Group Disability Insurance

If disability strikes, you may discover that your most valuable asset isn’t your home or your savings--it’s your ability to earn a living. Fortunately, group disability insurance can help protect you. Whether it’s offered through your employer, school, trade group, or another association to which you belong, group disability insurance is an affordable solution to your need for income protection.
What is group disability insurance?
Like other types of disability insurance, group disability insurance pays you a benefit that replaces part of your earned income when you’re sick or injured and can no longer work. A group disability policy covers all eligible members of a group that has a common interest or association, and may offer special terms, conditions, and rates.
Short-term and long-term
There are two major types of group disability coverage: short-term and long-term. Short-term disability insurance plans generally pay benefits for several months, or occasionally as long as 2 years. In the case of employer-sponsored coverage, benefits often start once you exhaust your sick leave. Long-term disability insurance plans may pay benefits for several years, or until age 65, and may be coordinated with benefits from a short-term plan so that your disability coverage is continuous. Ideally, you’ll want to have both types of coverage. While it’s true that short-term disabilities are more common, long-term disabilities can be even more financially devastating.

Some plans may cover partial disabilities, while others will require that you be totally disabled to receive benefits. Accela Update | Building & Safety’s New Counter Hours
Building & Safety Welcomes Accela Testers Lincoln’s Building and Safety Department is pleased to announce the five contractors who have agreed to use and test the new Accela software before it is installed and ready for contractor and homeowner use in late January. We want to use the “test” Accela software to get feedback from contractors before it is in general use. This feedback will help our staff understand how the typical contractor uses the program. It will help us with our training program for contractors and homeowners who will be using the new system. OSHA Inspection for HBAL Member OSHA inspectors are inspecting residential construction sites and extensions for the temporary enforcement measures will not protect you from an inspection. These extensions are providing you time to perfect your policies and training before the regulations become even stricter. • Is your trailer wired with a sub-panel? Does it look like the rough-in of a house or a finished safe product to be left exposed to employees? • Are your employees ready to be interviewed by inspectors? What will they say regarding your training program? • Do you hire new employees? At what stage are they considered fully trained? • Did you set that ladder against the house to have it out of the way or is it to be used? The same goes for an extension ladder leaning against the roof? From one builder to another, please make it obvious you are doing your best to maintain a safe jobsite and take your record keeping seriously. OSHA Extends Temporary Enforcement Measures in Residential Construction The U.S. Department of Labor’s Occupational Safety and Health Administration will extend for three months its temporary enforcement measures in residential construction. The temporary enforcement measures, now extended through March 15, 2013, include priority free on-site compliance assistance, penalty reductions, extended abatement dates, measures to ensure consistency and increased outreach. Fatalities from falls are the number one cause of workplace death in construction. OSHA has been working closely with the industry to assist employers in complying with the new directive. From October 1, 2011 to September 30, 2012, OSHA’s On-site Consultation Projects performed more than 3,000 on-site visits, conducted close to 1,100 training sessions and delivered close to 500 presentations related to fall protection in residential construction. OSHA’s regional and area offices also conducted more than 1,200 outreach activities on the directive. The agency will continue to work with employers to ensure a clear understanding of, and to facilitate compliance with, the new policy. EPA Responds to RRP Rule Questions With assistance from Senator Mike Johanns Office
The initial scenario was identified at the Remodelers Council Meeting on April 4, 2012 with an additional scenario added June 7, 2012. While attending the 2012 NAHB Spring Board of Directors Meeting and Legislative Conference, Mike Benker attended the NAHB Remodelers Board of Trustees Meeting to listen to Steve Chester, Deputy Assistant Administrator, Rosemarie Kelley, Director of Waste and Chemical Enforcement Division and Greg Sullivan, Chief of Chemical Risk and Reporting Enforcement Branch give a small presentation followed by 20 minutes of Q&A regarding EPA Enforcement. During the Q&A, the following questions were asked and following this meeting a discussion was held in which a written response was expected by Rosemarie Kelley. We want to thank Senator Johanns Office for their assistance with getting a written response for each scenario. Although the answers may not be exactly what a remodeling contractor may want to hear, at least they are more direct in their nature.
Scenario #1:
If you have a pre-1978 home with painted wood siding and you wish to overlay the siding with foam and a vinyl or other siding material, do you need to be a Certified Renovator? Is testing required? The concern is whether the surface area is the area being covered or the diameter of the nails being driven or shot through the surface in order to install the overlay products.
Answers – From the EPA:
Is testing required? No, testing is never required under the RRP Rule. The renovator is free to assume the presence of lead-based paint and proceed accordingly. See FQ 23002-32338. Do you need to be a Certified Renovator? It depends. The work practices for exterior projects are based on a performance standard - if the activity disturbs a painted surface (generally, by creating paint chips or dust) in excess of 20 square feet, the work area must be contained so dust or debris does not leave the work area while the renovation is being performed. Thus, if the installation of the foam and vinyl siding results in the disturbance of paint in excess of 20 square feet of painted surface, then the RRP Rule applies. However, if the activity will be performed in such a way that does not disturb 20 square feet of painted surface, then the RRP Rule would not apply. The definition of “minor repair and maintenance “ at 40 CFR 745.83 provides a guidance on how to measure the surface area disturbed: “When removing painted components, or portions of painted components, the entire surface area removed is the amount of painted surface disturbed.” When painted surfaces are being disturbed or disrupted, but not completely removed, the surface area disturbed is only the area being actively disturbed. For example, when removing painted siding, the surface area disturbed is the entire surface area of the painted siding board. When nailing new siding into old painted siding, the surface area disturbed

EPA Responds to RRP Rule Questions includes the cumulative area of the nails being driven through the painted surface and any additional surface area disturbance that might create paint chips, dust or debris.” The EPA recognizes this may be difficult to determine in advance of the renovation activity. However the renovator is the person with the expertise and experience to make this determination on a caseby-case basis. In such a situation, the renovator should consider how factors such as the condition of the underlying paint or the chosen method of renovation may increase or decrease the likely hood for a disturbance of paint. If there is still uncertainty, the EPA recommends renovators err on the side of caution and be prepared to contain any dust and debris.
Scenario #2:
A wood floor refinisher was asked to refinish an oak floor in a 1920’s home (pre-1978). There were differing opinions as to whether the refinisher needed to test the surface for lead before refinishing. Is stained and clear-coated woodwork to be tested whether it is on the floor or a trim material because of the phrase, “...a component surface covered in whole or in part with paint or other surface coatings.”
Answers – From the EPA:
The EPA’s regulatory definition of “painted surface” was derived from Congress’ statutory definition of “lead-based paint” in Section 401 of TSCA, 15 USC 2681: “The term ‘lead-based paint’ means paint or other surface coatings that contain lead in excess of 1.0 milligrams per centimeter squared or 0.5 percent by weight. . .” (emphasis added). The RRP Rule makes no distinction between surface coatings on the floor versus trim work.
Prior to 1978 it was common for varnishes to contain lead as a drying agent in the form of lead acetate. Sanding or removing these surface coatings without proper precautions can produce high levels of lead dust and pose risks to human health. You may ask “what’s next regarding the RRP Rule?,” the NAHB lawsuit failed and the definition of lead is changing. There are currently bills in committee for the House of Representatives (H.R. 5911) and Senate (S. 2148), which are companion bills to provide an opt-out for homeowners who are not in the target age-groups or statuses. As these bills are being reviewed and improved, it is likely they will move out of committee. This is your opportunity to make sure your representatives in the House and Senate support these bills or provide you with a reason why they cannot support them, which may further improve the bill itself.
