President’s Message Mike Rezac HBAL President How prepared are you? The spring storm season is a reminder for many people to evaluate their preparedness at home and at work. Unfortunately major storms catch people off-guard or underprepared when tragedy strikes and often times innocent people become victims of tragedy. Please review your game plan before a possible tragedy strikes! Job site preparation includes evaluating productiveness, efficiencies and safety. For the benefit of yourself, your company, your employees and their families, I encourage you to review your safety manuals, update as needed, ask questions and make sure you do not keep this information a secret. Please share it with your entire team! Reflection is another form of preparing for the future. Although this can and should occur throughout the year, Memorial Day is often a time of reflection to honor the men and women who have died while serving in our military. Honoring a loved one and spending time with family and friends are meaningful and provide purpose in life. The purpose of the NAHB BuildPac is to keep the housing industry’s agenda in the national spotlight. Whether this includes issues regarding financing, appraisals, regulation or affordability, we must be prepared to support candidates who understand our industry. I’ve issued a challenge (see page 7) to our members to join me in supporting BUILD-PAC at the Dollar-A-Day Club level. If we each give a little, together we can make a difference!

The Home Builders Association of Lincoln is planning its first Lincoln Home Builders Care Foundation Hog Roast. We are planning a fun evening! Along with the hog roast, there is a President’s bass fishing tournament in the works, a bounce house and fishing tournament for the kids, a “Fish and Chips” contest and a live band! Member News: Accela Assistance, Sidewalk Inspections, New I-9 Form, NLRB “Poster Rule”
Contractor Hotline Set-Up for Accela Assistance A growing number of contractors have signed up with Building and Safety to use the online options with the new Accela software. Many are now using credit cards for payments and moving funds into their trust accounts. Many are requesting inspections through Accela. We’re seeing an increase in communications relative to permits without having to come into the office. However, Building and Safety continues to receive calls for help from contractors who are having difficulties getting their contractor ID and trust account verification. They now have a phone number and personnel support for anyone needing help setting up an account or general information on how to use the system. Jerris Nider, Systems Specialist, will take your calls at 402-441-8385. If you get a busy signal, leave a voice message. Two additional staff will be checking the messages and helping with your questions. This extra ser vice will be available until June 20, 2013. If you need help with your account or need additional information, please use the Accela web link: https://my.lincoln.ne.gov/citizenaccess/default.aspx. If you still have questions, call 402-441-8385 for support.
Building and Safety to Inspect Sidewalks along Private Roadways Sidewalks are required on both sides of all public and private streets by the Lincoln Municipal Code Section 26.27.020 unless a waiver has been granted by the Planning Commission or City Council. The sidewalks should be constructed to the specifications set forth in Chapter 14.80 of the Lincoln Municipal Code. A year ago, Building and Safety took the responsibility for inspecting residential and commercial sidewalks and approaches, previously inspected by Public Works and Utilities. At that time, there were no permits or inspections for sidewalks along private streets (in the public sidewalk easement). Building inspectors realized the disparity between the public and private sidewalks when they noticed that some existing sidewalks along private streets were exceeding the maximum slope of 2% or one-inch for the width of the four-foot sidewalk. Recently they saw a four-foot private sidewalk poured with a side-to-side slope of 17% or eight inches. This exceeds the Americans with Disabilities Act (ADA) requirements. To eliminate these discrepancies, Building and Safety immediately will take permits and provide inspections for all newly-constructed sidewalks whether public or private. All sidewalks will need to comply with the ADA. Sidewalk inspections and driveway approaches on private streets will be the same as on public streets. 6 Lincoln Business Builder
Reminder: New I-9 Form Must be Used After May 7 Federal law places an affirmative duty on employers to verify the identity and work authorization of all newly hired persons through completion of the Employment Eligibility Verification Form I-9 within three business days after the individual is hired. The U.S. Citizenship and Immigration Services (USCIS) agency has issued a new Form I-9 for Employment Eligibility Verification. After May 7, 2013, all employers must use only the newly revised Form I-9 (expiration date 3/31/2016) for each new employee hired, or be subject to a civil penalty if audited. Download the new form and instructions at: http://www.uscis.gov/files/form/i-9.pdf. The new form requires additional data and expands the form from one page to two. Employers are encouraged to familiarize themselves with the new format and instructions. The USCIS is conducting several free I-9 webinars to provide answers to any questions about the new form. There is a Spanish language version of the new Form I-9 available for download at: Formulario I-9. However, please note that only employers and employees in Puerto Rico are permitted to use the Spanish-language form for employment eligibility verification purposes. Elsewhere, the Spanish language version can be utilized only for reference to facilitate completion of the English language version of the Form I-9. Except in Puerto Rico, employers must complete and retain only the English language Form I-9. For more information, email David Crump at NAHB or call him at 800-368-5242 x8491.
Court of Appeals Strikes Down NLRB “Poster Rule” In a victory for NAHB, the U.S. Court of Appeals for the District of Columbia on May 7 struck down a National Labor Relations Board (NLRB) rule that would have required millions of employers across the nation to place 11-inch by 17-inch posters in a prominent area in their workplace informing employees of their right to form a union, and that a failure to so post would be considered an unfair labor practice. The Court of Appeals Ruled that the NLRB lacked authority to promulgate such a rule because section 8(c) of the National Labor Relations Act provides that the dissemination (or non-dissemination) of non-threatening speech shall not be considered an unfair labor practice. NAHB is a member of the Coalition for a Democratic Workplace, which was a party to the case. NAHB and other business organizations maintained that the poster rule violated free speech rights, and amounted to little more than an imposed advertisement for union membership. Should You Pay Off Your Mortgage or Invest? Provided by Brian Willet, Waddell & Reed
Owning a home outright is a dream that many Americans share. Having a mortgage can be a huge burden, and paying it off may be the first item on your financial to-do list. But competing with the desire to own your home free and clear is your need to invest for retirement, your child’s college education, or some other goal. Putting extra cash toward one of these goals may mean sacrificing another. So how do you choose?
Evaluating the opportunity cost
Deciding between prepaying your mortgage and investing your extra cash isn’t easy, because each option has advantages and disadvantages. But you can start by weighing what you’ll gain financially by choosing one option against what you’ll give up. In economic terms, this is known as evaluating the opportunity cost. Here’s an example. Let’s assume that you have a $300,000 balance and 20 years remaining on your 30-year mortgage, and you’re paying 6.25% interest. If you were to put an extra $400 toward your mortgage each month, you would save approximately $62,000 in interest, and pay off your loan almost 6 years early. By making extra payments and saving all of that interest, you’ll clearly be gaining a lot of financial ground. But before you opt to prepay your mortgage, you still have to consider what you might be giving up by doing so--the opportunity to potentially profit even more from investing. To determine if you would come out ahead if you invested your extra cash, start by looking at the after-tax rate of return you can expect from prepaying your mortgage. This is generally less than the interest rate you’re paying on your mortgage, once you take into account any tax deduction you receive for mortgage interest. Once you’ve calculated that figure, compare it to the after-tax return you could receive by investing your extra cash. For example, the after-tax cost of a 6.25% mortgage would be approximately 4.5% if you were in the 28% tax bracket and were able to deduct mortgage interest on your federal income tax return (the after-tax cost might be even lower if you were also able to deduct mortgage interest on your state income tax return). Could you receive a higher after-tax rate of return if you invested your money instead of prepaying your mortgage? Keep in mind that the rate of return you’ll receive is directly related to the investments you choose. Investments with the potential for higher returns may expose you to more risk, so take this into account when making your decision.
• Have you saved enough for retirement? If you haven’t, consider contributing the maximum allowable each year to tax-advantaged retirement accounts before prepaying your mortgage. This is especially important if you are receiving a generous employer match. For example, if you save 6% of your income, an employer match of 50% of what you contribute (i.e., 3% of your income) could potentially add thousands of extra dollars to your retirement account each year. Prepaying your mortgage may not be the savviest financial move if it means forgoing that match or shortchanging your retirement fund. • How much time do you have before you reach retirement or until your children go off to college? The longer your timeframe, the more time you have to potentially grow your money by investing. Alternatively, if paying off your mortgage before reaching a financial goal will make you feel much more secure, factor that into your decision.
The middle ground
If you need to invest for an important goal, but you also want the satisfaction of paying down your mortgage, there’s no reason you can’t do both. It’s as simple as allocating part of your available cash toward one goal, and putting the rest toward the other. Even small adjustments can make a difference. While evaluating the opportunity cost is important, you’ll also need to weigh many other factors. The following list of questions may help you decide which option is best for you. • What’s your mortgage interest rate? The lower the rate on your mortgage, the greater the potential to receive a better return through investing. • Does your mortgage have a prepayment penalty? Most mortgages don’t, but check before making extra payments. • How long do you plan to stay in your home? The main benefit of prepaying your mortgage is the amount of interest you save over the long term; if you plan to move soon, there’s less value in putting more money toward your mortgage. • Will you have the discipline to invest your extra cash rather than spend it? If not, you might be better off making extra mortgage payments. • Do you have an emergency account to cover unexpected expenses? It doesn’t make sense to make extra mortgage payments now if you’ll be forced to borrow money at a higher interest rate later. And keep in mind that if your financial circumstances change--if you lose your job or suffer a disability, for example--you may have more trouble borrowing against your home equity. • How comfortable are you with debt? If you worry endlessly about it, give the emotional benefits of paying off your mortgage extra consideration. • Are you saddled with high balances on credit cards or personal loans? If so, it’s often better to pay off those debts first. The interest rate on consumer debt isn’t tax deductible, and is often far higher than either your mortgage interest rate or the rate of return you’re likely to receive on your investments. • Are you currently paying mortgage insurance? If you are, putting extra toward your mortgage until you’ve gained at least 20% equity in your home may make sense. • How will prepaying your mortgage affect your overall tax situation? For example, prepaying your mortgage (thus reducing your mortgage interest) could affect your ability to itemize deductions (this is especially true in the early years of your mortgage, when you’re likely to be paying more in interest).

For small appliances and stereos, you’ll need outdoor GFCI outlets. Consult with a professional electrician for local code requirements. Consider purchasing patio heaters or an outdoor fireplace if you plan on grilling in the chilly months.
Outdoor kitchens make life easier for those who enjoy grilling their meals and entertaining outdoors, making your deck or patio an extension of your family’s living space. It also can enhance your home’s resale value. With the proper amount of forethought and planning, you’ll be enjoying your meals in the great outdoors in no time.
For those days with inclement weather, you’ll want to get a cover for your grill. Select weatherproof materials for countertops, cabinets, and other elements of your kitchen. Stainless steel, slate, tile, stucco and stone all work well. A large tent or outdoor umbrella can cover your guests and equipment and provide shelter from the sun or rain.

Make sure there is plenty of space for people to watch without getting in the way or being too close to open flames. Typically, there should be 3 feet of space on either side of the grill for work space and food preparation.
How often will you be using your outdoor kitchen? This will determine numerous factors, including the equipment you purchase. If you will use your outdoor kitchen just in the summer, a grill with wheels can be moved into the garage and protected from the elements once the seasons change. These types of grills are the most common and come in a wide variety of sizes and prices with a range of features. If you want to use your outdoor kitchen year-round, consider a built-in grill. Look for one with side burners in the base unit that allow for cooking at different temperatures simultaneously. This base can provide extra countertop and storage space. Make sure the grill is in an area that can withstand high temperatures and is impervious to stray embers or sparks, such as a stone patio. You won’t be able to take it with you if you move, so think carefully before investing a lot of money in a permanent grill. Take into account your lighting needs. If you eat or entertain into the dark evening, you’ll want direct light for the work area so you can monitor the progress of the meat. Softer lighting works well for socializing areas.

How do I become a Spike?

Elliot Eisenberg, Ph.D. • GraphsandLaughs, LLC While Q1 GDP growth was 2.5%, it will probably be the best performing quarter of the year. Add to that continued contractionary fiscal policy in the form of both the sequester and the Fiscal Cliff deal, continued weak employment growth, declining exports and a lackluster manufacturing sector and suddenly recessionary fears are palpable. After all, a recession will inevitably come and it has been almost six years since the start of the last one. Aren’t we kind of due? Turns out, the answer is no, no and no! If history is any guide - and it’s a very good one in this case - there is no recession in sight. Since 1970 there have been seven recessions, and interestingly enough, each one has been preceded by an inversion in the yield curve, a situation where short term interest rates are higher than long term interest rates. Rarely is there an indicator that is seven for seven over a period of 44 very dissimilar years. The last time the yield curve inverted and a recession did not follow was in 1966-67, and though there wasn’t a recession, the economy slowed substantially with GDP growth of less than 1% for 21 straight months. Normally, interest rates are higher the longer the period of time money is lent. For example, today a one-year Treasury bill yields 0.15%/year, a 10-year Treasury note pays 2%/year and a 30-year Treasury bond pays 3.125%/year. After all, the longer you lend someone money, in this case the government, the more interest rate risk, inflation risk and credit risk you incur, and investors must be compensated for these risks. However, from time to time this normal relationship breaks down.
One explanation for this phenomenon is that by raising short-term rates (to slowdown an overheating economy with rising inflation), the Federal Reserve discourages bank lending, as banks generally borrow short and lend long. And when the yield curve is inverted, banks have much-reduced profit margins, and this reduction in lending causes a recession. A second explanation for an inverted yield curve is that investors expect future short-term interest rates to decline because they expect a recession. As a result, investors expect the central bank to lower interest rates to counteract the expected recession. And when this happens, investors plow into low-yielding long-bonds to lock in yields they expect will be still lower in the future. Regardless of the reason, from time-to-time the yield curve inverts. Today, the difference between ten-year Treasury notes and oneyear Treasury bills is 1.85%. Assuming the Federal Reserve felt compelled to start raising short-term interest rates soon (and let’s be clear, it does not), it would take, based on history, about two years before yields on one-year Treasury bills were higher than yields on 10-year Treasury notes. And again using history as our guide, it generally takes another 12 months after the yield curve inverts before a recession begins. This suggests that we have at minimum three years before the next recession. Of course, given the expansionary state of monetary policy and the laser-like focus of the Fed in preventing a recession, my bet is we have quite some time before the recession of 2018! Improving Markets List Includes 258 Metros in May Lincoln Included in List for Last 18 Months
WASHINGTON, May 6 – The number of U.S. housing markets showing sustained improvement in three key measures fell slightly to 258 in May from 273 in April, according to the NAHB/ First American Improving Markets Index (IMI), released today. This total includes entrants from all 50 states and the District of Columbia. The IMI identifies metropolitan areas that have shown improvement from their respective troughs in housing permits, employment and house prices for at least six consecutive months. Four new markets were added to the list and 19 were dropped from it this month. Newcomers included the geographically diverse metros of Dothan, Ala.; Elizabethtown, Ky.; Salisbury, Md.; and Salem, Ore. “The fact that over 70 percent of all U.S. metros are holding onto their spots on the improving list is definitely good news, and representative of the generally brightening outlook for housing markets nationwide,” said NAHB Chairman Rick Judson, a home builder from Charlotte, N.C. “That said, our industry’s progress on the road to recovery is being slowed by rising challenges related to the availability of credit, building materials, labor and lots for development.” “While seasonal trends in home prices resulted in an overall decline in the IMI this month, the index remains at a very strong level and continues to represent markets in every state,” noted NAHB Chief Economist David Crowe. “Some metropolitan areas that had
previously charted marginal home-price gains dropped off the list this time as a result of typically softer prices seen in the winter months, which is similar to what the index showed in this same period last year.” “Today’s report shows that the majority of U.S. metros are experiencing strengthening house prices, employment and permitting activity, which is a much more positive picture than the one we were seeing a year ago,” observed Kurt Pfotenhauer, vice chairman of First American Title Insurance Company. “That’s the big picture on which consumers need to focus.” The IMI is designed to track housing markets throughout the country that are showing signs of improving economic health. The index measures three sets of independent monthly data to get a mark on the top Metropolitan Statistical Areas. The three indicators that are analyzed are employment growth from the Bureau of Labor Statistics, house price appreciation from Freddie Mac and single-family housing permit growth from the U.S. Census Bureau. NAHB uses the latest available data from these sources to generate a list of improving markets. A metro area must see improvement in all three measures for at least six consecutive months following those measures’ respective troughs before being included on the improving markets list.
