Photographer Jim Dohms recently discovered a motorcycle parts dealer using one of his images they had found online to promote a holiday sale on their Facebook page. They hadn’t asked Jim for permission to use the image and, adding insult to injury, they had removed Jim’s signature from the image and altered it to include their company info. Jim wasted no time in telling them to take the image down anad it was removed after a few days. I was following the incident on Facebook and, after it was resolved, Jim told me, “It’s interesting that the mindset is if it is on the web you can use it”. And if you take a look around the web, especially on the social networking sites, you’ll see how accurate Jim’s words are. There seems to be a general feeling that anything posted online is fair game for anyone to download or copy and use as they wish. Well if you take the time to actually read the Terms of Service for the main social networking sites you’ll see it includes a rule against posting images that you don’t own the rights to. If you do, you could be violating the U.S. Copyright law.
pages. After all, sharing is what this online socializing is all about. The real issues arise when commercial entities, such as a motorcycle parts company, are using images that they don’t own to promote their business. This is especially prevalent on the social networking sites like Facebook. It’s so easy to download just about any image, song, or video clip and then post it on your page hoping to build your viewership. There’s a lot of pressure these days to have a dynamic website or a Facebook page with a large following and everyone is trying to be the one to post the next “It’s Gone Viral” online sensation. And, as long as you’re using your own creations, that’s a good thing. But thievery should not be rewarded. Unfortunately, policing the entire Internet is an impossible task, and it’s very likely you won’t get caught. And hey, everybody else is doing it! Why should you be left behind? Uh, perhaps because you’re an honest person with some integrity?
Biker With A Badge Takes a Holiday
I’ll save a lot of you the time and trouble of calling or sending me emails asking why there’s no column this month. Mike had a busy schedule this month but plans to be back on schedule for the February issue.
Copyright law gives protection to the creators of certain works, such as books, magazines, newspapers, photos, recordings, songs, and so forth. Collectively these items are known as Intellectual Property and the creator of a particular piece has the right to determine when, where, and how the work is used. You’ll find copyright notices on all kinds of products but the lack of that notice doesn’t mean it’s not protected. Copyright protection is pretty much automatic. You take a picture of something and you own the copyright to that image. Even if you post it on your Facebook page, you still own the rights to that image and someone else can’t legally use it unless you give them permission. So, unless you have the original creator’s permission, you can’t use that photo. Right? Not quite. You see, we’ve also got this very grey area called Fair Use. Section 107 of the Copyright Law addresses Fair Use and lists some of the factors which might allow a copyrighted piece to be used without the need to get permission. Those include when the work is used in news reporting, teaching, parody, comment, criticism, scholarship, and research. Yep, it’s a grey area and the fog gets thicker as new ways to share data evolve. It’s unlikely that any individual person is going to hear from the Copyright Cops for posting and sharing on their personal social network 4

Harley-Davidson Project Livewire Test Ride

When Harley-Davidson announced their first electric motorcycle it certainly took the viability factor for a battery powered bike to a new level. There are several companies already producing electric motorcycles, but none have the name recognition, and thus instant publicity, that Harley can generate by introducing a new product like this. The Project Livewire motorcycle is definitely a new direction for Harley. After all, everyone recognizes that very distinctive sound of a Harley-Davidson, it’s so entrenched in the Motor Company culture that efforts have been made to have it trademarked. Along with the sound, there’s also the feeling a rider gets sitting astride a two-wheeled machine powered by a rumbling internal combustion engine. Rolling the throttle, making the pipes bark, that’s one of the joys of riding. Well, roll back the throttle on a Project Livewire bike when it’s powered up and you’re off to the races. Quickly. That was one of the safety warnings the instructors kept repeating as small group of riders and myself prepared to discover what riding an electric Harley-Davidson is all about. The Project Livewire bikes have been touring the country giving demo rides 8
at select dealerships. In early December, they made a 3-day stop at Brandon Harley-Davidson. Riders could register online and schedule a ride, which I did. The demo trailer was set up in the parking lot and had a covered area for the bikes along with flat screens showing Project Livewire videos. There was also a bike on display and also one set up on a device Harley calls the “Jumpstart Demo”. It’s a stationary support stand for a motorcycle which lets a rider start up the machine and get the rear wheel rolling in place. No fear of dropping an expensive prototype bike, or worse, crashing. Before the test ride I watched an instructional video about the new bike and then it was off to the pit area for a pre-ride briefing. A couple of important points were emphasized such as when you roll on the throttle, the bike goes into motion and when you roll off the throttle something know as regenerative braking takes place and the bike immediately begins to slow even if you don’t touch the brakes. For that reason, we were cautioned to remember to tap the brake lights to alert those behind us. We then chose our bikes and got ready to ride. Put the kickstand up, move the switch to the Run position and watch the touch screen light up. Choose Power or Range mode (which wasn’t going to w w w.gofarmag.com
make a big difference for our test ride) and then wait for the screen to show “111”. Then, without rolling the throttle, press the Start button. The screen shows a Zero and the bike is ready. The group slowly, and almost silently, rides out to hit the streets. The acceleration is quick, very quick, so I made sure to leave some distance from the rider in front of me so I can enjoy a few of those momentary bursts. I then got it up to speed and when I rolled off the power, I could feel the bike braking. Smoothest downshifting I’ve ever done. The sport bike profile with red trim on a black paint job gives it an aggressive look and the low handlebars bring you forward with the foot pegs a bit to the rear. Seat height is comfortable, for me, at 31” but if you’re a tall and big person, you’ll likely find the riding position cramped. I’m hoping there’s a cruiser model once they work out the battery range issue. The ride is very smooth and fairly quiet. The power comes from a three-phase AC induction electric motor which is said to produce 55 kW of power or about 74hp. The sound has been described as a fighter jet, a vacuum cleaner, and unfortunately to me at times, like a drill, as in dentist. That was probably the only unpleasant thought I had during the test ride. Wait, I did have one other issue. Who decided to mount the mirrors below the handlebars? But I really enjoyed pulling up next to a vehicle at a stop light and seeing the looks the bike got. Continued On Page 35

The vendors were in a festive mode as were the bikers, the bands were great and there were plenty of food vendors. If you were looking for bling for you or your bike, there were a lot of choices. The slow ride event was a huge success with one rider carrying his dog along and everyone cheering for the dog!

It all started as just talk. “Let’s do a week long motorcycle trip in Pennsylvania” said Gordon, Wisconsin native and Cape Coral seasonal resident, and a good customer and great friend of The Shop (Pirate Coast Cycles). “Sure, why not?” Turns out he wasn’t kidding, because he had a condo timeshare all set aside for what was originally going to be a week long trip with his beautiful wife Rita. Rita’s back condition wasn’t getting better and she would not enjoy a long car ride. So what to do with the condo that’s already paid for? There it is, the makings of a motorcycle adventure. So the initial planning starts.

On day three the Wisconsin boys (Gordon and Lewis) get to the designated meeting place 15 minutes early, and I get there right on time (12 noon), which is not bad timing after 2-1/2 days of riding from different directions. Ok we’re here... Now what? We can’t check in at the condo until 5PM.... “Let’s go see Phil...Phil who? You know... Ground Hog Day Punxsutawney Phil.î Turns out this little town is just a short 80 miles away... so we go....Got lost of course...ended up on a gravel road somewhere in the pouring rain...found our way out...got soaking wet with cold rain, but we make it to Punxsutawney ...First photo stop...Looks like a small underground jail cell in the middle of a public plaza. We must be in the right place! Anyways, we ride right up to it, on the sidewalk...got a few glaring looks from the locals walking their dogs in the park, but nobody says anything. The fifth day’s idea is to ride deep into the Pocono Mountains... but of course, we don’t have a real plan because the wives aren’t here to direct us, so we decide to talk to one of the locals at the gas station and he says... Just head north to Route 6, and take Route 6 east all the way...you won’t regret it. Good enough for us...so we find Route 6 on the map and start heading north towards it. The Route 6 trip to the Poconos is something everyone who rides a motorcycle should put on their bucket list. We made a stop in St. Mary’s before getting there, and once on Route 6, we rode that entire thing with ear to ear smiles the whole way...stopping now and then for some fist pumps, photos, a drink of fuel, and a short breather....and by short I mean 5 minutes, then back to throttle up and...WOW!!...what a great motorcycle road! On the sixth day we decided to head southeast from home base via highway 322, so I say... “Let’s drop in at Penn State and pick up those PHD’s we had forgotten to get years ago. So we did...rolling in on campus and of course the first thing we do is ride our 3 motorcycles right up onto the sidewalk, like we always do, and we get off and take some pictures in front of the entrance. Big surprise...no one bothers us, and a security guard rides by and waves at us like we obviously must know what we’re doing, besides, who wants to screw with 3 guys on motorcycles? Day eight is now September 11th and we are determined to go to the Flight 93 Memorial, no matter what! Well...the day started out with rain so we hang out at the gas station drinking coffee and bullshitting with the locals while waiting for the weather to clear a little, and it does. Then we head out and ride 219 south to Shanksville to the memorial site of Flight 93, riding through some cold rain along the way, but no problem...just tuck in behind the windshield and roll on the throttle. What an experience! The Memorial is in open country with rolling fields and a new paved road that curves up to the crash site. A long wall of marble called the Wall of Names has all of the passengers and crews’ names, each on its own separate marble stone, and there were many photos, flowers, and mementos that had been left by their loved ones who had already visited the site that day. The alignment of the wall marks the exact descending flight path of Flight 93, and the point of impact is marked by a huge boulder with a wreath, and no one is allowed anywhere near that, but you can see it in the distance. Snowbird Season Our winter weather brings folks south that don’t even own cars in some of the major cities they live in during the rest of the year. They just keep a cage here in Florida at their winter homes. This means they are out of practice and now wielding a lethal weapon. Add this to our distracted drivers with their cell phones and touch screen computers in their dashboards and you have a recipe for disaster. One of the most common things we hear after an accident is that the motorcyclist was not seen by the driver of the car. The size of a motorcycle in comparison to an automobile makes you more likely not to be seen. Wearing reflective clothing can help alert the driver of an automobile that you are there. You also need to be alert to what is happening around you. Recently I observed a motorcyclist talking on a cellular phone while riding. In a split second a distracted driver can swerve into your lane. If you are on your phone you will not have time to react properly. As tempting as our digital devices are they should not be used while riding. I maintain the practice

of either zipping mine in an inaccessible pocket or storing it in the Tour Pack until I arrive at my destination. My new ride has a GPS and it too can pull my attention away when I need to get directions. My practice is to program before I leave the driveway and have a plan for where I am going, or pull over to program it. I plan to come home safely every time I ride. It takes precious little time from my travels to put that plan into action. As traffic increases on our roads we will need skill and common sense to stay safe. Some of the measures we can take are listed here: • Be observant o Watch the actions of other drivers. You can usually tell if someone is texting or distracted by their phone. Watch for them to check their mirrors. This can tell you which lane they are about to move to or even help you anticipate a left turn into your path. o Don’t focus on just what is ahead of you, or behind you. o Plan ahead by staying to the left or right of your lane in traffic. Keeping an “escape route” open should the driver in

front of you stop short in heavy traffic. • Look over your shoulder o Yes check your mirror but don’t miss the car in the blind spot in the process. Glance over your shoulder as well. • Hi Visibility Gear o Until recently you would look like you took your gear from a kid’s safety patrol member if you were wearing Hi Visibility Yellow or Orange. Fortunately it has become fashionable to wear these colors so no excuses that you will get picked on. • Interstate Travel Tip o Stay away from off-ramps unless you are using one. The driver that realizes they are about to miss their exit and be late for work may not see you. Many Motorcyclists are seriously injured or lose their lives in this scenario.
• Ride in a Bubble o Stay in the open and out of tight clusters of traffic. Riding with the flow of traffic will not keep you visible. You can stay out of blind spots by varying Continued On Page 35

The event is hosted by Harley-Davidson of Crystal River and included an escorted ride from Inverness to the dealership where a party included food, music, activities for the kids, and, of course, Santa Claus.

What Has Happened To Racing In The USA?

series where the OEM manufactures just simply stopped participating. Those that remained were shadows of the former teams. Drastically reduced in size and stickered up with sponsors to the hilt, the racing suffered, and so did the fans.
I recently took some time to check out the upcoming schedule for the 2015 Supercross Season. As usual the racing starts the first week in January in Anaheim CA. While taking a look at the schedule, I couldn’t help but to notice all the comments at the bottom of the page. The comments were from Canadian fans complaining that there were no Supercross rounds in Canada for the 2015 Season. What was even more comical was the fact that the AMA is stating the Detroit round will be sanctioned by the Canadian Federation…Like the fans in Canada give a rip who sanctions the race!?!
In 2014 the AMA announced that they would not be televising the Pro Road Racing and Pro Flat Track series on TV. Instead they decided to stream the racing via Fanschoice TV. Which isn’t TV at all. They claimed to do this so the fans could see all the racing but that is simply not true either. The AMA made this decision because the venue promoters and the AMA couldn’t come to an agreement. They are trying to retain more of the profits from the racing and they don’t want to pay the networks for the coverage of the racing. The promoters are set on making money, and so is the AMA. This is just another poor decision by the governing body of motorcycle racing in the US. Less TV coverage means less fans. People not exposed to racing will never get to see what motorcycle enthusiast love so much.
What is really sad about this whole deal is the fact that this has an effect on the entire industry. These poor decisions mean there are fewer young kids coming into the sport. That means fewer adults in the future will be involved in motorcycle riding and racing. All because the people running the show are more interested in money than the sport they are supposed If you haven’t been following the race to be supporting. scene for the last 10 years, you probably haven’t noticed the slow bleeding death I have supported the AMA for many of the AMA. Not too long ago the AMA did years. I have written many articles telling a good job of keeping the racing first and people to join the AMA so they can help keeping the participants riding. In recent support the sports I love so much. I am years they have simply lost sight of the now at the point where I question those goal and replaced the enthusiast with articles and decisions. VA Expands Eligibility for VA person for MST-related issues. Every VA Health Care Related to Military medical center and Community-based Vet Center offers MST-related outpatient Sexual Trauma Washington, DC – December 1, 2014 The Department of Veterans Affairs (VA), under authority from the Veterans Access, Choice, and Accountability Act of 2014 (“VACAA”), today announced expanded eligibility for Veterans in need of mental health care due to sexual assault or sexual harassment that occurred during their military service. This trauma is commonly known as military sexual trauma (MST). This expansion, which primarily pertains to Reservists and National Guard members participating in weekend drill, gives the authority to offer Veterans the appropriate care and services needed to treat conditions resulting from MST that occurred during a period of inactive duty training. “VA simply must be an organization that provides comprehensive care for all Veterans dealing with the effects of military sexual trauma,” said VA Secretary Robert A. McDonald. “Our range of services for MST-related experiences are constantly being reexamined to best meet the needs of our Veterans.” Secretary McDonald met last week with Ruth Moore, a Navy Veteran and MST survivor for whom the Ruth Moore Act of 2013 is named. Ms. Moore will be working with VA to ensure that survivors are treated fairly and compassionately, and that Veterans with MST can access fair compensation exams and access health care practitioners who are trained in understanding and working with MST issues. VA works closely with trauma survivors to ensure a full continuum of health care services are provided to assist Veterans recovering from experiences of MST. Recognizing that MST survivors may have special needs and concerns, every VA health care facility has an MST Coordinator who serves as a contact 26
counseling. Currently, all VA health care for mental and physical health conditions related to MST is provided free of charge. Veterans do not need to have a serviceconnected disability or seeking disability compensation to be eligible for MSTrelated counseling and care. Veterans also do not need to have reported such incidents to the Department of Defense or possess documentation or records to support their assertion of having experienced such trauma. The determination of whether a Veteran’s condition is MST-related is strictly a clinical determination made by the responsible VA mental health provider. Finally, Veterans need not be enrolled in VA’s health care system to qualify for MSTrelated treatment, as it is independent of VA’s general treatment authority. In addition to treatment programs, VA also provides training to staff on issues related to MST, including a mandatory training on MST for all mental health and primary care providers. VA also engages in a range of outreach activities to Veterans and conducts monitoring of MST-related screening and treatment, in order to ensure that adequate services are available. Today, IBM is working with several healthcare organizations to apply Watson’s cognitive capabilities in helping doctors identify and analyze cancer treatment options. Well, I’m goin’ out west where I belong. Where the days are short and the nights are long. Where they walk and I’ll walk. They twist and I’ll twist… (The Rivieras, California Sun 1964). But be sure before you head for the great Shake and Quake state you shake, rattle and roll your piggy bank to make sure there’s plenty of cash to pay for the flash! Besides, money is the only thing I know that is made, produced, grown or manufactured that does not have a warning label that says: “Warning, this product is known by the state of California to cause cancer”. California, by any measure, is an extremely diversified state. To put the size of California in some kind of visual perspective, if you rode a straight a line east from the Pacific Ocean’s California/ Oregon border to the Atlantic you would ride through Rochester, New Hampshire and if you did the same thing from San Diego, California you would ride through Florence, South Carolina. There is such an extreme difference in culture and way of life between the north and south ends of the state that there is currently a movement to divide the state into two separate states, one to be called California and the other Jefferson. My trip down the Pacific Coast started in Neah Bay, Washington; from what I experienced the entire Pacific Coast is expensive but the farther down you go, the more the cost goes up. I’m an avid camper and the Pacific Coast offer more camping then I could experience in a thousand lifetimes with hundreds of state parks, federal and national forests, and private campgrounds. It’s a camper’s paradise except for one thing, COST! I couldn’t believe the cost of camping. A prime example, Oregon Dune’s Lagoon Campground is a national 28

forest campground in Oregon. This is a really sweet campground with water, flush bathrooms, fantastic camp sites, and even pay showers. Without using the Senior Pass, it’s $20.00 a night for two vehicles, number of people don’t matter. The cost per night for a national or federal campground site in California is between $25.00 and $35.00. Kirk Creek campground is a national forest campground in Big Sur, California (Carmel south 90 miles to Ragged Point is generally considered the Big Sur section of the California coast), 670 miles south of Oregon Dunes, on California Highway 1. Kirk Creek is $25.00 a night, one vehicle, pit bathrooms, no water, no showers. Now as of October, there was a price increase that includes $10.00 per extra vehicle, $5.00 per extra person, and $8.00 for fire wood (generally you are not allowed to gather wood in the national forests) that California is adding to the price in federal and national parks. To camp in Kirk Creek, it works out like this: 1 night, 1 vehicle and 1 person = $25.00. Now if there is two or more, add another $5.00 per person per night for any additional people. Then throw in an extra $10.00 for each additional vehicle per night and $8.00 for fire wood. Sooooo, for you and Biker Babe to camp one night in a national forest campground in California if you’re on two bikes it’s gonna set ya back 48 bucks if you have a camp fire! This is just the beginning, private campgrounds are astronomical! I stopped at Big Sur River Inn a private establishment for gas and to check on a camp site for the night, I gotta tell ya it’s a pretty neat place to see. There is a

river that runs behind it, tables and chairs are set up in the river for your dinning pleasure. It really is pretty cool, but after I paid $5.70 a gallon for gas and found out tent sites start at $50.00 on the river $45.00 off the river and escalate up from there according to the number of people, pets and vehicles etc. I was afraid to order any food. When traveling I try not to carry much cash, so debit cards are what I use. One debit card I use is Discover, and one thing I discovered (Yea I hear ya!) is lots of convenience stores in California do not accept Discover Card at all and lots of convenience stores charge an additional .35 cents if you use any type of debit or charge card! That an extra .07 cents a gallon for gas base on a 5 gallon tank!!!!! One last thing, the California gas pumps are a little strange. There is a rubber “Boot” over the gas nozzle. The “Boot” has to be pushed up on the nozzle before the gas will come out. I guess that ain’t no biggie when fillin’ a car but when fillin’ a bike ya gotta push the “Boot” up and hold the “Boot” up on the nozzle with one hand while trying keep the nozzle in the tank and squeeze the pump trigger with the other! If you let the “Boot” slide down even a little bit the gas stops! The first few times more gas went on the tank and ground then in the tank! I hope Florida never gets that stupid! Welcome to 2015! May this year bring you lots of safe miles with smiles! I’m sure hoping that this year will be a heck of a lot better for me than 2014 was. I want to start by thanking Mugs & Jugs for giving us their place to have our Monthly 4th Sunday Biker Day. It’s hard to believe we’ve had this event going on there for 4 years now. By the way, I would also like to tell you about a dance hall that these folks opened up over on Colonial Blvd in Ft Myers. It’s called “The Ranch” and they’ve got live entertainment on the weekends. I went there to check it out, wow! Someone sure put some time and imagination into the decorating, this is a must see. Also if you wanna see a huge dance floor, go check this one out. I believe this is going to be one of the most popular places in the future for those who like to shake a leg… I’m attaching some of the photos from our last Mugs & Jugs event. It’s a family event with bike stuff on one side of the parking lot and a cornhole competition on the other side of the building, a very busy place. Be sure to add us to your list of destinations this New Year. Oh yes, and also a little note from Kat one of the organizers of the Eagles Helping the Guardian ad Litem Program. Cypress Hut Eagles Aerie # 4509 , Ladies Axillary, and Cypress Hut Eagle Riders #4059 would like to thank all who participated in our benefit for Guardian ad Litem. It was a good turnout, and we all had fun and raised some good money for the children. Photos can be seen in the December edition of Go For A Ride.

Successful completion of all of that and I got my choice of a free hat or shirt. So, did I like it? Heck, yes!
It’s new and fast and different. Would I buy one? That would depend on the pricing and on improvements with the range and re-charging times. Oh yea, and going from a bike with drag pipes to one that makes a whirring sound would definitely take some adjustment. Though my neighbors would likely be in favor.
