Have you discovered your new gtr? A message from your 2021 GTR President Ellie Lambert Hello and Happy New Year! This is my first opportunity to communicate with you as your 2021 President of the Greater Tampa REALTORS® (GTR) and I couldn’t be more humbled and honored. We made it through one of the most difficult times in American history and here we are. Part of everyday, over the past year, I have been innovating and creating with our 2020 GTR Leadership Team, CEO Dennis MacDonald and our GTR staff, to bring to all of you, our members, a newly reimagined and re-energized professional association. Our efforts started in late 2019, as we learned about how our industry and marketplace were being changed and challenged by an amazing range of trends, forces and disruptions that would, by mid-2021, impact almost every aspect of our traditional business model. Our primary focus over the past year has been to do everything possible to ensure that all 13,000 of you, our members, will have the ability to access all of the opportunities being created by these new dynamics. I am proud to share with you that we are succeeding in our quest. We have an exciting new business plan, we are creating a menu of new and reimagined programs, products and services that will support your businesses and careers in the new market arena. Most important of all, we have created an entirely new range of member participation opportunities that will give each of you a chance to learn and interact with some of the brightest players in the Florida real estate industry. I follow in the footsteps of some great past presidents and leaders who have paved the way for us to make these changes, with an up-to-date leadership process that will help us embrace, not fear the changes and disruptions in our marketplace, because one thing we all know, nothing stays the same. My goal in 2021 is to inspire you to learn, listen, discover and engage in your new transparent, creative and collaborative GTR. You will be thrilled at what has been accomplished. Your professional aspirations and career objectives will advance to a higher level of value. CODE OF ETHICS Ascertaining Whether a Consumer is Subject to an Exclusive Representation Agreement

R

EALTOR® A was holding an open house for their client’s home, which had been on the market for several months, so REALTOR®A was thrilled to see Buyer C approach the home after two hours with no visitors. REALTOR® A gave her a tour of the space, but Buyer C indicated she was looking for more of a “fixer upper”, as she had almost singlehandedly completed some significant renovation projects in her previous homes, and was looking for the perfect next project. REALTOR® A had another listing that she knew was perfect for Buyer C, and hadn’t been listed in the MLS yet as the client had just signed their agreement earlier that morning. REALTOR® A described the home to Buyer C, and offered to show it to her. Buyer C replied, “Oh, thank you, I am actually working with someone. I should probably ask them about it.” REALTOR® A responded, “that’s fine, but to be honest, I’m not sure if your agent will even get a chance to see it. At the price at which it’s listed, I’m confident it will sell before I can even get it in the MLS.” Somewhat reluctantly, Buyer C agreed to let REALTOR® A show her the second home. REALTOR® A drafted an offer, which was accepted, and the parties completed a quick close. Proud of a job well done for her client, REALTOR® A was shocked when she received notice of an ethics complaint filed against her by REALTOR® B, alleging a violation of Article 16 for interfering with his exclusive relationship with Buyer C. At the hearing, REALTOR® B provided the hearing panel with copies of this

exclusive buyer agency agreement with Buyer C, and Buyer C testified that she did tell REALTOR® A she was working with someone, but felt pressured to tour and submit an offer with REALTOR® A or risk losing the house. REALTOR® A defended her actions, stating, “Listen, if I had known that Buyer C had an exclusive agreement with someone, I would have backed off. But she never said that she was working with someone exclusively; just that she was working with someone. It’s not my responsibility to fill in the gaps on what she told me or hammer her with questions and drive away a potential buyer just to determine what sort of relationship she has. That doesn’t serve my client well.” The Hearing Panel decided that REALTOR® A had violated Article 16, as Standard of Practice 16-9 provides, “REALTORS®, prior to entering into a representation agreement, have an affirmative obligation to make reasonable efforts to determine whether the prospect is subject to a current, valid exclusive agreement to provide the same type of real estate service.” As REALTOR® A had made no affirmative effort to ascertain whether Buyer C’s relationship with another agent was exclusive or not, the Hearing Panel concluded she had made no reasonable efforts to determine the nature of the relationship as required by Article 16.

Q: I’m a landlord, and I don’t want to rent to college students. May a landlord refuse to rent to single college students without violating the Fair Housing Act? A: Yes. College students don’t constitute a protected class under the Fair Housing Act, which prohibits discrimination based on race, color, sex, religion, disability, familial status or national origin. Familial status has been defined as a person with one or more children under the age of 18, a woman who is pregnant or a person who has custody or is gaining custody of a child under the age of 18.

Legislative Update

2021 started on a good note as the new COVID-19 Relief Package was approved in 2020. Some of the highlights of the bill included financial help to landlords who could not evict tenants during the pandemic and $600 stimulus checks for many Americans. One of the bill’s biggest victories was rental assistance. It is expected to bring much needed relief to property owners and struggling American families. Cities and counties in Florida with populations of more than 200,000 will distribute their rental-assistance money to landlords and renters (about $550M), and the state will distribute the funds in all other areas (about $850M). Please be aware that these dollar amounts are rough estimates and final allocations haven’t been released as of January 13. This allows landlords to apply for funds on behalf of tenants. The amount requested can include rent payments, plus other costs related to housing, such as utilities and similar expenses. The bill also extended the federal eviction ban through the end of January 2021 (since extended to March). For businesses, the bill provides an additional $284 billion for the Paycheck Protection Program (PPP) and creates a more simplified forgiveness process for borrowers who take part in the loan program. 2021 Federal Legislative Priorities The National Association of REALTORS® (NAR) has laid out their list of legislative priorities for 2021. In the coming months, NAR plans to advocate for tax incentives for homeownership and construction of affordable housing. It also plans to fight to preserve the 1031 like-kind exchange, which allows investors to defer capital gains taxes under specific circumstances. Most importantly, NAR plans to fight for more inclusive national housing policy. It plans on partnering with lawmakers in Washington D.C. to “secure more equitable public policy” while also promoting its own efforts to members. Those efforts include providing anti-bias training videos, fair housing simulation training and other anti-discrimination initiatives.

Officer, Shannon McGahn, the Biden Administration is proposing a $15,000 first-time homebuyer tax credit proposal that could be particularly useful for minority homebuyers and millennials who have struggled to save for a down payment while juggling student loan payments and relentless housing price growth across the country. COVID-19 Relief Bill Highlights • Rental Assistance: Provides $25 billion to the states through Sept. 30, 2022, for rental assistance and allows landlords to apply for funds on behalf of tenants. Florida is expected to receive $1.4 billion in rental assistance. A huge increase in funding compared to the $250 million allocated for rental assistance last summer. • Individual Stimulus Checks: Authorizes one-time direct, economic stimulus payments of up to $600 for individuals and up to $2,400 for families of four. The payments are less than those included in the CARES Act, which authorized amounts of $1,200 to individuals and $2,400 to couples. • Unemployment Benefits: Extends all unemployment assistance, including the Pandemic Unemployment Assistance (PUA), through April 19, 2021 with a $300 weekly boost in payments through March 14. Unemployment benefits are extended to the selfemployed including REALTORS®. • Small Business Loans: Provides an additional $284 billion for Paycheck Protection Program (PPP) loans and $20 billion for Economic Injury Disaster Loans (EIDL) grants. • Tax Credits: Provides various tax credits, including a tax credit for companies offering paid sick leave to workers during the pandemic. [Note: for GTR’s territory, the only cities that meet this population threshold is Tampa. We can presume the state will receive all other funds coming to our region and distribute them directly to counties. As of now, it is not clear how quickly cities and states will receive this funding.]

2021 Goals

New Year, new Young Professional Network (YPN)! Each January, many of us sit and reflect on what we did the previous year to develop a list of new goals that we would like to accomplish. In 2021, we will continue to change and adapt with the times to achieve them. Personally, I always use the S.M.A.R.T. method when creating goals. S - Make them SPECIFIC. M - Make them MEASURABLE. A - Make them ACHIEVABLE. R - Make them REALISTIC. T - Make them TIMELY. When you break goals down this way, you have a specific set of criteria that ensures your objectives are obtainable within a certain time frame. You can have as many goals as you like, and they don’t always have to be sales focused. You can have educational goals, financial goals, health goals, etc. After coming up with a SMART goal, there are two major things that help me. I always write them down, and I make sure that my schedule supports it. Being a visual person, I love having my goals on a poster board in my office. I see them every day I am there, and it’s a great reminder that keeps me focused.

My schedule also supports my goals. Last year, I was at a conference and my favorite session topic was on Sales Goals. The speaker said, “Your calendar will match your bank account.” That’s when it hit me because if I wanted to meet my sales goals, I needed to fill my calendar with income-generating activities. No matter what the goal is, be sure that your calendar is supporting it. This year we have many goals with YPN. A few of them are to produce 10 YPN Agent Rescue Videos by year's end and to host three REALTour events, which will give our members a glimpse of exciting new developments in the Tampa Bay area. We would love for you to get involved with YPN and join a task force to help us accomplish our many goals. Don’t forget to follow us on our social media platforms to stay up to date! PROCEDURE CEO UPDATE

Finding Your Place at the Reimagined GTR 2020 was both an unprecedented and incredibly effective year for the Greater Tampa REALTORS® (GTR) membership, leadership and staff. From the very onset of the new year, one could almost feel it in the air. After five years of constant stimulation, venture capital investment, the introduction of new brokerage business models, a fast-changing competitive environment and the growing discontent of the new real estate consumer, it was clear that something had to happen, and this was the year. It was in this environment, a mere five weeks later, that the global pandemic exploded. Over the following six months it became abundantly clear that nothing within the industry, the Tampa Bay real estate marketplace or GTR, would ever be the same again. GTR mobilized at combat speed and, all things considered, with grace and commitment to respond to the circumstances and challenges of the day. The leadership and staff immediately turned to the task of evaluating circumstances and taking swift action. Working and collaborating to identify an appropriate outside expert and begin the task of creating a strategic business plan that would provide both a path and a destination through the pandemic upheaval. By July, the plan was in place and by September implementation was progressing. Operational change, cultural transformation and member support during the times ahead became the passion and the theme of GTR’s commitment. GTR’s business plan is like none other in the country. It speaks to what is happening, it exposed the ugly truths, and laid out a clear path using strategic intents and tactics to ensure GTR and its 13,000+ members would emerge from the pandemic victorious. While the plan is driven by several priorities none is stronger than its commitment to member support and involvement. GTR, like many of its association contemporaries, had always prided itself as being member driven. However, upon closer examination it began to appear that this objective was always a bit illusive and member support came in second to internal politics. The GTR leadership and staff were obsessive about this subject and maintained a constant pressure with respect to member participation throughout the 2020 research and planning phase. Interestingly enough, research disclosed that a significant force behind GTR’s struggle to reach its previous goals of universal

member participation was the DENNIS MACDONALD traditional committee structure. Chief Executive Officer For numerous reasons, such as 813-769-7180 dennis@tamparealtors.org favoritism, inadequate meeting management, failure to respect the member’s time, too many or too few members, lack of meaningful productivity and just plain “old politics,” the classic committee format was no longer attracting long-time or new REALTOR® members. In fact, during the research leading up to the plan it was discovered that the number one reason for members failing to participate with the association almost always started with, “I was on a committee once.” I am proud and pleased to share with you the good news that in the “reimagined” GTR, the classic committee of the past has disappeared in favor of an exciting new member participation format called the taskforce. There are now six committees and over 25 taskforces. GTR members participating in taskforce groups will find themselves working on exciting and stimulating projects that will make a difference. The meetings will be managed and facilitated by individuals who are experts in their field, and the timeframe respects the busy schedules and lifestyles of working REALTORS®. In most cases a taskforce assignment can be completed in a 75 minute or less meeting. The number of times a taskforce will meet will vary depending on the nature of the task, but the time commitment necessary will always be clearly expressed upfront. Members can work on more than one taskforce during any year. Over the next few months, we will be initiating a multitude of taskforces (maximum of nine members to ensure effective collaboration) to work on several projects that are highly relevant to the contemporary industry. The Year of Comfort 2021: and Multifunctional Homes by Tamiracle Williams The coronavirus pandemic caused many homeowners and potential first-time buyers to spend a majority of 2020 inside. As a result, many have begun to reimagine their homes to match their current lifestyle. Moving into the new year, homeowners will continue to renovate and repurpose existing spaces to allow for a more functional live, work and play lifestyle. Below are four trends/ projects that interior designers believe will become mainstream trends in 2021. Dedicated Spaces Homes have evolved to become a multifunctional space. Now more than ever, people are looking to create dedicated spaces to help create a better work/ life separation. Some interior designers suggest homeowners who are looking to sell repurpose their current home layout to create dedicated spaces. For example, homeowners or sellers can transform an underthe-staircase space or existing shelfing unit into an office space. Decorative screens can also be used to create layers of privacy without taking on a full renovation project. Rich fabrics, mirrors and textured metal can all be used to break-up a space. Livable Luxury Long gone are the days of purchasing beautiful furniture that is not practical for daily use. A necessity for a multifunctional home is aesthetically pleasing, yet comfortable furniture. Livable luxury will be a key focus for this year. With the switch to more durable furnishings, many designers are moving away from the glam and modern farmhouse trends to a more relaxed vibe with natural woods and neutral base colors (i.e., ivory, beige, blush, rust etc.). Bold colors like Pantone’s 2021 Color of the Year: Illuminating (13-0647) can be used for artwork, cushions, rugs and chairs to create a focal point in a room.

Edible Gardens In 2021, designers anticipate that more homeowners will make the switch from faux plants to natural indoor plants. For many Americans, the switch began during the pandemic lockdown. Indoor plants not only bring the calm of nature into a space, but they are a wonderful way to style a shelf or tabletop. Some are even bringing this trend into the kitchen with indoor herbs and vegetables (i.e., rosemary, oregano, thyme, chives). These plants require minimal maintenance such as a source of natural light and the occasional watering. Outdoor Space Homeowners will continue to invest and transform outdoor living spaces (backyard, patios, gardens, etc.) into a year-around entertainment space. Heat lamps, fire pits and drop-down screens are simple changes that can elevate a space. Some homeowners are taking it to the next level by adding novel amenities (i.e., pizza ovens, Blackstone griddle). With the addition of lighting and comfortable furniture, outdoor spaces can become a hot spot for socially distance entertaining with family and friends. RPAC UPDATE

REALTORS® Political Action Committee: A Year In Review by Connie Johnson Have you heard the saying, "if you are in real estate, you are in politics?" No other statement has ever been more true. I believe in the last few years, more and more REALTORS® are starting to see the importance of legislative issues and decisions in our business, whether it be local, state or federal. 2020 was a difficult year for all of us, but it was also a great opportunity to demonstrate the value of being a REALTOR®. Because of our relationship with the legislators in Tallahassee and Washington D.C., we were able to show our profession is essential. That did not just happen by accident. I say this because it is important to know where the money you donate to the REALTORS® Political Action Committee (RPAC) goes. As unprecedented as 2020 was, I could never have a greater sense of accomplishment for our members. Even without having fundraising initiatives that support private property rights, we were able to raise a historical amount of dollars for RPAC —­­­ nearly $300,000. Greater Tampa REALTORS® 2020 REALTOR® Party Committee made it a priority to raise RPAC awareness and educate members on why they should contribute. In addition to establishing ourselves as essential, we made sure our legislators knew that the financing industries needed to be protected as well. These

are not things that would be possible without your contributions to RPAC to help elect real estate-friendly legislators and build these relationships. These are just two successes RPAC has helped achieve and many more that go unnoticed. With this said, I urge you to invest in your profession and preserve the American dream of homeownership. Join Us for the (Virtual) Rally in Tally! by Jacob Bruynell Generally, this time of year, Greater Tampa REALTORS® members are gearing up to board a charter bus and travel to the Florida Capitol to advocate for the real estate industry and private property rights. This event, Great American REALTOR® Days (GARD), is held annually during Florida's legislative session in Tallahassee. During GARD, REALTORS® from around the state visit the Capitol to meet with lawmakers on pending real estate legislation and discuss important issues impacting Florida's real estate industry. Although it will be virtual this year, Florida’s 2021 legislative session brings new opportunities to promote the REALTOR® profession and defend the rights of property owners throughout the state. The session is scheduled to last 60 days, during which time many different bills will be discussed, debated and voted on that could affect the REALTOR® profession. Don Earl Walden Jr. July 24, 1928 - January 18, 2021 (age 92) Don E. Walden Jr., age 92, of Plant City, Florida died January 18, 2021. He was the son of the late Don and Lucile Gallagher Walden, he is also preceded in death by his wife; Lois Walden. Survivors include children; Selinda (Ken Keller) Walden, Lee-Ann (James Knox) Walden, two grandchildren, and three great grandchildren. Don was a fifth generation Plant City native. His father, Don Walden Sr. and mother, Lucile Gallagher Walden, were both natives of Dover. He graduated from Plant City High in 1946 and enrolled in Stetson University in Deland where he earned a business degree. He entered college thinking after graduation, he would take over his father's Plant City Chevrolet dealership. But the Korean War was raging by the time he got his diploma and he volunteered for military duty, entering the Army and graduating as a second lieutenant from Army Officer Candidate. School in October 1951. His military service Included stints in Korea, and two different tours in both Vietnam and Germany. Seeking to pursue his interest in aviation, he volunteered for Army Aviation but was rejected because he exceeded the physical requirements; at 6 feet, he was too tall to serve as a pilot. Despite this, during his service, he did obtain both his private and his commercial pilot's licenses. After a 22-year career.in the Army, he retired as a lieutenant colonel. He returned home to Plant City; obtained his multi-engine pilot's license and then launched another career in commercial real estate. Over the succeeding years, (he was still working at the age of 92), he had found time to serve as president of the Plant City Kiwanis Club, Chairman of Greater Plant City Chamber of Commerce, and President of Tampa Association of REALTORS® and had served on the Citizens Advisory Committee of the Metropolitan Planning Organization of Hillsborough County. He helped create the Community Redevelopment Agency in Plant City and was a founding organizer of the Plant City State Bank (now Wells Fargo.) As a person devoted to his community, Colonel Walden supported affordable housing projects, funded nursing scholarships for Plant City High School students, and consistently donated to South Florida Baptist Hospital, the Arts Council, the Photo Archives and History Center, and more, including many organizations supporting veterans and their families. In recognition of his many service and charitable acts, he had received several recognitions over the years including the Greater Tampa Association of REALTORS® highest honor: REALTOR® of the Year, special recognition from the Metropolitan Planning Organization of Tampa and most recently Citizen of the Year 2018. A public graveside service will be held at a later date. If so desired, donations can be made to the South Florida Baptist Hospital Foundation or the favorite charity of your choice.
