I will graduate in June of 2014 and will most likely be moving to Omaha to work or possibly staying in Lincoln to work for Olsson and Associates. Eleven Ways to Help Yourself Stay Sane in a Crazy Market

Keeping your cool can be hard to do when the market goes on one of its periodic roller-coaster rides. It’s useful to have strategies in place that prepare you both financially and psychologically to handle market volatility.

Here are 11 ways to help keep yourself from making hasty decisions that could have a long-term impact on your ability to achieve your financial goals.

1. Have a game plan

Having predetermined guidelines that recognize the potential for turbulent times can help prevent emotion from dictating your decisions. For example, you might take a core-and-satellite approach, combining the use of buy-andhold principles for the bulk of your portfolio with tactical investing based on a shorter-term market outlook. You also can use diversification to try to offset the risks of certain holdings with those of others. Diversification may not ensure a profit or guarantee against a loss, but it can help you understand and balance your risk in advance. And if you’re an active investor, a trading discipline can help you stick to a long-term strategy. For example, you might determine in advance that you will take profits when a security or index rises by a certain percentage, and buy when it has fallen by a set percentage.

2. Know what you own and why you own it

When the market goes off the tracks, knowing why you originally made a specific investment can help you evaluate whether your reasons still hold, regardless of what the overall market is doing. Understanding how a specific holding fits in your portfolio also can help you consider whether a lower price might actually represent a buying opportunity.

And if you don’t understand why a security is in your portfolio, find out. That knowledge can be particularly important when the market goes south, especially if you’re considering replacing your current holding with another investment.

3. Remember that everything’s relative

Most of the variance in the returns of different portfolios can generally be attributed to their asset allocations. If you’ve got a well-diversified portfolio that includes multiple asset classes, it could be useful to compare its overall performance to relevant benchmarks. If you find that your investments are performing in line with those benchmarks, that realization might help you feel better about your overall strategy.

Even a diversified portfolio is no guarantee that you won’t suffer losses, of course. But diversification means that just because the S&P 500 might have dropped 10% or 20% doesn’t necessarily mean your overall portfolio is down by the same amount.

4. Tell yourself that this too shall pass

The financial markets are historically cyclical. Even if you wish you had sold at what turned out to be a market peak, or regret having sat out a buying opportunity, you may well get another chance at some point. Even if you’re considering changes, a volatile market can be an inopportune time to turn your portfolio inside out. A wellthought-out asset allocation is still the basis of good investment planning.

9. Remember your road map

Solid asset allocation is the basis of sound investing. One of the reasons a diversified portfolio is so important is that strong performance of some investments may help offset poor performance by others. Even with an appropriate asset allocation, some parts of a portfolio may struggle at any given time. Timing the market can be challenging under the best of circumstances; wildly volatile markets can magnify the impact of making a wrong decision just as the market is about to move in an unexpected direction, either up or down.

Make sure your asset allocation is appropriate before making drastic changes.

10. Look in the rear-view mirror

If you’re investing long-term, sometimes it helps to take a look back and see how far you’ve come. If your portfolio is down this year, it can be easy to forget any progress you may already have made over the years. Though past performance is no guarantee of future returns, of course, the stock market’s long-term direction has historically been up. With stocks, it’s important to remember that having an investing strategy is only half the battle; the other half is being able to stick to it. Even if you’re able to avoid losses by being out of the market, will you know when to get back in? If patience has helped you build a nest egg, it just might be useful now, too.

11. Take it easy

If you feel you need to make changes in your portfolio, there are ways to do so short of a total makeover. You could test the waters by redirecting a small percentage of one asset class into another. You could put any new money into investments you feel are well-positioned for the future but leave the rest as is. You could set a stop-loss order to prevent an investment from falling below a certain level, or have an informal threshold below which you will not allow an investment to fall before selling. Even if you need or want to adjust your portfolio during a period of turmoil, those changes can--and probably should--happen in gradual steps. Taking gradual steps is one way to spread your risk over time as well as over a variety of asset classes.

Remember that while they’re sound strategies, diversification, asset allocation, and dollar-cost averaging can’t guarantee a profit or eliminate the possibility of loss.

5. Be willing to learn from your mistakes

Anyone can look good during bull markets; smart investors are produced by the inevitable rough patches. Even the best aren’t right all the time. If an earlier choice now seems rash, sometimes the best strategy is to take a tax loss, learn from the experience, and apply the lesson to future decisions.

Expert help can prepare you and your portfolio to both weather and take advantage of the market’s ups and downs.

6. Consider playing defense

During volatile periods in the stock market, many investors reexamine their allocation to such defensive sectors as consumer staples or utilities (though like all stocks, those sectors involve their own risks, and are not necessarily immune from overall market movements). Dividends also can help cushion the impact of price swings. According to Standard and Poor’s, dividend income has represented roughly one-third of the monthly total return on the S&P 500 since 1926, ranging from a high of 53% during the 1940s to a low of 14% in the 1990s, when investors focused on growth.

7. Stay on course by continuing to save

Even if the value of your holdings fluctuates, regularly adding to an account designed for a long-term goal may cushion the emotional impact of market swings. If losses are offset even in part by new savings, your bottom-line number might not be quite so discouraging.

If you’re using dollar-cost averaging--investing a specific amount regularly regardless of fluctuating price levels--you may be getting a bargain by buying when prices are down. However, dollar-cost averaging can’t guarantee a profit or protect against a loss. Also, consider your ability to continue purchases through market slumps; systematic investing doesn’t work if you stop when prices are down. Finally, remember that your return and principal value will fluctuate with changes in market conditions, and shares may be worth more or less than their original cost when you sell them.

8. Use cash to help manage your mindset

Cash can be the financial equivalent of taking deep breaths to relax. It can enhance your ability to make thoughtful decisions instead of impulsive ones. If you’ve established an appropriate asset allocation, you should have resources on hand to prevent having to sell stocks to meet ordinary expenses or, if you’ve used leverage, a margin call. Having a cash cushion coupled with a disciplined investing strategy can change your perspective on market volatility. Knowing that you’re positioned to take advantage of a downturn by picking up bargains may increase your ability to be patient.

The Landscape Water Quality Project | Building Inspections in the 3-Mile Area around Lincoln

The Landscape Water Quality Project Last year, the City of Lincoln experienced a record drought that threatened our water supply. Not since the drought of 1955 had we seen river flows so low. As a result of that year’s extreme drought, Lincoln’s 260,000 residents were placed under mandatory water restrictions trading city services—adequate drinking water and fire protection—for brown lawns.

Gone were their residential lawns—the living spaces for playing football or capture the flag.

Fortunately, science and technology have come a long way in improving soils and vegetation to provide homeowners a lower maintenance lawn.

The lawns are hardier, greener longer and healthier as they require less pesticide and fertilizer use, which ultimately saves the homeowner thousands of dollars over the lifetime of their ownership.

Homeowners have a choice, they can keep repairing their lawns, without ever fixing the problem or they can get at the root of the problem by taking advantage of the City of Lincoln’s cost-share program.

Currently, the City is offering a cost share grant program, ‘The Landscape Water Quality Project,’ to promote landscapes that increase stormwater infiltration and decrease watering and chemical use. The grant program offers 50 percent of recouped cost up to $2,000 per property for projects that improve soil quality, seeding/reseeding lawns, and rain gardens.

A few of the reimbursable expenses are: • Soil amendments • Shredded hardwood mulch • Native or hardy plants (would include lawn seeding or re-seeding with deep rooting grasses)

Building Inspections in the 3-Mile Area around Lincoln On September 5, 2013, the Building and Safety Department is responsible for taking permits and making inspections on 20+ acre residences in the three-mile zone around the City. The code is going into effect 90-days after the closing of the legislative session.

During the 2013 legislative session, LB88 had a legislative hearing with no opposition to the bill. When the bill came up on the floor of the Legislature for its first round debate, several farm groups opposed the bill. The City and senator McGill met with representatives of those farm groups and a compromise emerged.

The amendment established that the City can inspect all buildings within the three mile zone, except for “construction on farms for farm purposes.” This amendment has the benefit of using the same language as the statute dealing with the three mile zone around Omaha and allows the City to inspect outbuildings on acreages that are not used for farm purposes. Senators approved Senator McGill’s LB88 to insure that non-farm buildings comply with the same code requirements as those in effect in the City.

Currently the State Electrical Code was in effect on these properties; now building, mechanical, and plumbing permits and inspections will be required on September 5th.

Koontz v. St. Johns River Water Management District

Koontz v. St. Johns River Water Management District While everyone else is focusing on the headline-grabbing cases from the U.S. Supreme Court, many have missed the (lesserreported) ruling which is great news for our members.

On June 25, the Supreme Court issued an opinion that affects the conditions which governments try to impose on developers and builders in order to get a permit. The case is Koontz v. St. Johns River Water Management District, and the opinion is available at: http://www.law.cornell.edu/supct/pdf/11-1447.pdf. NAHB led a coalition of 16 associations which filed an amicus brief explaining to the Court that governments must not be allowed to extort money from property owners who wish to use their land. The Supreme Court actually used the word “extortion” several times in describing how governmental entities often treat developers!

In the Koontz case, a developer owned about 15 acres of land in Florida. He sought to develop nearly 4 acres and to grant a conservation easement over the remaining 11 acres to a water management district in order to accommodate wetland concerns.

The district did not accept his offer. The district told him that he could only develop ONE acre and that he would have to grant a conservation easement over the remaining 14 acres. OR they would allow him to develop his 4 acres as originally planned if he would hire contractors to make improvements to 50 acres of government owned land several miles away.

The Supreme Court said “yes” to both of these questions.

The case deals with “exactions” which are essentially conditions that the government puts on developers, and in exchange, the government will grant a development permit. Since the late 1980s, the Supreme Court has held that exactions must have a “nexus” to a legitimate governmental purpose and must be “roughly proportionate” to the impacts of the project. This is known as the Nollan/Dolan test, named after two Supreme Court cases. But the Nollan/Dolan test had never been applied to the denial of a permit or for the requirement that the developer spend extra money elsewhere to get the permit.

This case sends a message to governmental entities at all levels that the conditions they place on granting of permits (or other zoning and planning), must be closely tied to the project and tied to a legitimate governmental purpose, and that the protections extended to private property owners would be broadly interpreted.

This is a HUGE victory for our members and for all fans of private property rights. Spread the word and make sure you give kudos to the NAHB legal staff and Legal Action Committee. Their hard work on this cannot be overstated.

When the developer sued the water district, there were two unanswered questions: First, could the developer even sue since the permit was denied (versus a situation where the permit was granted with onerous conditions? Second, can the developer sue when the government is asking him to spend money somewhere else (versus putting conditions on his own property) in order to get a permit?

Stay Healthy in the Heat

A worker began installing a roof one hot sunny morning. Two hours later, he complained of feeling ill and vomited. He continued working. At 3:00 p.m., when he climbed down the ladder, he was confused and unsteady. He missed a step and fell. He was taken to the hospital and later died. His body temperature was 108 degrees.

Hot weather is here. When you are working outside, extreme heat is not only uncomfortable…it can kill. In 2011, thousands of workers in the United States got sick from exposure to heat on the job, and more than 60 workers died. These illnesses and deaths were preventable.

If you feel any of the symptoms of heat-related illness, or you see a coworker in distress, tell your supervisor right away.

OSHA CAN HELP. Visit www.osha.gov for worker fact sheets, worksite posters, and other resources on preventing heat illness, in both English and Spanish. If you have questions, call OSHA. It’s confidential. Call 1-800-321-OSHA (6742) or visit www.osha.gov to learn more about heat illness.

BEAT THE HEAT: THREE SIMPLE STEPS

Heat illness can be prevented. Remember these three things: water, rest, and shade.

• WATER: Drink plenty of fluids throughout the day.

Don’t wait until you’re thirsty to drink water. A good rule of thumb is to drink 4 cups of water every hour. It is best to drink a small amount of water every 15 minutes.

The work can’t get done without them.

• REST: Rest breaks help your body recover.

• SHADE: Resting in the shade or in air-conditioning helps you cool down.

MORE STEPS TO REDUCE YOUR RISK

Here are some other ways you can prevent illness from the heat: • Report symptoms of heat illness right away.

• Wear light-colored cotton clothing.

• Wear a hat.

• Wear sunscreen to prevent sunburn.

• Watch out for your coworkers.

• Know where you are working in case you need to call 911.

HEAT STROKE IS A MEDICAL EMERGENCY. CALL 911 if a coworker shows any signs of heat stroke.

• Does everyone know who to notify if there is an emergency?

• Heat exhaustion happens when your body loses too much water and salt through sweating. Symptoms may include: headache, nausea, dizziness, weakness, thirst and heavy sweating.

• Look out for one another and immediately report any symptoms?

• Heat fatigue, heat cramps, and heat rash are less serious, but they are still signs of over exposure to heat.

Proposed Stormwater Regulations

The City of Lincoln is proposing adoption of new ordinances to regulate stormwater runoff. The regulations are intended to improve the quality of stormwater (i.e. reduce the contaminants in stormwater) before it reaches our creeks and streams. However, these new requirements do not establish criteria to measure the intended water quality improvements, have the potential to delay the building and permitting process, achieve small benefit at great expense, create unnecessary maintenance issues and eliminate flexibility and creativity in improving the quality of stormwater runoff.

In 1972 Congress passed the Clean Water Act to “restore and maintain the chemical, physical, and biological integrity of the nation’s waters.”

Under this act cities must hold a permit (MS4) which requires them to regulate pollutants which flow into streams, rivers, lakes, and ponds. Instead of regulating the pollutants in stormwater the EPA now regulates stormwater itself as a pollutant and is requiring cities to establish regulations limiting the flow of stormwater into other bodies of water. To this date the EPA has not established standards of stormwater cleanliness and at least one federal court has determined that stormwater is not a pollutant that the EPA can regulate.

Responding to the threat of federal regulatory requirements, the City of Lincoln created the “Mayor’s Clean Water Program Task Force” to provide feedback to city staff as they developed stormwater management regulations in response to EPA requirements. The Committee listened to staff presentations and proposals before debating and voting upon a final report. The purpose of this report was to provide guidance to the staff as they developed stormwater requirements. Once the report was issued City staff developed draft “Regulations for Post Construction Stormwater Management.”

The proposed requirements will apply to all development and redevelopment projects of one acre or larger within Lincoln city limits and its extra territorial jurisdiction. It will require new developments and redevelopments to include stormwater

management structures capable of detaining a 90th% rainfall event and 80th% rainfall event respectively. Less stringent standards were designated for redevelopment projects due to space requirements and the immense cost of retrofitting a project with stormwater management structures. Acceptable structures include: • Green Roofs • Rain gardens • Permeable Pavement • Bioswales • Constructed Wetland Ponds • Retention Ponds • Underground screening and • Extended Detention Basins filtration As a result of mandating structural requirements the ordinances necessitate several legal and reporting requirements as well as penalties for failing to comply. These include: • A Post Construction Stormwater Management Plan (PCSMP) be approved by the Director of Public Works and Utilities as a prerequisite to approval of any planning application (preliminary plat, special permit, zoning change, etc.)

• A PCSMP be approved by the Director of Public Works and Utilities as a prerequisite to obtaining a building permit • The owner of the property (developer, home owners association, etc.) is responsible for maintenance, inspection, and submitting an annual report of inspection results to the Director of Public Works and Utilities • The Director of Public Works and Utilities and the Lower Platte South Natural Resources District may enter the property to inspect • The City is responsible for replacement of stormwater management structures solely at its discretion • Owners who fail to maintain stormwater management structures are punishable by a misdemeanor and a fine of $100 to $500 per day These proposed ordinances are scheduled to go before the Lincoln City Council at the end of August.

The July 17, 2012 article in the Lincoln Journal Star titled, “Water rates may get bump” by Nancy Hicks also shared the 19.3% increase in fees for landfill operations to begin September 1, 2013. The effects of the August 8, 2012 City Council vote are just about to begin. The City of Lincoln’s proposed budget shows a $4 fee increase to $25 per ton for landfill operations. This is $2 per ton towards the tonnage of refuse and $2 per ton towards the occupation tax. Although this only affects the average customer approximately 92 cents per month, builders, remodelers and anyone using roll-off on jobsites will need to plan accordingly.

As you hear about the possibility of mandatory recycling for contractors as part of the proposed Solid Waste Management Program, consider having to submit a recycling plan before a building permit is issued and multiple roll-offs on each of your jobsites all at the same time or creating one with dividers. There will be an opportunity for you to express your thoughts at a public meeting on Tuesday, August 13th (watch your email for more details). So to start things off, here are 3 simple things you can do right now: 1. First, be sure to have an account on the 3 most important social media platforms: Google Plus, You Tube and Twitter.

Then just post a couple times a day and then start over when you run out because people won’t see every post.

3. Finally, responsiveness is a major factor for social media.

This simply means that when people send you a message or make a comment that you get back to them. Businesses often miss out on huge opportunities when someone posts a question that shows their interest. If the interest goes without answer or engagement, they move on and give their $$ to your competitor. So monitoring your social media makes a huge difference in converting prospects to clients.
