HREE YEARS AGO, in November of 2012, Pittsburgh’s Act 47 recovery team recommended to the state department that oversees it (Community and Economic Development, or DCED) that it was no longer needed. DCED ruled against that recommendation and kept Pittsburgh in Act 47 status.

Now DCED is poised to make a decision on the future of the City’s other financial overseer, the Intergovernmental Cooperation Authority, also known as the oversight board or the ICA. To say that relations between the oversight board and the City of Pittsburgh are frosty is an understatement. At various points this year there has been a disapproval of the previously approved City’s 2015 operating budget, an open records decision on ICA contracts and communications that the City sought, a request for members of the state legislature to act as mediators in the dispute, and an audit on the ICA conducted by the state Auditor General’s office.

That audit - released November 10 - stated “The ICA’s approval of three consecutive balanced budgets [2013, 2014, and 2015] appears to meet the standard set in the ICA act that would allow the DCED secretary to proceed with dissolving the ICA”. The standard referred to is in Act 11 of 2004, Section 204 describing “term of existence.” If DCED rules that those three budgets and plans were approved, the oversight board would be dissolved.

Clearly a lot hangs on “legalese” as what exactly Act 11 means in regards to board approval of City budgets and financial plans. Adding some specific metrics to the law as we suggested in 2012 would have been helpful in clarifying this issue.

During a visit to southwestern Pennsylvania recently, the DCED secretary stated, “Our attorneys have to give me a legal opinion that says, ‘This is what it is. You have to,' or, ‘You don't have to … I want to be able to settle this one way or another. There's a solution out there. I just want to make sure it's the right one.”

One wonders how long that opinion will take. And if the opinion calls for dissolving the ICA will there be substantial pushback from the Republicans in the Legislature?

The desired solution from the City’s perspective would seem to be for the ICA to disappear. Is that the solution for the state as well? If events play out in such a way that the ICA does not get dissolved, there is a relatively easy fix to get the oversight board to move toward a much friendlier relationship with the City. Simply put, the officials charged by statute to make appointments to the board need to make them to fill the three open seats.

Section 202a of the Act states that the Governor, the President Pro Tem of the Senate, the Senate Minority Leader, the Speaker of the House, and the House Minority Leader each make an appointment to the ICA board. Currently, there are only two serving board members and they are Republican appointees.

The other three seats - all to be appointed by Democrats - are vacant due to one appointee’s death, one appointee’s term expiring with the expiration of the former Governor’s term, and a resignation. When the resignation occurred the Mayor of Pittsburgh was quoted in a news article as saying that “The board… now doesn’t have enough members to vote on anything.” Section 202d says that “A majority of the board shall constitute a quorum for the purpose of conducting the business of the board and for all other purposes.” By that clear language it appears that it takes three of five members to take action, but one could see an argument made that vacant seats don’t count in determining a majority, especially since the language does not specify what should happen if there are only two seated members. Indeed, if three appointing officials refuse to make appointments and the courts rule that any action requires at least three votes, then the board would be effectively constrained from taking any action.

Is it a deliberate strategy by the officials with unfilled appointments to refuse to make appointments so as to delegitimize the ICA? It is certainly a question worth asking in view of the length of time the unfilled board seats have been vacant. Moreover, it is not clear what, if anything, could be done to force an elected official to make an appointment to the board. Section 202b does state that “Whenever a vacancy occurs among the appointed members on the board, whether prior to or on the expiration of a term, the appointing authority who originally appointed the board member whose seat has become vacant shall appoint a successor member within 30 days of the vacancy.” But who would have standing to seek a court ruling that would enforce the “shall appoint” language?

For what it is worth it does not appear these officials have any objection in principle to appointing board members to municipal oversight agencies, as the Intergovernmental Cooperation Authority for Cities of the First Class (overseeing Philadelphia’s finances) has its full complement of five board appointees according to its website, all appointed or reappointed by the same five officials who are charged with appointing ICA board members.

What can be the motivation of these three officials for not finding appointees for the ICA vacancies who would be sympathetic to the City? They could vote together to advance ICA business, even if it occurred on a series of 3 to 2 party line votes. A 3 to 2 partisan vote would release gaming money the City receives from hosting the Rivers Casino (a critical issue in the current dispute), approve operating budgets, and make City-overseer relations much more amicable. So what is the objection to going this route in light of what has played out over most of 2015?

Indeed, why is the Mayor not pressing the Democrats with appointment authority for just such appointments to be made instead of trying to find legislators to mediate disputes with the ICA? Or have such appeals gone unheeded? It would seem far better to have an agreeable Democrat majority ICA that could be of great help to the City for at least the next three years covering the current Governor’s term. Moreover, if the ICA under majority control of Democrats wanted to move to dissolve itself, it would have the votes.

Something about all this does not add up. Does the problem stem from opposition from Republican leaders to the dissolution of the authority? If that is the case would it not be a better plan for the Democrats to appoint a majority of loyal party members to run the ICA in a manner that is solicitous of the City’s wants and needs, thereby undermining many of the reasons to oppose dissolution? Indeed, having the majority in control could hasten the demise of the ICA. With so much to gain by making the appointments it is mystifying as to why they are not being made.

Trying to undermine the ICA by refusing to appoint members of the board just creates drawn out legal issues that are unnecessary, probably costly, and gives more ammunition to those who are cynical about the manner in which their government operates.

Why do issues like those surrounding the refusal to make ICA appointments that should and could be solved simply by following the laws on the books have to face possible long, drawn out and expensive court battles to get resolved? At some point in this standoff, that will almost certainly happen. Political battles ought to be fought in Harrisburg at the state capitol, not in court as legal squabbles.

Liz never worried if she was still at the top. She always was at the top, because she was always Elizabeth Taylor.

HERE SEEMS TO BE A GROWING ARMY of online businesses convinced that I am neglecting my personal hygiene. But with the help of UPS and other package delivery services, my woes will soon be over. First it was Dollar Shave Club, an online razor blade home delivery service known not just for its products but also its creative and hilarious

YouTube videos featuring company co-founder Michael Dubin.

After assorted friends shared their infatuation with Dollar Shave Club via myFacebook wall, I visited the company website. Within minutes I was told that I was not only overpaying for razor blades, but my face was suffering because I did not always have fresh clean blades at my disposal.

Dollar Shave Club would solve these newfound problems by depositing blades in my mailbox on a monthly basis.

The pitch worked. Suddenly I decided that, yes, I need a constant stream of razor blades in my life. Never mind that my local drugstore is within walking distance of my house and never once have I had to move appointments around in my day planner because I needed a razor blade pronto.

A mere month after joining Dollar Shave Club, word had infiltrated cyberspace: Greg is too lazy to leave his home for basic necessities.

Enter FreshCleanTees.com, the "premier tee shirt club for all your T-Shirt needs" according to its website. I'm guessing that somehow, some way, the company discovered I was a Dollar Shave Clubsubscriber and decided to pounce by following me on Twitter. This despite the fact that I have never once, via social media posts, pleaded for a clean T-shirt. I vaguely remember mentioning onFacebook that I had packed mismatched shoes for a speaking engagement, a post that received the most unoriginal of responses from several friends: "Bet you have another pair just like them at home."

Oh, the hilarity.

Frankly, I'm surprised MensShoe.club did not discover that post. Otherwise, it would have surely offered to solve my feet/fashion faux pas with an invitation to receive, monthly, "a fresh new pair of premium leather shoes ... selected by our expert shoe stylists."

If company representatives are reading this column and feel inclined to send me an invitation, let me say that I purchase premium leather shoes about as often as I renew my passport.

I purchase T-shirts a bit more frequently, usually from Wal-Mart or some other discount retail establishment. They are white, nondescript and provide nothing more than a layer of protection and warmth between my skin and a dress shirt. But, thanks to FreshCleanTees.com, I now know that Tshirts have a "finite expiration date that most guys ignore leading to pit-stains, holes, and possibly even a funky smell that can lead to an awkward moment at the bar."

Suddenly self-conscious, I asked my wife for clarification after donning a T-shirt from my closet.

"Honey, do I smell funky?"

"No. Well, yes, but no."

While contemplating whether I should join FreshCleanTees.com or stay away from bars altogether, a tweet from GoodMouth.com inexplicably appeared on my Twitter feed. The company offers, you guessed it, home delivery of toothbrushes and other oral care products.

GoodMouth.com's mere presence on my computer has taken self-consciousness to a new level. Now I sit alone in my house, convinced I will not be invited to any Christmas parties this year due to my stinky breath and equally foul smelling armpits. But I could be the hit of those

Even detailed careers have job niches where that industry will need a big picture thinker. Many of my most successful technology professionals are always big picture thinkers. They can think outside the box and get breakthrough results that their detailed peers wouldn’t ever see.

Equally true is that overview careers like my field - running companies, and corporate strategy rely on detailed people to make sure we show up and get on the right plane.

I know it is difficult to admit there are just some things you are never going to be easily good at doing. They realize later that the magic is learning the tools to excel as they are rather than by trying to change their selves.

In-Law Feels Cut From The Herd

DEAR AMY: I have been married to my husband for a wonderful 17 years, but I have never felt accepted by his family. He is one of seven children.

They are a very close family. They plan get-togethers and don't remember to tell us until the last minute. When we are not available last minute, they shame us for not making family a priority. Recently I received a Facebook message from one of my husband's brothers. He is a single man who works only six months of the year. He told me I have no right to be upset for not feeling invited to family get-togethers and that we should make time when we are invited.

As a family of four, between three jobs, school and activities, we are very challenged to find time when invited at the last minute. My brother-in-law also told me he does not come to our home because he has to drive three hours to get here.

This same brother told me he tries to avoid us. He finds me too competitive and says it has influenced our daughter to the point that she has become a bossy know-it-all, making it difficult to enjoy her.

Is it inappropriate for one brother to insult his brother's wife and daughter? How should I respond to my brother-in-law in a way that builds a family relationship?

-- Left Out and Hurt DEAR LEFT OUT: Yes, it is inappropriate for your brother-in-law to insult you. So now that you know that he is inappropriate, how lucky you must feel that he promises to avoid you!

Families are complicated. Large families often have a herd mentality that is both wonderful and challenging -- especially for in-laws.

It is fun to be part of a herd when they are including and enfolding you. It is no fun at all to be on the fringes and to feel judged.

When someone insults you, you can respond honestly by saying, "Well, I'm so sorry you feel that way, but I really don't appreciate your insulting comments." It is also appropriate to delete the message and not respond at all, if you don't want to. In terms of your husband's family, you should put the word out that you are doing your best and will continue to try to attend family functions if you can.

Because of your other commitments, you can only do what you can do.

What I'm suggesting is a sort of detachment where you realize that you are not responsible for the way other people behave. See the good in these people when you can, enjoy the good bits and the individual friendships with your in-laws when you can have them, and plan your exit for those times when you don't like the dynamic.

DEAR AMY: I was invited to three nephews' "destination weddings" in one summer. I am an older widow and find it difficult financially and logistically to travel solo. I suggest more understanding be given to elder invitees to these extravagant weddings; the events are becoming "a bit much" (and all for show?)!

-- Old Auntie DEAR AUNTIE: Psst ... come and sit by me. I have an unsavory little tidbit to share about destination weddings.

There is a high likelihood that these invitations are "for show," and that your dear nephews didn't expect -- or even want -- you to come to their weddings. If they wanted to host a wedding that was familycentered and inclusive, they would have hosted it at a venue where people would find it easier (and less expensive) to attend.

DEAR AMY: Regarding "Upset Parents," whose adult children seemed always to find fault with them, they should respond by letting their kids know that when they are footing the bill, they can weigh in on tipping, driving, etc.

My father's favorite phrase (he's a pilot) is, "If you're buying, I'm flying." It worked great on me, and as an air traffic controller I use it on my kids now too. It gets the point across humorously and, really, anyone could use it.

HELLO. A FRIEND OF MINE sent me your link to Arizona haunted locations. She is a skeptic -- or was, until learning of what has occurred at my home.

We live down the street from Vail High School, listed as one of your haunted places.

To give a brief background, my husband and I are welleducated. I have three college degrees and am a collegelevel instructor, and he has a B.S. in computer networking and is a highway patrolman. We have two toddlers and are members of a local interdenominational church.

We live in a community called Rita Ranch. Rita Road is about 4 miles long and has small subdivisions along it.

While the housing is new (ours is only 2 years old this month), the area has history. In walking distance from our home was a deadly train wreck in January 1903.

Over a year ago, our eldest toddler awoke, crying. He NEVER does this. We awoke at the same time, only to see a group of roughly 15 people walking silently past the foot of our bed. All slowly disappeared, except one: a young woman around 19-21 years of age, long wavy dark hair, wearing a wide brimmed straw hat and a dark dress with white polka dots. Her back was turned to us, she faced our bathroom. Slowly she faded.

After repeated visits by her (none of the rest of the group though), we came to name her Dottie because of her dress. After a month of little sleep we came to realize she meant no harm, or else something would have happened already.

We have had countless encounters with Dottie, and occassionally a couple of other "visitors." One came up behind me where I currently sit, scaring the daylights out of me and disappearing. Another pushed on my calf one day while I was in the restroom. Most of our visitors seem to concentrate near our bathroom or the hallway near our toddlers' rooms. Our son at age 2 was already pointing out "Dave" in the hallway. I think this is who touched my calf that day, as Dave seems to be a child visitor. Neither of my own children were in the area at the time.

Upon learning of the train wreck a hundred years ago, I did some research and learned that a little boy was among the dead, though no name was ever learned.

I don't know if the terrible train wreck (14 died) have anything to do with what happens at our home, but we have come to terms with these visitors. Our faith in God has not changed, in fact it has only helped. We figure there are things out there that we as humans are just not yet meant to understand.
