Local home builders are putting the finishing touches on 340 homes that will be open to the public during the 53rd annual Spring Parade of Homes, April 25 through May 10. The Parade is Kansas City’s go-to event for home buyers looking for the latest in design and decorating, energy saving features, green building techniques and the great feeling that comes from being the first owner of a house. The homes on this spring’s parade offer the buying public a range of housing choices. The 111 builders represented on this year’s parade are offering homes priced from the $180,000 range to well over one million dollars, with the average selling price at $450,000. The homes are located in twenty-four different school districts in Kansas

The KCHBA Participates in “Bringing Housing Home” 2015 Legislative Conference KCHBA members met with Congressman Emanuel Cleaver (Missouri’s 5th District) and Congresswoman Lynn Jenkins (Kansas’ 2nd District) during NAHB’s Bringing Housing Home™ 2015 Legislative Conference. Congressman Cleaver is now the Ranking Democratic Member of the House Subcommittee on Housing and Insurance, giving him an important seat at the table on every housing issue in the U.S. House of Representatives. Members spoke with Congressman Cleaver about a wide range of issues affecting the industry but stressed the importance of addressing President Obama’s floodplain Executive Order and the U.S. Army Corps of Engineers/Environmental Protection Agency’s redefinition of “waters of the U.S.” Members provided the Con-

KCHBA Members Advocate for Housing in Jefferson City On February 25, KCHBA members conducted 17 face-to-face meetings with Missouri State Senators and Representatives during the 2015 Missouri Legislative Day in Jefferson City. KCHBA members spoke with lawmakers about the state of the home building industry in the greater Kansas City area and urged them to oppose any new laws or regulations on builders, developers and associate members at a time when the housing industry is still getting back on its feet. KCHBA members continued to build relationships with lawmakers who represent districts where they live and/or build homes.

Greater Kansas City Home Show Draws Crowd to Bartle Hall Chip and Joanna Gaines are hugely popular in Kansas City and their fans crowded into Bartle Hall to hear the Gaines’ story first hand. A standing-room only audience at all four presentations enjoyed this fun and personable couple share their experiences in home remodeling and in developing one of HGTV’s highest rated shows. The nearly 250 vendors benefited from the overflow crowd as they shopped booths including everything one could need in a home. Area landscapers brought spring into Bartle Hall with flowers, trees, water features and more. And Chris Ragland (Homes by Chris) supervised the construction of the “Scout Shack” for visitors to tour and see the latest in construction materials and beautiful finishes, accessorized with Scout memorabilia. Thank you to everyone who made this show one of our best ever!

JOCO Wastewater Seeking to Separate Floor Drains from Sump Pumps

HBA Remembers William Schweitzer and Jim Goodwin The passing of two long-time HBA associates, one national and one local, points out that participation in the association dedicated to home building can be more than just one more membership dues check to be written each year. NAHB leaders past and present are mourning the loss of William Schweitzer, who passed away suddenly on March 3. Mr. Schweitzer, who lived in Alexandria, Va., served admirably as the association’s outside counsel for 30 years and was instrumental in the launch of NAHB’s political action committee, BUILD-PAC, for which he also served as counsel. NAHB Chairman Tom Woods will fondly remember Mr. Schweitzer’s uncanny knowledge of baseball. “He knew about everything from players’ batting averages to the dynamics of the game. He loved the game,” he said. “But he also loved NAHB, and he worked hard for us. He had a brilliant legal mind, great institutional NAHB_AmericanDream_HalfPage.pdf

knowledge and always was such an excellent strategic thinker. He had NAHB’s best interests at heart in every situation I ever engaged with him.” Jim Goodwin, founder of Complete Home Concepts, passed away on February 27. Complete Home Concepts was established in 1977 and joined the HBA soon after in May of 1978. Jim led the KCHBA Associates Council and was also involved with the Associates Council at the NAHB level. Jim’s obituary mentioned both of these items, indicating just how important the association was to him and his family. Many long-time members of the HBA will miss this kind-hearted man.

KCHBA Members have met twice with John O’Neil, General Manager, and Susan Pekarek, Chief Engineer, with Johnson County Wastewater to discuss Wastewater’s efforts to prohibit builders from placing a floor drain near a sump pump, a common practice for builders to protect consumer’s property, but a method that Wastewater believes is prohibited under its regulations. Wastewater acknowledges that the overwhelming

The Kansas Legislature recently passed Senate Bill 21, which cleans up legislation that passed last year governing commercial vehicle weight and securement. Should Governor Sam Brownback sign the legislation into law, which he is expected to do, private motor carriers operating between 10,001 and 26,000 pounds will be required to perform annual vehicle inspections and follow federal load securement and trailer coupling regulations, but will not be subject to the remainder of federal requirements when

they are operating intrastate. The Kansas Building Industry Association, of which the KCHBA is a member, worked to ensure passage of this legislation. The Kansas Corporation Commission (KCC) has posted several resources on its website to help the community understand the new requirements. Worker Classification Under Scrutiny

The U.S. Department of Labor (DOL) has recently granted $10.2 million to 19 states to implement or improve worker misclassification programs. These programs are designed to help states identify instances where employers improperly classify employees as independent contractors or fail to report the wages paid to workers at all. The grants also help states conduct audits and oth-

er enforcement actions. This is the first time that the DOL has issued these types of grants and there was an additional $10 million approved for 2015. In addition to the grants, the U.S. DOL has entered into Memorandums of Understanding (MOUs) with certain states to share data and enable/facilitate enforcement of worker misclassification. The right of control, whether or not exercised, is the most important factor in determining the relationship. An employer-employee relationship exists when an employer has the right to exercise control over the manner and means by which the individual performs services. Missouri Employers — Know the Test Missouri applies the twentyfactor test originally developed by the Internal Revenue Service to determine whether workers are employees or independent contractors. The twenty factors do not serve as a bright-line rule to be applied without flexibility, but are used as guides in determining the nature of the employment relationship. The focus of the inquiry is the degree to which the employer has the right to control the manner and means of a worker’s performance. For a list of the factors with an explanation of each, go to the Missouri website www.labor.mo.gov and search for “twenty factor test”. are about 20 agreements between the U.S. DOL and state DOLs. Some states are “double whammy states” – they have a MOU with the U.S. DOL and received a grant (e.g., Texas, so it’s not just blue states). Missouri is a MOU state. KCHBA staff participated in a conference call with NAHB lobbyists and David Crump, head of legal research, to discuss this issue. NAHB is working to defund the U.S. DOL grants arguing that there is no information or criteria on how the grants are distributed - no metrics. They are also encouraging local HBAs to meet with the state DOL to find out more information. What can you do to protect your business from a DOL audit? First, review the tests used by Kansas and Missouri to determine whether a worker is an employee or an independent contractor. Second, compare your procedures and policies to the listed factors and, third, make any necessary corrections to your personnel classifications. As always, professional legal and tax advice is recommended in this process.

Text messages are also read more quickly than emails—90 seconds versus two hours. So, if you want to grab someone’s attention right away, texting seems to be the way to go. So how does texting fit into the new home sales process? The answer is: carefully. Texting is easy to do, but in the sales world, professionals must understand how to use this medium properly. You can’t text too soon, too often, or with TMI (too much information) — or you’ll risk hurting the relationship before it’s fully developed.

A sales optimization study conducted by Leads360º reported that the conversion rate improves by more than 100% when texting is used correctly. Prospects that received text messages from their sales professional converted 40% more often than those who received none. The study also showed that being too quick to text a prospect dramatically decreases the likelihood of making contact with that lead. Consider texting a privilege, not a right. Ask permission. When you’re chatting with your prospect, ask if you can text your contact information. Many will say yes, but how they say yes will reveal their comfort level. Even then, keep your texts professional, brief and to the point. It’s a nudge, not a conversation. “I usually find a way to ask if I can text a prospect that calls me,” said Andy Gottesman, an Internet sales associate at M/I Homes. “Asking, ‘Can I text you 22

the address of the model home?’ opens the door and then I try to find other reasons to engage. It’s much more casual than email and it builds trust at a much quicker rate.” You can use text to confirm an appointment, acknowledge receipt of or ask for information, report progress on an application, offer updates, and other such brief, but effective messages. If the customer has sent you a message (by text, phone or email) and you are unavailable at the moment, send a brief text acknowledging receipt and let them know you will get back with a reply as soon as you are back at the office. If you know your clients are comfortable with texting, make sure to send them photos of the construction process, videos, updates, and follow up to make sure they’ve received important documents. Residential Permits Hold Steady Through Winter Months Residential building permit numbers increased from the January 2015 total and also from the same month one year ago, according to the Home Builders Association of Greater Kansas City’s (HBA) monthly Residential Building Permit Statistics report. There were 260 single family permits issued and 102 multi-family units permitted during February. The year-to-date total of 495 single family permits is just slightly under the 503 permits issued during the first two months of 2014. Comparing 2015 and 2014 year-to-date totals, Cass, Clay, Johnson and Leavenworth counties have shown increases while the remaining counties in the area (Jackson, Platte, Wyandotte and Miami) have decreased. Year to date Johnson County leads the area with 186 single family units, followed by Clay County with 111, Jackson County with 92, and Platte County with 40. “As we get into 2015 we are hearing more about business expansion and new residents re-locating to the KC area and that is fueling optimism for spring new home sales,” said Executive Vice President Sara Corless. Kansas City remains the top permitting jurisdiction with 106 units in 2015 followed by Olathe at 74, Overland Park at 65, and Lee’s Summit and Blue Springs both with 32. The top ten permitting jurisdictions are rounded out with Lenexa, Parkville, Independence, Shawnee and Platte County. In a wrap up of 2014 statistics, the HBA identified the list of top permitting homebuilders in the metropolitan area. Summit Custom Homes tops the permit list with 226, followed by Rodrock Homes with 145, James Engle Custom Homes and Sallee Homes both with 124 and PC Homes at 94.
