Thanksgiving is over and Christmas is right around the corner. As you are out shopping, please think about supporting our annual Remodelers Council tradition by picking up some hats, gloves or mittens which are given to Lincoln Elementary students in need. For those of you who attended the Holiday party, I hope you had a GREAT time and enjoyed a little gambling for free money! HBAL is keeping an eye on the EPIC Consumption tax ballot initiative. If there are enough signatures gathered in the next several months, it will place new tax law changes as constitutional amendments on the ballot in the November 2024 general election. If you encounter someone collecting signatures for the ballot initiative, please make sure you are well-informed on how the proposed changes will affect Nebraska’s tax system. While the group promoting the tax makes it sound like this will be a great new system by eliminating property, sales, income and inheritance taxes, it will replace them with ONE LARGE consumption tax on EVERY new item purchased and service provided. This means the sale of any new home will incur a tax that HBAL’s consultants realistically estimate will be two to three times higher than the 7.5% the circulators are claiming. We are already in a housing shortage, and this will only exacerbate the problem. Please see pages 6-7 for more information. EPIC Facts & Fiction:

The Truth about the EPIC Consumption Tax Proposals Fact: Eliminates all Nebraska property,

Tax on insurance premiums because insurance premiums are subject to a premium tax, which is an excise tax.

Fiction: Consumption Tax rate on all

• This is a statement made by proponents, but not guaranteed. The current premium tax is not considered an excise tax.

• There is no guarantee that the rate will be 7.5%. It is more likely that the actual rate will be two or three times that high.

• Nebraskans will also pay the tax on deductibles and any out of pockets costs. All medical costs not covered by insurance will be subject to tax. Medicaid and Medicare services may be subject to the tax because those payors do not pay a premium tax.

The Legislature gets to decide what will be taxed and there is no guarantee as to what will or won’t be taxed. • Either way, the price of new homes and new vehicles would likely rise by over 20% eliminating the ability of many Nebraskans to purchase them. • The cost of many necessities will drastically increase including diapers, over-the-counter medications, auto repairs, and rent.

• This is contrary to the proposed Constitutional Language that states “the State of Nebraska shall impose a retail consumption tax or an excise tax on all new goods and services.” • There is no guarantee or definition of what constitutes a business-to-business transaction. If all new goods and services will be taxed without exception that includes business purchases and purchases by entities that have historically been tax exempt (Churches, non-profits, and governmental entities)

Fiction: The Consumption Tax is fair to all Nebraskans.

• The tax is regressive on its face and will harm small businesses, those with lower incomes, young families, and seniors.

Fact: There are no special tax exceptions for Government agencies and non-profits. • How does Nebraska expect to tax the

The Truth about the EPIC Consumption Tax Proposals federal government? Proponents can’t explain. • If we tax State government and political subdivisions in Nebraska, how will they raise the funds to pay the tax? • Will non-profits be able to survive if they are required to pay the tax? Will contributions or grants that generally fund such institutions increase enough to cover the cost?

Fact: The EPIC Option would be achieved in two steps

• Step 1: Vote of the people to amend the Nebraska State Constitution on the November 2024 ballot. - Ballot Language: “…No governmental entity in the state of Nebraska may impose taxes other than retail consumption taxes or excise taxes.” - Ballot Language: “The State of Nebraska shall impose a retail consumption tax or an excise tax on all new goods and services. There shall be no exemption from such sales taxes, except for grocery items purchased for off premises consumption.” - Fact: Once voted into the Nebraska State Constitution, these amendments can only be changed by another vote of the people and cannot be changed by the Legislature. ◊ This should scare everyone! We currently have nothing in place to facilitate the implementation of this change.

• Step 2: Legislative vote to adopt implementation legislation. - Proponents claim that the Legislature will adopt LB 79 (AM314) to implement the EPIC Consumption Tax. If that is true, it would have to be done in the 2024 Legislative Session which will end more than six months before the election. - If it doesn’t work, Nebraskans will be left holding the bag. Lawmakers who championed this change will no longer be in office and have stated that it’s “not their problem.”

Fiction: The EPIC plan protects local control

• Local control will be eliminated. All tax revenue will go to the State Treasurer in Lincoln. The Legislature will make all budget decisions from the State to your local school and fire district.

FACT: The EPIC Option Consumption

Tax Proposal is an EPICALLY BAD Idea for Nebraska! • No other state has a consumption tax. • Other countries that use a consumption tax (called a value added tax or VAT) have an average rate of 22% and they also collect other taxes, including income and dividend taxes. • If we are going to change the Nebraska Constitution, we should only do so with a clear path forward, not something that dumps a super sales tax in the lap of our future legislators. 7  Lincoln Business Builder

Went to Doane for college where I met my wife. We decided to raise our family in Southeast Nebraska - the area she was born and raised. What is the most unique or interesting thing about you that most people probably don’t know? I've had multiple side hustles over the years including woodworking, tile, mowing lawns and filming wedding videos. What's the strangest thing you've ever done? Getting my CDL after having never been in a semi-truck in my entire life. What is your greatest talent that you don’t utilize in your daily work life? 3D Archery Tournaments When you’re not working, how do you enjoy spending your time? If you ask my wife, I have far too many hobbies.

Archery whitetail hunting, open water and ice fishing for walleye, raising chickens, slow pitch softball and golfing. Who is someone who's made a big impact on your life? Why? Greg Reitmeier - Truck Center Lincoln's General Manager. Greg introduced me to the trucking industry, something I had never considered or thought of growing up. What do you/did you love the most about your job? The ability to meet successful and hard working business owners in and around Nebraska. Finding solutions for them that make their businesses more successful. What experiences and past roles have led you to where you are today? More Than Just a Member

HBAL MEMBER MORE THAN JUST A

When you join HBAL, your dues are more than just membership in the organization. The Home Builders Association of Lincoln provides opportunities to network and learn through member events, meetings and educational classes. HBAL's volunteer leadership and staff also do extensive behind-the-scenes work with government officials at the State and Local levels helping to decrease regulation and control housing costs. For example, members meet with elected officials and city officials on a regular basis. Meetings cover any topic potentially related to construction. Having a good working relationship is important to make sure everyone is well informed, which makes navigating potential changes in regulations easier. In 2023, members worked with the Lincoln Transportation and Utilities Department (LTU) on their updates to sidewalk and driveway approach criteria. Prior to 2023, sidewalk and driveway inspections were completed by the Building & Safety Department. With the change in City department oversight, there were significant changes to the process and new requirements had to be met. Effective communication with LTU made working through the changes easier. We appreciate all the dedicated members of HBAL who assist in these endeavors.

November Board Report

November Board Report Remodelers Council: The Remodelers Council met at the HBAL office on November 1 for “Distracted Driving is the New Impaired Driving” by the Nebraska Safety Council. Annual election of officers was conducted. Jason Willet (Willet Construction) will serve as chairperson. Matt Firestone (Concrete Craft) will serve as vice chairperson. Megan Dreyer (CS Kitchen & Bath Studio) will serve as secretary. A Remodelers 101 was presented with non-Remodelers members invited to attend. Next meeting will be December 6 at Wonderbowl for the Holiday Party. Remodelers will be collecting warm weather clothing again for local elementary schools. Growth is Good: The Growth is Good group is starting discussions about the next Lincoln on the Move Sales tax. Lincoln on the Move Sales tax was approved by voters in 2019 and will sunset in 2025. EPIC Consumption Tax: HBAL has been monitoring the EPIC Consumption Tax which is currently a petition drive. 2021 International Energy Conservation Code (IECC): Members participated in an educational meeting to learn more about the 2021 IECC. Some of the changes include: R-30 in walls when using standard batt insulation. Building solar ready. Requirement of wiring for EV charging station. Wiring in place for all appliances for conversion to electrical. New codes are expected to increase costs for building. TradeGamz: TradeGamz is the only tool schools have to connect local students with local businesses. They expect a large influx of students to sign up in the future. Basic business accounts are free. Members can contract through Monster Media for deeply discounted videos. Careers in Construction Committee: Construction Career Day is scheduled for 4/25/24. Cruisin’ for the Trades: Decision was made to not move forward in 2024 with a car show due to limited member participation, significant staff time commitment and limited need for Foundation funding at this time. 15  Lincoln Business Builder

Santa Cop Project

An Aggravation-style board game was built for the 2023 Santa Cop Project. The boards were cut, sanded and assembled over the course of a few days. The extra money raised was used to purchase a variety of games which were put into cinch sacks for delivery. In all, 30 game boards and 40 bags of games were given to the Lincoln Police Officers Union along with a check for $1000. All of this will help make the holidays a little brighter for the children LPD officers encounter. Thank you to all the volunteers who helped make this event a success! • • • • • • •

It has been a wonderful year here at the Remodelers Council. Thank you so much for giving me the opportunity to volunteer as the Chair of Remodelers Ben Klein Council. It has Remodelers Council been a great Chairperson experience being able to lead such a wonderful group of people. I hope I have been able to leave an impression on the group members and leaders for the next chapter in our leadership. Jason Willet will be taking over as Chair next year and I have all the confidence in the world that he will do a great job for the Remodelers Council. I hope he can grow the group even more so we can make changes and help other small businesses in Lincoln grow and prosper. I want to thank Jennie Korth and the rest of the HBAL staff for all the work they have done this year for the Remodelers Council. We could not do it without them. Kirk Van Pelt of the Nebraska Safety Council presented “Distracted Driving is the New Impaired Driving” at the November Remodelers Council Meeting. According to statistics, drivers are 23x more likely to be involved in a motor vehicle crash while texting and driving. The presentation reminded us that our driving choices not only affect us, but will also affect our coworkers, family and friends. The meeting also included a Remodelers 101 presentation by our 2023 officers. This was an opportunity to share what the Remodelers Council does throughout the year with new and potential members. We also had our election of officers. Special thanks to Jason Willet (Chairperson), Matt Firestone (Vice Chairperson) and Megan Dreyer (Secretary) for volunteering to serve in 2024!
