President’s Message Mike Rezac, HBAL President Thank you to everyone who attended the January 14 Installation and Awards Ceremony or has offered words of encouragement since. The evening was very enjoyable, entertaining and we were able to recognize a few very deserving members with annual awards. The building industry has changed immensely these past few years and is predicted to continue down the path of energy efficiency, new products, technology and changing methods of construction. There are very detailed discussions being held. I encourage you to participate, understand, evaluate and use your years of experience to challenge concepts when appropriate. Most economic forecasts indicate our industry will continue to make progress in 2013. This doesn’t mean there won’t be challenges with material costs, code changes or difficulties hiring quality, skilled employees or trade contractors. I encourage all builders, trade contractors and associates in Lincoln and surrounding communities to become active members of HBAL. Support one another, do business with one another and together we will continue to build our community. The 41st Nebraska Builders Home & Garden Show will be February 7-10. Most homeowners believe face-to-face is the most important source of home improvement information. If you are not already an exhibitor, sign up or come to the show to start making plans for next year! The mortgage interest deduction (MID) cost the US Treasury $88.8 billion in 2011, making it the second largest tax break for individuals. That is precisely why the Congress has its sights set on it. However, there is much debate about how to reduce its costs to the Treasury and by how much.

No matter what happens, reducing the MID will lower some house prices. That being said, how the Congress reduces the MID will determine how much how many houses lose value. And since so many of us own a home, sell homes or build homes, the MID will not be singled out for special treatment. Rather, the Congress will cap or phaseout the value of all deductions, and in that way avoid favoring one deduction over another.

While there are several possible approaches, the fiscal cliff compromise bill passed into law on January 2nd of this year phases out itemized deductions for households with incomes over $300,000. While at first blush this may appear to be quite damaging, I think homeowners, realtors, builders, and the entire housing industry have all dodged a bullet and should sleep well for quite a while, or at least until the Congress reopens debate on the tax code sometime in the future Phasing out Schedule A deductions for couples with incomes over $300,000 limits the impact to buyers of only the most expensive houses. For example, with a 10% down-payment on a $1,500,000 house, mortgage interest would be $54,000/year, property taxes would average $16,500, and insurance would be about $8,000, totaling $78,500 in annual housing-related expenses. To finance that mortgage, the $78,500 should ideally not be more than 30% of gross income, which means qualifying requires having an annual income of roughly $260,000; comfortably below the income level at which deductions start phasing out.

That being said, how much will a house valued at $2,000,000 decline? By very little! In theory it will fall by the one-time lump-sum amount necessary to compensate buyers for the new income taxes they will pay due to their being at or above the phaseout threshold. With interest rates currently at 4%, this means, and trust me on this, every $1,000 in added income taxes reduces the house price by ($1,000/4% or) $25,000. However, in reality, these impacts will be dramatically mitigated by tax avoidance strategies available to the very wealthy including systematically larger down-payments, cash purchases, corporate purchases and so on. In short, few homeowners will be impacted by the new tax treatment of deductions including the MID. For households with incomes below $300,000, there are no impacts stemming from this change and for those with higher incomes, the impacts will largely be mitigated by tax avoidance behavior. At worst, only homes worth well over a million dollars will be adversely affected. With huge deficits as far as the eye can see, the tax treatment of deductions is sure to continue to change and evolve. Enjoy the debate, but be aware that next time you may be on the menu. The American Taxpayer Relief Act of 2012 Provided by Brian Willet, Waddell & Reed

The new year began with some political drama, as last-minute negotiations attempted to avert sending the nation over the “fiscal cliff.” Technically, we actually did go over the cliff, however briefly, as a host of tax provisions and automatic spending cuts took effect at the stroke of midnight on December 31, 2012. However, January 1, 2013, saw legislation--retroactively effective--pass the U.S. Senate, and then later the House of Representatives. The American Taxpayer Relief Act of 2012 (ATRA) permanently extends a number of major tax provisions and temporarily extends many others. Here are the basics.

Tax rates

For most individuals, the legislation permanently extends the lower federal income tax rates that have existed for the last decade. That means most taxpayers will continue to pay tax according to the same six tax brackets (10%, 15%, 25%, 28%, 33%, and 35%) that applied for 2012. The top federal income tax rate, however, will increase to 39.6% beginning in 2013 for individuals with income that exceeds $400,000 ($450,000 for married couples filing joint returns). Generally, lower tax rates that applied to long-term capital gain and qualifying dividends have been permanently extended for most individuals as well. If you’re in the 10% or 15% marginal income tax bracket, a special 0% rate generally applies. If you are in the 25%, 28%, 33%, or 35% tax brackets, a 15% maximum rate will generally apply. Beginning in 2013, however, those who pay tax at the higher 39.6% federal income tax rate (i.e., individuals with income that exceeds $400,000, or married couples filing jointly with income that exceeds $450,000) will be subject to a maximum rate of 20% for long-term capital gain and qualifying dividends.

Alternative minimum tax (AMT)

The AMT is essentially a parallel federal income tax system with its own rates and rules. The last temporary AMT “patch” expired at the end of 2011, threatening to dramatically increase the number of individuals subject to the AMT for 2012. The American Taxpayer Relief Act permanently extends AMT relief, retroactively increasing the AMT exemption amounts for 2012, and providing that the exemption amounts will be indexed for inflation in future years. The Act also permanently extends provisions that allowed nonrefundable personal income tax credits to be used to offset AMT liability.

• Expanded tax credit provisions relating to the dependent care tax credit, the adoption tax credit, and the child tax credit • Higher limits and more generous rules of application relating to certain education provisions, including Coverdell education savings accounts, employer-provided education assistance, and the student loan interest deduction

Temporary extensions

• Provisions relating to increased earned income tax credit amounts for families with three or more children are extended through 2017 • American Opportunity credit provisions relating to maximum credit amount, refundability, and phaseout limits are extended through 2017 • The $250 above-the-line tax deduction for educator classroom expenses, the limited ability to deduct mortgage insurance premiums as qualified residence interest, the ability to deduct state and local sales tax in lieu of the itemized deduction for state and local income tax, and the deduction for qualified higher education expenses are all extended through 2013 • Charitable IRA distributions (IRA holders over age 70½ are able to exclude from income up to $100,000 in qualified distributions made to charitable organizations) are extended through 2013; special rules apply for the 2012 tax year • Exclusion of qualified mortgage debt forgiveness from income provisions extended through 2013 • Exclusion of 100% of the capital gain from the sale of qualified small business stock extended to apply to stock acquired before January 1, 2014 • 50% bonus depreciation and expanded Section 179 expense limits extended through 2013 The article is written by Broadridge Investor Communication Solutions, Inc., but is provided by Brian W. The Act makes permanent the $5 million exemption amounts (indexed for inflation) for the estate tax, the gift tax, and the generation-skipping transfer tax--the same exemptions that were in effect for 2011 and 2012. The top tax rate, however, is increased to 40% (up from 35%) beginning in 2013. The Act also permanently extends the “portability” provision in effect for 2011 and 2012 that allows the executor of a deceased individual’s estate to transfer any unused exemption amount to the individual’s surviving spouse.

Phaseout or limitation of itemized deductions and personal exemptions In the past, itemized deductions and personal and dependency exemptions were phased out or limited for high-income individuals. Since 2010, neither itemized deductions nor personal and dependency exemptions have been subject to phaseout or limitation based on income, but those provisions expired at the end of 2012.

The new legislation provides that, beginning in 2013, personal and dependency exemptions will be phased out for those with incomes exceeding specified income thresholds. Similarly, itemized deductions will be limited. For both the personal and dependency exemptions phaseout and the itemized deduction limitation, the threshold is $250,000 for single individuals ($300,000 for married individuals filing joint federal income tax returns).

HBAL Installation & Awards Ceremony

2012 Associate of the Year Mark Aksamit, Earl Carter Lumber Co., was named the 2012 Associate of the Year by the Home Builders Association of Lincoln (HBAL) at its annual installation banquet January 14, 2013. Mark has served on the HBAL Board of Directors and is involved with many activities through HBAL including member recruitment, the Lincoln Home Builders Care Foundation’s Chili Cook-off and Santa Cop Project. He is also an active member of the Remodelers Council of Lincoln. HBAL’s Associate of the Year award is given annually to recognize an outstanding Associate member of the association who has conducted themselves in an exemplary manner so as to bring credit to the building industry, community and HBAL.

Dan Peterson Affordable Housing Award Jerry Boyce, Boyce Construction, Inc., was named the 2012 recipient of the Dan Peterson Affordable Housing Award. Given in memory of Bob and Joan Peterson’s son, the award was presented by Bob to Jerry at the Home Builders Association of Lincoln’s annual installation and awards banquet on January 14, 2013. Jerry’s dedication to Habitat for Humanity is just one of many reasons he received this award. He has served as their job site supervisor for more than two years and recently received an award from Habitat for putting in the most volunteer hours in 2012. Jerry is a past president of the Home Builders Association of Lincoln and continues to be an active member of the Association, including helping guide them with their 16th Habitat Blitz Build last fall.

Home Builders Association of Lincoln Commits to Sponsorship of New Lincoln Children’s Museum Exhibit Up, way up! That’s the direction a new exhibit at Lincoln Children’s Museum will expand. A three-story exhibit based on the principles of design, imagination and construction will be made possible during Phase III of a five-phase renovation project thanks to support from the Home Builders Association of Lincoln (HBAL). “We appreciate the opportunity to be a part of the Lincoln Children’s Museum renovation and specifically one relating to the construction industry,” Pictured are Perry Haralson, Dan Klein, Sr., Paul Durban and Angela Smith. explained HBAL Executive Vice President Mike Benker. “The opportunity for young minds to Phase I of the plan featured a Hy-Vee grocery store and Kimmel creatively play now, may allow for future dreams to come true later,” Apple Orchard. In June 2012, the Water Exhibit opened with he added. generous support from more than a dozen donors and concluded Phase I. In November 2012, eight permanent exhibits: Sam & Benker, along with 2012 HBAL President Dan Klein Sr. of Regal Louie’s Pizzeria, Bryan Health, Lincoln Fire and Rescue and Lincoln Building Systems and HBAL 2nd Vice President Perry Haralson Police Department areas, Pet’s Vet, Johnny Carson Theater and of Cornhusker Bank, presented a $10,000 check to Paul Durban, Television Studio, Union Bank, Tracy’s Collision Center Mechanics executive director, and Angela Smith, director of development, on Garage, and BNSF Train comprised Phase II. behalf of the award-winning Museum. “HBAL’s generous sponsorship of our next phase is yet another example of their commitment to support educational and charitable activities in our community,” said Durban. “We are grateful and proud to call HBAL our partners in this effort to further the mission and improve the Museum for future generations.” Construction on the new exhibit, which will be the single-largest within the five-phase renovation project, is anticipated to begin in winter 2014. HBAL’s support will fund a portion of the exhibit, which will occur in conjunction with the expansion and renovation of the current popular “Tot Town” exhibit, a space dedicated to children ages 3 and younger. All of the Museum updates are focused on improving spaces where children as young as six months can make discoveries through play. For nearly 25 years, exhibits developed by Lincoln Children’s Museum in partnership with business, education and community leaders have been integral to hands-on learning and creativity among children—nearly 171,000 in 2012 alone! An entire generation has grown up benefitting from one of the best children’s museums in the nation. As times change and exhibits have been well loved, Lincoln Children’s Museum has done extensive research and development for future renovation plans.

The chart to the right illustrates the number of homes under construction (UCN) and newly finished unoccupied homes (NFU) in each of eight price points for the entire county. As the closing volume has increased and the number of NFU’s has gone down the months supply shown in red at the bottom has continued to fall. This low monthly supply across all price ranges could create a barrier to recovery due to lack of new homes for potential buyers to visit. The number of NFU in the county has declined by about 30 homes in the last twelve months. This chart is for all areas of the county and for all price points. Specific areas vary.
