So many of our best memories happen at home: a child’s first steps -- playing in the back yard -- music lessons -- prom night – holiday celebrations. For more than 80 years, members of the Home Builders Association of Greater Kansas City have helped thousands of families embark on their own American dream. We are proud to build the places where families experience the best times of their lives. Unfortunately, far too many in our community do not have the happiness and security that so many of us enjoy. Affordable housing, educational training and opportunity, and a strong, livable neighborhood should be available to all in our society. That is why the HBA has established the Home Builders Foundation Fund of Greater Kansas City. These words are from the brochure that introduced the KCHBA’s Foundation Fund to members and the public. Longtime KCHBA members will remember that the organization established a charitable fund in the early 2000s. In recent months, original and new members of the steering committee have made plans to re-invigorate the fund in order to increase the local homebuilding industry’s charitable outreach.

Plans are underway to reintroduce the Fund to HBA members and to encourage a new round of contributions. The Fall Parade and Awards celebration will be the initial focus of the re-launch of the Foundation Fund with friendly competition between HBA committees and a raffle. The fund was originally established in 2001 with the initial committee consisting of Jeff Alpert, Leo Ashner, Jim Goodwin, Richard Mather, Harry McCray, Greg Prieb, Dusty Rhodes and Harold Teague. In order to simplify administration of the fund, the committee decided in 2002 to establish the KCHBA Foundation as a fund within the Greater Kansas City Community Foundation (GKCCF). The Fund’s steering committee has been re-established with the sons of many founding members to continue the community outreach. Chaired by Tommy Bickimer, members of the committee include Greg Prieb, II; Hatch McCray,

Jeff Ashner, Mark Mather, Jeff Alpert, Justin Pfeifer, Tom Bickimer, and Todd Lipschutz. The original purpose of the fund was to advance a range of charitable, educational and community causes that help address issues of housing affordability, job training, declining neighborhoods and related matters. Thanks to the generous donations of members and investment earnings throughout the years, some of the causes the fund has supported include: Builders Development Corporation for their work in housing rehabilitation and creation of affordable homes; Pittsburg State University to support students’ travel to IBS and their competition in the Residential Construction Management Competition; Rebuilding Together Clay County as they assist seniors and others in improving their homes; and to the Oklahoma and Joplin Home Builders Funds as they recovered from devastating tornadoes. The KCHBA is excited to increase support of our community through the Foundation Fund. Please say “yes” when you’re asked to get involved.

Artisan Tour Raises Nearly $50,000 for RMHC

Thank you to everyone who visited homes on the Artisan Home Tour! The tour had a terrific turnout with about 2,000 people visiting at least one home. In total, the event raised $48,783 for Ronald McDonald House Charities KC through individual builder’s efforts and ticket proceeds.

Clark Graduates from Leadership OP Program Leadership Overland Park was established to ensure the continuing vitality of the community by providing a solid source of motivated leaders who are educated about the community and its issues, as well as prepared to accept future leadership roles in the Overland Park area. Josh Clark, executive vice president of the HBA, was accepted into the program and completed the leadership training. Founded in 1983 as a program of the Overland Park Chamber of Commerce, the program is now a program of the Chamber’s educational foundation. Builders Development Corporation Partners with Drumm Farm Center for Children The Builders Development Corporation (BDC) recently celebrated the completion of their latest rehabilitation project – a large home in Independence which provides housing for young adults leaving the foster care system.

The house (on Crysler Avenue in central Independence) had been sitting vacant for a number of years before the BDC acquired it from the City of Independence about three years ago. “Originally we were going to renovate it into one single-family house for low-to-moderate income families,” stated BDC President Michael Snodgrass, “but after careful consideration we determined it was too large and utility bills would make it unaffordable for the families.”

Members of the BDC board and supporters of the Drumm Farm Center for Children celebrate the opening of this renovated home.

It was around this time that the City of Independence approached the BDC with the idea of converting the property into studio or one bedroom apartments to be used by the Drumm Family Farm. BDC took this idea and made it into a reality. “We took a derelict house that the city had been trying to deal with for years,” said Tom Woods, a BDC and KCHBA board member. Only non-profit organizations are able to take advantage of the abandoned house program, so the partnership between the City of Independence and BDC was critical. Funding for the home was provided by Neighborhood Stabilization Program funds from the City of Independence, the Hall Family Foundation and the H&R Block Foundation. Alpha Title provided closing services for the home. Several items and features of the home were local donations, including the fire sprinkler system. In the short time it has been open, the 6

pants have shown to be actively working to create more stability in their lives and Crysler is the place to finalize and continue to grow upon these healthy habits. Woods grew up down the road from Drumm Farm. He believes years of building the right team and forging meaningful relationships has made a project like this possible. Woods is proud of this opportunity for the BDC to give back to the community. According to Woods, “every organization involved each did their part to make this a success.” Many HBA members are involved with BDC and Drumm Farm. The HBA applauds their continuous efforts to provide and support affordable housing options for those who need it most in Kansas City.

New IRS Campaign Targets S-Corp Compliance

The Internal Revenue Service on July 2 announced that it is launching five new compliance campaigns, including one that will seek to stop S corporations from abusing the rules governing passthrough entities. Several rules restrict which companies can be S corporations. Some are simple rules that define an S corporation, such as the fact that the business must be based in the U.S. and have no more than 100 shareholders.

Major Victory for NAHB and Builder in Clean Water Act Court Case Orchard Hill’s efforts were buoyed by several court cases.

On June 26, the U.S. Court of Appeals for the Seventh Circuit sided with an NAHB member engaged in a decade-long legal battle in a case supported by NAHB’s Legal Action Fund – Orchard Hill Building Company v. U.S. Army Corps of Engineers.

Orchard Hill finally got its day in court when the U.S. Supreme Court found in U.S. Army Corps of Engineers v. Hawkes that jurisdictional determinations are judicially reviewable. Ultimately, the Seventh Circuit ruled in favor of Orchard Hill, holding that the Corps had failed to prove the wetlands at issue had a significant nexus to any truly navigable water.

The case concerned 13 acres of wetlands owned by Orchard Hill Building Company. Orchard Hill sought a jurisdictional determination as to whether it would need a Clean Water Act section 404 permit from the U.S. Army Corps of Engineers to develop these acres. The Corps found that the acres fell under the jurisdiction of the Clean Water Act.

NAHB aided Orchard Hill in two distinct ways: First, it provided Orchard Hill with a $10,000 Legal Action Fund grant in 2016. Second, NAHB was involved in every court case that kept 7.25” Orchard Hill’s claims alive over their decade-long battle.

Orchard Hill disagreed with the Corps’ determination and over a 10-year period fought through the Corps’ internal appeals process. During this time,

NAHB’s proactive Litigation and Amicus Brief program allows NAHB to bring lawsuits and submit amicus briefs on siginificant issues that impact NAHB members. Through this program, NAHB aided Orchard Hill by litigating in cases that clarified the bounds of the Clean Water Act, vacated a rule that curtailed the use of the “prior converted croplands” exemption from the wetlands permitting program, and required jurisdictional determinations to be judicially reviewable. The NAHB Legal Action Committee’s Legal Action Fund is available to NAHB members and HBAs with litigation that implicates a national policy issue or a state or local problem that is common to the housing industry. Forest Service Pledges Largest Timber Harvest in 20 Years In a victory for NAHB, Interim Forest Service Chief Victoria Christiansen told Congress in early June that the Forest Service expects its 2018 timber harvest will be the biggest in 20 years.

Christiansen said: “Our anticipated level of timber harvest in fiscal 2018 is the highest it’s been in 20 years. In all, this year the Forest Service plans to sell 3.4 billion board feet of timber while

NAHB has been leading the charge to urge Congress and the Trump administration to consider ways to increase the domestic supply of timber of public lands. These efforts are especially critical, given that the Commerce Department has placed tariffs averaging more than 20% on Canadian lumber shipments into the U.S. and that the U.S. relies on Canada to meet roughly one-third of its lumber needs. Since January of last year, rising lumber prices have increased the cost of an average single-family home by nearly $9,000. Much of these unprecedented price hikes are due to the lumber tariffs. Testifying before Senate Committee on Energy and Natural Resources,

Administration Submits New WOTUS Definition for Review The Environmental Protection Agency and Army Corps of Engineers submitted a new proposed “Waters of the U.S.” (WOTUS) regulatory definition to the White House Office of Management and Budget for review. The proposal had not been expected until August. The regulatory definition of WOTUS determines not only what landscape features are subject to federal regulation for home builders and developers under the Clean Water Act but also what land clearing or dredging operations may trigger subsequent federal permitting requirements under the act’s wetlands permitting process and stormwater management programs. When the agencies submitted the new proposal June 15, it took the first step in the Trump administration’s long-

standing process to replace what home builders and other stakeholders say were confusing – and overreaching – definitions approved during the Obama administration. While those definitions are now on hold, this month’s action represents an opportunity for officials to see what new regulations might look like as other federal agencies can now provide comment about how the proposal is consistent with federal law and how its application might affect their own operations.

Typically, the interagency review process takes no more than 90 days — which means NAHB should expect a proposed WOTUS rule in the Federal Register for members to see and comment on by September.

“Recent Census Bureau data indicates that millennials are increasingly entering the housing market as first-time buyers,” said Josh Clark, executive vice president of the HBA. “This helps fuel the entire housing market – both existing and new homes are selling quickly in the Kansas City area.” Permits issued in Johnson County have accounted for 33% of the total during the first five months of this year. The Missouri counties of Clay, Jackson, Platte and Cass issued 58% of the total. Kansas City, Mo., recorded the highest number of permits so far in 2018, with 381 in its three county reach. Olathe has the second highest number of permits issued with 250 units. Blue Springs (233 permits), Lee’s Summit (173 permits), and Overland Park (164 permits) round out the top five cities with the most permits issued in the first quarter.
