Parade will Jump Start Spring Buying Season The Home Builders Association of Greater Kansas City will showcase more than 380 residences constructed by 112 of its member builders on the Spring Parade of Homes, April 22 through May 7. The association is thrilled to have so many beautiful, brand new homes on display for the public to tour and to represent an industry that contributes more than $1.5 billion to the Kansas City economy and supports more than 20,000 jobs in the Greater Kansas City metropolitan area. In addition, the HBA is excited to partner with Harvesters during the 2017 Spring Parade of Homes. This year marks the 55th anniversary of the Spring Parade in Kansas City and to commemorate the occasion the association is aiming to raise 55,000 meals for area kids this summer. From April 14 until the end of the Spring Parade the HBA will accept non-perishable food items at the HBA office, as well as virtually through the website, kcparadeofhomes.com. Kansas City home buyers will have the opportunity to view new homes and
neighborhoods across a spectrum of price, style and location including more than 35 homes in maintenance-provided communities as well as several townhomes and villas. The homes are located across the Kansas City metropolitan area and range in price from approximately
$165,000 to more than $1.6 million. Contest winners will be announced at the Spring Awards Celebration on April 26. The celebration will be held at The Grand Hall in the Power & Light building.

Missouri Legislative Update The Missouri State Legislature recently returned from its annual Spring Break to continue working on high priority legislation before the end of session. In the last week before the break, Speaker Richardson said that many promises made at the start of session have been delivered, including the House approving a ban on gifts from lobbyists. Richardson mentioned several other legislative priorities, saying, “we began work on improving Missouri’s economic climate with a range of labor reforms, including making Missouri the 28th right-to-work state and sending a clear signal across the country that Missouri is open for business.”

With a month remaining in the legislative session, there is much discussion regarding education reform, the FY 2018 budget, tort reform, and tax rates. Of interest to the Kansas City area is a resolution that will authorize the issuance of $48 million in public bonds for a new UMKC Conservatory located in downtown Kansas City.

The HBA of Missouri (HBAM) continues to monitor legislation relevant to the home building industry under the leadership of KCHBA member Gary Kerns, who is serving as President of HBAM for the 2017-2018 term. SB 240 – Electrical Contractors – creates a statewide license for electrical contractors. Per its 2017 Legislative Agenda, the HBA opposes efforts to establish statewide licenses for trades within the home building industry. SB 216/HB425 – Roofer Registration – allows roofing contractors to pay an application fee, provide proof of insurance, and register with the state. Both the HBA of Missouri and KCHBA oppose this legislation.

SB 398/HB 1096 – HOA Legislation – establishes detailed regulations for the creation and management of Homeowners Associations. It would severely impact a developer’s ability to make decisions while a planned development is still actively being sold. It would also hold builders and developers financially responsible years after he or she is out of the development. Both the HBA of Missouri and KCHBA oppose this legislation. HB 869 – Licensing Legislation – prohibits municipalities from requiring any certificates, licenses, or degrees from construction industry employees beyond workers’ comp and general liability insurance – thus eliminating local contractor licensing. This legislation is personally motivated and unlikely to progress through the legislature. It is opposed by the HBA of Missouri. HB 93 – Workforce Development – provides financial assistance to small business for job training through the Missouri Works Training Program. It is sponsored by local Rep. Jeanie Lauer (Blue Springs) and has passed the House and received a committee hearing in the Senate. Senator Jay Wasson (R-20) also has legislation modifying the Missouri Works Training Program by creating tax incentives for creating jobs in areas of distress. Workforce Development legislation is supported by the HBA of Missouri and KCHBA. HB 563 – First-Time Homebuyer Saving Account – establishes an individual income tax deduction for 50% of the contributions to a savings account dedicated to buying a first home. It would function similar to a 529 college savings plan but is not expected to pass this year. It is supported by the HBA of Missouri and KCHBA. Continued on page 17

Can You Still Build a Home Under $300k in Johnson County? The first Kansas Area Council of 2017 took place on March 22 at Brookridge Golf & Fitness. The luncheon featured a panel of speakers addressing home-building issues such as inventory concerns and rising material costs. Moderated by HBA President Harold Phelps of Phelps Engineering, panelists included realtor Kevin Tubbesing of The Land Source; planner Dan Whitney of LandMarketing; and builder Shawn Woods of Ashlar Homes, LLC.

When asked about inventory, Whitney noted the $550,000-$650,000 range has high inventory in Johnson County where the average cost for a house in the Blue Valley School District is $623,000. But otherwise inventory levels are rather low — particularly for customers looking for a home costing $300,000 or less.
Homes in this area cost around $200,000 to $250,000 currently, according to Whitney.

When asked for their housing predictions, Whitney said there is pent-up demand particularly from Millennials who have been renting longer than intended due to the long recovery cycle. Tubbesing said labor limits and population growth will impact the industry. “I think we will see contractors internalize laborers as employees.” are the three biggest factors that will raise home prices moving forward, according to Woods.

Kansas Legislative Update The 2017 Kansas legislative session reached its first adjournment on April 7. The legislature has passed a comprehensive rescission bill that will eliminate the state’s budget shortfall for the current fiscal year ending in June, an amount predicted at about $280 million. The measure borrows money from KPERS and internal idle funds managed by the Pooled Money Investment Board. The legislature returns on May 1 to finish up their work, which includes passing a balanced budget for FY 2018-2019. The legislature must also draft a new school funding formula by the end of June, due to the Supreme Court’s ruling that Kansas’ current block grant system for school funding is unconstitutional. Tax policy is still up in the air. Numerous proposals have been considered, including plans to move state individual income tax from the two-bracket system

to a three-bracket system, a flat tax system with one-bracket, and a variety of different tax rates. There is also an effort to generate sales tax on internet sales by out-of-state merchants. Many in the legislature would like to see a reduction in sales tax on food going forward as well.
Property Appraisal Bill: HB 2367 would roll back some appraisal reforms enacted in recent years. Specifically, it would remove the prohibitions against County Appraisers requesting/using private appraisals obtained by the homeowner for mortgage financing purposes. The bill also removes certain protections for commercial real properties whose valuations were reduced in the prior tax year through the appeals process. It has not received a committee hearing and is not likely to pass.
Finally, the legislature considered and passed legislation to expand Medicaid in Kansas. Governor Brownback vetoed the bill and the House did not override that veto. Issues of Interest to the home building industry: Sales Tax Exemption on Labor Services: The HBA is monitoring tax discussions to ensure the legislature does not attempt to eliminate the current sales tax exemption on labor. It is a valuable exemption that covers new construction and residential remodeling. The HBA recently met with Sen. Julia Lynn who stated that

prevent professions that are not currently regulated from becoming licensed in the future. It would also cap licensing fees at $25, virtually eliminating county contractor licensing departments. After facing significant opposition, SB 76 passed out of committee with an amendment so that it does NOT apply to local municipalities or local licensure. State-Run OSHA: SB 212 was recently introduced to direct the Kansas Secretary of Labor to develop a program for the state to enforce the federal OSHA requirements. Immigration: Multiple bills have been introduced on this issue, but most have dealt with Muslim sanctuary cities and less with traditional immigration issues. There is also a bill related to e-verify for contractors working on public projects valued at more than $50K. There has been limited action on these bills. The Kansas Building Industry Association (KBIA) is part of a coalition that has testified in opposition to a couple bills related to specific enforcement of immigration laws. Work Comp: Several bills have been introduced to expand/amend the existing workers’ compensation system in Kansas. The proposals range from reverting to an old edition of AMA Guidelines to changing the make-up of the advisory committee. It is not anticipated these bills will advance in the process.

MO Legislative Update Continued from page 4 HB 264 – Work Authorization – would require all employers and business entities to enroll and actively participate in a federal work authorization program and imposes stricter penalties for employing undocumented immigrants. Per HBAM lobbyist Jewell Patek, the federal program is currently underfunded and only has an 80% success rate, which opens builders up to liability issues. However, he does not see this legislation progressing much further in the process or becoming law. Workers’ Compensation – The Governor and legislature appear to have an appetite for major reforms to the current work comp system. The HBA of Missouri is researching the best way to address builder concerns such as lack of enforcement and working to put together legislative proposals.
The HBA will begin holding regular meetings with top permitting cities such as Overland Park, Olathe, Kansas City and Lee’s Summit to establish and maintain open dialogue with their planning and development departments on current builder issues. Builders who are interested in attending these meetings are encouraged to contact either Josh Clark

The solar panel industry and efficiency advocates have not backed off their efforts to require all new homes to be “solar-ready.” These efforts are showing up throughout the country at both the state and local levels. The solar panel industry submitted an amendment to the 2015 International Energy Conservation Code (IECC) that would have required all homes to be built in such a way that solar panels could be accommodated on the roof: typically including a conduit from the attic to the electric panel, space in the panel to accommodate the solar circuit and documentation that the roof is strong enough to hold a system as well as 300 square feet of clear (not north-facing) roof area.

The amendment to mandate solar-ready homes was defeated ─ but it was included in the appendix of the 2015 IECC, allowing a state or local jurisdiction the ability to require homes to be solar-ready if it wants to. It’s true that having the infrastructure in place for the installation of photovoltaic panels can be can be desirable to consumers in some markets – which is why NAHB is a strong supporter of voluntary programs and tax credits that encourage their use. But solar-ready homes aren’t for everyone and every region, so NAHB has resources for home builders and HBAs to refute arguments that they should be installed in all homes.

design issues: Plumbing and mechanical vents might need to be relocated to find the 300 square feet of space the panels require, and architectural features such as gables and dormers might not be possible on a home’s south side: a problem if that’s the side that faces the street. Some fire departments have expressed concerns about their ability to vent the roof in the event of a fire. Not every house is a good candidate for
solar panels either because of size or space constrictions or because of location – it makes no sense for a house that is often shadowed by tall trees or surrounding buildings, for example. An alternate to a mandate for solar-ready homes would be, if the builder requests it, that private solar panel installers “certify” a new home as solar-ready if the home’s design allows for easy placement of panels at a future date. The certification sticker could be placed on or near the home’s electrical panel and include the company telephone number so the owner can call when ready – and the solar company can make a sale. Builder Confidence and Building Permits Climbing in 2017 February permits issued for home construction continue to indicate that local builders are off to their busiest year in the past decade, according to statistics compiled by the Home Builders Association of Greater Kansas City (HBA). A total of 469 single-family units were permitted last month, bringing the 2017 year-to-date total to 917 — the highest count for the January-February months since 2006. On a national level, builder confidence in the market for newly built, single-family homes jumped six points to a level of 71 on the National Association of Home Builders/Wells Fargo Housing Market Index (HMI). This is the highest reading since June 2005. And this growth is expected to continue. According to speakers at a recent HBA Kansas Area Council meeting, developers are purchasing available lots in outlying areas of the city at a fast pace, particularly in south Overland Park and western Shawnee, in an effort to build their inventories — and before the land is bought by someone else. Permit activity remains highest in Kansas City, Mo. (152 permits in January and February), with most of Kansas City’s building in Clay and Platte counties. Lee’s Summit is considerably more active with 102 permits issued so far in 2017 as compared to 30 for the first two months of 2016. Likewise, Kansas City, Kansas/Wyandotte County has jumped from just 16 permits to start 2016 to a count of 101 during 2017. Olathe and Overland Park have also reported growth and these cities round out the top five for permit activity in the area.

1962: Spring Homes Tour Begins The Home Builders Association of Greater Kansas City added to its long-established fall Parade of Homes with a spring “May Homes Festival” in 1962. Each builder paid $50 per house to enter this tour and agreed to have his entries open from 10 a.m. to 9 p.m. on weekends and noon to 9 p.m. on weekdays during the two-week event. Chairman Charles Bleakley recommended that the tour be promoted with $7,500 worth of advertising in the Kansas City Star, radio spots, billboards, posters on buses and signs at the homes. After this inaugural event, the builders in 1962 decided by a thin margin (22 to 19) to continue with the spring tour in future years. The 1967 Spring Tour was budgeted at $13,000 and included TV advertising for the first time. In 1972, the tour was held for only one week and included “Step
The year 1988 marked the first year the HBA produced a guide book for the Spring Homes Tour. This guide was an 8.5” x 11” publication, in contrast to the Fall Parade of Home guide which was sized at 5.5” x 8.5”. With 434 entries in the 1988 tour, it was the largest in HBA history to that point and was the largest ever produced in the United States by a single HBA. der $200,000. Information provided for each home – address, subdivision, driving directions, rendering and floor plan – is the same as that included in current parade guides. Rather than arranging the homes in order of tour number, however, they were listed in ascending price order. The 1997 Spring Homes Tour included 445 entries and, in addition to the guide book listings, homes were included on the HBA’s website with locations, floorplans and photos. In 2012, the name of the Spring Homes Tour was officially changed to Spring Parade of Homes in order to more closely link the two events. The HBA’s proud tradition of offering the best in home building to the Kansas City public continues with 381 entries in the 2017 Spring Parade.
