Kansas Legislative Day Despite the winter weather, KCHBA representatives and members of the Kansas Building Industry Association (KBIA) gathered in Topeka for Kansas Legislative Day on Jan. 23. The afternoon was spent visiting legislators to discuss issues of importance to the housing industry. KCHBA members split into two groups and spoke with multiple Senators and Representatives in the afternoon. KCHBA members met with legislators not pictured here, including Rep. David Benson, Rep. Kellie Warren, Rep. Jan Kessinger, Rep. Chris Croft, Rep. Stephanie Clayton, Sen. Kevin Braun, Sen. Dinah Sykes and Sen. Barbara Bollier. Building for Fun and a Good Cause The 2019 Greater Kansas City Home and Lifestyle Show will feature the “Parade of Playhouses” in the hallway leading to the show floor. All indications are yes. Single-family green residential construction market share has continued to grow, rising from 2% in 2005 to 33% in 2017. Approximately one-third of the builders surveyed in the 2017 SmartMarket Brief: Green Multifamily and Single Family Homes said that green building is a significant portion of their overall activity (more than 60% of their portfolio). And 88% of builders reported they are incorporating features to make their homes greener than they did two years ago.

Ongoing research by NAHB and its partners also shows that many home buyers are interested in green. NAHB’s report, Housing Preferences of the Boomer Generation: How They Compare to Other Home Buyers, asked home buyers across four generations — millennials, Gen Xers, baby boomers, and seniors — what features they consider essential/desirable in a new home. Energy-efficient strategies, including ENERGY STAR appliances and windows and above-code insulation, made the most-wanted list and would positively influence the purchase decision of 80% or more of all home buyers.

Economic Forecast for 2019 The Kansas City Home Builders Association kicked off 2019 with the annual Economic Forecast Breakfast, sponsored by Christensen Lumber, on January 17. Titling his presentation “Economic Slowdown Ahead”, NAHB economist Robert Dietz explained to a crowd of 250 HBA members that there may be a bumpy landing ahead, but not a hard crash. As the longest recovery in U.S. history continues, Dietz listed several factors that continue to limit growth in the housing industry: a very tight labor market, rising costs of materials, and higher interest rates. Dietz predicted that the Federal Reserve will raise interest rates once or twice in 2019. The other speaker of the morning, Chris Kuehl, agreed with this forecast, unless inflation begins to increase. Kuehl explained that the Federal Open Market Committee consists of a majority of inflation hawks and they may raise interest rates to control inflation. Dietz pointed out that the share of young adults living with their parents has almost doubled since 2000. However, due to the huge number of millennials, demographic forces will increase housing demand in the next few years as they start families and move into their own homes. In discussing the labor shortage, both economists agreed that increasing the labor force participation rate is crucial to solving the problem. However, as Kuehl pointed out, many of the workers returning to employment or those just starting a career have very limited skills. This may lead to a decrease in worker productivity, which is a particular problem in the construction industry as construction worker productivity is already lower than overall productivity.

Remodeling to Begin Soon at the HBA The coldest day in decades did not deter about 50 HBA members from attending the Tearing Down the House party on January 30. While enjoying beer, wine and appetizers, members heard from remodeling committee chair George Schluter about plans to transform the upper floor of the HBA into first class office space and updated meeting spaces. The entryway, from the lower level entrance through the hallway and up the stairs, will also be re-constructed with new flooring, glass railing on the stairs and a showpiece lighting fixture. The HBA building was constructed in 1978/79, largely through the generous support of members. The remodeling committee is excited to present an interior that will represent the beautiful homes our members build. Many members spoke during the party about the tremendous support, education and friendships they have gained through the HBA. A way to give back to the association is to contribute to the remodeling of the “World Headquarters of the KCHBA� (as Gary Kerns named the building). Contributions will be acknowledged through all avenues of HBA communication and donors will be listed on a gratitude plaque in the board room. Three Key Takeaways from CES The annual Consumer Electronics Show (CES) is considered one of the world’s biggest showcases of innovative technology. Each year brings a new batch of breakthroughs into the limelight, and 2019 show was no exception. The CEDIA Technology Council is group of volunteers who stay abreast of tech trends to help those who are responsible for integrating that technology into the home know what’s on the horizon. Here are some of the latest trends and inventive solutions the council noticed at CES earlier this month that could soon have an impact on the construction trades. Make room for even bigger TVs. You’ve heard of 4K. Get ready for 8K. This higher-resolution format is coming, according to Gordon van Zuiden owner of integration firm cyberManor. “The logic behind it is that the average size of televisions sold in the U.S. this year is around 47, 48 inches,” van Zuiden said. “That’s compared to about eight years ago when it was 36 inches, and very soon we expect the average size will be between 50 to 55 inches. When TVs get to be that size, 8K makes a lot of sense.” Homes will have a greater number and variety of sensors. More devices continue to be introduced into the home to monitor everything – not only what we say, but also our daily routines, body gestures and health. Peter Aylett of Archimedia in Dubai noted that one of the firms on the show floor, Korea’s UMAIN, was demonstrating sensors that utilized – of all things – radar: “If you’re within about two meters, a radar can detect your heart rate and your respiration rate,” Aylett said. “So in terms of monitoring kids in nurseries, monitoring the elderly, the vulnerable, the sick – this is a fantastic, non-invasive method. There are no cameras, no microphones – you can hold a conversation and this thing isn’t picking it up. It’s picking up respiration, heartbeats, physical activity, security monitoring – all through radar.” Tools are getting a lot smarter. From motion-based measuring tools, to drills that let you know what distance into material the bit has traveled (and the precise angle of the drill bit, too), clever construction tools were on full display at CES. Rich Green, a Palo Alto integrator who owns Rich Green Designs, was impressed by a measurement product from a company called Moasure. “If you wanted to measure the total fabric requirements for an acoustical space,” Green said, “you can take this little puck, move it around the room, and it’ll tell you with incredible accuracy precisely how much fabric you need.” NAHBNow, 1/22/19

NAHB Files Amicus Brief in Supreme Court Case Challenging Power of Federal Regulators ence because it can create incentives for agencies to avoid formal rulemaking processes, or create vague regulations that they can later interpret however they see fit. Either tactic prevents home builders and other industries from participating in the development of rules that govern their activities.
NAHB has weighed in on a Supreme Court case that has widespread implications for how courts handle challenges to all agency regulations. The case, Kisor v. Wilkie, addresses the issue of whether courts should defer to an agency’s interpretation of its own regulations, known also as Auer deference.
Along these lines, the NAHB brief stated: “With little or no notice, Auer allows agencies to drastically transform the regulatory foundation on which individuals and businesses have built their lives and livelihoods, and to do so with impunity.”
NAHB supported the petitioner with an amicus brief as part of a proactive strategy developed to identify cases that put this issue squarely before the Supreme Court.
The NAHB Legal Action Committee and legal staff have developed a number of strategies to ensure that NAHB is wellpositioned to influence litigation on the issues that impact NAHB members, including cross-cutting regulatory issues that influence how courts review all federal regulatory actions.
The NAHB-led coalition focused its amicus brief on the real-world consequences that can result when courts defer to agencies on their interpretations of their own regulations. Auer deference has harmed NAHB’s interest in a number of cases, including a Clean Water Act case where the court relied on Auer to affirm the finding of a violation against property owners who had constructed a ditch to build a residential subdivision.
The Supreme Court will hear oral arguments on this case in March, and a decision is expected by the end of June 2019. NAHBNow, 1/31/19

Continuing Education at the HBA On Jan. 31, students learned the major residential changes between the 2012 and 2018 IRC and received 8 hours of credit. Upon completion, they were able to identify and explain the major differences, as well as understand and apply the intent of those changes. On Feb. 1, the seminar informed participants of the requirements from the IRC to safeguard public safety, affordability, structural strength, sanitation, light and ventilation, energy conservation and safety to life and property from fire and other hazards attributed to the built environment. Appreciation goes to Russell Thornberg for traveling from Texas to Kansas City to teach these classes.

2018 Permit Activity Slows From Prior Year

Local cities and counties permitted a total of 630 single family units in November and December. The 2018 year-to-date total of 5,673 is an 8% decrease from 2017’s total, but returns to the 2016 level of permit activity, according to the Home Builders Association of Greater Kansas City’s (HBA) monthly Residential Building Permit Statistics report. Multi-family unit permits (five or more units in one building) have surpassed 2017’s total, with 3,245 units permitted in 2018 compared to 2,434 in 2017.

Attached homes continue to grow in popularity throughout the metro area with over 600 units described as either a villa or townhome permitted during 2018.

Kansas City remains the top permitting city, with 809 single family permits issued in Clay, Platte, and Jackson counties. Olathe was the second most active city, with 521 permits and Overland Park was third busiest with 385 units permitted. The Jackson county cities of Blue Springs and Lee’s Summit were the fourth and fifth busiest, with 382 and 372 single family unit permits issued, respectively. Overall, the top ten cities issued 3,574 single family permits during 2018, compared with 3,984 issued by the ten most active during 2017.
