Commitment to Fair Housing Principles A message from your 2021 GTR President Ellie Lambert In April of 1968, President Lyndon B. Johnson signed into law the Civil Rights Act of 1968, thereinafter almost universally referred to as the Fair Housing Act. The keystone of the Johnson administration was a package of legislative actions known around the world as the “Great Society.” The Fair Housing Bill was one of the last major pieces of the Great Society legislation to be passed by Congress. Initially rejected twice by Congress, its passage was ultimately credited, to a great extent, to the death of Martin Luther King, Jr. Upon signing the act into law, President Johnson remarked that few in the country “believed that fair housing would, in our time, become the unchallenged law of this land.' President Johnson’s comments turned out to be an accurate prophecy. Over the past 53 years across the country and in the Tampa Bay area itself education, monitoring and enforcement regarding the Fair Housing Act has involved and engaged the passions, energies and resources of innumerable dedicated individuals and organizations all of whom believe strongly in the values and ethics espoused by the Fair Housing Act. The Tampa Bay Realtors (now known as Greater Tampa REALTORS® or GTR) are proud to be counted among the most active
of these groups. Through its leadership, communications, professional standards and professional development programs GTR has followed through on its commitments to the principles of fair housing. As evidenced by its activities during the most recent Black History Month, GTR’s efforts with respect to Fair Housing remain vital and relevant in 2021. Moving forward, the entire Tampa Bay community, including its REALTORS®, must recommit to ensuring that Fair Housing is indeed “the unchallenged law” of our land and our community.

CODE OF ETHICS Honest Treatment of All Parties
A
s the exclusive agent of Client A, REALTOR® B offered Client A’s house for sale, advertising it as being located near a bus stop. Prospect C, who explained that his daily schedule made it necessary for him to have a house near the bus stop, was shown Client A’s property, liked it, and made a deposit. Two days later, REALTOR® B read a notice that the bus line running near Client A’s house was being discontinued. He informed Prospect C of this, and Prospect C responded that he was no longer interested in Client A’s house since the availability of bus transportation was essential to him. REALTOR® B informed Client A and recommended that Prospect C’s deposit be returned. Client A reluctantly complied with REALTOR® B’s recommendation, but then complained to the Board of REALTORS® that REALTOR® B had not faithfully protected and promoted his interests; that after Prospect C had expressed his willingness to buy, REALTOR® B should not have made a disclosure that killed the sale since the point actually was not of major importance. The new bus route, he showed, would put a stop within six blocks of the property. In a hearing before a Hearing Panel of the Board’s Professional Standards Committee, REALTOR® B explained that in advertising Client A’s property, the fact that a bus stop was less than a block from the property had been prominently featured. He also made the point that Prospect C, in consulting with him, had emphasized that Prospect C’s physical disability necessitated a home near a bus stop.
Thus, in his judgment, the change in bus routing materially changed the characteristics of the property in the eyes of the prospective buyer, and he felt under his obligation to give honest treatment to all parties in the transaction, that he should inform Prospect C, and that in so doing he was not violating his obligation to his client. The Hearing Panel concluded that REALTOR® B had not violated Article 1, but had acted properly under both the spirit and the letter of the Code of Ethics. The panel noted that the decision to refund Prospect C’s deposit was made by the seller, Client A, even though the listing broker, REALTOR® B, had suggested that it was only fair due to the change in circumstances.

Q: I'm a real estate licensee with a listing. I've been contacted by a sales associate who has a buyer interested in making an offer on my seller's property. However, I've discovered that this sales associate's license is inactive, and that this person is not currently working for a broker. May I still pay the cooperating agent a commission? A: No. Section 475.25(1)(h), Florida Statutes, provides that a real estate licensee may not share commission with a person not properly licensed as a broker, broker-associate or sales associate. Further, since the cooperating agent's license is inactive, he or she is in violation of Section 475.42(1)(a), Florida Statutes, which is a felony of the third degree. If the agent's license is inactive, the agent may not receive compensation.

Applying the Fair Housing Act
I remember studying to become a REALTOR® and learning about the Fair Housing Act (FHA). Little did I realize at the time of how crucial and important it is in my day-to-day operations, as I am sure it is for many of you as well. The Fair Housing Act was created to protect individuals from discrimination when they are engaged in activities to attain a home. This usually includes renting or purchasing a home, obtaining a mortgage, seeking housing assistance and a few others. This Act primarily protects against discrimination based on race, color, national origin, religion, sex, family status, and/or disability. As agents, it's our job to get to know our clients. This is usually done through casual conversations. It's through these "get to know you" conversations where there could be a risk of violating the Fair Housing Act. Without even knowing it, we may unintentionally violate the Act by the asking of, answering to, or inferring demographic-related information. There are many other pitfalls we should all be aware of to protect ourselves and to protect the brand of our profession. Some helpful tips or reminders to help navigate through the Do's and Don'ts of the Fair Housing Act are listed below: •

Review Advertising: Be aware of the descriptions and words that you use. Refrain from making statements like “Perfect for families” and “A safe area” or

exclusionary words like “No” and “Only." Don't Send Love Letters: Although a nice gesture/ tactic, sending letters to the sellers from your buyers could possibly violate fair housing regulations depending on what is written. Never Assume: The property listings you share with your clients should align with their search criteria. Going rogue on what you assume they need could also lead to an unintentional violation. Don’t Steer: Agents may believe they are helping, however guiding a client to a neighborhood due to their race or financial profile could be construed as discriminatory and direct violation of the Fair Housing Act.
As we’ve seen over the years, discrimination happens to individuals and families in various life events. People have suffered from discrimination through different social injustices such as financial limitations, educational opportunities, equal rights in our society and unfortunately within the home buying/renting process. The creation of the FHA is to ensure everyone is treated regardless of race, color, national origin, religion, sex, family status and/or disability. REFAA HOSTS BLACK HERITAGE MONTH EVENT Overcoming the Past to Celebrate the Future
Under the banner of the Real Estate for All Alliance (REFAA), the diversity partnership between Greater Tampa REALTORS® (GTR) and the six real estate specialty groups in the Tampa Bay area, is proud to have hosted its inaugural black history month event, Overcoming the Past to Celebrate the Future. The insightful conversation was hosted in partnership with the National Association of Real Estate Brokers Tampa chapter (the Bay Area Association of Realtist or NAREB) and sponsored by GTE Financial. 2021 GTR President Ellie Lambert welcomed the viewers and was encouraged by their support. She took time to introduce each REFAA partner and stated “We look forward to hosting more of these enlightening conversations with our other REFAA partners to help us learn and grow as individuals and become even more successful as REALTORS®” as a result. The moderator for the session was 2021 President-elect Ruth Bryson. Bryson has achieved many milestones throughout her life, as a veteran Army lieutenant colonel, and as a REALTOR® leader. The most recent achievement for Bryson in the real estate industry is becoming GTR’s first African American female presidentelect. Bryson welcomed the viewers to the forum and explained that the conversation will “explore the challenges that have plagued fair housing & homebuyer

equity,” and how they will “learn about the gains, setbacks, solutions and resources to help us move forward.” Bryson introduced the local NAREB President Travis Brooks as the guest speaker. Brooks, a native Floridian, has been a REALTOR® since 2005. He was an inaugural member of USF football team in 1996, but with injuries cutting his football career short, his education contributed to the eventual development of his company, the Realty Brooks Team. Well-traveled and a sought-out speaker among the lending institutions on the topic of diversity, fair housing and equity and providing strategies for companies to develop policies to truly improve lending practices for all, Travis “strives to constantly educate himself on the ever-changing real estate market to ensure he is able to deliver the most accurate and up to date information to his clients and agents.” Brooks provided a history about NAREB and pointed out that the organization had its humble beginnings in Tampa, Florida in 1964. He noted that NAREB is the oldest African American trade association in the country and their motto is “democracy in housing,” and their mission is to be an advocate for the minority real estate professional and consumers. NAREB members refer to themselves as “Realtist” since African Americans real estate agents were not permitted to join the National Association of REALTORS®.
In bringing understanding of the racial divide related to home ownership, Brooks stated that while the New Deal1 of 1933 was effective in establishing the thirtyyear mortgage and fixed low interest rates, 98% of those loans went to white Americans within a five-year period of the program. He spoke of the nuances about red lining whereby in the 1930s “maps drawn by the federal Home Owners Loan Corporation (HOLC) colorcoded neighborhoods in 239 cities in the 1930s.”2 Travis outlined how the color green was the designated color for “best,” blue for “still desirable,” yellow for “declining,” and red for “high risk and uninsurable.” Lenders used these maps to deny mortgages to entire neighborhoods, considered them a credit risk and subjected them to stricter mortgage terms based on their racial and ethnic backgrounds.” It was not until 1968, the Fair Housing Act was passed and outlawed redlining and housing discrimination, but Brooks stated, “by that time, we had already suffered 30 plus years of racial inequality, housing disparity and housing discrimination.” Brooks asserts that it is a known fact homeownership is a pathway to wealth, and because of the inability to purchase homes and land, it comes as “no surprise for the wealth-gap” that exists today. Bryson asked Brooks to elaborate on the Black homeownership rate which she researched and found it was 47% in 2021. Brooks elaborated that the third quarter of 2020 is when the 47% was reached, but due to the pandemic all racial groups experienced a drop in home ownership, but the Black community dropped to 44% in the fourth quarter, according to the US Census. However, he goes on to say that the U.S. is still dealing with the same issues today as when the Fair Housing Laws were passed in 1968 when Black homeownership was at 42%. Ownership peaked at 49% in 2004 during the big housing boom, which included subprime and predatory lending that targeted many African Americans seeking home mortgages. “When we went through the housing crisis of 2008, we suffered the most…, because we had more of the bad mortgage products than any other group, which is the reason it is taking us longer to recover,” Brooks said. In discussing resolutions to improve the condition, Brooks stated that because policies were intentionally put in place to create the disparities, it must be intentional in resolving the dilemma. He recommended viewers visit NAREB.com to read the State of Housing in Black America Report3 (SHIBA), which identifies several points of intentional policy measures to help improve
the disparity in housing. In addition to proposing revamping and enforcing the Community Reinvestment Act (CRA) and reduction of the mortgage insurance on the Federal Housing Administration (FHA) loans, Brooks said that increasing diversity in real estate and mortgage lending industries are also among the needed strategies outlined in the SHIBA Report. In concluding the conversation, Ruth Bryson advised all REALTORS®, who seek better understanding on “what not to do” when it comes to discrimination, to watch the Newsday expose’, Long Island Divided, which was a three-year investigation that “uncovered widespread evidence of unequal treatment by real estate agents on Long Island.” After watching the video, Bryson also encouraged members to act on NAR President Charlie Oppler’s call to action4 to take the Fair Housing Challenge to Stand Up for Racial Equity. The Fairhaven Fair Housing5 challenge was issued to REALTOR® leaders of committees, liaisons, RVPS, executives and board members. “When one group is not doing well, it holds the rest of us back…, we as REALTORS® are the gate keepers. We need to make sure that there is diversity and equity in housing; in everything for all,” Ruth Bryson commented. Insight from the 2020 Affiliate of the year Greetings! This year I am honored to serve all the Affiliates at Greater Tampa REALTORS® (GTR), as the Affiliate Director. Being an Affiliate brings great reward and longlasting relationships. There are so many benefits to being a member of such a great organization! Instead of hearing from me about all the benefits this year, you will hear it from other affiliate members. To kick us off is the 2020 Affiliate of the Year, Char Knetsch, with Brown & Associates Law & Title, P.A. and I sat down, virtually, for an interview. It was such a joy to speak with her and gain her insight and experience! Char has been a member of GTR for 25 Years! WOW! She began as a REALTOR®, and remained one when she made the switch to title. Here’s how the interview went: Tammy: Many Affiliates join thinking they will receive a return immediately. What advice do you have for them? Char: Yes. In my tenure with GTR, there have been times when I have thought, “What am I getting?” One of the challenges is that many REALTORS® are already loyal to relationships they have built over the years. Yet, I have discovered that not everyone can be everything. Each of us have our own unique niches we bring to the table. That is what they should focus on, and it is ok to be another choice for the REALTORS®.
