on planting sweet potatoes. Vasquez said they’re very happy to be cooperating with others in the community. The Blue Ridge Nursery across from Southern States in Front Royal volunteered to set seedlings up for them, but before the big planting, she projected that they would probably buy tomato and pepper starts. When asked if they will allow others to garden their individual plots, she said there’s not enough room right now, but the addition of fresh produce to the three organizations that receive it, will be a boost to people who depend on them for their food supply. She also mentioned that many folks may not know there are people in this community who are totally dependent on these places for food. Vasquez said that CHEO grew out of efforts and informally structured meetings among folks who call themselves the “Wednesday Group.” This is composed of concerned citizens, several of whom are members of the Warren County Board of Supervisors and the Economic Development Authority. Motivated by the desire to help the community, they pooled their resources and talents. These include using their contacts to get help with the project and grant writing. “I love the idea of the community coming together to help each other. People may be working with someone who might have different political views, etc., but all are working together. “It’s hard work, but gives you a good feeling,” Vazquez concluded. They say folks can help in this community project by volunteering to help plant, harvest, distribute the crop or just pull weeds. They will be seeking volunteer canners later in the season and volunteers are required to sign waivers,

Creation Care Community Another local group dedicated to growing food for folks in need is the Front Royal United Methodist’s Creation Care Community. Emma Resnick, who is an organizer of the group, volunteered to speak about their efforts. “We’re focusing on environmental education and we wanted to expand into the community,” she said. “We started in the summer of 2018, and although last year in 2020 was difficult, we were given the plot next to the

United Methodist Church and planted four large beds and made some smaller ones from pallets.” They were so successful that the garden produced a variety of vegetables that were donated to the Lutheran Church’s Community Table soup kitchen, the House of Hope and CCap. Every other week they took boxes to distribution points, and spread the deliveries out as needed. “We’re just getting started for this season. We’ll have tomatoes, lettuce, greens, beets and will be able to supply for the whole summer,” she explained.

Some people even choose foods in the hopes that they can help to reduce symptoms of allergies and inflammation. As concerns about cognitive decline and diseases that attack the brain and memory grow, some people are seeking critical nutrients that can reduce their risk for Alzheimer’s disease and other dementias. While there’s no quick fix, consuming a wide variety of fresh, nutritiously diverse and not overly processed ingredients, like those found in this recipe for “Garden Vegetable Hummus” from “The Brain Boosting Diet” (Whitecap) by Norene Gilletz and Edward Wein, Ph.D. Garden Vegetable Hummus Makes 21⁄2 cups 1 19-ounce can chickpeas, drained and rinsed (preferably no-salt added) 3 to 4 cloves garlic 1⁄2 green bell pepper, cut into chunks 1⁄2 red bell pepper, cut into chunks 4 green onions (or 1 medium onion, cut into chunks) 1⁄4 cup chopped fresh basil or Italian parsley 2 tablespoons extra virgin olive oil 2 tablespoons lemon juice (preferably fresh) 2 to 3 tablespoons tahini Salt and freshly ground black pepper Chopped fresh parsley for garnish 1. Combine all ingredients except parsley in a food processor fitted with the steel blade.

Process with quick on/offs to start, then let the motor run until the mixture is very smooth, about 2 minutes, scraping down the sides of the bowl as needed. 2. Transfer the hummus to a serving bowl and sprinkle with parsley. Cover and chill for 1 to 2 hours before serving. (Hummus will thicken when refrigerated.) Note: The tahini in the hummus is a very nutrient-dense ingredient because it has a very low moisture content. It is an excellent source of mono- and polyunsaturated fats, which are good fats, as well as an excellent source of protein, magnesium, zinc, manganese fiber, and potassium. Chickpeas are legumes that are also high in protein and fiber.

There’s Thelma and Louise on one side of us and Luke and Leia on the other. You may remember Thelma and Louise from the early 90s? And Luke and Leia, they played fairly significant roles in a bunch of films you might have seen. Star Wars. Rambo lives across the street. That’s what I call her anyway. We also have the cast from Dumb and Dumber nearby. These geniuses pull into the oncoming lane of traffic so they can stop in front of their mailbox and check for mail without having to get out of the car. Hmm. My wife didn’t want me to say that, so I crossed it out. Ever see Three Men and a Baby? We have Two Ladies and a Dog. Or we did until the other day when they moved. We’ll miss them. Even the dog who always barked at us. The set for the 1970s show Eight is Enough is across the road. The TV family had eight kids. I’m not sure exactly how many our neighbors have, but it’s a lot. And what celebrity lives in our house? My wife calls me Gladys, as in Gladys Kravitz, the nosy neighbor on Bewitched, a comedy series that was popular in the 1960s and 70s. Gladys liked to look out her window to keep tabs on everyone. I think of myself more as part of the Neighborhood Watch, you know, to make sure everything’s ok. Spring and summer aren’t my favorite times of the year. With all the tree leaves, my views are obstructed. I may have to cut some down. When I was a kid, there was a poor family on my street, although they spelled their name differently (Porr). Next to them were people who liked to make food, the Cooks, but I don’t recall them ever sharing any with us. And we had Mr. Watson, half of the Sherlock Holmes-Mr. Watson duo. There was even an outlaw, Mr. James, but was he Jesse? And we also had the Ludwigs, but I don’t think they were related to the Beethoven guy. My mother always used to say you

The Northern Virginia printmaker-painter’s ‘Trees/ Humans: Life in the Balance’ carries an earnest message, as its title implies. But Underwood’s artworks also are beautiful, exuberant and monumental. The two tallest are 15 foot ceilingscrapers.” The selection includes some drawings, but most are mixed-media pictures that began as photographs of what Underwood’s statement calls ‘ancient trees.’ The photos are the basis for silkscreen and linocut prints to which that artist adds tints and painted designs. The finished pieces range in viewpoint from close up to wide angle, and in style from realistic to very nearly psychedelic. They’re mounted on wood panels, some rectangular and others cut to the shape of the trunks and branches they represent. Among the subjects are such arboreal details as ‘Birch Bark’ and ‘Gi-

ant Sequoia Needles,’ rendered at enlarged sizes, as well as tree stumps and downed trunks. REMINDER: IF YOU FIND A FAWN, LEAVE IT ALONE The Department of Wildlife Resources (DWR) wants to remind you that it’s that time of year again when white-tailed deer fawns are showing up in yards and hayfields, and concerned citizens want to know how to help. In almost all cases, the best way to help is to simply give the fawn space and leave it alone. Concerned people sometimes pick up animals that they think are orphaned. Most such “orphans” that good-intentioned citizens “rescue” every spring should have been left alone. Most wild animals will not abandon their young, but they do leave them alone for long periods of time. Fawns, born from May through July, are purposely left alone by their mothers. Female deer, called does, stay away from the fawns to avoid leading predators to their location. The white-spotted coat camouflages a fawn as it lies motionless in vegetation. Young fawns generally will not try to run away when

they are approached. Does will return several times each day to move and/or feed their young. You probably will not see the doe at all since she only stays to feed the fawn for just a few minutes before leaving it alone again. If less than 24 hours have passed since a fawn has been “rescued,” the fawn should be taken back and released at the exact same location where it was found. After returning the fawn, immediately leave the area and do not wait for the doe to return. The doe will not come back for the fawn if a human is nearby. If a wild animal has been injured or truly orphaned, do not take matters into your own hands. You may locate a licensed wildlife rehabilitator by calling the Virginia Department of Wildlife Resources (DWR) toll-free wildlife conflict helpline at 1-855-571-9003, 8:00AM-4:30PM, Monday through Friday or visit the DWR website at: dwr.virginia.gov/wildlife/injured/rehabilitators/ Raising a wild animal in captivity is illegal unless you have a DWR wildlife rehabilitation permit. Each animal’s nutritional, housing, and handling requirements are very specific and must be met if they have any chance of survival. With even the best professional care possible, the survival rate of rehabilitated fawns and many other animals is very low. The best advice for someone who wants to help wildlife is to keep it wild.
