The 2016 ICC Annual Conference and Group B Public Comment Hearings took place in Kansas City from October 16-25 at Bartle Hall. The conference featured a Building Safety & Design Expo, education sessions, and drone classes and demos. The purpose of the public comment hearings was to shape the 2018 International Code Council’s model building codes. More than 2,000 proposals from builders, manufacturers, energy efficiency advocates, fire officials and trade partners were heard throughout the week. Those that survived the process are now one step closer to becoming new building codes.
The hearing process allowed for testimony from both supporters and opponents of the proposals, and included time for rebuttals on controversial topics. Testimony was provided by a range of interested groups, including representatives from the energy sector, city code officials, engineers, associations, and individuals. NAHB provided testimony in support of positions on a number of the codes dealing with energy and structural provisions. Once all the positions were heard and evaluated, the proposals were voted on by ICC members, usually with a show of hands or by a standing count if the vote is close to a tie.
The KCHBA welcomed special guests in town for the hearings at the October Board of Directors meeting. We heard from Phil Hoffman – Chairman of Construction, Codes and Standards, NAHB; Chip Dence – Vice Chairman of Construction, Codes and Standards, NAHB; and Randy Noel – 2nd Vice Chairman of the Board, NAHB. They urged members to attend the code hearings to “learn how the sausage is made.” The KCHBA is grateful to all members who attended the hearings and to George Schluter, who works tirelessly to monitor the code process.

HBA builders and engineers met with the KCMO Planning and Development Department recently to preview its new online permitting system, Energov. The goal is to streamline plan reviews and the permitting process by moving the entire process online. The system will be able to send automatic email notifications and will include a messaging

Members also used the time to discuss specific concerns they have with the city, which is currently struggling with phone issues, inspections, plan review delays, and being understaffed. City officials are aware of the problems and are working towards both short and long term solutions. For example, Jeff Lee has returned to working on plan reviews, which should help eliminate inconsistent feedback. The city is also adding a new position for a Development Concierge, who will help streamline the process and direct development and building questions to the appropriate department contacts. 2

Political Forecast Breakfast: Insights into the State Races

The HBA’s political action committee, HBA-PAC, hosted a Political Forecast Breakfast on Oct. 12 at Milburn Country Club. Two prominent and well respected political journalists, Martin Hawver and Dave Helling, focused primarily on state level politics. Hawver, editor and publisher of Hawver’s Capitol Report, reported that the election of moderate Republicans and Democrats over more conservative Republicans – a trend that occurred during the primary elections – is likely to continue in November’s election. However, neither chamber will likely have enough moderates elected to reach veto-override levels, allowing Governor Brownback to maintain a significant level of influence over state actions. Hawver commented that the Governor remains an unpopular figure in the state legislature and that many candidates have actively avoided campaigning with him. Hawver pointed out that the most significant action in the 2017 Kansas Legislature will revolve around the issues of budget, taxes, and school funding issues. If the current State Supreme Court Justices are retained and the court orders more money spent on K-12 education, the legislature will likely have to turn to income taxes or property taxes to help cover costs. Finally, Hawver commented that those involved in the home building industry should pay special attention to the LLCs’ current tax exempt status – the legislature may be looking to add those back on the state income tax rolls. Dave Helling, three-time Emmy nominated journalist and multimedia reporter for the Kansas City Star, began by summarizing the most interesting races on

The U.S. Senate election between incumbent Senator Roy Blunt and current Secretary of State Jason Kander has been surprisingly close – recent polls put them one or two points apart. Helling still predicts Blunt to be the favorite, but acknowledges that Kander has run a “masterful campaign,” between the popular gun ad and calling for a generational change in Congress.

Helling also noted that the gubernatorial race between Attorney General Chris Koster and political newcomer Eric Greitens is now the most expensive governor’s race in the country. It seems clear that whoever is elected to this office will determine whether or not Missouri will become a Right to Work state. The other statewide races are mostly seen as toss-ups. Most of the winning candidates in Missouri state legislative races are already determined as almost half of the Senate seats and two thirds of the House races are uncontested. Therefore, it is safe to say the Republicans will maintain their majority.

The NAHB Defender of Housing Award recognizes federal legislators who have demonstrated strong support for housing and NAHB positions on key issues facing the industry. The award, fashioned in the likeness of a traditional house key, is awarded biannually. NAHB created the Defender of Housing Award on behalf of the more than 700 state and local HBAs across the country that make up the NAHB Federation. Planning for Growth in South Kansas City The October meeting of the Missouri South Area Council focused on development opportunities in the region as the Cerner campus brings 16,000 employees to the area over the next decade. Joanne Burns, Cerner’s Senior Vice President and Chief Strategy Officer opened the meeting with an overview of the campus plans and timeline for the buildout. Did you know the buildings are designed to resemble the punch cards that operated computers in the 1970’s? Stacey Johnson-Cosby, president of the South Kansas City Alliance, then introduced a survey conducted of Cerner associates regarding their current and future housing preferences. Kellie Johnston Dorsey and Joe Blankenship, both with Kansas City Planning and Development, provided more details from

Derek Ramsay, Kansas City Regional Association of Realtors, compared the Cerner associates’ preferences to amenities and housing that are currently available in the area. The conclusion reached by these speakers: there is a great deal of opportunity for home building and business development in the south Kansas City area.

New Overtime Regulations NAHB and a coalition of more than 55 Texas and national business groups have filed a lawsuit against the U.S. Department of Labor seeking to halt its federal overtime rule set to take effect December 1. Earlier this year, the DOL issued the rule, which will double the current overtime salary limit of $23,660 to $47,476. It also allows the minimum salary requirements to be raised every three years. NAHB and many groups not in favor of the rule have warned that such a huge jump in such a short period of time could actually hurt a significant number of the Continued on page 9

November Elections For the first time in its 74-year history, NAHB officially endorsed candidates for the U.S. House and Senate in the upcoming Nov. 8 elections. Along with endorsing Sen. Roy Blunt (see story on page 11), the NAHB urged the re-election of: Rep. Emanuel Cleaver II, Rep. Sam Graves, and Rep. Vicky Hartzler. “As housing goes, so goes the economy,” said NAHB Chairman Ed Brady. “This election could determine if the housing and economic recovery stays on track or veers off course. The incumbents and candidates from both political parties that NAHB will be endorsing have all exhibited a commitment to
advance policies that will promote homeownership and rental housing opportunities for all Americans.” When the 115th Congress convenes in Washington early next year, there will be plenty of unfinished housing business awaiting lawmakers. NAHB believes that Congress must focus on: Reforming and streamlining the regulatory process.

spur economic growth.” Senator Blunt addressed concerns about burdensome government regulations at the event, specifically citing the EPA’s Waters of the U.S. Rule – an attempt to drastically expand its jurisdiction over virtually all bodies of water and make them subject to federal regulation. Blunt stated that he is opposed to “out of control regulators” and desires a process to make new regulations be approved by a congressional vote.

Homeownership Rate Edges Up According to the Census Bureau’s Housing Vacancy Survey (HVS), the U.S. homeownership rate rose to 63.5% in the third quarter 2016, reversing the downward trend of homeownership rate nationwide. It is 60 basis points higher than the rate in the second quarter 2016, which is largely driven by the increase in the millennial and 65+ homeownership rates. Compared to the peak at the end of 2004, the homeownership rate has steadily decreased by 5.7 percentage points and remains below the 25-year average rate of 66.2%. The millennial homeownership rate increased by 1.1% after reaching its own historically lowest level of 34.1% in the second quarter 2016. It suggests that millennials are gradually returning to the housing market.

Compared to a year ago, homeownership declined among all age groups except for those ages 35 to 44 and over 65 since a year ago. Permit Activity Remains Strong in 2016 The third quarter of 2016 ended with 418 permits issued during September, according to the Home Builders Association of Greater Kansas City’s (HBA) monthly Residential Building Permit Statistics report. Year-to-date total permits are the highest in nine years with 4,270 single family permits compared to 2015 with 3,449. Permit activity through September has increased 24% as compared to 2015 at this time. Multi-family construction is at its highest level in a decade, with 459 units permitted during September, bringing the year-todate total to 3,521. With every county in the eight-county region reporting an increase in permits from 2015, home buyers should be able to find a new home in any area of the metro. Cass County, in particular, has more than doubled in the number of permits issued this year with the cities of Belton, Harrisonville, Peculiar, Pleasant Hill, Raymore, and unincorporated areas of the county all showing double digit increases in permit numbers. Growth north of the river allows Kansas City, Missouri to continue to top the list of area cities in number of permits issued with 887 (an increase of 169 from 2015); it is followed by Olathe with 469, Overland Park with 341, Lee’s Summit at 271 and Kansas City, KS/Wyandotte County rounding out the top five at 201.

OSHA Seeks Feedback on Revisions to Recordkeeping & Construction Standards The Occupational Safety and Health Administration (OSHA) recently proposed revisions to its existing recordkeeping and construction standards as part of the agency’s Standards Improvement Project (SIP). The goal of the SIP is to remove or revise outdated, duplicate, or unnecessary requirements in OSHA’s standards, which will help reduce regulatory burdens on employers while still protecting workers.

The following revisions could affect the home building industry: • Excluding detached, single-family residences and townhouses from a requirement to post the maximum safe load limits of floors in storage areas. (Residential construction employers would still be required to ensure that any loads placed on floors do not exceed the maximum safe loads of the floors.) • Adding a clarification that employers must protect their employees from loose rock or soil and excavated or other materials or equipment that could fall or roll into an excavation. • Revising the recordkeeping requirements for occupational hearing loss, so that if an event or exposure in the work environment either caused or contributed to the hearing loss or significantly aggravated a preexisting one, the case must now be considered work-related. OSHA also clarified that it is not necessary for work to be the sole cause, predominant or even a substantial cause of the hearing loss: Any contribution from work makes the 16
• Revising the requirements for signs and devices used to protect workers near automobile traffic by incorporating by reference the 2009 Department of Transportation’s Manual of Uniform Traffic Control Devices. • Revising the requirements for rollover protective structures to comply with current consensus standards for newly manufactured equipment. • Eliminating the requirement that employers include an employee’s social security number on exposure monitoring, medical surveillance and other records. This revised rule would help to better protect employee privacy and prevent identity fraud.
