The International Builders’ Show (IBS) is the largest annual light construction show in the world and takes place January 22-24 in Las Vegas. New Building Codes Expected to Take Effect in the New Year Following the passage of new building codes in Kansas City, Missouri, Overland Park and Olathe, building code officials from several cities and counties across the Kansas City metro area are close to finalizing their building code proposals to present to their respective city councils for approval before the end of the year. As of November 14, 2012, the HBA expects several new codes to take effect on either January 1 or April 1, 2013 (see chart on page 7). Last month the HBA hosted building code officials from six different jurisdictions to talk about the status of their building code proposals and to provide an opportunity for members to

weigh-in on the changes. In this meeting, a common approach emerged on how to handle compliance with the energy code. Some cities, such as Shawnee and Olathe, are providing builders with two options for compliance. The “prescriptive option” would require that builders follow the code requirements by the book. The alternative option or “HERS option” would require builders to enlist an independent energy auditor to provide a Home Energy Rating System (HERS) Index Score on all new homes to meet the energy efficiency requirements in the code. The Facts on that Rumored 3.8% Sales Tax on Homes
The Fiscal Cliff and Housing
w
Among the most common tax and housing policy questions, according to NAHB, is whether a 3.8 percent sales tax will hit home sales in 2013. The answer is no. NAHB has been tracking a set of emails that falsely claim that the 2010 health care reform legislation (which contained a burdensome 1099 reporting requirement, now repealed) imposed a 3.8 percent sales tax or transfer fee on all home sales in 2013. There is an element of fact underlying this rumor, but for the most part this claim is false. The new tax added by the health care reform law is an add-on to existing taxes on capital gains and other ”unearned income” (dividends, rents, and interest). The new 3.8 percent tax is often referred to as a Medicare tax because its revenues will be dedicated to the Medicare Trust Fund. For capital gains, presently taxed at a 15 percent rate, the gains rate would rise an additional 3.8 percentage points for high-income taxpayers, those with adjusted gross incomes (AGI) above $250,000 ($200,000 if filing a “single” return). Capital gains arise with the sale of capital assets, such as stocks, bonds, and real estate. But importantly for home sales, the existing $500,000 / $250,000 gain exclusion for a seller of a principal residence continues to apply, so most principal resi-
dences sales will not be affected. Some second home sellers with high incomes may have to pay some additional capital gains tax to the extent that their AGI exceeds $250,000, but only on that portion of the gain that causes the taxpayer’s AGI to exceed $250,000 and only for the realized capital gain - not the actual sales price. Consider the following typical example. Suppose a married couple sells their principal residence for $500,000, after having purchased the home for $200,000. Suppose the capital gain on the sale is $300,000. The couple is allowed (under Section 121 of the Internal Revenue Code) to exclude from all tax (including the standard capital gains tax and the new 3.8% tax) up to $500,000 of gain, so there is no tax on the realized $300,000 gain from the home sale. To be clear, the 3.8 percent tax is not in any way a sales tax paid against the sales price of the home for either the home seller or home buyer. Nor is it an additional business income tax for home builders selling a new home out of inventory. The housing market has enough policy uncertainties today. With the 2012 election over, Congress, the White House and the country have moved on to a discussion on how to avert the “fiscal cliff.” In short, the “fiscal cliff” is the combination of across-the-board spending cuts in defense and domestic government programs and tax increases that begin to take effect in January 2013 unless Congress passes new legislation to avoid them. These automatic spending cuts and tax increases were part of a deal included in the Budget Control Act of 2011 designed to force both parties to come to a budgetary compromise by the end of the year or face painful economic and political consequences. But with only a few work weeks scheduled in the lame duck session to reach a new deal, it is unclear whether or not leaders can come together and how their inaction would impact an already delicate recovery in the housing market. What is clear is that Congress’ inaction would hurt almost every American’s pocketbook and send a message to the world that the U.S. is not in control of its economic destiny. The nonpartisan Congressional Budget Office predicts that falling off the “fiscal cliff” would put the U.S. back into a recession. Up to 3.4 million
jobs would be lost and the unemployment rate would reach 9.1 percent. Further, taxes would increase for individuals and businesses already struggling to make ends meet. The economic uncertainty may delay a family’s decision to build or buy a home in the near-term. Barry Rutenberg, chairman of the National Association of Home Builders (NAHB), issued the following statement: “In the closing weeks of the 112th Congress, NAHB urges President Obama and congressional leaders to work together to resolve issues related to the ‘fiscal cliff’ by extending all of the 2001 and 2003 tax cuts while being mindful of how broadbased tax reform will affect the fledgling housing recovery. Any effort to engage in tax reform should be done in a careful and deliberate manner and demands the proper vetting by Congress and all relevant stakeholders. There should be no rush to judgment on an issue that will affect virtually every American citizen.” The KCHBA encourages members to reach out to their representatives in Washington to urge them to reach a deal and avoid hurting an already fragile economy. The HBA Inaugural Celebration will welcome new Board President Fred Delibero as the HBA’s 68th President. “It has been an honor serving on many HBA committees over the past decade, and most recently serving on the executive committee as secretary/treasurer and vice president helping to lead the HBA through some of the most challenging times in our history,” said Delibero. “My commitment to the homebuilding industry and this organization remains steadfast,” he added. Fred is founder and president of Lee’s Summit based Summit Custom Homes, one of the largest volume homebuilders in the metro area. He has been a member of the HBA since 2002, the same year he started his company. “I started Summit Custom Homes during some very good times for the homebuilding industry and rode the roller coaster of uncertainty together with all of our members over the past five years. It’s been a challenging, educational and rewarding experience and one I’m happy to have survived. Through it all, the HBA was there to support our industry with quality education, market information, political advocacy at the local and state level and unmatched networking opportunities,” Delibero said. Prior to founding Summit Custom Homes, Fred was involved in commercial and retail real estate development and leasing with several companies including locally based Copaken Brooks where he was responsible for shopping center and outparcel leasing and development. In addition to his service at the HBA, he also serves as a member of the NAHB Board of Directors and is a member of the Lee’s Summit planning commission. Fred earned his Bachelor of Science in Marketing and Master of Business Administration degrees from Nova Southeastern University in Fort Lauderdale, FL. He, his wife Lisa, and their two children Griffin and Riley reside in Lee’s Summit. www.kchba.org

In addition, Fred plans to support initiatives aimed at giving back to the communities in which our members reside. “We are a powerful and well respected organization and as such we’re in a position to effect positive change for our community and we need to embrace that responsibility,” he said. “I look forward to working together with the volunteers and membership of our organization to continue our mission.”

Travis Graham Honored at Past Presidents Dinner The Past Presidents of the Home Builders Association gathered for an annual dinner recently at Jasper’s Italian Restaurant to honor 2011 HBA President, Travis Graham, Graham Construction. Travis’ dedication to the HBA is unprecedented since he is the first president to serve two terms, 12 years apart. He first served as the youngest president in 1999 then he served again in 2011. Bruce Rieke (HBA President 2005) recalled how the HBA was at a crossroads a few years ago and needed leadership that could navigate the association through difficult times. “We are deeply grateful that Travis answered the call,” said Bruce. Unified Government Waives Building Fees for New Home Construction

The Unified Government Board of Commissioners is waiving all building permit fees, inspection fees and sewer connection fees for new single family home construction beginning this month through December 2013. The move is designed to spark a renewed wave of home construction to meet the demand created by thousands of new jobs coming to Wyandotte County. The Kansas Area Council members learned about the details from Greg Kindle, Executive Director for the Wyandotte Economic Development Council recently at the Council luncheon at the HBA. They also heard from John Kelly, Olathe Chief Building Code Official, who reviewed recent changes in the building code. www.kchba.org

New Households Sprouting Up
As Recession-Era Fears Ease, Confident Consumers Take Steps to Rent or Buy By Robbie Whelan,The Wall Street Journal, November 7, 2012
Americans are setting up house at the fastest rate in more than six years, an indication that recession anxiety, which prompted adult children to move in with their parents and single people to postpone marriage, is starting to ease. The nation added 1.15 million households in the 12 months that ended in September, according to the most recent Census Bureau data. That is a significant rise from the past four years when an average of 650,000 households were formed annually. While what economists call “household formation” is running a little lower than the average 1.25 million added annually during the boom years, the latest data nevertheless represent an important shift. Rising household formation, which is tied to employment growth, means more students are finding jobs when they leave college, more adult children are leaving their parents’ homes and more couples feel confident enough about the future to tie the knot. It could also mean that immigration is picking up. “During the recession, a lot of those major life events like marriage, children and migration were put on hold,” said Kenneth Johnson, a senior demographer at the University of New Hampshire’s Carsey Institute. “It may be that there are couples who are thinking about living together, and they’re thinking, ‘The jobs picture is getting better. It’s time to make the next step.’” That is what happened with Imran Akram, a patent inspector for the U.S. government, and his wife, Salmah Rizvi, who works for the Defense Department. The couple, who married in September, recently closed on their first home, a $250,000 condominium in Baltimore. Mr. Akram, who is 29 years old, and Ms. Rizvi, who is 26, say they wanted to buy a condo as soon as possible after their wedding. They plan to live there for at least a year and then rent it out if Ms. Rizvi decides to go to law school and they move. “At least here in Baltimore, purchase prices are still low, but rents are pretty high, because everyone’s scared to buy,” Mr. Akram said. “We’re both employed and feel secure with our jobs. We also feel like the housing market is on an upward swing. Prices are still depressed, but they’re probably going up.” Building Business News
While young home buyers represent one source of new households, the overall growth is due mainly to renters, many of them recent college graduates. The number of homes lived in by renters has grown by more than five million since 2006 to 39.6 million. During the same period, the number of homes lived in by owners fell 1.4 million to 75.1 million as many properties slipped into foreclosure or became vacant for other reasons. But the number of owneroccupied units is starting to rise again as buyers emerge.
List of Improving Housing Markets Expands to 125 in November November 6, 2012 - The number of U.S. housing markets showing consistent improvement in three key measures of strength expanded by 22 in November to a total of 125, according to the National Association of Home Builders/ First American Improving Markets Index (IMI), released today. This marks a third consecutive NAHB Improving Markets Index 130 monthly gain for the index, which 98 now includes 65 r e p r e s e n t a t i v e s 33 from across 38 0 states as well as Nov 11 Feb 12 May 12 Aug 12 Nov 12 the District of Kansas City has been included since February 2012 Columbia. The index identifies metropolitan areas that have shown improvement from their respective troughs in housing permits, employment and house prices for at least six consecutive months. Markets added to the list in November include such geographically diverse locations as San Diego, Calif.; Gainesville, Ga.; Omaha, Neb.; Louisville, Ky.; and Charlotte, N.C. “Not only did 22 additional markets qualify for the improving list in November, but the geographic distribution of included metros expanded from 33 states to 38 (plus the District of Columbia), while 97 out of 103 markets retained their spots on the list from the previous month,” observed Barry Rutenberg, chairman of the National Association of Home Builders (NAHB) and a home builder from Gainesville, Fla. “This shows that a housing recovery is firmly taking root and helping generate needed jobs and www.kchba.org
economic growth across much of the country -- though we know that this expansion could be even stronger were it not for ongoing challenges including overly tight lending conditions and difficult appraisals.” “The solid increase in the number of improving housing markets this month illustrates the degree to which the housing recovery has gained momentum since we initiated the IMI last year,” noted NAHB Chief Economist David Crowe. “Compared to the 30 markets that made the list as of November 2011, we now have 125, which is about onethird of all the markets surveyed for this index.” “This new high point for the Improving Markets Index provides the latest evidence that housing has turned a corner due to rising demand from consumers who are increasingly confident about the direction of local home values,” said Kurt Pfotenhauer, vice chairman of First American Title Insurance Company. The IMI is designed to track housing markets throughout the country that are showing signs of improving economic health. The index measures three sets of independent monthly data to get a mark on the top improving Metropolitan Statistical Areas. The three indicators that are analyzed are employment growth from the Bureau of Labor Statistics, housing price appreciation from Freddie Mac and single-family housing permit growth from the U.S. Census Bureau. NAHB uses the latest available data from these sources to generate a list of improving markets. A metropolitan area must see improvement in all three measures for at least six consecutive months following those measures’ respective troughs before being included on the improving markets list. HBA-PAC Supports Several Pro-housing Candidates in Kansas and Missouri The HBA-PAC supported several pro-housing candidates in Kansas and Missouri during the 2012 election cycle. Overall, the HBA-PAC contributed to 38 candidates, 19 in Kansas and 19 in Missouri, competing for positions ranging from seats on county commissions and in state legislatures to statewide races. Of these candidates, 33 were elected to office, an 86 percent success rate. Since its founding, the HBA-PAC has served to help elect hundreds of prohousing candidates to office at the state and local level, which could only happen with the continued support of its members. These efforts are necessary to ensure that the voice of the housing industry is heard at all levels of government and that our elected officials understand the importance of new home construction for building strong communities and local economies. The HBA encourages members to get

Build PAC is Key to Keeping Housing Strong
A key reason for the HBA’s strength is its aggressive political affairs program. Nationwide Housing Affordability Improves in Third Quarter Lower interest rates helped make homes more affordable to median-income families even as house prices continued to inch up in metro areas across the country in the third quarter, according to the National Association of Home Builders/Wells Fargo Housing Opportunity Index (HOI), released today. Nationwide, 74.1 percent of all homes sold in this year’s third quarter were affordable to families earning the U.S. median income of $65,000. This was up slightly from the 73.8 percent of homes sold that were affordable to median-income earners in the second quarter. “The latest housing affordability data is good news on two fronts, because it shows that the share of homes affordable to median-income earners has risen even as home prices have continued to gradually recover from their recession lows,” noted NAHB Chairman Barry Rutenberg, a home builder from Gainesville, Fla.

“This is primarily due to the fact that mortgage rates are now lower than we’ve seen them since the HOI was initiated more than a decade ago. That said, given today’s overly tight lending conditions, we know that it remains very difficult for potential buyers to qualify for and obtain those great rates.” “The median price of all new and existing homes sold in the third quarter was $189,000, which was up from $176,000 in last year’s third quarter and the strongest number we’ve seen since the final three months of 2008,” explained NAHB Chief Economist David Crowe. “But at the same time, mortgage rates were at their lowest levels in decades, which kept homes quite affordable. Clearly, for families who qualify for a mortgage at such favorable terms, the outlook is brightening -- but being able to afford a home and getting approved for a mortgage are still two different things in the current marketplace.” Topping the affordability list for the first time in the HOI’s history, OgdenClearfield, Utah, was named the most affordable major housing market in the country in the third quarter. There, 93.2 percent of all new and existing homes sold between July and September of this year were affordable to families earning the area’s median household income of $71,500. Also ranking among the most affordable major housing markets in respective order were Youngstown-Warren-Boardman, Ohio-Pa; Indianapolis-Carmel, Indiana.;

Lakeland-Winter Haven, Florida.; and Toledo, Ohio. Among smaller housing markets, Fairbanks, Alaska, retained its standing at the top of the affordability chart with an incredible 99.4 percent of all homes sold there in the third quarter being affordable to families earning the area’s median income of $92,900. Other smaller housing markets at the top of the index included Mansfield and Lima, Ohio; Wheeling, W.Va.-Ohio; and Kokomo, Ind. Meanwhile, New York-White PlainsWayne, N.Y.-N.J. retained the title of the least affordable major housing market in the country for an 18th consecutive quarter, with just 28.5 percent of homes sold there being affordable to families earning the area’s median income of $68,300. Other major metros at the bottom of the affordability chart included perennial entrants San Francisco-San MateoRedwood City, Santa Ana-Anaheim-Irvine and Los Angeles-Long Beach-Glendale, Calif., as well as Bridgeport-StamfordNorwalk, Conn., in that order. The least affordable small housing market in the third quarter was Santa Cruz-Watsonville, Calif., with just 44.4 percent of homes sold being within reach of families earning the median income of $87,000. Other small metros at the bottom of the list included Ocean City, N.J.; San Luis Obispo-Paso Robles, Calif.; Laredo, Texas; and Santa Barbara-Santa MariaGoleta, Calif., respectively.

Housing Permits Fourth Quarter Starts Out Strong Housing production continues to climb in cities across the Greater Kansas City Metropolitan Area. The monthly graph is up and down, but the trends show the fourth quarter is off to a strong start as builders make plans for the winter months. Single family permits in October were 331, the best October since 2007. Multi-family housing production continues to climb in 2012 with the total unit number coming in at 277, according to the Home Builders Association of Greater Kansas City’s (HBA) monthly Residential Building Permit Statistics report. “Builders are encouraged with national news that indicates an increasing number of households being created at the fastest rate in six years along with price appreciation that is now occurring for homes in many neighborhoods,” said Executive Vice President Sara Corless. “Builders are making decisions now while material costs and interest rates are favorable and create significant opportunities for buyers. All reports are that fall sales have been brisk and builders must prepare for spring buying activity. In addition to this activity, custom home builders, those who build to specific needs and wants of a client, are busier than they have been in several years. ” Five counties have increased year to date in October with the highest increases in Platte County up by 109 percent, Clay County up by 75 percent, and Wyandotte County up by 74 percent, and Johnson County up by 43 percent. Top cities ranked by number of single family units year to date continue to be led by Kansas City with 534, though only 15 permits were pulled in October. Builders attributed the drop to uncertainty and costs associated with new building code that took effect October 1. Cities rounding out the top ten year to date include Olathe with 358, Overland Park with 313, Lee’s Summit with 224, Platte County with 130, Shawnee with 115, Lenexa with 105, Kansas City, Kansas with 89, Blue Springs with 80, and Leawood with 62.
