Derechos de los Pacientes Patient Rights
Todo paciente debe ejercer sin restricciones por motivos de raza, sexo, edad, idioma, religión, opiniones políticas o de cualquier índole, origen social, posición económica o condición social:

Su derecho a elegir libremente al médico y, en general a los profesionales como también a las instituciones de salud que le presten la atención requerida, dentro de los recursos disponibles del país.

Su derecho a disfrutar de una comunicación plena y clara con el médico, apropiadas a sus condiciones sicológicas y culturales, que le permita obtener toda la información necesaria respecto a la enfermedad que padece, así como a los procedimientos y tratamientos que se le vayan a practicar, y al pronóstico y riesgos que conlleve, también su derecho a que el, sus familiares o representantes, en caso de inconsciencia o minoría de edad consientan o rechacen estos procedimientos, dejando constancia escrita de su decisión.

Su derecho a recibir un trato digno respetando sus creencias y costumbres, así como las opiniones personales que tengan sobre la enfermedad que sufre. Su derecho a que todos los informes de la Historia Clínica sean tratados de manera confidencial y secreta y que, solo con su autorización, puedan ser conocidos. Su derecho a que se le preste durante todo el proceso de la enfermedad, la mejor asistencia médica disponible, pero respetando sus deseos en el caso de enfermedad irreversible. Su derecho a revisar y recibir explicaciones a cerca de los costos de los servicios obtenidos, tanto por parte de los profesionales de la salud como por las instituciones sanitarias. Al igual que el derecho a que en casos de emergencia, los servicios que reciba no estén condicionados al pago anticipado de honorarios. Su derecho a recibir o rechazar apoyo espiritual o moral, cualquiera que sea el culto religioso que profese. Su derecho a que se le respete la voluntad de participar o no en investigaciones realizadas por personal científicamente calificado, siempre y cuando se haya enterado acerca de los objetivos, métodos, posibles beneficios, riesgos previsibles e incomodidades que el proceso pueda implicar. Su derecho a que se le respete la voluntad de aceptar o rehusar la donación de sus órganos para que estos sean trasplantados a otros enfermos.

Su derecho a morir con dignidad y a que se le respete su voluntad de permitir que el proceso de la muerte siga su curso natural en la fase terminal de su enfermedad. Resolución 13437 de 1991
The right to choose their own physician and, in general, their own healthcare professionals and institutions, within the limits of the resources available in the country.
The right to clear and open communication with their physician, in accordance with their psychological and cultural conditions, so as to receive all the necessary information regarding their disease, the treatments and procedures to be performed and the risks and prognosis of such treatments. Patients also have the right to accept or reject the procedures, or to have their relatives or representatives do so in the event they are unconscious, or in the case of children, and to communicate their decision in writing whenever possible. The right to be treated with dignity and respect for their beliefs and customs, as well as for their personal opinions regarding their disease. The right to confidentiality of their medical information and to ensure that such information is disclosed only with their authorization. The right to receive the best medical care possible, but with all due respect for their wishes in the event of an irreversible disease. The right to review and receive explanations from the healthcare professionals as well as from the health institutions about the costs of their care. Additionally, patients have the right to not have to pay in advance for emergency care. The right to receive or refuse spiritual or moral support, regardless of their religious beliefs. The right to agree or refuse to participate in research work undertaken by qualified scientific personnel, as long as complete information has been given regarding the objectives, methods, potential benefits, foreseeable risks and discomfort that the research process might entail. The right to accept or reject organ donation for transplantation to other patients.

Deberes y Obligaciones de los Pacientes Patient Responsabilities Los usuarios del Sistema de Seguridad Social en Salud deberán cumplir los siguientes deberes y obligaciones:

Actuar frente al sistema y sus actores de buena fe.
Suministrar oportuna y cabalmente la información que se requiera para efectos del servicio. Informar a los responsables y autoridades de todo acto o hecho que afecte el sistema. Procurar en forma permanente por el cuidado de la salud personal y de la familia y promover las gestiones del caso para el mantenimiento de las adecuadas condiciones de la salud pública.
Users of the Social Security System in Health must fulfill the following duties and obligations:

Act in good faith in their relationship with the system and its stakeholders. Provide timely and complete information as required for the purpose of receiving healthcare. Inform the authorities or the relevant individuals of any action or fact affecting the system. Strive to further their own health and that of their family, and do what is necessary to maintain adequate public health conditions.

Pagar oportunamente las cotizaciones e impuestos y, en general, concurrir a la financiación del sistema. Realizar oportuna y cabalmente los pagos moderadores, compartidos y de recuperación que se definan dentro del sistema. Contribuir según su capacidad económica al cubrimiento de las prestaciones y servicios adicionales a favor de los miembros de su familia y de las personas bajo su cuidado. Cumplir las citas y atender los requerimientos del personal administrativo y asistencial de salud, así como brindar las explicaciones que ellos les demanden razonablemente en ejecución del servicio. Suministrar la información veraz que se le demande y mantener actualizada la información que se requiera dentro del sistema en asuntos administrativos y de salud.

Participar en las instancias de deliberación, veeduría y seguimiento del sistema.

Participar en los procesos de diseño y evaluación de las políticas y programas de salud; así como en los ejercicios de presupuestación participativa en salud.
Hacer un uso racional de los recursos del sistema.
Respetar a las personas que ejecutan los servicios y a los usuarios. Hacer uso, bajo criterios de razonabilidad y pertinencia, de los mecanismos de defensa y de las acciones judiciales para el reconocimiento de derechos dentro del sistema.

Make timely payment of the fees and taxes and, in general, contribute to the financing of the system. Make timely payment of all moderating, shared or recovery payments defined in the system. Contribute, in accordance with their financial capability, to the coverage of additional benefits and services for the members of their family and other people under their care. Honor their appointments and answer the requests of the administrative and healthcare staff, as well as provide the explanations reasonably required of them as part of the provision of the healthcare service. Provide accurate information and maintain updated information on administrative and health issues, as required by the system.

Participate in the different instances of discussion, oversight and follow-up of the system.

Participate in the process of design and appraisal of healthcare policies and programs, as well as in participative health budgeting exercises.
Make a rational use of the system’s resources.
Respect service providers and users. Use the mechanisms of protection and legal action, within reasonable and relevant limits, to ensure that their rights under the system are respected.
