BUILDING ON OUR MOMENTUM “Traveler, there is no path. The path is made by walking.” This quote by poet Antonio Machado in many ways defines our recent journey at Greater Tampa REALTORS®. Finding our way through a pandemic, a hot market and more industry disruption than many of us ever thought possible, we have emerged not just as survivors, but even stronger than before. In that spirit, and in keeping with my theme Moving Forward 2022, we will continue moving forward. For the past two years, GTR has been committed to forging a new path that would put GTR on forefront of member services and success, through the development of a new strategic plan and implementation of Year 1. As we embark on Year 2 of the three-year plan, we are well positioned to manage and even take advantage of the rapid changes in our industry. We will face challenges with confidence, including anticipated increased market competition, regulatory changes and the need to continuously embrace new technology skills. Our efforts will be focused on ensuring members have the best programs, products and services to thrive in an everchanging marketplace. We also pledge to keep you informed and up-to-date. And, of course, we want to hear from you. Not only do we want an unambiguous understanding of your needs and interests, but we also want to tap into your talent and ideas. We encourage you to consider being part of one of our new task forces, all focused on moving the Association forward. By working together to assess needs, identify risks, seek opportunity, and find solutions, we will forge a sure path to carry us well into our next century of service. CODE OF ETHICS Responsibility for Subordinates
R
EALTOR® B, a sales Associate in REALTOR® A’s office, exclusively listed a suburban house and subsequently convinced the seller to accept $60,000 less than the listed price. Several weeks after the transfer of title, the seller filed a written complaint with the Association, charging REALTOR® B with a violation of Article 4 in that REALTOR® B had sold the property to his mother without disclosing this relationship to his client, the seller, and that REALTOR® B got the price reduced for his mother’s benefit.
by REALTOR® B stating that he had carefully read and understood his personal obligation under the Code of Ethics.
The complaint was reviewed by the Grievance Committee which, with the complainant’s concurrence, named REALTOR® A as an additional respondent.
The Hearing Panel noted that REALTORS® are not presumed to be in violation of the Code of Ethics in cases where REALTORS® Associated with them are found in violation. Rather, their culpability, if any, must be determined from the facts and circumstances of the case in question. It was the conclusion of the Hearing Panel that REALTOR® A had made reasonable efforts to ensure that REALTOR® B was familiar with the Code and its obligations, and that it would have been unreasonable to expect REALTOR® A to have known the purchaser was REALTOR® B’s mother. Consequently, REALTOR® A was found not to have violated Article 4.
At the hearing, REALTOR® B stated that he saw nothing wrong in selling the property to his mother and that the seller would have accepted the contract at the reduced price, even if the buyer had not been REALTOR® B’s mother. REALTOR® A stated that REALTOR® B was an independent contractor licensed with him. REALTOR® A acknowledged that he was accountable under the Code for the actions of other REALTORS® and Associated with him but shared with the panel information on his firm’s orientation program. He noted that he required each licensee joining his firm to complete associationsponsored Code training. In addition, he required everyone in his firm to read Professionalism in Real Estate Practice, and produced a form signed
The panel found that REALTOR® B should have made his relationship to the buyer, his mother, unmistakably clear to the seller. He should have disclosed in writing that the buyer was his mother so there would have been no misunderstanding. The Hearing Panel found REALTOR® B in violation of Article 4.

Q: I'm a sales associate and I want to open a real estate corporation. May I be an officer or director of this real estate corporation? A: A brokerage must have at least one broker, and every broker licensed with a brokerage must be registered as one of its officers, directors or general partners. There is no maximum number of brokers a brokerage can have. (Section 61J25.016, Florida Administrative Code) A sales associate or a broker associate may own a brokerage. However, no sales associate or broker associate may be registered as that brokerage’s officer, director or general partner. (Section 61J2-5.016, Florida Administrative Code)
Q: May a sales associate be paid directly for conducting a broker price opinion? A: No. Section 475.42(1)(d), Florida Statutes, does not allow sales associates to collect any money in connection with a real estate brokerage transaction, whether as commission or other payment, except in the name of their employer—the broker. GTR has Your Back GTR faces another historic year, ready for its challenges With this edition of the Tampa Realtor Magazine, the Greater Tampa REALTORS® community begins its 111th year of supporting the aspirations and potentials of the region’s real estate industry and marketplace. 2021 will go down in history for a broad range of successes and notable events including its status as GTR’s second year of operating under several restricted COVID-19 related pandemic precautions and limitations. Under the leadership of 2021 President Ellie Lambert, the association achieved and set several records and accomplishments, including expanding to more than 15,000 members. Last year also was distinguished by the performance and success of GTR’s members in a historic market that will forever be known at the “Hot Market,” distinguished by the incorporation of many new procedures and protocols, as well as a record level of residential and commercial properties sales. In 2021, the association completed the first year of its three-year business plan with a new approach to member participation utilizing a contemporary structure of task forces, organizational excellence, improved governance efficiency, and a significant level of financial security. (See GTR’s Strategic Business Plan on the next page.) Further, we reorganized and streamlined our staff positions, and incorporated new member service technologies and procedures, which assisted the association in delivering hundreds of thousands of successful member service contacts last year alone.

But, perhaps most important, in 2021 GTR laid the foundation for continued improvement and success in 2022. The Tampa marketplace started off the year with news from the Zillow Group that Tampa would be the single hottest housing market in the country. GTR is proud to announce that it is fully engaged at the altitude and speed necessary to support its membership through the challenges of this amazing distinction. GTR leadership and its staff are prepared to support our association’s members as they engage the challenges created by higher levels of market competition, new competency and skill set requirements, new regulatory programs, the strain of increased litigation, the opportunities created by working with the increased expectations of a rapidly changing real estate consumer, and the realities of climate change. As we begin what promises to be year of historic progress, I want to take this moment to encourage all GTR members to participate within the new GTR Task Force program. When we gather to celebrate the achievements of 2022, this is the program which will have made the difference. There are dozens of exciting and stimulating positions for relevant member involvement as we work together to create a new post pandemic Tampa area real estate marketplace. Emerging Home Trends in 2022 What to Expect from Home Buyers this Year

by Greater Tampa REALTORS® Whether inspired by walls that closed in a bit during the pandemic, DIYers with mad renovation skills on TikTok, or simply a sense of wanting just a bit more – perhaps a lot more - people are taking their sense of cozy and convenience to luxurious new levels. And some of that might just come in shades of periwinkle.

Consumers want the best, the latest and the trendiest, even if it takes just a bit longer to arrive or install. While tile is still No. 1 when it comes to flooring, luxury vinyl plank is growing in popularity for its resilience. Homeowners who now have more time for DIY projects may opt in to take on this mission due to its affordability and ease of installation. For both interior and exterior walls, unfinished brick is a forerunner element. Due to its timeless and imperfect appeal, unfinished brick is versatile in complementing

This year is about going green – both through color and sustainability! While bold and popping colors are making a revival, other shades such as Laurel Leaf by Better Homes & Garden, and similar muted tones including khaki greens, are another favorite request. Many home buyers are attracted to the return to nature, inspiring concentration and relaxation, radiated from these hues. Further, the switch from gas to electric stoves, installation of long-
lasting metal and solar power roofs, to energy efficient light fixtures, are top desire for customers who seek more environmental-friendly living requirements.
Home Theater, Yoga & Gym and Breakout Rooms
With increased amounts of time spent in the home quarantining, homeschooling and working, it only makes sense that families also want space to exercise, for entertainment and even a little “me” time. Being able to step away without having to leave home for focused work, entertainment and physical and mental health purposes, is all the craze.
Enjoying the Great Outdoors
As people seek to be outdoors more for both leisure and health, many buyers want large yards. Elevated balconies are also gaining popularity. Screened in patios, outdoor kitchens, built-in pizza ovens, fire pits and porch swings are top wants for these evolved spaces.
Maximalism
While the focus has been on minimalism, beginning with the recession of 2008, this trend is swiftly fading as the economy has improved over the last several years. With maximalism, more is more! With increased disposable income, consumers have had more opportunity to collect objects of interest from rare collectibles, bold art pieces, traveling souvenirs along with other kitschy and eclectic accessories. Featuring these diverse pieces together is a refreshed art form, stated through maximalism. This look mixes and matches, colors, patterns, and textures, using a combination of metals, woods, rugs and furnishings for an over-the-top aesthetic.
Mid-Century Modern and Contemporary Chic Architecture
Whether a nod to nostalgia or clean lines, mid-century modern architectural details, and home furnishings, remain a fan favorite. Warm, versatile and sophisticated, contemporary chic is a close second for its modern renditions of classic design. To further accomplish this look, buyers are looking toward antique hunting and secondhand furniture shopping. As supply chain disturbances have caused shipping delays and increased raw material prices, many consumers are seeking traditionally inspired vintage furniture pieces, adding a touch of unique character to any room. Items that are weathered and aged are key for capturing this special ambiance. The pandemic has helped us view home with new eyes. As these trends show, today’s dream home blends form and function, greeting us aesthetically and practically. We want to surround ourselves with both style and comfort, which makes 2022 even more inviting.

It is that time of year when REALTORS® from around Florida are preparing to travel to the state capitol to advocate for your profession and Florida property owners. This event, Great American REALTOR® Days (GARD), is held annually to provide our members the opportunity to meet with lawmakers on pending legislation and discuss important issues impacting Florida’s real estate industry. The 2022 Great American REALTOR® Days is set for February 7 - 9.

REALTORS® are there to make sure our elected leaders have the right information before voting on legislation that could hurt your bottom line, threaten the growth of your business or make it harder for Floridians to buy their dream homes or sell their properties. • • •
Is something in a real estate transaction complicating the process unnecessarily? Are escalating insurance premiums driving away buyers? Does the water quality in your area impact your sales?
These are just a few examples of the issues lawmakers might consider each year during the annual legislative session. Our advocacy has seen the passage of landmark legislation over the years, and REALTORS® across Florida continue to advise the legislature on how proposed legislation will affect property owners. The 2022 legislative session will last 60 days, during which time many different bills will be discussed, debated and voted on. Some legislative issues being monitored and garnering REALTOR® support during the 2022 Legislative Session include: •
Hometown Hero Housing Program (HHHP): Support HHHP to increase affordable housing opportunities for Florida’s front-line and emergency workers. Continue to support funding for the State Housing Initiatives Partnership (SHIP) and State Apartment Incentive Loan programs (SAIL), serving low-income Floridians.

Rising Property Insurance Costs: Support sensible legislation that balances the need for property insurance relief with measures that ensure Florida's insurance industry remains healthy and competitive Water Quality and Environmental Funding: • Support state funding to help preserve our natural resources and water quality projects. • Support legislation and funding that addresses the escalating problem of sea level rise, such as the Resilient Florida Grant Program. • Support legislation and funding efforts to reduce the negative impact of blue-green algae on Florida's coastlines, including the wastewater grant program. • Monitor legislation regarding septic tanks to balance property rights and water quality improvements. Private Property Rights: Support legislation that allows homeowners to rent their properties free from overburdening local short-term rental ordinances. Support legislation that creates a statewide, uniform system of regulations for vacation rentals. Business Rent Tax: Continue to advocate for further reductions to this tax to ensure Florida businesses not only have additional resources to recover from the pandemic but can grow and better support their communities. Condominium Reforms: Advocate for greater transparency in the management of community associations to ensure their residents and visitors are safe.

Habitat for Humanity Home Dedication 2022 Greater Tampa REALTORS® President Ruth Bryson and President-Elect Jay Quigley joined in a holiday celebration as Habitat for Humanity Hillsborough officially dedicated the new home of the Wheeler family. GTR sponsored the construction of two Habitat homes this year and GTR volunteers aided with the construction. The second home will be dedicated on February 4.

Welcome to 2022 - The new Normal 2022 will be about creating opportunities 2021 was a crazy year for business and we all felt the impact. COVID-19 prevented so many face-to-face opportunities, so we all had to create new ways to market and network in a virtual world. Zoom meetings became the norm. Companies learned quickly what parts of their work could be done remotely to protect the health of their employees. What will 2022 bring? I’d like to share my goals for 2022 as the Affiliate Director. First and always will be safety and COVID-19 compliance. Hopefully, as more people become immunized and the variants continue to weaken, some opportunities to meet face-to-face will be available. Everything we do should be with safety of all members as priority. My second goal is representing all the Affiliates at the board meetings and providing input. We have a lot of knowledge and experience that can be of value. As business owners, we have experience in looking ahead and planning for the future. I look forward to sitting on the board meetings and helping GTR stay relevant and strong. My third goal is to create opportunities for affiliates to share their brands. We are Affiliates because REALTORS® are a great referral partner for our businesses. It is
