N NOVEMBER 5TH the Court of Common Pleas of Allegheny County ruled that the Allegheny County Controller does not have the power to audit four Authorities related to Allegheny County: the Allegheny County Airport Authority, the Allegheny County Sanitary Authority (ALCOSAN), The Sports and Exhibition Authority (SEA), and the Port Authority of Allegheny County (PAT). The Court’s opinion is that these Authorities were created by state law and are therefore not subject to review by the Controller. As we wrote earlier this year, regarding the Controller’s request to audit the Sports and Exhibition Authority (SEA), “the law seems clear. As long as the SEA annually delivers to the City and County an independent audit … then the Controller does not have standing to conduct an audit.” The Court in its ruling also extended this assessment to the Allegheny County Airport Authority, ALCOSAN, and PAT. The crux of the Controller’s argument was that the office has the right to perform an audit on any entity receiving public money (from the County) as granted to the Controller under the Second Class County Code. The Court’s opinion noted that the Code grants the Controller “the general supervision and control of the fiscal affairs of the county and of the accounts of all officers or other persons, who shall collect, receive or distribute the public moneys of the county, or who shall be charged with the management or custody thereof. 16 P.S. § 4901.” Of course the Controller wanted not only to perform a financial audit, but a performance audit as well and believed the Code also allows that. As was outlined in the opinion, the Controller argued that the office “may at any time require from any of them, in writing, an account of all moneys or property which may have come under their control.” She was particularly interested in how the SEA distributes tickets to events at its facilities. Of course counsel for the Authorities disagreed, claiming that the Authorities were granted operating power through state legislation wherein no specific provision was made for permitting the County Controller to perform audits. The Airport Authority and ALCOSAN were created through the Municipal Authorities Act (1945) which gave governmental auditing power to the Attorney General. The Attorney General was also granted auditing authority for the SEA which was created under Act 85 of 2000, “Second Class County Code - Omnibus Amendments.” PAT was created under the Second Class Port Authority Act which provided the Auditor General auditing powers. Of course, all Authorities must by law have financial audits carried out by the qualified firm of their choosing. As we wrote previously, “the office of the Attorney General is the state’s top law enforcement officer, not an auditor. On its webpage the Attorney General’s office lists as its responsibilities and duties items such as defending the Commonwealth and its agencies in a court of law but, to no one’s surprise, auditing authorities is not one of them.” Was the provision in the laws authorizing these three Authorities (excluding PAT which is periodically audited by the Auditor General) granting auditing power to the Attorney General rather than the Auditor General which presumably should be able to audit any agency receiving state funds - done deliberately to limit governmental scrutiny or was it merely a typographical error? Since it happened in two different Acts, the latter possibility seems very unlikely. Indeed, it would be interesting to learn whether the Attorney General’s office ever performed an audit of an authority. The Court’s opinion is that the Legislature specified the Attorney General to have the primary auditing power and the best the Controller can do is review any fiscal audits that are performed for the Authorities. Quoting the court ruling: “That the legislature gave the controller only a back-up or provisional right to audit and gave the Attorney General the principal right to audit leads this court to the conclusion that the Controller cannot conduct an audit outside of the Municipalities Authority Act …” That quote was in reference to the Airport Authority, but similar conclusions were made regarding ALCOSAN, PAT, and the SEA. The ruling notes that “the general powers granted to the controller by the Second Class County Code cannot override the specific auditing structure the Legislature has created. 1Pa C.S.A.§ 1933.” Of course that is the strict legal interpretation, which is of course correct. The Legislature created these Authorities and gave the oversight power to state level officials, the Attorney and Auditor Generals. They did not include local oversight. However there is an easy fix: the Legislature can amend these Acts to give auditing power to the Auditor General, the county controller, or both, especially in the cases where the power is currently limited to the Attorney General, who would probably never become involved unless possible criminal activity was taking place. Indeed, involvement of the Attorney General would almost certainly be perceived to be an investigation. First and foremost, transparency would be the main reason for allowing this move. The crux of this lawsuit was the Controller’s desire to examine the awarding of tickets by the SEA. Were the recipients politically connected and were they given as favors or rewarding past support? Was there any quid pro quo, whether explicit or not? The public has a right to know. In the opinion, one judge stated in regard to the Acts, “the Legislature has created several layers of safeguards to assure the public that government funds and assets are being used wisely.” But the ultimate “safeguard” was placed in the hands of the Attorney General, not exactly the greatest accounting and auditing expert. And as noted above, any audit by an Attorney General would likely be viewed as a signal that there were suspicions of questionable behavior. In short, the current law regarding the creation of the SEA and the other Authorities needs to be amended to include granting auditing powers to the Auditor General and the local Controller. Simple modifications in one sentence would be all that is required. Why should there be any hesitation to offer the requisite amendment language and bring it to a vote? END TRIBUTE: Over the weekend, while surfing the TV channels, I happened to come across the very famous 1951 musical “An American in Paris” with Gene Kelly and Leslie Caron. I’ve always considered this Vincente Minnelli offering overrated. Watching it one more time didn’t change my mind at all, despite all the talent involved. How it won Best Picture over A Streetcar Named Desire or A Place in the Sun, baffles me. Gene Kelly in tight tights is impressive - but does a rear end deserve an Oscar? To me, it is Nina Foch as Kelly’s patroness who walks away with the movie. Foch had a very long career, usually playing upper-class ladies with a real mean streak. But in the Kelly film, she is full of warmth and wit and deserved better than the script she had to work with. Her character was dropped unceremoniously from the movie with no explanation, after Kelly and Caron cavort during the long finale. Miss Foch died in 2008, and was working in TV shows such as “NCIS” until the end. Just thought I’d remind you.

PREVENTION Be Smart About Antibiotic Use "

WHEN USED CORRECTLY, antibiotics and similar drugs known as antimicrobial agents can alleviate infections caused by various bacteria and some types of fungi and parasites. The CDC says that these drugs have been used successfully for the last 70 years to treat patients with infectious diseases. But those antibiotics cannot treat illnesses that stem from viruses, which include most colds and the flu. As effective as antibiotics can be, antibiotic resistance is a real problem. The CDC reports that at least two million people become infected with certain bacteria that are resistant to antibiotics, and roughly 23,000 people die each year as a result of these types of infections. An April 2014 report from the World Health Organization stated,

“This threat is no longer a prediction for the future, it is happening right now in every region of the world and has the potential to affect anyone, of any age, in any country. It is now a major threat to public health." The Alliance for the Prudent Use of Antibiotics says antibiotic resistance occurs when an antibiotic has lost its ability to effectively control or kill bacterial growth. The three main ways resistance develops include natural resistance to types of antibiotics, genetic mutation or through the acquisition of resistance from another bacterium. This resistance can occur spontaneously or through misuse of antibiotics or antimicrobials. Prudent antibiotic use can help prevent the recurrence of resistance. Most individuals can help the process in a number of differemt ways.

HILE VIEWING A DAILY ROUNDUP of the country's top trending news topics, I heard a California TV reporter utter what might possibly be the biggest oxymoron of the holiday season: "Sophisticated porch pirates." The term "porch pirates" rears its ugly head every holiday season, as it refers to bands of thieves

who steal unattended boxes left by package delivery services on front porches and in apartment lobbies. As more consumers opt to receive their Christmas gifts from brown UPS vans as opposed to brick-and-mortar retail establishments, targets become more plentiful in December. OK, that part I get. But sophisticated? What type of thief, other than a truly stupid one, elects to steal something without actually knowing what he or she is acquiring? Don't these pirates realize what can be purchased online these days? December 25 is rapidly approaching, yet so far neither my wife nor I have procured a single Christmas gift that did not originate from inside a PC or iPad. Some lovely trinkets, destined to be covered in festive wrap and ribbons, have since arrived at our front door. But so have basic necessities we stumbled upon due to the fact that online retailers are offering steep discounts on, well, everything. GROWING UP I LIVED IN the same house from the time I was two till I was 16. It was a house in a nice neighborhood and it couldn't have been more than 20 years old. My earliest memory of the ghostly going ons was when I was younger, 5 or so, and I'd lay in my bedroom at night and swear I could hear someone in the kitchen doing dishes. I could hear the water running and the dishes and the silverware in the sink. I tried to tell my parents but they thought I was crazy. Also at night I swear I could see dark shadows moving, it may have been my imagination but I saw them during the day too. Then there was the basement. You would be down there by yourself and always feel like someone was watching you and creeping up on you and just when you'd turn around to check them there would be no one there. In the basement we had this room under the stairs called the cold room and the door would never shut and the light would always stay on. One day when it was just me and my dad home alone he asked me to go get some veggies from the cold room. I remmeber making sure I shut the door and turned off the light because me and my brothers were constantly getting blamed for leaving them on and open. I went back upstairs and he asked me to get something else from the cold room. When I got back downstairs and reached the cold room the door was open and the light was on! I hated that basement and it always felt so unwelcoming. My bedroom was at the end of the hall way upstairs and every now and then my door would pop open. No open windows, no one else home nothing. To make sure it wasn't my imagination I would latch my door and make sure it was shut and it still popped open. One day it popped open as I was changing; there was no one else home and I was getting annoyed with this so I calmly said, "Listen I'm changing could you please shut the door?" and just like that the door shut and latched. Everytime after that I'd simply ask it to shut and it would. My mother said one night while she was up late watching TV she caught the figure of somone in white walking down the hall to my room. She thought it was me sleep walking so she went into my room to check on me but I was sound alseep. Then there's the light going on and off on the stairs to the basement all by itself. The switch that turned this light on made a loud pop every time you flipped it and we'd hear the pop and the lights would turn on then we'd hear it again and they'd be off. The most intense one happened to my father. He woke up early one moring and went out to the kitchen to find the microwave on and a bowl of the soup from the night before in it. He thought my mother did this, so when she awoke he asked her and she had no idea about the soup. My brothers were both too little then to operate a microwave and I had not done it. My dad figured it had been left on from the night before by me and I was just too scared to tell the truth. Then my mom reminded him that after she cleaned up dinner, she and I had made cookies and used the microwave to heat up brown sugar so the bowl could not have been put in the night before. After my parents divorced and I moved out into my new apartment I didn't experience anything. My brothers said they still had weird things take place in the house though. My dad and brothers moved out a month ago and it was then that my dad told me that two owners previous to us had been a man who killed himself in the basement.
