Q: I’m negotiating the terms of a listing, and the seller asked that I get a flat-fee commission, as opposed to a commission based on percentage of sales price. Assuming my broker approves the amount and structure of the commission the brokerage firm will receive, is this acceptable?

Q: A landlord’s rental property is in a military town. The landlord has had a string of bad experiences renting to military personnel, so she wanted to know if it would be OK to just not rent to anyone in the military going forward. Is this permissible?

hearing, REALTOR® B outlined his complaint and told the Hearing Panel that at no time during the inspection of the property, or during the negotiations which followed, did REALTOR® A disclose any defect in the roof. REALTOR® B acknowledged that he had walked around the property and had looked at the roof. He had commented to REALTOR® A that the roof looked reasonably good, and REALTOR® A had made no comment. The roofing contractor REALTOR® B had employed after the leak occurred told him that there was a basic defect in the way the shingles were laid in the cap of the roof and in the manner in which the metal flashing on the roof had been installed. It was the roofing contractor’s opinion that the home’s former occupant could not have been unaware of the defective roof or the leakage that would occur during hard REALTOR®rains.A told the panel that he was participating only to prove that he was not subject to the Code of Ethics while acting as a principal as compared with his acts as an agent on behalf of others. He pointed out that he owned the property and was a principal, and that REALTOR® B had purchased the property for himself as a principal. The panel concluded that the facts showed clearly that REALTOR® A, the seller, did have knowledge that the roof was defective, and had not disclosed it to REALTOR® B, the buyer. Even though a REALTOR® is the owner of a property, when he undertakes to sell that property he accepts the same obligation to properly represent its condition to members of the public, including REALTOR® who are purchasers in their own name, as he would have if he were acting as the agent of a seller. The panel concluded that REALTOR® A was in violation of Articles 1 and 2 of the Code.

REALTOR® B had a roofing contractor inspect the roof. The roofing contractor advised REALTOR® B that the roof was defective and advised that only a new roof would prevent future water damage.

A: No. Section 83.67(3), Florida Statutes makes it illegal to discriminate against servicemembers in how property is offered for rent, or in the terms of a lease offered to a servicemember. If landlords or property managers violate this law, they could face stiff penalties.

I was in Germany, our mission was to protect the border between the East and the West. The Soviet Union was the enemy. A lot of what finally broke the Soviet Union was cable TV. The citizens could only be lied to so much when technology started feeding them more and more information. This was really the start of our world shrinking and this global economy that we live in now. Advancements in technology, travel, and most importantly, communications have given us access to market the world. We can literally speak into our phones with any question and get an immediate answer. Once a seemingly large world, now everyone is our neighbor. My kids would play video games in their rooms after homework. I could hear them talking to other players from all over the world. We have the same global reach in business. We all complain about our phones “listening” to us. If I speak to my wife about our daughter's upcoming wedding, I get advertisements about weddings. If my wife searches for BBQ grills online, I get Facebook advertisements for grills. We can also take advantage of the same technology as small businesses. The world wants to come to Florida. It is a great place to work, retire, vacation and make investments. We can directly market our Florida services to anyone in the world affordably. My business has Google ads that only run on devices that have researched specific keywords. I have commercials that run on TVs in homes that have only talked about our research of certain keywords. This allows me to target the world at little cost. I now have clients investing in Florida from Europe, the Middle East, South America and Canada. Technology makes the global market work smoothly and efficiently. A global market gives us all more customers and provides great opportunities. I really hope you all have taken advantage of the shrinking world and embrace all the changes that are coming down the road.

One of my first assignments in the Army was in Germany. I really had no clue what I was about to experience. This was before cell phones, the internet and home computers. We didn’t even have cable TVs. My introduction to the culture and expectations came from library research and a mandatory Army class. I learned over the assignment that Europe was amazing and was able to visit so many great places and see so much history. I just didn’t have the foresight going into it. I bought my first computer in Germany, the Commodore 64, which I later upgraded to the Commodore 128. 128 megabytes, who needed that much space? Still no internet, so it was basically a gaming computer for one player. Fast forward to my first deployment to the middle east after 911. Most people had cell phones, but they were truly just phones. I was in Kuwait when I saw my first cell phone with a camera on it. I thought it was a stupid idea and people didn’t need cameras on a phone. I guess I never did have much foresight. I never imagined that phones would become minicomputers. My cell phone is a thousand times more capable than that first Commodore When64.
