OSHA 10 Hour Training & Lead: Renovation, Repair and Painting Program HBAL has applied for grants to offer another OSHA 10 Hour Training class as well as a Lead: Renovation, Repair and Painting Program. The classes have been tentatively scheduled for Sept. 14 & 15 and Sept. 22 respectively. Seating is limited, so contact Jennie at 402-423-4225 or jennie@hbal.org if you would like to attend. Only one person from each member company is allowed to attend and a $25 deposit is required to hold your reservation.

I greatly appreciate HBAL’s contributions. This scholarship will help pay for my tuition at SCC in Milford where I just finished up my third quarter, which consisted of drafting and estimating. Then I will be moving on to cabinet making next quarter. I honestly have no specific plans on what I want to do with my life after I graduate from the Building Construction program. All I know is that I will be pursing some sort of career in the construction industry, and I am keeping my options open. Once again, thank you for your contributions to our scholarship fund and all you do for the NAHB student chapter in Milford. Governor Promotes New Opportunities Created by Talent & Innovation Initiative Businesses Can Now Apply for InternNebraska

Gov. Dave Heineman visited Scottsbluff and Kearney on June 6, 2011 to highlight opportunities for Nebraska businesses to benefit from new tools to help businesses harness technology and research in expanding their workforce. The four-part Talent & Innovation Initiative was created to advance business innovation and strengthen workforce recruitment in Nebraska. “The Talent and Innovation Initiative provides tools to help build Nebraska’s innovation economy,” Gov. Heineman said. “We are reaching out to let Nebraska communities from border to border know about the new opportunities available. We want to develop business opportunities in industries positioned for growth in Nebraska, and we want to attract new, technology-focused companies to our state.” The Talent & Innovation Initiative was developed to enhance momentum in Nebraska’s fastest growing industries and others positioned to integrate new technologies. It increases internship opportunities for college students, promotes business innovation, invests in new sites and buildings for commercial development, and encourages investment in Nebraska’s high-tech and start-up businesses. businesses, giving 500 to 750 college students an opportunity to gain job experience. It provides a 40 percent match in urban areas and a 60 percent match in rural areas for an eligible business that create up to 10 new student internship opportunities. Students must be enrolled full-time at a college or university, and be a junior or senior or be in their second year at a community college. Eligible internships must pay at least minimum wage and can range from 12 week to year-long programs. The program began June 1. Businesses creating summer internships can submit applications, as well as those planning for fall 2011 and spring 2012 internships. Funded with $1.5 million a year, awards will be made on a firstcome, first-serve basis. Additional information is available at www.InternNE.com. Other Talent & Innovation measures include a new: • Business Innovation fund, available starting in October, will help companies develop and introduce new technologies to their business model. It will provide competitive grants for businesses to work with Nebraska research institutions on prototype development, commercialization and applied research projects. Funding will also be available for small business and entrepreneur outreach efforts. • Site & Building Development funding will help the state partner with local communities to provide resources that create ready-to-go industrial and commercial sites for expanding businesses. Projects can assist with demolition, new construction and rehabilitation. State funding will be focused on land and infrastructure costs with 40 percent of funding dedicated to projects outside Douglas, Lancaster and Sarpy Counties. The program will be available starting Oct. 1. • The Angel Investment Tax Credit encourages investment in high-tech and other startup enterprises in Nebraska by providing refundable state income tax credits to qualified investors of early-stage companies. Capped at $3 million annually, the program requires a minimum investment of $25,000 for individuals and $50,000 for investment funds. Eligible businesses will have fewer than 25 employees with the majority based in Nebraska. Information will be available in August, ahead of the program’s Sept. 1 implementation. Eligibility for some programs may be limited to companies in targeted industries, including: agricultural machinery, food processing, renewable energy, biosciences, health sciences, precision metals manufacturing, transportation-warehousing and logistics, research and development, hospitality and tourism, business management, financial services, and computer and software service providers.

Stretch IRAs

Provided by John Oestreich, Waddell & Reed The term “stretch IRA” has become a popular way to refer to an IRA (either traditional or Roth) with provisions that make it easier to “stretch out” the time that funds can stay in your IRA after your death, even over several generations. It’s not a special IRA, and there’s nothing dramatic about this “stretch” language. Any IRA can include stretch provisions, but not all do. Why is “stretching” important?

Earnings in an IRA grow tax deferred. Over time, this tax-deferred growth can help you accumulate significant retirement funds. If you’re able to support yourself in retirement without the need to tap into your IRA, you may want to continue this tax-deferred growth for as long as possible. In fact, you may want your heirs to benefit--to the greatest extent possible--from this taxdeferred growth as well. But funds can’t stay in your IRA forever. Required minimum distribution (RMD) rules will apply after your death (for traditional IRAs, minimum distributions are also required during your lifetime after you reach age 70½). The goal of a stretch IRA is to make sure your beneficiary can take distributions over the maximum period the RMD rules allow. You’ll want to check your IRA custodial or trust agreement carefully to make sure that it contains the following important stretch provisions.

This is where the IRA language becomes crucial. If, as is commonly the case, the IRA language doesn’t address what happens when your beneficiary dies, then the IRA balance is typically paid to your beneficiary’s estate. However, IRA providers are increasingly allowing an original beneficiary to name a successor beneficiary. In this case, if your original beneficiary dies, the successor beneficiary “steps into the shoes” of your original beneficiary and can continue to take RMDs over the original beneficiary’s remaining distribution schedule. What if your IRA doesn’t stretch?

You can always transfer your funds to an IRA that contains the desired stretch language. In addition, upon your death, your beneficiary can transfer the IRA funds (in your name) directly to another IRA that has the appropriate language. And if your spouse is your beneficiary, he or she can also roll over the IRA assets to his or her own IRA, or elect to treat your IRA as his or her own (if your spouse is your sole beneficiary). Because your spouse becomes the owner of your IRA funds, rather than a beneficiary, your spouse won’t have to start taking distributions until he or she reaches age 70½. And your spouse can name a new beneficiary to continue receiving payments after your spouse dies. Stretching your IRA--a case study

Jack dies at age 78 with an IRA worth $500,000. He had named his surviving spouse, 69-year-old Mary, as his sole beneficiary. Mary elects to roll over the funds to her own IRA. This is particularly true for long-term investments. It is important to note that investments offering the potential for higher rates of return also involve a higher degree of risk to principal. • All earnings are reinvested, and all distributions are taken at year-end. • The projected figures assume that Mary takes the smallest distribution she’s allowed to take under IRS rules at the latest possible time without penalty. • The projected figures assume that tax law and IRS rules will remain constant throughout the life of the IRA. A word of caution While you might appreciate the value of tax-deferred growth, your beneficiary might prefer instant gratification. If so, there’s little to prevent your beneficiary from simply taking a lump-sum distribution upon inheriting the IRA, rather than “stretching out” distributions over his or her life expectancy. It’s possible, though, to name a trust as the beneficiary of your IRA to establish some control over how distributions will be taken after your death. Time is running out to sign up to golf in the Remodelers Council Scholarship Golf Tournament to be held August 5 at Hidden Valley Golf Course. The proceeds from the tournament are used for scholarships for high school students entering the construction industry. The tournament is a great way to support the industry. If you haven’t signed up to golf, and are interested call Kayla at the HBAL office for more information. If you’re not a golfer, but want to help we can always use volunteers. If you are looking for a good way to network with fellow members, even if you are only available for a couple hours let Kayla know. We’ll even feed you lunch for volunteering! On another note, the week of August 22 is National Safe at Home Week. Use this as a reminder to update first aid kits in your house, your vehicles and your work sites; exchange expired items and stock up on used items. HOW IT WORKS

• This will be a Sporting Clay event with a “Shot Gun” start. • 100 rounds per person with 15 stations (12 gauge shells provided). • Boots, jeans, casual wear . . . dress appropriately for the weather and lots of walking. • Eye protection and ear plugs required - available at club house if needed. • Bring 12 gauge shot gun - limited number available at club house if needed. • Must be present at 12:30 p.m. for Rules & Regulations to shoot. • Teams of approximately 5 will complete the course shooting “true pairs,” “report pairs,” etc. • Scores will be tallied for various prizes and recognition. • Prizes and drawings awarded during BBQ. • Warm-up Trap and Novice Lessons available starting at 10:30 a.m. • Side games to be announced.

The Lincoln Home Builders Care Foundation was established in 2009 as a 501(c)(3) charitable, non-profit organization dedicated to the future of the home building industry in Lancaster County. The Lincoln Home Builders Care Foundation's mission is to support the educational and charitable activities of the Home Builders Association of Lincoln. The Foundation strives to support the community by contributing to community service projects focused on housing, as well as providing scholarships for students pursuing a career related to the building industry, and providing funding for other industry related educational programs. The Foundation will accept tax deductible contributions to establish scholarships and other programs. Proceeds from the annual golf tournaments and the October sporting clay shoot will be directed to the Foundation.

National Emergency Grant for On-the-Job Training

National Emergency Grant for On the Job Training The Nebraska Department of Labor Lincoln Career Center is currently offering a National Emergency Grant to offer on-the-job training to employers and job seekers meeting the qualifications for participation. If qualified, employers may be reimbursed for the training period of new hires up to 90% of the wages paid during the training period, depending on the size of the employer, the level of training and the position. Generally speaking, the positions that qualify for this grant are beyond entry level and require some specialized or specific training to enable the new hire to fully perform the duties of the position. It does require the job to be posted in the Department of Labor’s NEworks system, and their Business Service Representatives can help with that process or employers may post their own positions in the system by going to https://neworks.nebraska.gov. So far, they have been successful in assisting employers in IT, sales and marketing and medical services, but they will look at any area of employment that has a significant training component, offering full time employment. Candidates for the positions must have been unemployed for at least 16 weeks, as verified by Unemployment Insurance. Employers may refer/recommend individuals to us to determine if they meet the qualifications for participation in the grant and/ or the Lincoln Career Center can refer qualified candidates. The employer identifies the basic skills needed to be considered for employment, makes the hiring decisions and determines the training curriculum and the Lincoln Career Center works with the employer to determine the training time, the skill level classification and rate of reimbursement. The On-The-Job-Training (OJT) contract must be signed before the candidate actually begins the job. The grant is available until June 30, 2012, but considering training times, etc. the Department of Labor needs to have the OJT’s in place by the end of this year. Criteria Necessary to Qualify Employers: • Private sector or Private non-profit sector. • Must be for full time employment. • Employer evaluates skill gap of referred candidate(s) and makes the hiring decision. • Wage reimbursement of training period (maximum 6 months) based on employer size (size of employer based on ONE geographical site location – site could be one store of a national chain, or site could include 60 acres of plant structures counting all employees). - 1 – 50 employees = up to 90% wage reimbursement - 51 – 250 employees = up to 75% wage reimbursement - 251 or more employees = up to 50% wage reimbursement • Length of training determined by the skill gap of trainee. • Hiring/firing decisions remain with the employer and based on criteria used for all employees. • Wage reimbursement cannot exceed state’s average wage of $17.94 per hour. Candidates: • Dislocated worker unemployed for at least 16 weeks. • Veterans meeting the initial requirements are priority participants. • Must possess the basic skills needed to be successful in the position – skill gap to be addressed in training determined by the employer.

Remodelers working in pre-1978 homes must comply with the rule — which includes becoming an EPA-certified renovator and following the lead-safe work practices required under the regulation — or risk fines of as much as $37,500 per violation per day and litigation. Be Aware and Be Ready

The EPA’s regional offices have begun inspections and are initiating enforcement under the lead rule. Last month, enforcement actions were initiated against a Rockland, Maine, contractor whose employees were caught on video scraping paint from the side of an older home without using lead-safe work practice and otherwise complying with the rule. All contractors — remodelers, HVAC contractors, window replacement specialists, etc. — working in pre-1978 housing units where painted surfaces are disturbed, must understand the requirements of the lead rule and be able to demonstrate compliance to an EPA inspector. NAHB has learned that inspectors are requesting three years of records from firms under investigation. These records include: • Signed copies (by the home owner/tenant of applicable projects) of EPA’s Pre-Renovation Disclosure Form (www.epa.gov/opptintr/lead/pubs/pre-renovationform.pdf), affirming they have received pre-renovation education from the EPA’s “Renovate Right” pamphlet (www.epa.gov/opptintr/ lead/pubs/renovaterightbrochure.pdf). This requirement predates the lead rule and remodelers need to have three years of applicable records on file. • A copy of “Firm Certification” by the EPA or an EPAdelegated state (list of EPA-Delegated states can be found here: www.epa.gov/lead/pubs/renovation.htm#authorized) and a copy of “Certified Renovator Certificate,” also issued by the EPA or delegated state. Remodelers must have both these certifications on file and all certified renovators must be employed by a certified firm. Failure to have both these certifications can result in fines. Rehberg Amendment Passes EPA Enforcement Funding May Be Cut

In a rare voice vote, the House Appropriations Committee approved an amendment offered by Rep. Denny Rehberg (R-Mont.), that would limit funding for enforcing the U.S. Environmental Protection Agency’s Lead: Renovation, Repair and Painting rule until the agency approves a more accurate lead paint test kit. While the measure must be approved by the House and then the Senate before it goes to the President’s desk, the amendment is a great step forward for the NAHB-led coalition seeking commonsense answers for compliance and enforcement of the lead rule, which applies to homes built before 1978. In addition, the amendment is testament to the power of NAHB Remodelers, who immediately called and emailed Members of Congress who serve on the Appropriations Committee to ask for their support after NAHB alerted them Monday night to the vote. “I’m very pleased that the committee understood how important it is to rein in these EPA excesses,” said NAHB Remodelers Chair Bob Peterson, CGR, CAPS, CGP, a remodeler in Fort Collins, Colo. “NAHB members strongly support the intention of the lead paint regulations, but without a reliable test kit, the required lead-safe work practices add only expense, and not additional protection.” This amendment is a first step in limiting the EPA’s enforcement of the lead rule. While passage through the House and Senate will be an uphill battle, the message to the EPA is that the agency should heed the concerns of professional remodelers about the lead rule. EPA Rejects Proposal to Add Third-Party Clearance Testing In good news received by NAHB on July 15, the Environmental Protection Agency announced that it was rejecting a proposal to add third-party clearance testing to requirements under the Lead: Renovation, Repair and Painting Rule. In an official statement applauding the move, NAHB Remodelers Chairman Bob Peterson said, “We’re pleased that the EPA listened to the concerns of remodelers about the extreme costs and lack of safety improvements that the proposed clearance testing would have entailed.” Currently, the lead rule applies to homes built prior to 1978 and requires renovators and their firms to be certified in EPA’s lead-safe practices, perform so-called “visual clearance” following renovation work, and comply with EPA record-keeping requirements. The proposal that EPA has just rejected would have required contractors to hire EPA-accredited dust samplers to collect several samples after a renovation and send them to an EPA-accredited lab for lead testing -- at a cost of more than $260 per room. By EPA’s own estimates, the annual cost of this rule to the remodeling industry would have been more than $400 million. The cost considerations, as well as the waiting period for test results and the limited number of accredited labs nationwide, made professional remodelers very concerned about home owners’ willingness to undergo the process. NAHB Remodelers Council members and staff met repeatedly with both EPA officials and representatives from the Office of Management and Budget to express these concerns and urge the agency to reconsider the proposed regulation. Strong Congressional support for this has come from Sen. James Inhofe (R-Okla.) and Reps. Denny Rehberg (R-Mont.) and Bob Latta (R-Ohio). And with NAHB’s urging, the regulation was accepted for review per a Presidential Executive Order aimed at reducing the impacts of federal rules on small business and job creation. Prepare for Inspections as OSHA Steps Up Enforcement Secretary of Labor Hilda Solis has made it clear that stepped-up enforcement is a priority for the Occupational Safety and Health Administration. As evidence that OSHA is “back in the enforcement business,” the agency in May fined a company more than $106,200 for workers plastering a home on scaffolds without guardrails or other fall protection devices and it fined a residential roofer $102,000 for failing to provide fall protection, protective eyewear, head protection and fall hazard training. OSHA has also taken steps to increase the dollar amount of all penalties through administrative enhancements to its penalty policy. There are a few simple things that remodelers and trade contractors should do to be prepared for OSHA inspections: • Conduct an assessment to identify and correct safety hazards on the job site. • Conduct appropriate safety training for employees — such as fall protection and ladder safety training. • Update records and make sure they are readily available. • Understand the OSHA inspection process. Remodelers and trade contractors should pay particular attention to the following hazards, which are the top 10 most frequently cited OSHA standards for construction in 2010 (with the reference to the specific OSHA standard in parentheses): 1. Scaffolding, general requirements, construction (29 CFR 1926.451) 2. Fall protection, construction (29 CFR 1926.501) 3. Ladders, construction (29 CFR 1926.1053) 4.
