More than 750 builders from across the nation converged on Capitol Hill for the annual National Association of Home Builders (NAHB) Legislative Conference to urge their lawmakers to support policies that will keep the housing recovery moving forward and increase housing opportunities for all Americans. “We are sending a loud and clear message to members of Congress that a strong housing market is critical to create jobs and boost economic growth,” said NAHB Chairman Rick Judson, a home builder and developer from Charlotte, N.C. In 300 individual meetings with their representatives and senators, builders discussed the following key housing issues: Tax reform. To meet the nation’s growing need for affordable rental housing and homeownership opportunities, NAHB members urged Congress to maintain its support for vital housing tax incentives, including

the mortgage interest deduction. Builders also emphasized that the Low Income Housing Tax Credit is essential to ensure that lower-income families have access to safe, decent and affordable housing. Missouri General Assembly and Kansas Legislature Wrap Up Legislative Sessions The Missouri General Assembly The 97th Missouri General Assembly adjourned on May17, 2013. Lawmakers filled more than a thousand bills during the legislative session, passed 164 bills, and are now waiting to learn whether Governor Jay Nixon will sign or veto their legislation. The Governor has until July

14, 2013 to take action. Republican lawmakers believe that the legislative session includes several “historic accomplishments” while Democratic lawmakers allege that the session was a “historic failure.” In reality, several issues remain unresolved, such as Medicaid expansion and transportation,

and lawmakers did not pass legislation supported by the local business community that they believe would have spurred economic development. Lawmakers did, however, pass legislation to fix the State’s Second Injury Fund (SIF). The SIF was created to compensate injured workers when a current Continued on page 3

KCHBA Members Advocate for Housing on Capitol Hill Several KCHBA members attended the National Association of Home Builder’s 2013 Legislative Conference on June 5th in Washington, DC, to meet face-to-face with U.S. Senators and Congressmen and Congresswomen representing constituencies in Kansas and Missouri. During the meetings, HBA members talked frankly about key issues facing the housing industry and shared information about the local housing economy. HBA members also expressed frustration with the gridlock in Congress and encouraged lawmakers to find a way to get along for the good of the country. Under the new law, the SIF will not cover employees of uninsured workplaces. This should create an incentive for all businesses to contribute to the SIF, creating a larger pool of money for those who tap into the fund. The law also narrows the list of injuries that qualify for compensation and establishes a supplemental surcharge on employers not to exceed 3 percent of net profits on businesses through 2021 to fund the SIF. The Missouri General Assembly also passed legislation to significantly cut personal income and corporate tax rates. The legislation would reduce the personal income tax rate from 6 to 5.5 percent over the next 10 years, and the corporate income tax rate from the current 6.25 to 3.75 percent over the next 5 years, cutting tax revenue by approximately $700 million per year. The Kansas Legislature One of the lengthiest legislative sessions in Kansas ended in the early morning hours on June 2, 2013. Over the 99-day legislative session Kansas lawmakers passed sweeping tax legislation, a two-year budget, limits on prevailing wages and changes to unemployment insurance. The legislative session got off to an alarming start for the housing industry when Governor Sam Brownback proposed to do away with the state mortgage interest (MID) and property tax deductions to pay for eliminating all state income taxes. What followed was a lengthy debate on taxes between the Governor and Kansas Senate on one side and the House of Representatives on the other side. The Kansas Building Industry Association and Kansas Realtors spent months meeting with state lawmakers and raising public awareness on the legislation.

In the end, the Kansas legislature passed a plan that was very different than the plan originally proposed by the Governor. The plan that was signed into law maintains the MID and property tax deductions for current and future homebuyers and reduces their value roughly in proportion to the income tax cuts received from 2012-2018. The bill also provides for future income tax cuts for the years 2014-2018, ultimately resulting in a lower tax bracket of 2.3 percent and a top tax bracket of 3.9 percent, and permanently sets the sales tax increase at 6.15 percent. With the exception of charitable deductions, all deductions will be treated the same in this tax plan. In sum, housing is not bearing the entire burden of generating revenue to pay for future tax cuts.

Credit for housing production. Despite the recent upturn in housing, builders in many markets are still unable to obtain construction loans for viable home building projects. NAHB called on lawmakers to support House bill H.R. 1255 sponsored by Reps. Gary Miller (R-Calif.) and Carolyn McCarthy (D-N.Y.) and companion Senate bill S. 1002 introduced by Sens. Robert Menendez (D-N.J.) and Johnny Isakson (R-Ga.) that would help resolve the ongoing credit problems for builders.

The Lenexa City Council recently reinstated an incentive program aimed at spurring single-family residential development in Lenexa. This limitedtime incentive includes a $750 flat fee for building permit and plan review for the first 300 new single-family home permits issued over the next 12 months. This is the second time Lenexa will offer the flat fee program. The City offered a similar program beginning in June 2012, which was hugely successful. With the help of the flat fee program, Lenexa saw a significant increase in the number of new homes built in the community and issued 200 new single-family permits in less than one year. Building permit fees vary depending upon the size of the structure and/or standard or estimated construction costs. Plan review fees are 20 percent of the calculated permit fee. Here are some examples of the significant savings for homebuilders and new homeowners in Lenexa: A $200,000 house has building permit fees of $795 plus the plan review of $159 for a total of $954. New fee: $750; savings: $204.

A $300,000 house has building permit fees of $995 plus the plan review of $199 for a total of $1,194. New fee: $750; savings: $444. A $400,000 house has building permit fees of $1,195 plus the plan review of $235 for a total of $1,430. New fee: $750; savings: $680. “The idea is that a potential savings of $200 to $1,000 or more will give a homebuilder, developer or potential new resident an extra enticement to choose Lenexa,” said Beccy Yocham, Community Development Director. “Because last year’s program was so successful, we wanted to again offer a flat fee to continue growth in Lenexa.” The goal is to issue 300 building permits under the program by this time next year. Builders can begin applying for permits under the new fee structure now. The incentive will end when 300 permits have been distributed or one year from June 20, whichever comes first. Either way, developers contemplating this offer should act quickly. For more information, contact Lenexa’s Community Development Department by calling 913.477.7500.

HBA Continues to Build Support for BUILD-PAC

The HBA is still accepting contributions towards BUILD-PAC, the National Association of Home Builder’s Political Action Committee, which exists to help elect pro-housing candidates at every level of government. HBA PAC and BUILDPAC members are particularly interested in recruiting new members to the Gold Key Club (the $1,000 contribution level). NAHB received 22 new Gold Key Club members during the recent Spring Board

meeting in Washington, DC, increasing Gold Key Club membership to 500 members. NAHB’s goal is to reach 550 Gold Key members by the 2013 Fall Board meeting. The KCHBA is doing its part. HBAPAC members held a fundraiser in

April 2013 and contributed the cost of mulligans at the HBA Golf Tournament towards BUILD-PAC. International Builders Show Gears Up for Mega-Exhibit

Gearing up for the return of a healthy home building and remodeling market, manufacturers and suppliers have stepped up plans for exhibit spaces for the new Design and Construction Week, when the International Builders’ Show (IBS) and the Kitchen and Bath Industry Show (KBIS) join forces for a mega-exhibit in Las Vegas Feb. 4-6, 2014. Exhibit sales are up by 16 percent over last year, and that’s good news for attendees of both shows: IBS, presented by the National Association of Home Builders, and KBIS, the annual show of the National Kitchen and Bath Association – already the two leading trade events in the residential design and construction market. Since the announcement earlier this year IBS and KBIS would co-locate to create the first annual Design and Construction Week, IBS has already reeled back in more than 60 companies that had left the show during the building downturn. The result: more than 20,000 square feet of new exhibit space. Nearly 90 other companies have increased the size of their exhibit spaces

by more than 30,000 square feet. Exhibit space for KBIS is already 90 percent sold. “Design and Construction Week offers manufacturers and suppliers the unique opportunity to reach two very large audiences for the cost of exhibiting in one trade show,”said Mark Pursell, NAHB’s senior vice president of Exposition Marketing & Sales. “That, combined with an improving housing market, is translating into these bigger exhibit space sales. We are seeing more and more companies returning to exhibit after sitting out for several years.” Among the companies back in the show: Electrolux Home Appliances, Pro Build Holdings, Masterbrand Cabinets, BSH Appliances, Caesarstone USA, Rinnai and Viega. “Clearly, the co-location of these two great events, together with the steady climb in home building and remodeling projects, are being well received by our industry’s’ manufacturers and suppliers,” Pursell added. The first annual Design and Construction Week takes place Feb. 4-6, 2014 at the Las Vegas Convention Center, Las Vegas.

May Extends Upward Trend in New Home Construction Builders broke the 400 permit mark in April and missed that mark in May 2013, but statistics still reflect the best May since 2007 with 337 single family permits. This brings the year to date total to 1,613 which is a 33 percent increase over 2012 which was 1,211, according to the Home Builders Association of Greater Kansas City’s (HBA) monthly Residential Building Permit Statistics report. Multi-family permits totaled 169 during May with year to date of 1,450 which is the most since 2001. “Though the May numbers were a little short of April’s, the market is still continuing to improve,” said Executive Vice President Sara Corless. “May, June and July are all big months for home sales and closings so we will know more after this selling season, but every indicator is looking good and builders are going strong.” Every county showed an increase over the 2012 permits. Johnson County is leading the way year to date with 664 permits followed by Jackson County with 296, Clay County with 267, Platte County with 151, Wyandotte County with 78, Cass County has 67, Leavenworth with 65, and Miami County with 25.
