A few thoughtful steps are all it takes to put safety first A message from your 2021 GTR President Ellie Lambert While REALTORS® like to keep our focus on our clients and the great services we provide, we know safety must come first. As we mark the National Association of REALTORS® annual Safety Month, we are reminded that 38 percent of the nation’s 1.3 million agents have felt unsafe at some point in their real estate careers. That’s more than half a million. Undoubtedly, many of you are represented in that statistic. REALTORS®, by nature of the job, have easily accessible contact information and often place themselves in vulnerable situations. Fortunately, there are many things you can do help ensure your safety. To start, create a safety strategy for when you are at the office, with clients and even at home. Having a plan that you, your team and even your family follow will make safety second nature. Further, get help from technology. There are many new tools, including a number of smartphone apps that provide an extra layer of protection through: • • • •

Alarm systems that operate by silent panic button via cell phone, Personal emergency transmitters that send a personalized message and your GPS location to up to 30 contacts and updates your location every 30 feet, Verification of your prospect’s identity and potential risks, And even 24/7 personal monitoring by a team of professionals.

The app also features a preset system that calls for help, even if an agent can’t access the phone. You set the time you expect your showing to take – the app automatically selects 45 minutes - and adds emergency contacts. If you don’t respond in the time limit, your contacts are notified. I have found a product called InvisaWear to be the perfect complement to my safety plan. This attractive charm looks like jewelry but hides a panic button that can set up to alert family and friends, text a link to your location and even, with an ADT subscription, get 911 assistance. It’s another tool that doesn’t require you to be holding a phone. Even beyond the safety necessary for real estate interactions, please also remember that the COVID-19 virus is still a concerning part of our day-to-day lives. Retaining those simple precautions that are now part of our routine will go a long way to help. Taking steps to protect your safety is worth the cost of a little extra time and effort. If you do ever experience a situation that makes you feel unsafe, don’t hesitate to call for help. Intentional Misrepresentation of a Competitor’s Business Practices

F

ollowing a round of golf early one morning, Homeowner A approached REALTOR® X. “We’ve outgrown our home and I want to list it with you,” said Homeowner A. “I’m sorry,” said REALTOR® X, “but I represent buyers exclusively.” “Then how about REALTOR® Z?,” asked Homeowner A, “I’ve heard good things about him.” “I don’t know if I would do that,” said REALTOR® X, “while he does represent sellers, he doesn’t cooperate with other brokers and, as a result, sellers don’t get strong offers for their properties.” Later that day, Homeowner A repeated REALTOR® X’s remarks to his wife who happened to be a close friend of REALTOR® Z’s wife. Within hours, REALTOR® Z had been made aware of REALTOR® X’s remarks to Homeowner A earlier in the day. REALTOR® Z filed a complaint against REALTOR® X charging him with making false and misleading statements. REALTOR® Z’s complaint was considered by the Grievance Committee, which determined that an ethics hearing should be held. At the hearing REALTOR® Z stated, “I have no idea what REALTOR® X was thinking about when he made his comments to Homeowner A. I always cooperate with other REALTORS®.” REALTOR® X replied, “That’s not so. Last year you had a listing in the MLS and I spent months working with the buyers that submitted a purchase offer. You didn’t pay me the offer of compensation, though; you paid another broker who stole my clients from me at the last minute, and all he did was submit the purchase offer.” REALTOR® Z countered REALTOR® X’s statements, indicating he had made

a blanket offer of compensation in the MLS, and that his refusal to pay REALTOR® X had nothing to do with him not cooperating with other brokers, but the fact that there was a procuring cause dispute at the end of the transaction. Upon questioning by panel members, REALTOR® X admitted he had no personal knowledge of any instance in which REALTOR® Z had refused to cooperate with any other broker, but assumed that his failure to pay the compensation REALTOR® X felt he had earned was likely how REALTOR® Z treated other brokers. The Hearing Panel, in its deliberations, noted that cooperation and compensation are not synonymous. In fact, Standard of Practice 3-10 provided that the duty to cooperate established in Article 3 relates to the obligation to share information on listed property, and to make property available to other brokers for showing to prospective purchasers/tenants when it is in the best interests of sellers/landlords. In that respect, the Hearing Panel felt REALTOR® Z had, in fact, cooperated with REALTOR® X. However, to characterize REALTOR® Z’s refusal to pay requested compensation because of a genuine commission dispute as a “refusal to cooperate”, and to make the assumption and subsequent statement that REALTOR® Z “did not cooperate with other brokers”, was false, misleading, and not based on factual information. Consequently, REALTOR® X was found in violation of Article 15.

Q: I received a fine for not updating my listing status in a timely manner, even though I closed it out in the same month. So why did I receive a fine? It shouldn’t even matter. A: Although it may not matter to you, as a participant or subscriber in the MLS, it should matter – and it’s important to your fellow REALTORS®. My best advice would be to contact your MLS or review your local MLS rules and regulations. Each MLS has specific rules regarding timeframes when listing updates are required.

Q: What specific types of speech does this new Standard of Practice 10-5 prohibit? What are NAR’s categories of protected classes? A: Standard of Practice 10-5 provides that “REALTORS® must not use harassing speech, hate speech, epithets, or slurs based on race, color, religion, sex, handicap, familial status, national origin, sexual orientation or gender identity.”

Keeping You Safe

September is officially REALTOR® Safety month, but safety is something we must practice year-round to ensure we make it home to our families. According to the National Association of Realtors, 38% of members report they’ve been in a situation where they feared for their safety. When I first got into the industry, my Broker preached about REALTOR® safety at every Monday morning meeting. It wasn’t until I had my first incident, I started taking it more seriously. One Saturday morning, I showed a property and someone started knocking on the door and jiggling the handle. Instead of opening the door, I went to the window and noticed a guy at the front. He asked to be let in as soon as he saw me because the owner sent him to fix the AC. There were many red flags I noticed right away. He did not have a uniform on, there was no vehicle out front and the AC seemed to be working fine. He finally left after I refused to let him in the home and got on the phone to call the agent. One of my most important rules, “always lock the door once you are inside” potentially kept us safe. I am not sure what the guy's intentions were, but I did not want to find out.

Below I have a few safety tips that I follow to keep me safe on the job. 1. Stranger Danger. When you have a new client, meet them at your office to get a copy of their driver's license. 2. Glock it. Register to get your concealed weapons permit and purchase a handgun. 3. App It. Download a safety app such as SafeShowings (free for members through Florida REALTORS®) to contact your emergency contact in case of an emergency. 4. Suns Out. If possible, do not show homes at night. 5. Partner Up. Do not host an open house alone. Ask someone from your office or a preferred lender to join you. There is no such thing as being “too safe", so we must practice safety each day. Always trust your instincts and if you ever feel uncomfortable in a situation, get out! Best Safety Practices Every REALTOR® Should Know Information REALTORS® Need to Stay Safe on the Job by Jennifer Lalji Each year, September recognizes REALTOR® Safety Month by observing ways to improve the day-to-day risks agents face and allowing them to return safely to their own homes, each night. In 2020 alone, nearly 58,000 or 4% of members were victims to various violent crimes ranging from assault, sexual abuse, rape, robbery and murder, according to the National Association of REALTORS® (NAR). These staggering numbers prove why REALTOR® safety should in fact be recognized not just annually, but every day.

Safety Affects Everyone

It’s a common misconception that many of the attacks and offences committed against REALTORS® and real estate agents are unplanned, opportunistic, random, only focused on targeting female agents. Unfortunately, these heinous crimes, in actuality, are calculated, predatory and directly affect male workers in more violent and deadly incidents. Male agents account for 30% of all attacks made because males more often do not anticipate that a crime will be committed against them, placing them at an astonishing higher risk of violent crimes. By continuing the conversation that all

REALTORS® are affected, we can work together to improve the safety culture, across the industry.

Defending Yourself

When planning to meet with a prospect for the first time, consider meeting in a public place and always take premeditative measures such as checking in with family, coworker or a friend to help safeguard against a potentially dangerous encounter. While countless REALTORS® invest heavily into personal defense training and courses, personal strength may not always guide agents to safety. Continual practice of techniques can help keep you prepared, but often flight over fight may be the better option in most violent scenarios. Nearly half of REALTOR® members choose to carry self-defense weapons. Although this may be beneficial for some, if the user isn't trained properly or hasn't practiced, they could be placing themselves or others in harm's way when placed in a high stress defensive position. Staying up to date with state laws and training courses can help lead users to a higher level of confidence.


When Your Prospect is a Predator

Out of 1.45 million members, NAR has also found that roughly 5% of REALTORS® have reported being a victim of a crime while working as a real estate professional and 23% of REALTORS® have experienced an encounter that made them fear for their personal safety or safety of their personal information. One of the biggest tools of defense a member can carry, is their own gut instinct! By learning how to meticulously identify predatory behavior, and not discount one’s own intuition, can help lead agents to safer experiences and make all the difference in an agent’s daily encounter with strangers. So the question is, how can you identify if your prospect is a predator? Research conducted by The University of Texas, breaks down the difference between predator and thief motives. A thief’s motive is solely for profit, without an inserting emotional component to the crime. The thieves’ objective is to isolate in order to steal from the home, whereas a predator’s motive is about obtaining control and power. An emotional component is indeed a part of this type of crime and the actions that lead up to the offence. The predator’s objective is to not only isolate, but also to attack. Understanding what attracts a thief (valuables) and a predator (weakness/vulnerability), can help agents make conscious decisions in their day-to-day actions by using “smart marketing.” Smart marketing can range from the type of personal information you release about yourself online such as social media, down to the details included on your professional website, such as the neighborhood where you live, the school and or church your family attends and other areas you frequent or gather. This information puts your and, possibly your family, at risk of a potential attack. Additional marketing to consider is your headshot, which is how you will be identified. From tiniest details including what type of jewelry and clothing is worn down to the gaze, smile and position of your face in your headshot can make all the difference in if you are targeted by a criminal. Questions to consider: Is your jewelry over the top or more understated? Is your facial expression more authoritative or personal? A recommended tip is to take the steps to evaluate if your headshot can easily by misconstrued and if it conveys messages of extravagant wealth/vulnerability, taking a look at the examples mentioned above.

Trust Yourself - Best Practice Tactic

While it may be challenging to detect a thief or predator out the gate, there are powerful measures that all real estate professionals can take to help guide them to safer practices. By simply staying alert and using “active listening,” agents can focus on asking clients open-ended questions to help gain trust and determine possible red flags. Active listening involves asking your basic “W” questions, who, what, when, where and why type inquiries, seeking out inconsistencies to otherwise “easy” answers. By focusing on the client’s Q&A given in this conversation style, agents can negate motives, helping them to reveal any dishonesty or stumble across irregularities or mistakes in responses. We recommend that all REALTORS ® continuously think about safety — and ways they can not only protect themselves, but also guide other professionals as well. Nominations are open for the Greater Tampa REALTORS® annual awards, which will be presented at our annual Awards Banquet. Do you know someone who is deserving of an award? AWARDS CATEGORIES REALTOR® of the Year This award is Greater Tampa REALTORS® highest honor and goes a member with at least 10 years of service to GTR and who exemplifies what it means to be a REALTOR®. They are active in the Association, the community and contribute generously of their time and talent. They volunteer because they know one person can make a difference. They are committed to excellence in their profession and service in their clubs, churches and communities. They are ongoing examples of the professionalism exemplified by the Code of Ethics to which they subscribe. This person is known to be honorable and respected throughout the real estate community. REALTOR® Spirit This award goes to a member who demonstrates a commitment to laws and regulations of the Association and the National Association of REALTORS® Code of Ethics and is dedicated to furthering principles of good real estate practice among other real estate brokers, the media and the general public. The winner also will have a demonstrated commitment in one or more of the following:

Distinguished Service Award (Vernon E. Taylor Award) Established in 2018 and named in honor of the late Vernon E. Taylor, 2010 President of the Association, this award goes to the member with a sterling reputation among his or her peers and who has a minimum of 15 years of exemplary service to Greater Tampa REALTORS®. This REALTOR® has been a mentor to others, invests passionately and continually in RPAC, steps up when asked and has ethics above reproach. This person has served on or chaired committees and has dedicated their time, talent and energies for the betterment of our Association and its members. This award is someone all REALTORS® are proud to point out and say yes, that person deserves The Distinguished Service award. (Former recipients of Meritorious Service are not eligible.) Outstanding Leadership Award (Edward T. Starr Award) Established in 1961 and named in honor of the late Edward T. Starr, 1959 President of the Association, this award is given to the Committee or Task Force Chair who exhibits outstanding leadership to the committee or task force for the current year. It defines the Chair’s leadership style to include time spent, efforts made, who benefited and why and any other specific details. Newcomer of the Year Award This award honors a deserving REALTOR® with two years or less tenure in the real estate profession. You must indicate whether your nominated candidate practices

real estate as a full- time profession (to the best of your knowledge) and the number of hours per week (on average) your nominated candidate works in the real estate profession. Criteria should include but is not limited to: • Tenure as a REALTOR® (two years or less) • Ethical practices • Participation in Association activities (Examples include service on task forces, attending Great American REALTOR® Days and/or state conventions, investing in RPAC, writing an article for GTR’s magazine, attending GTR functions, working toward NAR designations, etc.) • Active in community affairs (For example: service on committees and any volunteer work) REALTOR® Community Service Award (C. Ed Owings Award) Established in 1964 and named in honor of the late C. Ed Owings, 1961 President of the Association, this award is given to a REALTOR® who has performed outstanding service to the community for a minimum of three years. Find your balance. Get involved. Greetings to my affiliate peers! This year seems to be moving along at warp speed! As Affiliate Director this year, I have had the esteemed honor to interview several other affiliate members and provide their insight. As we move through 2021, I’d be remiss if I let the year go by and did not interview my own team: Ailleen Rodriguez, Chanda Nelson, Gulianna Mesropyan and Shannon Corinti. I asked each of them questions about being a member of GTR, and here’s what they had to say. Me: Ailleen, what is the best thing you find about being a member of Greater Tampa REALTORS®? Ailleen: Being a member of GTR allows me to present to the REALTORS® and share how I can partner alongside of them to become successful. Being a member of GTR also gives me opportunity to learn. Anytime you sponsor a class you will learn something from it. Whether or not you are a REALTOR®, lender or whatever your trade is. There is always something new to learn. This is an ever-changing industry, and we should stay abreast of the changes. GTR gives us that opportunity. Me: Chanda, during COVID, how have you been able to maintain your relationships and membership with GTR? And, what would you say to a new affiliate member that wanted to wait until COVID was over?

Me: Gulianna, what has been the most beneficial aspect of being a member of GTR, and how has participation helped you? Gulianna: I belong to serval organizations, and GTR makes it easy to participate with several networking opportunities. As an affiliate member, you can sponsor a class, an even and/or join a committee. This gives you the exposure that you need and the bandwidth to reach a broad audience. The staff at GTR is very helpful and knowledgeable. All of the REALTORS® I work with at GTR are amazing and we have a true partnership. Me: Shannon, as an affiliate member of GTR, if someone was thinking of joining but unsure, what advice would you give them? Shannon: Anyone that would ask me whether to join or not I would tell them not to wait. The decision to join is the best one you will make. You will not regret it. Also, you have to work your membership. Be active and participate. It is so much more than getting your name in a directory. It is building lasting relationships for years to come.

Chanda: GTR made the transition from in-person to virtual so easy. While social distancing, I am still able to stay visible and personally connect with other REALTORS®/ brokers. I would absolutely encourage you not to wait until after COVID is over; becoming an affiliate member is such a valuable investment. GTR is a great resource

It’s harvest time in Plant City, and the smell of fresh strawberries hangs in the air thick as jam, sweet enough to taste. Just flick your tongue in the breeze and see. The plump red berries are what most people imagine when they think of Plant City, and while strawberries are indeed king in the World’s Strawberry Capital, there’s something else in the air these days: the scent of success wafting through the rural community. After years of just “being there” east of Tampa and mostly unnoticed, save for the week of the Strawberry Festival, it seems homebuyers have all suddenly taken notice of Plant City, which appears to be enjoying its moment. Seems these days, just as the plump, red berries are picked in the Plant City fields, homebuyers more and more are picking Plant City. Wayne Wiggins, owner-broker of Plant City Realty, Inc., understands. He’s generation number five in Plant City, and he’s been wondering when people would finally get it—when they would figure out there’s a lot more to Plant City than just its famous fruit. “Builders have finally discovered us,” said Wiggins, who concentrates his real estate business there. He notes that new housing is booming, more is coming and the supply of pre-owned homes is low due to high demand— something driven by more working families choosing the town ideally situated midway between Tampa and Orlando

Add the ease of commuting in either direction to value pricing, an abundance of country charm, and an old-fashioned, small-town feel, and the rush to Plant City is more than understandable, said Wiggins. “As I like to say, we’re having our 15 minutes,” he said. Wiggins’ Plant City ancestors go way back (some slung muskets in the Civil War). A town street bears his family name. It’s changed over the years, but Wiggins said despite the surge in growth, no one need worry that development will spoil Plant City. Its leagues of guardian residents and founding families are smart, the city’s leadership and planners are just as sharp, and wise enough to control growth using good ol’ “common sense.” New people coming sometimes may have a tendency to try and make their new hometown into the one they came from, Wiggins lamented, but Plant City leaders—its movers and shakers—have a “way of tempering that,” and they jealously protect Plant City’s wholesome, country character, Wiggins said. The new chapter in Plant City began when improving the city’s parks, streets and revitalization efforts downtown began to “get traction,” he said. When

the nation’s largest builders began to show up, things began to really roll. Companies like DR Horton and Pulte Homes are building in the city, and Plant City has annexed parts of Hillsborough County to accommodate some of that building. Seems the builders like Plant City as much as the families buying their new homes, something Wiggins attributes to the fact that the city works so well with developers. Plant City’s new homes are now known as some of the best values going. Young families can get into new 3/2 Plant City homes for around $200,000, Wiggins said. If you’ve got $300,000 to spend, count on that home being a “really nice one.” At the low end of the pre-owned market, an older family home that needs some fixing might come in below

$150,0000. A large mobile home on enough land for livestock can be had for $150,000 to $200,000. The problem is demand exceeds supply, Wiggins said. Still, prices remain stable and comparatively attractive. He does advise having financing in order, as considering a deal too long could mean watching it get scooped up by a better prepared buyer. The pre-owned market is a diverse mix of historic woodframe farmhouses and small bungalows, to large, two-story executive and manor homes on acreage that push $1 million. For those who imagine Plant City is poor farm country, think again, Wiggins said. “Plant City is not a poor town,” he said. “There’s a lot of old money and new money” and many homes are valued between $500,000 and $1 million. Be it a mobile home or a mini mansion, what one can’t put a price on is the smalltown feeling Plant City exudes, said Melissa Poage, an agent with Signature Realty who grew up there. It’s grown over the years, but retains its smalltown charm, she said, something rare these days. “It’s still America’s small town,” she said of Plant City. “It’s community-minded, family oriented; it’s just that it’s grown.” Many who grew up in Plant City leave for careers only to return years later, she said, adding it’s the kind of place with the power to call one back. home“It’s comforting, towny, yet it’s close to everything,” she noted, referring to the easy drive into neighboring Tampa. Many who live there commute to work in Tampa, St. Petersburg or Orlando, she said.
