The Economic Forecast Breakfast in January gave members valuable planning information from two well-known economists. The International Builders Show (IBS) celebrated Tom Woods as he closed out his year as chairman of the National Association of Home Builders. Late in January, the annual Kansas Legislative Day offered members the chance to meet with legislators face-to-face and

discuss current issues affecting home builders. Elliot Eisenberg returned to Kansas City in February with his message, “The Economy in 2016: Much Like 2015”. The meeting of the Missouri North Area Council re-instituted the regular meetings of our three area councils as members were updated on development in the northland. HGTV celebrities Chip and Joanna Gaines brought huge crowds to the Greater Kansas City Home Show in March. The Home Show also featured Darol Rodrock’s Farmhouse in the landscape square. April was an especially busy month

OSHA’s longstanding position has been that an employer’s duty to record an injury or illness continues for the full five-year record-retention period. In 2012, the D.C. Circuit Court decided in AKM LLC v. Secretary of Labor (Volks) to reject OSHA’s position on the continuing nature of its prior recordkeeping regulations. Per OSHA, the new final rule more clearly states employers’ obligations. It does not add any new compliance obligations, nor does it require employers to make

However, the Recordkeeping Clarification Notice of Proposed Rulemaking (NRPM) runs contrary to the Occupational Safety and Health Act of 1970, and therefore should be withdrawn. OSHA does not have the statutory authority to promote or enforce a regulation that changes a clear statutory mandate. The agency had an opportunity to solidify its position through the judicial branch by appealing the Volks decision, but chose not to do so. Absent a legislative fix by Congress, OSHA cannot ignore the judicial decision which found its position without merit and “simply implausible.” For these reasons, NAHB urges OSHA to reconsider its position, and withdraw the Recordkeeping Clarification NPRM immediately. Employers Face Earlier W-2 and 1099 Deadlines As tax season approaches, it’s a good idea to keep two big payroll tax filing changes in mind:

Kansas Legislative Update

The HBA of Missouri met in Kansas City on Wednesday, Nov. 16 to create a policy agenda for 2017, review the HBAM budget, renew the state lobbyist contract, and discuss the incoming HBAM leadership. The presidency rotates on a yearly basis among the participating HBAs. Mark Simpson with the HBA of Southwest Missouri (Joplin) will be the 2017 President, succeeding Matt Bailey from Springfield. Misty Hanson from the KCHBA will continue to serve as Secretary/Treasurer and Gary Kerns will be the new President-Elect, meaning Kansas City will lead HBAM in 2018. George Schluter will continue to serve as the Missouri State Builder National Director and Misty Hanson as the Missouri State Associate National Director for NAHB.

The Kansas Building Industry Association (KBIA) met Dec. 7, 2016 to plan for the upcoming legislative session and discuss the 2017 housing policy agenda for the state. The group also discussed the KBIA budget, rev i e w e d NAHB’s plans for IBS, and received a local report from each Kansas HBA. The 2017 Kansas Legislative Day in Topeka will be Jan. 25. It will start with a Board meeting in the morning, Capitol visits in the afternoon, and will end with a legislative reception from 4:30 to 6:30 pm.

The annual HBAM Legislative Day in Jefferson City has been tentatively set for Feb. 15, 2017. Participating in legislative day is one of the best ways members can directly connected with legislators and encourage them to support the interests of the housing industry.

When the state legislative session begins on Jan. 4, it is likely that one of the first priorities of the legislature will be to pass Right to Work labor reform, which is also supported by Governor-Elect Eric Greitens. Other possible actions include expanded ethics reform, tort reform, prevailing wage legislation, and a discussion about phasing out corporate income tax. The legislature will also face some tough choices on school funding and how to pay for infrastructure improvements.

There have been several noteworthy changes in the Kansas Legislature recently, including the election of Representative Ron Ryckman, Jr. to be Speaker of the House of Representatives. His district is located in Olathe, where he still serves on the City Council. Over the years, Representative Ryckman has maintained a good relationship with the HBA. Another local legislator and friend to the HBA, Representative Erin Davis – also representing part of Olathe – has been chosen to serve as ViceChair of Appropriations. The position is especially significant this session considering the crucial budget and tax questions facing the legislature. Sixty new legislators will be serving in the Kansas House and Senate this year, making it difficult to predict what actions might be taken and when. However, the most crucial legislation will revolve around the issues of budget and tax reform as the state continues to struggle with a severe budget deficit.

In 2017, classes such as the Certified New Home Sales Professional (CSP), Master Certified New Home Sales Professional (MCSP), and the Certified Aging in Place Specialist (CAPS) will not only provide attendees with certification but also count toward their required accreditation hours for the year.

Kansas City Area Single Family Permits Top 5000 Kansas City, MO—Kansas City area home builders continued their increased activity, with 412 single family units permitted during November, bringing the year-to-date total to 5,144, according to the Home Builders Association of Greater Kansas City’s (HBA) monthly Residential Building Permit Statistics report. This is a 20% gain over last’s years January through November permit count. “Builder sentiment is strong and we can look forward to growth in the single-family market in the year ahead as the industry adds workers and lots and Washington policymakers provide regulatory relief for small businesses.” said National Association of Home Builders Chairman Ed Brady. Several area cities have experienced remarkable growth in permits during 2016: Belton with 102 units in 2016, compared to 13 in 2015; Harrisonville has increased from 10 to 52; and Louisburg has issued 46 permits this year with only 7 last year. Overall, the 10 busiest cities have a 16% increase – with a total 2,918 permits issued by them in 2015 and 3,375 issued in 2016. Kansas City continues to top the list with 1,024 permits; it is followed by Olathe, Overland Park, Lee’s Summit and Kansas City, KS/Wyandotte County.

From 1937 to 2017: 80 Years of the HBA Before there was the Home Builders Association of Greater Kansas City there was the “builder division” of the already existent National Association of Real Estate Boards (NAREB), which was the precursor to the National Association of Realtors. In 1937, fewer than 100 Kansas City area builders designated themselves as the builder division of NAREB and served as the originators of what would become the KCHBA.

As of the end of 1948, there were 53 builder members and 63 associate members and the association ended the year with a deficit of $1,329 from total income of just under $11,000. During this 80th anniversary year of the Home Builders Association, each month’s BBN will feature a look back at the HBA’s history. Members who have photos or artifacts are encouraged to share them with HBA staff as we celebrate and remember the association’s past.
