PRESIDENT’S CORNER

2021 Year End Presidential Insight It is that time of the year again when the chief elected officers of REALTOR® organizations across the country look at the past 12 months and ask themselves, what was accomplished, where did the time go and how is our organization better than it was the year before? My initial response, which I suspect reflects that of many of my peers, was to ask how did the year pass so quickly? Did I accomplish everything on my list? Is Greater Tampa REALTORS® a better organization as a result of my presidency, and are we ready to meet the challenges of 2022? By any measure, 2021 for GTR was a year of innovation, experimentation, and achievement. As our member brokerages, agent teams and agents themselves struggled to adapt to the pandemic and historic market conditions, we were thankful that GTR could offer support, data and analysis, and practical solutions.

The COVID-19 pandemic affected every aspect of our industry and marketplace. GTR quickly shifted its energies and efforts to ensure programs and services remained relevant, and it helped manage the effects the pandemic had on members, their business and careers.

Every GTR member brokerage and agent today is in a very different configuration on a new future course. Further, 2022 promises to be yet another unique experience and your GTR organization already is preparing to meet those challenges and exciting opportunities.

Every member of the GTR leadership and staff spent significant time and energy working with members and helping them understand the forces, trends, and disruptions affecting their industry and marketplace. Frustration levels grew when ordinary efforts to move forward encountered these forces, and yet GTR adapted.

The entire GTR community learned a lot about themselves, their market and their consumers in 2021. They were challenged by not one but three distinct forces that might have toppled a lessor group. But GTR persevered, adapted and overcame. I am looking forward to 2022 and the leadership of President-Elect Ruth Bryson who brings to the GTR podium what I believe to be the perfect combination of leadership knowledge, skills and experience. Ride on Ruth we are all behind you.

I want to extend my appreciation to the entire GTR staff who learned to co-exist and collaborate in a remote environment. They did an extraordinary job. GTR CEO Dennis MacDonald is the right person in the right place. The GTR leadership team is proud of Dennis and the GTR staff’s efforts. The GTR leadership team also rose to the occasion. Implementing our new business plan midst pandemic, resulted in closer working relationships among our directors. We had level-up our knowledge and create a more focused approach to the unique challenges the pandemic presented. This more seasoned leadership team is now fully prepared to exceed the challenges of 2022. It was a privilege and an honor to work with them over the past year. The now famous “hot” market also made the year unique. Our members faced situations, circumstances and client demands never before encountered. By all accounts it appears GTR members handled the characteristics of the “hot” market with flair and professionalism. We can all be proud to be associated with 15,000 committed and motivated real estate professionals. Our year, and industry, was further challenged by a third force: the organic transitions caused by massive venture

The lessons learned by GTR were wonderfully articulated by the following language from a Pew Research Center study released earlier this year. When pandemics sweep through societies, they upend critical structures, such as health systems and medical treatments, economic life, socioeconomic class structures and race relations, fundamental institutional arrangements, communities and everyday family life. This indeed is what happened in our Tampa Bay marketplace. Oh, and about those questions I posed at the beginning. I think we had a great year and I believe that your GTR is fully prepared to assist its members to succeed and prosper moving forward. But it did take a village.

CODE OF ETHICS Knowing or Reckless False Statements About Competitors

EALTOR® A operated a residential brokerage firm in a highly competitive market area. He frequently used information from the MLS as the basis for comparative ads and to keep close track of his listing and sales activity as well as his competition. One day, while reviewing MLS data and comparing it to a competitor’s ad, REALTOR® A noticed that REALTOR® Z had used a diagram to demonstrate his market share, contrasting it with those of several other firms. The ad showed that REALTOR® A had listed 10% of the properties in the MLS over the past three months. REALTOR® A thought this was low. His analysis of MLS data showed his market share was 11%. REALTOR® A filed an ethics complaint against REALTOR® Z citing Article 15 of the Code of Ethics in that REALTOR® Z’s “obviously understated market share claim” was a “misleading statement about other real estate professionals.” REALTOR® A’s complaint was considered by the Grievance Committee which determined that an ethics hearing should be held. At the hearing, REALTOR® Z testified he had always been truthful in his advertising and that all claims were based in fact. He produced an affidavit from the MLS administrator which indicated that a programming error had resulted in miscalculations and, after careful recomputation, REALTOR® A’s market share over the past three months had been 10.9%. The administrator’s statement noted

that this was the first time that information related to REALTOR® A’s listings or sales had been misstated on the system. “I relied on information from the MLS. It’s always been accurate and I had no reason to even suspect it was wrong last month,” said REALTOR® Z in his defense. The Hearing Panel agreed with REALTOR® Z’s logic, noting that a REALTOR® should be able to rely on generally accurate information from reliable sources. They reasoned that if, on the other hand, the MLS had shown REALTOR® A having, for example, 1% of the market, then REALTOR® Z’s reliance on the information would have been “reckless” because REALTOR® A had generally had a 10 –15% market share and a reasonable conclusion would have been that the information from the MLS was seriously flawed. The Hearing Panel concluded that REALTOR® Z’s comparison with other real estate professionals, while slightly inaccurate, was based on usually accurate and reliable information and had been made in good faith and while technically “misleading,” had not been “knowing” or “reckless”. REALTOR® Z was found not to have violated Article 15.

Q: My seller dropped a bomb on me yesterday. She was adamant – she does not want my friend and colleague from another brokerage to show her property. I know this agent. He’s an honest, upstanding guy, and it grieves me to treat Fred this way. What can I do? A: This is not an uncommon predicament, and Article 3 of the Code of Ethics is on the seller’s side. The obligation under Article 3 says, Realtors® shall cooperate with other brokers except when cooperation is not in the client’s best interest. And in this case, your seller is telling you it’s not in her best interest to cooperate with this brokerage based on past dealings.

Q: May a sales associate be paid directly for conducting a broker price opinion? A: No. Section 475.42(1)(d), Florida Statutes, does not allow sales associates to collect any money in connection with a real estate brokerage transaction, whether as commission or other payment, except in the name of their employer—the broker. BPOs fall within the defi nition of real estate brokerage activity— "appraising" property—as per Section 475.01, Florida Statutes. tamparealtors.org

As 2021 comes to an end, I want to thank you for allowing me to be your YPN Ambassador. This year has been eventful, and we have encountered many changes in our market and the way we do business. We have continued to push forward through it all, and I have been able to witness many YPN Members have a record-breaking year! Some of our members have started their own brokerages this year, won top agent awards and even been featured on HGTV. I cannot explain how grateful I am to be a part of the Greater Tampa REALTORS® Young Professional Network. I have grown personally, professionally and made some incredible connections. As this is my last article as your Ambassador, I want to leave you with some valuable end-of-the-year tips that will benefit you and your business for years to come. Get right with Uncle Sam. Start reviewing your expenses for the year and ensure that everything is organized correctly in your accounting software. Consult with your CPA; there may be some additional business deductions you can take to offset your tax liability. Start Planning. Business planning is essential for success in the world of real estate. Write everything you want to accomplish and how you will do it on paper now, so on January 1st, you can hit the ground running. Focus on Your Follow Up. Reach out to your past customers and check-in. A simple holiday card is perfect

for following up and reminding them you are still in the business. They may be in the market or know someone who is thinking of buying or selling. Again, I want to say thank you. FLOOD INSURANCE

New Flood Insurance Ratings Consider Risk Factors of Individual Properties Federal Emergency Management Agency (FEMA) Risk Rating by Greater Tampa REALTORS® Home buyers already are experiencing changes in the National Flood Insurance Protection (NFIP) program’s new rating methodology that went into effect for new policies on October 1, 2021. Understanding the changes can help agents expertly guide clients purchasing properties in or near Florida flood zones. The NFIP rating methodology had gone unchanged since the 1970s and previously did not consider individual flood risk and underlying home values. Since then, technology, access to data and even basic understanding of flood risk have improved, allowing homeowners to access rates that are easier to understand and more accurately reflect a property’s unique flood risk. The new ratings will go into effect for existing policy renewals on April 1, 2022. Austin Perez, Senior Policy Representative for the National Association of REALTORS®, worked with the Federal Emergency Management Agency, which administers NFIP, to help develop the new rating methodology. This work also was supported by the

REALTOR® Political Action Committee (RPAC). Perez said previously NFIP rates were determined using a system created 50 years ago incorporating only two pieces of information: base flood elevation and Special Flood Hazard Area. Under that system, neighbors could have vastly different rates depending on where a creek or river flowed. “The problem, of course, is that water doesn’t respect flood zones,” Perez said. So low-risk homes can be charged the same as high-risk homes and vice versa. Further, the old method didn’t consider homes that had multiple claims because of ongoing flood risk.


The outcome was that many homeowners paid more than their share of the risk, while others paid much less. FEAM Risk Rating 2.0, called “transformational” by the agency, bases rates on individual properties and their unique risk. Insurance is priced by incorporating common sense variables (e.g., more types of flood risk and distance to flooding source) into the rating methodology. It pairs state-of-the-art industry technology with the NFIP’s mapping data to establish a new risk-informed rating plan. Cyndee Haydon, NAR Insurance Committee Vice Chair, said the result should be a more equitable application of rates and, for many homeowners in lower risk situations, a reduction in rates. “At the end of the day, as a REALTOR®,” Haydon said, “we wanted something equitable and affordable. We want people to be able to plan.” Moving forward, she said, buyers: • Will know a home’s actuarial rate • Can make better long-term decisions • Will have a firmer idea of cost of future flood insurance • Can assume seller’s NFIP Policy In other words, Hayden said, a buyer can make a better educated decision and is less likely to face heartbreaking decisions about having to a sell home that has become unaffordable or wonder whether they can retire in that home due to unanticipated insurance cost increases.

Risk Rating 2.0 in summary: • The maximum rate is now $12,125 a year (a 73% decrease) • 23% of policy holders will see an immediate decrease; most will pay the same • Buyers can get quotes immediately without waiting for the Elevation Certificate, although the certificates could still present savings for some homeowners. • Fewer policyholders will see big increases • Lower value homes don’t subsidize high value homes • All policies (even X zone) get property specific rates and mitigation discounts, including Community Rating System (CRS) discounts • Buyers can shop the private market and make a choice.

What’s not changing: • Resident and commercial policy coverage • Buyers can still assume/transfer the sellers’ policy and buyers won’t face a big jump in rates in Day 1. • The statutorily protected 18 to 25% cap on annual increases • Using Flood Insurance Rate Maps (FIRMS) for mandatory purchase and floodplain management. In other words, homeowners still must have flood insurance if they are in a Special Flood Hazard Area and have a federally backed mortgage • CRS discounts of 5 to 45%

There are robust topics that address everything from technology to working with buyer and seller types. For those newly licensed and looking to jump start their careers, a good start is the Graduate REALTOR® Institute, or as commonly referred to as the GRI, designation. The materials developed in this sevenmodule designation are thoughtfully designed to help sharpen skills and reinforce the fundamentals of a solid real estate business. There also is the added benefit of post licensing education credits. Pricing Strategy Advisor: The PSA Certification course is currently the most popular course being taken. Its performance is directly related to the changing market and being able to discuss valuation and pricing matters with your clients. e-PRO Certification: This course focuses on popular technology tools, tricks and trends including the ever important need to secure your data and your client’s personal information. At Home with Diversity (AHWD) provides a better understanding of Fair Housing laws but also strengthens REALTORS® understanding of working with multi-cultural clients. Since the Tampa Bay market also is affected by secondhome and international clients, the Resort and SecondHome Property Specialist (RSPS) Certification course or become a Certified International Property Specialist (CIPS) designee provide helpful support in working with these specialized clients. As we navigate from the pandemic, the real estate world continued to bring unprecedented events. Appraisers became overbooked, home inspectors schedules were bursting at the seams, insurance industry saw a change, purchase offers were still competing to be the one selected, and lenders ramped up to keep pace with the volume. Many had to realign resources to keep in pace with volume. There was not one dull moment. As I take a moment to reflect back on the previous articles submitted from our affiliate peers, and the advice given, there is one theme, one message, one word, that repeated itself – RELATIONSHIP. It’s harvest time in Plant City, and the smell of fresh strawberries hangs in the air thick as jam, sweet enough to taste. Just flick your tongue in the breeze and see. The plump red berries are what most people imagine when they think of Plant City, and while strawberries are indeed king in the World’s Strawberry Capital, there’s something else in the air these days: the scent of success wafting through the rural community. After years of just “being there” east of Tampa and mostly unnoticed, save for the week of the Strawberry Festival, it seems homebuyers have all suddenly taken notice of Plant City, which appears to be enjoying its moment. Seems these days, just as the plump, red berries are picked in the Plant City fields, homebuyers more and more are picking Plant City. Wayne Wiggins, owner-broker of Plant City Realty, Inc., understands. He’s generation number five in Plant City, and he’s been wondering when people would finally get it—when they would figure out there’s a lot more to Plant City than just its famous fruit. “Builders have finally discovered us,” said Wiggins, who concentrates his real estate business there. He notes that new housing is booming, more is coming and the supply of pre-owned homes is low due to high demand— something driven by more working families choosing the town ideally situated midway between Tampa and Orlando

work centers. Add the ease of commuting in either direction to value pricing, an abundance of country charm, and an old-fashioned, small-town feel, and the rush to Plant City is more than understandable, said Wiggins. “As I like to say, we’re having our 15 minutes,” he said. Wiggins’ Plant City ancestors go way back (some slung muskets in the Civil War). A town street bears his family name. It’s changed over the years, but Wiggins said despite the surge in growth, no one need worry that development will spoil Plant City. Its leagues of guardian residents and founding families are smart, the city’s leadership and planners are just as sharp, and wise enough to control growth using good ol’ “common sense.” New people coming sometimes may have a tendency to try and make their new hometown into the one they came from, Wiggins lamented, but Plant City leaders—its movers and shakers—have a “way of tempering that,” and they jealously protect Plant City’s wholesome, country character, Wiggins said. The new chapter in Plant City began when improving the city’s parks, streets and revitalization efforts downtown began to “get traction,” he said. When

the nation’s largest builders began to show up, things began to really roll. Companies like DR Horton and Pulte Homes are building in the city, and Plant City has annexed parts of Hillsborough County to accommodate some of that building. Seems the builders like Plant City as much as the families buying their new homes, something Wiggins attributes to the fact that the city works so well with developers. Plant City officials are “friendly,” is the best way Wiggins said he can put it, at least compared to Hillsborough County. By friendly he doesn’t mean easy and willing to give away the store. He means easyreasonable—easy, practical and realistic. The planning and building process is “less cumbersome; they use common sense and decisions are made based on what is a good idea,” said Wiggins. Plant City’s new homes are now known as some of the best values going. Young families can get into new 3/2 Plant City homes for around $200,000, Wiggins said. If you’ve got $300,000 to spend, count on that home being a “really nice one.” At the low end of the pre-owned market, an older family home that needs some fixing might come in below

$150,0000. A large mobile home on enough land for livestock can be had for $150,000 to $200,000. The problem is demand exceeds supply, Wiggins said. Still, prices remain stable and comparatively attractive. He does advise having financing in order, as considering a deal too long could mean watching it get scooped up by a better prepared buyer. The pre-owned market is a diverse mix of historic woodframe farmhouses and small bungalows, to large, two-story executive and manor homes on acreage that push $1 million. For those who imagine Plant City is poor farm country, think again, Wiggins said. “Plant City is not a poor town,” he said. “There’s a lot of old money and new money” and many homes are valued between $500,000 and $1 million. Be it a mobile home or a mini mansion, what one can’t put a price on is the smalltown feeling Plant City exudes, said Melissa Poage, an agent with Signature Realty who grew up there. It’s grown over the years, but retains its smalltown charm, she said, something rare these days. “It’s still America’s small town,” she said of Plant City. “It’s community-minded, family oriented; it’s just that it’s grown.” Many who grew up in Plant City leave for careers only to return years later, she said, adding it’s the kind of place with the power to call one back. home“It’s comforting, towny, yet it’s close to everything,” she noted, referring to the easy drive into neighboring Tampa. Many who live there commute to work in Tampa, St. Petersburg or Orlando, she said. It’s a safe place, kid friendly, the schools are good and it has the wide-open country spaces that are a sure cure for urban claustrophobia. People know each other, and it’s
