I

N HIS FIRST BUDGET ADDRESS the newly inaugurated Governor carried through with his promise to go for a severance tax on Marcellus Shale gas production. He has proposed a five percent severance tax on the value of natural gas being pumped from the Marcellus Shale formation in Pennsylvania plus a 4.7 cent tax per thousand cubic feet (Mcf) fee. As we outlined previously, there are questions as to whether a net of $1 billion in revenue will be forthcoming from the tax scheme and, just as important, whether using Marcellus tax revenue to fund huge increases in education spending without first proving the additional funds will improve education quality should be a non-starter in the General Assembly. The problem is quite simple: the price of natural gas has been on a downward trend since late 2014 and does not seem to be coming back up anytime soon, with the Henry Hub price closing at $2.72 on March 23rd - 38 percent lower than its trading price one year ago. Using 2014’s unconventional well production of just under 4 billion Mcf, and the average Henry Hub price for 2014 ($4.13) and factoring the per cubic foot fee, the estimated amount generated will be about $1 billion. However, in mid-February, that price had fallen to $2.75 and the amount realized would be around $735.5 million. With the most recently recorded trading price at about the same level, our revenue estimate would be essentially unchanged. Here it is important to note that the price used in the above calculations is the Henry Hub price as mentioned in Act 13 which is used to set the price for the impact fee schedule. Henry Hub is a natural gas pipeline hub in Louisiana that is the national benchmark, as traded on the New York Mercantile Exchange, but it is not necessarily the price at which natural gas is sold in Pennsylvania. Pennsylvania has its own hubs where drillers bring gas to the market. Hubs in the southwest, near Pittsburgh, such as the Dominion South, are a little closer to Henry Hub. But for the Transco-Leidy Hub in Potter County, the selling price is much lower due to the oversupply being brought to the market and the inadequate pipeline infrastructure in moving it out to other regions. News reports note that at the Dominion South hub, the selling price as of March 20thwas $2 per Mcf, while at Transco-Leidy, the price was $1.49. Of course the problem the severance tax proposal faces is that prices do in fact fluctuate. The original announcement said the tax would be five percent of the value of gas produced. And then we learned that an updated proposal included a 4.7 cent per thousand cubic feet add on fee. And now that prices have continued to stay low and revenue forecasts are not moving higher, we are learning through the media that an updated severance tax proposal will set an arbitrary minimum gas price for tax calculation purposes at $2.97 per Mcf. This is obviously an attempt to get more money when prices are low and add stability to revenue. But this would create a serious problem when prices are as low, or lower, than they are now. Setting a minimum price near $3 per Mcf means that for producers who are getting half that price the severance tax rate would be much higher than five percent. And the flat 4.7 cents per Mcf adds to the total tax rate. Consider a producer with a monthly volume of one million Mcf selling at a price of $1.50 per Mcf. The value of the produced gas is $1.5 million. At five percent, this producer would pay a tax of $75,000 and another $47,000 from the 4.7 cent per Mcf add-on for a total of $122,000 per month - an 8 percent tax rate. However, with the artificial price floor of $2.97, the severance tax will be based on $2.97 million in value and this producer would pay $148,500. On top of that the company would still pay $47,000 in the per Mcf fee for a total of $195,500 in taxes that month. That is a total tax rate of 13 percent of actual market value. At that level, the tax becomes extremely punitive. Of course, the tax paid will reduce the profit by that amount and will lower the corporate income tax somewhat but it will also lower the amount available for royalty payments and reduce the rate of return on investment. In effect, the tax is an added cost on production. When costs go up and cannot be passed on in prices, it hurts investment and production. The ramifications for the future of this industry in Pennsylvania need to be weighed carefully before this tax grab is even considered seriously by the Legislature. And where is the proposal to apply the severance tax to shallow wells? Note that conventional vertical wells tapping into the Marcellus formation are also subject to the tax, but they represent a very small fraction of total production. Finally, the Governor’s stated purpose for levying this tax is to use it for education. As we have shown earlier adding dollars to education spending without demonstrating how they will improve education is folly. For the most part, advocacy for more money is special interest pleading by the education establishment that cares little or not at all about cost management. There is never a willingness to entertain significant reforms such as ending teacher strikes or creating a voucher system that would let children get out of failing public schools. Any discussion of meaningful pension reform, a main driver of higher education costs, is met with derision. The General Assembly should demand some concessions on these points before it considers increasing spending for education. It should also ask why some districts can achieve sterling academic results while spending well below the state average per pupil and some districts spend far more than the state average and have dreadful academic results. And it would be useful to critically review spending in other areas as well. A “left leaning” think tank spokesman advocating the severance tax said that Pennsylvania is the only gas producing state with no severance tax and it is high time we had one. Perhaps the spokesman might consider that several states do not have a personal income tax, does that mean Pennsylvania should get rid of its personal income tax? Twenty-five states have a right to work law, including important recent additions in Michigan, Indiana and Wisconsin. Should Pennsylvania not have a right to work law as well? Only three states have significant numbers of teacher strikes and only eleven even allow teacher strikes. Pennsylvania for years has led the nation in teacher strikes. Should we not outlaw teacher strikes as well? Moreover, only two states, one of which is Pennsylvania, have state owned liquor stores. Should the Commonwealth not join the 20th century and 48 other states and privatize its stores? If Pennsylvania is out of touch with better economically performing states, it is because of its outdated laws regarding public unions, pension crises, prevailing wages, liquor stores, antiquated property assessment laws and so much more. The severance tax arguments are a red herring to take people’s minds off the real fundamental structural problems the state is beset with and cannot bring itself to deal with. And it is also an effort to make people believe there are easy and quick fixes to the state’s financial woes that can be dumped on the backs of the Shale industry. Isaac plays an upwardly mobile 1980s businessman faced by corruption - both commercial and political - that forces him to take drastic steps to protect his oil firm and his family.

THE BOOK OF NEGROES: A major television project for BET in America and CBC Television in Canada earlier this year, this miniseries based on Lawrence Hill’s novel casts Aunjanue Ellis as a 19th-century woman who undergoes grueling journeys both emotional and literal after she is abducted in West Africa and enslaved in South Carolina. MASTERPIECE MYSTERY!: GRANTCHESTER: Church and state have less separation in this series, recently broadcast by PBS and based on the novels by James Runcie that make 1950s sleuthing partners of a young vicar - James Norton and an experienced policeman - Robson Green. The puzzlers begin as Rev. Sidney Chambers -Norton- believes there’s more to a supposed suicide, but trying to convince law officers - including Inspector Keating -Green- of it won’t be easy. Morven Christie also stars.

SHANIA: STILL THE ONE LIVE FROM VEGAS: She’s wrapped up her two-year run as a Las Vegas headliner, but Shania Twain is seen taking the stage at the Colosseum at Caesars Palace in this offering, televised recently as an ABC special and presenting sequences from her concerts as well as behind-the-scenes footage. Don’t expect the most objective portrait, since Twain also is the executive producer here.

Q: I’M SENIOR management and have a stressful job with a lot of responsibility. I’m also juggling kids, a marriage, friends, family and life logistics. News' George Stephanopoulos for signing that law the following Sunday. It sure is nice to be a Democrat. What exactly does the law state? The Religious Freedom Restoration Act in Indiana states that "a governmental entity may not substantially burden a person's exercise of religion, even if the burden results from a rule of general applicability." That rule does not apply only if the government's action "is in furtherance of a compelling government interest" and is also "the least restrictive means of furthering that compelling government interest." If government does act against someone in violation of that person's religious principles, he or she can assert that violation "as a claim or defense in a judicial or administrative proceeding." The law does not specifically single out same-sex marriage as an activity against which a religious person may discriminate, but it certainly holds out that possibility. Of course, that possibility is already inherent in a little concept we in the United States used to call freedom -- freedom to choose how to conduct one's business and freedom to practice one's religion in one's practice of business.

First they believe any problem can be solved if the government throws our tax dollars at the problem. Second, if people are not feeling charitable, then make it a government mandate.Both theories are wrong. Most people have enough money to pay their heating bills if their priorities are in the

right order. One definition of charity is a 'voluntary giving of money to those in need'. Voluntary is defined as given of one's own free will. A government or business mandate is a tax, not a donation or charity. I don't wish to donate to an energy assistance program. I have trouble paying my own gas bill. If Mr. Mazur and other liberals are so bothered by this problem, they should increase their monthly donation to $5 or $10. They should put their money where their mouth is. My Sex Offender Brunch

S

UNDAY MORNING AT 10 found me slicing the tomatoes and arranging the cheese platter. My husband was setting up the chairs. At 11, the doorbell rang. And so began my very first sex offender brunch. What exactly is that? It's a brunch where I invited my friends in the press to meet my friends on the sex offender registry -- Josh

Gravens, 28, and Galen Baughman, 31. I'll tell you their crimes in a sec, but first let me explain why this issue interests me. As founder of the book, blog and movement called "Free-Range Kids," I am always trying to figure out, as the subtitle of my book says, "how to raise safe, self-reliant children without going nuts with worry." I like programs that actually help kids avoid abuse, such as those that teach them the three R's: recognize (that no one can touch where your bathing suit covers), resist (kick, scream, run) and report (tell me if anyone is making you uncomfortable, and I promise I won't be angry with you). The three R's make kids safer and take away an abuser's biggest asset -- a child's silence. What I learned through my research, though, is that one thing not making kids safer is the public sex offender registry. Study after study shows two things. First, "stranger danger" is a myth; the vast majority of crimes against kids are committed by people they know. Second, in New York state, where I live, as elsewhere, there's been no difference in the number of sex offense arrests before and after implementing the public sex offender registry. Yet it is very scary to send your kids outside once you see a red dot locating a sex offender on your neighborhood map. The problem is that the registry is cluttered with people who don't actually pose a threat to children. So though it's easy to think "dot equals monster," many registrants are teens who had sex with other teens, people who urinated in public, men who visited prostitutes, etc. A study by the Georgia Sexual Offender Registration Review Board, for instance, found that of the 17,000 people on the state's registry, just over 100 were "predators" compelled to prey on kids. But of course, all 17,000 dots look alike. Which brings me to my brunch. Through my research, I'd met Josh and Galen. Josh is a Texan who was visiting New York last week. At age 12, he played doctor with his sister. His sister told their mom; their mom called a counseling center to ask what to do; the counselor was a "mandated reporter"; and Josh ended up in juvenile prison for 3 1/2 years. His "therapy" there consisted of sickening things such as acting out sex acts for the therapist. Josh was still a virgin! Ever since he got out, he has been on the registry, even though his sister has long forgiven him. I wanted my guests to meet him. I wanted them to meet Galen, too. When Galen was a 19-year-old opera student in Indiana, he met a young man, 14, at a friend's family party. They started emailing. When the 14-yearold's mom found out her son was writing to a gay teen, she took his computer to the local district attorney, who gave it to a cop. The cop continued the online conversation, pretending to be the 14-year-old. He asked Galen to send him gay teen porn, and when Galen complied, he was arrested for distributing child pornography. On Galen's personal computer, cops found evidence that he'd had a sexual encounter (once) with a different 14-year-old. The emails showed it was consensual, but this still constitutes rape. He went to prison for nine years. They told their stories to my reporter friends as we ate our brunch. Then we all went our separate ways, filled with carrot cake to die for and a new skepticism about just whom we label a "sex offender."

PREVENTION Snack Foods To Promote Better Sleep

ACCORDING TO the National Sleep Foundation, changes in sleep patterns are a part of the aging process. Many people experience difficulty falling asleep and then staying asleep as they age. But even though difficulty sleeping may be a part of aging, that does not mean men and women over 50 cannot take steps to improve their sleeping patterns. For example, certain snack foods may help improve quality of sleep. While men and women over 50 should always consult with their physicians before making any changes to their diets, the AARP notes that the following are a handful of snack foods that promote better sleep. · Almonds: Magnesium is a mineral with muscle-relaxing properties, and almonds contain enough magnesium to help men and women get a better night's sleep.

· Bananas: Much like almonds, bananas provide a substantial amount of magnesium. Bananas also contain the amino acid tryptophan, which many people associate with Thanksgiving turkey. While tryptophan might be most often associated with the sleepiness people feel after eating a holiday meal, it also has been linked to better sleep quality. · Cheese and crackers: One more traditional snack may help you get a better night's sleep. Cheese and crackers contain tryptophan and carbohydrates, which can induce a better night's sleep and help you fall asleep sooner. · Cherries: Cherries contain the sleep hormone melatonin, and the AARP notes that recent studies indicated that participants who drank tart cherry juice on a daily basis fell asleep more quickly and slept longer.

· Hummus: The primary ingredient in hummus is chickpeas, which are loaded with tryptophan, folate and vitamin B6. Folate has proven especially beneficial to older men and women who need help regulating their sleep patterns, while vitamin B6 helps the body regulate its clock. · Peanut butter: Peanut butter is another snacking item loaded with tryptophan. Spread some peanut butter on a carbohydrate, whether it's a slice of toast or some crackers, before going to bed, and you may enjoy a better, longer sleep. · Walnuts: Like cherries, walnuts contain melatonin, which can contribute to a longer, more restful night's sleep. Walnuts also can help regulate stress, which is a leading cause of sleeping difficulty. Many men and women experience difficulty sleeping as they age. There are a variety of factors that can cause us to either have problems falling asleep or sleeping through the night. But the right foods may just help combat such problems and help men and women get a more adequate night's sleep.

Racist Family Makes Girlfriend Want to Flee By Amy Dickinson

DEAR AMY: I have been with a wonderful man for over four years and have a healthy relationship with him. Despite our happiness together, I am contemplating whether to leave him because of his family. They are racist and rude. He is white and I'm Middle Eastern. They have made racist comments to me, called me foul names, and his mother even telephoned me to say she wishes and prays that her son breaks up with me. He has tried talking to them but at this point it's so awkward; he just wants me to get over it. They are paying for his living expenses while he is in school, so he feels he owes them, and they're "the good guys" now. I don't know if I can forgive them after four years of torture. I try to be polite and say nothing, but secretly I want to scream and walk out. Should I forgive and forget? I feel like I have to choose between a good guy with a horrible family or nothing at all. -- Sad DEAR SAD: I vote for screaming and walking. Here's why: They are his family. They are also his blank check. In not expecting and/or demanding respectful treatment of his partner, he is actually aligning with them -- demonstrated by his choice to tolerate their disrespect in exchange for support. Your guy has "tried talking to them" when he should have Shut. It. Down. His loyalty is to his family first; you get whatever is left. This might be almost understandable or forgivable if not for the fact that he somehow expects you to get over something that is not resolved. I suggest you answer his mother's prayers and find someone who comes from a better family. DEAR AMY: Three months ago a young man added me by accident on Facebook. He had been adding some people from a certain religious group, of which I'm a part. I accepted this Facebook friendship on a limited basis, as it is rare to find friends of my faith. Turns out he is from the same country as my father. He thought I was from his country, too, before he figured out I am American. We began chatting and have Skyped about that and about our faith; as the months have gone on, I have become very fond of him. I'd like to take this to the next level; my parents dated long-distance in an eerily similar way, and I believe I could handle that. But is it rational to fall for someone you've never met, based on common values and interests? -- Long-Distance Lover? DEAR LONG-DISTANCE: This happens all the time. In fact, in many ways, it's easier to fall for someone long-distance because you are each presenting an idealized version of yourself, designed to appeal to the other. You are quite literally writing the story of your life, exactly as you want it told. I believe that people tend to be more open about personal values and actually communicate better when they're getting to know one another at a distance. There is nothing irrational or inherently wrong in falling for someone this way -- the heart-quickening rush when an email or text comes in is exciting and affirmative. However, all of the usual caveats apply when dealing with an Internet relationship. Verify his identity through other sources. And if he asks for a loan or offers you an exciting deal on an interesting investment opportunity, run in the other direction.

assume for the unfortunate hunchback, but apparently he has some highly dramatic songs. This new show, which has been well reviewed, stars Michael Arden, Ciara Renee and Patrick Page. The production is apparently so lavish that one reviewer commented that no Broadway house could really accommodate it! New Jersey is always the butt of jokes, some deserved because of the officials in power, but the Paper Mill Playhouse remains a true theater jewel. Two productions I’ve seen there have always stuck in my mind revivals of “No, No, Nanette” and “Follies” - neither of which reached Broadway.

In the case of Sondheim’s “Follies,” New York audiences missed out on, among other things, Ann Miller’s incredible rendition of “I’m Still Here.” The audience went berserk over Miller’s rendition! I’d always felt that Yvonne De Carlo’s version of “I’m Still Here” from the original 1971 show was definitive. But Ann Miller made it all her own. “Hunchback” runs until April 5 and maybe I’ll get a chance to see it. I encourage others only because I already know the quality productions this theater presents. Now I guess I just have to be patient and wait for the musical version of “Psycho,” starring a good-looking young

ONCE UPON A time in a town named Gonzales, Texas, I reluctantly went to see my parents, who had forsaken Fort Worth and gone to live in “The Lexington of Texas.” This was/is the spot where the first shot of the Texas Revolution was fired back at the Mexican Army. I thought Gonzales was a comedown from big city lifeand nothing really of note had happened there since thirtytwo Revolutionary Texans had marched out and traveled 70 miles on foot to “die to a man” in the catastrophe awaiting them at the Alamo. So I didn’t really appreciate little town life until I met a woman there by the name of Marjorie Hall, who seemed to be leading an upscale life all of her own devising. Marjorie, a beauty, had a daughter, equally attractive, named Jerry. In time, Jerry Hall would reach the heights of the modeling world and then diverted herself by romancing Mick Jagger. Diversion led to love and in 1990 Jerry and Mick wed in an Hindu ceremony. They had four children together. Nine years later, they split. Jerry and I became pals after she split from the star. She is a great, earthy, funny woman. Her striking good looks are the only clue to the fabulous international life she’s led. I was reminded of all this when I saw a photo of one of Mick and Jerry’s adorable children, Georgia May, now 23, marching in a London advertising parade. At least she isn’t marching to the Alamo.

I HAVE THREE TYPES of supernatural stories. Those I read about from people I don't know, those that have actually happened to me personally, and those which have happened to people I know well and trust. This story is from the last group. John and Mary were very good friends of my ex-wife and me for years. This story happened in the early 80s in a house in Rusk, Texas in which I am pretty sure was haunted. They moved into the house and John got a job while Mary stayed at home with her young three-year-old son, Robbie. Robbie would be playing in his room as Mary went about her day and she began realizing that the young boy was actually holding conversations. At first she thought it was an imaginary playmate, but when she would walk in and question the boy he would look guilty and say it was nothing, as if he were trying to hide something. One time, as she was walking by his room, she saw Robbie talking away to his empty rocking chair. The terrifying thing was that it had rocked, almost as if someone had gotten out of it in a hurry and it was on its last rock. Her blood went cold. She began to question Robbie over the next couple of days, and he opened up to her slowly. He said that he was talking with a boy a little older than him named Goon. The boy had a sister he talked about but that Robbie had never seen named Dixie Rose. While Mary was working out in the yard one day her son walked up to her and pointed to a thick hedge. "That's where Dixie Rose is buried," he said matter-of-factly. This scared Mary, because she couldn't imagine a three year old coming up with such things. She called her friend and told her everything, and while she was recounting the story a coffee cup, hung on a hook flew off the hook and bounced around on the hard floor without breaking, rolling into the wall. This terrified Mary. Her husband was not very convinced and definitely not a believer, so he blew it off whenever she talked to him about it. He would just switch the subject. In this same house another incident happened. Mary had a good ex-college friend who was going to visit them in June for a week or so, and they were both thrilled. Unfortunately, John's troublesome, alcoholic uncle showed up out of the blue and out of a job, so John told him he could sleep in the empty bedroom until Mary's friend came, then he could sleep on the couch. John said he would give his uncle one month to "get it together and leave" as he put it. Unfortunately, the uncle was still there when Mary's old girlfriend showed up. So, they put the woman in the empty bedroom and made John's uncle sleep on the couch. On the second or third night, the visiting woman was sleeping when she realized that another woman was sitting on her bed shaking her gently awake, whispering, "Honey, you have to wake up now!...Wake up!" At first the woman thought it was Mary waking her up for something, so she sat up and rubbed her eyes and when she opened them again, there was no one on her bed. BUT...her bedroom door was slowly opening, and she screamed mightily. John and Mary ran to her door only to find the uncle trying to sneak into her room. He made some excuse about wanting to get some book which apparently wasn't there, so John kicked him out. The woman stayed her full visit and didn't have another incident happen to her. All of these things took place in the same house in Rusk, Texas. ©theshadowlands.net
