Workforce Area Council Features Inspiring Story, Interactive Element At the Workforce Area Council at Jack Stack BBQ last month, guest speaker Jeff Lee shared his personal story of incarceration in multiple prisons across the country before joining Connections to Success and assisting current inmates with their transition back into society. Connections to Success is a nonprofit organization whose mission is to inspire individuals to realize their dreams and achieve economic independence by providing hope, resources and a plan. While in prison in Leavenworth, Lee learned of Connections to Success and, once released, entered the organization’s program. Today, as a program manager with Connections to Success, Lee helps others acclimate to life outside of prison by teaching soft skills such as how to interact in a professional environment and what to expect during a job interview. Don’t Put Your Cell Phone Away The Workforce Area Council also featured an interactive element. Throughout the luncheon attendees were asked a series of workforce-related questions, which they could answer via their phones and see the results on a screen live. Most attendees answered the questions about the Construct KC program and KC MADE correctly. The hardest question: What is the web address for the HBA’s workforce website? The answer is KCHomeWork.com. This website was built specifically for students interested in the skilled trades and their parents so they can find resources and information and even get an idea of salary ranges for different trades. Brian Tebbenkamp Member of NAHB’s New “Connect 10” Program “Connect 10” is NAHB’s new program geared toward companies that may not yet be established enough to warrant a traditional membership in the NAHB 20 Clubs, yet it offers similar networking and educational benefits. KCHBA’s Brian Tebbenkamp of Patriot Homes is one of the original members of this new group and recently attended a meeting in Dallas last month. Modeled as a stepping stone toward membership in a 20 Club within two to three years, Connect 10 is based largely on virtual meetings. The virtual club model was developed as a convenient and appealing platform particularly for newer company owners. The only requirement for a Connect 10 membership, aside from being an NAHB member, is that the member companies are less than 10 years old. Each club comprises up to 10 members and meets quarterly for two,

two-hour virtual meetings. In addition to a 20 Club facilitator, each club will have a dedicated mentor — a retired 20 Club veteran — to facilitate conversation and provide guidance. Congratulations, Brian, for serving as a leader and one of the founding members of this new group.

Artisan Tour Now Open to Occupied Homes June 5-7, 12-14, and 19-21, 2020 Have you built a unique home recently that showcases your capabilities as a custom home builder? If you built a home that has been lived in a year or less that fits the Artisan standards, enter it in the 2020 Artisan Home Tour. It doesn’t have to cost $1 million to be considered “artisan” – it has to have unique features that you don’t see in an average home. How do you get the homeowners to agree? Does the homeowner know someone suffering from diabetes? Tell them the tour is partnering with the Juvenile Diabetes Research Foundation (JDRF) in an effort to find a cure for Type 1 diabetes. Knowing their efforts will potentially help find a cure may sway their thinking. Why JDRF? JDRF is not only a great cause, but its supporters are some of the most affluent people in Kansas City. New EPA Guidance Says Groundwater Discharges Do Not Require Permits

The EPA has released interpretive guidance on April 16 to clarify whether groundwater pollution that eventually reaches federally regulated traditional navigable waters — e.g., seas, rivers, lakes — requires a permit under the National Pollutant Discharge Elimination System (NPDES) program.

EPA stated that discharges to groundwater are not covered by the Clean Water Act (CWA): “… releases of pollutants to groundwater are categorically excluded from the Act’s permitting requirements because Congress explicitly left regulation of discharges to groundwater to the states and EPA has other statutory authorities.” EPA’s position is consistent with NAHB comments submitted to the Agency last spring. Under the NPDES program, it is a violation of the CWA to discharge any “pollutant” into a jurisdictional water unless that discharge has been permitted. Currently, many developers and builders install low-impact development or green infrastructure practices as well as septic systems that are designed to infiltrate into groundwater.

OSHA’s Use of Drones: What Builders Need to Know Over the last several years, the use of Unmanned Aircraft Systems — commonly called drones — has grown exponentially. It is predicted that by the year 2021 commercial drone use in the United States will expand tenfold. Drone use is regulated principally by the Federal Aviation Administration, which has registration requirements and sets operational rules to ensure safe operation. With the emergence of wider drone use, OSHA has also stepped into the drone business, allowing the use of drones during worksite inspections for compliance assistance and for training purposes. The potential for OSHA to use drones in enforcement activities has raised concerns from home builders and other contractors. OSHA Memorandum on Drone Use On May 18, 2018, in a memorandum to Regional Administrators, OSHA set forth its policy related to the use of drones during inspections. The Agency stated: “[Drones] may be used to collect evidence during inspections in certain workplace settings, including in areas that are inaccessible or pose a safety risk to inspection personnel.” In addition to OSHA having to comply with FAA and other regulations regarding drone use, the memorandum establishes “Recommended Best Practices” to be followed by OSHA regions when using drones. The best practices are extensive and are designed to ensure the drones are flown safely and that employer and employee rights are protected by the use of the drones. Notably, in order for OSHA to use a drone in the course of an inspection, OSHA must receive consent by Continued on page 16

the employer to use the drone. OSHA must also notify all affected personnel on the job site that it will be using a drone. How to Prepare In the near term, OSHA’s use of drones during inspections will likely be limited to rare circumstances where the nature of the inspections is such that compliance officers cannot safely access particular areas (e.g., emergency response inspections, or accessing work sites located at significant heights). “Home builders should still be aware that OSHA owns drones and has the capability to use them in the course of inspections, and should plan accordingly,” noted Brad Hammock, an attorney with the law firm of Littler Mendelson, P.C. in Washington, D.C. To prepare, home builders should review OSHA’s drone memorandum and Recommended Best Practices. In addition, job site supervisors should be trained in the memorandum, in particular, that: • OSHA by policy cannot use drones in the course of an inspection without employer consent. • OSHA must notify any affected employees regarding the use of drones. Home builders should determine their approach to allowing OSHA’s use of drones in advance of an inspection and ensure job site supervisors are trained and knowledgeable about the approach.

Residential Permitting Gains Ground but Still Lagging 2018 In April, 414 single-family permits were issued for a total of 1,242 single-family permits year-to-date in 2019, according to the Home Builders Association of Greater Kansas City’s (HBA) monthly Residential Building Permit Statistics report. Single-family permitting continues to lag behind 2018, which had 501 single-family permits issued in April 2018 and a total of 1,933 single-family permits issued at this time in 2018. “On a regional level, single-family starts are down 6.4 percent in the Midwest year-to-date,” said HBA Executive Vice President Will Ruder. “Locally, weather-related delays have resulted in a slower start to the building season, but ongoing job growth, rising wages, and a low interest rate environment continue to support solid demand for new single-family homes.” No multi-family permits were issued locally in April this year. Year-to-date, however, multi-family permits in the KC area are up 76 percent compared to April 2018. At the national level, multi-family starts are also increasing, according to the National Association of Home Builders (NAHB). In fact, multi-family permits increased 8.9 percent in April nationally – the highest since March 2018, according to NAHB. The top permitting cities in the greater Kansas City area – for both single- and multi-family – in April 2019 were Olathe (72), Lee’s Summit (42), and Kansas City, Mo., (35). Year-to-date, the top permitting cities are Lee’s Summit (258), Overland Park (243) and North Kansas City (241).

YPs Host Volunteer Night at VCP The HBA’s young professional group has begun volunteering the last Thursday of the month at Veterans Community Project. Last month, they hung insulation on the outside of the tiny homes. While the YPs host this event, anyone is welcome to participate. If you’d like to help out, the next HBA volunteer night will be Thursday, June 27 from 4:00 p.m. to 7:00 p.m.
